The Policy defines and re‑uses a set of core concepts that determine which procedural path and substantive controls apply to a proposal. Key definitions and their mechanical effect, taken from the Policy text, are:

• The Act and Interpretation Act linkage. The Policy expressly states the Act means the Environmental Planning and Assessment Act 1979 and notes the Interpretation Act 1987 also affects interpretation (s 1.3; see also s 2.2 notes). This anchors enforcement and remedial options under the Act even where the Policy sets specific development rules.
• Biophysical strategic agricultural land (BSAL). Defined as land shown on the Strategic Agricultural Land Map as “biophysical strategic agricultural land” (except where certified otherwise by a site verification certificate) and any other land certified by a site verification certificate as BSAL (s 2.2(2), definition). BSAL triggers the gateway and site verification processes and specific criteria in gateway decisions (ss 2.24, 2.25, 2.29-2.36).
• Critical industry cluster land and SA land. Critical industry cluster land is also shown on the Strategic Agricultural Land Map and SA land means land that is BSAL or critical industry cluster land or both (s 2.2(2)). SA land is the threshold for gateway panel involvement (Division 4, Part 2.4).
• Coal seam gas and coal seam gas development. Coal seam gas is petroleum principally methane extracted from coal beds (s 2.2(2)). Coal seam gas development is defined to capture exploration and production for coal seam gas but excludes gas recovered as part of mining or development to which ss 2.13 or 2.14 apply (s 2.2(2)). Coal seam gas development is expressly prohibited in coal seam gas exclusion zones and buffer zones (s 2.12).
• Gateway certificate, Gateway Panel and Planning Secretary. A gateway certificate is a certificate issued by the Gateway Panel under Division 4 of Part 2.4 (s 2.2(2)). The Gateway Panel is the Mining and Petroleum Gateway Panel constituted as a subcommittee of the Independent Planning Commission (ss 2.37-2.38). The Planning Secretary issues site verification certificates and manages publication and timing duties under Parts 2.4 and related sections (ss 2.26-2.28, 2.36).
• Site verification certificate and Site Verification Protocol. A site verification certificate is issued by the Planning Secretary certifying whether land is or is not BSAL; the Planning Secretary must have regard to the Site Verification Protocol when deciding applications and must determine within 21 days (ss 2.26-2.27).
• Exempt, complying and permissible development. The Policy lists classes of activity that are exempt if minimal impact standards are met (s 2.13), additional exempt activities where land is not within an environmentally sensitive area of State significance (s 2.14), and classes that are complying development (s 2.15). It separately prescribes development that is permissible only with development consent (s 2.9) and development that may be carried out without consent (s 2.8). The Policy clarifies that where a local environmental plan provides for consent subject to plan provisions, those provisions do not apply to development for mining, petroleum or extractive industry (s 2.10).
• Non‑discretionary development standards for mining. The Policy identifies certain impact thresholds (noise, air particulates PM10 and PM2.5, airblast, ground vibration and aquifer interference) that operate as non‑discretionary standards under s 4.15(2)-(3) of the Act; compliance prevents a consent authority from requiring more onerous standards for those matters (s 2.16).
• Environmental significance categories. The Policy defines “environmentally sensitive area of State significance” with an inclusive list (coastal waters, Ramsar wetlands, state conservation areas, World Heritage, land identified as high Aboriginal cultural significance or high biodiversity significance, State Heritage Register items, etc.) (s 2.2(2)). These definitions determine whether certain exempt or complying pathways are available (ss 2.13-2.15).

These terms operate together. For example, being designated SA land brings the gateway process into play, which adds mandatory referrals (s 2.30) and a requirement for the applicant’s development application to be accompanied by either a gateway certificate or a site verification certificate per the policy’s repeated note referencing clause 50A of the Environmental Planning and Assessment Regulation 2000 (see the notes preceding Division 2, 3 and Division 3). The non‑discretionary standards constrain one element of the consent authority’s discretion but do not strip it of power to impose other conditions or to grant consent where those standards are not met (s 2.16(1) and note).

The Policy also deploys geographic instruments , Minister‑approved maps (s 2.7) and Schedules 1-7 , to generate location‑specific outcomes such as mapped prohibitions and site lists for extractive significance in the Sydney Region (Schedules 1, 3-5, 6 and 7).

All definitions in the Policy must be read alongside the Act and Interpretation Act definitions because the Policy expressly imports meanings unless otherwise defined (s 2.2(1)).

The Policy changes decision pathways and information obligations for multiple actors. The direct statutory actors and the principal affected private parties are:

• Applicants and proponents of mining, petroleum production, coal seam gas and extractive industry projects. The Policy governs whether an activity is exempt, complying, permissible with consent or prohibited and therefore determines pre‑application behaviour, documentation (for example cost benefit analysis if accompanied by a gateway certificate, s 2.25(2)(d)), and whether the applicant must seek a gateway certificate or site verification certificate before lodging an application under the Act (notes before Divisions 2 and 3; ss 2.29-2.31; ss 2.26-2.28).
• Landowners and occupiers. Owners are parties who may apply for site verification certificates (s 2.26(2)) and must be notified where a third party applies for site verification or gateway certificates over land (s 2.26(3), s 2.29(3)). The Policy notably excludes holders of mining leases from the definition of owner in the site verification context (s 2.26(5)), which affects who can seek certificates and when.
• Consent authorities. Councils are the default consent authority for development under this Chapter (s 2.3; s 3.5 for Chapter 3). In parts of the Western Division not within a local government area, the Minister is the consent authority (s 2.3(b)). Consent authorities must follow the Policy’s mandatory matters for consideration when determining applications (ss 2.17-2.23) and must treat specified local environmental plan provisions as having no effect on permissibility determinations for mining, petroleum or extractive industry where those plans condition consent on certain plan matters (s 2.10).
• Gateway Panel and Planning Secretary. The Gateway Panel (a subcommittee of the Independent Planning Commission) determines gateway certificates, provides advice to consent authorities and prepares advice on environmental assessment requirements (ss 2.37-2.38). The Planning Secretary issues site verification certificates (s 2.26), publishes applications and certificates (ss 2.28; 2.36) and may be directed to compel the Panel to issue a gateway certificate where the Panel defaults (s 2.32(2)).
• IES Committee and Minister for Regional Water. For proposed mining or petroleum development on biophysical strategic agricultural land, the Gateway Panel must refer applications to the IES Committee and the Minister for Regional Water for advice on water resource impacts (s 2.30). The Minister for Regional Water must have regard to the Aquifer Interference Policy in providing advice (s 2.30(2)).
• Roads authorities and the Roads and Traffic Authority. If a project involves transport of materials on public roads, the consent authority must provide a copy of the application to roads authorities and the Roads and Traffic Authority within seven days (s 2.22(2)), must wait to consider submissions for 21 days and must provide them with a copy of the determination (s 2.22(3)).
• Local communities and sensitive receivers. The Policy embeds protections for private dwellings and defined sensitive receivers (hospital, school classroom, child care, place of worship) through non‑discretionary noise and air standards (s 2.16(3)-(6)). It also designates environmentally sensitive areas of State significance that limit exempt and complying pathways (s 2.2(2) and ss 2.13-2.15).
• Extractive industry operators in the Sydney Region. Chapter 3 identifies specific sites, matters councils must consider, rehabilitation and flood and hydrodynamics constraints for extractive industries within the Sydney Region (ss 3.1-3.14 and Schedules 3-7). These place prescriptive obligations on operators and councils in those local government areas.

Indirect but real effects fall on other regulators and infrastructure users. For example, water licensing remains the responsibility under respective water legislation but the Policy requires aquifer interference thresholds to be observed (s 2.16(7) note). The Policy also prevents the receiving or disposal of off‑site waste as a permissible use under the Chapter (s 2.45; s 3.14(1)), thereby affecting waste managers and operators who might otherwise seek to use extractive sites for waste receipts.

Finally, the Policy’s mapping and schedule lists (s 2.7 and Schedules) can materially affect land value and project feasibility because they create location‑specific permissions, exemptions and prohibitions. Local councils are given a route to request exceptions to the coal seam gas prohibition by recommending to the Minister that areas be listed in Schedule 2 (s 2.12(3)), which creates a political and administrative interface for local government.

The Policy allocates duties to decision authorities, administrative duties to the Planning Secretary and Gateway Panel, and rights to applicants and landowners. The primary duties and rights with statutory anchors are:

Duties of consent authorities and councils

• Consider compatibility with existing, approved and likely preferred land uses and compare public benefits before deciding on mining, petroleum or extractive industry applications (s 2.17). This is a mandatory consideration and must explicitly address incompatibilities and proposed mitigation measures.
• Take into account the Voluntary Land Acquisition and Mitigation Policy before determining State significant development for mining, petroleum or extractive industry, including offers to acquire land affected by noise or particulate impacts (s 2.18). The duty extends to modification applications and to applications already made before the section’s commencement (s 2.18(3)-(4)).
• Consider whether proposed development will affect current or future extraction or recovery of resources and evaluate relative public benefits (s 2.19).
• Consider environmental responsibility measures and whether consent should be conditioned to avoid or minimise impacts on surface and groundwater, threatened species and biodiversity, and greenhouse gas emissions; and to consider assessments of greenhouse gas emissions including downstream emissions (s 2.20).
• Consider resource recovery efficiency and whether consents should be conditioned to optimise recovery and minimise waste (s 2.21). The consent authority may refuse consent if it is not satisfied the development optimises resource recovery (s 2.21(3)).
• Consider transport conditions including whether material should be transported by means other than public road, limiting truck movements near residential areas or schools, and whether a transport code of conduct is required. The consent authority must immediately provide a copy of applications to roads authorities and consider their submissions before determining (s 2.22(1)-(3)).
• Consider rehabilitation and issue conditions requiring end‑use plans, appropriate waste handling during rehabilitation, remediation of contaminated soils and public safety during and after rehabilitation (s 2.23).

Administrative duties and rights of the Gateway Panel and Planning Secretary

• The Gateway Panel must determine gateway applications, issue gateway certificates (conditional or unconditional), state reasons and may recommend studies or mitigation to address criteria failures (ss 2.31-2.33). A gateway certificate must indicate whether the development meets relevant criteria and set out reasons and recommendations (s 2.31(2)-(3)).
• The Gateway Panel must refer biophysical strategic agricultural land applications to the IES Committee and the Minister for Regional Water and take any advice received into account subject to the statutory timeframes (s 2.30).
• The Gateway Panel is to determine gateway applications within 90 days. If it fails, the Planning Secretary can direct the Panel to issue a certificate within 30 days; failure after that triggers an unconditional certificate (s 2.32).
• The Planning Secretary may issue site verification certificates and must determine applications within 21 days, having regard to the Site Verification Protocol (ss 2.26-2.27). The Planning Secretary must publish applications and site verification certificates on the Department website and give copies to relevant councils (s 2.28).

Rights of applicants and landowners

• Applicants proposing mining or petroleum development on SA land must apply to the Gateway Panel for a gateway certificate (s 2.29(1)). Only the person proposing the development may make the application (s 2.29(2)). If not the owner, the applicant must notify the owner prior to application or advertise the application (s 2.29(3)).
• Owners may apply to the Planning Secretary for a site verification certificate if certain access arrangement notices or agreements have occurred (s 2.26(2)). Applicants who are not owners must notify owners before applying for site verification (s 2.26(3)).
• Applicants can be subject to one request for further information by the Gateway Panel; during the response period the statutory clocks stop (s 2.33(1)-(2)). If the applicant fails to provide the information within 30 days, the Panel must either reject the application or proceed within existing timeframes (s 2.33(3)).

Rights and limitations on consent authorities regarding standards

• The Policy identifies non‑discretionary development standards for mining: specified cumulative noise and air quality levels, airblast overpressure and ground vibration thresholds, and aquifer interference requirements (s 2.16(3)-(7)). The object is that compliance with these standards prevents consent authorities from requiring more onerous standards for those particular matters; however, the consent authority retains full powers to impose conditions on other impacts and may still grant consent even if those standards are not complied with (s 2.16(1)-(2) and accompanying note).

Controls, prohibitions and exemptions

• The Policy provides classes of exempt and complying development and sets criteria such as minimal environmental impact, distance setbacks, height and capacity limits, and that exempt development cannot occur in critical habitats or wilderness areas (ss 2.13-2.15; notes referencing s 4.1 of the Act).
• Certain development is explicitly prohibited regardless of other EPIs, set out in Schedule 1 and including mapped prohibitions on open cut coal mining in specific localities and prohibitions on petroleum activity in specified LGAs (s 2.11; Schedule 1).
• Coal seam gas development is prohibited in coal seam gas exclusion zones and buffer zones unless the land is listed in Schedule 2 (s 2.12). Local councils may request the Minister to add areas to Schedule 2 (s 2.12(3)).

Procedural publication and transparency duties

• The Gateway Panel must publish applications, advice received and gateway certificates on its website or the Department’s website and provide documents to the Planning Secretary (s 2.36(2)). The Planning Secretary must publish site verification applications and certificates (s 2.28(1)-(2)).

These duties and rights shape who must act, what they must consider, what they can require of others, and which procedural timelines and publication obligations apply.

The Policy itself contains no express criminal penalties or monetary fines within its text for non‑compliance. Instead, enforcement and consequences arise through the planning consent regime established by the Act and by the policy’s substantive prohibitions and conditions which engage administrative enforcement under the Act. The Policy therefore establishes standards and procedural prerequisites that trigger the Act’s enforcement machinery rather than detailed penalty schedules inside the Policy text. The relevant mechanisms and their practical enforcement implications, as set out in the Policy, are:

• Prohibitions and illegality. The Policy declares certain development prohibited (s 2.11 and Schedule 1). Carrying out prohibited development would, by definition, be unauthorised under the planning framework. The Policy does not itself specify enforcement sanctions, but prohibited development would be subject to the Act’s enforcement provisions (see s 1.3 noting the Policy operates with the Act). The Policy’s repeated notes make clear that exempt development is only lawful if it meets the Act’s exempt development rules (ss 2.13-2.15 notes referencing s 4.1 of the Act).
• Administrative consequences through consent processes. The Policy creates pre‑application gating devices (gateway certificates, site verification certificates) and prescriptive timeframes, with statutory consequences for non‑action by decision bodies. For example, if the Gateway Panel fails to issue a gateway certificate within the prescribed time and the Planning Secretary’s direction period has lapsed, the Panel must issue an unconditional certificate (s 2.32(3)). These are administrative enforcement mechanisms that affect whether an applicant can proceed with a development application, and therefore realise or lose rights to seek consent.
• Conditions, refusals and designations. The consent authority may refuse consent where the Policy requires it (for example, if not satisfied resource recovery will be optimised, s 2.21(3)), or impose conditions aimed at rehabilitation, resource recovery, water protection and minimisation of greenhouse gas emissions (ss 2.20-2.23). Failure to observe consent conditions may attract enforcement action under the Act, though the Policy does not itself set out those sanctions.
• Publication and transparency as compliance pressure. The Panel and Planning Secretary must publish applications, advice and certificates (ss 2.28, 2.36). That publication increases public visibility and thus creates reputational and third‑party scrutiny that can precipitate statutory compliance actions under the Act or third‑party objections and reviews.
• Designated development status. Extractive development in the Western Division exceeding specified extraction thresholds is declared designated development (s 2.46). That declaration imposes the Act’s additional requirements for designated development, which can include stricter assessment and approval regimes and administrative oversight. The Policy does not itself list sanctions but invokes the Act’s designated development framework.
• Pecuniary interest and procedural controls. Members of the Gateway Panel must disclose pecuniary interests and not participate where such interests arise, under the Local Government Act references incorporated into the rule (s 2.42). Failure to follow those disqualification rules potentially affects the validity of a Panel decision and can be raised in judicial review or administrative challenge; the Policy frames this as a duty rather than as a penal outcome.

Where the Policy refers to or requires actions under other statutes (for example, water licences under water legislation or licences under the Protection of the Environment Operations Act 1997), those statutory regimes contain their own compliance, penalty and enforcement provisions (see s 2.16(7) note stating that the taking of water must be authorised under relevant water legislation). The Policy therefore operates as part of an interlocking regulatory system where breaches will typically be remedied or sanctioned under the Act or the other relevant statutes it cross‑references.

In short, the Policy sets legal prerequisites and substantive thresholds; enforcement in the form of sanctions, fines or prosecutions is not specified in the Policy text but follows via the Act and other applicable statutes and administrative mechanisms referenced by the Policy (s 1.3; ss 2.11, 2.16(7) note, 2.46).

The Policy is expressly drafted to operate in conjunction with, and subordinate to, several other legislative instruments and policies. The Policy’s own text contains multiple cross‑references; the concrete interaction rules are:

• Relationship with the Act and Interpretation Act. The Policy repeatedly states that definitions and other interpretative rules in the Act and the Interpretation Act 1987 affect its meaning and application (s 1.3; s 2.2(1) and notes). The Policy therefore sits within the Act’s planning framework and delegates substantive enforcement and procedural powers back to the Act where relevant.
• Prevail‑to‑extent rule against other environmental planning instruments. The Policy prevails to the extent of any inconsistency with another environmental planning instrument, subject to exceptions for particular State environmental planning policies such as the State Environmental Planning Policy (Major Projects) 2005 and the State Environmental Planning Policy (Coastal Management) 2018 (s 2.6(1)-(2)). Chapter 3 contains a narrower rule that it prevails to the extent of any inconsistency except with another State environmental planning policy (s 3.3(1)).
• Cross‑statutory technical standards and policy documents. The Policy incorporates and relies on external technical documents as the basis for non‑discretionary standards and referral advice. Examples include:
  • The NSW Aquifer Interference Policy, which is used to specify aquifer interference thresholds and to inform the Minister for Regional Water’s advice (s 2.16(7); s 2.30(2)).
  • The Noise Policy for Industry, whose Table 2.2 is the reference for cumulative amenity noise levels for private dwellings in the non‑discretionary standards (s 2.16(3)).
  • Australian Standards and building codes are invoked in exempt and complying development criteria (for example AS 4282,1997 for lighting, AS 2601,2001 for demolition, AS 1940,2004 for storage of flammable and combustible liquids) (ss 2.13(3)(a)(ii)-(iii); 2.15(3)-(4)).
• Interaction with mining and petroleum statutes. The concepts of mining leases and production leases under the Mining Act 1992 and the Petroleum (Onshore) Act 1991 are integral to who must obtain gateway certificates or site verification certificates, and to the Policy’s definitions of mining, mineral exploration, petroleum exploration and production (s 2.2 and multiple cross‑references such as ss 2.24(1), 2.26(2)).
• Water and environmental regulation. The Policy requires consideration of impacts on water resources and makes the taking of water subject to authorisation under applicable water legislation (s 2.16(7) note). It also disallows exempt development in critical habitat as identified under the Threatened Species Conservation Act 1995 and Fisheries Management Act 1994 and in wilderness areas identified under the Wilderness Act 1987 (s 2.13 note).
• Transport and roads law. Transport impacts must be referred to the roads authorities as defined by the Roads Act 1993 and the Policy requires consent authorities to consider submissions from roads authorities and the Roads and Traffic Authority (s 2.22(2)-(3) and note).
• Local environmental plans and local government functions. The Policy overrides certain plan provisions that would otherwise condition consent (s 2.10). Councils retain obligations under Chapter 3 for extractive industries in the Sydney Region, including preparing development control codes modelled on the Act’s development control plan procedures (s 3.12).
• Interaction with transitional and amendment instruments. The Policy contains specific savings and transitional provisions that address prior amending SEPPs and transitional projects under Schedule 6A of the Act (ss 2.47-2.49). For example, section 2.48 extends the 2018 amendments about air and noise impacts to development applications made but not determined before that amendment (s 2.48).

Mechanically the Policy therefore integrates with a broader regulatory design: it sets out planning triggers and thresholds while depending on specialised substantive rules and enforcement mechanisms contained in other statutes and policy instruments. Where inconsistencies arise, the Policy generally prevails over other environmental planning instruments except where a different State SEPP is explicitly protected (s 2.6). The Policy’s use of maps and schedules further localises interaction by creating site‑specific overlays which operate alongside local environmental plans and other State policies (s 2.7; Schedules 1-7).

The Policy text includes explicit amendment annotations and transitional provisions that document some recent changes and incorporate earlier amending instruments. The Policy itself commenced on 1 March 2022 (s 1.2). Cited amendments and transitional notes within the text include:

• Section 2.2 carries an amendment notation: "s 2.2: Am 2024 (42), Sch 1.41." This indicates an amendment to s 2.2 made in 2024 as recorded in schedule 1.41 of amending instrument 42 for 2024. The Policy text includes this marginal note, but the instrument text itself must be read to see the precise wording changes effected by that amendment (s 2.2 annotation).
• Section 3.15 (extractive industry prohibited in certain places) carries the notation "s 3.15: Am 2022 (629), Sch 3.18[1]". That records an amendment made in 2022. Schedule 1 also records amendments: "sch 1: Am 2022 (629), Sch 3.18[2]; 2022 (649), sec 4." This notes at least two amending instruments in 2022 affecting Schedule 1 and section 3.15.
• The Policy refers to an "amending SEPP" - State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) Amendment 2019 - in its savings and transitional provision regarding gateway certificates (s 2.49). That amending SEPP is used to preserve the currency of gateway certificates that pre‑dated the substitution of section 2.34.
• Section 2.48 refers to a 2018 amendment , State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) Amendment (Air and Noise Impacts) 2018 , and confirms that the non‑discretionary standards in s 2.16, as amended, apply to previously lodged but undetermined development applications (s 2.48).
• Schedule 8 is explicitly noted as repealed in 2021 with the annotation "sch 8: Rep 2021 (731), Sch 8." That indicates a repeal of Schedule 8 took effect in 2021.

The Policy also contains various transitional provisions that preserve or constrain certain existing approvals and applications when the Policy or particular sections commence or are substituted. For example, s 2.47 provides transitional arrangements for coal seam gas development in exclusion zones, applying the prohibition retrospectively to applications not finally determined while preserving certain transitional Part 3A projects and development consents already approved, subject to compliance with existing conditions (s 2.47(1)-(3)).

Because the Policy incorporates or refers to other amending SEPPs and regulations, the full amendment history and operative text must be reconstructed from the Policy's marginal amendment notes together with the amending instruments themselves. The Policy’s internal annotations provide pointers to those amending instruments and the dates of change but do not, in the instrument text shown, reproduce each historical version.

The Policy text itself does not list or reference any judicial decisions, case law, or specific litigation outcomes. There are no named cases in the instrument provided. The Policy therefore contains no internal litigation history annotations.

Practitioners should note, however, that the Policy embeds several administrative decision points, mandatory considerations and statutory duties which are standard grounds for administrative and judicial review under the Act or for merits review where available. Examples of decisions that commonly generate litigation or review under the Act in practice include:

• Decisions to refuse or grant development consent with particular conditions, especially where resource recovery, rehabilitation or water impacts are central (ss 2.20-2.23; s 2.21(3)).
• Gateway Panel determinations, including failures to act within statutory timeframes and the consequential issuance of unconditional gateway certificates (ss 2.31-2.33; s 2.32).
• The Planning Secretary’s issuance or refusal of site verification certificates and the one‑certificate per land rule (ss 2.26-2.28).
• The interpretation and application of non‑discretionary standards, which limit the consent authority’s ability to impose more onerous standards on specified matters (s 2.16).
• Challenges to the validity of Panel composition or member participation, because the Policy requires disclosure and non‑participation where pecuniary interests exist (s 2.42).

Those are potential litigation attractors because the Policy sets clear procedural and timing constraints and ties substantive criteria to expert advice (for example, the IES Committee and Minister for Regional Water referrals, s 2.30) and technical policies. The Policy’s repeated cross‑references to the Act indicate that disputes about compliance, consent conditions and enforcement would be litigated under the Act’s available remedies and review pathways. However, no case law or court decisions are reported or cited within the Policy text provided.

The Policy contains a number of procedural and substantive traps for the unwary. These practical "gotchas" arise directly from the language and structure of the instrument:

1. Gateway certificate timing and default unconditionality (ss 2.32-2.33). The Gateway Panel has 90 days to determine an application. The Planning Secretary can direct issuance if the Panel defaults, and if the Panel still does not act the Panel must issue an unconditional certificate. Applicants and opponents should note that delay can produce an unconditional certificate that removes the Panel’s ability to impose recommendations. The Panel may request further information once only and that request pauses the clock (s 2.33(1)-(2)). If applicants fail to provide the requested information within 30 days, the Panel must either reject or proceed; the Panel may not make further stop‑the‑clock requests (s 2.33(3)-(4)). Practitioners should plan responses carefully.

2. One site verification certificate only per land (s 2.26(4)). The Planning Secretary may issue only one site verification certificate for the same land. If an owner or applicant relies on a negative site verification outcome, they should be aware that the opportunity to seek a second certification is not available under this rule.

3. Owner definition excludes mining lease holder for certificate applications (s 2.26(5)). Where land is subject to a mining lease, the holder of the lease is not treated as the “owner” for site verification purposes. This affects who may apply and who must be notified under the Policy.

4. Cost benefit analysis requirement where gateway certificate accompanies the DA (s 2.25(2)(d)). If a development application is accompanied by a gateway certificate, the consent authority must consider a cost benefit analysis submitted with the application. Applicants should budget for and prepare a CBA to avoid procedural incompleteness.

5. Non‑discretionary standards do not remove all discretion (s 2.16). Compliance with the specified non‑discretionary development standards prevents the consent authority from requiring more onerous standards for those matters, but it does not prevent the consent authority from imposing other conditions or from granting consent even where a standard is not met. The note to s 2.16 makes explicit that the consent authority may still impose conditions regulating project‑related noise, air quality, blasting or ground vibration impacts that are not the subject of the non‑discretionary standards.

6. Exempt and complying pathways have multiple conditional limits (ss 2.13-2.15). Many exemptions and complying development items are available only on sites that are lawfully cleared of vegetation, are of minimal environmental impact, are outside environmentally sensitive areas of State significance, meet Australian Standards, have set capacity or size limits, or are time‑limited. Misreading these conditions can convert a purportedly exempt action into unauthorised development.

7. Local environmental plan provisions have reduced effect for mining and petroleum permissibility questions (s 2.10). If a local environmental plan imposes conditions precedent for consent, those provisions have no effect in determining whether development for mining, petroleum or extractive industry may be carried out or on the content of the development application. This can surprise councils and applicants used to plan‑based trigger matters.

8. Coal seam gas exclusion and buffer zones (s 2.12). Coal seam gas development is prohibited on and under land within a coal seam gas exclusion zone and within 2 kilometres of residential zones, future residential growth area land or additional rural village land (buffer zone), unless the land is listed in Schedule 2. Schedule 2 is blank at commencement, but councils can request the Minister to list an area (s 2.12(2)-(3)). Practitioners must check the maps and Schedules carefully.

9. Publication obligations and transparency. Applications for site verification and gateway certificates and the resulting certificates and advice must be published (ss 2.28, 2.36). This public visibility can accelerate community opposition and political scrutiny.

10. Multiple statutory regimes interface. The Policy repeatedly defers to other statutes and policies (the Act, Mining Act, Petroleum Acts, Aquifer Interference Policy, Noise Policy for Industry, water licensing regimes). Applicants must comply with overlaying statutory regimes (for example, water licences) even where the Policy sets planning thresholds (s 2.16(7) note). Failure to obtain water authorisations is not remedied by planning consent.

11. Designated development thresholds in Western Division (s 2.46). Extractive industries in the Western Division exceeding specified throughput thresholds are declared “designated development” for the purposes of the Act, invoking extra assessment rules.

12. One‑off limitations on Panel procedures and composition. The Panel is a subcommittee of the Independent Planning Commission and must have particular expertise mixes; members with pecuniary interests must disclose and not participate (ss 2.37, 2.39-2.42). Challenges to Panel decisions could be premised on composition or conflict of interest breaches.

13. Transitional complexity. The Policy preserves certain Part 3A projects and consents in limited ways (s 2.47). Where projects pre‑date the Policy or amendments, practitioners must read the transitional sections carefully to identify what work can continue and what new constraints apply.

Read together, these provisions create a procedural maze where timing, notification, public publication, single‑use certificates and cross‑agency referrals can materially affect both the content of an assessment and the prospects for approval.

This compliance guide is a practical step‑by‑step checklist tied to the Policy’s statutory provisions. It is source‑grounded in the sections cited.

1. Determine the applicable development classification.

   • Check whether the proposed activity is exempt, complying, permissible with consent or prohibited under the Policy: see ss 2.8 (development permissible without consent), 2.9 (development permissible with consent), 2.13-2.15 (exempt and complying development) and s 2.11 plus Schedule 1 (prohibited development).
   • Verify whether the site is inside an environmentally sensitive area of State significance (s 2.2 definition). If so, many exempt/comprising pathways are unavailable.

2. Check map overlays and schedules.

   • Use the Minister‑approved maps referenced in the Policy (s 2.7) to determine whether the land is biophysical strategic agricultural land, critical industry cluster land, future residential growth area land, additional rural village land, or falls within any Schedule‑listed prohibition (Schedule 1; Schedules 3-5). The Policy requires those maps to be publicly available (s 2.7(3)).

3. If the land is SA land (BSAL or critical industry cluster), prepare for the gateway or site verification requirement.

   • Clause 50A of the Environmental Planning and Assessment Regulation 2000 requires that a development application for mining or petroleum development on certain identified land be accompanied by either a gateway certificate or a site verification certificate (note repeated at Divisions 2 and 3).
   • If seeking a site verification certificate, follow ss 2.26-2.28: owners may apply when certain access arrangement notices/agreements have occurred (s 2.26(2)); applicants who are not owners must notify owners or advertise the application (s 2.26(3)); applications must be in writing, contain prescribed information, be in the approved form and pay any fee (s 2.27(1)); Planning Secretary must determine within 21 days and must have regard to the Site Verification Protocol (s 2.27(2)-(3)); applications and certificates are published on the Department website and certificates given to relevant councils (s 2.28).
   • If applying for a gateway certificate, follow ss 2.29-2.36: only the proposer may apply (s 2.29(2)); applicants who are not owners must notify owners or advertise (s 2.29(3)); applications must be in writing and include specified particulars (s 2.29(4)); the Gateway Panel will refer BSAL applications to the IES Committee and Minister for Regional Water (s 2.30); the Panel must decide within 90 days, may make one stop‑the‑clock information request of 30 days and must issue reasons with each certificate (ss 2.31-2.33); the Panel must publish applications, advice received and certificates (s 2.36(2)).
   • Prepare for the Panel’s criteria: show that proposed development will not significantly reduce agricultural productivity of BSAL based on explicit factors listed in s 2.31(4)(a)(i)-(vi), or for critical industry cluster land satisfy s 2.31(4)(b) criteria.

4. Compile technical studies and prescribed documents.

   • Prepare a cost benefit analysis if the development application will be accompanied by a gateway certificate, because the consent authority must consider it (s 2.25(2)(d)).
   • Prepare greenhouse gas emissions assessments including downstream emissions as required by s 2.20(2).
   • Prepare aquifer interference assessments to meet the Aquifer Interference Policy thresholds where relevant (s 2.16(7); s 2.30(2)).
   • Prepare noise and air quality modelling against the non‑discretionary standards: Noise Policy for Industry Table 2.2 levels, PM10 and PM2.5 thresholds, airblast overpressure and ground vibration limits (s 2.16(3)-(6)). Note that compliance with these standards limits the consent authority’s ability to require more onerous standards for those matters (s 2.16(1)-(2)).

5. Consider transport referral and code requirements.

   • If the development involves material transport on public roads, provide copies of the application to each roads authority and to the Roads and Traffic Authority within seven days (s 2.22(2)). Do not expect determination until their submissions are considered; the consent authority must wait 21 days for submissions (s 2.22(3)). Prepare a transport code of conduct if requested (s 2.22(1)(c)).

6. Prepare rehabilitation, resource recovery, and waste management plans.

   • The consent authority must consider rehabilitation conditions, end‑use plans, waste handling, soil contamination remediation and public safety (s 2.23). Resource recovery efficiency must be considered and may be conditioned; consent may be refused if resource recovery optimisation is not demonstrated (s 2.21). Do not plan to use an extractive site for receipt/disposal of off‑site waste, as the Chapter does not permit that use (s 2.45; s 3.14).

7. Meet exempt/compliant development conditions carefully.

   • If relying on an exempt or complying pathway, ensure all numeric, spatial and standard conditions are met strictly (for example shed setbacks, heights, area caps, bunding and cleared vegetation requirements in ss 2.13-2.15). Confirm the site is not in critical habitat or wilderness as those preclude exempt development (s 2.13 note).

8. Engage early with local councils and owners.

   • Where the proposal may affect SA land, the owner and relevant council must be engaged because councils can request Ministerial amendment to Schedule 2 to exclude areas from the coal seam gas prohibition (s 2.12(3)). If proposal is on mapped Sydney Region extractive sites, expectations in Chapter 3 (rehabilitation, flood and hydrodynamic assessments, consultation and development control codes) apply (ss 3.6-3.14).

9. Track publication and timing risks.

   • Be aware of public disclosure obligations: gateway applications, advice and certificates and site verification applications and certificates are published (ss 2.28, 2.36). Plan communications accordingly and allow for potential third‑party engagement and challenges.

10. Check for prohibited development and schedule constraints.

• Confirm the proposal is not in a location that Schedule 1 prohibits (open cut coal mining prohibitions, mapped extractive industry prohibitions, LGA restrictions on petroleum activities in Schedule 1). For coal seam gas, check exclusion and buffer zone maps; Schedule 2 may be blank but councils can seek exemptions by recommending amendment (s 2.12).

11. Assemble statutory decision record.

• The Gateway Panel and consent authority must state reasons for decisions and recommendations (s 2.31(2)). Prepare decision briefs, responses to the Panel’s recommendations and evidence that addresses all listed criteria (s 2.25(3)).

12. Anticipate cross‑statutory consents.

• Arrange or be ready to obtain water licences, mining or petroleum leases and environmental protection licences where the Policy notes these are required independently of planning consent (s 2.16(7) note; references throughout to Mining Act 1992 and Petroleum Acts).

Compliance under the Policy is therefore a multi‑track exercise requiring mapped checks, pre‑application certificates, specific technical studies (noise, air, aquifer, greenhouse gas, cost benefit analysis), explicit owner and council notification where required, and careful management of statutory timeframes and publication obligations. Follow the cited sections when preparing applications and procedural responses: ss 2.8-2.16, 2.22-2.36, 2.45-2.49 and Chapter 3 provisions where the Sydney Region-specific rules apply.
