South Australian Public Health (General) Regulations 2013

The instrument defines a compact set of technical and legal concepts that determine scope, compliance thresholds and enforcement mechanics. Key definitions and concepts in the Regulations include:

• Act (reg 3(1)): the South Australian Public Health Act 2011. The Regulations operate as subordinate instruments under that Act and repeatedly reference specific Act provisions (for example sections 50, 54, 93, 109 and 92).
• Occupier (reg 3(1)): means a person who has, or is entitled to, possession or control of premises and includes a person in charge of the premises. This definition places duties and potential liability on both owners and occupiers/managers.
• Public swimming pool and public spa pool (reg 3(1)): each is defined by reference to the pool’s function and users rather than by technical construction alone. A pool is “public” if it is used by paying persons, by persons staying temporarily at accommodation, or by persons who attend, live or work on the premises where the pool is located, with an express carve‑out where the pool is solely connected with a single private residence for residents and their guests.
• Swimming pool and spa pool technical definitions (reg 3(1)): a spa pool is defined as a water‑retaining structure designed for human use that can hold more than 680 litres and includes equipment for heating and creating turbulence (air bubbles or pressurised water). “Swimming pool” is broad and includes waterslide pools, wave pools and hydrotherapy pools but explicitly excludes spa pools and tidal pools.
• Waste (reg 3(1)): defined negatively , waste for the purposes of reg 7 excludes wastewater or sewage whose collection and management is governed by separate instruments, the South Australian Public Health (Wastewater) Regulations 2013 or the Water Industry Act 2012.
• Closed to the public (reg 3(2)): a pool is only taken to be closed if a conspicuous barrier or sign is erected or if access is prevented by locked doors or gates. This sets a clear, observable standard for closure.
• Publication and accessibility concepts (regs 4-6): the Regulations require publication of the State Public Health Plan and policies in the Gazette (regs 4-5) and require that incorporated codes, standards and documents are available for inspection at the principal office of the Department (reg 6). The Regulations list specific guidelines (reg 11) which are prescribed under s 109(2)(o) of the Act and are stated as “in force from time to time”.
• Prescribed interest (reg 5A): the “prescribed rate of interest” for the purpose of s 93(5) of the Act is the cash advance debenture rate for the relevant financial year, and that rate is defined by reference to the Local Government Act 1999 terminology.
• Charge on land scheme (reg 5B): sets out the procedural form for creating a charge on land where a person does not comply with a notice under the Act. It authorises delivery of a notice to the Registrar‑General in a Ministerially determined form, creates a notation in the Register Book or General Registry Office, and specifies the legal effect and ranking of the charge (including that a charge in favour of the Chief Public Health Officer corresponds to a Crown mortgage ranking ahead of mortgages registered after notation; a council’s charge corresponds to the charge under s 177 of the Local Government Act 1999).
• Technical water quality and equipment standards (regs 8-9): include precise disinfectant regimes, residual free chlorine minima (with temperature and cyanuric acid stabilisation permutations for pools), total chlorine limits for combined chlorine other than free residual, prohibition or limitation on use of cyanuric acid (in enclosed pools and spa pools), pH range (7.2-7.6), alkalinity range (60-200 mg/L), filtration turnover rates for different pool types, requirement for continuous filtration and automatic analysers that continuously monitor disinfectant and pH levels, visible clarity standard (150 mm disc visibility) and maintenance of records for two years.
• Monitoring, verification and record retention (regs 8(2)-(3), 9(2)-(3)): the Regulations require automatic analysers with continuous control, daily reading and recording of results, manual tests to verify analyser accuracy and manual testing for parameters not measured automatically; records must be kept for two years and be available to authorised officers on request.
• Closure triggers (regs 8(4), 9(6)): a pool or spa pool must be immediately closed to the public if filtration ceases or if a reading shows total chlorine concentration exceeds 10 mg/L.
• Defences (regs 8(7)-(8), 9(8)-(9)): an offence under the pool rules has a defence where the defendant proves the act was not intentional and resulted from taking reasonable care to avoid the offence, with an explicit pathway for owners/occupiers to prove they engaged managers with appropriate knowledge and experience.
• Fee administration (reg 11A): authorises relevant authorities (as defined by cross‑reference to other Public Health regulations) to refund, reduce or remit prescribed fees and to recover fees as a debt in court.

Collectively, these concepts translate statutory powers into enforceable technical, administrative and financial mechanisms intended to manage specific public health risks associated with waste and artificial aquatic facilities and to provide administrative continuity for prior notices under repealed or revoked instruments.

The Regulations create obligations and procedural rights that affect a bounded set of actors. Identify who pays, who decides and who is liable:

• Owners, occupiers and managers of premises with waste that poses or may pose a risk to public health (reg 7). The owner or occupier must take “reasonable steps” to ensure risk‑posing waste is stored in specified receptacles and made available for collection at appropriate intervals. Liability is expressly placed on the owner or occupier; offence penalties and expiation are set out (reg 7).
• Owners, occupiers and persons responsible for the care, control and management of public swimming pools (reg 8(6)) and public spa pools (reg 9(7)). The Regulations make each of those classes of persons separately guilty of an offence where requirements are not met, which distributes liability across ownership and operational control.
• Persons using public pools and spa pools (the public). The Regulations place behavioural obligations on users: prohibitions on entry while suffering from open wounds or notifiable conditions, requirements of reasonable cleanliness of person and clothing, prohibitions on spitting or releasing bodily material and prohibitions on animals entering pools (reg 10). Failure to comply attracts a separate maximum penalty (reg 10).
• Relevant authorities under the Act. The Regulations enable relevant authorities to publish plans and policies by Gazette (regs 4-5) and to deliver notices to the Registrar‑General to create charges on land where people fail to comply with notices (reg 5B). Relevant authorities also have power to refund or recover prescribed fees as a debt under reg 11A and to issue notices under s 92 of the Act where prior notices are transitioned.
• Local government councils and the Chief Public Health Officer. Reg 5B distinguishes charges created in favour of the Chief Public Health Officer (which correspond to a Crown mortgage and rank ahead of mortgages registered after notation) and charges created in favour of a council (equivalent to charges under s 177 of the Local Government Act 1999). The council is therefore an agent able to use the charge mechanism to recover amounts in a manner consistent with local government rating law (reg 5B(5)-(7)).
• Registrar‑General and the land registration system. Reg 5B requires the Registrar‑General to enter a notation in the Register Book or General Registry Office upon receipt of the required form of notice. The form is to be determined by the Minister on the recommendation or with the approval of the Registrar‑General (reg 5B(2)).
• Operators of facilities that supply water or sanitary services indirectly affected: the Regulations exclude wastewater and sewage governed by the Wastewater Regulations 2013 or the Water Industry Act 2012 from the definition of “waste” for reg 7; this separates regulatory responsibility for those matters from the obligations imposed here (reg 3(1)).
• Businesses that provide pool services and testing equipment. The Regulations require specific equipment (continuous filtration, automatic analysers that continuously analyse and control disinfectant and pH levels) and impose filtration turnover and clarity standards (regs 8(1)(f), 9(1)(g)(ii)). Manufacturers, suppliers and maintenance contractors for such systems will therefore be in demand by victims of compliance requirements.
• Persons who held notices under repealed or revoked regimes. Transitional provisions (regs 13-14) convert existing notices under the repealed Public and Environmental Health Act 1987 and certain revoked regulations into notices under s 92 of the Act, affecting those parties by preserving the ongoing conditions and enforcement mechanisms.

Who pays and who decides: financial burdens fall primarily on owners/occupiers/managers of premises (capital and operating costs to install and operate required equipment, fees and potential penalties), users who breach behavioural rules face fines, and relevant authorities and councils make decisions about issuing notices, creating charges and seeking recovery. The Registrar‑General is an administrative decision point for notation and cancellation of land charges; the Minister has a role in determining the form of notices to the Registrar‑General (reg 5B(2), (8)).

The Regulations thus impose operational duties on private parties operating public pools and managing waste while equipping public authorities with inspection, notice, and recovery tools tied into land registration and rating regimes.

This section extracts the principal operative duties imposed by the Regulations and identifies statutory rights or defensive avenues available to regulated parties.

Principal duties

• Waste control (reg 7): the owner or occupier must take reasonable steps to ensure that waste posing or potentially posing a public health risk is:

  • Kept in receptacles that are capable of adequately holding the waste, containing offensive odours and fluids, inaccessible to pests and animals, impervious to water, and in clean and sound condition (reg 7(a)(i)-(iv)); and
  • Made available for collection by a waste collection service as often as appropriate given the nature of the waste (reg 7(b)). Failure to comply is an offence (maximum penalty $5,000; expiation fee $315) (reg 7).

• Operation and maintenance of public swimming pools (reg 8):

  • Pools must be disinfected by chlorine or by a method approved by the named Standard (reg 8(1)(a), (e)).
  • If chlorine is used, the Regulations prescribe minimum residual free chlorine concentrations that vary with whether chlorine is stabilised by cyanuric acid and with water temperature (reg 8(1)(b)(i)(A)-(D)), a limit on combined chlorine other than residual free chlorine (1 mg/L) (reg 8(1)(b)(ii)), restrictions on cyanuric acid use in enclosed pools (reg 8(1)(b)(iii)), and required cyanuric acid concentration when used (30-50 mg/L) (reg 8(1)(b)(iv)).
  • pH to be maintained between 7.2 and 7.6 (reg 8(1)(c)); alkalinity 60-200 mg/L (reg 8(1)(d)).
  • Filtration system requirements include continuous circulation, defined turnover rates for different pool classes (waterslide pools at least once per hour, wading/hydrotherapy pools once per 2 hours, all others once per 6 hours), and a visible clarity standard (150 mm disc) (reg 8(1)(f)(i)(A)-(C)).
  • Automatic equipment must continuously analyse and control disinfectant and pH levels (reg 8(1)(f)(ii)).
  • Monitoring: daily reading and recording of analyser results, manual verification tests, and other manual tests as required (reg 8(2)).
  • Records to be kept for two years and available to authorised officers on request (reg 8(3)).
  • Immediate closure required if filtration ceases or if total chlorine exceeds 10 mg/L (reg 8(4)).
  • Offending parties: owner, occupier, and person responsible for care and management each guilty of an offence for non‑compliance (reg 8(6)).

• Operation and maintenance of public spa pools (reg 9):

  • Specific disinfection requirements: if chlorine used, total residual free chlorine must be at least 4 mg/L; combined chlorine other than free chlorine must not exceed 1 mg/L; cyanuric acid must not be used to stabilise chlorine in spa pools (reg 9(1)(b)(i)-(iii)).
  • pH and alkalinity ranges identical to pools (reg 9(1)(c)-(d)).
  • Weir off‑take or skimmer system requirement while the spa is in use (reg 9(1)(f)).
  • Filtration turnover: all water through filter at least once every 30 minutes (reg 9(1)(g)(i)(B)), plus continuous analysers and clarity standard (reg 9(1)(g)).
  • Monitoring daily, manual verification, records for two years, closure triggers for ceased filtration or total chlorine exceeding 10 mg/L (reg 9(2)-(3), (6)).
  • Additional operational duties unique to spa pools: water must be replaced at a rate of at least 20% every day open for use, or the spa must be completely drained at least weekly (reg 9(4)); spa pools must be cleaned at least once every week during which they have been open for use (reg 9(5)).
  • Offending parties: owner, occupier and person responsible for care and management each guilty of an offence for non‑compliance (reg 9(7)).

• Behavioural duties of the public (reg 10):

  • Individuals must not enter pools or spa pools if they have an open wound or sore, suspect they have a notifiable condition that could be transmitted, or are not reasonably clean (reg 10(a)-(b)).
  • Prohibitions on spitting, squirted water or release of bodily material other than ordinary water immersion (reg 10(c)).
  • Owners or controllers of animals must not allow animals to enter pools (reg 10(d)).
  • Offences attract a maximum penalty of $1,250 (reg 10).

Administrative duties and powers

• Publication obligations for State plan and policies (regs 4-5): the State Public Health Plan and policies or amendments must be published by notice in the Gazette (reg 4; reg 5).
• Prescribed interest and recovery mechanics (reg 5A): a duty to apply the cash advance debenture rate (Local Government Act definition) when calculating prescribed interest under s 93(5) of the Act.
• Registrar‑General interactions and creation of charges on land (reg 5B): relevant authorities may deliver a Ministerially determined form to the Registrar‑General asking for notation; the Registrar‑General must enter appropriate notation which creates a charge; the charge’s legal character and ranking are specified (reg 5B(2)-(6)). The Chief Public Health Officer has the same powers of sale as a mortgagee under Real Property Act 1886 when the charge is in favour of the Chief Public Health Officer (reg 5B(6)); a council may recover amounts as if they were a rate constituting a charge on land under the Local Government Act (reg 5B(7)). Upon payment, the relevant authority must deliver a cancellation notice to the Registrar‑General in the Ministerially determined form (reg 5B(8)).

Defensive rights

• Defences to pool offences (regs 8(7)-(8), 9(8)-(9)): a defendant may avoid liability by proving the offence was not intentional and resulted from taking reasonable care to avoid the commission of the offence. Owners/occupiers may, by proving they took reasonable care to ensure a competent manager was in charge, satisfy the reasonable care limb (reg 8(7)-(8); reg 9(8)-(9)).
• Fee remission/refund discretion (reg 11A(1)): relevant authorities may refund, reduce or remit prescribed fees where they consider it appropriate, which is an administrative discretion that affected entities can seek to exercise.
• Recovery of fees as debt (reg 11A(2)): prescribes a route for authorities to recover unpaid prescribed fees,by action in a court as a debt due to the relevant authority.

Rights of inspection and administrative access

• Codes, standards and documents incorporated by reference are to be available for inspection at the Department’s principal office (reg 6). The pool-related guidelines are prescribed to assist administration and operation of Part 4 (reg 11), and the Regulations state the named documents as “in force from time to time”, indicating they are living references for compliance.

Collectively, duties allocate operational responsibilities for routine sanitation, monitoring and closure decisions to owners and managers of pools and spa pools and place legal and recovery tools in the hands of relevant authorities and councils for enforcing compliance and recouping costs.

The Regulations establish monetary penalties, expiation fees, direct enforcement tools and recovery mechanisms. Below is an organised view of those enforcement features, with references to the operative provisions.

Monetary penalties and expiation fees

• Waste obligations (reg 7): maximum penalty $5,000 and expiation fee $315 for failure by an owner or occupier to take reasonable steps to ensure risk‑posing waste is properly stored and made available for collection (reg 7).
• Public swimming pools (reg 8(6)): failure to comply with the technical and monitoring obligations in reg 8 attracts a maximum penalty of $5,000 and an expiation fee of $315. The offence can be made out against the owner, occupier and the person responsible for care, control and management of the pool (reg 8(6)).
• Public spa pools (reg 9(7)): similar to pools, non‑compliance attracts a maximum penalty of $5,000 and expiation fee $315 against owner, occupier and manager responsible for the spa pool (reg 9(7)).
• Obligations of the public (reg 10): contraventions by users (for example entering while unclean or with open wounds) attract a lower maximum penalty of $1,250 (reg 10).

Enforcement powers and immediate operational enforcement

• Closure trigger obligations (regs 8(4) and 9(6)): these are direct operational enforcement requirements: if the filtration ceases to operate or a reading indicates total chlorine concentration exceeds 10 mg/L, the pool or spa pool must immediately be closed to the public. That is both an obligation and an immediate remedial enforcement mechanism embedded in the regulatory requirements (regs 8(4); 9(6)).
• Inspection and record access (regs 8(3) and 9(3)): owners/managers must retain monitoring records for two years and make them available for inspection at any time on request by an authorised officer. This gives authorised officers a practical compliance and audit tool.

Land charge and recovery mechanisms (reg 5B)

• Non‑compliance recovery scheme (reg 5B): the Regulations prescribe the scheme for creating a charge on land under s 93 of the Act. A relevant authority may deliver a notice, in a Ministerially determined form, to the Registrar‑General that sets out the amount recoverable and the land to which the action relates and requests a notation (reg 5B(2)(a)-(c)).
• Registry entry and charge creation (reg 5B(3)-(4)): on receipt of this notice, the Registrar‑General must enter an appropriate notation in the Register Book or, for land not under the Real Property Act 1886, against the land in the General Registry Office. When the entry is made, a charge over real property is created (reg 5B(3)-(4)).
• Legal character and priority of the charge (reg 5B(5)-(6)): in the case of a charge in favour of the Chief Public Health Officer, it corresponds to a mortgage in favour of the Crown that ranks ahead of any mortgage, encumbrance or charge registered after the notation (reg 5B(5)(a)). The Chief Public Health Officer obtains the same powers of sale as a mortgagee under the Real Property Act 1886 where default occurs (reg 5B(6)). In the case of a charge in favour of a council, the charge will be the same as a charge under s 177 of the Local Government Act 1999, enabling recovery as if it were a rate constituting a charge on land (reg 5B(5)(b), (7)).
• Cancellation on payment (reg 5B(8)): where the amount is paid, the relevant authority must notify the Registrar‑General in the determined form to cancel the charge.

Administrative discretion and fee recovery (reg 11A)

• Discretion to remit fees (reg 11A(1)): relevant authorities may refund, reduce or remit payment of prescribed fees if the authority considers it appropriate.
• Recovery of fees as a debt (reg 11A(2)): prescribes that prescribed fees payable to a relevant authority may be recovered by action in a court as a debt due to the relevant authority.

Defences and evidential points

• Defence of due care (regs 8(7)-(8), 9(8)-(9)): provisions give defendants a two‑limbed defence: (a) the alleged offence was not committed intentionally; and (b) it did not result from the defendant’s failure to take reasonable care. Owners/occupiers are given a specific evidential pathway to prove reasonable care by showing they ensured the person responsible for pool management had appropriate knowledge and experience (reg 8(7)-(8); reg 9(8)-(9)). These defences will be central to contested prosecutions.

Procedural form and Ministerial role

• Form of Registrar‑General notice (reg 5B(2)): the notice to the Registrar‑General must be in a form determined by the Minister on the recommendation or with the approval of the Registrar‑General. This ties an administrative discretion to a Ministerial instrument prepared in consultation with registry practice (reg 5B(2)).

Enforcement avenues preserved under transition

• Transitional conversion of existing notices (regs 13-14): notices under the repealed Public and Environmental Health Act 1987 and certain revoked regulations automatically become notices under s 92 of the Act and remain subject to the same conditions, preserving ongoing enforcement action without a need to re‑issue notices (regs 13-14).

In short, enforcement is a mixture of administrative remediation (immediate closure triggered by readings or system failure), inspection and record audits, monetary penalties and expiation, and statutory recovery via charges on land that can be registered and, in the Chief Public Health Officer’s case, enforced with sale powers comparable to a mortgagee under the Real Property Act 1886 (reg 5B). The Regulations also give procedural discretion to refund or recover fees and set a prescribed rate of interest for calculations under the Act (reg 5A; reg 11A).

The Regulations are intentionally cross‑referenced to several other legislative instruments. The cross‑references are operational: they allocate jurisdiction, prescribe rates by borrowing definitions, and avoid duplication with regimes that govern wastewater, land registration and local government rating law.

Direct cross‑references to the South Australian Public Health Act 2011

• Purpose and scope: the Regulations are made under and for the purposes of the Public Health Act 2011. Multiple regulations expressly state they give effect to particular provisions of the Act: reg 4 for s 50 (State public health plan), reg 5 for s 54 (procedure for making policies), reg 5A and 5B for s 93 (interest and non‑compliance with notices), and reg 6 (public access to documents) for s 109(6)(c) of the Act. The transitional provisions convert notices into s 92 notices under the Act (regs 13-14). Those cross‑references are foundational: they define the statutory hook under which these subordinate rules operate.

Interaction with land title and property statutes

• Real Property Act 1886 (reg 5B(6)): reg 5B(6) gives the Chief Public Health Officer the same powers of sale of relevant land as are given by the Real Property Act 1886 to a mortgagee when default occurs, and treats a sale by the Chief Public Health Officer as if it were such a sale by a mortgagee for the purposes of that Act. This integrates recovery under the Public Health Act with the mechanics and remedies available under the Real Property Act.
• Registrar‑General’s functions and forms (reg 5B(2)-(3)): reg 5B requires the Registrar‑General to enter a notation in the Register Book or the General Registry Office and ties the form of notice to a Ministerial determination “on the recommendation or with the approval of the Registrar‑General”. This allocates the procedural interface between the public health authority and land registration systems.

Interaction with local government law

• Local Government Act 1999 (reg 5A and reg 5B(5)(b), (7)): reg 5A relies on the Local Government Act 1999 definition of “cash advance debenture rate” to prescribe the interest rate under s 93(5) of the Act. Reg 5B(5)(b) and (7) equate a council’s charge to a charge created under s 177 of the Local Government Act 1999 and allow councils to recover amounts as if they were a rate constituting a charge on land under s 144(2) of that Act. This links recovery under the Public Health Act to local government rating and priority regimes.

Interaction with wastewater and water industry regimes

• Waste exclusion and coordination (reg 3(1)): reg 3(1) expressly excludes wastewater or sewage the collection and management of which are governed by the South Australian Public Health (Wastewater) Regulations 2013 or the Water Industry Act 2012 from the definition of “waste” for the purposes of reg 7. This clears jurisdictional overlap and ensures that wastewater matters remain governed by the instruments designed for that sector (the Wastewater Regulations 2013 and the Water Industry Act 2012), rather than by the waste control reg 7.

Interaction with prior subordinate instruments and transitional continuity

• Revocation and conversion of prior notices (Part 5, regs 12-14): the principal Regulations revoke earlier subordinate instruments (listed in the legislative history). Regs 13-14 convert notices issued under the repealed Public and Environmental Health Act 1987 and certain revoked regulations into s 92 notices under the 2011 Act and preserve the same conditions. This preserves enforcement continuity and avoids gap in regulatory coverage during the legislative transition.

Interaction with codes, standards and guidelines

• Incorporated standards and guidelines (regs 8(1)(a), 8(1)(e), 9(1)(a), 9(1)(e), reg 11): the Regulations incorporate by reference specified documents: the Standard for the Operation of Swimming Pools and Spa Pools in South Australia (December 1991) and two named guidelines for sanitation and pool inspection and maintenance (1991-1992). Reg 6 prescribes that copies of codes, standards or other documents referred to or incorporated by these Regulations are available for inspection at the Department’s principal office. The Regulations do not amend those standards but make compliance with them a route to compliance with the Regulations, except where the Regulations themselves prescribe priorities or deal with inconsistencies.

Administrative and Ministerial interfaces

• Ministerial determination of form (reg 5B(2), (8)): the Minister has a role in determining the form to be used for notices to the Registrar‑General, and the form must be prepared on the recommendation or with the approval of the Registrar‑General. This creates an administrative interlock between ministerial policy and registry practice.

In short, these Regulations are embedded in a network of statutes and instruments: they are subordinate to the Public Health Act 2011, borrow definitional and remedial concepts from the Local Government Act 1999 and the Real Property Act 1886, defer wastewater and sewage to the Wastewater Regulations 2013 and the Water Industry Act 2012, and operationally incorporate existing public health standards and guidelines by reference with inspection rights centred at the Department’s principal office.

The legislative history recorded in the Regulations provides a concise timeline of the instrument’s origin and subsequent variations. The entries identify the principal instrument, variations and revoked predecessor instruments.

Principal instrument and commencement

• The South Australian Public Health (General) Regulations 2013 were made as No 41 of 2013 and published in the Gazette on 23 May 2013 (Gazette 23.5.2013 p2007). The commencement entry indicates (see legislative history) that reg 2 commenced on 16 June 2013 (16.6.2013: r 2). The principal instrument revoked the earlier Public and Environmental Health (General) Regulations 2006 (legislation revoked by principal regulations).

Subsequent variations and insertions

• 2015 variation (No 165 of 2015): On 18 June 2015 (Gazette 18.6.2015 p2856), regulations 5A and 5B were inserted into Part 2 by r 4 of 165/2015, with commencement 18 June 2015. These insertions:

  • Added reg 5A, prescribing the rate of interest for s 93(5) of the Act by reference to the cash advance debenture rate under the Local Government Act 1999.
  • Added reg 5B, prescribing the scheme and mechanics for creating charges on land via a notice to the Registrar‑General under s 93(6) of the Act, including the form determination by the Minister with the recommendation or approval of the Registrar‑General, and clarifying the legal character and priority of charges in favour of the Chief Public Health Officer and councils.

• 2020 variation (No 167 of 2020): On 4 June 2020 (Gazette 4.6.2020 p3020) reg 2 commenced 1 July 2020 and inserted Part 4A by r 4 of 167/2020. Part 4A contains reg 11A, which provides for refund, reduction, remission and recovery of prescribed fees by relevant authorities, and cross‑references the definitions of relevant authority to the Legionella and Wastewater regulations.

Legislative revision notes

• The legislative history notes that earlier versions of the Regulations (historical versions) are listed in the legislative history and that some provisions were omitted under the Legislation Revision and Publication Act 2002 (for example r 2 and Sch 1 omitted 18.6.2015). The legislative history also lists commencement dates for amendments and notes revocations.

Transitional conversion of prior notices

• Part 5 contains transitional provisions that convert notices issued under the repealed Public and Environmental Health Act 1987, the revoked Legionella regulations (Public and Environmental Health (Legionella) Regulations 2008) and the revoked Waste Control regulations (Public and Environmental Health (Waste Control) Regulations 2010), such that notices in force immediately before commencement are taken to be notices issued by the relevant authority under s 92 of the Public Health Act 2011 on that commencement and remain subject to the same conditions (regs 13-14).

Practical effect of amendments

• The 2015 insertion of regs 5A and 5B materially added mechanisms for calculating interest on recoverable amounts and for giving statutory effect to recovery through land charges recorded in the land registry; the 2020 insertion of reg 11A added administrative flexibility in fee remission/refund and clarified recovery as a debt in court for fees payable to relevant authorities. These are measurable administrative and enforcement expansions relative to the original 2013 instrument.

The legislative history entries are explicit about variation dates and the nature of insertions or omissions; they also list the principal regulations and variations, which provides a straightforward audit trail for counsel, compliance officers and researchers tracking legislative evolution.

The Regulations as provided contain no references to judicial decisions, and the instrument does not report any litigation arising from its provisions. There are no cases named in the text of the Regulations. The statutory text does, however, create multiple potential points where litigation or contested administrative proceedings could arise; the Regulations themselves provide the legal mechanics that would be litigated. The following summarises areas where disputes are likely to generate litigation, strictly based on the text of the Regulations:

• Offences and defences (regs 8, 9 and 10): the Regulations create offences for non‑compliance with pool and spa pool technical requirements and for public misconduct in pools (regs 8(6), 9(7), 10). They also create an evidentially framed defence of non‑intention and reasonable care (regs 8(7)-(8), 9(8)-(9)). Disputes will likely centre on whether the defendant took “reasonable care” and whether alleged conduct was “intentional” or reasonably outside the defendant’s control. Owners/occupiers are given a specific route to show they had engaged appropriately qualified management (regs 8(8), 9(9)), which would be an evidential focus in prosecutions or civil recoveries.

• Record disclosure and inspection (regs 8(3), 9(3), reg 6): compliance records must be kept for two years and made available to authorised officers on request, and incorporated standards must be available for inspection at the Department’s principal office (reg 6). Disputes may arise over whether records were properly kept, completeness of records, and whether an authorised officer had proper authority to inspect. Such disputes typically engage administrative law and statutory interpretation of “authorised officer” under the Act (the Act provisions are not reproduced in these Regulations but forms the parent statute linkage).

• Closure decisions and immediate obligations (regs 8(4), 9(6)): the Regulations require immediate closure of a pool when filtration ceases or readings show total chlorine concentration exceeds 10 mg/L. Litigation could arise over whether closure was required (e.g. accuracy of readings, reliability of instruments) and whether a premature or wrongful closure order was justified. Related disputes may involve equipment calibration, supplier responsibility, and the reasonableness of manual verification tests required by the Regulations (regs 8(2)(b), 9(2)(b)).

• Creation and priority of land charges (reg 5B): the Regulations create a statutory procedure for entering a notation and creating a charge against land. They explicitly state the priority of a charge in favour of the Chief Public Health Officer as corresponding to a Crown mortgage that ranks ahead of mortgages registered after the notation (reg 5B(5)(a)), and they grant sale powers analogous to a mortgagee under the Real Property Act 1886 (reg 5B(6)). Litigation may arise over the correctness of the amount claimed, whether procedural requirements for notice and form were met (form determined by the Minister on Registrar‑General recommendation or approval, reg 5B(2)), and disputes over priority and the effect of the notation on third parties. The Regulations also allow councils to recover amounts as if they were rates (reg 5B(7)); disputes may arise over conversion of a recovery into a rating process or contested liability.

• Fee recovery and remission (reg 11A): reg 11A authorises relevant authorities to recover prescribed fees by action in a court as a debt and to refund or remit payment. Disputes can therefore arise over the propriety of fee determinations, whether fees were properly payable under the relevant subordinate instruments (e.g. Legionella or Wastewater regulations), and whether the relevant authority exercised remission powers appropriately.

• Interaction and boundary disputes with other regimes (reg 3(1)): the Regulations exclude wastewater and sewage governed by Wastewater Regulations 2013 or the Water Industry Act 2012 from the “waste” definition for reg 7. Litigation could arise where parties dispute whether a particular effluent or material falls within reg 7’s scope or is governed by the wastewater regime, implicating construction and statutory interface arguments.

Because the Regulations do not name any decisions, the text provides no judicial interpretation to cite. The likely areas of litigation are those where the Regulations create duties tied to technical measurements, operational decisions (closure), and formal registry actions (land charge creation), and where defences rely on standards of “reasonable care”. Any judicial construction will therefore be driven by facts around recordkeeping, instrument accuracy, managerial competence and registry formality as set out in regs 5B, 8 and 9.

This section highlights technical and practical traps in the Regulations that frequently cause compliance errors or unexpected costs, referencing exact regulatory text.

1. Cyanuric acid rules differ across pool types and settings (regs 8(1)(b)(iii)-(iv); reg 9(1)(b)(iii))

   • For public swimming pools, cyanuric acid is permitted in outdoor or non‑enclosed pools with specified concentrations (30-50 mg/L) but is prohibited in enclosed pools (reg 8(1)(b)(iii)-(iv)). For public spa pools, cyanuric acid is expressly prohibited (reg 9(1)(b)(iii)). Operators who treat a pool as “outdoor” versus “enclosed” must be precise about classification, because differing requirements affect minimum residual free chlorine targets and stabiliser rules (reg 8(1)(b)(i)(A)-(D)). Misclassification can result in inappropriate disinfectant regimes or offences.

2. Variable chlorine minima tied to temperature and stabilisation (reg 8(1)(b)(i))

   • For public swimming pools, residual free chlorine minima change with both water temperature and whether cyanuric acid stabiliser is used: 1 mg/L (not stabilised, ≤26°C), 2 mg/L (stabilised, ≤26°C), 2 mg/L (not stabilised, >26°C), 4 mg/L (stabilised, >26°C) (reg 8(1)(b)(i)(A)-(D)). This creates operational complexity for pools that straddle temperature thresholds or vary daily; operators must monitor temperature as well as disinfectant stabilisation status and adjust dosing accordingly.

3. Total chlorine ceiling and closure threshold (regs 8(1)(b)(ii), 8(4), 9(1)(b)(ii), 9(6))

   • The Regulations limit the total chlorine concentration other than residual free chlorine to 1 mg/L (regs 8(1)(b)(ii) and 9(1)(b)(ii)), but they also require immediate closure if total chlorine concentration in the water exceeds 10 mg/L (regs 8(4) and 9(6)). The two thresholds are different regulatory constraints , one is a limit on combined/other chlorine species (1 mg/L), the other is a safety trigger (10 mg/L) requiring immediate closure. Operators must reliably distinguish “total residual free chlorine” and “total chlorine concentration” in measurements to avoid confusion.

4. Filtration turnover rates vary by pool type (reg 8(1)(f)(i)(B); reg 9(1)(g)(i)(B))

   • Pools have differing minimum turnover rates: waterslide pools at least once every hour, wading or hydrotherapy pools at least once every two hours, other swimming pools at least once every six hours (reg 8(1)(f)(i)(B)). Spa pools must pass all water through the filter at least once every 30 minutes (reg 9(1)(g)(i)(B)). Many older pool installations will not meet these turnover specifications without pump or pipework upgrades, creating potential capital costs. Note that reg 8(5) specifically disapplies one turnover requirement for Naracoorte and Millicent swimming lakes , a narrowly tailored exception.

5. Automatic analysers plus manual verification (regs 8(1)(f)(ii), 8(2)(b); reg 9(1)(g)(ii), 9(2)(b))

   • Operators must have automatic equipment that continuously analyses and controls disinfectant and pH levels, but they must also perform manual tests to verify analyser accuracy daily and record results (regs 8(1)(f)(ii), 8(2)(b); regs 9(1)(g)(ii), 9(2)(b)). Relying solely on automated records is insufficient: there is a mandatory verification duty, which requires calibrated testing kits and trained personnel. Failure to maintain manual verification records is an offence risk despite having automated equipment.

6. Record retention and inspection (regs 8(3) and 9(3))

   • Records must be kept for two years and produced “at any time on request by an authorised officer”. This is a strict retention and availability requirement; a routine oversight in data management or staff turnover can result in missing records, which is an independent compliance breach. The Regulations do not provide a limited notice period prior to inspection; “at any time” is immediate.

7. Spa pool water replacement and cleaning obligations (regs 9(4)-(5))

   • Spa pools must replace at least 20% of water each day open for use or be completely drained at least weekly, and be cleaned at least once weekly (regs 9(4)-(5)). These recurring operational duties have recurring water and labour costs. Operators who assume standard pool maintenance frequencies may fall short of these specific spa obligations.

8. Immediate closure requirement is strict and objective (regs 8(4) and 9(6))

   • The duty to close immediately when filtration ceases or readings show total chlorine exceeds 10 mg/L is unqualified. Operator judgement about whether a closure is necessary must bow to the reading/instrument result, subject to later proof in defence. This can result in sudden business interruption and potential customer losses if equipment or sensors fail.

9. Creation and priority of land charge (reg 5B)

   • Reg 5B grants a powerful recovery mechanism: a charge in favour of the Chief Public Health Officer corresponds to a Crown mortgage and ranks ahead of mortgages registered after the notation (reg 5B(5)(a)). That ranking means that non‑payment can potentially extinguish or subordinate later financiers’ security, and the Chief Public Health Officer gains powers of sale equivalent to a mortgagee under the Real Property Act 1886 (reg 5B(6)). Parties must be attentive to notification and form requirements, and owners may face severe consequences for unpaid amounts.

10. Form determined by Minister and Registrar‑General approval (reg 5B(2))

    • The notice form required to create the land charge is to be “determined by the Minister on the recommendation or with the approval of the Registrar‑General.” If the Ministerial form is not readily available or is changed, there may be procedural contests about whether the correct form was used, affecting the charge’s validity.

11. “Waste” exclusion may surprise mixed facilities (reg 3(1))

    • Reg 7’s controls on waste exclude wastewater or sewage governed by the Wastewater Regulations 2013 or the Water Industry Act 2012. Facilities that produce both general waste and regulated wastewater (for example, caravan parks, campgrounds) must segregate responsibilities and ensure they comply with both regimes in the right domains. Misallocating an effluent stream to the wrong regulatory bucket can produce regulatory non‑compliance.

12. Defences require evidential proof, not merely assertion (regs 8(7)-(8), 9(8)-(9))

    • The defences require the defendant to prove lack of intent and that an offence did not result from failure to take reasonable care. Owners are specifically guided to prove reasonable care by showing they employed managers with appropriate knowledge and experience. This places an evidential burden on defendants to document hiring, training and supervision , not simply to assert they tried to comply.

13. Documents “in force from time to time” can change compliance expectations (reg 11)

    • The Standards and Guidelines listed in reg 11 are prescribed “as in force from time to time”, which means the compliance baseline can change without amending these Regulations. Operators must monitor changes to those referenced documents and cannot sole‑rely on a version they initially obtained.

14. Transitional notices continue to bind (regs 13-14)

    • Notices issued under the repealed Act or revoked regulations and in force immediately before commencement are taken, on commencement, to be notices under s 92 of the Public Health Act 2011 and continue subject to the same conditions (regs 13-14). Entities that thought prior notices were obsolete must note that those notices remain live and enforceable as s 92 notices.

These “gotchas” are concrete operational and legal risks embedded in detailed technical requirements, documentary and registry processes, and differing thresholds between pool types. Compliance requires active monitoring of both technical measurements and administrative steps.

This section translates the Regulations’ obligations into a practical compliance checklist and processes tailored to owners, occupiers, managers of pools and spa pools, and relevant authorities. Each task is grounded in specific regulatory requirements.

For owners/occupiers/managers of public swimming pools (reg 8)

1. Equipment and system installation

   • Ensure a continuous filtration system is installed and sized to meet the prescribed turnover rates: waterslide pools at least once every hour, wading or hydrotherapy pools at least once every two hours, other pools at least once every six hours (reg 8(1)(f)(i)(B)). Design capacity so total pool volume cycles within the mandated period.
   • Install automatic analysers that continuously analyse and control disinfectant and pH levels (reg 8(1)(f)(ii)).
   • Ensure filtration and pump redundancies or alarm systems are in place to avoid sudden stoppages that would trigger immediate closure (reg 8(4)).

2. Water chemistry and stabilisation

   • Decide whether to use chlorine stabilised with cyanuric acid. If using cyanuric acid, ensure concentration is maintained between 30-50 mg/L and ensure the pool is not an enclosed structure where cyanuric acid is prohibited (reg 8(1)(b)(iii)-(iv)).
   • Monitor and maintain residual free chlorine at required minima based on temperature and stabilisation status: 1 mg/L (not stabilised ≤26°C), 2 mg/L (stabilised ≤26°C), 2 mg/L (not stabilised >26°C), 4 mg/L (stabilised >26°C) (reg 8(1)(b)(i)).
   • Keep total chlorine concentration other than residual free chlorine at or below 1 mg/L (reg 8(1)(b)(ii)).
   • Maintain pH at 7.2-7.6 and alkalinity 60-200 mg/L (regs 8(1)(c)-(d)).

3. Monitoring, verification and recordkeeping

   • Implement daily read-and-record protocols for automatic analyser outputs; do so at least once every day the pool is open (reg 8(2)(a)).
   • Conduct manual tests daily to verify analyser accuracy and for parameters not measured automatically; record results (reg 8(2)(b)-(c)).
   • Retain all records for two years and ensure they are readily producible to an authorised officer “at any time” on request (reg 8(3)). Use versioned logbooks or electronically timestamped records to preserve chain of custody.

4. Closure readiness

   • Establish and train staff on an immediate closure procedure triggered if filtration ceases or total chlorine exceeds 10 mg/L (reg 8(4)). Place signage and physical barriers ready to deploy to meet reg 3(2) standards for closure.

5. Personnel and training

   • Employ or contract persons with appropriate knowledge and experience in pool operation and document their qualifications as part of the “reasonable care” defence (reg 8(7)-(8)). Maintain written job descriptions, training records and supervision logs.

For public spa pools (reg 9)

1. Equipment and operational differences

   • Ensure a weir off‑take or skimmer system continuously removes surface water while in use (reg 9(1)(f)).
   • Size filtration to pass all water through the filter at least once every 30 minutes (reg 9(1)(g)(i)(B)). Spa pools require higher turnover and therefore stronger pumps and filtration.
   • Install continuous automatic analysers for disinfectant and pH control (reg 9(1)(g)(ii)).

2. Water chemistry

   • If chlorine is used, maintain residual free chlorine at least 4 mg/L and ensure combined chlorine other than residual free chlorine does not exceed 1 mg/L; do not use cyanuric acid to stabilise chlorine in spa pools (reg 9(1)(b)).
   • Maintain pH at 7.2-7.6 and alkalinity at 60-200 mg/L (reg 9(1)(c)-(d)).

3. Wastewater and cleaning cycle

   • Replace at least 20% of spa water each day it is open for use or fully drain and refill at least weekly (reg 9(4)). Schedule weekly cleaning and document completion (reg 9(5)). Ensure wastewater removal from spa maintenance complies with wastewater regulations where relevant.

4. Monitoring and records

   • Read and record analyser outputs daily and perform manual verification tests; retain records for two years and be ready to produce on demand (reg 9(2)-(3)). Implement calibrated manual test kits and documented calibration logs.

5. Closure plan

   • Prepare procedures to close immediately if filtration ceases or total chlorine concentration exceeds 10 mg/L (reg 9(6)). Keep conspicuous signs and physical barriers to ensure compliance with the definition of “closed” (reg 3(2)).

For compliance with waste control obligations (reg 7)

1. Receptacle standards

   • Use receptacles that are impervious to water, capable of containing offensive odours and fluids, inaccessible to pests, and maintained in a clean and sound condition (reg 7(a)(i)-(iv)).
   • Where waste types and volumes vary, tier receptacles by waste type and schedule.

2. Collection frequency

   • Arrange waste collection at intervals appropriate to the nature of the waste. Document risk assessments that justify collection frequency and retain those records to demonstrate “reasonable steps” (reg 7(b)).

For dealing with notices, interest and recovery (regs 5A, 5B, 11A)

1. Responding to notices

   • Treat any notice under s 92/s 93 seriously. If non‑compliance or remedial action is required, prioritise engagement with the relevant authority to avoid escalation and the creation of a land charge under reg 5B.

2. Managing potential land charges

   • If the relevant authority notifies the Registrar‑General to create a notation (reg 5B(2)-(3)), seek early legal and title advice because a charge in favour of the Chief Public Health Officer will correspond to a Crown mortgage and rank ahead of mortgages registered after the notation (reg 5B(5)(a)) and may result in sale powers analogous to a mortgagee (reg 5B(6)). Councils’ charges will operate as rates under the Local Government Act 1999 (reg 5B(5)(b), (7)).

3. Interest calculations

   • Expect interest on recoverable amounts to be calculated using the cash advance debenture rate for the relevant financial year (reg 5A(1)).

4. Fee remission and recovery

   • If a prescribed fee is payable to a relevant authority defined in reg 11A, the relevant authority may exercise discretion to refund, reduce or remit fees (reg 11A(1)), and may recover unpaid fees by court action as a debt (reg 11A(2)). Maintain contemporaneous records and seek remission where appropriate.

Administrative best practice

• Maintain a compliance manual that maps each regulatory duty to responsible staff, equipment, verification frequency and record location. Keep hard and electronic copies of all records for two years as required (regs 8(3), 9(3)).
• Maintain calibrated test kits and calibration logs for automatic analysers and manual verification devices; record manual test methodology and results (regs 8(2)(b), 9(2)(b)).
• Retain evidence of staff qualifications and training to support the “reasonable care” defence (regs 8(7)-(8), 9(8)-(9)).
• Keep copies (or documentary references) of the Standard for the Operation of Swimming Pools and Spa Pools and the prescribed guidelines and monitor amendments “in force from time to time” (reg 11; reg 6).
• Implement incident response protocols for immediate closure events and for correcting high chlorine readings, including customer communication and notification to relevant authorities where appropriate.
• For multi‑jurisdictional facilities or those generating wastewater, map which obligations fall under these Regulations and which are governed by the Wastewater Regulations 2013 or the Water Industry Act 2012 to avoid misapplication of duties (reg 3(1)).

Regulatory liaison and dispute avoidance

• Where a remedial notice has been issued, engage early with the relevant authority to agree on remedial steps and timelines to preclude escalation to land charge creation (reg 5B).
• If a charge notation appears in the Register Book or General Registry Office, verify the form of notice used and seek Registrar‑General confirmation of any procedural irregularities; ensure any payment and request for cancellation to the Registrar‑General conforms to the Ministerially determined form (reg 5B(8)).
• Use reg 11A remission routes proactively if fees would cause disproportionate hardship, and document all requests and responses.

Summary

Compliance requires an integrated mix of technical investment (filtration and analysers aligned with turnover rates), operational rigs (daily monitoring, manual verification, recordkeeping), people processes (qualified managers, training records), and administrative processes (notice response, fee management and registry interactions). The Regulations prescribe specific numerical thresholds, equipment requirements and documentary duties; built compliance systems should be mapped directly to the specific subregulation clauses cited above so the operator can demonstrate compliance against each discrete obligation.
