Standard Time and Summer Time Act 1972

The Act introduces several defined and operational concepts. Standard time is UTC+10, fixed by section 4 and defined in the dictionary as “ACT standard time”. Summer time is one hour in advance of standard time during a summer time period, defined as “ACT summer time” (section 5). The summer time period is either the default period (2 am first Sunday in October to 2 am first Sunday in April) or such other period as the Minister declares under section 6 (dictionary). Coordinated universal time is defined by reference to the International Bureau of Weights and Measures and maintained under the Commonwealth National Measurement Act 1960, section 8AA (dictionary). This ties the ACT’s time standard to the international atomic time scale, not to any astronomical or solar observation.

The concept of a legal instrument is central. The dictionary defines it broadly to include: (a) an Act or statutory instrument; (b) a contract or agreement, whether oral or in writing or both; (c) a deed or other instrument having legal effect. This means that even verbal agreements are caught by the interpretive rule. The Act does not define “other instrument having legal effect”, leaving scope for judicial interpretation - it could include wills, trusts, court orders, notices, or any document that creates, varies, or extinguishes legal rights.

The dictionary itself is part of the Act (section 2), and definitions apply to the entire Act unless the contrary intention appears (note 2 to section 2). The dictionary replaced earlier provisions; the original Act had definitions scattered in sections. The 2005 amendments systematically rewrote the Act, introducing the current dictionary and replacing references to “daylight saving period” with “summer time period”. The 2008 amendment altered the dictionary definition of “summer time period” to codify the uniform start and end dates that had effectively been adopted by all Australian states that observe daylight saving (except Western Australia, Queensland, and the Northern Territory). However, the Minister’s power to declare a different period means uniformity is not guaranteed.

Another important concept is the manifest contrary intention exception in section 7(3). If a legal instrument expressly provides for time to be determined by a different standard, or does so by “manifest contrary intention”, the interpretive rule does not apply. The phrase “manifest contrary intention” is not defined; it likely requires clear language or necessary implication that the instrument intends to depart from ACT time. This gives parties some freedom to contract out of the default regime, but only if they are explicit. An oral agreement that impliedly refers to a different time zone may not satisfy the “manifest” standard, increasing the risk of unintended application of ACT summer time.

The Act also distinguishes between references to a time and references to a period of time (section 7(5) clarifies that the section applies to both). So a lease starting at 9 am on a particular date and a 72-hour notice period are both subject to the interpretive rule.

The Act affects every person, business, and government entity that relies on time references in legal instruments within the ACT. Because the definition of “legal instrument” is so broad, the Act applies whenever an Act, statutory rule, contract, deed, or other document has any time-related term that is not expressly displaced. This includes: individuals signing leases, employment agreements, or loan contracts that specify times; businesses with trading hours, delivery deadlines, or time-based penalties; schools, hospitals, and transport operators whose schedules have legal implications (e.g., school attendance regulations, patient consent forms); financial institutions handling transaction cut-off times; and media companies broadcasting time signals.

The Act particularly affects parties to interstate transactions. If a contract governed by ACT law refers to 5 pm, that means ACT summer time during the summer period. If the counterparty is in Queensland (which does not observe daylight saving), confusion can arise unless the contract specifies which time zone applies. The Act does not provide a choice-of-law rule for time; it simply says that if a legal instrument is subject to ACT law, the time reference is interpreted using ACT time. For cross-border contracts, this may lead to disputes over whether the parties intended ACT time or the time where performance occurs. The manifest contrary intention exception allows parties to override the default, but requires them to be aware of the rule and to draft accordingly.

The Minister is directly affected by the power to declare a summer time period. The declaration is a notifiable instrument, meaning it must be published on the legislation register but does not require tabling or disallowance unless the Legislation Act so requires. This power could be exercised to align the ACT’s daylight saving with New South Wales or Victoria, or to adopt a different period for local reasons. The decision affects everyone in the ACT, but the Minister bears no direct cost; the compliance costs fall on businesses and individuals who must adjust schedules, update software, and manage confusion.

The exception for astronomy, meteorology, and navigation (section 7(4)) means that scientists, meteorologists, and navigators in those fields are not affected by summer time for those purposes. However, if they are also parties to legal instruments (e.g., research contracts, equipment leases), the general interpretive rule still applies unless the instrument falls within the exception. The Act also excludes the use of summer time for those purposes, but not the use of standard time - meaning that during summer time, astronomical observations could be recorded in UTC+10 while legal obligations refer to UTC+11.

The Act imposes no duties on private actors. Its primary legal effect is to create an interpretive rule for time references. The only duty is on the Minister to make a declaration in writing if she wishes to alter the summer time period (section 6(1)). No duty to consult, provide reasons, or give advance notice exists in the Act itself, though the Legislation Act may impose notification requirements. The duty to make the declaration a notifiable instrument is procedural, ensuring transparency via the public register.

Private parties have the right to rely on the time standard determined by the Act. If a contract requires payment by 5 pm, the payor is deemed to have complied if payment is made by 5 pm ACT standard or summer time as applicable. Conversely, a payee cannot claim late payment if the time is properly calculated under the Act. This provides legal certainty for time-based obligations, reducing transaction costs that would arise if each instrument had to specify its own time reference.

Parties also have the right to exclude the default rule by including an express term or showing a manifest contrary intention (section 7(3)). This preserves freedom of contract, but only if they are sufficiently explicit. The burden of proof falls on the party arguing that a different time standard applies, and the standard is high: “manifest contrary intention” implies a clear, not merely implied, departure. An oral agreement that refers to “Sydney time” might not suffice if Sydney is in the same time zone as the ACT, but if the speaker means AEDT (UTC+11) while the ACT is on standard time, the ambiguity could be resolved by the surrounding circumstances, though that is uncertain.

The Act does not create any right to compensation for losses caused by a change in summer time period. If the Minister declares an early start or late end, businesses that rely on a fixed schedule (e.g., farmers, airlines, broadcasters) bear the adjustment costs without recourse. There is no requirement for a regulatory impact statement or cost-benefit analysis before a declaration is made.

Similarly, the Act does not grant any right to challenge a declaration other than through standard judicial review avenues (e.g., for unreasonableness or failure to consider relevant matters). The discretion is wide. The only substantive limit is that the declaration must be a “period” for this Act, presumably of some finite duration, but that could be as short as a day or as long as several years. The Act does not forbid the Minister from making multiple declarations in a year, creating start-and-stop daylight saving.

The Act contains no penalty provisions. It does not create any offences. The republication note on page i states that the value of a penalty unit for an offence against this republished law is $100 for individuals and $500 for corporations, but that note appears to be a generic statement required by drafting practice for republications of ACT laws that contain offences. In this Act, no offence exists, so the penalty unit value is irrelevant.

Enforcement is thus indirect. If a person fails to comply with a time-based obligation in a legal instrument, and that obligation is interpreted under section 7, the consequence is civil: breach of contract, late payment, missed deadline, or invalidity of an action. The court or tribunal will use the Act to determine whether the time was correctly calculated. The Act itself does not provide a remedy; the remedy arises under the law governing the instrument (e.g., contract law, employment law, property law). The Act simply supplies the time standard.

There is no regulator responsible for enforcing the Act. The Minister’s declaration is self-executing; no one checks compliance. The only potential enforcement action would be judicial review of a Ministerial declaration if it were ultra vires (e.g., if the Minister declared a period that could not reasonably be considered a “period” or that conflicted with another law). But the Act gives broad discretion, and courts typically defer to executive decisions on matters of time-setting unless clearly unreasonable.

The absence of penalties means that the Act imposes no direct compliance cost on individuals or businesses. The cost is indirect: the need to ascertain the current summer time period, to update clocks and systems, and to ensure that time references in contracts are either consistent with the Act or expressly excluded. For most people, this cost is negligible (they rely on broadcast time). But for large organisations with automated systems, a change in the summer time period may require software patches, manual adjustments to schedules, and communication across departments. The Act does not require the Minister to give notice before the declaration takes effect; the notifiable instrument must be notified, but notification could occur simultaneously with the commencement of the period, leaving no lead time.

Section 7(1) applies whenever a “legal instrument” - defined to include Acts and statutory instruments - refers to time. This means the Act overrides any implied time references in all other ACT legislation, unless the other Act “expressly, or by a manifest contrary intention, provides for the reference to have another meaning” (section 7(3)). So, for example, if the ACT Employment Act says “an employer must pay wages by 5 pm”, that time is interpreted as ACT summer time during the summer period, even if the Employment Act contains no explicit time zone reference.

The Act interacts with the Legislation Act 2001 in several ways. Notifications of ministerial declarations are made under the Legislation Act (section 6(2) note). The definition of “coordinated universal time” relies on the Commonwealth National Measurement Act 1960, which incorporates international standards. The Act also interacts with the Interpretation Act (now part of the Legislation Act) which may contain general provisions about time - but section 7 of this Act will prevail for ACT time references unless the contrary intention is shown.

For interstate instruments, the Act only applies if the instrument is governed by ACT law. If a NSW contract is litigated in the ACT, the court may apply NSW time if the contract’s proper law is NSW. The Act does not purport to change choice-of-law rules. However, if an instrument is silent on governing law but is executed in the ACT, a court might infer that ACT law applies, bringing in the Act’s time rule.

The exception for astronomy, meteorology and navigation (section 7(4)) means that other laws regulating those fields (e.g., aviation regulations, weather data collection) must use standard time, not summer time, for those purposes. This could create a mismatch: a flight plan filed for 10 am may be in standard time, but the same time in a contract for hangar hire could be in summer time if the contract does not specify.

The Act does not override the National Measurement Act (Cth) definition of UTC; it adopts it. That Act’s provisions on timekeeping are given effect in the ACT through the dictionary definition.

The Act’s effect on private agreements is potentially far-reaching. Because a “legal instrument” includes oral contracts, a verbal agreement to meet at 3 pm is deemed to use ACT time. This eliminates the need for every contract to specify a time zone, reducing negotiation costs but also removing flexibility. If two parties agree to meet at 3 pm “your time” while in different cities, the manifest contrary intention exception may not apply unless the phrase “your time” is considered a clear enough departure from ACT time.

The Act began as the Standard Time and Summer Time Ordinance 1972 (Cwlth) A1972-34, notified on 23 October 1972 and commencing the same day. It was a Commonwealth ordinance applicable to the ACT under the Seat of Government (Administration) Act 1910 (Cwlth). The original ordinance established standard time as UTC+10 and provided for summer time, initially without a fixed default period; the Minister could declare a daylight saving period.

It was first amended by the Standard Time and Summer Time (Amendment) Ordinance 1982 (Ord1982-4), which inserted section 7 (originally dealing with references to time) notified 4 March 1982. The 1986 amendments came in two waves: Ord1986-1 (27 February 1986) substituted section 7 and removed the definition of “year”; Ord1986-59 (10 October 1986) omitted section 7 entirely and inserted a new section 5A dealing with declaration of daylight saving period, and amended the definition of “daylight saving period” to align with the then-standard start/end dates (though the default period was later changed).

After self-government on 11 May 1989, the ordinance was converted into an ACT enactment under section 34(4) of the Australian Capital Territory (Self-Government) Act 1988 (Cwlth). The name changed from “Ordinance” to “Act” by the Self-Government (Citation of Laws) Act 1989 A1989-21. Further amendments occurred: the Statute Law Revision (Miscellaneous Provisions) Act 1993 A1993-1 removed the definition of “the Territory”; the Legislation (Consequential Amendments) Act 2001 A2001-44 replaced section 5A and amended section 6, and omitted section 2 (dictionary) temporarily.

The most significant restructuring came with the Justice and Community Safety Legislation Amendment Act 2005 (No 3) A2005-43, which rewrote the Act. It substituted sections 4, 5, and 6; inserted a new section 7; omitted old section 5A; inserted a new dictionary; and redefined “summer time period” as the period from first Sunday in October to first Sunday in April, with a fallback to a Ministerial declaration. This removed the old “daylight saving period” terminology and aligned the Act with contemporary drafting practice.

The Standard Time and Summer Time Amendment Act 2008 A2008-24 amended the dictionary definition of “summer time period” to codify the precise wording of the default period (2 am start/end on the first Sundays). This followed a national agreement among states observing daylight saving to maintain uniform dates. The 2008 amendment commenced on 9 July 2008, which is the republication date of the source text.

The amendment history shows that the Act has been substantively amended at least six times. The trend has been toward clarity: defining terms in a dictionary, specifying a default period, and simplifying the language. However, the ministerial override power has remained through all versions, giving the executive ongoing discretion over the summer time period.

The source text does not mention any reported cases. The Act is a mechanical statute that rarely generates litigation because it provides a clear rule. Most potential disputes would involve factual questions (e.g., “was the payment made by 5 pm under ACT summer time?”) rather than legal interpretation of the Act.

The most litigable provisions are the “manifest contrary intention” exception (section 7(3)) and the definition of “legal instrument” (dictionary). One could imagine a dispute over whether an oral agreement that references “Eastern Standard Time” but is made in the ACT during summer time is sufficient to show manifest contrary intention. Similarly, courts may need to decide whether a particular document (e.g., a text message exchange) constitutes a “legal instrument” for the purposes of time interpretation. No reported decisions have tested these points.

The Ministerial declaration power (section 6) could be challenged for procedural failure - e.g., if a declaration was not notified properly. But the Legislation Act provides the framework, and any challenge would likely be under the Legislation Act 2001 rather than this Act itself.

The Act’s stable life and lack of political controversy over daylight saving in the ACT (which has aligned with NSW for decades) have contributed to the absence of litigation. If the Minister were to declare a non-uniform period, legal challenges could emerge from businesses seeking to avoid compliance costs or from individuals arguing that the declaration is unreasonable. But as of 2008, no such cases exist in the public record.

Several features of the Act could catch unwary parties.

1. Ministerial discretion without notice requirements. Section 6 allows the Minister to declare a summer time period different from the default. The Act imposes no minimum notice period before the declaration takes effect. A declaration could be made and notified on the same day it starts, leaving businesses and individuals scrambling to adjust. The notifiable instrument requirement only means publication; it does not require a delay. If the Minister decides to start summer time a week early or extend it a week late, immediate compliance is expected.

2. Retrospective application of section 7. Section 7(6) states that the section applies to a legal instrument even if it was made before the commencement of the section (which was inserted in 2005). This means that a contract signed in 1990 that says “payment due at 5 pm” is now interpreted using ACT summer time, even if the parties originally intended standard time. Unless the contract contains a manifest contrary intention, the new interpretive rule applies. Existing contracts that are silent on time zone are now subject to daylight saving adjustments that did not exist when they were written (though daylight saving did exist in the ACT pre-2005, the 2005 amendment clarified the rule). This could produce unexpected late payments or deadlines.

3. Oral agreements are legal instruments. The dictionary definition of “legal instrument” includes “a contract or agreement (whether oral or in writing or both)”. So a verbal agreement to meet at 10 am is statutorily interpreted using ACT summer time. If two people agree to meet at 10 am in a café, but one party assumes standard time and the other summer time, the Act dictates that summer time applies during the summer period. The “manifest contrary intention” exception may not apply to oral agreements because it is harder to prove a clear intention to depart from the default. This adds uncertainty to everyday transactions.

4. Override only by express agreement or manifest contrary intention. Section 7(3) permits departure, but the standard is high. A contract that says “time of payment is 5 pm AEDT” may be sufficient if AEDT aligns with ACT summer time, but if the contract says “5 pm EST” that could be ambiguous (EST is UTC+10, but during summer that is not the time in the ACT). Parties cannot rely on trade custom or past conduct to override the Act; they need express language or a clear implication. This increases drafting costs for any contract where time matters.

5. Exception for astronomy, meteorology, navigation only. Section 7(4) preserves standard time for those three purposes. But legal instruments that touch on those fields, such as contracts for satellite data or weather observation, may still be subject to summer time for non-astronomical provisions. For example, a contract that requires delivery of meteorological data by a certain time might be ambiguous: the data collection is exempt, but the contractual delivery time is not. The interplay could cause confusion.

6. Default period is not an Act; it is in the dictionary. The default summer time period is defined in the dictionary, which is part of the Act, but it can be overridden by a ministerial instrument. Changes to the dictionary by amending Act require parliamentary scrutiny, but changes by ministerial declaration do not (subject to disallowance). A future government could alter daylight saving dates without new legislation, creating uncertainty for those planning long-term contracts.

7. No grandfathering for existing contracts after a declaration. If the Minister declares a longer or shorter summer period, all existing legal instruments that rely on the default period are automatically reinterpreted. A contract written when the default period was the first Sunday in October to the first Sunday in April may be affected if the Minister moves the start to September. The contract does not need to be amended; its time references shift. This may create windfall gains or losses for parties.

Compliance with the Act requires no filing, registration, or approval. It is entirely passive: the time standard is determined by the Act, and legal instruments are automatically interpreted accordingly. However, prudent actors should take steps to avoid unintended consequences.

For individuals and small businesses: Rely on public time signals (broadcast, telecommunications, public clocks) which automatically reflect any summer time changes. Ensure that any agreements you enter that involve a time element (e.g., lease start times, appointment times in contracts) are understood to be based on ACT time. If you make a verbal agreement with someone in a different time zone, confirm in writing which time standard applies. Keep track of the current summer time period by monitoring the ACT legislation register for declarations under section 6. It is good practice to check the register each year before the expected start of daylight saving.

For businesses with multiple jurisdictions: Explicitly include a time zone clause in all contracts. Example: “All times referred to in this agreement are references to ACT standard time or, if a summer time period is in effect, ACT summer time, unless the parties expressly agree in writing to another time standard.” This avoids reliance on the Act’s default and prevents ambiguity. For contracts with counterparties in Queensland, Western Australia, or the Northern Territory, this is essential. Even for contracts with NSW or Victoria, which currently use the same schedule as the ACT default, the Ministerial power to change the ACT period means uniformity cannot be assured.

For automated systems and IT: Ensure that any system that processes time-based events (payroll, billing, access control, scheduling) is configured to adjust for ACT summer time based on the default period, but also incorporate a mechanism to receive updates if the Minister declares a different period. Because the declaration is a notifiable instrument, subscription to notifications from the ACT legislation register can alert IT managers to changes. The 2008 amendment fixed the default period in law, but future amendments or declarations could alter it. Manual patches may be required annually.

For lawyers and contract drafters: Review existing instruments that were created before 2005 (or before any relevant declaration) to see if they contain time references. If they are silent, they are now subject to summer time adjustments. Consider whether to amend those instruments to include a manifest contrary intention if the parties did not intend summer time to apply. For new instruments, specify the time standard explicitly, even if you intend to use ACT time - that eliminates ambiguity. Note that the “manifest contrary intention” exception requires clear drafting; “all times referred to are in ACT standard time” is unambiguous.

For the Minister: Comply with the requirement to make a declaration in writing and to ensure it is notified as a notifiable instrument. Before issuing a declaration, consider the implications for businesses and the community: a change from the uniform dates imposes adjustment costs and may be perceived as an unexpected regulatory burden. While the Act does not require consultation, prudent Ministers may nonetheless consult or provide advance guidance.

General compliance strategy: There is no regulator to audit compliance, so the risk is purely civil. The best protection is to ensure that any time-dependent right or obligation is documented in a way that makes the intended time standard clear. For those who do nothing, the Act provides a default that works smoothly as long as the default period remains unchanged and the counterparty is also in the ACT. The risk arises when the Minister exercises the override power or when cross-border issues arise. Monitoring the legislation register and updating contracts accordingly is the sensible approach.
