State Concessions Act 2004

The Act introduces a hierarchy of defined categories of concession recipients. The foundational category is ‘eligible beneficiary’. This includes Commonwealth health care card holders (section 3 paragraph (b)), but excludes cards issued in respect of a child in foster care or a child for whom a carer allowance is payable under section 953 of the Social Security Act 1991 (Cth). It also includes Gold Card holders under the Veterans’ Entitlement Act 1986 (Cth) who are eligible for treatment under Part V, except dependants other than the widow or widower of a veteran. Critically, the Minister may by order declare any class of person to be an eligible beneficiary under section 4(1). This power allows the executive to expand the pool of concession recipients without further legislative amendment. ‘Eligible pensioner’ is a narrower category: holders of a Commonwealth pensioner concession card or Gold Card holders who both are eligible for treatment under Part V of the Veterans’ Entitlement Act and receive a pension under section 13(1) as the widow or widower of a veteran. ‘Eligible recipient’ combines eligible pensioners with Gold Card holders who are eligible for treatment and receive a pension as a totally and permanently incapacitated veteran under section 24 of the Veterans’ Entitlement Act. ‘Eligible person’ is the widest category, being anyone who is an eligible beneficiary, eligible pensioner, or eligible recipient.

The ‘user cost’ is the charge on which a concession can be granted. Section 3 lists rates or charges under the Local Government Act 1989, domestic gas, electricity, water and sewerage charges. The Minister may by order declare any other charge to be a user cost under section 4(2). This gives the executive the flexibility to add new categories of charges, for example if new utility taxes or levies are created. The ‘relevant period’ is the period during which the user cost was incurred, which determines whether a person was eligible when they incurred the charge.

A ‘concession order’ is an order made under section 5. It may determine concessions in relation to user costs payable under an Act or otherwise. This means the concession can apply to charges imposed by statute (such as council rates) or by private contract (such as a gas retailer’s charges). The order may apply to all eligible persons or to a class of eligible persons. The form of the concession is flexible: a pro rata reduction of the user cost, an amount payable in respect of the user cost, an amount to be deducted, or any other manner. The order may be of general or limited application; differ according to time, place or circumstance; be subject to specified conditions; specify the application process; and apply to a class of eligible persons. The order takes effect on the date of publication in the Government Gazette or a later date specified in the order. Before making an order that relates to a user cost payable under an Act, the Minister must consult with the Minister administering the provision of that Act under which the user cost is payable.

The reimbursement mechanism is a central concept. Section 9 requires the Minister to ensure that any agency, person or body with an obligation under an Act or otherwise to grant concessions in accordance with a concession order is reimbursed by the State. The reimbursement is paid from the Consolidated Fund, which is appropriated by the Act. Section 10 permits the Minister to enter into agreements or arrangements with those agencies covering the period, terms and conditions of the reimbursement and the concessions granted. This allows the State to contractually specify how and when claims are made and verified.

The Act directly affects three groups: the eligible persons who may receive concessions, the agencies that must grant them, and the Minister who administers the scheme. Eligible persons are primarily low income households that hold Commonwealth concession cards, households with children in care or foster care (though those are specifically excluded from the health care card definition), elderly pensioners and veterans. The Minister can also declare additional classes, so the pool is not static. The Act does not require a means test beyond holding the relevant card, but the card itself is means tested under Commonwealth law. The concession reduces the out of pocket cost of rates and utility bills for these households.

Agencies affected include local councils (for rates and charges), electricity retailers, gas retailers, water corporations and sewerage service providers. These entities are obliged under the terms of the concession order to grant the reduction on the user cost. They then claim reimbursement from the State. The Act does not specify the terms of reimbursement beyond requiring the Minister to enter into an agreement. This creates a compliance burden for the agencies: they must verify the customer’s eligibility at the time the user cost is incurred, apply the correct concessional rate, maintain records, and submit reimbursement claims. The administrative cost of this process is borne by the agencies, though the reimbursement covers the value of the concession itself, not necessarily the administrative overhead. The agreement under section 10 may address that, but it is not mandatory.

The Minister and the state budget are also affected. The Consolidated Fund is appropriated under section 9(2) to reimburse concessions granted. This means spending is automatic and does not require further parliamentary approval each year. The total cost depends on the take up rate and the level of concessions set in the orders. The Minister must also arrange for newspaper publication and tabling, though failure does not invalidate orders. The Minister is required to consult with other portfolio ministers before making orders that affect user costs payable under their Acts, which introduces an interdepartmental coordination step.

The wider community of taxpayers ultimately funds the scheme. There is no provision in the Act for cost recovery from the benefiting households or for any contribution from the agencies. The Act creates a transfer from general taxpayers to households meeting the eligibility criteria. The value of the transfer depends on the orders, which can be changed by the Minister without legislative amendment. This gives the executive flexibility but also creates uncertainty for eligible persons and agencies, because the level of concession may change without public consultation. The Act does not require a regulatory impact statement or cost benefit analysis before an order is made.

The Act imposes a clear duty on the Minister under section 9(1) to ensure that agencies granting concessions are reimbursed by the State. This is a mandatory obligation. The duty is backed by an automatic appropriation from the Consolidated Fund. The Minister also has a duty under section 5(2) to consult with the relevant portfolio Minister before making a concession order that relates to a user cost payable under an Act. This is a procedural requirement that does not require agreement, only consultation. The Minister must publish the order in the Government Gazette (section 5(1)) and cause a copy to be published in a daily newspaper (section 6). The Minister must also cause a copy to be laid before each House of Parliament within seven sitting days of the Gazette publication (section 7). However, section 8 provides that failure to comply with the newspaper publication or tabling requirements does not affect the validity, operation or effect of the order. In effect, the only mandatory step for the order to have legal effect is publication in the Gazette.

Agencies that have an obligation under an Act or otherwise to grant concessions in accordance with a concession order have a duty to grant those concessions to eligible persons who apply and satisfy the conditions set out in the order. This duty arises from the concession order itself, not directly from the State Concessions Act. The Act does not create a private right of action for eligible persons if an agency fails to grant a concession. The enforcement mechanism is likely through the reimbursement agreement under section 10 or through the underlying Act that imposes the user cost. For example, if a council is obliged under the Local Government Act to grant a rates concession, a failure could be challenged under that Act. The State Concessions Act does not add a separate penalty.

Eligible persons have a right to apply for the concession in the manner specified in the concession order (section 5(4)(d)). They do not have a right to the concession itself independent of the order; the order determines the amount, conditions and application process. If an order is made, eligible persons may claim. If an order is silent on a particular class, they have no entitlement. The Act does not give eligible persons a right to be heard before an order is made or amended.

The Minister may enter into agreements or arrangements with agencies under section 10. This is a discretionary power, not a duty. The agreement must include arrangements for reimbursement. The Act does not specify what must happen if no agreement is reached. The Minister retains the duty to ensure reimbursement regardless of whether an agreement exists, as per section 9(1). The agreement is a practical tool for setting terms, notice periods and verification procedures, but it is not essential to the operation of the scheme.

The Act contains no penalty provisions. It does not create any offences, and it does not specify any enforcement actions for failure to grant concessions, for failure to comply with the reimbursement duty, or for non compliance by eligible persons. This is a notable gap. The enforcement of the concession scheme relies on other Acts that impose obligations on agencies. For example, if a council does not grant a rates concession as required by a concession order, the council may be in breach of its obligations under the Local Government Act 1989 or the order itself, but the State Concessions Act provides no direct remedy. The eligible person’s recourse would be through the administrative law or the specific Act under which the user cost is payable. The Minister’s duty to ensure reimbursement under section 9 is enforceable by the agency that is owed the money, presumably through the agreement or through an action for debt against the State, although the Act does not create a statutory cause of action.

The automatic appropriation under section 9(2) ensures that funds are available, but it does not guarantee timely payment. If the Minister fails to pay, the agency would need to pursue payment through the agreement (which may specify dispute resolution) or through a court proceeding. The Act is silent on interest for late payment or any penalty for delayed reimbursement.

Section 8 provides that failure to comply with the newspaper publication or tabling requirements does not affect the validity of the order. This effectively removes any legal penalty for non compliance with those procedural steps. A Minister could omit the newspaper publication and the order would still be effective. This reduces the transparency incentive but avoids litigation over technical defects.

Because the Act has no penalty provisions, the practical enforcement burden falls on the agencies that grant concessions. They must verify eligibility correctly. If they grant a concession to an ineligible person, they may not be reimbursed by the State. The agreement under section 10 would likely address verification procedures and audit rights. If they fail to grant a concession to an eligible person, they may face complaints, but no statutory penalty arises under this Act. The overall enforcement structure is light and relies on contractual arrangements and the strength of underlying legislation.

The Act directly interacts with the State Concessions Act 1986, which it repeals under section 12. Section 14 deems references in other Acts, subordinate instruments and documents to the 1986 Act to be references to the 2004 Act, unless the context is inconsistent. This ensures continuity. The Schedule to the Act originally contained consequential amendments to other Acts, but that Schedule was repealed by the Statute Law Revision Act 2011 (No. 29/2011) as at 22 June 2011. The text of the repealed Schedule is not available in this version, so it is not possible to identify which Acts were amended. The effect of the repeal is that those amendments are no longer contained in this Act; they may have been incorporated into the other Acts or may have lapsed.

The more significant interaction is with the Acts under which user costs are payable. Section 5(2) requires the Minister to consult with the Minister administering the provision of the Act under which the user cost is payable before making a concession order that relates to that user cost. For example, if the order affects rates under the Local Government Act 1989, the Minister must consult with the Minister for Local Government. This does not require the other Minister’s consent, only consultation. The order can still be made even if the other Minister objects.

The concession order alters the charge that would otherwise be payable under the other Act. For example, if the Local Government Act 1989 imposes a rates liability, the concession order reduces that liability for eligible persons. The other Act must accommodate this reduction. Agencies such as councils must modify their billing systems and processes to apply the concessional rate. The interaction is hierarchical: the concession order overrides the full rate for eligible persons, but only if the agency grants the concession. The agency is obliged to grant it by the concession order, but the source of that obligation may be the other Act if it incorporates the concession regime. The State Concessions Act does not itself impose the obligation; it merely empowers the Minister to make an order that creates the obligation.

The reimbursement mechanism under section 9 interacts with the Consolidated Fund and the appropriation process. The Act provides its own appropriation, so no further annual appropriation is needed. This gives the scheme budget certainty but also reduces parliamentary oversight of spending on concessions. The agreements under section 10 may interact with state procurement laws and contract law generally.

The Act may also interact with the Social Security Act 1991 (Cth) and the Veterans’ Entitlement Act 1986 (Cth) insofar as eligibility is defined by reference to cards issued under those Commonwealth Acts. Changes to Commonwealth card eligibility will automatically affect the pool of eligible persons under the Victorian Act. This creates a dependency on Commonwealth policy decisions. The Minister’s power to declare additional classes under section 4(1) can partially insulate the state scheme from Commonwealth changes, but the core eligibility hinges on federal concessions.

The Act was assented to on 16 November 2004 and came into operation on 1 March 2005 by operation of section 2(2), as it was not proclaimed earlier. It has been amended once. The Statute Law Revision Act 2011 (No. 29/2011) received assent on 21 June 2011 and commenced on 22 June 2011. Section 3(Schedule 1 item 89) of that Act repealed the Schedule to the State Concessions Act 2004. The Schedule originally contained consequential amendments to other Acts, but the content of those amendments is not reproduced in the available version. The repeal had the effect of removing those provisions from the Act. The explanatory details in the endnotes state that no entries exist at the date of publication, so no further information is provided about the original Schedule.

No other amendments have been made to the Act. The version as at 22 June 2011 is version 003. The Act has not been amended in the decade since, which may indicate that the framework is considered stable or that the scheme is operating without need for legislative change. The Minister’s order making power allows changes to concession levels and eligibility classes without amending the primary Act, which may explain the lack of amendment activity. The Act itself is a skeleton; the substantive changes occur through orders which are not recorded in the primary legislation.

The repeal of the 1986 Act under section 12 is a transitional measure that consolidates the law. The effect of the deemed references in section 14 ensures that instruments referencing the old Act continue to operate. This history is straightforward.

The text of the Act and the endnotes contain no references to any litigation. The Act has been in operation since 2005 and has been the subject of no reported judgments cited in the source. This is not surprising for a framework Act that does not create penalties or private rights of action. Disputes would likely arise under the specific Acts that incorporate the concession obligations or under the reimbursement agreements, not under the State Concessions Act itself. For example, a dispute between an agency and the Minister over the amount of reimbursement might be resolved through the agreement’s dispute resolution clause or through a commercial arbitration or court proceeding, but such disputes would not necessarily generate a reported decision on the Act itself.

The definitional provisions could potentially be litigated, for instance on the meaning of ‘eligible beneficiary’ with respect to the exclusion of foster care children or dependants of veterans. The power of the Minister to declare additional classes under section 4(1) could be challenged on the grounds that it is an impermissible delegation of legislative power, but such a challenge would be against the validity of the order, not the Act itself. Section 8’s provision that non compliance with publication and tabling does not affect validity may have been included to avoid litigation over procedural defects, and it appears to have been effective in preventing such challenges. No litigation history is provided in the source material, and it would be speculation to assert that none exists. The answer is that the source does not refer to any litigation, and the analyst cannot assume or invent it.

Several provisions in the Act could catch out the unwary. The most significant is section 8: a failure to comply with the newspaper publication requirement under section 6 or the tabling requirement under section 7 does not affect the validity, operation or effect of a concession order. This means an order is effective from the date of Gazette publication even if the Minister neglects to publish it in a newspaper or table it. Agencies and eligible persons cannot rely on the newspaper publication as a guarantee that the order is valid or that they will be notified. The only definitive publication is the Government Gazette. Agencies must monitor the Gazette to know the current concession levels. The newspaper publication is a transparency measure with no legal consequence for omission.

The consultation requirement under section 5(2) applies only when the concession order relates to a user cost payable under an Act. If the user cost is not payable under an Act for example, domestic gas charges that are governed by a retail contract the Minister is not required to consult with any other Minister. The definition of user cost includes domestic gas charges without specifying an Act, so gas concessions could be made without interdepartmental consultation. This may lead to inconsistencies if the gas concession interacts with other energy regulation.

The Minister’s power to declare additional eligible beneficiary classes under section 4(1) is broad. The order does not need to be tabled or published in a newspaper, only in the Government Gazette. There is no requirement for consultation or impact assessment before adding a class. This could expand eligibility quickly and create unanticipated budget costs. Conversely, the Minister could also narrow eligibility by amending a concession order to apply only to a class of eligible persons, as per section 5(4)(e). However, the Minister cannot remove a class from the definition of eligible beneficiary once declared under section 4(1) unless that order is itself amended or revoked. The Act does not require a sunset or review of such declarations.

The ‘relevant period’ definition ties eligibility to the period when the user cost was incurred. If a person becomes eligible after the user cost period, they may not claim a concession for that period. The Act does not provide for retrospective application. Agencies must verify the person’s eligibility status during that specific period, not at the time of billing or payment. This can create administrative complexity if bills span periods when a card is issued or expires mid period.

The reimbursement mechanism under section 9(2) provides an appropriation from the Consolidated Fund ‘to the necessary extent’. This is a standing appropriation that does not require annual legislative approval. However, if the value of concessions granted exceeds the budget allocation within the department, there may be practical funding constraints, but legally the appropriation is sufficient. The Act does not require the Minister to cap the total reimbursement or to seek supplementary funding. This can lead to budget overruns without parliamentary control.

There is no offence for an eligible person who knowingly provides false information to obtain a concession. The Act is silent on fraud. The reimbursement agreement under section 10 may include audit and clawback provisions, but the Act itself does not impose penalties for misrepresentation. This is a notable gap for a scheme that involves taxpayer funds.

Finally, the Act does not contain a provision for review of the Minister’s decisions or orders. There is no merits review or requirement for reasons. An affected person or agency may seek judicial review under general administrative law, but the Act does not facilitate it.

For an agency that must grant concessions under a concession order, compliance requires several steps. First, the agency must identify the current applicable concession orders by monitoring the Government Gazette. The Gazette is the definitive source; newspaper publication is not reliable for legal effect. The agency should establish a system to track new orders and amendments, including any changes to the categories of eligible persons or the level of concession.

Second, the agency must verify the eligibility of each customer claiming a concession. This involves checking the type of card presented (health care card, pensioner concession card, Gold Card, etc.) and ensuring that the card was valid during the relevant period when the user cost was incurred. The exclusion for certain health care card holders (foster care and carer allowance) and for certain Gold Card dependants must be applied. The agency may need to ask for additional information, such as whether the card is for a child in foster care. If the Minister has declared additional classes under section 4(1), those must be incorporated into the verification process.

Third, the agency must apply the correct concession as specified in the order. The concession may be expressed as a pro rata reduction, a fixed amount, or some other manner. The agency must calculate the billed amount accordingly and issue a reduced invoice to the eligible person. The agency should maintain records of each concession granted, including the customer’s eligibility evidence, the amount of concession, and the relevant period.

Fourth, the agency must enter into an agreement or arrangement with the Minister under section 10 if it has not already done so. The Act allows the Minister to initiate such agreements but does not require the agency to have one. However, without an agreement, the agency may face uncertainty about the reimbursement process. The agreement should specify the terms for claiming reimbursement, the timing of payments, the required documentation, and any audit or verification procedures. The agency should ensure that its internal processes align with the agreement’s requirements.

Fifth, the agency must submit reimbursement claims to the State in accordance with the agreement. The claims should be accurate and supported by evidence. The Act does not prescribe a time limit for claims, but the agreement likely will. The agency should reconcile reimbursements received against the concessions granted. If the State fails to reimburse, the agency can rely on the agreement for remedies, but the Act itself does not provide a private right of action.

For the Minister, compliance involves ensuring that the reimbursement duty under section 9 is met. The Minister should have a system to process claims from agencies and arrange payment from the Consolidated Fund. The Minister must also consult with relevant portfolio ministers before making orders that affect user costs under Acts, and should document that consultation. The Minister must publish orders in the Gazette, and should attempt to comply with the newspaper publication and tabling requirements even though failure does not invalidate the order, to maintain transparency and avoid criticism.

For eligible persons, compliance is straightforward: hold a valid concession card during the period the user cost is incurred, and apply for the concession in the manner specified in the concession order. The order may require the person to provide their card details, complete a form, or notify the billing agency. The person should keep copies of their card and any correspondence. If the concession is refused, the person may have recourse under the underlying Act that governs the user cost, but not under this Act.
