Statement of Expectations for Airservices Australia from 1 November 2025 to 30 June 2027

The core concepts the instrument mobilises are: “expectations” as a form of ministerial direction or notice (it is explicitly issued under s 17 of the Air Services Act 1995); governance and accountability; service-level performance tied to CASA authorisations; collaboration on major modernization programs; financial discipline and capital-structure review; community and stakeholder engagement (including noise management); environmental and contamination management (PFAS); and transparent reporting and escalation.

Expectations and notice: The instrument repeatedly frames its content as expectations to be met by Airservices. It begins by stating it “serves as a notice” under s 17 of the Act, and later directs that Airservices “comply with this SoE and all Ministerial Directions issued under the Act.” That links the SoE to the statutory regime for ministerial directions without restating or amending those statutory powers within the instrument.

Governance and management: The SoE specifies the Board’s and CEO’s responsibilities as the mechanisms for delivery. It expects the Board and CEO to ensure Airservices has necessary resources, capabilities and corporate planning arrangements “in accordance with section 21 of the Act” and that the CEO manage operations “in accordance with section 35 of the Act.” The Board is expected to notify the Minister and the Department of significant decisions or issues “as soon as practicable” and to invite a Department senior executive or nominated official to an annual strategic meeting.

Service levels and safety compliance: The SoE ties service expectations to CASA determinations and Civil Aviation Safety Regulations. Air Traffic Services are to be provided commensurate with airspace classification and baseline hours determined by CASA, subject to unforeseeable contingency. Aviation Rescue Fire Fighting Services (ARFFS) must be provided at the category listed on the CASA-issued ARFFS Provider Certificate and in accordance with Part 139H of the CASRs. The SoE expects timely resolution of CASA safety findings and compliance with CASA directions and conditions.

Financial and structural review: The instrument expects Airservices to manage its finances “in an efficient, economic and ethical manner” and to “demonstrate it is on track to return to financial stability and pay a dividend to Government as agreed by Government.” It also requires Airservices to “arrange and pay for independent biennial reviews to assess Airservices’ capital structure,” imposing a recurring, specified cost and an accountability mechanism tied to capital and financing arrangements.

Modernisation, technology and inter-agency programmes: The SoE directs Airservices to engage with the OneSKY Australia Program and the Civil Military Air Traffic Management System, to operationalise and iteratively develop a Flight Information Management System (FIMS), to work on UTM and ADS-B mandate policy support, and to facilitate trials and airspace modernisation consistent with the Australian Airspace Policy Statement and the 2024 Aviation White Paper.

Community, environment and contamination: The SoE places expectations on noise minimisation and community engagement, resourcing the Airservices Noise Complaints and Information Service, supporting transition of the Aircraft Noise Ombuds function to an independent structure, and commitment to the Sydney Airport Long Term Operating Plan (Ministerial Direction dated 30 July 1997). It also puts specific reporting and advisory obligations on Airservices in relation to PFAS contamination at Airservices-impacted sites, including quarterly reporting to the Minister and collaborative policy work with the Department.

Stakeholder engagement and reporting: The SoE emphasises proactive, frank and timely communication with the Department, CASA, Defence, industry and the community, and requires quarterly progress reports against the Corporate Plan, the SoE and additional reasonable reporting requested by the Minister or the Department. The SoE requires Airservices to inform stakeholders about disruptions and remediation, and to undertake biennial reviews of community engagement implementation.

Repeal of prior instruments: Schedule 1 repeals three prior Statements of Expectations (the 2019-2021, 2021-2023, and 2023-2025 instruments), making the 1 Nov 2025-30 Jun 2027 SoE the operative statement for the period.

Primary addressee: The instrument is directed at Airservices Australia. It is issued by the Minister for Infrastructure, Transport, Regional Development and Local Government to Airservices and is framed as a notice under s 17 of the Air Services Act 1995. The operative expectations bind Airservices as the entity required to comply with the reporting and operational instructions contained in the SoE.

Board and executive: The Board of Airservices and the CEO are singled out as accountable decision-makers. The SoE specifies expectations for the Board to ensure resources and capabilities and to notify the Minister and the Department of significant issues. The CEO is expected to manage operations and organisational capacity in accordance with section 35 of the Act. These provisions place governance-level responsibilities on people and bodies within Airservices.

The Department and the Minister: The Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts (the Department) and the Minister are addressees of reporting obligations. The instrument expects Airservices to keep the Minister and the Department informed, to provide quarterly progress reports, and to invite a Department senior executive or nominated official to an annual strategic meeting. The instrument also requires Airservices to provide regular updates to the Department on PFAS investigations, management and remediation options.

Civil Aviation Safety Authority (CASA): CASA’s determinations and regulatory instruments function as benchmarks within the SoE. Service levels, baseline hours of service, airspace classification and ARFFS certificates determined by CASA are made the touchstone for expected performance. The SoE requires Airservices to resolve CASA safety findings and satisfy CASA directions in accordance with the Civil Aviation Safety Regulation 1998.

Defence and inter-agency programmes: Defence is an engaged partner. The SoE expects Airservices to work with the Department of Defence to progress OneSKY and the Civil Military Air Traffic Management System, advising the Department and supporting reporting to Government. The Department, CASA, Defence and other government agencies are ongoing collaborators for programs like Airspace Management Modernisation and Western Sydney Airport readiness.

Industry and users: Airlines, airports (explicit reference to Western Sydney International (Nancy-Bird Walton) Airport and Sydney Airport), general aviation, operators of emerging technologies (Remotely Piloted Aircraft Systems, Advanced Air Mobility), and other industry stakeholders are affected by Airservices’ implementation of the SoE. Expectations to operationalise FIMS, support ADS-B mandate policy work, trial UTM and integrate emerging aviation technologies will impact these stakeholders through changed service offerings, trial participation and regulatory alignment.

Communities and affected persons: Noise-affected communities are named beneficiaries of expectations around noise-minimisation measures, the Airservices Noise Complaints and Information Service and the Aircraft Noise Ombuds function. The SoE’s PFAS-related expectations also implicate communities proximate to Airservices-impacted sites, by requiring Airservices to investigate contamination and report risks, management and remediation options to the Department and Minister.

Public finance and taxpayers: The SoE’s financial expectations , in particular the requirement that Airservices demonstrate a return to financial stability and pay a dividend to Government as agreed , indicate an interface with public finance outcomes. The instrument also requires Airservices to pay for independent biennial capital-structure reviews, which imposes a direct cost on the corporate entity and indirectly implicates public-sector financial objectives.

Other agencies and forums: The SoE anticipates Airservices’ engagement with international air navigation agencies and forums, and named Australian advisory groups such as the National Airports Safeguarding Advisory Group. These bodies will be affected by inputs from Airservices in policy development, technical advice, and community engagement reviews.

Duties framed by the SoE

• Governance and capability duties: The SoE requires the Board and CEO to “ensure Airservices has the necessary resources and capabilities” to manage strategic direction, risks and corporate planning “in accordance with section 21 of the Act” and to manage operations and organisational capacity “in accordance with section 35 of the Act.” That places an expectation on governance structures and executive management to align with the Act’s referenced duties.

• Reporting duties: Airservices must provide quarterly progress reports to the Minister and the Department against the Corporate Plan and the SoE, and provide “reasonable additional reporting requested by me or the Department, including financial and performance metrics.” The Board is expected to notify the Minister and Department “of any significant decisions or issues as soon as practicable.” The SoE also requires regular updates to the Department on PFAS investigations and remediation options, and reports on significant matters considered at Board meetings.

• Service-level duties: Airservices is expected to deliver Air Traffic Services and ARFFS in line with CASA-determined airspace classifications and certifying instruments, including baseline hours and ARFFS Provider Certificate categories. Airservices must resolve CASA safety findings and satisfy directions and conditions within timeframes acceptable to CASA and must maintain sufficient staff capacity to avoid service reductions due to staff availability or competency, except where reductions are required by legislation or unforeseeable contingency.

• Financial and review duties: Airservices is expected to manage finances in an “efficient, economic and ethical manner,” to demonstrate a trajectory back to financial stability and to pay a dividend to Government as agreed. It has a duty to “arrange and pay for independent biennial reviews to assess Airservices’ capital structure,” creating a recurring, contracting and budgeting requirement.

• Collaboration and program duties: The SoE requires Airservices to work with Defence on OneSKY and with the Department and CASA on ARFFS policy, FIMS development, UTM trials, ADS-B mandate policy support, Airspace Management Modernisation and Western Sydney Airport readiness, and to support Asia Pacific capacity-building initiatives.

• Community, environmental and PFAS duties: Airservices must apply sufficient resources to noise complaint services and the Aircraft Noise Ombuds function; undertake and publish biennial reviews of the Airservices Community Engagement Standard; and provide detailed PFAS reporting and advisory information to the Department and Minister, including risks of liability, remediation costs and methods.

• Communication duties: The SoE expects proactive, frank, timely and regular communication with stakeholders and the Department, including transparent publishing of disruption information and remediation actions.

Rights and discretion preserved or implied

• Operational discretion within legal frameworks: The instrument directs Airservices to perform “in accordance with the Act” and other laws and standards; consequently, Airservices retains the operational discretion and statutory duties under the Air Services Act and Civil Aviation Safety Regulations (as they stand) to determine the precise measures for compliance, recruitment, rostering, procurement and service delivery, subject to the expectations set out. The SoE does not on its face amend statutory powers or create new statutory rights for third parties.

• Ability to report contingencies: The SoE recognises unforeseeable contingencies as a legitimate reason for deviations from baseline service hours and ARFFS category reductions required by legislation; it requires Airservices to communicate such deviations clearly to CASA and the Minister, including remediation plans. That acknowledges a right to deviate from expectations in certain circumstances, within a reporting framework.

• Contracting and procurement autonomy: The obligation to “arrange and pay” for independent reviews implies Airservices’ right and responsibility to enter contracts and procure consultancy and review services at its own expense, consistent with PGPA Act requirements and other procurement rules, notwithstanding that the SoE insists on these reviews.

• Engagement rights in policy development: The SoE expects Airservices to provide technical advice and support to the Department and CASA on emerging technologies and policy initiatives; Airservices retains the right to shape that advice but is obliged to make itself available for such inputs.

Documentary and timing rights

• Temporal scope defined: The SoE applies for a fixed period (1 Nov 2025 , 30 Jun 2027). As a notice under s 17, the SoE creates expectations over that term; the instrument repeals prior SoEs for earlier terms in Schedule 1. The temporal boundary gives Airservices a defined horizon for the listed duties and for scheduling biennial reviews and reporting cycles.

Limitations and omissions

• No explicit statutory sanction in the instrument: The SoE itself contains no express penalty provisions or enforcement mechanisms beyond references to compliance with Ministerial Directions and statutory obligations. Consequently, the primary mechanisms for ensuring compliance in the text are oversight, reporting obligations, Ministerial Directions under the Act and inter-agency engagement, not explicit financial or criminal penalties included within this instrument.

• Reliance on external regulatory standards: Many duties are stated as expectations to act “in accordance with” CASA determinations, the Civil Aviation Safety Regulation 1998, the PGPA Act and international obligations (ICAO/Chicago Convention). That establishes external standards as the measure of compliance rather than prescriptive technical obligations inserted into the SoE itself.

The instrument does not specify new statutory penalties or discrete enforcement measures within its text. Instead, enforcement and compliance mechanisms referenced in the SoE operate through existing statutory frameworks, reporting, and the Minister’s oversight functions. The SoE explicitly requires Airservices to “comply with this SoE and all Ministerial Directions issued under the Act,” thereby situating enforcement potential within the Act’s powers to issue Ministerial Directions; the instrument itself does not elaborate those statutory enforcement powers or penalties.

Mechanisms identified by the SoE

• Reporting and escalation: The SoE mandates quarterly progress reports to the Minister and the Department, including financial and performance metrics; notification by the Board of significant decisions or issues “as soon as practicable”; and inclusion of remediation plans in quarterly reports where Airservices cannot meet specified expectations. These reporting obligations are compliance tools: regular reporting creates visibility and provides the Minister and Department with information on which to base further action.

• Ministerial Directions under the Act: The SoE requires compliance with Ministerial Directions issued under the Air Services Act. While the SoE does not recite the Act’s particular powers, it explicitly links the SoE to that statutory regime; any enforceable orders or directions would be effected under the Act’s provisions rather than by the SoE alone.

• Departmental engagement and meetings: The Board is expected to invite a member of the Department’s Senior Executive or a nominated Department official to an annual strategic meeting; the Department’s presence creates an oversight and monitoring channel. The SoE also anticipates Airservices providing information “as requested by me or the Department.” These supervisory interactions are mechanisms for the Minister and the Department to monitor and, if necessary, press Airservices on remediation.

• Reputational and fiscal pressure: The SoE requires Airservices to “demonstrate it is on track to return to financial stability and pay a dividend to Government as agreed by Government.” While the SoE does not impose a statutory penalty for failure, non-compliance could result in political or fiscal pressure, including negotiation of dividend arrangements, Ministerial scrutiny, or potential use of statutory powers under the Act or PGPA Act to influence outcomes. The instrument itself does not state those consequences; it simply establishes expectations which create accountability pressure.

• Conditions tied to CASA authorisations: The SoE requires resolution of CASA safety findings and satisfaction of CASA directions and conditions “in accordance with the Civil Aviation Safety Regulation 1998 and within a time period acceptable to CASA.” Enforcement in relation to safety findings and certificating conditions lies with CASA’s regulatory powers under the Civil Aviation Safety Regulations, not the SoE; the SoE therefore connects Airservices’ obligations to an external regulator that has its own enforcement mechanisms.

Not specified in the instrument

• No explicit penalties, fines or trigger-based sanctions: The SoE does not set out specific fines, statutory penalties, or automatic triggers for remedial action. It does not amend the Act or delegate new enforcement powers. Any coercive measures would therefore arise through existing statutory provisions (for example, Ministerial Directions under the Act or CASA regulatory enforcement) or through administrative instruments not contained in this SoE.

• No formal dispute-resolution procedure: The SoE contains no dispute resolution clause, arbitration mechanism, or independent compliance panel. The text focuses on expectations, reporting and inter-agency collaboration rather than formal compliance adjudication mechanisms within the instrument itself.

Practical enforcement implications

• Primary enforcement tools are oversight, information flow and inter-agency regulatory interfaces. The Minister and Department are positioned to use information from quarterly reports, Board notifications and strategic meetings to apply oversight. CASA remains the operational safety regulator whose directives and certificates are referenced as performance benchmarks. Financial oversight and public accountability are reinforced by the requirement for independent biennial capital-structure reviews and reporting on financial metrics.

• Because the instrument ties expectations to statutory and regulatory obligations rather than prescriptive sanctions, the effective enforcement pathway is through a combination of Ministerial direction powers under the Act, CASA regulatory action where safety findings arise, and administrative or political pressure driven by the SoE’s reporting regime.

The SoE explicitly situates Airservices’ expectations within a matrix of existing statutory and regulatory regimes and international obligations. The instrument repeatedly directs that Airservices perform “in accordance with” particular Acts, regulations and international instruments, thereby making those instruments the substantive compliance standards for many of the SoE’s expectations.

Direct statutory and regulatory references in the SoE

• Air Services Act 1995: The SoE is issued as a notice under section 17 of the Air Services Act 1995 and references sections 21 and 35 in relation to corporate planning and the CEO’s responsibilities. By framing the SoE under s 17, it invokes the Act’s statutory mechanism for ministerial expectations and directions without altering the Act itself. Any statutory remedies, directions or powers available under the Air Services Act remain the operative legal framework.

• Public Governance, Performance and Accountability Act 2013 (PGPA Act): The SoE requires Airservices to perform its functions and manage finances in accordance with the PGPA Act, “best practice principles and guidelines” and relevant accounting standards. That places the PGPA Act’s financial management, reporting, accountability and governance obligations into direct interaction with the SoE’s expectations.

• Civil Aviation Safety Regulation 1998 (CASR): The SoE specifies compliance with the CASR, including resolution of CASA safety findings and satisfaction of directions and conditions “in accordance with the Civil Aviation Safety Regulation 1998” and refers to Part 139H (Aerodrome rescue and firefighting services) for ARFFS expectations. CASA’s determinations (airspace classification, baseline hours, ARFFS Provider Certificate category) function as regulatory inputs embedded into the SoE’s performance benchmarks.

• International obligations: The SoE requires Airservices to “function in conformity with Australia’s international obligations, including the requirements of the International Civil Aviation Organization (ICAO) and obligations under the Chicago Convention.” Those instruments impose technical and safety standards and represent external constraints on operational choices; the SoE therefore requires Airservices to calibrate domestic service delivery against international commitments.

Other intersecting instruments and policy documents

• Ministerial Directions: The SoE requires compliance with all Ministerial Directions issued under the Air Services Act. Those Directions (which are not reproduced in the SoE) remain legally significant and can supplement or amplify expectations set out in the SoE.

• 2024 Aviation White Paper and Australian Airspace Policy Statement: The SoE tasks Airservices with implementing elements aligned with these policy documents (for example ADS‑B mandate modelling in the 2024 Aviation White Paper and Airspace Management Modernisation consistent with the Australian Airspace Policy Statement). These policy documents interact with the SoE as non‑statutory but authoritative government policy frameworks that Airservices is expected to support.

• Ministerial Direction dated 30 July 1997 (F2009B00158): The SoE expressly reaffirms the commitment to the Sydney Airport Long Term Operating Plan as required by that Ministerial Direction, tying Airservices’ obligations at Sydney Airport to that older direction.

• Environmental and contamination policy expectations: The SoE places obligations on Airservices to engage with the Department on PFAS contamination management and to report on remediation options, costs and liability risks. While the SoE does not itself create environmental enforcement powers, it requires Airservices to comply with relevant government expectations and to provide risk and remediation information to the Department.

Practical interaction effects

• External regulation as compliance standard: Because the SoE defers to CASA determinations and CASR provisions for service benchmarks, Airservices’ compliance obligations are tightly linked to the operational regulator’s standards. Regulatory enforcement for safety and certification matters will proceed under CASA’s statutory powers; the SoE functions to align Airservices’ performance expectations with those regulatory standards.

• Financial governance overlay: The requirement to comply with the PGPA Act and to carry out independent biennial capital-structure reviews overlays financial governance standards on Airservices’ commercial and operational decisions. That creates an interaction where public-sector financial accountability requirements constrain corporate finance choices.

• Inter-agency coordination: The SoE envisages significant inter-agency coordination (Department, Defence, CASA, ATSB, other agencies) on programs such as OneSKY, FIMS and Western Sydney Airport. That coordination implies a need to manage competing legal, procedural and policy standards across agencies.

• Non-binding but administratively potent: The SoE’s legal character is that of a ministerial notice under s 17; the instrument does not repeal or amend underlying legislation but establishes administrative expectations that intersect with existing laws and regulatory instruments. The principal legal consequences therefore flow through existing statutory frameworks identified in the SoE rather than through novel statutory changes imposed by the SoE itself.

This instrument is dated 13 October 2025 and is expressly framed as the Statement of Expectations for Airservices Australia for the period 1 November 2025 to 30 June 2027. The instrument’s Schedule 1,Repeals revokes earlier Statements of Expectations. Specifically, Schedule 1 repeals:

• “Statement of Expectations for Airservices Australia for the Period 15 July 2019 to 30 June 2021 (Federal Register of Legislation No. F2019L00978)” , the whole instrument is repealed (Schedule 1, item 1).

• “Statement of Expectations for Airservices Australia for the Period 1 July 2021 to 30 June 2023 (Federal Register of Legislation No. F2021L00930)” , the whole instrument is repealed (Schedule 1, item 2).

• “Statement of Expectations for Airservices Australia from 1 July 2023 to 30 June 2025 (Federal Register of Legislation No. F2023L00987)” , the whole instrument is repealed (Schedule 1, item 3).

The practical effect of these repeals is to replace the prior SoEs with the 1 Nov 2025-30 Jun 2027 SoE as the operative ministerial statement for the specified period. The instrument itself does not record amendments to the Air Services Act 1995 or other legislation; it functions as an administrative instrument operating under s 17 of the Act.

Important temporal details

• Operative period: The SoE applies from 1 November 2025 until 30 June 2027. This gives a defined implementation horizon during which the Minister’s expectations should guide Airservices’ corporate planning cycles, reporting cadence (quarterly reports are required), and the scheduling of the mandated independent biennial capital-structure reviews.

• Biennial reviews timing: The SoE requires Airservices to “arrange and pay for independent biennial reviews to assess Airservices’ capital structure.” Given the SoE’s 20-month term, one biennial review would be required at least within the SoE’s lifetime (subject to interpretation as to exact timing); the obligation creates an ongoing review schedule beyond the SoE term if read as a standing biennial requirement while similar SoEs remain in force.

Administrative continuity and repeal consequences

• Repeal of prior SoEs: By expressly repealing the prior SoEs, the instrument removes potential overlapping or inconsistent expectations from previous instruments and consolidates the ministerial expectations for the new period.

• No explicit transitional provisions: The instrument does not include transitional provisions governing obligations commenced under prior SoEs which may continue beyond their repeal; the Schedule simply states that the whole of the prior instruments are repealed. Any continuing obligations or actions started under prior SoEs that are not re-stated in the new SoE are not addressed in the text.

Record-keeping and public availability

• The instrument is published and dated (13 Oct 2025). The Schedule cites Federal Register of Legislation references for prior SoEs, which creates a public record path for cross-referencing the instrument and its predecessors. The SoE’s publication and the repeals are administrative actions recorded in the instrument; they do not in themselves change statutory law but they document the Minister’s administrative direction over time.

The text of this instrument does not record, reference, or summarise any litigation or judicial decisions related to the Statement of Expectations, Airservices Australia, or the matters it addresses. The instrument is an administrative notice issued under s 17 of the Air Services Act 1995 and contains no litigation annotations, case citations, or summaries of judicial review or other proceedings.

What the instrument’s silence indicates for practitioners

• No recorded challenges within the instrument: Because the instrument does not mention any judicial decisions or challenges, there is no litigation history embedded in this document to rely upon for interpretive guidance. Practitioners seeking to understand the legal status, enforceability or reviewability of the SoE will need to consult the Air Services Act, administrative law principles and any external case law not contained in the SoE to assess remedies or avenues for challenge.

• Potential for administrative law claims outside the instrument: The instrument creates expectations and reporting obligations that could, in theory, give rise to administrative disputes (for instance, over whether the Minister’s directions are lawfully issued under the Act, or whether a particular action by Airservices complies with a Ministerial Direction). The SoE itself does not describe the avenues for challenging the SoE or the Minister’s actions; such challenges would turn on the statutory provisions of the Air Services Act and general administrative law remedies, which are not set out in this instrument.

• Regulatory enforcement pathways are external: Many of the operational standards in the SoE are tied to CASA determinations and Civil Aviation Safety Regulations. Any enforcement action for safety compliance would rest with CASA and the CASR regime, and any legal disputes arising from CASR enforcement would be recorded in CASA or court records rather than in this instrument.

Practical guidance arising from the absence of litigation material

• Use statutory and regulatory sources for legal testing: Because this instrument does not provide litigation precedents, practitioners must analyse the Air Services Act, the PGPA Act and the Civil Aviation Safety Regulations , instruments expressly referenced in the SoE , to evaluate legal obligations, potential reviewability, and enforcement options.

• Records and reporting as evidence: The SoE’s emphasis on quarterly reporting, Board notifications and biennial reviews creates a documentary trail. That trail will be relevant evidence if any administrative or judicial review of Airservices’ compliance with the SoE or related Ministerial Directions is litigated, but the SoE itself does not supply case law or legal interpretation.

• Monitor external developments: Any litigation that implicates the SoE’s obligations (for example, disputes about Ministerial Directions, safety certification, or PFAS liabilities) will appear in external legal databases and administrative law reports. The SoE does not summarise or reference such material.

The instrument is compact but dense with operational expectations; several practical risks and potential pitfalls (gotchas) for Airservices and stakeholders flow directly from the text. The following items are anchored in the SoE’s wording and highlight implementation frictions, compliance ambiguities and costs that decision-makers should monitor.

Expectation-vs-obligation ambiguity: The instrument is framed as “expectations” and “serves as a notice…under section 17 of the Air Services Act 1995.” That creates ambiguity for practitioners about the SoE’s legal force relative to statutory duties and Ministerial Directions. While the SoE requires Airservices to “comply with this SoE and all Ministerial Directions issued under the Act,” it does not itself define the outcome of non-compliance. Practitioners should not assume the SoE produces autonomous statutory sanctions; instead, the SoE functions as an administrative benchmark tied to statutory regimes.

Reporting burden and frequency: The SoE requires quarterly progress reports “against the Corporate Plan, this SoE and reasonable additional reporting requested by me or the Department, including financial and performance metrics.” Providers should note the operational cost and resourcing implications of ongoing, potentially increasing reporting requirements, including the need to prepare financial and performance metrics suitable for Ministerial and departmental review.

Biennial review cost obligation: Airservices is required to “arrange and pay for independent biennial reviews to assess Airservices’ capital structure.” That is a concrete, recurring budgetary liability embedded in the SoE. The SoE does not specify scope, procurement rules, or reviewer qualifications; contracting and budgeting choices fall to Airservices but will likely attract Departmental scrutiny.

Financial expectations and dividend commitment: The SoE expects Airservices to demonstrate a return to financial stability and “pay a dividend to Government as agreed by Government.” The SoE does not specify dividend quantum or schedule; that leaves uncertainty for corporate finance planning. The expectation may constrain capital allocation, borrowing and investment decisions, particularly when balanced against obligations to resource modernization programs and increased reporting.

Operational staffing expectations vs contingencies: The SoE expects Airservices to provide services “minimising the use of demand management practices due to staff availability or competency” and to ensure “sufficient, competent staff resources” for ARFFS. However, it also allows for reductions where required by legislation or unforeseeable contingencies. Employers must balance workforce planning against the caveat that unforeseeable contingencies may present legitimate exceptions; the SoE requires communications to CASA and the Minister where expectations cannot be met.

CASA timeframes and acceptability: The SoE requires resolution of CASA safety findings “within a time period acceptable to CASA.” That ties Airservices’ remediation timetable to CASA’s acceptability criteria, which are external to the SoE. Practically, Airservices must maintain close engagement with CASA to ensure remediation plans and timeframes align, otherwise the SoE’s reporting obligations will capture any divergence.

Integration of major programs creates dependencies: The SoE tasks Airservices with supporting OneSKY, FIMS, UTM trials, ADS-B mandate policy support and Western Sydney Airport opening. These programs are interdependent and will require cross-agency coordination (Defence, CASA, Department). Delays, funding mismatches, or technical issues in one program could cascade into other obligations that the SoE expects Airservices to support.

PFAS reporting and liability sensitivity: The SoE requires Airservices to report PFAS contamination investigations, management and remediation options and to advise the Department on risks of liability and damages at impacted sites. That imposes disclosure and advisory duties touching on potential environmental liabilities. The SoE does not establish compensation mechanics or remediation funding responsibilities beyond collaborative policy engagement with the Department, so Airservices may face open-ended exposure to reputational and potential liability risks that require careful legal and financial planning.

Noise Ombuds transition and resourcing: The SoE expects Airservices to apply sufficient resources to the Aircraft Noise Ombuds function and to support its transition to an independent structure. The instrument does not prescribe the transition model, timing, or resourcing envelope, leaving Airservices to plan the transition while complying with noise-complaint service obligations.

No explicit dispute-resolution or appeal route in the SoE: The instrument does not create an internal appeal or dispute-resolution mechanism for disagreements over the SoE’s expectations, scope or interpretation. Airservices and stakeholders may need to rely on statutory remedies or inter-agency negotiation where there is disagreement.

Repeal of prior SoEs without transitional detail: The Schedule repeals earlier SoEs in full but does not provide transitional wording on obligations or ongoing projects begun under prior SoEs. Practitioners should verify whether ongoing obligations from earlier instruments are expressly restated or whether prior expectations have effectively lapsed.

Potential for increased administrative oversight: The cumulative effect of frequent reporting, mandated independent reviews and Departmental access to strategic meetings increases the potential for close administrative oversight and input into Airservices’ corporate planning. That may constrain operational autonomy and impose compliance costs.

Complying with the SoE requires translating the Minister’s expectations into a programme of governance, reporting, operational and financial tasks. The SoE is operative from 1 November 2025 to 30 June 2027 and is issued as a notice under s 17 of the Air Services Act. The following actions are grounded in the text and represent concrete steps Airservices should take to align with the instrument.

Immediate governance and reporting steps

• Board and CEO accountability mapping: Document and formalise the Board’s and CEO’s responsibilities in light of the SoE. Ensure corporate planning documents explicitly reference section 21 and section 35 of the Act where the SoE does. Implement Board procedures for “notifying the Minister and the Department of any significant decisions or issues as soon as practicable,” with an agreed notification threshold and escalation timeline.

• Quarterly reporting framework: Develop a standardised quarterly progress-report template that maps deliverables to the Corporate Plan and the SoE. Include financial and performance metrics as required, and design a mechanism for capturing additional reporting requested by the Minister or Department. Establish internal sign-off processes and a schedule that meets the SoE’s cadence.

• Annual strategic meeting: Implement a process to invite a Department Senior Executive or nominated Department official to an annual strategic meeting, and prepare an agenda that covers strategic direction, risks, capital-structure review findings (when applicable), and program status (OneSKY, FIMS, Western Sydney readiness, PFAS investigations).

Financial and review compliance

• Biennial independent capital-structure reviews: Plan procurement and budgeting to “arrange and pay for” independent biennial reviews. Prepare a scoping document that reflects the SoE’s stated purpose, identify procurement rules under the PGPA Act and internal procurement policies, and set procurement timelines so that reviews are deliverable within the SoE’s reporting horizons.

• Dividend and financial stability reporting: Prepare a financial recovery roadmap and reporting metrics that demonstrate progress toward financial stability and the ability to pay a dividend “as agreed by Government.” Ensure that financial reporting aligns with PGPA Act standards and relevant accounting standards noted by the SoE.

Operational service delivery

• CASA-aligned service plans: Map Airservices’ Air Traffic Services and ARFFS delivery to CASA-determined airspace classification, baseline service hours and the ARFFS Provider Certificate category (Part 139H). Maintain systems to track staffing levels, availability, competencies and rostering to minimise demand management practices due to staff shortfalls, and include contingency plans for unforeseeable events.

• Safety-finding remediation process: Establish a documented process to resolve CASA safety findings, including timelines acceptable to CASA, remediation plans and evidence of completion. Include escalation and reporting elements so that unresolved items are included in quarterly reports and Board agendas.

Program delivery and inter-agency work

• OneSKY and Civil Military interfaces: Put in place governance and information-sharing arrangements with Defence and the Department to support OneSKY delivery. Provide mechanisms for early risk identification and milestone reporting back to the Department and Minister, as required by the SoE.

• FIMS, UTM and ADS-B mandate support: Assign technical leads to operationalise and iteratively develop FIMS and to support UTM trials and ADS‑B policy work. Identify resources, trial sites, trial governance and data-sharing agreements required to support trials and program reporting.

• Western Sydney Airport readiness: Assign a dedicated project plan for Western Sydney International airport opening in 2026 covering air traffic control, ARFFS, navigational aids, airspace planning and post-implementation review. Ensure the plan includes resourcing, procurement timelines and stakeholder engagement.

PFAS and environmental compliance

• PFAS investigation and reporting protocol: Establish a standardised PFAS reporting pack for quarterly submissions to the Minister and Department, including current management arrangements, investigative findings, remediation options, cost estimates, and legal risk assessments of liability and damages. Coordinate legal, environmental and financial expert inputs to ensure the Department receives comprehensive and timely updates as required by the SoE.

Noise and community engagement

• Resourcing for noise services: Audit current resourcing for the Airservices Noise Complaints and Information Service and the Aircraft Noise Ombuds function. Prepare a plan to allocate “sufficient resources” and to support the Ombuds’ transition to an independent structure, including timelines, budget and stakeholder consultation.

• Community Engagement Standard reviews: Schedule and publish biennial reviews into the implementation of the Airservices Community Engagement Standard, as required, and incorporate findings into stakeholder engagement plans.

Documentation and transparency

• Record-keeping and public-facing reporting: Maintain a clear record of all communications with CASA, the Department, Defence and the Minister. Where the SoE expects “frank and timely” communication with stakeholders, prepare public-facing statements or community notices to communicate disruptions and remediation steps in line with the SoE’s transparency expectation.

• Board minutes and audit trail: Ensure Board meeting minutes capture significant decisions, risk discussions, capital-structure reviews, PFAS updates and anything the Board considers significant for reporting to the Minister. This creates an auditable trail aligning with the obligation to report “significant matters considered at Airservices’ Board meetings.”

Procurement and contracting

• Procure expertise early: For mandated independent reviews, FIMS development, OneSKY support, PFAS remediation advice and noise-ombuds transition, secure procurement and contracting strategies that comply with PGPA Act procurement obligations and ensure delivery timelines align with reporting requirements.

Risk management and contingency planning

• Contingency communication protocol: Develop a clear contingency communication playbook for unforeseeable events that affect service hours or ARFFS category. The protocol should set out notification timelines to CASA and the Minister, remediation plans, and inclusion in quarterly reporting as required by the SoE.

• Inter-agency risk register: Maintain an inter-agency risk register for programs where the SoE expects Airservices to take a coordinating or advisory role (OneSKY, Western Sydney Airport, FIMS, UTM). Use the register to identify inter-dependencies, funding gaps and critical path items that would affect SoE compliance.

Legal and compliance oversight

• Legal alignment and advice: Obtain regular advice on the interaction between the SoE, the Air Services Act, Ministerial Directions and the PGPA Act. Ensure that reporting to the Minister and Department aligns with legal disclosure obligations and does not unintentionally waive privileges or create undue exposure.

• Internal compliance monitoring: Establish an internal compliance function or assign responsibilities to ensure that quarterly reports, biennial reviews, CASA remediation timelines and other obligations are tracked and met. Use compliance metrics in Board reporting and in the quarterly submissions to the Minister and Department.

By translating the SoE’s expectations into concrete operational, financial and governance actions as above, Airservices can create the documentary and managerial infrastructure the instrument requires. The SoE sets reporting and collaborative obligations linked to existing statutory standards; compliance therefore involves meeting those administrative and regulatory benchmarks while preserving the operational discretion and statutory duties that govern Airservices’ day-to-day functions.
