Sports Drug Testing Act 2001

The Act’s structure relies on a small set of cross-references to the Commonwealth Australian Sports Drug Agency Act 1990 (the Commonwealth Act) and a defined class of Western Australian participants. The principal concepts and their legal effects are these.

• ASDA. The Act uses the same institutional actor established by the Commonwealth Act, naming ASDA and conferring on it the same functions in relation to WA competitors as it has in relation to Australian competitors (s 3, ASDA; s 4(1)). This is not the creation of a separate WA agency. The Act imports ASDA’s statutory role into Western Australian sporting contexts for the specified class of persons.

• WA competitor. The definition in s 3 is the key gatekeeping concept. It captures four categories: (a) persons who represent, are selected to represent, or purport to represent Western Australia in sporting competition; (b) persons in selection squads; (c) persons who receive Government “support” (as defined in the Commonwealth Act) to enable or assist participation or training; and (d) persons whose names are entered on a register under the Commonwealth Act. The definition explicitly excludes “Australian competitor” (s 3), so the Act targets a WA-specific list rather than duplicating Commonwealth coverage.

• Importation and reading-in of the Commonwealth Act. Section 3 adopts defined terms from the Commonwealth Act, including sample and sporting competition. Section 4(1) gives ASDA the same functions in relation to WA competitors as it has under the Commonwealth Act for Australian competitors, and s 4(4) prescribes how to read the Commonwealth Act when applying those functions to WA competitors (for example, “references to representing Australia were references to representing Western Australia” (s 4(4)(c))). The Act therefore relies on the Commonwealth Act’s substantive machinery for testing, registering and dealing with competitors, read subject to the textual substitutions listed in s 4(4).

• Information and education duty. Section 4(2) places a specific function on ASDA to disseminate information about the possibility of being asked to provide samples, the procedures involved, and the likely consequences of non-compliance or positive results (s 4(2)(a)-(b)). This is a procedural/communications obligation placed on ASDA in its dealings with WA competitors.

• Protection of minors. Section 5 creates a specific protective rule: ASDA must not request a sample from a WA competitor under 18 unless written parental or guardian consent is first obtained (s 5(1)). A parental refusal is not to be treated as the competitor’s failure to provide a sample, nor can it be used as grounds to enter the competitor’s name on a Commonwealth Act register (s 5(2)(a)-(b)). Consent may be general or specific to a particular request (s 5(3)).

• Ministerial agreement. Section 6 restricts ASDA’s ability to exercise the functions conferred by the Act until there is an agreement in force between ASDA and the Minister about the performance of those functions (s 6(1)). The agreement may require ASDA to perform the functions in the manner or subject to the conditions provided in the agreement (s 6(2)). This places a formal gate between statutory functions and operational execution.

• Regulation-making power. Section 7 permits the Governor to make regulations necessary or convenient to give effect to the Act. The scope includes matters required or permitted to be prescribed by the Act (s 7).

These concepts work together to extend the Commonwealth Act’s drug-testing infrastructure into Western Australian sport subject to textual substitutions, specific protections for minors, an agreement requirement, and a stand-alone requirement that ASDA communicate relevant information to WA competitors.

The Act’s defined class of WA competitors (s 3) identifies the primary group affected. That class is broader than just athletes who represent the State at interstate or national events. It includes four distinct categories.

• Representative athletes. Persons who represent, are selected to represent, or purport to represent Western Australia in sporting competition, whether individually or as part of a team (s 3(a)). This catches formal representatives and those holding themselves out as representing the State.

• Squad members. Persons in squads formed for selecting persons or teams to represent Western Australia (s 3(b)). This reaches athletes at pre-selection levels where selection decisions are made.

• Government-supported persons. Persons who receive Government “support” (as that term is defined in the Commonwealth Act) to enable or assist participation in, or training for, sporting competition (s 3(c)). This category ties coverage to financial or in-kind assistance from the Government. The Commonwealth Act’s definition of “support” is adopted by reference (s 3), so the scope depends on the Commonwealth Act’s definition.

• Registrants under the Commonwealth Act. Persons whose names are entered on a register under the Commonwealth Act (s 3(d)). This brings within the WA regime any person placed on a Commonwealth Act register, even if their connection to Western Australia is indirect.

Excluded from the WA competitor definition is the label “Australian competitor” (s 3), so the Act targets people from the WA cohort rather than duplicating any Commonwealth coverage of national competitors. The Act also affects institutional actors.

• ASDA. The agency has functions in relation to WA competitors identical to its Commonwealth functions (s 4(1)). The Act compels ASDA to communicate about testing and consequences (s 4(2)) and only permits ASDA to act under the Act once an ASDA-Minister agreement is in force (s 6(1)).

• The Minister. The WA Minister is a decision-maker under s 6 because ASDA may not act under the Act unless a Ministerial agreement exists and that agreement can impose manner and conditions for performance (s 6(1)-(2)). The Minister therefore controls whether and on what terms ASDA exercises the Act’s functions in Western Australia.

• Administrative Appeals Tribunal. The AAT, members and officers have the same functions in relation to WA competitors as they have under the Commonwealth Act for Australian competitors (s 4(3)), so the AAT is a review/decision forum in the imported regime.

• Parents and guardians. For competitors under 18, parents or guardians have a decisive role: ASDA must obtain their written consent before requesting a sample from a minor, and a refusal cannot be treated as the competitor’s failure or used to justify recording the minor on a register under the Commonwealth Act (s 5(1)-(2)). Consent can be general or request-specific (s 5(3)).

• The Governor and the executive. The Governor has a regulation-making power (s 7), and the execution of ASDA’s functions in WA depends on the Minister entering an agreement with ASDA (s 6).

Who pays and who bears burden. The Act does not set out financial arrangements. Costs of testing, information dissemination, and administration are not detailed in the Act. The Act creates potential costs for affected athletes and sporting bodies, including the obligation to submit samples if requested (subject to the constraints in s 5 and s 6) and to receive the informational material ASDA must provide (s 4(2)). The Government, via the Minister and any agreement with ASDA, will decide operational parameters including likely financial arrangements because the Act bars ASDA from acting without an agreement with the Minister (s 6(1)-(2)).

This section sets out the duties imposed by the Act and the principal rights that follow directly from its text.

Duties imposed on ASDA

• Functional parity. ASDA “has the same functions in relation to WA competitors as are conferred on it by the Commonwealth Act in relation to Australian competitors” (s 4(1)). That is a duty to exercise the statutory powers and responsibilities that the Commonwealth Act confers, in relation to WA competitors, subject to this Act’s adjustments.

• Information dissemination. ASDA must disseminate information about the possibility of WA competitors being requested to provide samples, the procedures for obtaining and testing samples, and the likely consequences for failing to comply or for registering positive results (s 4(2)(a)-(b)). This imposes a communicative obligation rather than an investigatory duty.

Duties and constraints on ASDA’s operational exercise

• Agreement requirement. ASDA must not exercise any functions conferred by this Act unless there is an agreement in force between ASDA and the Minister about the performance of those functions (s 6(1)). This is a precondition to ASDA acting in Western Australia under the Act.

• Agreement content. The agreement may require ASDA to perform functions in the manner or subject to the conditions provided in the agreement (s 6(2)). This permits the Ministerial agreement to prescribe how ASDA’s functions are to be exercised in WA.

Duties of the Administrative Appeals Tribunal

• Parity of functions. The AAT and its members and officers have the same functions in relation to WA competitors as under the Commonwealth Act in relation to Australian competitors (s 4(3)). This confers on the Tribunal the same procedural and review roles as in the Commonwealth regime, applied to WA competitors.

Rights and protections for WA competitors

• Minors’ parental consent right. A WA competitor under 18 cannot be requested to provide a sample unless written consent is obtained from the parent or guardian (s 5(1)). The parent or guardian can give or refuse consent generally or with respect to a particular request (s 5(3)). This is both a protection and a right: it prevents ASDA from requiring sample provision from minors in the absence of parental consent.

• No adverse treatment for parental refusal. A parental or guardian refusal to consent is explicitly not a failure by the competitor to provide a sample (s 5(2)(a)) and is not a ground for entering the competitor’s name on a register under the Commonwealth Act (s 5(2)(b)). That removes two concrete adverse legal consequences for minors whose parent or guardian refuses consent.

Regulatory powers

• Governor’s regulation power. The Governor may make regulations for matters required or permitted by the Act or necessary or convenient to its purpose (s 7). This enables the executive to specify further details of processes and implementation.

Implicit or imported duties and rights

• Functions and remedies under the Commonwealth Act. Because s 4(1) imports ASDA’s functions and s 4(4) prescribes reading the Commonwealth Act “as if” certain substitutions were made, rights and duties under the Commonwealth Act potentially apply to WA competitors as if they were Australian competitors. For example, registers, testing procedures and any Commonwealth Act appeals machinery reasonably fall within the imported functions, read subject to the Act’s substitutions and caveats (s 4(1), s 4(4)). The Act itself does not restate offence provisions, sanctions or the Commonwealth Act’s procedural regime; instead it relies on the Commonwealth Act’s content as read into the WA context.

Operational constraints and decision authority

• Ministerial control. The Minister is the gatekeeper who decides whether ASDA may exercise the imported functions in Western Australia by entering an agreement and by setting manner and conditions in that agreement (s 6(1)-(2)). The Minister therefore holds a central practical right to determine the scope and conditions under which ASDA acts.

Summary

The Act imposes communicative and functional duties on ASDA (s 4), places a consent and protection regime for minors (s 5), conditions ASDA’s exercise of functions on a Ministerial agreement that can set manner and conditions (s 6(1)-(2)), and imports the Commonwealth Act’s machinery through a prescribed reading-in (s 4(4)). The Act does not itself create a schedule of offences or penalties; those mechanisms, if applicable, are imported through s 4(1) and s 4(4) from the Commonwealth Act.

The Sports Drug Testing Act 2001, as presented in the provided text, does not explicitly create new criminal offences, civil penalties or administrative sanctions within its own body. The Act’s enforcement architecture arises principally by importing ASDA’s functions under the Commonwealth Act and prescribing how the Commonwealth Act should be read in relation to WA competitors (s 4(1), s 4(4)). That importation is the primary route by which penalties and enforcement mechanisms associated with sports drug testing would apply to a WA competitor.

What the Act does say about enforcement mechanisms

• Functional importation. Section 4(1) gives ASDA the same functions in relation to WA competitors as are conferred by the Commonwealth Act in relation to Australian competitors. The enforcement mechanisms attached to those functions under the Commonwealth Act , for example registers and any associated sanctions or deprivations of eligibility , are not set out in the WA Act itself but are the mechanisms that ASDA would exercise under the imported functions, subject to the reading directives in s 4(4).

• How to read the Commonwealth Act. Section 4(4) directs that the Commonwealth Act is to be read as if certain substitutions had been made (for example, references to representing Australia read as representing Western Australia) and as if other necessary or prescribed changes had been made. The effect is to extend the Commonwealth Act’s enforcement and remedial machinery to cover WA competitors, after making the textual substitutions listed in s 4(4).

Limitations on enforcement in the WA Act

• Minors’ protection limits enforcement consequences. Section 5(2) provides that a parental or guardian refusal to consent is not a failure by the competitor to provide a sample and cannot be used as grounds for entering the competitor’s name on a register under the Commonwealth Act. That reduces the Commonwealth Act’s potential enforcement reach in respect of minors because one specified trigger for adverse administrative action under the Commonwealth Act cannot be invoked in WA for under-18s where parents or guardians refuse.

• Agreement requirement as an operational constraint. Section 6(1) prevents ASDA from exercising the functions conferred by the Act unless an agreement between ASDA and the Minister is in force. That agreement can regulate the manner and conditions of ASDA’s performance (s 6(2)). Therefore the Ministerial agreement can practically delay, condition, or limit the use of enforcement powers in Western Australia.

Administrative review

• Administrative Appeals Tribunal. Section 4(3) imports the AAT’s functions with respect to WA competitors in the same way as they operate under the Commonwealth Act for Australian competitors. This provides a route for administrative review of decisions taken under the imported Commonwealth Act regime, as applied to WA competitors.

What is not in the Act

• No standalone offence or penalty clauses. The WA Act does not itself enumerate offences, monetary penalties, or sanctioning processes. Any penalty or enforcement must be traced to the Commonwealth Act through the reading-in mechanism of s 4(1) and s 4(4).

Practical implication for enforcement

• Enforcement is a mix of Commonwealth machinery and WA constraints. In practice, enforcement against WA competitors depends on ASDA’s functions under the Commonwealth Act being imported and operationalised in WA, subject to the parental-consent protection for minors (s 5) and the agreement with the Minister (s 6). The Act leaves the specifics of penalties and enforcement to the Commonwealth Act regime, but it constrains when and how those mechanisms can be applied in Western Australia.

For legal advisers and compliance officers, the immediate task is to map the Commonwealth Act’s enforcement provisions onto the WA context using the substitutions in s 4(4), and to check any ASDA-Minister agreement and regulations under s 7 that will affect enforcement mechanics in WA.

The Act is heavily interdependent with the Commonwealth Australian Sports Drug Agency Act 1990 and with the Administrative Appeals Tribunal’s jurisdictional framework. Its primary interaction mechanisms are direct textual importation and substitution, an agreement that alters how imported functions are exercised, and a regulation power. The relevant provisions are s 3 (definitions importing Commonwealth Act terms), s 4 (importing functions and prescribing textual substitutions), s 5 (limiting effect of importation for minors), and s 6 (agreement requirement).

Direct importation of Commonwealth Act concepts and machinery

• Defined-term adoption. The Act treats certain terms as having “the same meaning as they have in the Commonwealth Act,” explicitly including sample and sporting competition (s 3). This ties statutory interpretation of those terms in the WA Act to the Commonwealth Act’s definitions.

• Functional importation. Section 4(1) states that ASDA has the same functions in relation to WA competitors as it has under the Commonwealth Act in relation to Australian competitors. Section 4(4) then prescribes how to read the Commonwealth Act for that purpose, instructing that references to competitors, national teams, and representing Australia be read as WA equivalents (s 4(4)(a)-(d)). This is a statutory mechanism for applying a Commonwealth regime to State-specified persons.

Administrative Appeals Tribunal and review pathways

• Parity of AAT functions. Section 4(3) brings the Administrative Appeals Tribunal into the imported framework by giving it the same functions in relation to WA competitors as it has under the Commonwealth Act in relation to Australian competitors. Therefore, decisions arising under the imported Commonwealth Act machinery as applied to WA competitors should be reviewable by the AAT under the same regime, as read pursuant to s 4(4).

Constraints and carve-outs

• Minors and Commonwealth Act consequences. Section 5 limits the operational effect of the Commonwealth Act in two respects for under-18 WA competitors: (1) ASDA must obtain parental consent before requesting a sample (s 5(1)); and (2) parental refusal is not a failure to provide a sample and cannot be used to justify entry on a register under the Commonwealth Act (s 5(2)(a)-(b)). These rules constitute express carve-outs from the Commonwealth Act’s application to minors in WA.

• Agreement with the Minister. Section 6 requires an agreement between ASDA and the Minister before ASDA may exercise functions conferred by the WA Act. This acts as a procedural and political overlay to the Commonwealth Act’s implementation in WA. The Ministerial agreement may dictate the manner and conditions for performance (s 6(2)), which may modify how the Commonwealth Act’s functions operate in practice within Western Australia.

Potential interaction with registers and person listings

• Registers under the Commonwealth Act. Section 3(d) explicitly makes persons whose names appear on a Commonwealth Act register part of the WA competitor class. At the same time s 5(2)(b) prevents parental refusal from being used as grounds to enter the name of a minor on such a register. Consequently, the Commonwealth Act’s registers are both a source of WA coverage and a subject to limited State-law constraints for minors.

Regulation-making and subordinate law

• Governor’s regulation power. Section 7 authorises regulations to prescribe matters required or permitted by the Act or necessary or convenient to achieve its purposes. Regulations may therefore clarify or expand the Act’s interaction with Commonwealth mechanisms and specify procedures for implementation.

Jurisdictional and interpretive implications

• Reading-in as an interpretive tool. Section 4(4) does not itself amend the Commonwealth Act but instructs that the Commonwealth Act be read for the purposes of this WA Act as if certain substitutions and necessary changes had been made. That is an interpretive device to align Commonwealth processes with State coverage. Advisers must therefore treat the Commonwealth Act’s provisions as applicable to WA competitors, subject to the textual substitutions and the WA Act’s specific limitations (for example, s 5 and s 6).

• No direct repeal or conflict clause. The Act does not expressly repeal or override other WA laws, nor does it spell out conflict resolution with other statutory regimes. Its operative mechanism is to read Commonwealth law into the WA context for specified persons, subject to the Act’s internal qualifications.

Practical consequence

• To understand legal rights, duties and remedies for WA competitors one must read the Commonwealth Act, make the substitutions required by s 4(4), and overlay the WA-specific rules in s 5 and s 6. The Act therefore creates a two-legged regime: the Commonwealth Act supplies the substantive testing and sanction machinery, and the WA Act supplies definitions, caveats and a Ministerial-approval gate.

The compiled text provided includes both the original enactment details and a single recorded amendment. The compilation table and marginal notes identify the legislative history from enactment through the later amendment.

Original enactment

• Short title and assent. The Sports Drug Testing Act 2001 (No. 13 of 2001) received assent on 14 August 2001 and commenced on 29 December 2001 (see s 2 and Gazette notice cited in the compilation table). The Act’s commencement date is therefore 29 December 2001 (compilation table).

Subsequent amendment recorded in the compilation

• Statutes (Repeals and Miscellaneous Amendments) Act 2009. The compilation shows an amendment recorded as “Statutes (Repeals and Miscellaneous Amendments) Act 2009 s. 118.” That instrument is recorded as No. 8 of 2009, assented 21 May 2009, with commencement 22 May 2009 (compilation table). The legislative notes in the Act indicate specific textual amendments effected by that instrument: the bracketed note following s 3 states “[Section 3 amended: No. 8 of 2009 s. 118(2).]” and the bracketed note following s 4 states “[Section 4 amended: No. 8 of 2009 s. 118(3).]”. The compilation table and marginal notes therefore show that s 3 and s 4 were amended in 2009 under s 118 of the Statutes (Repeals and Miscellaneous Amendments) Act 2009.

Scope of the recorded amendments

• The source text supplied does not include the pre-amendment versions or the precise textual changes made by the 2009 Act. The compilation notes identify which sections were amended (s 3 and s 4) and tie those amendments to the Statutes (Repeals and Miscellaneous Amendments) Act 2009, s 118. To determine the precise wording changes effected by that amendment, one would need to consult the 2009 amendment instrument or prior versions of the WA Act. The supplied compilation, however, records that s 3 and s 4 have been amended and that the amendments were made in 2009 (bracketed marginal notes after s 3 and s 4; compilation table).

No further amendments recorded in the supplied compilation

• The compilation table lists only the 2001 original Act (No. 13 of 2001) and the 2009 amendment (No. 8 of 2009 s. 118). No other amendments are recorded in the provided compilation table.

Practical note on amendment tracing

• The Act’s operation today must be read in light of the 2009 amendments as reflected in the current text. For amendment detail, the source text identifies the amending instrument and the affected sections but does not reproduce earlier wording. If specific historical wording or the exact nature of the changes is material to a legal question, the amending instrument and prior versions should be retrieved and compared.

The supplied legislative text and compilation do not include or reference any court or tribunal decisions concerning the Sports Drug Testing Act 2001. The Act does not list cases, decisions, or judicial interpretations in its notes. The compilation table and marginal notes record enactment and amendment history but do not record litigation. Therefore, on the basis of the provided material:

• No litigation is cited or recorded in the supplied text. The Act’s text refers to the Administrative Appeals Tribunal’s functions as applying to WA competitors (s 4(3)) but does not describe any decisions or a litigation record arising from the Act. Any judicial or administrative decisions that interpret how this Act operates in practice, or that address the interaction between the Commonwealth Act and this WA Act, are not included in the supplied source.

• Where administrative or judicial review might be expected in practice, the AAT is expressly brought into the regime (s 4(3)). That suggests an intended administrative-review pathway, but the supplied material contains no reported determinations or litigation extracts.

Practical consequence for research

• If litigation history or case law is required for advising on contested points , for example, disputes about whether a person is a WA competitor, whether an ASDA-Minister agreement was properly entered or complied with, or AAT decisions interpreting the imported Commonwealth Act provisions as applied to WA competitors , those materials are not in the provided Act text and must be sourced separately from tribunal or court databases, or from the AAT’s published decisions, where relevant. The Act as compiled here provides the statutory architecture but not any judicial construction.

This Act is short and relies heavily on reading-in the Commonwealth Act, which creates a number of practical “gotchas” for practitioners, administrators and sporting bodies. The following points draw directly from the statutory text and its cross-references.

Scope and definition surprises

• The WA competitor definition is broader than just representative athletes. It includes persons who “purport to represent” Western Australia (s 3(a)), members of selection squads (s 3(b)), recipients of Government support (s 3(c)), and those entered on a Commonwealth Act register (s 3(d)). Organisations that think only formal State representatives are covered may be mistaken; training squads and Government-supported participants can be pulled into the regime.

• Government support ties in Commonwealth definitions. The Act imports the Commonwealth Act’s definition of “support” by reference (s 3). The practical reach of that category depends on the Commonwealth Act’s content and can capture a wide array of financial and in-kind assistance. Practitioners must check the Commonwealth Act’s definition to know who is caught.

Agreement with the Minister as a precondition

• ASDA cannot act in WA without an agreement. Section 6(1) bars ASDA from exercising any functions conferred by this Act unless an agreement between ASDA and the Minister is in force. That means there may be periods when the statutory apparatus exists but ASDA is precluded from acting because no agreement has been concluded, or because the agreement’s terms limit action. Sporting organisations must not assume ASDA activity can commence merely because the Act exists; they must check whether an operative ASDA-Minister agreement exists and its scope.

Ministerial control over manner and conditions

• The Minister may impose how ASDA performs its functions. Section 6(2) allows the agreement to require ASDA to perform those functions in the manner, or subject to conditions, provided in the agreement. That gives the Minister considerable practical control over testing procedures, information-sharing, and possibly funding or administrative arrangements, all of which will affect how testing is conducted in WA.

Minor consent may disrupt testing data and processes

• Parents can block tests for minors without adverse administrative consequences. Section 5(1)-(2) means ASDA must not request samples from under-18s without written parental or guardian consent, and a refusal is not a recordable failure or registerable ground. For sports bodies used to national juvenile testing systems, parental refusal will stop requests and cannot be treated as non-compliance for the purpose of Commonwealth Act registers. That may affect enforcement statistics and the completeness of testing panels for youth athletes.

Imported Commonwealth Act provisions may be subtly altered

• The Act requires substitutions when reading the Commonwealth Act into WA (s 4(4)). This is an interpretive device rather than a formal amendment. Small wording differences between the Commonwealth and WA contexts may create interpretive uncertainty. Practitioners must undertake a careful textual exercise applying s 4(4)’s substitutions to the Commonwealth Act provisions to determine their precise operation in WA.

No standalone penalties in the WA Act

• Enforcement machinery is not restated. The WA Act does not itself set out offences, penalties or registration processes; it imports functions under the Commonwealth Act (s 4(1)). That means practitioners need to map the Commonwealth Act’s enforcement regime into the WA context using the reading-in prescribed in s 4(4), while bearing in mind WA-specific exceptions such as s 5.

Information duty but no procedural detail

• ASDA must disseminate information (s 4(2)), but the Act does not say how or to whom exactly. The practical reach of that duty may depend on the ASDA-Minister agreement and any regulations made under s 7. There is therefore uncertainty about whether dissemination must reach grassroots clubs, squads, or only registered State teams.

Uncertainty about financial and administrative burdens

• The Act is silent on funding. It does not specify who pays for testing, transport of samples, storage, or consequences of testing processes. Because ASDA is a Commonwealth agency, and execution in WA depends on a Ministerial agreement (s 6), financial arrangements and administrative burdens will be determined by that agreement, but the Act does not require a particular funding model.

Registers and cross-jurisdictional entries

• Names on Commonwealth registers trigger WA coverage, and vice versa. Section 3(d) brings persons entered on a register under the Commonwealth Act into the WA competitor definition. At the same time s 5(2)(b) limits register entries for minors whose parents refuse consent. Practitioners should note this two-way interaction.

Regulatory gap risks

• Regulations may fill detail gaps. Section 7 allows for regulations to prescribe matters required or convenient to give effect to the Act, but until regulations are made, there may be gaps in process, timelines and enforcement detail. Operational readiness depends on both an ASDA-Minister agreement and any regulations made.

Administrative Appeals Tribunal role

• AAT functions are imported (s 4(3)), but the Act does not explain the precise appeals pathway or timelines for review in WA terms. Advice on remedies should therefore examine the Commonwealth Act as read by s 4(4), and any AAT practice specific to WA cases.

In short, the “gotchas” arise from: (1) the breadth of the WA competitor definition; (2) the requirement that ASDA have an agreement with the Minister before acting; (3) the special parental-consent protections for minors; (4) the importation of Commonwealth machinery via textual substitution; and (5) the Act’s silence on funding and procedural detail, which may be filled by agreement or regulation.

This section sets out concrete steps for sporting organisations, government departments, ASDA and legal advisers to operationalise compliance with the Act as it is written. Each step is grounded in the Act’s provisions.

1. Identify who is a WA competitor

• Apply the definition in s 3 to each individual. Check whether the person: (a) represents, is selected to represent, or purports to represent Western Australia in sporting competition; (b) is in a squad for WA selection; (c) receives Government “support” under the Commonwealth Act for participation or training; or (d) has a name on a Commonwealth Act register (s 3). For category (c) review the Commonwealth Act’s definition of “support” because s 3 imports that meaning.

2. Confirm whether ASDA is authorised to act in WA

• Before implementing or responding to testing requests, verify if there is an agreement in force between ASDA and the Minister under s 6(1). ASDA is prohibited from exercising functions conferred by the Act unless such an agreement exists. Obtain a copy of the agreement, or confirm publicly available terms, to determine the scope and conditions under s 6(2).

3. Review the ASDA-Minister agreement

• If an agreement exists, examine it for conditions affecting manner of testing, notification processes, funding arrangements, roles and responsibilities, data-sharing protocols, and any limitations on ASDA action under s 6(2). The agreement can impose manner or conditions on ASDA’s performance, so those operational features will govern much of compliance.

4. Put parental consent procedures in place for minors

• For WA competitors under 18, do not permit ASDA to request a sample without written parental or guardian consent (s 5(1)). Establish and retain written consent forms, clarify whether consent is general or request-specific (s 5(3)), and implement procedures to document consent or refusal. Note that parental refusal is not a failure to provide a sample and cannot be used as grounds for entering the minor on a register under the Commonwealth Act (s 5(2)(a)-(b)). Maintain records to demonstrate compliance with s 5 if challenged.

5. Ensure information dissemination

• ASDA must disseminate information about possible testing, procedures, and consequences (s 4(2)(a)-(b)). Sporting bodies should: (a) request ASDA’s educational materials; (b) ensure athletes and support staff receive them; and (c) incorporate those materials into athlete onboarding processes. Keep records showing distribution of materials to demonstrate that athletes were informed, in case procedural fairness or notification issues arise.

6. Train staff and develop internal protocols

• Develop internal protocols for responding to ASDA requests, sample collection procedures, chain-of-custody processes, privacy and data protection measures, and communication with athletes and parents. Ensure staff understand the difference between WA-specific rules (e.g., parental consent for minors, s 5) and the Commonwealth Act’s provisions imported by s 4(1) and s 4(4).

7. Map enforcement consequences using the Commonwealth Act

• Because the WA Act does not list sanctions, map relevant Commonwealth Act provisions that are being read into the WA context under s 4(1) and s 4(4). Identify how findings (for example positive tests or failures to provide samples) will translate into registers, suspensions or disqualifications once applied to WA competitors. Pay special attention to s 4(4)’s substitution list when applying Commonwealth Act terms.

8. Maintain documentation of register entries and consent decisions

• Keep accurate records of any entries on Commonwealth Act registers, communications about testing, consents from parents and guardians, and any refusals. Because s 3(d) brings persons on Commonwealth registers into the WA competitor class, records about register procedures and outcomes are central to compliance.

9. Monitor regulations and policy guidance

• Watch for regulations made under s 7 and any policy instruments arising from the ASDA-Minister agreement that specify procedures, timelines, or funding arrangements. Those instruments will provide the operational detail missing from the Act and may impose additional obligations.

10. Prepare for AAT review avenues

• The Administrative Appeals Tribunal’s functions apply to WA competitors (s 4(3)). Prepare administrative decision-making to meet procedural fairness and review standards that the AAT applies, and ensure that appeal points (for example, on process or substantive findings) are documented and defensible.

11. Seek legal advice for contested or ambiguous cases

• Where an individual’s WA competitor status is arguable, or where ASDA’s request is made without evidence of an operative ASDA-Minister agreement, obtain legal advice. The Act makes the existence of the Ministerial agreement a statutory precondition to ASDA action (s 6(1)), and s 5 creates special protections for minors.

12. Clarify funding and logistical arrangements

• Because the Act is silent on costs, sporting bodies and government should clarify who funds testing, transport and laboratory fees in the ASDA-Minister agreement or through separate memoranda. Establishing these arrangements in advance reduces operational friction.

13. Ensure data privacy and confidentiality compliance

• Testing generates sensitive health and personal information. Although the Act does not specify data-handling rules, organisations must ensure that sample handling and results disclosure comply with applicable privacy laws and any obligations under the ASDA-Minister agreement and the Commonwealth Act as read-in under s 4(4).

14. Maintain proactive communication channels with ASDA and the Minister’s office

• Because the Ministerial agreement controls ASDA’s authority to act (s 6(1)-(2)), maintain direct lines with both ASDA and the Minister’s office to confirm operational parameters, testing schedules, and educational activity.

By following these steps, sporting organisations and administrators can translate the Act’s statutory architecture into a practical compliance framework that follows the Act’s definitions and operational constraints, especially the parental-consent provision for minors and the requirement for an operative ASDA-Minister agreement.
