Statement of Principles concerning acute meniscal tear of the knee (Reasonable Hypothesis) (No. 25 of 2019)

The instrument builds around a small set of core legal and medical concepts that determine its application in claims.

Acute meniscal tear of the knee , defined (section 7(2)) as a meniscal tear causing a sudden onset of pain and tenderness and excluding chronic tear and degenerative disease. The instrument provides a clinical note that acute tears may be accompanied by certain signs (pain with twisting/pivoting, swelling, locking, loss of function) occurring within 24 hours of the injury (note to section 7(2)). The statutory definition supersedes mere reliance on the ICD‑10‑AM code: section 7(3) says the meaning is the one given in subsection 7(2), although the code S83.2 is referenced and the ICD‑10‑AM edition cited in section 7(4).

Reasonable hypothesis threshold , the SoP sets out the factors which “must as a minimum exist before it can be said that a reasonable hypothesis has been raised connecting acute meniscal tear of the knee or death from acute meniscal tear of the knee with the circumstances of a person's relevant service” (section 9). This is an evidentiary threshold used in claim assessment; the instrument does not itself determine entitlement but provides the medical basis for raising the reasonable hypothesis.

Specified factors , the SoP lists two alternative factors (section 9):

1. significant physical force applied to or through the affected knee joint at the time of clinical onset (section 9(1)); or
2. inability to obtain appropriate clinical management for the acute meniscal tear (section 9(2)).

Relationship to relevant service , the instrument requires that any factor relied upon be related to the person’s relevant service (section 10(1)). The Schedule defines “relevant service” to include specific categories under the VEA (operational, peacekeeping, hazardous, British nuclear test defence service) and the MRCA (warlike and non-warlike service) (Schedule 1).

Temporal and causal limits , section 10(2) places a temporal and causal limit on the second factor (inability to obtain appropriate clinical management): it applies only to material contribution to or aggravation of acute meniscal tear where the person’s acute meniscal tear was suffered or contracted before or during (but did not arise out of) the person’s relevant service. That language introduces a distinct pathway for claims where the condition pre-existed or was contracted before/during service but not caused by service itself; the inability to obtain management during service may then be relevant.

Cross-SoP referrals , section 11 provides that if a factor in section 9 refers to an injury or disease already covered by another SoP determined under subsection 196B(2) of the VEA, then the factors in that other SoP apply as in force from time to time. This creates a modular application where multiple SoPs may be engaged for overlapping conditions or causal chains.

Death and terminal events , death is included where the acute meniscal tear contributed to a terminal event; Schedule 1 defines terminal event with examples including pneumonia, respiratory failure, cardiac arrest, circulatory failure, and cessation of brain function (section 7(5) and Schedule 1).

Authority and evidentiary claim , section 8 is the Authority’s declaration that it has sound medical‑scientific evidence supporting the causal link between condition/death and relevant service. The instrument is therefore presented as grounded in the Authority’s medical judgment, and is intended to be the operative medical-scientific template for claim assessment under the cited provisions.

This Statement of Principles affects three groups directly and several others indirectly through the claims process and evidentiary requirements.

Primary groups directly affected

• Persons making claims under the Veterans' Entitlements Act 1986 (VEA) where section 120A applies, and persons making claims under the Military Rehabilitation and Compensation Act 2004 (MRCA) where section 338 applies, since the instrument expressly applies to claims to which those sections apply (section 5). The instrument therefore engages veterans, former members of the Forces, and potentially serving members seeking entitlements covered by those provisions.
• Decision-makers who assess those claims must take this SoP into account as the medical-scientific framework for whether a reasonable hypothesis exists that links the condition to relevant service. The instrument does not name a decision-maker, but its application is limited to the specified claim provisions (section 5).

Secondary and indirect stakeholders

• Medical practitioners and experts who provide opinions for claims, because the SoP defines the clinical definition of “acute meniscal tear” for the purposes of the claims process (section 7), and specifies the particular factors and their temporal relationship to service that raise the reasonable hypothesis (sections 9-10). Their clinical reports will need to address those definitions and factors to be useful in claim assessment.
• Administrative bodies or insurers operating under the VEA or MRCA framework, insofar as they adjudicate or administer entitlements for which the SoP supplies the medical-causation template.
• Parties or processes invoking other Statements of Principles, because section 11 requires cross-application where a factor refers to an injury or disease covered by another SoP.

Who is not covered or whose claims are excluded

• Persons whose knee pathology is purely chronic or degenerative meniscal disease are excluded by the express definition: the SoP excludes “chronic tear and degenerative disease of the meniscus” (section 7(2)(b)). That exclusion shifts the evidentiary focus to acute presentations with sudden onset.
• Claims that are not within the scope of the cited sections (s120A VEA or s338 MRCA) are outside the instrument’s stated application, and the SoP does not purport to govern such claims (section 5).

Geographic and service-type coverage

• The Schedule defines “relevant service” in categories that include operational, peacekeeping, hazardous, British nuclear test defence service (under the VEA), and warlike or non‑warlike service (under the MRCA) (Schedule 1). Therefore, the instrument affects claimants whose service falls within those categories; the SoP’s applicability depends on whether a person’s service qualifies as “relevant service” under the Schedule.

Administrative effect on behaviour

• Claimants and their advisers will need to collect evidence demonstrating one of the section 9 factors and its relationship to relevant service (sections 9-10). Medical practitioners asked to provide evidence will need to address timing of clinical onset, the mechanism of injury (significant physical force), or circumstances around access to appropriate clinical management during or before/during service (section 9; section 10(2)). The instrument therefore shapes what clinical and service documentation will be relevant and required for a successful application of the reasonable hypothesis threshold.

The instrument does not create new criminal offences, fines, or regulatory licences. Instead, it establishes evidential duties and rights relevant to the administrative claims process governed by the VEA and MRCA.

Duties created or clarified by the SoP

• Duty to establish at least one of the specified factors to raise the reasonable hypothesis: A claimant (or the evidence they present) must show that at least one of the two factors in section 9 exists before it can be said that a reasonable hypothesis has been raised connecting an acute meniscal tear or death from it with relevant service (section 9). The SoP therefore imposes an evidentiary duty on claimants to address those factors in their supporting material.
• Duty to connect the factor to relevant service: Any factor relied upon must be related to the person’s relevant service (section 10(1)). In practice, this requires evidence linking the factor (for example, a documented incident involving force, or documented inability to access care while on service) to the period and circumstances of relevant service.
• Duty to observe the temporal limitation for inability to obtain appropriate management: Section 10(2) restricts the application of section 9(2) (inability to obtain appropriate clinical management) to cases where the acute meniscal tear was suffered or contracted before or during, but did not arise out of, relevant service. This creates an evidentiary and causal nuance: where the tear arose out of relevant service, inability to obtain management during service may not operate under section 9(2) as a separate factor.

Rights or entitlements affected

• Right to have a claim assessed using the medical template supplied by the SoP: Because the instrument applies to claims to which specified sections of the VEA and MRCA apply (section 5), claimants under those provisions have their cases assessed using this SoP as the medical-causation framework. The SoP defines what is sufficient, at a minimum, to raise a reasonable hypothesis linking the condition to service.
• Right to rely on other SoPs where factors overlap: Section 11 gives claimants and decision-makers a right to apply the factors in other SoPs if a section 9 factor refers to an injury or disease covered by another SoP. That creates a procedural right to import the content of other SoPs “as in force from time to time” where relevant.

Operational duties on decision-makers and experts

• Duty to apply the SoP’s definition of the condition: The instrument requires the use of the statutory definition for assessment purposes (section 7(2)-(4)). Medical experts and decision-makers are therefore required to align clinical descriptions with the SoP’s definition rather than only ICD‑10‑AM coding.
• Duty to consider cross-SoP interactions: Where a factor references another injury/disease covered by an SoP, decision-makers must incorporate that other SoP’s factors as they stand at the time of assessment (section 11).

Absence of civil or criminal sanctioning duties

• The SoP does not impose enforcement duties or penalties within its text. There are no offence provisions, monetary penalties, or specified compliance sanctions in the instrument itself. Its effect is evidentiary and administrative within the claims framework rather than punitive.

Practical implication of duties and rights

• These duties shift the evidentiary burden onto claimants to adduce records or testimony that speak to the specified factors and their connection to relevant service. Medical reporting and service documentation must therefore be tailored to the SoP’s language (sections 7-11). Decision-makers are obliged to use the SoP as the operative medical template when assessing whether a reasonable hypothesis exists in claims under the cited provisions (section 5).

The instrument contains no express penalty, offence, or enforcement regime. It is a Statement of Principles intended to be used as the medical-scientific basis for determining whether a reasonable hypothesis exists that links acute meniscal tear of the knee (or death from it) to relevant service in claims under section 120A of the VEA or section 338 of the MRCA (section 5). It therefore functions as an evidentiary and administrative tool rather than as a regulatory instrument that prescribes sanctions.

Consequences in administrative decision-making

• The practical “enforcement” effect of the SoP operates through the claims-adjudication process governed by the VEA and MRCA. If a claimant can establish that at least one of the factors in section 9 exists and that the factor is related to relevant service (section 10(1)), then, by the SoP’s own terms, a reasonable hypothesis has been raised (section 9). That evidentiary threshold is a prerequisite within the adjudicative machinery for certain administrative findings; the SoP itself, however, does not specify what administrative outcome follows from a reasonable hypothesis, nor does it specify penalties for failure to establish a factor.

No criminal or civil penalties in the text

• The instrument does not create criminal offences, fines, or disciplinary powers against individuals or organisations. There is no statutory enforcement mechanism embedded in the instrument itself; rather, its binding effect is as an authoritative statement by the Repatriation Medical Authority about the medical‑scientific evidence relevant to specific claims.

Agency discretion and implementation

• The practical application and “enforcement” of the SoP will rest with the agencies and decision-makers administering the VEA and MRCA claims processes, who will use the SoP to determine whether the relevant evidentiary threshold is met. The instrument does not delineate the scope of agency discretion in applying the SoP (for example, the weight to be given to particular kinds of evidence), nor does it prescribe procedural rules for how decision-makers must record or disclose their application of the SoP.

Evidence and proof dynamics

• Because the SoP defines the minimum factors that must exist to raise a reasonable hypothesis (section 9), failure to adduce evidence meeting these factors will, in practical terms, make it harder for a claimant to satisfy the reasonable hypothesis test relied upon in claims. Conversely, establishing a factor, and showing it relates to relevant service, will be the route by which a claimant can advance beyond that evidentiary threshold. These evidentiary dynamics function as the instrument’s practical enforcement mechanism within administrative decision-making, even though there is no statutory sanction or penalty for non-compliance with the SoP itself.

Relevance of repeal

• The instrument repeals the previous SoP (No. 55 of 2010) (section 4). That repeal means that from commencement all relevant claims and assessments will use the current SoP as the operative medical template; any administrative “enforcement” of prior standards ceases as the older SoP is removed. The instrument does not provide transitional penalty or enforcement provisions; assessment practice must simply follow the in-force SoP.

The instrument situates itself within the statutory claims frameworks of the VEA and the MRCA by explicit reference to the sections under which it applies and by its mechanism as a Statement of Principles.

Statutory authority and application

• The SoP is made under subsection 196B(2) of the VEA (section 3). Its stated application is to claims “to which section 120A of the VEA or section 338 of the MRCA applies” (section 5). The instrument therefore interacts directly with the statutory provisions cited by serving as the medical-causation template that claim assessors will apply when those provisions are engaged.

Operational effect on claim assessment

• Where a claim falls within the cited statutory provisions, the SoP supplies the minimum factors that must exist to raise a reasonable hypothesis linking acute meniscal tear (or related death) to relevant service (section 9). That shapes the operation of the VEA/MRCA claims processes because decision-makers and medical assessors will rely on the SoP’s definitions and factors when making causal findings in respect of such claims. The instrument does not modify the substantive entitlements in the VEA or MRCA but provides the medical evidence framework used in causation assessment.

Cross-references to other Statements of Principles

• Section 11 creates a direct textual link between this SoP and other SoPs made under subsection 196B(2) of the VEA. If a factor in section 9 refers to an injury or disease already covered by another SoP, then the factors in that other SoP “apply in accordance with the terms of that Statement of Principles as in force from time to time” (section 11). This mechanism creates layered interaction: claims involving multiple injuries or causal chains will require coordinated application of two or more SoPs, with each applied according to its current wording.

Definition-driven interaction

• The Schedule supplies definitional connections to the VEA and MRCA through the Schedule’s definitions of MRCA and VEA and the definition of “relevant service” (Schedule 1). For example, “relevant service” is defined by reference to specific categories under both statutes (operational, peacekeeping, hazardous, British nuclear test defence service under the VEA; warlike and non-warlike service under the MRCA). The SoP therefore interacts with the statutory definitions of service types when determining whether a claimant’s service meets the “relevant service” test embedded in this instrument (Schedule 1; section 10(1)).

Coding and international classifications

• The instrument cites ICD‑10‑AM code S83.2 for acute meniscal tear (section 7(3)-(4)) and specifies the edition and effective date of the ICD‑10‑AM text it references (Tenth Edition, effective date 1 July 2017). The SoP thus interacts with medical classification systems used in clinical and hospital coding, but it makes clear that the statutory definition in the SoP governs application rather than the code alone (section 7(3)).

Temporal and causal delimiters relative to service law

• Section 10(2) places a specific causal and temporal condition on the applicability of the “inability to obtain appropriate clinical management” factor: it applies only where the tear was suffered or contracted before or during, but did not arise out of, relevant service. This interacts with the legal distinction between conditions that arise out of service and those aggravated during service. The SoP assigns a role to the inability to obtain management only in the limited factual circumstances specified, and therefore interacts with the statutory allocation of causation and aggravation under the VEA/MRCA frameworks.

Absence of express modification to entitlements

• The instrument does not purport to change substantive entitlements under the VEA or MRCA; it provides a medical-causation framework used to establish the reasonable hypothesis that will be applied within those statutory schemes. Any interaction with rights to compensation, rehabilitation, or other outcomes under the VEA/MRCA is through the established claim-adjudication pathways that use the SoP as medical evidence, rather than through changes in those statutes’ substantive provisions.

This instrument replaces and repeals the prior Statement of Principles concerning acute meniscal tear of the knee No. 55 of 2010 (Federal Register No. F2010L01668) (section 4). The instrument itself is numbered No. 25 of 2019 and is dated 1 March 2019, with commencement on 25 March 2019 (sections 1-3). Those are the only amendments or historical elements recorded within the instrument text.

Specific steps reflected in the instrument

• Repeal of earlier instrument (section 4): The instrument expressly removes the 2010 SoP for acute meniscal tear of the knee. The repeal is absolute in form , there are no transitional provisions or savings clauses provided in the text. From the commencement date (25 March 2019), the 2019 SoP is the operative Statement of Principles on this subject.
• New authoritative view (section 8): The Repatriation Medical Authority states it is of the view that there is sound medical‑scientific evidence indicating a relationship between acute meniscal tear (and death from it) and relevant service. This declaration constitutes the Authority’s medical-scientific basis for making the 2019 instrument and can be read as replacing the prior medical view underpinning the 2010 instrument.

No further legislative amendments recorded in the text

• The instrument contains no subsequent amendment history, savings, or transitional arrangements within its text. It does not record any earlier or later amendments beyond the stated repeal of the 2010 SoP and its own commencement. There is no mention of amendments to the VEA or MRCA themselves; the instrument exists as a subordinate instrument made under the VEA’s subsection 196B(2).

Implication for records and practice

• The repeal of the 2010 instrument means that any reference to the earlier SoP in records or decision practice should be updated to reflect that the 2019 SoP is in force as of 25 March 2019. Practitioners and decision-makers will need to apply the current text when assessing claims arising on or after commencement, and should be careful that the definitions and factors in the 2019 instrument (for example, the express exclusion of chronic or degenerative meniscal disease (section 7(2)(b))) govern the evidentiary assessment.

No internal amendment logs or versions within the instrument

• The instrument itself does not contain a history of prior drafts, submissions, or incremental amendments. The only recorded change is the repeal of the 2010 instrument and the establishment of the 2019 instrument as the operative SoP. Any further amendments would appear as separate instruments or legislative updates and are not recorded in the text provided.

The instrument contains no litigation history, case citations, or judicial interpretations within its text. It is a Statement of Principles issued by the Repatriation Medical Authority under statutory power (subsection 196B(2) of the VEA) and does not purport to record judicial consideration, appeals, or precedent.

Practical consequences of the absence of litigation history in the text

• Practitioners cannot rely on this instrument alone to identify any judicial rulings that interpret or apply its terms since none are recited here. Any litigation or administrative appeals that address the SoP’s application, threshold, or interaction with the VEA or MRCA will be found outside this instrument in decision records, case law, or tribunal determinations, none of which are included in the document.
• Because the instrument provides the Repatriation Medical Authority’s medical‑scientific conclusions and the factors which, if met, raise a reasonable hypothesis (sections 8-9), the absence of judicial commentary in the instrument does not inhibit administrative decision-makers from applying it. However, lawyers and advocates will need to seek external sources (administrative decisions, tribunal outcomes, or judicial reviews) to assess how courts or tribunals have applied or tested the SoP in disputed cases.

What to expect in subsequent litigation

• If a claimant’s case proceeds to internal review, tribunal hearing, or judicial review, those decisions may test how decision-makers applied the SoP’s factors (for example, whether section 9’s factors were properly taken into account, or whether section 10(2)’s limitation was correctly applied). The instrument itself contains no guidance on how such disputes have been resolved, the weight courts give to the Authority’s declarations, or procedural matters that emerge in litigation.

Interim reliance on the SoP in the absence of litigation history

• Administrative bodies assessing claims will apply the SoP as the operative medical template; claimants and advisers should therefore prepare cases in strict accordance with the SoP’s language (definitions, factors, linkage to relevant service) and anticipate that any legal challenge to a decision based on the SoP will have to engage with external adjudicative or judicial materials, which are not provided in the instrument.

The text of the SoP contains several points that commonly produce misunderstanding or evidentiary pitfalls. Practitioners should note these precise textual features.

Narrow substantive definition , exclusion of chronic and degenerative disease

• The SoP’s operative definition excludes “chronic tear and degenerative disease of the meniscus” (section 7(2)(b)). Cases described in clinical or hospital coding as meniscal pathology driven by degeneration will not fall within the SoP’s definition of “acute meniscal tear” even if an ICD‑10‑AM code S83.2 is recorded. The SoP’s note that acute meniscal tear is associated with symptoms within 24 hours of injury should be closely heeded (note to section 7(2)).

ICD‑10‑AM code is not determinative

• Although the instrument notes that the condition attracts ICD‑10‑AM code S83.2, it expressly states that the meaning of acute meniscal tear for the purposes of the SoP is the statutory definition in subsection 7(2) (section 7(3)). Reliance solely on diagnostic coding without evidence addressing the SoP definition (sudden onset, exclusion of degenerative disease) risks failure to meet the minimum evidentiary standard.

Timing and “clinical onset” matters for the force factor

• The first enumerated factor requires “significant physical force applied to or through the affected knee joint at the time of the clinical onset of acute meniscal tear of the knee” (section 9(1)). The draftsmanship links the force to the clinical onset moment. Evidence that an incident occurred at some time remote from clinical onset may not satisfy this factor; contemporaneous records linking the incident to immediate onset are the relevant evidentiary focus.

Ambiguity and evidentiary difficulty on “significant physical force”

• The term “significant physical force” is not quantitatively defined in the instrument. Practitioners must therefore supply factual and clinical evidence that allows decision-makers to infer that the physical force was sufficient to cause a sudden tearing injury at the time of clinical onset (section 9(1)). Absent clear documentary or clinical evidence, establishing this factor may be contested.

Narrow scope for inability to obtain clinical management

• Section 9(2) permits inability to obtain appropriate clinical management to be a factor, but section 10(2) restricts its application to cases where the acute meniscal tear was suffered or contracted before or during (but did not arise out of) the person’s relevant service. That means inability to obtain management will not generally operate as a factor where the tear itself arose out of service; it is tailored to situations of pre-existing conditions materially contributed to or aggravated by lack of care. Practitioners must therefore ensure the factual matrix fits the section 10(2) limitation before relying on section 9(2).

Cross-SoP referrals can complicate causation chains

• Section 11 says that where a factor in section 9 refers to an injury or disease covered by another SoP, the other SoP’s factors will apply “as in force from time to time.” This means claimants may need to deploy evidence relevant to multiple SoPs, and that subsequent amendments to other SoPs could alter the applicable factors. Practitioners should check the current versions of any referenced SoPs and be prepared to marshal evidence across different instruments.

Death link requires causative contribution to terminal event

• For death to be treated as included under this SoP, the acute meniscal tear must have “contributed to” a terminal event or condition (section 7(5)). The Schedule supplies examples of terminal events (pneumonia, respiratory failure, cardiac arrest, circulatory failure, cessation of brain function). Establishing a causal link between a knee meniscal tear and such terminal events may be factually challenging; claimants must be prepared to develop clinical causal narratives and evidence showing contribution rather than mere temporal association.

Relevance of “relevant service” categories

• The Schedule’s definition of “relevant service” is specific (operational, peacekeeping, hazardous, British nuclear test defence service under the VEA; warlike and non-warlike under the MRCA). Whether a person’s service meets one of these categories will determine the instrument’s applicability (Schedule 1). Failure to establish that the service qualifies as relevant service may be dispositive.

No transitional or savings provisions for the repeal

• The instrument repeals the 2010 SoP without expressing transitional rules (section 4). For claims straddling the repeal and commencement dates, practitioners should be attentive to which SoP is operative for the relevant assessment periods; the instrument does not itself resolve such transitional questions.

No internal guidance on evidential weight or thresholds

• The SoP specifies the factors that must exist to raise the reasonable hypothesis (section 9) but does not set out the standard of proof for later entitlement decisions, nor does it direct the weight decision-makers must afford different types of evidence. Practitioners cannot rely on the SoP alone to predict how an adjudicator will weigh competing medical opinions.

To work effectively with this Statement of Principles, practitioners and claimants should prepare evidence and submissions that directly map to the SoP’s language and constraints. The SoP establishes an evidentiary template: show that at least one factor in section 9 exists, and that the factor is related to the person’s relevant service (sections 9-10). Below are practical steps and focused evidential priorities.

1. Confirm applicability

• Establish that the claim is one “to which section 120A of the VEA or section 338 of the MRCA applies” (section 5). If the claim does not fall under those sections, the SoP does not apply.
• Confirm that the person’s service meets the Schedule’s definition of “relevant service” (Schedule 1). Identify which category applies (operational, peacekeeping, hazardous, British nuclear test defence service, warlike, non-warlike).

2. Align the medical diagnosis with the statutory definition

• Ensure medical records and expert reports describe the condition in terms used by subsection 7(2): tearing of a meniscus resulting in sudden onset of pain and tenderness, and explicitly exclude chronic or degenerative aetiology if appropriate (section 7(2)). Address the 24‑hour onset note where relevant (note to section 7(2)).
• Do not rely solely on ICD‑10‑AM coding. Although the code S83.2 is referenced (section 7(3)), the operative meaning for claims is the statutory definition. Have clinicians opine on whether the presentation meets that statutory definition.

3. Tailor evidence to the section 9 factors

• For section 9(1) (significant physical force at clinical onset):

  • Obtain contemporaneous service records, incident reports, or witness statements documenting a specific traumatic event and the timing of clinical onset.
  • Obtain emergency department notes, immediate clinical assessments, imaging (MRI, arthroscopy reports), or surgical notes that link the reported incident to sudden meniscal tear findings.
  • Ensure clinicians address the causal link between the described force and the sudden onset tear in clear medical terms.

• For section 9(2) (inability to obtain appropriate clinical management):

  • Collect evidence that clinical management was not available or was inaccessible in the relevant service setting (medical service records, contemporaneous logs, directives, clinic absence reports).
  • Remember section 10(2): this factor applies only where the tear was suffered or contracted before or during, but did not arise out of, relevant service. Thus, document the pre-existence or timing of the tear relative to service and explain why it did not arise out of the service itself.

4. Establish linkage to relevant service

• Prepare a narrative that connects the factor(s) to the relevant service period and circumstances (section 10(1)). That includes mapping dates, locations of service, and how the factor materialised in the context of service.
• If relying on section 9(2), ensure the narrative explains how inability to obtain care during service materially contributed to or aggravated the condition.

5. If other SoPs are triggered, gather relevant materials

• Under section 11, if a section 9 factor refers to an injury or disease covered by another SoP, practitioners must identify and apply that other SoP’s factors “as in force from time to time.” Locate and address any cross-referenced SoPs and obtain evidence necessary under those instruments.

6. Address death cases carefully

• If the claim concerns death, ensure medical evidence links the acute meniscal tear to a terminal event in the sense of section 7(5) and Schedule‑defined terminal events. Prepare clinical cause-of-death documentation and expert opinions that explain how the meniscal tear contributed to the terminal event.

7. Prepare for absence of numerical thresholds

• The SoP does not quantify “significant force” or prescribe evidentiary weights. Provide corroborating documentation (imaging, operative findings, contemporaneous clinician notes) to support the clinical plausibility of causation, and have experts articulate the mechanism in clear causal terms.

8. Record and present contemporaneous medical and service documentation

• Because the instrument emphasises timing (sudden onset, clinical onset, before/during service), contemporaneous records will be particularly persuasive. Prioritise records made at the time of the incident, early clinical assessments, and service medical logs.

9. Anticipate cross-checks with decision-makers

• Decision-makers applying the VEA/MRCA processes will use the SoP as the medical-templating instrument. Structure submissions so that each element of section 9 is addressed expressly, with a brief legal-technical map that references the specific SoP section being satisfied.

10. Keep the definitions and limitations in sight

• Be attentive to the SoP’s exclusions (e.g., degenerative disease excluded, section 7(2)(b)) and temporal limits (section 10(2)). Avoid conflating aggravation of degenerative disease with an acute tear unless clinical evidence distinguishes the phenomena in accordance with the SoP’s wording.

By focusing evidence and expert opinion narrowly on the statutory definitions and the two factors in section 9, and by establishing the required link to relevant service under section 10(1) (and, where applicable, the section 10(2) limitation), claimants and advisers will align submissions with the instrument’s operative structure. The RMA’s declared medical‑scientific view (section 8) supports the SoP as the governing framework for claims under the cited statutory provisions (section 5), so compliance requires meticulous mapping of factual and medical evidence to the SoP language.
