What it does
These Regulations prescribe which Western Australian government-owned or state-related entities are to be treated as “State enterprises” for the purposes of section 5 of the State Enterprises (Commonwealth Tax Equivalents) Act 1996, and they fix the date on which that prescription takes effect for each listed entity (r. 3; Table). The instrument is short and procedural. It does three things in statutory form.
- It provides the short title for the instrument (r. 1).
- It fixes the commencement of the Regulations as the same day the parent Act comes into operation (r. 2). That sets a temporal link between the Regulations and the Act they operate with.
- It lists, in a single table, every body prescribed as a “State enterprise” for the purposes of s. 5 of the Act and records, opposite each body, the commencement date on which the prescription applies to that body (r. 3 and Table).
Mechanically, the prescription is the only substantive legal act effected by these Regulations. The Regulations do not themselves set out the substantive tax-equivalents regime, liabilities, calculation methods, assessment, reporting or payment processes; those matters are contained in the principal Act. The Regulations therefore operate as a map that determines which entities will be brought within the Act’s s. 5 mechanism and on what day that legal inclusion becomes effective.
Several entries in the Table tie commencement of the prescription to the operation of other primary Acts or to other regulations. Examples include entities whose prescription commences on a stated calendar date, such as the Forest Products Commission from 1 January 2001 and Gold Corporation from 1 July 2002, and entries where commencement is contingent, for example Western Carbon Pty Ltd, which is prescribed “the day on which the State Enterprises (Commonwealth Tax Equivalents) (Application) Amendment Regulations 2003 come into operation” (Table, relevant rows). The Table also records later additions and changes, such as port authorities whose prescription dates depend on amendment regulations made in 2014, and the entry for Keystart, whose prescription hinges on the commencement of s. 15 of the Keystart Act 2024.
