Sports Drug Testing Act 2000

The Act defines several key concepts that determine its operation. A “State competitor” is defined exhaustively in section 4. It covers four categories: (a) persons who represent or have been selected to represent a particular sport or South Australia in that sport in senior open sporting events , that is, national competitions open to all ages competing at the top level; (b) members of a squad from which persons are selected for such representation; (c) persons on a scholarship with the South Australian Sports Institute (SASI) entitling them to financial assistance or use of Institute services and facilities; and (d) persons who, as a direct or indirect result of having their name entered on the Register under the Act, have been prevented from participating or become ineligible to participate in sporting events. The fourth category is circular and broad: once a competitor is on the Register, that very status can make them a State competitor for future purposes, potentially applying the Act to a person who would not otherwise meet the top-level representation test. A “drug testing scheme” is defined by reference to the Commonwealth Act as a scheme under that Act, as modified, if at all, by regulations under the South Australian Act. This means the substantive testing obligations, the list of scheduled drugs and doping methods, the procedures for collection and testing, and the consequences under the Commonwealth scheme are incorporated into state law by reference. However, the Act does not automatically adopt the Commonwealth Act itself; it adopts the schemes as modified by SA regulations. The “Register” is a Register of Notifiable Events established and maintained by ASDA under a drug testing scheme. It is not a statutory register created by the Act; rather, the Act assumes such a register exists under the Commonwealth scheme and requires entries to be made on it. “Relevant sporting organisation” is defined broadly to include both state and national organisations of which the competitor is a member or with which the competitor is in any way associated in that capacity. This means a national sporting body could be notified even if the competitor only holds state-level membership. The term “scheduled drugs or doping methods” is also left to the drug testing scheme. The concept of “failure to comply” is defined in section 6(3) as not only failing to provide a sample as required, but also failing to complete or sign any required form, or failing to do something required or doing something prohibited in relation to the sample after providing it. This imposes a complex set of administrative obligations on the competitor, and any breach can trigger entry on the Register, even if the sample itself was provided. The concept of “reasonable excuse” is used in section 8 as a basis for avoiding entry on the Register if the competitor fails to comply, but the Act does not define what constitutes a reasonable excuse, leaving that to the Agency to determine in the first instance and possibly to the ART on review.

The primary class of persons affected are State competitors as defined in section 4. This includes athletes who compete at the top national level in open-age events , not just professional sportspeople but also amateurs who represent South Australia in such events. It also includes members of squads from which such representatives are chosen, even if the person has never actually competed at a senior open event. SASI scholarship holders are caught regardless of whether they compete at the top level; the Act captures them solely because of their scholarship status, which may cover many developing athletes who are not yet competing nationally. The fourth category extends the Act to any person whose previous entry on the Register has led to them being prevented from participating or becoming ineligible , a person who is already caught by the Register is treated as a State competitor for the purposes of being requested to provide further samples, creating a cascade effect. Sporting organisations, both state and national, are heavily affected because they are mandatory recipients of notifications and are required to report to the Minister on the entry and their actions (section 12(3)). This imposes administrative duties on private bodies and may require them to adjust their internal rules to respond to notifications in a timely manner. The Australian Sports Drug Agency itself is given functions and powers under state law, including the power to charge fees for its services (section 5(3)(a)) and to delegate its powers (section 5(3)(c)). The Minister responsible for the administration of the Act receives notifications about individual entries and removals for competitors who are SASI scholarship holders (section 12(1)), and can request negative test results for any specified State competitor (section 12(2)). This gives the Minister access to personal health information about athletes that is not necessarily available under the Commonwealth scheme alone. The South Australian Sports Institute is indirectly affected as the body that grants scholarships that bring athletes within the Act’s scope. The Administrative Review Tribunal is given jurisdiction to review the Agency’s decisions to enter names on the Register (section 10), which affects its workload. Parents and guardians of competitors under 18 are affected because the Agency cannot obtain a sample without their written consent (section 7), which must be given either generally or for a particular request. This imposes a decision-making responsibility on parents that carries weight because refusal may lead to no sample being taken, but the competitor’s absence from testing could still have consequences under the sporting organisation’s own rules. Finally, the general public is affected insofar as the Act reduces the autonomy of athletes to choose whether to submit to testing without consequence, and insofar as it funnels private information about individuals to the Minister and to multiple organisations.

The Act imposes duties primarily on the Agency, but also on sporting organisations and the Minister, while conferring certain rights on State competitors. The Agency’s duties include disseminating information about testing procedures and consequences (section 5(1)(a)); collecting samples and causing them to be tested in accordance with the drug testing scheme (section 5(1)(b)); notifying a competitor in accordance with the scheme of the possible consequences of failure to comply with a request (section 6(2)); notifying the competitor and each relevant sporting organisation in writing of any entry on the Register (section 9); notifying the competitor of the right to have the decision reviewed and of any other rights conferred by the scheme (section 9(2)); and, if the ART sets aside a decision to enter a name, removing the entry as soon as practicable and giving written notice of the removal to all persons and bodies who were notified of the entry (section 11). The Agency is also required, if it is aware that the competitor is on a SASI scholarship, to give notice of the entry or removal to the Minister (section 12(1)). The Minister must cause drug testing schemes promulgated under the Commonwealth Act to be laid before both Houses of Parliament within six sitting days (section 14). A sporting organisation that is notified of an entry on the Register must give the Minister written notice of the contents of the entry and of any action taken or to be taken by the organisation as a result (section 12(3)). This imposes a mandatory reporting obligation on private bodies, enforceable presumably through general administrative law or the Minister’s informal powers, but the Act itself creates no direct penalty for failure to report. Competitors have the right to be notified of the entry on the Register (section 9(1)(a)) and of their review rights (section 9(2)). They have the right to apply to the ART for review of the Agency’s decision to enter their name on the Register (section 10). The ART’s jurisdiction is the same as it has in relation to competitors under the Commonwealth Act, which means the grounds and procedures for review mirror the federal regime. If the ART sets aside the decision, the Agency must remove the entry (section 11(1)). Competitors under 18 have the right not to provide a sample unless written parental or guardian consent has been given (section 7). However, the Act does not require the Agency to seek consent; it only prohibits the Agency from obtaining a sample without that consent. The competitor has no right to refuse a request on grounds other than absence of consent for minors, but section 6(4) makes clear that no criminal or civil liability arises from failure to comply. That provision, however, does not protect the competitor from the Register consequences: failure can still lead to an entry. The competitor has a right to be notified of the possible consequences of failure before or at the time of the request (section 6(2)), though the content of that notification is left to the drug testing scheme. There is no statutory right to be given reasons for the Agency’s decision to enter a name on the Register, except what the scheme may provide.

The Act deliberately avoids creating direct legal penalties for non-compliance. Section 6(4) states categorically that a person incurs no criminal or civil liability by reason only of failing to comply with a request to provide a sample. This means the Police or other state enforcement agencies cannot prosecute or sue a competitor who refuses to provide a sample, and the Agency itself cannot sue for damages. Enforcement of the Act is therefore indirect, operating through the Register and the notification chain. If a State competitor fails to comply with a request without reasonable excuse, the Agency must enter the competitor’s name on the Register (section 8). The same applies if a positive test result is returned. That entry triggers notifications to sporting organisations (section 9(1)(b)), and those organisations are then required to notify the Minister of the entry and of any action taken or to be taken (section 12(3)). The real penalty , suspension, loss of funding, ineligibility , is imposed by the sporting organisation under its own rules, not under the Act. The Act thus outsources enforcement to private bodies, which may have varying standards of procedural fairness and may act on the notification without giving the competitor a hearing. The competitor’s only statutory remedy is to apply to the ART for review of the Agency’s decision to make the entry (section 10). However, the ART’s review is limited to the decision to record the information on the Register; it does not extend to any consequential action taken by the sporting organisation. If the sporting organisation imposes a sanction based on the entry, the competitor’s challenge must be under the organisation’s internal processes or under general contract or administrative law, not under this Act. There is no provision in the Act for the Agency to impose financial penalties, issue infringement notices, or seek court orders. The Agency may charge reasonable fees for its services (section 5(3)(a)), but that is a fee-for-service arrangement, not a penalty. For a competitor under 18, the Agency cannot lawfully obtain a sample without the written consent of a parent or guardian (section 7). If the Agency proceeds without that consent, it is acting beyond its powers, and any resulting entry on the Register would be potentially subject to review. The Act does not provide any penalty for the Agency if it does so, but the competitor could seek remedies through the ART or possibly through judicial review. For sporting organisations that fail to notify the Minister as required under section 12(3), the Act is silent on consequences. There is no express penalty or enforcement mechanism for that duty, which effectively makes it a moral or political obligation rather than a legal one. This creates an asymmetry: the competitor faces serious practical consequences from notification, but the organisations that trigger those consequences have no statutory sanction for failing to report. Overall, the enforcement model relies on the coercive effect of information transmission rather than state-imposed fines or imprisonment, but that coercion may be just as effective in practice, especially given the high stakes of eligibility to compete.

The Act is explicitly designed to interact with the Commonwealth Australian Sports Drug Agency Act 1990 and the drug testing schemes made under it. It defines “Commonwealth Act” as that Act “as in force from time to time, and includes regulations and orders as in force from time to time under that Act” (section 3(1)). This means that any changes to the Commonwealth Act or its instruments automatically flow into the South Australian scheme, without requiring any amendment to the state Act. The same applies to “drug testing scheme”, which means a scheme under the Commonwealth Act as modified by SA regulations. The SA regulations could potentially alter the operation of the Commonwealth scheme for State competitors, but only to the extent not inconsistent with the Commonwealth Act. The Act also relies on the Commonwealth Administrative Review Tribunal Act 2024 (Cth). Section 10 gives the ART jurisdiction to review Agency decisions under this Act, and section 11(2) refers to orders under section 32 of that Commonwealth Act staying or affecting the operation of a decision. This embeds the federal administrative review framework into state law. The Act does not explicitly refer to the Privacy Act 1988 (Cth) or the Health Records Act 2001 (SA) or any equivalent, yet its operation involves collection, use, and disclosure of sensitive health information (test results). The notification to sporting organisations and the Minister (including negative test results on request under section 12(2)) could raise privacy issues, especially since the Minister can request information about a specified competitor’s negative test results without any stated threshold or safeguarding requirement. The Act does not provide for the competitor’s consent to those disclosures beyond the initial sample collection. It is possible that the drug testing scheme itself contains privacy protections, but the Act does not cross-reference them. The Act also interacts with each relevant sporting organisation’s constitution, rules, and disciplinary procedures. Once a sporting organisation receives a notification under section 9, it must decide what action to take. That action may be governed by the organisation’s own anti-doping policy, which may be modelled on the World Anti-Doping Code or on the Commonwealth scheme. The Act does not prescribe what action the organisation must take; it only requires the organisation to report to the Minister. This can lead to inconsistency between organisations. For State competitors under 18, the Act interacts with state child protection and consent laws, but section 7 provides its own consent requirement that appears to override any other general law on the age of consent for medical procedures. The Act’s disregard for reasonable excuse in section 8 (where the Agency must enter the name if failure is without reasonable excuse, but the Agency decides what is reasonable) interacts with general administrative law principles of procedural fairness. The ART review provides a mechanism to challenge the Agency’s determination of reasonableness. The legislative history notes that section 2 was omitted under the Legislation Revision and Publication Act 2002 (SA), a housekeeping statute. The 2025 amendment replacing the AAT with the ART reflects the Commonwealth’s restructuring of its review tribunals; the South Australian Act now refers to the new federal tribunal.

The Act was originally enacted as the Sports Drug Testing Act 2000 (No 32 of 2000) and commenced on 23 November 2000. The original Act included a section 2 (commencement provision) which was subsequently omitted under the Legislation Revision and Publication Act 2002, a standard consolidation statute that removes spent provisions. The only substantive amendment to the Act occurred in 2025 via the Statutes Amendment (Administrative Review Tribunal) Act 2025 (No 54 of 2025), Part 12 (sections 20 to 22), which commenced on 20 November 2025. That amendment replaced references to the Commonwealth Administrative Appeals Tribunal (AAT) with references to the newly established Administrative Review Tribunal (ART). Specifically, the definition of “Administrative Review Tribunal” was inserted into section 3(1) (previously the definition referred to the Administrative Appeals Tribunal). Section 10, which provides for review of Agency decisions, had its heading and text amended to refer to the ART instead of the AAT. Section 11(1) and (2) were also amended to update the references from the AAT to the ART and from the Administrative Appeals Tribunal Act 1975 to the Administrative Review Tribunal Act 2024. These amendments were mechanical, reflecting the Commonwealth’s restructuring of its merits review system. No other provisions have been amended. The Act has therefore remained largely unchanged in substance for 25 years, with only procedural updates to the review mechanism. This stability may be due to the Act’s design as a skeleton that incorporates Commonwealth schemes by reference; substantive changes to testing policy occur at the federal level without requiring state amendments. The absence of any amendment in response to evolving anti-doping standards (such as the World Anti-Doping Code revisions) suggests that the Act is not intended to be a substantive anti-doping law but rather a jurisdictional enabling layer. The Parliament has not inserted a statutory review clause, sunset provision, or any mechanism requiring periodic reassessment of the Act’s operation. This means that the legislative framework remains frozen in its 2000 design, even as the Commonwealth drug testing schemes have evolved.

The provided source material , the Act itself and its legislative history , contains no mention of any litigation decided under or involving the Act. The text does not refer to any court cases, tribunal decisions, or legal challenges. It is therefore impossible, from this source alone, to provide an account of the Act’s litigation history. However, the Act creates the potential for litigation in two main areas. First, decisions by the Agency to enter a name on the Register are reviewable by the ART (section 10). Disputes could arise over whether a competitor had a “reasonable excuse” for failing to comply, whether the testing procedure complied with the drug testing scheme, whether the notification requirements were properly followed, and whether the Agency correctly applied the definition of “State competitor”. The ART’s jurisdiction is the same as it has in relation to competitors under the Commonwealth Act, so principles developed in federal anti-doping review are likely to be applied. If a sporting organisation acts on a notification and imposes a sanction, the competitor may challenge that sanction in state courts under contract law (for breach of the organisation’s rules) or under administrative law if the organisation is exercising public functions. However, the Act itself does not provide a cause of action for such challenges. Second, the requirement that sporting organisations report to the Minister (section 12(3)) could be enforced through an injunction or other prerogative writ if the Minister sought compliance, though as noted there is no penalty for non-compliance. There may also be potential for a privacy-related challenge if disclosures under the Act are alleged to breach the Commonwealth Privacy Act or state health records laws, though the Act itself provides statutory authority for the disclosure, which could be a defence. Given the Act’s age and that it has only been amended once (and that amendment was procedural), and given the high-profile nature of anti-doping disputes, it is likely that there have been some ART decisions under the Act, but the source does not reveal them. A researcher would need to search ART databases and possibly state court records. For the purposes of this deep dive, it must be noted that the Act’s text provides no litigation history whatsoever.

Several features of the Act may trap unwary competitors, sporting organisations, or legal advisers. First, the definition of “State competitor” in section 4 is broader than many would assume. A person can be a State competitor not by representing South Australia in competition, but merely by being a member of a squad from which persons are selected (section 4(b)), or by being on a SASI scholarship (section 4(c)). This captures developing athletes who may never actually compete at a senior open event. Furthermore, section 4(d) means that once a person’s name has been entered on the Register, they are deemed a State competitor for the purposes of the Act, even if they would not otherwise meet any of the other criteria. This creates a self-perpetuating eligibility: someone who fails a test and is entered on the Register is then subject to further testing requests under the Act. A second trap lies in the definition of “failure to comply”. Section 6(3) includes not just failing to provide a sample but also failing to complete or sign any form required under the scheme, or after providing the sample, failing to do something required or doing something prohibited in relation to the sample. This means that a procedural misstep , such as not signing a chain-of-custody form or placing the sample in the wrong container , can be treated as a failure to comply, leading to an entry on the Register, even if the sample itself was provided and tested negative. A third trap is the absence of a requirement for the Agency to give reasons for its decision that a competitor failed without reasonable excuse. The Act requires the Agency to enter the name if the failure is without reasonable excuse, but it does not require the Agency to state what it considered a reasonable excuse or why it concluded the excuse was not reasonable. The competitor must apply to the ART to discover the reasoning, which adds time and cost. A fourth trap: the Act does not require the Agency to notify the competitor before notifying relevant sporting organisations. Under section 6(1)(c), if it appears to the Agency that the competitor is likely to fail to comply with a request, the Agency may tell any relevant sporting organisation of the likely failure, with a view to the organisation persuading the competitor to comply. This can happen before any actual failure has occurred, potentially prejudicing the competitor’s reputation and standing with the organisation before they have even decided whether to comply. A fifth trap: section 12(2) allows the Minister to request in writing a notice stating, for each specified State competitor, whether the competitor has returned a negative test result and, if their name is on the Register, the contents of the entry. This means the Minister can access information about competitors who have never failed a test , simply to confirm they have negative results. There is no requirement that the Minister have a reasonable suspicion or that the competitor be notified of such a request. This creates a significant privacy exposure for clean athletes. A sixth trap: the use of the word “must” in section 8 (the Agency will enter the name if failure is without reasonable excuse or a positive test result is returned) is mandatory. The Agency has no discretion to refrain from entering the name even if it considers the circumstances minor or the test result borderline. The only way to avoid the consequence is to have a reasonable excuse, which the Agency determines. If the Agency errs, the competitor must seek review. A seventh trap: the Act does not specify a timeframe for the Agency to notify the competitor after an entry, nor for the sporting organisation to notify the Minister. This could delay the competitor’s ability to challenge the entry or to know that their eligibility is at risk. An eighth trap: the interaction with the drug testing scheme means that the competitor must be aware of the scheme’s detailed requirements, which are not reproduced in the Act. A failure to read and understand those requirements can lead to unwitting non-compliance. A ninth trap: the Act contains no express provision for the Agency to correct an erroneous entry on the Register, except if the ART sets aside the decision. If the Agency later discovers it made a mistake (for example, a misidentified sample), there is no statutory power to unilaterally remove the entry; the competitor would still need to seek ART review unless the scheme itself provides a correction mechanism.

Compliance obligations differ depending on the actor. For State competitors, the primary duty is to comply with any request from the Agency to provide a sample in accordance with the drug testing scheme. This means not only providing the sample itself but also completing and signing all required forms, following all procedures for the handling and storage of the sample, and not doing anything prohibited in relation to the sample after providing it. Competitors should familiarise themselves with the current drug testing scheme under the Commonwealth Act, as modified by SA regulations, to understand the precise steps required. If the competitor has a reasonable excuse for non-compliance , for example, a medical condition that makes providing a sample at the required time impossible , they should immediately inform the Agency in writing, with supporting evidence, and seek confirmation that the excuse is accepted. If the Agency proceeds to enter the name on the Register, the competitor should apply to the ART for review as soon as possible, because the notification to sporting organisations may occur quickly. Competitors under 18 must ensure that a parent or guardian provides written consent to the Agency before the sample is taken. The consent can be general or specific to a particular request. If no consent is given, the Agency cannot lawfully obtain a sample, but the competitor may still face consequences under the sporting organisation’s rules if the organisation’s own policies require testing regardless. For sporting organisations, compliance requires prompt action upon receiving a notification from the Agency of an entry on the Register. The organisation must immediately give written notice to the Minister of the contents of the entry and of any action taken or to be taken by the organisation as a result. The organisation should have internal procedures in place to ensure this reporting occurs within a reasonable time, even though the Act does not specify a deadline. The organisation should also ensure that any disciplinary action it takes as a result of the notification is procedurally fair and consistent with its own rules, because the Act does not confer any immunity or exemption. Organisations should also be aware that they may be asked by the Agency under section 6(1)(c) to assist in persuading a competitor to comply with a request; such a request is not mandatory, but a failure to cooperate could have political consequences. For the Agency, compliance requires strict adherence to the drug testing scheme in collecting, testing, and handling samples, as well as in notifying the competitor and relevant organisations. The Agency must ensure proper notice under section 9, including informing the competitor of the right to ART review. It must also follow section 12(1) and notify the Minister when a SASI scholarship holder is entered or removed from the Register. The Agency should document its reasoning for concluding that a failure was without reasonable excuse, so that it can defend that decision on review. For the Minister, compliance involves causing copies of all drug testing schemes to be laid before both Houses of Parliament within six sitting days of their promulgation (section 14). The Minister should also establish procedures for handling requests for information about negative test results under section 12(2), ensuring that such information is only used for the purposes intended and is kept confidential as required by law, though the Act is silent on confidentiality. For SASI, there is no specific compliance duty under the Act, but the Institute should inform scholarship holders that they are State competitors under the Act and advise them of their obligations. For any legal practitioner advising a competitor, the key steps are: verify whether the client meets the definition of State competitor; obtain a copy of the current drug testing scheme; ensure the client understands the procedural requirements; document any potential reasonable excuse; and, if an adverse entry is made, lodge an ART review application promptly, as time limits may apply under the Administrative Review Tribunal Act 2024. Also, advise the competitor that compliance with the Act is necessary to avoid the practical consequences of a Register entry, even though no criminal or civil liability attaches to non-compliance.
