Specification of Categories of Visas that Preclude a Person from Lodging a Student Visa Application in Australia 2016/016

The central concept is the specified substantive temporary visa. A substantive visa is a visa other than a bridging visa, a criminal justice visa, or an enforcement visa. The instrument only applies to substantive temporary visas, not permanent visas. The prohibition is on lodging a student visa application in Australia. An application is lodged at the time it is received by the Department, not when it is decided. If the applicant holds one of the listed visas at the date of lodgment, the application is invalid. The applicant cannot later cure the invalidity by ceasing to hold the visa after lodgment; the application is a nullity from the start.

A second key concept is stream specificity. For Subclass 403, only the Domestic Worker (Diplomatic or Consular) stream is specified. That means holders of other Subclass 403 streams - such as the Government Agreement stream, the International Relations stream, or the Religious Worker stream - are not precluded by this instrument and may apply for a student visa onshore (subject to other visa conditions and eligibility). For Subclass 995, only visas granted to an applicant who satisfied the primary criteria are specified. The term primary criteria is defined in the Migration Regulations for each visa subclass. Typically, the primary criteria must be met by the main applicant (the person who holds the visa in their own right, not as a family member). Family members who are granted Subclass 995 as secondary applicants (for example, dependant children or spouses) are not caught, so they can lodge a student visa application onshore. This creates a distinction within the same visa subclass.

A third concept is the regulatory context. The instrument does not operate in a vacuum. The Migration Regulations contain numerous other provisions that affect student visa eligibility, such as Schedule 3 criteria (for onshore applicants who have held certain visas), public interest criteria, and genuine temporary entrant requirements. But this instrument is a threshold filter: if the applicant holds a specified visa, the application never reaches those other criteria. The instrument also interacts with the three‑month validity period for lodging an application after a visa ceases: if a person holds one of these visas, they cannot apply onshore even if they apply after the visa ends but while still in Australia (because the prohibition applies to holding the visa at time of application; if the visa has ceased, the holder no longer holds it, so the instrument does not apply). However, other provisions may then apply, such as the requirement that the applicant holds a substantive visa at the time of application (which would be lacking if the previous visa expired and no bridging visa was held). The instrument therefore narrows the options for those who want to transition from temporary visa to student visa while in Australia.

Finally, the instrument is a legislative instrument registered under the Legislation Act 2003. It is publicly available on the Federal Register of Legislation. Unlike a regulation, it is made by the Minister personally (or delegate) and can be amended or revoked without lengthy parliamentary process, though it is subject to disallowance. The instrument has no sunset date; it continues in force until amended or repealed.

The instrument directly affects any person who is physically in Australia and holds one of the listed visas and who wishes to apply for a student visa (Subclass 500). The affected population includes:

• Temporary Graduate visa holders (Subclass 485): many graduates of Australian institutions wish to undertake further study, such as a second degree or a research program. They are now blocked from applying onshore. This group is likely large and includes professionals who may need additional qualifications for migration purposes. The compliance cost for them is significant: they must either depart Australia before their 485 ends, incurring travel expenses, or arrange an alternative onshore pathway (if available).

• Visitor visa holders (Subclass 600): tourists, business visitors, and family visitors who decide they want to study in Australia cannot simply apply from within the country. This is a common scenario for parents visiting student children or for people on working holiday who later want to study. The instrument forces them to apply from offshore, which may involve returning home and waiting for a new visa.

• Electronic Travel Authority (Subclass 601) and eVisitor (Subclass 651) holders: these are electronic visitor visas for nationals of certain countries. Many holders are unaware they cannot apply for a student visa onshore, leading to invalid applications and wasted fees.

• Medical Treatment visa holders (Subclass 602): persons in Australia for medical treatment may decide to stay for study; they are blocked.

• Maritime Crew (Subclass 988) and Transit (Subclass 771) holders: these are niche categories but relevant for seafarers and transit passengers.

• Domestic worker (diplomatic or consular) visa holders: both Subclass 403 (Domestic Worker stream) and the entire Subclass 426 are precluded. These are domestic staff of diplomatic missions.

• Diplomatic visa primary holders (Subclass 995): diplomats and consular officers granted the primary visa cannot apply for student visas onshore, but their dependants can.

Beyond visa holders, the instrument affects education providers. Australian universities, colleges, and schools may expect onshore students to transition between visa types. The instrument reduces the pool of potential onshore applicants who could enrol quickly. Providers may need to advise prospective students to apply offshore, which can delay enrolment and increase dropout risk. Migration agents and lawyers must check the current specification when advising clients on student visa applications. The instrument’s amendment in July 2024 changed the list; any advice based on the pre‑2024 list could be wrong.

The Department of Home Affairs is affected administratively: it must reject invalid applications at the lodgment stage, which is efficient but can also generate disputes and requests for refunds of visa application charges. The Department must also maintain and publish the current instrument.

The instrument does not affect people who hold permanent visas, bridging visas, or substantive temporary visas not on the list. For example, holders of a Subclass 482 (Temporary Skill Shortage) visa are not precluded (unless that visa is added in the future). Nor does it affect people applying offshore: the prohibition is only for applications made in Australia.

The instrument imposes no duties directly; it is a specification that triggers a prohibition in the Migration Regulations. The relevant duty is on the visa applicant: if they hold a specified visa, they must not attempt to lodge a valid student visa application while in Australia. There is no discretion. The Department has a duty to accept only applications that meet the statutory requirements; it must reject an application that is invalid due to this specification.

Rights are affected indirectly. A person who holds a specified visa retains the right to apply for a student visa from outside Australia (offshore). They also retain the right to apply for other onshore visas that are not prohibited by other instruments. For example, a Temporary Graduate visa holder can apply for a skilled visa or a partner visa onshore without issue, provided they meet all criteria. The instrument does not affect the right to hold a student visa once granted; it only affects the ability to apply while onshore.

The instrument creates no right to be notified that a specified visa is held; it is the applicant’s responsibility to know their visa conditions. However, the Department often provides visa conditions in grant letters, but the instrument itself is not included there. There is also a right to seek review of a decision that an application is invalid? Typically, a decision that an application is invalid is not a reviewable decision under the Migration Act because there is no “refusal” of a valid application. The Federal Circuit and Family Court may have jurisdiction to review the legal validity of the instrument or its application, but that is a separate right.

The instrument does not provide any exception for compelling circumstances, family violence, or humanitarian need. It is a blanket specification. This is a notable limitation on individual choice: a person on a medical treatment visa who recovers and wishes to study cannot do so onshore, even if leaving would cause hardship. There is no waiver mechanism in the instrument itself. Any relief would require the Minister to exercise a personal power (such as under s 351 of the Migration Act) to grant a visa despite non‑compliance, but that is rare and non‑compellable.

The instrument contains no penalty provisions. It is a specification, not an offence provision. The consequences of non‑compliance are procedural rather than punitive. If a person lodges a student visa application while holding a specified visa, the application is invalid. The Department will not process it. The visa application charge (currently AUD 710 for Subclass 500 main applicants) is generally not refunded for invalid applications. This is stated in the Migration Regulations (reg 2.13) and the Migration Act (s 45B). Therefore, the financial penalty is the loss of the application fee and any associated costs (biometrics, health checks, translation fees).

There is no criminal penalty for attempting to lodge an invalid application. However, if a person knowingly provides false information (e.g., denies holding a specified visa) that could amount to non‑compliance with s 101 of the Migration Act, leading to visa cancellation and potential exclusion periods. But that is separate from the specification.

Enforcement is automatic: the Department’s visa lodgment system is programmed to check the visa held by the applicant at the time of electronic lodgment. If the system detects a specified visa, it will reject the application or require a paper lodgment, which will then be refused as invalid. The onus is on the applicant to know the law; there is no warning or grace period.

For holders of bridging visas who previously held a specified visa, the instrument may still affect them indirectly. For example, a person who held a Subclass 600 (Visitor) and applied for a different visa before the visitor visa expired may be on a bridging visa A. That bridging visa is not a substantive visa, so the instrument does not directly apply. However, if the bridging visa is granted on the basis of a substantive visa application that is not a student visa, the person may still be able to apply for a student visa onshore as a further bridging visa? This is complex; but the instrument itself does not address bridging visas.

The Department may also take compliance action if a person lodges an invalid application and then remains in Australia after their substantive visa expires, if the application does not result in a bridging visa. The person may become unlawful and face detention or removal.

The instrument operates within the Migration Regulations 1994 framework. Its empowering provision is subitem 1222(5)(c) of Schedule 1 to the Regulations. Schedule 1 deals with visa application requirements. Subitem 1222 specifically applies to Subclass 500 (Student) visa applications. Paragraph (4) states that an application in Australia by a person who holds a substantive temporary visa of a class specified in an instrument is invalid. This instrument is that instrument. Therefore, the instrument is directly tied to the validity of a student visa application.

The instrument interacts with:

• Migration Act 1958: Section 45A provides for visa application charges and refunds; s 46 lists when applications are invalid. The instrument effectively creates a new ground of invalidity under the Regulations, which is a form of delegated legislation under the Act. Section 48 of the Act imposes restrictions on applying for further visas after refusal or cancellation; this instrument does not trigger s 48 but may affect whether a person is eligible to apply onshore after their current visa ends.

• Other specification instruments: The Minister may specify other classes of visas for different purposes, such as the classes of visas that allow a person to apply for a further visa onshore. Some of those specifications may overlap or conflict. For example, the Migration (Specification of Classes of Subclass 500 Student Visas) instrument may list student visa streams that are subject to different conditions. But there is no direct conflict.

• Schedule 3 to the Regulations: If a person does not hold a substantive visa at the time of application (e.g., after expiry of a specified visa), they must meet Schedule 3 criteria to apply onshore. But if they hold one of the specified visas at the time of lodgment, the application is invalid regardless of Schedule 3. Thus the instrument overrides any possibility of using Schedule 3 while holding the specified visa.

• Bridging visas: A person who holds a specified visa and validly applies for another visa (not a student visa) may receive a bridging visa. That bridging visa is not a substantive visa, so if they then try to apply for a student visa onshore while on the bridging visa, this instrument does not apply (since they do not hold a substantive visa). However, they may still be prevented from applying by other provisions, such as condition 8101 (no work) or the fact that the bridging visa may not allow application for a further substantive visa.

• State and territory laws: The instrument does not interact with state or territory laws. It is purely federal immigration law.

• International obligations: The instrument does not reference any treaty. Its blanket application may raise questions under the International Covenant on Civil and Political Rights (right to education, non‑discrimination) but that is not within the instrument itself and would be a matter for broader migration policy.

The instrument is one part of a policy regime to limit “visa hopping” - switching from a short‑stay or post‑study work visa to a student visa without departing. It complements other tools like the genuine temporary entrant test and the requirement for higher risk providers to be refused.

The instrument was first made on 3 May 2016 (registered as F2016L00638) and commenced on 1 July 2016. The original schedule contained a list of visa categories. The exact content of the original schedule is not reproduced in the compilation, but the compilation notes that the schedule was substituted by the 2024 amending instrument. The sole amendment to date is the Migration (Specification of Categories of Visas that Preclude a Person from Lodging a Student Visa Application in Australia) Amendment Instrument (LIN 24/051) 2024, registered on 26 June 2024 and commencing on 1 July 2024. That instrument replaced the entire Schedule 1 with the current list.

The amendment history in endnote 4 shows that the commencement text (the paragraph stating commencement) was repealed by Legislation Act 2003, s 48D. This is a standard administrative repeal that occurs when the instrument becomes a compilation; it does not affect the law’s operation. The schedule is shown as “rs. F2024L00787” (repealed and substituted by the 2024 instrument).

The 2024 amendment likely reflected a policy change. Without the original text, we cannot say exactly what changed. However, based on known policy, the inclusion of Subclass 485 (Temporary Graduate) is significant. Prior to 2016, there was no such specification for Temporary Graduate visas, but that original instrument may have included it. There may also have been adjustments to Subclass 403 or Subclass 995. The amendment was made by LIN 24/051, which is a legislative instrument made by the Minister under delegation (LIN instruments are standard for such specifications). The amendment appears to be the only substantive change since the instrument’s inception.

The instrument has no expiry date. It remains in force until amended or repealed. The compilation date is 1 July 2024, meaning the current text reflects the 2024 amendment.

The instrument itself contains no references to any litigation. As a specification, it is rarely the direct subject of legal challenge. More commonly, challenges arise in the context of a refusal of a student visa application based on invalidity, where the applicant argues that the instrument is invalidly made (e.g., that the Minister did not comply with legislative instrument requirements, or that the visa held does not fall within the specified category). However, no such cases are recorded in the compilation.

The underlying subitem 1222 may have been judicially considered, but that is not part of this instrument. The Administrative Appeals Tribunal may hear matters where an applicant argues that they did not hold a specified visa at the time of application (e.g., they held a bridging visa, or the visa had ceased). But those cases turn on fact, not on the instrument itself.

There is no evidence of any constitutional challenge to the instrument. The power to specify visas is a delegated power from the Migration Regulations, which themselves derive from the Migration Act. The Act is valid under the Commonwealth’s immigration power. The instrument is a legislative instrument and is subject to disallowance by Parliament, but that is a legislative check, not a judicial one.

If a person challenges the validity of the instrument, they would likely argue that the Minister did not have the power to make it, or that the instrument is unreasonable in a legal sense. But the Minister has broad discretion to specify classes of visas under subitem 1222(5)(c). The instrument is clearly within the scope of that power.

In summary, there is no recorded litigation history specific to this instrument. The practitioner should be aware that the instrument’s application can lead to litigation at the merits level (Tribunal) if criteria are disputed, but the specification itself is settled law.

Several traps are not obvious from a reading of the instrument alone.

• Temporary Graduate visa holders (485) are caught: many holders of Subclass 485 believe they can “top up” to a student visa to stay longer. This instrument prevents that. The only onshore option for them to study may be to apply for a different visa (e.g., partner visa) or to depart and apply offshore. The cost: travel, accommodation, and the risk of refusal offshore may be higher.

• The stream limitation for Subclass 403: only the Domestic Worker (Diplomatic or Consular) stream is specified. Holders of other Subclass 403 streams (e.g., Government Agreement, International Relations, Religious Worker, etc.) are not precluded. This is a trap for the unwary: a visa holder on a different stream could mistakenly think they cannot apply, or a migration agent might incorrectly advise they must leave.

• Subclass 995 primary criteria trap: only primary holders of Subclass 995 are caught. Dependants on the same visa (e.g., diplomat’s spouse or children) are not. They can apply for a student visa onshore. But the primary holder cannot. This creates confusion if a family wants to study together; the primary holder cannot simply add study to their schedule while dependants can.

• The instrument only applies at the time of lodgment: if a person holds one of these visas on the day they lodge the student visa application, it is invalid. But if they first travel offshore, then lodge a student visa application while outside Australia, they can do so even if they hold that visa (as long as the visa permits travel). For example, a Temporary Graduate visa holder on holiday overseas can lodge a student visa application offshore. They may then return to Australia on the 485 (if it still valid) while the student visa is processing, but they must be careful not to be onshore at the time of the student visa grant if conditions require offshore grant? Not relevant here.

• Bridging visas: if a person’s specified visa expires and they apply for a different visa (e.g., a tourist extension) and receive a bridging visa, they no longer hold the specified substantive visa. They may then be able to apply for a student visa onshore while on the bridging visa, provided they meet other requirements. The instrument does not apply because they do not hold the specified visa. However, other restrictions may apply (e.g., the bridging visa may not allow further applications, or condition 8534 may be imposed).

• Visa application charge non‑refundable: an invalid application will be rejected, and the fee is lost. There is no refund. This is a significant financial penalty, especially for high‑fee student applications. The Department does not “warn” applicants before rejecting invalid applications; the system may prevent electronic lodgment, but manual errors still happen.

• No exceptions for compelling circumstances: unlike some other visa provisions, there is no waiver for humanitarian or compassionate reasons. A person on a Medical Treatment visa who recovers and wants to study a short course cannot do so onshore, even if leaving would be medically unwise.

• The instrument is updated rarely: only one amendment in eight years. But it could change at any time. Practitioners must check the current version on legislation.gov.au before advising clients. The compilation date of 1 July 2024 is current, but future amendments may add or remove visas.

• Interaction with visitor visa conditions: visitor visas (600) often have condition 8531 - must not stay longer than 3 months. If a holder lodges an invalid student visa application, they may overstay and breach conditions. This can lead to visa cancellation and future exclusion.

Compliance is straightforward for individuals and their advisors: do not lodge a student visa application in Australia if you hold any of the specified visas at the time of lodgment. The prescribed steps depend on the individual’s circumstances.

Step 1: Identify the current visa held. Check the visa grant letter, VEVO (Visa Entitlement Verification Online), or the Department’s app. Also check the subclass and stream. For Subclass 403, only the Domestic Worker (Diplomatic or Consular) stream is caught; for Subclass 995, only primary holders. For all other listed subclasses, the entire subclass is caught.

Step 2: Decide on the best pathway to a student visa. If the person holds a specified visa, they have two lawful options:

• Apply from outside Australia (offshore). They must depart Australia before the expiry of their current visa (or while it is still valid) and lodge a student visa application at an Australian embassy or via ImmiAccount overseas. They should be aware that processing times may be longer and the genuine temporary entrant test may be applied more strictly for offshore.

• Apply for a different onshore visa first (if eligible) that is not specified, and then later apply for a student visa. For example, a Temporary Graduate visa holder may be eligible for a Subclass 482 skilled visa or a Subclass 820 partner visa. Once granted a new substantive visa (that is not on the list), they can then apply for a student visa onshore (subject to other conditions). This is complex and requires professional advice.

• Wait until the current specified visa expires and then apply for a student visa onshore, but only if they have a substantive visa immediately before expiry that is not on the list, or if they can meet Schedule 3 criteria. However, subitem 1222(4) only applies if they hold a specified visa at the time of application; if the visa has expired, they no longer hold it. But then they may be unlawful unless they hold a bridging visa. This is risky.

Step 3: Avoid invalid applications. The Department’s systems may block electronic lodgment if the applicant’s VEVO record shows a specified visa. But manual or paper applications may still be accepted and later found invalid. Do not attempt to “game” the system by omitting or misstating current visa details. That would be false information with serious consequences.

For education providers: advise prospective students before enrolment. If a student is in Australia on a Visitor visa, do not issue a Confirmation of Enrolment until they confirm they will apply offshore or after changing to a permissible visa. Providers should maintain systems to check client visa status.

For migration agents: keep a current copy of this instrument in your file. When preparing a student visa application, always run a VEVO check. If the client holds a specified visa, advise on offshore application or alternative pathways. The instrument is only one part of the validity puzzle; also check subitem 1222(4) itself and any other specifications.

Compliance burden: the instrument imposes information costs: time spent checking the list and explaining options. For many visa holders, the only practical solution is to depart Australia, incurring travel and relocation expenses. This may be disproportionate for short courses or low‑cost study. The instrument also reduces competition among education providers for onshore enrollees, potentially increasing marketing costs for providers seeking offshore students. There is no private choice to apply onshore; the government has eliminated that choice. The compliance burden is absolute: no room for negotiation or waiver. Businesses (travel, accommodation, etc.) may benefit from forced departures, but that is a secondary effect.

The instrument is clear and easy to comply with in theory, but the real cost is the opportunity cost of being forced to study offshore or not at all. For holders of a Temporary Graduate visa, the ability to further study onshore could enhance human capital and labour market outcomes; removing that option may reduce productivity gains. However, that is a policy trade‑off beyond the instrument itself.
