What it does
This legislative instrument, Specification of Fields of Education IMMI 16/076, makes a single, discrete change: it specifies a set of "fields of education" for the purposes of paragraph 2.26AC(5A)(b) of the Migration Regulations 1994. The instrument is made by the Minister for Immigration and Border Protection under subregulation 2.26AC(5B) (see the instrument heading and clause 1). The operative content is the Schedule, which contains a two‑column table. The instrument’s clause 1 expresses the specification by reference to the column entitled "Narrow Field of Education" in the Schedule: the narrow fields listed in that column are the fields that the instrument declares to be the relevant specification.
The instrument records its commencement: it comes into force immediately after the commencement of the Migration Amendment (Entrepreneur Visas and Other Measures) Regulation 2016. The instrument is dated 7 September 2016 and signed by the Minister (the Hon Peter Dutton MP). Those are the mechanical facts recorded on the face of the instrument.
Mechanically, then, the instrument performs three tasks only: (1) it relies on the Minister’s power under subregulation 2.26AC(5B) to specify fields for the stated paragraph; (2) it identifies a list of narrow fields of education (the Schedule) to be used for that paragraph; and (3) it fixes a commencement timing linked to the commencement of another subordinate instrument. The instrument does not, on its face, add definitions, alter other provisions of the Migration Regulations directly, nor does it set out eligibility criteria, rights, or penalties; it is a specification document. The legal effect intended on the face of the instrument is to make the listed narrow fields the operative fields to which paragraph 2.26AC(5A)(b) must have regard (see clause 1 and the reference to subregulation 2.26AC(5B)).
