State Records Act 1997

Key definitions and structural concepts in the Act determine its operational contours.

Agency: The Act defines “agency” broadly (s 3(1)). It includes the Governor, Ministers, courts and tribunals, statutory offices, bodies established for public purposes by or under an Act, departments and administrative units of the public service, the police force, municipal or district councils, and any person or body declared by regulation to be an agency (s 3(1)(a)-(i)). The definition includes former agencies and agencies that ceased to exist before commencement, but explicitly excludes Houses of Parliament and certain parliamentary officers and members except where they are Ministers acting in ministerial capacity (s 3(1) j-m). That scope sets the universe of record creators and custodians subject to the statutory regimes for custody, disposal and access.

Official record: “Official record” is central. It is defined as a record made or received by an agency in the conduct of its business, but the definition contains exclusions, notably records made for delivery to third parties, draft records not for further use, items accepted into library or museum collections not associated with agency business, Commonwealth records within the Commonwealth Archives Act regime, and records already transferred to the Commonwealth (s 3(1) official record, (d)-(e)). The Act treats records expansively to include copies, parts, attachments and accompanying materials (s 3(2)), but excludes objects/devices used merely to produce or reproduce records.

Dispose: The Act defines “dispose of an official record” to include destruction, abandonment, acts rendering reproduction impracticable, or transfer/sale of ownership or possession, but it expressly excludes transfers to State Records or between agencies (s 3 dispose of an official record). That definition frames the prohibition in s 23 that an agency must not dispose of official records except under a Manager determination approved by the Council.

Custody and transfer timing: The statute uses two trigger rules for mandatory delivery into State Records custody: when the agency ceases to require access for current administrative purposes; or during the year occurring 15 years after the record came into existence, whichever comes first (s 19(1)). Section 3(4) provides a dating rule, taking a record to have come into existence on 31 December of the year in which it came into existence; that affects the calculation of the 15-year trigger.

Standards and managerial instruments: The Manager has an express mandate to issue standards relating to record management practices (s 7(h)), and section 14 empowers the Manager, with Ministerial approval, to issue standards and makes clear that such standards are binding only in their application to administrative units of the Public Service and agencies or instrumentalities of the Crown, subject to regulation (s 14(1)-(2)). The Manager may also make determinations about disposal, following Council approval (ss 7(c), 23, 24). The Act thus layers managerial rule-making, ministerial approval and Council oversight.

Access and public rights: The objects expressly include enabling public access to records in custody subject only to exceptions authorised under the Freedom of Information Act 1991 and equivalent local government law (s 5(1)(e)(i)). The Manager decides public access applications in accordance with the Act (s 26(4)), while agencies remain able to seek access and make determinations about restrictions in consultation with the Manager (s 26(1)).

Enforcement and remedies: The Act creates a criminal offence for unauthorised damaging or disposal of official records, with a maximum penalty of $10,000 or two years imprisonment, and empowers courts to order compensation (s 17). It gives the Manager power to require delivery of privately held official records and to seek Magistrates Court orders to compel delivery (s 21). It also contains protections for authors and officers acting under the Act (s 29), evidentiary presumptions for certified copies and certificates (ss 30, 31), and regulation-making power to prescribe fees and fines (s 33).

Council composition and procedures: The Council is a nine-member body appointed by the Minister, with specified categories required for membership (historian, archivist, records manager, CEO delegate from an agency, local government representative, business person, nominee of the Chief Justice, an Aboriginal researcher, and a public user of State Records) and minimum gender representation (ss 9(2), 9(4)). Its principal function is to approve disposal determinations and advise the Minister and Manager (s 10).

These concepts interact to create a regime where custody and long-term preservation are centralised, disposal is constrained by a Council-mediated approval mechanism, agencies retain operational access, and State Records has day-to-day decision powers including standard-setting, survey and recovery powers.

The Act affects a wide set of actors. The immediate and principal persons and bodies that the Act governs are:

• Agencies: The statutory definition encompasses executive and administrative bodies such as the Governor, Ministers, courts and tribunals, statutory officeholders, public service departments and units, the police, municipal and district councils, and any body declared by regulation to be an agency (s 3(1)(a)-(i)). Agencies therefore include most public-sector record creators in South Australia. The Act excludes Houses of Parliament and certain parliamentary officers and members (s 3(1)(j)-(m)), so parliamentary records sit outside this regime unless otherwise brought within it by regulation.

• The Manager of State Records and staff: The Manager is a public service employee heading the Office of State Records (s 6). The Manager decides on custody, issues standards (ss 7, 14), approves or declines voluntary transfers (s 18), may postpone compulsory delivery (s 19(3)), may exempt agencies from delivery requirements where facilities are adequate (s 19(4)), determines access conditions (s 26(2)), and has other statutory powers. Staff receive delegations under s 8.

• The State Records Council: Composed of nine Ministerially appointed members from prescribed categories (s 9(2)), the Council must approve disposals and advise the Manager and Minister on policy and standards (s 10). The Minister appoints the chair and sets terms (ss 9(3), 11). The Council participates in disposal determinations (ss 7(c), 10).

• Ministers and the Minister responsible for State Records: The Minister has roles including appointing the Council, receiving annual reports (s 32), making regulations via the Governor in Council (s 33), and, where disputes arise under disposal or access, may determine the matter on application (ss 23(4), 25(3)).

• Agencies’ senior executives and records managers: These individuals are the points of compliance. Agencies must maintain records in good order (s 13), follow Manager-approved arrangements for transfers (s 19(2)), cooperate with surveys (s 15(2)), and seek Manager determinations for disposal (s 23).

• Public users and researchers: Members of the public, researchers and local government applicants are directly affected by the public access and fee regime in s 26, and by the objects in s 5 which articulate the policy balancing preservation, privacy and FOI exceptions. The Council must include a member who is a public user (s 9(2)(i), 9(4)).

• Aboriginal communities engaged in historical research: The Manager has a function to assist in identifying records disclosure of which might constitute a contravention of Aboriginal tradition (s 7(f)). The Council must include an Aboriginal person engaged in historical research nominated by the relevant public service chief executive (s 9(2)(h)).

• Private holders of records and donors: Persons who hold official records otherwise than in an official capacity are subject to delivery notices under s 21. Donors who place non-official records into State Records custody do so under s 27 and may impose conditions that bind future Managers (s 27(2)).

• Courts: Records of courts are treated specially. While the mandatory delivery rule does not apply to court records (s 19(6)), the Governor may direct delivery of specified court records after consultation with relevant judges and the Manager. Also, evidentiary provisions treat official records from State Records as having the same value as if produced by the originating agency (s 30).

• The wider public service and local government: Standards issued by the Manager are binding as to administrative units of the public service and agencies or instrumentalities of the Crown, subject to any exclusions by regulation (s 14(2)). Local government access is explicitly linked to Part 5A of the Local Government Act 1934 and the Freedom of Information Act 1991 for public access exceptions (s 5(1)(e)(i), s 26(5)).

Who “pays” and who “decides”: Agencies incur costs of maintaining, cataloguing, preparing and transferring records, and may incur costs if a Manager refuses a transfer and requires ongoing storage or if the Manager inspects and revokes an exemption (s 19(4)-(5)). The Minister and Manager make key decisions, with the Council required to approve disposal determinations (ss 7, 10, 23). The Magistrates Court is the judicial mechanism to enforce delivery of privately held records (s 21).

The Act creates a network of duties for agencies and rights for agencies, State Records and the public. These statutory duties and rights determine operational obligations and procedural entitlements.

Agency duties:

• Maintenance: Every agency must ensure official records in its custody are maintained in good order and condition, subject to the Act (s 13). That is an ongoing operational duty.
• Transfer obligations: Subject to the Act, an official record must be delivered into State Records custody when the agency ceases requiring it for current administrative purposes, or during the year occurring 15 years after the record came into existence, whichever occurs first (s 19(1)). Delivery must follow Manager-approved arrangements including time, form and provision of reproduction devices where necessary (s 19(2)(a)-(c)). Agencies must also advise the Manager where delivered records are restricted in disclosure by other Acts or laws (s 20(1)).
• Non-disposal without authority: An agency must not dispose of official records except in accordance with a determination by the Manager with Council approval (s 23(1)). Requests by agencies for disposal determinations must be processed as soon as practicable (s 23(2)).
• Cooperation with surveys: Agencies must afford the Manager reasonable cooperation and assistance in the conduct of record management surveys (s 15(2)).

Manager and State Records rights and duties:

• Custody acceptance and refusal: An agency may voluntarily deliver records to State Records (s 18(1)), but the Manager may decline to receive records if necessary or appropriate (s 18(2)).
• Exemptions and postponement: The Manager may postpone delivery in accordance with standards, to enable appraisal and receipt, or if records are further required for current purposes or special reasons, with consultation (s 19(3)). The Manager may exempt an agency from delivery where the agency has sufficient and adequate storage and care facilities; such exemptions are subject to variation or revocation on inspection or application (s 19(4)-(5)).
• Standard-setting and guidance: The Manager may issue standards related to record management practices, following consultation with the Council and with ministerial approval as required (ss 7(h), 14(1)). Standards are binding in their application to administrative units of the Public Service and agencies/instrumentalities of the Crown (s 14(2)).
• Disposal determinations and conservation: The Manager has functions to make determinations about disposal with Council approval and to ensure organisation, retention, conservation and repair of records in custody (ss 7(a)-(c), 24(1)). Before disposing of a record in custody, the Manager must obtain the consent of the responsible agency and consult any person with a proper interest (s 24(3)).

Council duties:

• Disposal approvals and advice: The Council must approve determinations relating to disposal (s 10(a)) and provide advice to the Minister or Manager on record management policies (s 10(b)). It must meet at least quarterly and keep minutes provided to the Manager (s 12(1), (7)).

Public and agency access rights:

• Agency access: The agency responsible for a record in State Records custody has the right to access and to make or direct use of the record as it requires, subject to preservation conditions and time limits for possession where a record has been in existence for 15 years or more (s 25(1)-(2)).
• Public access: The agency, in consultation with the Manager, may determine that access is unrestricted save for Manager-imposed preservation conditions; alternatively the agency may determine restrictions on access (s 26(1)). Public applications for access must be made to the Manager in the prescribed manner and may attract fees (s 26(3)). The Manager decides such applications according to the determinations in relation to the record (s 26(4)).
• FOI and local government rights: The Act preserves the right to apply under the Freedom of Information Act 1991 or Part 5A of the Local Government Act 1934, and decisions under this Act are subject to those Acts if access is sought under them (s 26(5); s 5(1)(e)(i)).

Protections and evidentiary rights:

• Protection from liability: Authors of official records who deliver records to State Records incur no criminal, defamation, breach of confidence or other civil liability by reason of delivery (s 29(1)). Officers of State Records likewise have protection where they honestly believe the access decision is proper under the Act (s 29(2)). The Act also makes clear that granting access does not amount to authorising publication for defamation or confidence law purposes (s 29(3)).
• Evidentiary presumptions: An official record produced from State Records carries the same evidentiary value as if produced by the originating agency (s 30(1)). Certified copies or statements certified by the Manager are admissible as proof of contents in the absence of contrary proof (s 30(2)). A Manager’s certificate as to disposal is evidence of that fact absent proof to the contrary (s 31).

Enforcement and remedial duties:

• Offence and penalties: A person intentionally damaging, altering, disposing of or removing an official record without proper authority commits an offence carrying a maximum penalty of $10,000 or two years imprisonment, and the convicting court may order compensation to the Minister (s 17(1), (3)).
• Recovery powers: The Manager may issue written notices requiring private holders to deliver records to State Records, and may apply to the Magistrates Court for orders compelling delivery if notices are not complied with; the Minister may, at discretion, compensate the person who delivered a record as a result of such a notice or order (s 21).

Collectively, these duties and rights create a regime where agencies must manage, prepare and timely deliver records for long-term custody, the Manager exercises central control over receipt, standards and disposal subject to Council oversight, and the public and agencies retain conditional access rights with statutory protections and evidentiary facilitation.

The Act contains a combination of criminal and civil risk allocations, administrative enforcement mechanisms, and court-based remedies.

Criminal offence: Section 17 creates a specific criminal offence. A person who, knowing they lack proper authority, intentionally damages or alters an official record, disposes of an official record, or removes an official record from official custody commits an offence. The maximum penalty is $10,000 or imprisonment for two years. The section also clarifies that authority to dispose of official records may only be conferred by or under this Act or another Act (s 17(2)). A court that convicts a person under s 17 may also order the convicted person to pay compensation to the Minister as the court thinks fit (s 17(3)). The section preserves other criminal and civil rights and powers (s 17(4)).

Administrative enforcement: The Manager has several administrative enforcement and compliance mechanisms:

• Surveys and reporting: The Manager may conduct surveys of official records and record management practices and agencies must afford reasonable cooperation (s 15). If the Manager considers practices inadequate, the Manager must report the matter to the Minister (s 16). These processes enable identification and escalation of non-compliance.
• Notices for recovery: If the Manager believes a person has custody of an official record otherwise than in an official capacity, the Manager may issue a written notice requiring delivery into State Records custody within a specified period (s 21(1)). Failure to comply exposes the holder to court-ordered compulsion.
• Court enforcement: On non-compliance with a delivery notice, the Manager can apply to the Magistrates Court for an order compelling the person to deliver the record by a specified date (s 21(2)). The Minister may, at discretion, pay compensation for deprivation of the record where the person delivered the record following a notice or order (s 21(3)). This provides a civil enforcement path combining administrative notice and judicial compulsion.

Regulatory penalties: The regulations may prescribe fines of up to $2,500 for contravention or non-compliance with regulations under the Act (s 33(2)(b)). Regulations may also prescribe fees for services and waivers or refunds (s 33(2)(a)).

Dispute resolution: For disputes over disposal determinations or access rights, the Act provides a ministerial determination pathway. If there is a dispute as to a disposal determination under s 23, the Minister may, on application, determine the matter (s 23(4)). Similarly, if there is a dispute as to access under s 25, the Minister may determine the matter on application (s 25(3)). These provisions create an administrative appeal/decision mechanism terminating disputes short of judicial review.

Protections that affect enforcement exposure:

• Good faith protections: Section 29 protects authors and persons delivering records from criminal or civil liability by reason of delivering the records into State Records custody (s 29(1)). The Manager and officers are protected from criminal or civil liability for granting access where they honestly believe the decision is proper under the Act (s 29(2)). These protections limit the risk of collateral civil suits against public officers acting under the Act, which in turn affects practical enforcement by reducing the chilling effect on access decisions.
• Evidentiary facilitation: Sections 30 and 31 facilitate the use of records in legal proceedings by establishing evidentiary presumptions for certified copies and Manager certificates, which reduces litigation friction where State Records custody applies.

Operational enforcement: The Manager’s power to decline voluntary transfers (s 18(2)), to postpone delivery (s 19(3)), to exempt agencies with adequate facilities (s 19(4)) and to recall records kept elsewhere under arrangements (s 22(3)) are administrative controls that affect compliance incentives and enforcement pathways. The Manager must obtain agency consent and consult interested persons before disposing of a record in custody (s 24(3)), which imposes procedural constraints before a potentially final act.

Who enforces and who pays: Enforcement mechanisms involve the Manager initiating processes, the Magistrates Court ordering delivery where private possession persists, and criminal courts imposing penalties if an offence under s 17 is proven. Agencies bear practical costs of compliance such as storage, cataloguing and preparing transfers; statutory fines target individuals or entities breaching regulations, while criminal penalties target intentional wrongdoing to destroy or remove records.

The Act is drafted to operate alongside and, in specific respects, to prevail over other legal regimes. Its interactions are explicit in several provisions.

Freedom of Information and Local Government Acts: The objects of the Act explicitly state that public access to records in State Records custody is to be subject only to exceptions or restrictions that would be authorised under the Freedom of Information Act 1991 or Part 5A of the Local Government Act 1934 (s 5(1)(e)(i)). Section 26(5) further preserves a person’s ability to apply for access under those Acts and makes a determination or decision under the State Records Act subject to the provisions of those Acts if access is sought under them. Practically, State Records decisions about public access sit alongside FOI processes and local government access regimes; they do not supplant them.

Commonwealth archives law: The Act excludes Commonwealth records as defined by the Archives Act 1983 of the Commonwealth from the definition of “official record” (s 3(1)(d)), and excludes records transferred to the Commonwealth (s 3(1)(e)). This preserves the separation between State and Commonwealth archival regimes where federal law governs custody and access.

Secrecy and other restrictive legal provisions: Section 28 provides that official records may be delivered into State Records custody as required or authorised under this Act despite any other Act or law that prevents or restricts disclosure of official information or information gained in the course of official duties. That is an express override of contrary secrecy provisions, limited to delivery into custody. Nevertheless, where disclosure is restricted by other Acts or law at the time of delivery, agencies must advise the Manager of that restriction (s 20(1)). The Act does not itself override all legal restrictions on public access; s 5(1)(e) ties public access to FOI and local government law exceptions.

Court records and judicial consultation: The mandatory delivery provisions do not apply to records of a court, but the Governor may direct specified court records be delivered into State Records custody after considering submissions from the judge or magistrate in charge of the court and the Manager (s 19(6)). This creates a consultative mechanism recognising judicial independence and the special status of court records.

Regulatory interaction and exclusions: The Governor may, by regulation, exclude or modify the application of the Act to agencies or official records (s 4). Regulations may also exclude particular agencies or instrumentalities from standards binding under s 14(2). This enables selective interaction between the Act and other bodies by regulation.

Evidentiary overlap with legal proceedings: The Act provides that an official record produced from State Records has the same evidentiary value as if produced from the agency from which it was obtained (s 30(1)). Certified copies by the Manager are admissible as proof of contents in the absence of contrary proof (s 30(2)). A Manager’s certificate about disposal is evidentiary (s 31). These provisions are intended to smooth litigation involving historical records and to reduce the need to obtain originals from agencies for admissibility.

Civil liability regimes: Section 29(1) and (2) create statutory protections from criminal liability, defamation, breach of confidence or other civil liability for authors delivering records and for State Records officers granting access where they act honestly and under the Act. However, s 29(3) stresses that granting access does not amount to authorising publication and hence does not itself displace defamation or breach of confidence law in relation to publication by a third party.

Transitional statutory interaction: The Act amended and interacts with several statutes at commencement, including the Freedom of Information Act 1991, the Libraries Act 1982 and the Local Government Act 1934, with transitional provisions dealing with records formerly in the custody of the Libraries Board of South Australia (Schedule cl 1-3). The Legislative History lists subsequent amendments that changed particular subsections (see “Amendment history”).

In short, the Act operates as a state-level custodial and access framework that preserves FOI pathways, recognises Commonwealth archival jurisdiction, enables regulatory tailoring, and provides evidentiary and liability adjustments to facilitate the central custody model. Where it conflicts with other statutes on delivery into custody, s 28 empowers delivery notwithstanding secrecy provisions, but public access remains anchored to FOI and local government law exceptions.

The statute includes a legislative history annex summarising amendments since enactment. Key chronological points in the principal Act’s history are as follows:

• Enactment and commencement: The State Records Act 1997 received assent on 20 March 1997 and commenced on 31 October 1997 (Gazette 4.9.1997 p612), as recorded in the Legislative History.

• Statutes Amendment (Attorney-General’s Portfolio) Act 1998: No 59 of 1998 effected amendments with commencement noted for Part 11 (section 20) on 13 December 1998. The legislative history indicates s 19(6) was substituted by 59/1998 s 20 (see “Provisions amended” and “Legislative history”), which concerns the non-application of mandatory delivery to court records and the Governor’s power to direct delivery after consultation.

• Statutes Amendment (Public Sector Consequential Amendments) Act 2009: No 84 of 2009 amended aspects of the Act; the legislative history notes commencement on 1 February 2010 for particular provisions including Pt 149 (s 342),with s 9(2) specifically amended by 84/2009 s 342(1), (2). The effect reported in the Provisions amended table is that s 9(2) was amended as of 1 February 2010. Section 9(2) concerns the composition and categories of Council members.

• Omissions and reprints: The legislative history notes that certain clauses and sections were omitted under the Legislation Revision and Publication Act 2002: for example, s 2 was omitted, and Schedule clauses 1-3 were omitted under that Act. A reprint occurred on 13 December 1998 (Reprint No 1).

• Textual notes: The Legislative History includes a caution that references to other legislation, instruments and titles of bodies or offices are not automatically updated; earlier versions of the Act are listed at the end of the legislative history, and readers are referred to the Index of South Australian Statutes and the official website for subordinate legislation made under the Act.

Practical effect of amendments visible in the text:

• The substitution in s 19(6) (1998 amendment) enshrines the special position of court records and the Governor’s consultative power to direct delivery, reflecting a policy choice to protect judicial records while enabling transfer after consultations.
• The amendment to s 9(2) in 2009 changed Council composition requirements. The current text of s 9(2) specifies nine categories of appointments. The legislative history records that change; to understand the exact pre- and post-amendment wording one must consult the historical versions or the amending Act text.

The Act’s amendment history, as recorded, is concise. The schedule of specific amending Acts and provisions is: State Records Act 1997 No 8 (assent 20.3.1997; commencement 31.10.1997), Statutes Amendment (Attorney-General’s Portfolio) Act 1998 No 59 (assent 3.9.1998; relevant provision s 20 commenced 13.12.1998), and Statutes Amendment (Public Sector Consequential Amendments) Act 2009 No 84 (assent 10.12.2009; Pt 149 s 342 commenced 1.2.2010). The Legislative History table records these amendments and the provisions varied.

Readers seeking precise amendment wording and the historical text for compliance or litigation should consult the amending Acts and reprints referenced in the Legislative History and the South Australian legislation database referenced in the Act’s notes.

The text of the Act does not list or cite any judicial decisions or litigation outcomes. The statute itself contains internal dispute resolution and evidentiary provisions but does not record case law. Consequently, there is no litigation history included in this instrument that names cases or reports judicial interpretations.

Practical implications and potential litigation pathways that arise from the statutory architecture include:

• Enforcement prosecutions under s 17 for unauthorised damaging or disposal of official records, which would proceed in criminal courts where facts support intentional and unauthorised conduct. The Act gives courts authority to order compensation to the Minister on conviction (s 17(3)).
• Civil actions concerning refusal or conditions of access. Although the Act confers decision-making to the Manager and agency and preserves FOI avenues, administrative law challenges (judicial review) may be possible against decisions made by State Records or by the Minister under ss 23(4) and 25(3), on grounds of jurisdictional error, procedural fairness, or irrationality, subject to court jurisprudence not contained in the Act.
• Disputes over delivery notices and recovery of records from private holders involve the Magistrates Court as the statutory enforcement mechanism under s 21. A person subject to a delivery notice may resist on factual or legal grounds, leading to a contested court process under s 21(2).
• Evidentiary use in litigation: Sections 30 and 31 create statutory presumptions intended to limit evidentiary disputes over authenticity and disposal. Challenges might arise where an apparent certified copy is contested, but the Act places the evidentiary burden on the party asserting contrary proof.

Because the Act provides processes for ministerial determination of disputes (ss 23(4), 25(3)), many disputes are first channelled into administrative resolution, which may reduce immediate litigation. However, the availability of judicial review and civil remedies remains an external possibility, though the Act’s provisions such as s 29(2) supply protective defences for officers acting honestly.

For an exhaustive litigation history, practitioners must search South Australian and federal case law databases for decisions involving state records, delivery notices, disposal determinations, s 17 prosecutions, disputes about access, and judicial review of State Records decisions. This statutory text does not contain such cases and therefore does not provide authoritative guidance on how courts have interpreted particular provisions, procedural requirements for appeals, or evidentiary standards beyond what the Act itself prescribes.

The Act contains several technical features and drafting points that can catch practitioners and administrators if not carefully tracked. The following issues are grounded in the text and matter for operational attention.

Timing of mandatory delivery and the 15-year rule: Section 19(1) uses a dual trigger , delivery is required when an agency ceases to require a record for current administrative purposes, or during the year occurring 15 years after the record came into existence, whichever first occurs. Section 3(4) provides that a record is taken to have come into existence on 31 December of the year in which it came into existence. This dating rule means that the “15 years” calculation is pegged to year-end, not to the precise creation date. That can advance or delay a transfer by up to 12 months depending on the true creation date, affecting retention scheduling and transfer logistics. Practitioners must adopt the statutory dating rule in operational retention schedules to avoid premature or late transfers.

Narrow exclusions from “official record”: The definition of “official record” contains multiple exclusions: records delivered to non-agency third parties, drafts not for further use, items in library or museum collections not associated with agency business, Commonwealth records, and transferred Commonwealth records (s 3(1) official record (a)-(e)). Records that may appear “official” in practice could fall outside the regime if they meet these exclusions. Agencies should determine whether material is captured by the statutory definition before applying the Act’s transfer and disposal rules.

“Dispose” excludes transfer to State Records: The statutory definition of “dispose of an official record” explicitly excludes transfer to State Records or transfers between agencies (s 3 dispose). As a result, the prohibition on disposal absent a Manager/Council determination in s 23 does not inhibit transfers to State Records or between agencies. This is an important drafting nuance , disposal rules seek to prevent destruction or alienation outside the statutory pathways but do not stop transfers to the central custodian.

Manager’s dual standard-making references: The Act contains two related provisions on standards: s 7(h) gives State Records a function “to issue standards (following consultation with the Council) relating to record management,” while s 14(1) states “The Manager may, with the approval of the Minister, issue standards” and s 14(2) limits their binding effect. The presence of both provisions suggests procedural steps for standards: consultation with the Council, and ministerial approval where the standards are to be issued by the Manager. Practitioners should check any procedural requirements and whether a given standard is ministerially approved so as to assess binding effect under s 14(2).

Exemptions and revocation risk: The Manager may exempt an agency from mandatory delivery where the Manager is satisfied the agency has sufficient and adequate facilities (s 19(4)). However, that exemption is subject to variation or revocation by the Manager, including on inspection (s 19(5)(b)). Agencies relying on self-storage to avoid transfer should be prepared for periodic inspections and potential revocation, and must manage the risk of abrupt transfer requirements if exemption is revoked.

Voluntary transfer may be declined: Although agencies may voluntarily deliver records to State Records (s 18(1)), the Manager may decline to accept such records where the Manager judges it necessary or appropriate (s 18(2)). Voluntary delivery is therefore not a one-way delegation of responsibility; the Manager retains curatorial discretion.

Court records special treatment: Mandatory delivery rules do not apply to court records (s 19(6)). However, the Governor may direct specified court records be delivered after consultation. That consultative barrier can delay centralisation of historical court records and can produce complexity where records have mixed provenance or are part-court, part-administrative.

Evidentiary presumptions and potential rebuttal: The Act treats copies certified by the Manager as proof of contents in absence of contrary proof (s 30(2)), and a Manager’s certificate of disposal is evidence absent contrary proof (s 31). These presumptions facilitate use, but they are rebuttable , practitioners should preserve chain-of-custody, consideration of originals and any contrary material for litigation-sensitive records.

Public access fees and formality: Applications for public access must be made to the Manager in the manner and form and accompanied by the fee (if any) prescribed by regulation (s 26(3)). Failure to comply with prescribed formalities or fees could delay or impede access. Practitioners advising researchers should check the current regulations for fees and application forms.

Overlap with FOI: Decisions under this Act are subject to FOI or local government law where access is sought under those Acts (s 26(5)). Individuals can pursue FOI avenues for records in State Records custody, which may produce different procedural timeframes and review rights than the State Records Act’s own processes. Agencies must track which route applicants take.

Liability protection carve-outs: Section 29 offers protection against criminal or civil liability for authors and officers acting under the Act, but those protections hinge on the honesty of the decision-maker’s belief regarding the propriety of access (s 29(2)). That standard requires managers to document decision-making rationales to rely on the protection if challenged.

Regulatory scope and fines: Regulations may exclude or modify application of the Act to agencies or records (s 4), and may prescribe fees and fines up to $2,500 for breach of regulations (s 33(2)(a)-(b)). Agencies should be attentive to subordinate instruments that may materially change operational obligations.

Ministerial determination as final arbiter: The Act provides that the Minister may determine disputes on disposal and access (ss 23(4), 25(3)). That centralised dispute mechanism is administratively final unless judicial review is later sought; stakeholders should be aware of that pathway and its implications for contesting decisions.

These are not legal conclusions but operational “gotchas” derived from the Act’s text that affect scheduling, compliance, risk allocation and administrative practice.

To comply with the State Records Act 1997, agencies and responsible officers should adopt a practical, documentable programme that aligns statutory triggers, Manager approvals, standards and audit trails. The following steps are grounded in the statutory text and indicate concrete compliance actions.

1. Map and classify records against the statutory definition:

   • Identify which records are “official records” per s 3 and which meet any exclusions (s 3(1) official record). Classify records accordingly so transfer and disposal rules are applied correctly.

2. Implement a retention schedule consistent with the 15-year rule and s 3(4):

   • Use the Act’s dating convention, treating a record as coming into existence on 31 December of the year of creation (s 3(4)), when calculating the 15-year delivery trigger in s 19(1). Document how creation dates are recorded and calculated.

3. Maintain records in good order and condition:

   • Comply with the agency duty in s 13 by establishing physical and digital preservation standards. Prepare for Manager surveys under s 15 and remedial reporting to the Minister under s 16.

4. Prepare for transfer mechanics:

   • Follow Manager-approved arrangements for delivery under s 19(2) including time, form, and provision of devices necessary to reproduce information (s 19(2)(a)-(c)). Create packing, metadata, and transfer protocols that meet likely Manager requirements and that preserve chain-of-custody evidence.

5. Seek early consultation for postponement or exemptions:

   • If records are still required for current administrative purposes, apply for postponement under s 19(3) in accordance with record management standards, and document reasons and consultation with the Manager. If the agency has adequate storage and seeks an exemption under s 19(4), prepare to evidence facilities and agree to inspections because the Manager may vary or revoke exemptions (s 19(5)).

6. Do not dispose of records except with a Manager determination approved by the Council:

   • Under s 23(1), an agency must not dispose without a Manager/Council determination. When disposal is sought, apply to the Manager and follow s 23(2) timelines. If the Manager makes a determination, ensure it has Council approval and document the decision. If dispute arises, note that the Minister may determine the matter (s 23(4)).

7. Comply with advice and standards:

   • Monitor and comply with standards issued under s 7(h) and s 14. Confirm whether standards have Ministerial approval where binding effect under s 14(2) is relevant. Incorporate standards into agency record management policies and training.

8. Notify restrictions and handle restricted material conscientiously:

   • When delivering records whose disclosure is restricted by other Acts, ensure the Manager is advised of the restriction as required by s 20(1). Maintain a register of any statutory confidentiality or privacy constraints that may affect later access.

9. Be prepared for recovery notices and court enforcement:

   • If records are in private hands, be ready to comply with written notices from the Manager under s 21(1). If subject to a notice, consider legal grounds for contesting the order before the Magistrates Court and document ownership and provenance.

10. Create access protocols and fee handling:

• For agency access under s 25, agree with the Manager on conditions to ensure preservation and limit resumption of possession for records 15 years or older to what is reasonably necessary (s 25(2)). For public access, set up application procedures to take applications under s 26(3) in the prescribed form and collect any fees under regulations. Maintain logs of access and decisions because s 26(4) requires the Manager to decide applications in accordance with determinations.

11. Preserve devices and reproduction means:

• Where records require devices to reproduce information, ensure those devices are preserved or access is provided as part of delivery arrangements (s 19(2)(c)). Document device availability and compatibility issues.

12. Document decision rationales and record Manager interactions:

• Given the protections in s 29(2) hinge on honest belief about propriety, managers should keep clear records of decision rationales and consultations. Similarly, record all communications with State Records, Council approvals and consent for disposal to preserve evidentiary trails for ss 30 and 31.

13. Train staff on the offence provision:

• Educate staff about s 17 offences for unauthorised damage, disposal or removal of official records, including potential penalties and court-ordered compensation. Ensure a clear delegation and authorisation policy so that only proper authorities act to dispose.

14. Engage Council and Minister where required:

• For disposal or dispute scenarios expect Council involvement and potential Ministerial determination. Plan for timelines and documentation to support Manager/Council consideration under ss 23 and 24, including obtaining agency consent and consulting persons with proper interest before disposal (s 24(3)).

15. Monitor regulations and subordinate instruments:

• Regularly check regulations under s 33 for fees, prescribed forms and any agency-specific exclusions or modifications under s 4. Regulations may impose operational costs or fines for non-compliance with regulatory obligations (s 33(2)).

16. Prepare annual reporting and internal audit:

• The Manager must report annually to the Minister (s 32). Agencies should prepare internal reports documenting transfers, disposals, exemptions and access requests to support any Manager inquiries and to ensure audit readiness.

Checklist for transfers and disposals:

• Confirm record is an “official record” and note any exclusions (s 3).
• Calculate “came into existence” date per s 3(4) and apply 15-year rule (s 19(1)).
• Engage Manager early for transfer arrangements and device provision (s 19(2)).
• If disposal is intended, apply for a Manager determination and obtain Council approval (s 23).
• Before disposal by Manager, obtain agency consent and consult interested parties (s 24(3)).
• Keep records of all decisions, approvals and consents for evidentiary purposes (ss 30, 31).

Adopting this set of practices aligns everyday recordkeeping and retention policies with the statutory duties and reduces the risk of unauthorised disposal, enforcement action or interruption to administrative access.
