State Laws and Records Recognition Act 1901

Definitions and scope: Section 2 defines the key terms that determine the Act’s reach. "Court" is broadly defined to include judges, justices, arbitrators under any Act or State Act, and any person authorised by law or by consent of parties to hear, receive and examine evidence (s 2). "Courts within the Commonwealth" expressly covers the High Court, all Federal Courts and Courts exercising federal jurisdiction, the Inter-State Commission when sitting as a Court, and all State courts (s 2). The Governor of a State is defined in the conventional manner (s 2). These definitions give the Act a broad institutional application, extending to non‑traditional adjudicative forums prescribed by statute or consent.

Judicial notice and mandatory acceptance: Sections 3-5 establish mandatory judicial notice rules. Section 3 requires Courts to take judicial notice of Acts of State Parliaments. Section 4 requires judicial notice of the impression of a State seal without further evidence of the fact of impression. Section 5 requires judicial notice of the signature of a specified list of State officers (governors, judges of Supreme Court, registrars, registrars-general, statisticians, magistrates, justices of the peace and other corresponding offices) and of the seal of courts or persons listed, where such signatures or seals purport to be attached to judicial or official documents. Section 5 also permits the Governor‑General to add offices to the list by Order published in the Gazette. The form is mandatory: "shall take judicial notice", which turns documentary tokens into presumptively self‑authenticating features in Commonwealth proceedings.

Modes of proof and forms of admissibility: Sections 6 to 17 form the technical core. They specify acceptable evidence for various categories:

• Proclamations, commissions, orders and regulations: s 6 lists four permissible proofs (Government Gazette; a printed copy said to be by the Government Printer or by State authority; certified copy by the Clerk of the Executive Council where the Governor issued it; certified copy by a State Minister where issued by/under authority of the Minister). Section 6(2) removes the need to prove the handwriting or official position of persons certifying under s 6.
• Proclamations and acts of State can also be proved by examined copy or sealed copy (s 7).
• Public documents admissible under State law in that State without proof of seal, stamp or signature, or without proof of signatory’s character, are to be admissible in Commonwealth courts on the same terms (s 9).
• Where a State Act prescribes forms (seal, stamp, signature) for public documents, records and certified copies, such documents will be admitted in Commonwealth courts where they purport to be sealed, stamped or signed as directed by that State Act, without proof of seal or signatory or official character (s 8).
• Public books and documents where the original is admissible on production in the State are admissible by examined copy or certified copy by an officer who certifies custody (s 10).
• Votes and Proceedings (Parliamentary journals/minutes and papers printed by the Government Printer) are admissible on mere production (s 11).
• The Government Gazette and papers printed by the Government Printer are to be accepted as such on mere production (ss 12-13).
• Evidence of acts by Governors or Ministers may be evidenced by production of the Government Gazette containing notification (s 14).
• By‑laws and regulations printed by the Government Printer or by authority are evidence of their making and, where they state so, of approval or confirmation by the Governor (s 15).
• Company incorporation and registered instrument proofs via registrar certificates and certified copies are admissible (s 16).
• Judicial proceedings of State courts (judgments, decrees, rules, affidavits, pleadings) may be proved by examined copy, sealed copy, or by a judge’s signature stating the court has no seal, and such signature is treated as sufficient without proof of judicial character (s 17).

Faith and credit and preservation of other powers: Section 18 requires that public acts, records and judicial proceedings of a State, when proved or authenticated as required by the Act, be given the same faith and credit in every Commonwealth Court and public office as they have in the originating State. Section 19 makes explicit that the Act supplements and does not derogate from powers at common law or given by any State law.

Taken together these concepts create a uniform procedural architecture: specified documentary forms produce automatic admissibility and judicial notice across Commonwealth jurisdictions; State statutory forms and practices determine admissibility in Commonwealth courts where the State law provides for admissibility without proof; and registrars, ministers and clerks are placed as authorised certifiers whose certifications remove ordinary proof burdens.

The Act distributes burdens, entitlements and conveniences across multiple actors. The most directly affected categories are:

• Courts within the Commonwealth: The Act binds courts to take judicial notice and to accept specified proofs (ss 3-7, 17-18). "Courts within the Commonwealth" is defined inclusively to cover the High Court, federal courts and State courts and also the Inter‑State Commission when sitting as a Court (s 2). The obligation is mandatory, "shall", which changes court practice by limiting the evidentiary enquiries courts may demand as a precondition to admitting State documents in specified forms.
• State governments and their officers: State executive officers (Governors, Ministers, Clerk of the Executive Council), judicial officers, registrars, registrars‑general, statisticians and other listed offices acquire procedural significance because their signatures, seals and certifications are expressly declared self‑authenticating for specified documents (s 5; s 6; s 16). The Act makes it administratively cheaper for State agents to have their official acts and records treated as evidence in Commonwealth fora by relying on existing State publicity mechanisms (Government Gazette, Government Printer, registrar certifications).
• Litigants and parties in Commonwealth proceedings: Private litigants, corporations and other parties benefit from the reduced documentary burden when bringing State documents into Commonwealth proceedings , for instance, company incorporation certificates certified by the State registrar will be evidence of incorporation and date (s 16). Conversely, parties defending against documents will face a regime in which certain proofs are admitted without additional authentication, which shifts strategic behaviour: parties must be prepared to challenge the substance rather than the authenticity, or to mount rebuttal evidence notwithstanding the statutory presumptions.
• Registrars, clerks and certifying officers: Officials responsible for custody of documents, certification and printing (Government Printers, Clerks of Executive Councils, State registrars) have a procedural role; the Act treats their certifications as sufficient and removes the need for proof of handwriting or official position in several instances (s 6(2), s 10(b), s 16).
• Arbitrators and private tribunals: Because "Court" includes arbitrators under any Act or State Act and persons authorised to receive evidence by law or consent (s 2), the Act's evidentiary concessions extend to some non‑judicial dispute resolution fora established by statute or consensual submission. Where an arbitrator is empowered under a State Act, documentary modes prescribed by this Act will apply.
• The Executive at Commonwealth level: The Governor‑General has a specific administrative role via s 5, allowing expansion of the list of offices whose signatures will be judicially noticed by Order published in the Gazette. That confers discretion for future categorical expansions.

Who pays and who decides: The principal transaction cost reduction benefits flow to litigants and State governments , they save time and expense on cross‑jurisdictional authentication. Courts cede some investigative cost (they may rely on statutory forms rather than conducting independent proof), but retain adjudicative authority on substantive matters. There are no penal sanctioning mechanisms in the Act for false or fraudulent certification; therefore, costs of fraudulent or mistaken documents fall to parties who must rebut or to courts that must assess substantive truth , the Act does not shift those costs to State certifiers or create penalties.

Behavioural effects: State authorities will have incentives to use the Government Gazette and Government Printer in ways that the Act deems self‑authenticating; registrars and clerks will bear the operational responsibility of providing certified copies. Parties bringing evidence will prefer to use the forms prescribed by the Act to avoid authentication disputes. Some private actors may alter litigation strategy in response to the reduced authentication burden of State documents, concentrating litigation effort into factual contestation rather than formal proof of authenticity.

Duties imposed on courts and officers:

• Mandatory judicial notice: Courts within the Commonwealth are obliged to take judicial notice of Acts of State Parliaments (s 3) and the impression of State seals (s 4). They must also take judicial notice of specified official signatures and seals when affixed to judicial or official documents (s 5). The duty is framed as "shall take judicial notice", converting what might otherwise have been discretionary judicial practice into a statutory command.
• Acceptance of specified documentary proofs: Courts "shall admit" (or "shall take" / "shall be admitted") various State documents on production in the forms enumerated across ss 6-17. For example, production of the Government Gazette is evidence of publication and date (s 12); a paper purporting to be printed by the Government Printer is evidence of that fact (s 13); a registrar's certificate of incorporation is evidence of incorporation and of the date of incorporation (s 16). These are duties laid on judicial officers and court clerks in the exercise of their evidentiary functions.
• Preservation of other powers: The Act expressly states it is "in addition to and not in derogation of any powers existing at common law, or given by any law at any time in force in any State" (s 19). That is a duty to read the Act alongside existing powers rather than as an exhaustive code.

Rights and presumptions created for parties and officials:

• Self‑authenticating documents: State authorities and the persons who produce documents in the specified modes obtain the practical "right" that their instruments will be admitted without further proof of seal, signature or official character where the Act provides (see ss 6-11, 13-17). This is not a substantive right against liability for content; it is an evidentiary entitlement.
• Reduced proof burden for certifiers and custodians: Section 6(2) explicitly states "No proof shall be required of the handwriting or official position of any person certifying in pursuance of this section." That immunises the certifier's handwriting or title from further proof in the specified contexts, streamlining the admissibility process.
• Faith and credit: When State public acts, records and judicial proceedings are proved or authenticated as the Act requires, they are to be given "such faith and credit" in Commonwealth courts and public offices as they have in the originating State (s 18). This is a substantive rule of comity: authenticated State acts have the same evidentiary weight in Commonwealth fora as in their State fora.

Discretion and administrative levers:

• Governor‑General’s Order adding offices: Section 5 includes an administrative discretion for the Governor‑General to declare by Order published in the Gazette additional offices to which s 5 applies. That is a procedural lever allowing expansion of the list of officials whose signatures and seals are judicially noticed.
• Court procedures otherwise intact: While the Act prescribes acceptance of certain forms of proof, it does not remove judicial control over reception of evidence beyond the specified self‑authenticating modalities. Courts retain their substantive adjudicative powers and procedural discretion not otherwise displaced by the Act.

Limits and caveats in duties and rights:

• Scope depends on State law in some cases: Sections 8-9 import State law on admissibility , if a State Act makes a public document admissible without proof in State courts, then a Commonwealth court must admit it to the same extent and for the same purposes. That ties Commonwealth evidentiary outcomes to State legislative choices. The Act therefore creates rights in parties that are contingent on State law as it stands.
• No statutory penalties: There are no penal or enforcement provisions in the Act that punish misuse, false certification or fraudulent documents. The Act’s mechanisms are evidentiary and procedural; responsibility for detecting and remedying falsity remains with parties and courts under general law.

The Act contains no penal provisions, fines, criminal offences, or express administrative sanctions concerning false statements, false certification or misuse of the evidentiary paths it creates. Enforcement operates procedurally and through judicial practice rather than by statutory penalties. The enforcement architecture and its implications are as follows:

• Procedural enforcement through acceptance/refusal of evidence: The Act prescribes when certain documents must be accepted as evidence in Commonwealth courts (ss 6-17). The primary enforcement mechanism is therefore the court's reception, or refusal, of evidence according to the statutory rules. Where a document meets the Act's specified form, courts are statutorily obliged to admit it or take notice (see ss 3-5, 6-7, 11-17). Conversely, a document not satisfying the prescribed form may be excluded or require further proof under ordinary rules of evidence.
• No statutory sanctions for improper certification: The Act does not create an offence for producing a falsely certified document, nor does it specify civil liability for a certifier who misstates facts in a certification. The absence of statutory penalties means remedies for fraud or false certification must be sought under general law (fraud, perjury, contempt, statutory offences where applicable, or civil actions for misrepresentation) rather than under this Act. The Act neither shifts nor adds enforcement costs to State certifiers by way of specified penalties.
• Reliance and rebuttal: Because the Act removes certain authentication burdens (for instance, no proof is required of a certifier's handwriting or official position in s 6 circumstances), the remaining means of enforcement against a falsely certified document are rebuttal evidence, cross‑examination on content, collateral proof of falsity, or contempt/perjury proceedings where applicable. The text does not provide a statutory privilege or immunity for false content, it simply reduces preliminary authentication hurdles.
• Administrative oversight and risk allocation: The statutory design allocates verification costs in favour of accepting State documentary forms. In effect, where State documents comply with the modalities the Act prescribes, courts and litigants are expected to accept them and litigants bear the burden of challenging the documents’ substantive truth rather than their formal authenticity. This is an enforcement design choice that reduces duplicate authentication procedures but increases the importance of substantive challenge mechanisms.
• Judicial remedies remain available: The Act does not restrict courts from exercising inherent powers to control proceedings, order investigations, or address abuses of process. Those powers, however, are not created by the Act; the Act operates alongside them. Section 19 expressly states the Act is "in addition to and not in derogation of any powers existing at common law, or given by any law at any time in force in any State." Thus enforcement of improper certifications would typically proceed under existing common law remedies or other statutory regimes.

In short, the Act enforces its provisions by compelling courts to accept specified forms of State-authenticated documents as evidence, rather than by creating new penal or administrative sanctions. The practical enforcement consequence is reduced authentication friction but a potential shift of risk toward parties and courts to detect and address falsity through general law channels rather than through Act-specific penalties.

The Act operates as an evidentiary overlay; its interaction with other laws is governed within the text itself. Key interaction points are:

• Dependence on State law for admissibility rules: Sections 8 and 9 explicitly import State statutory standards. If a public document is admissible in a State court without proof of seal, stamp or signatory character by State law, then it is admissible in Commonwealth courts "to the same extent and for the same purposes" (s 9). Section 8 likewise provides that documents that a State Act requires to be sealed, stamped or signed as directed are admissible in Commonwealth courts where they purport to comply. Thus Commonwealth admissibility is conditional upon the documentary standards and exceptions that State laws create. The Act therefore aligns Commonwealth evidentiary outcomes with State legislative choices and creates a form of statutory comity grounded in State regimes.
• Supplementing rather than supplanting common law and State statutes: Section 19 states that the Act is "in addition to and not in derogation of any powers existing at common law, or given by any law at any time in force in any State." The effect is that the Act does not oust other evidentiary mechanisms; it provides parallel, supplementary routes for proof. Where other statutes or common law provide additional or alternative routes, those remain available.
• Interaction with constitutional principles of comity: Section 18 directs that authenticated State acts, records and judicial proceedings shall have in Commonwealth courts "such faith and credit" as they have in the originating State. That phrasing echoes constitutional expectations of inter‑jurisdictional recognition and comity. The marginal note references "See Constitution s. 118", but the body text operates as a statutory rule specifying the required faith and credit once authentication under the Act has occurred. This statutory command interacts with any constitutional or common law principles that may govern interstate judicial recognition, by prescribing a baseline of equivalence in evidentiary weight for authenticated State materials.
• Administrative orders and expansion of scope: Section 5 permits the Governor‑General to declare by Order published in the Gazette additional offices to which the judicial notice provision applies. This creates a mechanism for future harmonisation or expansion of the list of officers whose signatures and seals are self‑authenticating, and it interacts with executive administrative law by vesting that expansionary discretion in the federal executive.
• Application to arbitral and non‑court fora: Because "Court" includes arbitrators under any Act or State Act and persons authorised to receive evidence by law or consent, the Act interacts with statutory regimes that create arbitration or tribunal processes. Where a State Act empowers an arbitrator, the evidentiary shortcuts in this Act will typically apply, subject to the rules of the particular tribunal and any relevant statutory modifications.
• No statutory displacement of criminal or civil liability regimes: The Act does not create criminal offences nor civil causes of action concerning false certification; thus, laws that already create penalties for perjury, forgery, fraud or false statutory declarations will continue to operate unimpaired. Parties seeking to address fraudulent documents rely on those separate legal regimes; the Act does not alter their scope.

Operational consequence of these interactions: The Act links Commonwealth evidentiary practice to the content of State law in critical respects. It both simplifies federal court proof by accepting State modes of authentication and preserves pre‑existing common law and statutory powers, thereby creating a layered evidentiary framework rather than a single comprehensive code.

The text provided is the original Act as enacted and assented to on 5 September 1901 (preamble: "An Act to provide for the recognition throughout the Commonwealth of the Laws, the Public Acts and Records, and the Judicial Proceedings of the States"; assent date recorded). The statute itself contains no textual amendments, schedules of amendment, or later‑date modifications within the supplied material. The marginal notes and in‑text parenthetical references cite antecedent colonial or State enactments (for example "See Qd., 62 Vic. No. 15, s. 3. Fed. Council 49 Vic. No. 2." and similar references beside many sections) but do not constitute amendments to the present Act; rather they record antecedent sources or comparative provisions.

Because the supplied instrument contains only the original text and no express amending provisions, the following points flow from the source as given:

• Original enactment details: The Act is labelled "No. 5 of 1901" and records assent on 5th September 1901. Those particulars identify the statute as one of the early Commonwealth Acts aimed at cross‑jurisdictional recognition of State legal instruments.
• No subsequent amending provisions included: There are no schedules or later dated notes within the provided text indicating repeal, substitution or amendment to any substantive section. The text therefore should be read as the original statutory language unless and until replaced by subsequent legislative instruments.
• Preservation clause: Section 19 operates as a static clause at enactment, stating the Act is "in addition to and not in derogation of any powers existing at common law, or given by any law at any time in force in any State." That clause is part of the original architecture and indicates the drafters’ intent that the Act not displace pre‑existing statutory or common law powers.

Practical implication for readers: The supplied text does not record any post‑enactment changes. For current application or practice one must consult a later consolidated statute book or the official legislative database to confirm whether amendments, repeals, or consequential changes have since been made. The Act as provided, however, stands complete in its original form with the provisions described in earlier sections (ss 1-19).

The statutory text supplied contains no recorded case references, decisions, reported litigation, judicial construction or annotated judicial history. There are in‑text marginal "See" cross‑references to colonial or State enactments (for example "See N.S.W., No. 11, 1898, s. 18." alongside s 6 and similar marginal notes), but these are bibliographical references to antecedent statutes, not to judicial decisions.

Because no litigation history is included within the provided material, the following are the only claims that can be made from the source itself:

• No cases are cited in the text supplied: The Act, as given, contains no judicial citations or examples of how courts have applied its provisions.
• No statutory interpretation history in the document: The text does not record any subsequent judicial reinterpretation, declaratory judgments, or appellate treatment within the document.

What this means for practice: Readers requiring authoritative guidance on judicial interpretation of the Act must consult case law databases and reported decisions. The Act’s language presents several points likely to have generated litigation in practice (for example, the permissible scope of "examination" for examined copies; the meaning of "purporting to be printed by the Government Printer"; the application of s 8 and s 9 where State laws differ; the effect of s 6(2) removing proof of handwriting), but such adjudications are not recorded in the statutory text provided. The Act’s own marginal references to the Constitution (near s 18) signal areas where constitutional materials and judicial interpretation intersect; again, the statutory text itself contains no litigation narrative.

The statute creates helpful evidentiary shortcuts but contains a number of specific drafting features and conditionalities that can cause practical surprises if overlooked. The primary “gotchas” evident from the text include:

• Reliance on the phrase "purporting to be" and "purporting to be printed": Many admissibility provisions allow reception of documents that "purport" to be printed by the Government Printer or to be sealed with the State seal (for example ss 6(b), 7(b), 13). The Act treats those "purporting" forms as sufficient; the result is that the outward appearance of compliance with form is often decisive, placing the onus on the opposing party to demonstrate a discrepancy. Practitioners should note that the Act accepts form prima facie, and challenge must target substance rather than mere form.
• State law determines admissibility in many instances: Sections 8 and 9 tie Commonwealth admissibility to State law standards. If a document is admissible in a State court without proof then it will be admissible in Commonwealth courts "to the same extent and for the same purposes" (s 9). That means outcomes in Commonwealth proceedings may vary depending on which State produced the document. Do not assume uniform national rules beyond what the Act prescribes.
• Removal of proof of handwriting or official position in some contexts: Section 6(2) explicitly states that no proof of the handwriting or official position of any person certifying under s 6 is required. That reduces a typical cross‑jurisdictional authentication requirement. The practical consequence is fewer procedural challenges to the capacity of certifiers, but also potentially greater risk if a certification is fraudulent , the Act does not set up a statutory counter‑sanction.
• Judicial notice of seals and signatures is mandatory: Sections 3-5 use "shall take judicial notice". Where a document bears a State seal or specified official signature, courts must take notice; they are not to demand further verification. That can limit tactical approaches that rely on attacking the chain of custody or form of a document in preliminary motions.
• "Court" includes arbitrators and persons authorised to receive evidence: Because s 2 defines "Court" to include arbitrators under any Act or State Act and persons authorised by law or consent to hear evidence, the evidentiary shortcuts may apply in non‑court adjudicative settings. Parties involved in arbitration should not assume formal authentication hurdles where a State Act empowers the tribunal.
• Company incorporation proof is conclusory as to date: Section 16(1) makes a registrar's certificate evidence of incorporation and of the date of incorporation. That evidentiary concession is powerful; practitioners should ensure that any contested issues about corporate existence or dating require direct substantive challenge rather than technical authentication arguments.
• Judicial proceedings may be proved by judge's certificate where no seal exists: Section 17(c) allows proof of judicial proceedings when the copy purports to be signed by a Judge with a written statement attached that the court has no seal, and then expressly dispenses with proof of the judge's judicial character or truth of the statement. That is a narrow but potent pathway for receiving copies of proceedings from courts lacking seals.
• No express protection against fraudulent documents: The Act provides no statutory remedy specifically for fraudulent certification or forged seals; remedies remain those available under general law. Where a forged document is admitted under the Act's admissibility rules, parties must rely on fraud proceedings, perjury, contempt or civil actions to remedy the situation.
• Governor‑General's discretionary expansion can change landscape: Section 5 permits the Governor‑General to add offices by Gazette Order. That is a non‑legislative route to alter who counts as an authorised signatory, and could quietly expand categories of self‑authenticating officials without Parliamentary amendment.
• Practical dependence on the Government Printer and Gazette: Several provisions make production of the Government Gazette or papers printed by the Government Printer conclusive evidence of publication or printing (ss 6(a), 6(b), 11-13). Where State practice changes (for example, moves to electronic publication without the traditional "Government Printer" imprint), questions may arise about whether the new mode satisfies the Act's phrasing.
• The Act is silent on electronic documents and modern forms: The statute prescribes physical forms (seals, printed copies, signatures). The text contains no reference to electronic signatures, digitised seals or authenticated electronic gazettes. Practitioners relying on contemporary practices must check whether current statutory or judicial developments have adapted these requirements; the original Act as supplied may not contemplate modern document forms.

In practice, these gotchas mean that parties should carefully match documentary evidence to the exact statutory routes (Government Gazette; printed by Government Printer; certified by named officers; sealed copies; examined copies; registrar certificates) and be aware that many common authentication attacks are foreclosed where the documentary form meets the Act’s specifications.

To make State documents admissible in Commonwealth Courts under the Act’s rules, follow the specific modes of proof and authentication the Act prescribes. Compliance steps, grounded in the section references, are:

1. Use the Government Gazette for State proclamations and ministerial acts:

   • For any proclamation, commission, order or regulation issued by the Governor of a State, produce the Government Gazette purporting to contain it (s 6(a)). Section 12 further makes mere production of a paper purporting to be the Government Gazette evidence that it is the Gazette and was published on its date.
   • Where a Governor or Minister acts under authority and publishes a notification in the Gazette, production of the Gazette will be evidence of the act (s 14).

2. Prefer printed copies produced by the Government Printer or by State authority:

   • Where available, produce a copy that purports to be printed by the Government Printer of the State or by the authority of the State (s 6(b)). Section 13 makes such production evidence that the paper was printed by that Government Printer or under State authority.

3. Obtain certified copies from named State officers where required:

   • For proclamations, commissions, orders or regulations issued by the Governor, a copy or extract certified as true by the Clerk of the Executive Council of the State will be acceptable (s 6(c)).
   • For acts issued by or under a State Minister, a copy or extract certified as true by the relevant Minister is acceptable (s 6(d)).
   • Section 6(2) provides no proof is required of the handwriting or official position of persons certifying in pursuance of s 6, so ensure the certificate is in the form anticipated by the section.

4. Use examined or sealed copies where appropriate:

   • For proclamations and other acts of State, an examined copy or a copy sealed with the State seal will be accepted (s 7).
   • Judicial proceedings of a State court can be proved by an examined copy, by a sealed copy, or by a copy signed by a judge accompanied by a statement the court has no seal (s 17).

5. Follow State statutory prescription for public documents, registers and certified copies:

   • Where a State Act specifies that a public document (or a certified copy or entry in a register) should be sealed, stamped or signed in a particular way, ensure the document purports to comply with that prescription. Section 8 makes admissible in Commonwealth courts any such public document that purports to be sealed/stamped/signed as directed by the State Act, without further proof of authentication.

6. For public books and custody documents:

   • If a State book or public document is admissible on mere production in the State, then produce an examined copy or a copy signed and certified by the officer who certifies custody (s 10). The certifying officer should further certify that they are the officer to whose custody the original is entrusted.

7. For parliamentary Votes and Proceedings:

   • Produce copies purporting to be printed by the Government Printer of the State; section 11 admits Votes and Proceedings (including Journals, Minutes and papers laid before either House and printed by Government Printer) on mere production.

8. For by‑laws and regulations:

   • Provide printed papers purporting to be by‑laws or regulations printed by the Government Printer or by State authority; s 15 treats such printed papers as evidence both that they were made and, where the printed paper indicates, that they were approved or confirmed by the Governor.

9. For company incorporation and registrar extracts:

   • Provide a certificate of incorporation or registration purporting to be signed by the Registrar or Assistant/Deputy Registrar in the State (s 16(1)). For copies or extracts from company registries, ensure they are certified under the hand of the Registrar or Assistant/Deputy Registrar (s 16(2)).

10. For judicial proceedings and court documents:

    • Produce examined or sealed copies of judgments, decrees, rules, affidavits, pleadings, and other legal documents (s 17). Where a court has no seal, a judge’s signature with a written statement that the court has no seal suffices, and the judge’s judicial character need not be proved in that context.

11. Check State law exceptions and specific forms:

    • Before relying on s 8 or s 9 routes, confirm the originating State’s statute to see whether a given public document is admissible in that State without proof. If it is, then s 9 ensures admissibility in Commonwealth courts "to the same extent and for the same purposes". That requires checking current State statutes and regulations for their own evidentiary provisions.

12. Keep in mind the practical limits:

    • The Act does not substitute for substantive challenge rights. Authentication shortcuts do not preclude parties from challenging the truth of a document’s contents, nor do they create immunity for fraudulent content. Practitioners should therefore be prepared to deploy substantive rebuttal evidence or other legal remedies (perjury, forgery, fraud proceedings) where content is contested.

13. Be aware of institutional practice and possible updates:

    • Because the Act treats printed Government Printer materials and Government Gazettes as conclusive, ensure the State’s printing and publication processes are compatible with the Act’s language. Where States have modernised publication methods, confirm that electronic publication routes have been adapted in law or practice (the Act itself prescribes physical forms).

14. Expand authorised officer lists where needed via executive Order:

    • If a State‑level certification requires additional categories of officials to be self‑authenticating in Commonwealth courts, note that s 5 contains a mechanism by which the Governor‑General may add offices by Gazette Order. Use that administrative route where appropriate and where executive action has been taken.

In short, compliance requires matching documentary production to the statutory pathways the Act identifies: Government Gazette, Government Printer copies, specified official certifications, sealed or examined copies, and registrar certificates. Practitioners should ensure that certifications are in the names and formats the Act contemplates, and should verify State statutory rules where the Act imports State standards (ss 8-9). Because the Act eliminates certain authentication burdens, careful attention to the accuracy and substantive truth of documents remains essential , the Act eases formal proof but leaves substantive truth checks to general legal remedies.
