Statement of Principles concerning acute meniscal tear of the knee (Balance of Probabilities) (No. 26 of 2019)

The SOP focuses on a narrow medical concept: acute meniscal tear of the knee, defined by clinical features rather than solely by an ICD code (section 7(2)-(4)). The RMA gives a working statutory definition: an injury causing tearing of a meniscus of the knee joint that results in a sudden onset of pain and tenderness, excluding chronic tear and degenerative meniscal disease (section 7(2)(a)-(b)). The instrument notes typical associated signs or symptoms that may occur within 24 hours of the injury: pain worsened by twisting/pivoting movements, swelling, locking, or loss of functional ability (note to section 7(2)).

Central legal-medical concepts in the SOP are:

• Balance of probabilities causation standard: the instrument is determined under the legislative test set out in the VEA procedure (title and section 8), and the RMA states that, on the sound medical‑scientific evidence available, it is of the view that it is more probable than not that the condition can be related to relevant service (section 8). The SOP itself lists the factors which, if established on that standard, will satisfy the causation requirement for the specified claims (section 9).

• Specified causation factors: the SOP requires at least one of two factors to be established: (1) significant physical force applied to or through the affected knee joint at the time of clinical onset; or (2) inability to obtain appropriate clinical management for the condition (section 9(1)-(2)). The instrument treats the factors as alternative routes to establishing a link to service, not cumulative prerequisites (section 9 introductory wording).

• Relationship to relevant service: factors must be related to the person’s relevant service as defined in Schedule 1 (section 10(1)). The concept “relevant service” is itself defined in the Schedule and is limited to specified kinds of service (Schedule 1: eligible war service other than operational service; defence service other than hazardous service and British nuclear test defence service; and peacetime service under the MRCA).

• Scope limitation for clinical‑management factor: the inability-to-obtain-appropriate-management factor operates only in limited circumstances , where the acute meniscal tear was suffered or contracted before or during (but did not arise out of) relevant service, and where lack of appropriate management materially contributed to or aggravated the condition (section 10(2)). That means the clinical‑management pathway is not a free‑standing ground for claims that arise out of service events.

• Interaction with other SOPs: when a factor in this SOP refers to an injury or disease covered by another SOP, the terms of the other SOP apply in accordance with section 11. This is an explicit mechanism to coordinate overlapping SOPs.

Ancillary references: the SOP mentions the ICD‑10‑AM code S83.2 as the code attracting acute meniscal tear of the knee, but clarifies that the meaning of the condition for the SOP is given by the instrument’s own definition rather than the code (section 7(3)-(4)). Death from the condition is included where death resulted from a terminal event or condition that was contributed to by the acute meniscal tear (section 7(5)), and “terminal event” is defined in the Schedule to include specific proximate or ultimate causes such as pneumonia, respiratory failure, cardiac arrest, circulatory failure or cessation of brain function (Schedule 1).

These are the primary legal‑medical concepts that decision makers, claimants and advisers must work with when this SOP is engaged in a claim under the statutory provisions identified by section 5.

The SOP applies to persons presenting claims that fall within the identified statutory gateways: claims to which section 120B of the VEA or section 339 of the MRCA apply (section 5). The instrument therefore affects:

• Veterans and former members who are seeking a service‑connection decision under the VEA provisions indicated (section 5). The Schedule defines the kinds of VEA “relevant service” that can be relied on: eligible war service other than operational service, and defence service other than hazardous service and British nuclear test defence service (Schedule 1).

• Members and former members whose claims fall under the MRCA provision identified (section 5). The Schedule defines the MRCA reference for the SOP and identifies “peacetime service under the MRCA” as relevant service for its purposes (Schedule 1).

Consequently, the population materially affected is the subset of claimants who: (a) allege acute meniscal tear of the knee or death from it; and (b) have the type of relevant service specified in the Schedule (section 7, section 5, Schedule 1). The SOP’s exclusions are also relevant to who is affected: chronic tear and degenerative disease of the meniscus are expressly excluded from the SOP’s definition of acute meniscal tear (section 7(2)(b)). That exclusion narrows the covered claimant pool by purposefully omitting degenerative presentations.

Decision makers and administrators within the Department and rehabilitation/compensation systems are affected in their adjudicatory function: the SOP prescribes the medical factors that will be used to satisfy causation on the balance of probabilities for the conditions specified (sections 8-10). Where a factor refers to another SOP’s injury or disease, decision makers must give effect to that other SOP’s factors in accordance with section 11.

Medical practitioners and treating clinicians are affected indirectly because the SOP specifies the kinds of clinical evidence that will be relevant to proving one of the listed factors. For example, documentation of a sudden onset of pain and tenderness, objective signs within 24 hours, or records demonstrating inability to access appropriate clinical management are the sorts of records that will bear on the SOP’s factors (note to section 7(2); section 9(2)).

Estate representatives and coroners may also be affected where a claim involves death from an acute meniscal tear: the SOP includes death from the condition where it contributed to a terminal event, and it specifies examples of terminal events in the Schedule (section 7(5); Schedule 1). The instrument therefore has evidential implications for proving that death was contributed to by the meniscal tear.

Finally, practitioners advising claimants need to take into account the relationship requirement (section 10(1)) and the restricted operation of the clinical‑management factor (section 10(2)) in constructing evidentiary strategies.

This SOP does not create prescriptive duties in the sense of obligations on private parties to act; rather, it creates legalised evidentiary thresholds and definitional rules that have rights‑effect in the statutory adjudication process governed by the VEA and MRCA. From the text, the critical operational duties and rights are:

• Duty of decision makers to apply the SOP as the causation template in claims within its application: the instrument is made under subsection 196B(3) of the VEA and applies to claims under specified provisions of the VEA and MRCA (sections 3 and 5). That gives decision makers a duty to use the SOP’s factors when considering whether, on the balance of probabilities, the injury or death is connected with relevant service (sections 8 and 9).

• Right of claimants to rely on the factors identified: claimants have the right to rely on either of the two alternative factors set out in section 9 to establish service connection on the balance of probabilities. Demonstration of at least one of the listed factors, and its relation to relevant service (section 10(1)), is the pathway to acceptance under the SOP.

• Duty to limit the clinical‑management pathway: decision makers are required to apply the restriction in section 10(2). The inability to obtain appropriate clinical management factor applies only to material contribution to, or aggravation of, an injury that was suffered or contracted before or during (but did not arise out of) relevant service. That imposes a structural duty to exclude the clinical‑management factor from claims where the injury arose out of service events.

• Duty to respect inter‑SOP references: where a factor in section 9 refers to an injury or disease that is already the subject of a different SOP, the decision maker must apply the factors in that other SOP according to its terms (section 11). This creates an obligation to use the content of other SOPs where relevant.

• Right to have the RMA’s evidential view recorded: section 8 records the RMA’s view that, on the sound medical‑scientific evidence available, it is more probable than not that the condition can be related to relevant service. That statement, as part of the instrument, operates as the RMA’s authoritative medical position for adjudicators applying the causation test.

• Right to have the SOP‑defined meaning prevail over ICD coding: although the instrument notes the ICD‑10‑AM code that corresponds to acute meniscal tear of the knee, it explicitly states that the meaning of the condition for this SOP is that given in subsection 7(2) (section 7(3)). So claimants and decision makers must use the instrument’s definition rather than an ICD code alone.

There are no duties on private practitioners or claimants to provide particular documentation imposed by the SOP itself; however, in practice the SOP’s factors create evidentiary expectations (e.g. records of force applied at the time of clinical onset; medical records documenting inability to obtain appropriate clinical management). The instrument does not create criminal or civil penalties; it is an evidentiary instrument used in statutory decision making (no penalty provisions appear in the text).

This Statement of Principles does not create or prescribe penalties. The instrument is silent on any enforcement mechanisms, fines, sanctions or criminal provisions. Its purpose is evidentiary and determinative within the VEA/MRCA claim processes: it sets medical causation factors to be applied when deciding whether acute meniscal tear of the knee, or death from it, is connected with relevant service (sections 5, 8 and 9). Enforcement, therefore, occurs indirectly through the statutory decision‑making processes under the VEA and MRCA that apply this SOP; the instrument itself contains no enforcement regime.

Operationally, the way the SOP is enforced is by its use as the RMA’s determinative statement of medical factors for the specified condition. Decision makers assessing claims that fall under the VEA and MRCA provisions referenced must apply the SOP’s factors when evaluating causation (sections 5 and 9). If a decision maker departs from the SOP, the consequences are procedural or judicial review pathways available under the VEA/MRCA and general administrative law, not penalties prescribed in this instrument. The SOP does not specify those review or appeal routes; it merely provides the causation framework.

Because the SOP prescribes factors to be proved on the balance of probabilities, "enforcement" in the practical sense consists of acceptance or rejection of claims based on whether evidence satisfies the listed factors, and whether those factors are related to relevant service as required by section 10(1). Where a factor refers to another SOP‑covered condition, decision makers must also apply that other SOP under section 11; this creates an internal compliance requirement for administrative decision makers to coordinate SOP application.

In sum, this instrument does not itself authorise sanctions or enforcement beyond being the medical‑scientific authority for adjudication. Any consequences for claim outcomes (entitlements accepted or rejected) flow through the VEA/MRCA entitlement and review procedures, not from this instrument’s own provisions.

The instrument is made under s196B(3) of the VEA and explicitly applies to claims to which s120B of the VEA or s339 of the MRCA apply (sections 3 and 5). Its interaction with other laws arises in three principal ways:

1. Role within VEA and MRCA adjudication: The SOP supplies the RMA’s statement of medical factors which decision makers must apply when resolving causation issues in claims governed by the cited VEA and MRCA provisions. The SOP does not replace or amend the VEA or MRCA; rather it acts as an evidentiary instrument used to determine whether the statutory tests in those Acts are satisfied. The instrument does not state the substantive entitlement tests or remedies under the VEA or MRCA; it confines itself to the medical causation aspect (section 5).

2. Relationship with other SOPs: Section 11 expressly anticipates and regulates cross‑SOP interactions. If a factor in this SOP applies in relation to a person and that factor refers to an injury or disease covered by another SOP determined under subsection 196B(3) of the VEA, then the factors in that other SOP "apply in accordance with the terms of that Statement of Principles as in force from time to time." That means decision makers must give effect to the content and any temporal terms of the other SOP when a referenced injury or disease falls within another SOP. The SOP therefore creates a legal mechanism for coordinating overlap between different RMA SOPs.

3. Relationship to ICD coding and external medical classifications: The instrument references ICD‑10‑AM code S83.2 for acute meniscal tear of the knee (section 7(3)-(4)) and identifies the specific edition (Tenth Edition, effective 1 July 2017) and source. However, the instrument also makes clear that for the purposes of the SOP, the definition in subsection 7(2) controls and is the operative definition. Therefore, the SOP interacts with external medical classification systems only as a reference point and not as a substitute for the instrument’s statutory definition.

Limits and exclusions relative to other provisions: The Schedule defines "relevant service" in limited terms (eligible war service other than operational service; defence service other than hazardous service and British nuclear test defence service; and peacetime service under the MRCA) (Schedule 1). That definition determines whose service history can found a claim under this SOP; it therefore interacts with statutory definitions of service in the VEA and MRCA and limits the SOP’s practical scope.

What the SOP does not do: it does not amend substantive entitlements in the VEA or MRCA, does not alter review or appeal pathways, and does not create offences or civil penalties. It is designed to be used within the broader legal architecture of the VEA and MRCA, not to replace or rewrite those Acts.

The instrument itself contains a short express amendment history. Key dates and changes provided in the text:

• The SOP is numbered No. 26 of 2019 and is dated 1 March 2019 (cover page). It commences operation on 25 March 2019 (section 2).

• It was made under subsection 196B(3) of the VEA (section 3).

• The instrument expressly repeals the prior Statement of Principles concerning acute meniscal tear of the knee No. 56 of 2010 (Federal Register of Legislation No. F2010L01669), which had been made under the same provision of the VEA (section 4). The repeal means No. 56 of 2010 is no longer of effect once this instrument commences.

• The instrument references the ICD‑10‑AM Tenth Edition effective 1 July 2017 for the code S83.2 (section 7(4)). That reference fixes the edition of the external classification system used as a comparative reference in the instrument.

No other amendments, schedules, or transitional provisions are contained in the instrument. There are no savings clauses or explicit transitional arrangements in the text for claims lodged before commencement; the instrument’s repeal provision simply replaces the earlier SOP. The instrument’s language in section 5 confirms it applies to claims to which s120B VEA or s339 MRCA apply, but it does not set out how claims in progress as of the commencement date should be handled. The absence of transitional directions means decision makers must apply the new SOP to claims from its commencement date consistent with the statutory decision process.

Where the instrument refers to other SOPs (section 11), those other SOPs may themselves be amended from time to time, and section 11 requires decision makers to apply those SOPs as in force from time to time. The instrument therefore allows for future amendments to interacting SOPs to affect how this SOP operates when cross‑referenced.

The instrument itself contains no record or citation of any litigation. There are no cases referenced in the text. The RMA records its medical‑scientific view (section 8) but does not record any judicial consideration of this SOP within the instrument. Therefore, on the face of the instrument, there is no litigation history to report.

What this absence implies in practice is limited: the instrument does not purport to catalogue case law or challenge administrative decisions. Any litigation or judicial review that may subsequently arise from decisions applying this SOP will be documented in external judicial records; the instrument does not provide a registry or summary of litigation. Users seeking to understand how courts or tribunals have interpreted this SOP will need to consult judicial decisions and administrative law reports outside the text of the SOP, because the instrument itself contains no litigation references, authorities or interpretative clarifications.

The SOP’s brevity and focused drafting create several points where practitioners and claimants can err if they misread the text. The following are concrete traps and conditional limits that arise directly from the instrument’s language:

• Definition controls over ICD code: Although the SOP records the ICD‑10‑AM code S83.2 as the code attracting acute meniscal tear (section 7(3)), it explicitly says that, in applying the SOP, the meaning of acute meniscal tear of the knee is the definition given in subsection 7(2). Practitioners who rely solely on ICD coding or on external classification language risk missing the SOP’s control language (section 7(2)-(4)).

• Exclusion of chronic and degenerative disease: The SOP excludes chronic tear and degenerative disease of the meniscus (section 7(2)(b)). This exclusion is categorical; claims where the clinical picture is degenerative or chronic rather than acute, even if linked temporally to service, fall outside this SOP.

• Timing of clinical signs: The note to section 7(2) identifies signs and symptoms that may occur within 24 hours of the injury (pain on twisting, swelling, locking, loss of function). This 24‑hour observation window is an evidential touchstone for acute onset. Absent contemporaneous records within that short timeframe, establishing the SOP’s notion of “sudden onset” may be harder.

• "Clinical onset" phrasing in the physical force factor: Section 9(1) requires "a significant physical force applied to or through the affected knee joint at the time of the clinical onset". This ties the force to the clinical onset, which is an interpretative constraint. Evidence of remote trauma or repeated micro‑trauma not tied to a sudden clinical onset may not meet this factor.

• Narrow operation of the clinical‑management factor: Section 9(2) and its qualification in section 10(2) restrict the “inability to obtain appropriate clinical management” pathway to situations where the meniscal tear was suffered or contracted before or during (but did not arise out of) relevant service, and where lack of appropriate management materially contributed to or aggravated the condition. That means the clinical‑management factor does not apply where the injury arose out of the service event itself. Misapplying section 9(2) to injuries that arose out of service would be inconsistent with section 10(2).

• Requirement that a proved factor be related to relevant service: Section 10(1) requires that any factor relied upon must be related to the person’s relevant service. Even if a claimant satisfies section 9(1) or 9(2) factually, the causal nexus to the type of relevant service defined in Schedule 1 must also be established. "Relevant service" is itself a limited concept in the Schedule, excluding operational war service and certain hazardous defence categories (Schedule 1).

• Interaction with other SOPs: Section 11 makes this explicit. If a factor refers to an injury or disease already covered by another SOP, the other SOP’s terms apply. This can create a multi‑SOP evidentiary pathway and increase complexity in multi‑condition causation scenarios. Failure to identify and apply the other SOP can result in incorrect application of factors.

• Death causation and terminal events: Section 7(5) includes death from the acute meniscal tear where death from a terminal event or condition was contributed to by the tear. The Schedule provides examples of terminal events. However, proving contribution to a terminal event such as pneumonia or cardiac arrest from an otherwise peripheral knee injury requires careful evidentiary linkage; the SOP does not expand on how contribution is to be proved.

• No guidance on evidentiary standards beyond balance of probabilities: While section 8 states the RMA’s view on the evidential standard, the SOP does not provide guidance on what types of documentary, eyewitness, or medicolegal evidence satisfy the factors. Practitioners must infer what is required from the wording of the factors and from related administrative practice.

• No penalties or remedies in SOP: The instrument provides causation guidance only. It does not create entitlements, remedies, or specify how disputes about whether a factor has been established are to be resolved. Those procedural and remedial matters remain within the VEA and MRCA frameworks.

Each of these points flows directly from the instrument’s text. Awareness of these constraints is necessary when assembling a claim or advising a client about the likelihood of satisfying the RMA’s causation framework for acute meniscal tear of the knee.

Compliance in this context means presenting evidence and submissions to decision makers in a way that aligns with the SOP’s defined factors and limitations. Because the SOP is an evidentiary instrument used in claims under s120B VEA or s339 MRCA (section 5), claimant representatives and treating clinicians should structure evidence to meet the elements and the relationship requirement. Practical steps grounded in the SOP text are:

1. Establish the condition as the SOP defines it: Ensure the medical diagnosis presented in the claim corresponds to the SOP’s definition of acute meniscal tear of the knee , an injury causing tearing of a meniscus with sudden onset of pain and tenderness , and explicitly note that chronic tear or degenerative meniscal disease are excluded (section 7(2)(a)-(b)). Where the ICD code S83.2 is used, state that the SOP controls the meaning and provide clinical detail that matches subsection 7(2) (section 7(3)-(4)).

2. Prove at least one of the section 9 factors on the balance of probabilities:

   • For the physical force factor (section 9(1)): assemble contemporaneous incident reports, witness statements, duty logs, operational records, and medical records that link a significant physical force applied to or through the affected knee joint to the clinical onset. Emphasise evidence of sudden onset of pain and tenderness coinciding with the force event and, where available, signs occurring within 24 hours (note to section 7(2)). Imaging reports (MRI, arthroscopy findings) that show meniscal tearing consistent with an acute mechanism can support the timing and mechanism.

   • For the inability to obtain appropriate clinical management factor (section 9(2)): document attempts to obtain care, records showing unavailability of appropriate treatment, and clinical opinions that lack of appropriate management materially contributed to or aggravated the meniscal tear. Because section 10(2) restricts this factor to injuries suffered or contracted before or during (but not arising out of) relevant service, ensure the chronology demonstrates that the condition pre‑existed or was contracted before/during service and that lack of management occurred during relevant service. Provide clinical evidence of material contribution or aggravation attributable to lack of management (section 10(2)).

3. Link the proved factor to relevant service (section 10(1)): Correlate the proven factor with the person’s type of relevant service as defined in Schedule 1. Claims must show that the event or lack of management is related to the kind of relevant service specified (eligible war service other than operational service; defence service other than hazardous service and British nuclear test defence service; or peacetime service under MRCA). Evidence could include service records, postings, unit rosters, and contemporaneous administrative communications.

4. Where a factor refers to another SOP, apply the other SOP: Identify if any element of the factor relies on an injury or disease that is covered by another SOP. If so, present evidence in the form required by that SOP and refer to its operative terms, because section 11 requires application of the other SOP as in force from time to time.

5. Address death claims with contribution evidence: For claims of death from the meniscal tear, produce medical records, autopsy or coronial reports, and clinical opinion demonstrating that the meniscal tear contributed to a terminal event or condition listed in the Schedule (section 7(5); Schedule 1). Be explicit about the causal link between the knee injury and the proximate or ultimate cause of death.

6. Anticipate evidentiary timing constraints: Use medical records documenting symptoms and clinical signs within 24 hours where available (note to section 7(2)). If contemporaneous records are absent, obtain retrospective clinical opinions that explain the clinical history and reconcile any gaps with the SOP’s definition of acute onset.

7. Be precise about the legal standard: Frame submissions in terms of proving a factor on the balance of probabilities, as the RMA’s view contemplates that standard (section 8). Avoid arguing alternative standards or importing extraneous causal theories inconsistent with the SOP’s two defined factors.

8. Prepare for cross‑SOP complexity: When multiple conditions or injuries are alleged, map each claimed injury to its relevant SOP and demonstrate how the factual matrix satisfies the specific factors of each SOP relied upon, as required by section 11.

9. Use the SOP’s definitions in pleadings and medical reports: When drafting medical‑legal reports and claim submissions, quote the SOP’s definition of acute meniscal tear and the relevant factor wording to ensure alignment and to make clear which element of the SOP is being relied upon.

10. Keep records of attempts to obtain clinical management: Because one factor depends on inability to obtain appropriate management, detailed administrative documentation of attempts to access care (referrals, waitlists, correspondence, local facility limitations) and contemporaneous clinical notes on the consequence of delayed or absent care will be material.

These steps are derived from the SOP’s text (sections 5, 7-11 and Schedule 1) and reflect how evidence should be structured to meet the instrument’s criteria. The SOP does not prescribe procedural forms or mandatory document lists; practitioners should therefore align documentary evidence with the specific phrases and limitations used in the instrument.
