This Division does not apply to: (a) the Commonwealth; or (b) a person acting as an employee or agent of the Commonwealth or as a member of the Defence Force.
Note: Example: The Commonwealth and a private company are to carry out a launch as joint venturers. The Commonwealth would not need a launch facility licence or Australian launch permit etc. to do so, but the private company would (unless the company were acting as an agent of the Commonwealth, in which case it too would be exempt from this Division).
