State Aid to Religion Abolition Act 1871

The Act directly affects all religious denominations that held Crown-granted land in Victoria as of 6 January 1871 (the date of assent). This includes the Anglican Church, Presbyterian, Methodist, Catholic, and any other body recognised as a denomination under the broad definition. It also affects the trustees of those lands, who must consent (or be overridden by a majority) to any application. The “head or authorised representative” of the denomination (as accepted by the Governor) is the moving party. Persons entitled to minister in or occupy a building on the land also have a consent right (s 4) and thus an effective veto if they refuse to join. The Minister of the Crown administering the Act receives applications and lodgements. The Governor (acting on Executive Council advice) decides applications where objections are lodged; where no objections, the decision is mandatory provided requirements are met. The Registrar of Titles under the Transfer of Land Statute issues the new certificate of title and holds the Gazette notice as the trust document. The Act also affects the Crown itself: it ceases to reserve land for religious purposes after 1 July 1870 (retrospective repeal) and ceases to pay money from consolidated revenue for religion after 31 December 1875. Taxpayers and the public are affected because the ongoing public subsidy to religion is ended, and land previously held subject to public‑use restrictions becomes private property. The Act does not directly affect individuals who are not part of a denomination or who hold no office in one, except that their right to object to an application (s 6) is a limited public participation right - any person may lodge an objection, but only within the one‑month window. Landlords, neighbours, or other members of the public could challenge an application if they believed the land was not properly covered or the trustees lacked authority. The Act therefore creates a narrow class of potential objectors (any person) but does not require public notice beyond the Gazette and one local newspaper, so practical awareness may be low.

The Act imposes a series of procedural duties on denominational applicants. The head or authorised representative must make an application in the form set out in the First Schedule, with the written consent of the resident trustees (or a majority) and of any occupant minister (s 4). The applicant must lodge the application at the Minister’s office, and within one month give notice by advertising once in the Government Gazette and once in a local newspaper, and serve a copy on any non-consenting resident trustee (s 5). These notice duties are conditions precedent to the Governor allowing the application without objection; failure to comply would likely prevent the application from being allowed. The applicant also bears the duty to certify details of the original grant, promise, or reservation, and to list all trustees, buildings, and occupants (First Schedule). The applicant has the right to request that the Governor modify the proposed trusts if an objection is lodged, but only with the applicant’s consent (s 7). The applicant also has the right to have the application allowed if notice is properly given and no objection is lodged within one month from the last advertisement, and if the land is indeed of the kind described (s 7 - “the Governor shall allow the application”). This mandatory language creates a right in the applicant to a favourable decision in the absence of objections. If objections are lodged, the Governor has a discretion to allow, reject, or modify; the applicant has no right to insist on the original terms.

The rights of objectors are limited: any person may lodge an objection at the Minister’s office within one month from the last advertisement (s 6). No standing requirement (e.g. property interest) is imposed, so any member of the public can participate. The objector has no further right beyond lodging; the Governor decides what weight to give the objection, and may refer it for inquiry and report (s 7). The objector has no right to appeal the Governor’s decision. Non-consenting trustees have a special right to be served with the application (s 5), but their consent is not individually required if a majority of resident trustees consent. Their objection might still be lodged under s 6, but they have no veto.

The Governor’s power to frame regulations (s 10) allows alteration of the forms in the Schedules, so long as consistent with the Act. The Governor may also refer objections for inquiry and report by any person. The Registrar of Titles has a duty to register the new trustees as joint proprietors in fee, with no survivorship (s 8), upon application after the allowance is gazetted. Section 9 provides that the certificate of title has the same effect as any other Transfer of Land Statute certificate, giving the new trustees and persons dealing with them the usual Torrens immunity: persons dealing with the trustees are not concerned with the trusts (the Gazette notice is deposited but does not affect the immunity of subsequent purchasers).

The Act contains no penalties or offences. It does not create criminal liability for failure to comply, nor does it impose fines, imprisonment, or civil penalties. Enforcement is indirect: if the procedural duties are not met, the Governor will not allow the application. The only sanction for non-compliance is the denial of the benefit (the ability to dispose of the land free of the old trusts). For example, if an applicant fails to advertise in the Gazette or local newspaper, or fails to serve non-consenting trustees, the application may not be allowed, or an objector could bring the failure to the Governor’s attention. Because the Governor’s allowance is conclusive evidence of compliance (s 8), any procedural defect would need to be raised before the allowance is gazetted; after gazettal, the validity of the title cannot be challenged on grounds of non-compliance with the Act. The Act thus places the burden on objectors to monitor and challenge applications quickly. The Governor may also refer objections for inquiry, but there is no penalty for an objector who makes a frivolous objection. The Governor’s decision is final: there is no appeal to a court under the Act. If a certificate of title is improperly issued, the Torrens assurance fund might provide compensation, but that is under the Transfer of Land Statute, not this Act. The Act also provides that the Gazette publication is conclusive evidence that all provisions have been complied with - meaning that even if the applicant did not strictly follow the procedure, the gazettal cures the defect. This is a strong enforcement protection for the new trustees: once the Governor signs the allowance and it is published, the title is unassailable on procedural grounds.

The Act expressly interacts with three pieces of legislation. First, it repeals section 53 and Part 8 of Schedule D of the Constitution Act (the 1855 Constitution) as from 31 December 1875 (s 1). That section had required the setting apart of public moneys for the advancement of the Christian religion and for public worship. The Act does not repeal any other part of the Constitution. Second, it overrides section 7 of the Land Act 1869: s 8 provides that the new trustees hold the land fee-simple “anything contained in the seventh section of the Land Act 1869 to the contrary notwithstanding”. Section 7 of the Land Act 1869 presumably imposed restrictions on dealings with land granted for public or religious purposes; this Act removes those restrictions for land that goes through the application process. Third, the Act repeals part of section 6 of the Land Act 1869, retrospectively from 1 July 1870, insofar as it relates to reservations of Crown lands for places of public worship and ministers’ dwellings (s 11). The remainder of the Land Act 1869 continues unaffected. The Act also relies on the Transfer of Land Statute (the Torrens system) for the issuance of certificates of title. Section 9 provides that the certificate has the same effect as any other Torrens certificate, and the Gazette containing the allowance is deposited as the document declaring the trusts, under section 38 of that Statute. That section likely required trust documents to be lodged with the Registrar. The Act also references the Land Act 1869 in s 12, preserving promises or reservations made before the cut-off date unless an application is made - so the Land Act’s reservation provisions still apply to those lands until and unless the denomination chooses to apply under this Act. The Act does not interact with the common law of trusts except to extinguish the original trusts and replace them with the new trusts stated in the application. There is no apparent interaction with the Victorian Charitable Trusts Acts, as the Act provides its own regime. No amendment history exists; the Act has not been amended since 1871.

The Table of Amendments endnote confirms that no amendments have been made to the State Aid to Religion Abolition Act 1871 by any subsequent Acts or subordinate instruments. The Act has remained in its original form since receiving royal assent on 6 January 1871. However, the version as at 3 March 2003 (the version provided) includes endnotes showing no amendments. This does not mean the Act is still operative in practice; many of its provisions would have been spent once the 31 December 1875 deadline passed and once denominations completed disposal of their lands. But the Act remains on the Victorian statute book as a historical enactment. Its lack of amendment suggests that the policy of disentangling state from religion in land grants and funding was settled and not revisited. The Act’s definitions section, particularly the broad definition of “denomination” covering any church or religious body of whatever faith, has not been updated, so it would include modern religious bodies if any residual operation remains. The Governor’s regulation-making power (s 10) has presumably been used if at all, but no regulations are noted in the provided text. The Act is a short, self-contained piece that achieved its objectives and then became dormant.

The provided text and endnotes contain no entries for litigation history. No cases are mentioned, and the Explanatory Details endnote entry states “No entries at date of publication.” It is possible that litigation arose in the decades after 1871 concerning the validity of particular applications, the meaning of “denomination”, or the effect of the conclusive evidence clause, but no such cases are recorded in the source. The Act’s design aimed to minimise litigation: s 8 makes the publication of the allowance conclusive evidence of compliance, barring any collateral attack on procedural grounds. Section 12 preserves existing promises until application, so no immediate dispute arises about whether land was properly promised or reserved. The Governor’s discretion when objections are lodged may have produced some administrative law challenges, but the Act provides no right of appeal. Given the Act’s age and the probability that most applications were processed within a few years of 1871, any litigation would likely be historical and not readily available from the source. The absence of recorded cases in the official endnotes suggests that either no significant litigation occurred, or that the case law is not compiled in the version provided. For the analyst, this means the Act’s interpretations are untested by modern courts, and any today would rely on the plain text. The conclusive evidence provision in s 8 is particularly powerful and would make it difficult to reopen settled titles.

Several provisions can trap the unwary. First, the repeal of state aid does not take effect until 31 December 1875, nearly five years after the Act’s assent (s 1). That meant the state continued to fund religion for another five years. A reader might assume immediate cessation; the Act deliberately delayed. Second, the repeal of the power to reserve Crown lands for churches and ministers’ dwellings is retroactive to 1 July 1870 (s 11), six months before the Act was passed. This means any reservation made between 1 July 1870 and 6 January 1871 is automatically invalid, unless it was a promise or reservation that had already been made before 1 July 1870 (s 11 saves those made before that date). Third, s 12 preserves promises or reservations made under the old law until a denomination applies under the Act - so old trusts continue unless and until the denomination chooses to convert them. A denomination that never applied remains bound by the original trusts. Fourth, the conclusive evidence provision in s 8 means that once the allowance is gazetted, it is impossible to challenge the application for procedural defects. This includes defects in consents, advertising, or the authorisation of the head or representative. The only window for objection is the one month after the last advertisement; after that, the title is final. Could an objector challenge the Governor’s allowance on jurisdictional grounds (e.g., the land was never of the type described)? Possibly, but s 8 says “conclusive evidence that all the provisions of this Act in respect of the application have been complied with and that the trustees named … are entitled to the land … discharged of all trusts”. The language is broad; it may preclude even jurisdictional challenges. Fifth, the certificate of title issues to the new trustees as joint proprietors with no survivorship - that is a tenancy in common, not a joint tenancy (s 8). This is a specific Torrens rule: on the death of a trustee, their share passes to their estate, not to the other trustees. This may affect the management of the trust property; the surviving trustees do not automatically hold the whole. Sixth, the definition of “trustee” includes any person holding that office, “although no legal estate may be vested in such person” (s 2). This means that bare trustees or those with only equitable interests are caught; they must consent or be served. Seventh, the applicant must obtain consent of “the person or persons, if any, entitled to minister in or occupy any building upon the land” (s 4). If a minister resides on the land, they have a consent right. A minister who refuses consent may block the application unless the denomination can argue no building exists (if the building is unoccupied, or if the person is not “entitled”). Eighth, the Governor can modify the proposed trusts only with the applicant’s consent (s 7). If an objection leads the Governor to propose modifications the applicant rejects, the application may be rejected. Ninth, the Act does not require that the new trusts be for religious purposes; the proceeds of disposition may be applied “for the purposes of such denomination in such manner as the denomination may deem most beneficial” (s 3). This means the denomination could sell the land and use the money for any purpose, including non-religious activities. Tenth, the Act does not contain a sunset clause; it remains in force, so if any land fitting the description still exists and has not been transferred, the mechanism could theoretically be used today, subject to the limitation that the land must have been granted, promised, or reserved before 1 July 1870 (for promises or reservations) or at any time without purchase money (for grants); but the grant must have been at the time of the Act’s passing (s 3 - “at the time of the passing of this Act have been granted”). That temporal limit likely means only lands already granted by 6 January 1871 are eligible. Finally, the application form requires a statement of the purposes to which proceeds will be applied - those purposes become the new trusts. If the statement is too vague, the Governor might reject or require modification.

Compliance with the Act for a denomination wishing to dispose of Crown-granted land requires a five-step process. First, the denomination must identify the land. It must have been granted by the Crown without purchase money, or promised or reserved for church, church and school, or minister’s dwelling purposes, before 1 July 1870 (for promises/reservations) or at the time of the Act’s passing (for grants). Land granted after the Act is not covered. Second, the head or authorised representative (accepted by the Governor) must prepare an application in the form of the First Schedule. This requires stating the details of the original grant, promise, or reservation; listing all resident trustees (whether or not they hold legal title - see the wide definition) and obtaining their written consent or the consent of a majority of them. The consent of any person entitled to minister in or occupy a building on the land must also be obtained; if no such person exists, that must be stated. The application must include a Statement of Trusts setting out the new trustees (with names, residences, occupations), their powers of disposition (sale, exchange, mortgage, lease, etc., and any limitations), and the purposes to which proceeds or land taken in exchange will be applied. The new trusts replace the old ones. Third, the application must be lodged at the office of the Minister. Within one month of lodging, the applicant must advertise the application once in the Government Gazette and once in a newspaper circulating in the neighbourhood of the land. A copy of the application must also be served on any resident trustee who did not consent. Fourth, the applicant must wait one month from the date of the last advertisement. If no objection is lodged, the Governor must allow the application (s 7). If an objection is lodged, the Governor will consider it; the applicant may suggest modifications with the Governor’s concurrence. The Governor may also refer the objection for inquiry and report. The applicant should be prepared to respond to objections. Fifth, once the Governor signs the allowance (in the form of the Second Schedule), it must be published in the Government Gazette. That publication is conclusive evidence of compliance. The applicant then applies to the Registrar of Titles for a certificate of title, depositing a copy of the Gazette containing the allowance as the document declaring the trusts (s 9). The Registrar will issue a certificate of title to the new trustees as joint proprietors in fee, with no survivorship. The land is now held under the Torrens system on the new trusts, free of all previous restrictions. The denomination can then exercise the powers of disposition stated in the trusts (e.g. sell, lease, mortgage) and apply the proceeds to the stated purposes. It is critical to strictly follow the form and timing; any deviation may give an objector grounds. However, once the allowance is gazetted, the title is unassailable as to compliance.
