State Energy Commission (Validation) Act 1978

The Act is narrowly framed around a set of recurring legal concepts. These concepts are defined in the Act itself or derive from the principal Act and the amending Act as adopted by the validation measures.

• Validation and retrospective authorisation (s 4). The core concept is retrospective validation: acts done before the amending Act are to be treated as if they had statutory authorisation at the time. Section 4 provides that where the Commission had purported to exercise powers not then conferred but which are of the kind now conferred by the amending Act, those prior exercises are "deemed to be and to have been duly authorized" and "lawfully and properly executed." The legal mechanism is declaratory: the statute declares a historical legal state rather than creating new forward‑looking rights.

• Treasurer’s guarantee (s 5). The Act treats any specific guarantee given by the Treasurer on behalf of the State in respect of any Commission undertaking as having been lawfully authorised in the terms of the amending Act. The provision also validates procedural steps in giving or implementing those guarantees. The Effect is to remove procedural or statutory defects that might otherwise challenge the State’s guarantee.

• Undertakings and ratification (s 6). The principal Act uses the term "undertaking." Section 6 deems matters or things which would have been an undertaking had the Governor approved them, and contracts that should have been ratified but were not, to have been validly approved or ratified. The device is a statutory deeming clause that backdates Governor approval or ratification.

• Tariffs, fees and recoverability (s 7(1)). This clause validates tariffs, schedules or tables purportedly published outside the Government Gazette and renders fees and charges demanded or received under such instruments lawful. It also expressly permits recovery in a court of competent jurisdiction for moneys demanded under such tariffs unless it is established that the demand was unjustified for reasons including non‑supply, mistake or "other cause" (s 7(1)). Importantly the phrase "other cause not limited to the failure by the Commission to comply with the provisions of the principal Act in regard to the making of by‑laws or the levying of fees and charges" broadens the scope of excusable grounds and signals that failure to comply with the principal Act remains a possible ground to establish that a demand was unjustified.

• Deposits, security and interest (s 7(2)). The statute validates earlier demands or receipts of deposits, guarantees and securities for fees and charges and validates the Commission’s dealing with them. Where no rate of interest was determined, the Commission is not liable to pay interest. Deposits may be retained as income until refunded or credited, and amounts that cannot be refunded or credited are to be treated as unclaimed money under the Unclaimed Moneys Act 1912.

• By‑laws (s 8). The Act validates a specific set of by‑laws published on 23 June 1978 (State Energy Commission (Electricity and Gas Charges) By‑laws 1978), deeming them validly made under the principal Act.

• Procedural bar on litigation (s 9). The Act contains a non‑merits procedural bar, preventing proceedings that "could not have been brought or sustained had this Act been in operation prior to the time on which the cause of action arose." The clause is retrospective and limits legal contests of the validated acts, but it is framed as a bar only where the cause of action could not have been brought or sustained if the Act had already been in force before the cause arose.

• Defined terms and cross‑reference (s 3). The Act defines "Commission," "the amending Act," and "the principal Act." The principal Act is identified as the State Electricity Commission Act 1945, "as from time to time amended and now intituled the State Energy Commission Act 1945-1978." The amending Act is the State Energy Commission Act Amendment Act 1978. These cross‑references are necessary for understanding what statutory powers are being validated.

Taken together, the statute uses standard remedial devices seen in validation acts: deeming clauses, retrospective authorisation, and targeted provisions to remove procedural and formal defects. Conceptually the Act treats the Commission’s prior practical behaviour and the Treasurer’s guarantees as if they had been exercised in strict compliance with the formal requirements of the legislative framework at the time.

The Act identifies and affects a narrow set of actors and interests. The primary affected parties are:

• The State Energy Commission of Western Australia (the Commission). The Commission is the main beneficiary of the validation clauses. Sections 4, 6, 7(1) and 7(2) operate directly on the Commission’s prior acts: they validate its exercise of powers, its tariffs and charges, its receipt and handling of deposits and securities, and contracts purportedly made by it. The statutory effect is to transform previously irregular or unauthorised conduct into lawful conduct for legal and accounting purposes. The Commission gains recoverability rights under s 7(1), is relieved of certain interest liabilities under s 7(2), and has its by‑laws dated 23 June 1978 validated (s 8).

• The Treasurer and the State. Section 5 deems any specific guarantee given by the Treasurer on behalf of the State in respect of a Commission undertaking to have been lawfully authorised and implemented. The Treasurer and State are therefore formally bound by past guarantees, with the Act supplying the necessary retrospective authorisation and validating the procedures used.

• Consumers and account holders. Persons charged fees, deposits, reconnection fees, connection fees, service fees, account‑establishment fees or fixed charges, or assessed pro rata charges, are affected in several ways. Money paid to the Commission prior to the amending Act is deemed lawfully received and, except in certain circumstances, recoverable by the Commission (s 7(1)). Depositors whose money was held as security may find the Commission lawfully retained those amounts as income until refunded (s 7(2)). Claimants seeking to challenge prior demands or the Commission’s retention of deposits face a statutory framework that substantially narrows available legal remedies.

• Contracting parties and counterparties. Parties to contracts with the Commission that were not ratified or approved in the manner required by the principal Act are affected by s 6, which deems those contracts to have been properly ratified or approved, thereby altering contractual defect arguments.

• The Governor. The statute addresses Governor approval and ratification by deeming it to have occurred where required but not carried out (s 6). This affects the formal record of executive approvals and the legal status of undertakings.

• Courts and litigants. Courts are given explicit guidance on recoverability and are affected by the bar on proceedings in s 9. Litigation that challenges validated acts may be curtailed by the statutory deeming provisions and the s 9 procedural bar, subject to the exceptions identified in s 7(1).

• Administrators handling unclaimed money. Section 7(2) directs that amounts which cannot be refunded or credited are to be dealt with as unclaimed money under the Unclaimed Moneys Act 1912, thereby engaging administrators and processes under that statute.

Who pays and who benefits: payers in practical terms are consumers and account holders who may be required to pay or have already paid amounts that the Act now deems lawful; beneficiaries are primarily the Commission and, where guarantees are concerned, creditors or financiers that relied on Treasurer guarantees now declared valid.

Who decides: prior decisions by the Commission, the Treasurer and the Governor are retrospectively validated by Parliament. Future decisions are not altered by this Act except insofar as validated by the historic authorisations. Courts remain decisionmakers on whether a given demand was unjustified for reasons such as non‑supply or mistake (s 7(1)), but with a narrower range of procedural challenges available against prior acts.

Geographic and temporal scope: the Act is directed to dealings of the Commission before the amending Act came into operation. Its validation is retrospective to that period; it does not itself enlarge the Commission’s prospective powers beyond those in the amending Act and the principal Act once those are in force (s 2 and s 4).

The Act does not create extensive new duties or penalties. Instead it alters the legal status of past duties performed and rights exercised. The key rights and duties it establishes or confirms are:

• Right to retrospective legal authorisation (s 4). The Commission is granted a statutory right to have certain prior acts treated as duly authorised and properly executed. This is not framed as a new operational duty but as a retrospective confirmation that duties and exercises of power previously undertaken were lawful.

• Right to enforce charges and recover moneys (s 7(1)). The Commission is given a right to recover moneys demanded under tariffs or schedules that were not published in the Government Gazette but were used by the Commission prior to the Act’s commencement. Such moneys "may be recovered by the Commission in a court of competent jurisdiction" unless the person establishes that the demand was not justified for reasons such as non‑supply, mistake or other cause including failure to comply with the principal Act’s by‑law or fee‑levying provisions. The right to recovery is therefore substantial but not absolute.

• Right to retain deposits as income until refunded (s 7(2)). Deposits or securities demanded or received by the Commission and validated by the Act may be retained by the Commission as income derived from its business until refunded or credited. Where a refund or credit cannot be effected, the amount is to be treated as unclaimed money under the Unclaimed Moneys Act 1912. The Act also removes liability for interest where no rate was determined.

• Right to have Treasurer’s guarantees validated (s 5). The Treasurer is declared to have been authorised to provide and implement specific guarantees in the terms of the amending Act, and the procedures are deemed lawfully carried out. Creditors or financiers who relied on those guarantees therefore have a statutorily conferred right that the guarantee is binding.

• Deemed approval and ratification (s 6). Matters that would have been "undertakings" had the Governor approved them, and contracts that required ratification but were not ratified, are deemed to have been approved or ratified. This confers legal certainty on the enforceability of those undertakings and contracts.

• Validity of a specific set of by‑laws (s 8). The Commission’s State Energy Commission (Electricity and Gas Charges) By‑laws 1978 are declared validly made under the principal Act, validating the regulatory framework those by‑laws set out.

• Procedural bar on proceedings (s 9). The Act limits the rights of litigants to bring or continue proceedings in relation to causes of action that "could not have been brought or sustained had this Act been in operation prior to the time on which the cause of action arose." That modifies the procedural landscape for challenges to the validated acts.

Duties that are affirmed or altered:

• Refund and credit duties adjusted (s 7(2)). The Act recognises that the Commission may have "failed to refund, or make a credit in respect of, any moneys so deposited" (s 7(2)(c)) and provides for retention until refund rather than imposing retrospective obligations to pay interest (s 7(2) last part). Where no rate of interest was determined, the Commission bears no liability for interest.

• Compliance with Unclaimed Moneys Act 1912 (s 7(2)). Where refunds or credits cannot be effected, the Commission is required to deal with the amounts "as though it was unclaimed money held by the Commission as a company within the meaning of the Unclaimed Moneys Act 1912." That imposes duties derived from the Unclaimed Moneys Act on the handling and disposition of such amounts.

• Preservation of judicial scrutiny on justification (s 7(1)). While the Act validates many prior fees and charges, it preserves a duty on the Commission to justify demands when challenged; the courts retain the function of determining whether a demand was unjustified for reasons such as non‑supply or mistake.

Notable absences: the Act does not introduce specific consumer protection duties, it does not require payment of retrospective interest in cases where no rate was determined, and it does not institute new administrative sanctions against the Commission for prior failures. It likewise does not create criminal penalties for prior conduct. The effect is to privilege legal certainty for the Commission and the State while leaving limited avenues for judicial challenge on substantive grounds.

The Act is primarily remedial and declaratory; it does not create new criminal offences nor prescribe administrative penalties. Enforcement and remedies are limited to civil processes and statutory deeming. The principal enforcement and remedy mechanisms are:

• Court recovery of moneys (s 7(1)). The Act expressly authorises the Commission to recover moneys demanded under validated tariffs, schedules or tables "in a court of competent jurisdiction," subject to the exception that the claimant establishes the demand was unjustified for reasons such as non‑supply, mistake, or other cause (s 7(1)). This is the principal civil enforcement mechanism provided for in the Act.

• Treatment of unrefunded deposits as unclaimed money (s 7(2)). Where a deposit cannot be refunded or credited, the Act directs that it be handled "as though it was unclaimed money held by the Commission as a company within the meaning of the Unclaimed Moneys Act 1912." Enforcement and disposition of such funds will therefore proceed under that Act’s processes and administrative mechanisms, which the validation provision imports by reference.

• Validation of guarantees (s 5). Because the Treasurer’s guarantees are validated, parties whose contractual or financing position depended on those guarantees have the practical remedy of enforcing the guarantee as a binding State instrument. The Act removes procedural objections to the guarantees’ validity rather than establishing a separate enforcement procedure.

• Deeming of Governor approvals and contract ratification (s 6). Contracts and undertakings that were not properly ratified are deemed ratified; enforcement of contractual rights therefore proceeds on the basis that ratification occurred. The Act converts what might have been procedural defects into enforceable rights.

• Prohibition of proceedings (s 9). The Act contains a prophylactic enforcement mechanism: it prohibits the bringing or continuation of "any proceedings" in respect of a cause of action that could not have been brought or sustained had the Act been in operation before the cause arose. This is a statutory bar that courts must apply when determining whether a proceeding can be maintained. It is a preclusive device rather than a penalty, but practically it extinguishes certain procedural avenues.

What the Act does not do, in enforcement terms:

• It does not create fines, imprisonment, or other penal sanctions for prior conduct by the Commission or its officers.
• It does not endorse retrospective penalty imposition on third parties; it validates recoveries by the Commission, but recovery is framed as enforcement of legally owed moneys rather than as punitive imposition.
• It does not create a state cause of action for wrongful retention of deposits; instead it validates retention until refund and removes the obligation to pay interest where no rate was determined.

Burden of proof and judicial role

• The Act preserves some role for the courts in assessing challenges to demands and claims. Section 7(1) permits recovery "unless it is established that the demand was not justified by reason of non‑supply, mistake or other cause not limited to the failure by the Commission to comply with the provisions of the principal Act." The phrase "it is established" indicates that the onus is on the person resisting recovery to prove that a specific ground (non‑supply, mistake or other cause) applies. The Act does not displace judicial fact‑finding or equitable remedies where properly pleaded.

Procedural consequences

• Because the Act is retrospective and validates prior acts, parties may find themselves barred from bringing or continuing proceedings that would attack those prior acts absent the validation (s 9). Where a claimant seeks to challenge a validated demand, the claimant must bring evidence within the preserved grounds noted in s 7(1).

In sum, enforcement under the Act proceeds predominantly through civil recovery and administrative processes under the Unclaimed Moneys Act 1912. The Act reduces the scope for procedural or formal challenges to past Commission conduct and validates state guarantees, but does not itself create criminal enforcement regimes.

The Act expressly cross‑references and interacts with a small number of other statutes and legal instruments. Because its principal operation is to validate prior acts by reference to powers provided by the amending Act and the principal Act, the interaction is primarily retrospective statutory incorporation.

• The principal Act (State Electricity Commission Act 1945, as amended and now intituled State Energy Commission Act 1945-1978) (s 3). The Act repeatedly refers to "undertaking" as defined by the principal Act (s 6) and validates by‑laws made "under and within the authority of the principal Act" (s 8). The validation provisions operate by deeming that acts or approvals required by the principal Act occurred. The Act therefore alters the legal effect and enforceability of transactions and instruments that interface with the principal Act’s governance, approval and by‑law mechanisms.

• The amending Act (State Energy Commission Act Amendment Act 1978) (s 3 and s 4). The validation depends on the amending Act for the substance of the powers retrospectively authorised. Section 4 validates exercises of power that are of the kind now conferred by the amending Act. The commencement clause (s 2) ties the Validation Act’s operation to the day the amending Act comes into operation.

• The Unclaimed Moneys Act 1912 (s 7(2)). The Act directs that amounts which cannot be refunded or credited be dealt with "as though it was unclaimed money held by the Commission as a company within the meaning of the Unclaimed Moneys Act 1912." This imports procedures and obligations for the handling and disposition of unclaimed money, and may involve compliance with reporting and publication requirements set out in the Unclaimed Moneys Act.

• Government Gazette procedures (s 7(1), s 8). The statute acknowledges the procedural distinction between tariffs published in the Government Gazette and tariffs published elsewhere. It specifically validates tariffs, schedules or tables not published in the Government Gazette and separately validates the specific by‑laws that were published in the Government Gazette on 23 June 1978 (s 8). The interaction is therefore between the Act and statutory or administrative publication requirements under the principal Act.

• Governor’s approval and ratification mechanisms (s 6). The Act alters the effect of failures to obtain Governor approval or ratification under the principal Act by deeming approvals and ratifications to have occurred. This reduces the legal force of arguments that actions lacked necessary executive approvals.

• Court jurisdiction and civil procedure (s 7(1), s 9). By making recoveries of validated moneys recoverable in a "court of competent jurisdiction," the Act assumes the availability of ordinary civil remedies and procedures. At the same time, s 9 imposes a statutory limit on proceedings by reference to whether the cause of action could have been brought or sustained had this Act been in operation earlier.

Points of tension and limits of interaction

• The Act does not repeal or amend the principal Act or the amending Act directly within its text. It operates by declaratory and deeming mechanisms to supply retrospective authority. Therefore its interaction is limited to curing procedural or formal defects rather than changing substantive statutory norms going forward.

• The Act preserves specific substantive challenges to demands (s 7(1)). It does not oust judicial review or equitable remedies entirely; a court must still consider claims of non‑supply, mistake, or other causes. The reference to the Unclaimed Moneys Act 1912 creates an administrative compliance overlay where unrefunded funds must be treated under that regime.

• The Validation Act’s commencement is conditional on the amending Act coming into operation (s 2). Therefore the Validation Act is operationally linked to the amending Act in time and subject matter.

In practice, the Act functions as a closure mechanism to align the legal record with prior factual practice by the Commission while retaining a limited set of interactions with ordinary civil, administrative and executive law mechanisms.

The Act as supplied is short and self‑contained. The compilation table included in the provided text states that this is a compilation of the State Energy Commission (Validation) Act 1978 and "includes all amendments effected by the other Acts referred to in the following Table." The accompanying compilation table lists only the original enactment:

• State Energy Commission (Validation) Act 1978, No. 66 of 1978, Assent 26 September 1978, Commencement 26 September 1978.

The Act’s short title is established in s 1 and its commencement is tied to the amending Act in s 2; the compilation table, however, records that the Act commenced on 26 September 1978. The defined terms in s 3 identify the "Commission," "the amending Act" (State Energy Commission Act Amendment Act 1978) and "the principal Act" (State Electricity Commission Act 1945 as amended and now intituled State Energy Commission Act 1945-1978).

Beyond the original enactment, the supplied compilation table contains no entries for subsequent amending Acts or repeals. The text therefore indicates no post‑1978 amendments are recorded within this compilation. The notes state that the compilation includes all amendments in the table; the absence of other entries is the compilation's indication that no further legislative changes to this Act were included in this compilation.

Interpretational consequences of the amendment history supplied

• The Act is a single‑purpose, short‑lived statutory instrument enacted contemporaneously with the amending Act. Its commencement is linked to the amending Act (s 2), suggesting the legislature intended contemporaneous retroactive validation when reconfiguring the Commission’s statutory regimen.

• Because the compilation table lists no subsequent amendments, practitioners should treat the Act’s text as the operative legislative content unless and until a later amending instrument (not contained in the supplied text) alters it. The Act’s focus on retrospective validation implies that its purpose was tied to the legislative changes occurring in 1978.

• The absence of listed amendments in the supplied compilation should be read as an absence of recorded subsequent legislative modification within the document provided; the Act itself contains no sunset or expiry clause, so its deeming and validation provisions remain part of the statutory fabric unless repealed or amended by later legislation.

For due diligence, users consulting this analysis should confirm whether later compilations or legislative updates have repealed, superseded or otherwise amended the Validation Act beyond the 1978 enactment recorded here, because this text alone supplies only the original enactment and compilation table.

The supplied Act text contains no recital of judicial decisions, case law, or judicial interpretation of the Validation Act. It names no cases and the statutory text itself contains no references to judicial authority beyond entrusting courts with recovery in a "court of competent jurisdiction" (s 7(1)). Because the source material provided is the statute alone, there is no internal litigation history to summarise.

Notwithstanding the absence of case citations in the Act, the statute’s provisions have clear litigation implications that a court would address if called upon:

• Defence to recovery actions. Section 7(1) recognises that a person may oppose recovery by establishing that a demand was not justified by reason of non‑supply, mistake, or other cause (including failure to comply with principal Act provisions regarding by‑laws or fee levying). Litigation arising from Commission attempts to recover validated charges would therefore require courts to adjudicate whether such defences are established.

• Effect of s 9 on continuance of proceedings. Section 9 enacts a statutory bar on proceedings "which could not have been brought or sustained had this Act been in operation prior to the time on which the cause of action arose." Litigation practice will need to engage with the temporal test embedded in s 9: courts will have to determine whether a cause of action could have been brought or sustained under the counterfactual that the Validation Act had existed earlier. That temporal and counterfactual test raises discrete procedural and evidentiary issues.

• Questions about the scope of "undertaking" and the governor’s ratification (s 6). If litigants challenge the treatment of a matter as an "undertaking" or contest the effect of deemed ratification, courts would need to interpret the principal Act’s definition of "undertaking" in the context of the Validation Act’s deeming language.

• Determinations under the Unclaimed Moneys Act 1912 (s 7(2)). Where the Commission has treated amounts as unclaimed money under the direction of s 7(2), litigation could arise concerning whether proper procedures under the Unclaimed Moneys Act have been followed.

Because the supplied material contains no judicial decisions, practitioners wishing to ascertain how courts have applied s 7(1)’s defences, the reach of s 9’s bar on proceedings, or the interplay with the Unclaimed Moneys Act should conduct a jurisdictional search of reported and unreported decisions post‑1978 to see whether any litigation has tested these provisions. The statutory text itself provides the contours of dispute but not any case law authority resolving those contours.

This Act contains several drafting and practical features that can produce surprising legal outcomes if not carefully observed. The following items are concrete, source‑grounded points to watch for.

• Retroactive validation can change historical rights and liabilities. Sections 4, 5, 6 and 7 operate retrospectively. Amounts and acts that a consumer or contractor assumed were invalid because they were not properly authorised may be retrospectively validated, making those charges collectible and contracts enforceable. Practitioners should not assume that procedural defects automatically void earlier Commission acts: the Act expressly deems many of those defects cured (ss 4, 6, 7).

• Limited but significant judicial exceptions remain for recovery. Although s 7(1) validates tariffs and permits recovery, the section preserves a defence where the demand was not justified by "non‑supply, mistake or other cause not limited to the failure by the Commission to comply with the provisions of the principal Act." That language is wide but requires that the person resisting recovery "establish" the defence. The effect is to shift the burden onto the defendant in a recovery action. Practitioners must therefore plan to marshal evidence on non‑supply, mistake or other concrete causes to contest recovery.

• Validation of retention without interest. Section 7(2) validates retention of deposits as income and removes liability for interest "where no rate was determined in respect thereof." If a rate was not set, the Commission has statutory cover against claims for retrospective interest. Challengers seeking retrospective interest must therefore show that a rate had been determined or otherwise rely on equitable remedies independent of this Act.

• Deeming of Governor approval and contract ratification. Section 6 deems that matters were approved by the Governor or contracts ratified. This removes a common ground for challenging a contract’s validity. A counterparty who believes a contract was void for lack of ratification will face the statutory deeming as a substantial hurdle.

• s 9’s bar is framed counterfactually and temporally. Section 9 prevents proceedings "which could not have been brought or sustained had this Act been in operation prior to the time on which the cause of action arose." The operative test is counterfactual: whether the proceeding could have been brought or sustained if the Act had existed before the cause arose. This raises practical questions about timing and cause of action. Litigants need to be precise about when a cause arose and whether it would have been viable in the counterfactual; otherwise claims may be dismissed for jurisdictional reasons.

• Specific by‑laws validated only by reference to a date. Section 8 validates by‑laws published in the Government Gazette on 23 June 1978 and cited as the State Energy Commission (Electricity and Gas Charges) By‑laws 1978. If there are other by‑laws or later versions, they are not covered by this discrete deeming and would require separate analysis.

• Treatment as unclaimed money imports separate statutory obligations. Where refunds cannot be made, s 7(2) requires amounts to be handled under the Unclaimed Moneys Act 1912. Entities dealing with such funds must comply with that statute’s procedures; failing to do so could invite administrative or civil consequences under that other statute.

• Commencement is tied to the amending Act. Section 2 states that the Act comes into operation on the day the amending Act comes into operation. Practitioners must track the actual commencement date of the amending Act to determine the Validation Act’s retrospective reach and the precise cut‑off for validated acts.

• Absence of consumer protection or penalty provisions. The Act focuses on validation rather than consumer remediation. While it preserves some defences, it does not provide express compensation, interest, or restitution mechanisms beyond ordinary civil recovery and the Unclaimed Moneys Act. Consumers seeking remedies beyond those preserved defences may need to search for alternative statutory or equitable causes of action.

• Narrow textual scope. The Act’s validation applies only "in respect of the purported exercise by the State Energy Commission of certain powers" as framed by the amending Act and the principal Act (preamble, ss 3-4). The deeming provisions should be read narrowly: they validate acts that fall within the kinds of powers now conferred by the amending Act and not unrelated conduct.

In short, the Validation Act can convert apparent procedural defects into enforceable legal positions, curtails certain challenges, and alters rights to interest and refunds. Parties affected by pre‑amendment Commission conduct must examine whether the specific transactions fall within the Act’s text and whether they can establish one of the preserved judicial defences.

Compliance for affected parties differs depending on whether one represents the Commission, the State/Treasurer, or private parties (consumers, depositors, counterparties). The following steps are grounded in the statutory text and necessary practical follow‑ups.

For the Commission (or its legal and accounting officers)

1. Identify and catalogue validated acts. Prepare an inventory of all acts, tariffs, schedules, tables, by‑laws, contracts, undertakings, deposits and guarantees in issue prior to the amending Act’s commencement that fall within the kinds of powers later conferred (s 4, s 7, s 8). Document factual circumstances and dates to show whether the Act’s retrospective deeming applies.

2. Exercise collection rights carefully. Where prior demands were made under validated tariffs, the Commission may recover moneys in a court of competent jurisdiction (s 7(1)). Before pursuing recovery, assess whether the debtor can plausibly establish non‑supply, mistake or other cause. Maintain contemporaneous evidence of supply, account notices, connection/reconnection work orders and correspondence to meet evidentiary challenges.

3. Handle deposits in accordance with s 7(2) and the Unclaimed Moneys Act 1912. Establish procedures to refund or credit deposits where appropriate. For deposits that cannot be refunded or credited, follow the Unclaimed Moneys Act procedures as though the funds were unclaimed money (s 7(2)). Document attempts to contact depositors and to effect refunds, and ensure administrative compliance with the Unclaimed Moneys Act.

4. Confirm interest positions. If no rate of interest was determined for deposits, record that position. Where a rate was determined, maintain documentation demonstrating the rate to avoid disputes concerning retrospective interest.

5. Archive ratification and approval records. For matters deemed approved by the Governor or contracts deemed ratified (s 6), keep records demonstrating the earlier substantive approvals or, where absent, document the basis on which the validation is relied upon. This will assist in countering later litigation.

6. Check by‑law status. For the specific by‑laws validated by s 8, confirm that the text and publication correspond to the 23 June 1978 Government Gazette entry and maintain the Gazette record.

For the Treasurer and State agencies

1. Confirm guarantee terms and implementation. Section 5 deems that specific guarantees given by the Treasurer were authorised and properly implemented in the terms of the amending Act. Agencies and Treasury should maintain complete records of guarantees and the related procedural steps to support enforcement and to demonstrate compliance with the validated procedures.

2. Coordinate with Commission recovery efforts. Treasury and the Commission should agree on positions regarding whether and how validated guarantees will be invoked and whether further procedural steps are necessary to secure enforcement.

For consumers, depositors and counterparties

1. Assemble evidence of non‑supply, mistake or other cause. If resisting recovery or seeking refund, gather contemporaneous material evidence of non‑supply, billing mistakes, or other lawful grounds that would render a demand unjustified (s 7(1)). The statutory language places emphasis on the party establishing the defence.

2. Check whether a rate of interest was determined. If no rate was determined, s 7(2) removes the Commission’s liability for retrospective interest in relation to deposits. If a rate was determined, collect records showing the rate or agreement.

3. Assess the effect of s 9 on possible proceedings. Before initiating or continuing litigation related to pre‑amendment acts, evaluate whether the cause of action "could not have been brought or sustained had this Act been in operation prior to the time on which the cause of action arose" (s 9). If a proceeding would be precluded by s 9, consider whether other available remedies exist.

4. Monitor unclaimed money procedures. If the Commission claims that an amount cannot be refunded and has treated it under the Unclaimed Moneys Act 1912 pursuant to s 7(2), check whether appropriate notification, publication and look‑up mechanisms under that Act have been followed. Where procedures under the Unclaimed Moneys Act are not observed, a remedy may be available under that Act.

For courts and counsel

1. Apply s 7(1) defences strictly. When adjudicating recovery claims, courts should require clear evidence that the demand was not justified for reasons within the statutory exceptions. The Act’s text requires a party resisting recovery to "establish" the ground.

2. Treat s 9 as a jurisdictional or procedural bar issue. Litigants must plead and prove the temporal and counterfactual elements of s 9. Courts should carefully determine the time of accrual of causes of action and whether the counterfactual test excludes proceedings.

3. Bring Unclaimed Moneys Act compliance into focus. When matters involve funds treated as unclaimed money under s 7(2), courts should consider whether the Commission has complied with the Unclaimed Moneys Act’s requirements, as those will be relevant to disposition rights.

Administrative and operational measures

• Retain and index Government Gazette notices, tariff schedules and any off‑Gazette publications that the Commission used. The Act validates off‑Gazette publications (s 7(1)), but documentary proof will be necessary to support recovery actions.

• Maintain correspondence logs with depositors and customers showing attempts to refund or credit deposits. These records will be relevant both for compliance with the Unclaimed Moneys Act and for defending claims that a demand was unjustified.

• Where possible, regularise outstanding procedural authorisations under the principal Act and ensure that future governance complies strictly with the principal Act and the amending Act to avoid reliance on validation measures.

In all cases, parties should align factual records with the statutory thresholds in ss 4-9. The Act’s remedial nature means that documentary proof is the primary mechanism through which parties assert rights or resist claims arising from validated past acts.
