South Australian Multicultural Act 2021

The Act deploys several core legal concepts and policy mechanisms that structure how multiculturalism will be addressed administratively in South Australia.

• Commission as statutory corporation. The Commission is a body corporate with perpetual succession, a common seal, capacity to sue and be sued, and the legal powers of a natural person (s 5(2)(a)-(c)). Documents purporting to bear the common seal are presumed valid absent proof to the contrary (s 5(3)). The Commission holds property on behalf of the Crown (s 5(2)(d)).

• Ministerial direction and limited independence. The Commission is subject to the direction and control of the Minister except in relation to formulation of advice and reports to the Minister (s 5(4)). The Minister appoints members after calling for expressions of interest under a Minister‑determined scheme (s 7(1), (3)), sets terms and conditions, determines remuneration (s 10), and may remove members for specified grounds or reconstitute the whole membership if dissatisfied with performance (s 7(8)-(9)).

• Composition and inclusion rules. Membership caps at 15 and appointments require Australian citizenship or permanent residency (s 7(1)-(2)). The Minister should, so far as reasonably practicable, ensure membership reflects cultural, gender, age, lived experience and geographic diversity, and have regard to specified personal qualities (s 7(4)). Minimum composition requirements include at least half women (rounded down), at least one regional resident and at least one person under 25 at appointment (s 7(5)(a)-(c)). Terms are up to 3 years with a limit of 3 consecutive terms (s 7(6)-(7)).

• Advisory and consultative functions. The Commission’s statutory functions are advisory, promotional, consultative and evaluative rather than supervisory or enforcement focused. They include advising the Minister and State authorities, raising awareness of multiculturalism and the harms of racism, promoting the Charter, consulting with the Commissioner for Equal Opportunity and reviewing government‑funded services (s 11).

• Charter as policy instrument. The Minister must prepare and maintain the Charter in consultation with the Commission and the Commissioner for Aboriginal Engagement, must publish drafts and invite submissions, and must review the Charter at least every 5 years (s 19(1)-(5), (3)). The Charter is explicitly an expression of policy and does not create legally enforceable rights or entitlements (s 19(8)).

• Statutory “have regard to” duty on State authorities. Every State authority must, when exercising functions or powers, have regard to and seek to give effect to the Charter (s 20(1)), subject to statutory or regulatory exceptions (s 20(2)). Failure to comply does not, of itself, give rise to civil liability (s 20(3)).

• Broad regulatory delegation. The regulations power is wide. Regulations may exempt persons, incorporate codes or standards, determine application thresholds, and declare persons or bodies to be State authorities or excluded from that definition (s 21(1)-(4); s 3(1)(f)). Incorporated documents must be available for public inspection and may be certified by the Minister for evidentiary purposes (s 21(4)).

• Transitional legal continuity. The repeal of the 1980 Act and dissolution of the prior Commission are managed by transitional provisions that convert existing members into appointees under the new Act and vest assets and liabilities in the Minister (Schedule 1 cl 2-3).

Those concepts combine an advisory institutional layer with a policy instrument that is intended to shape administrative behaviour through publication, consultation and a statutory duty to have regard to the Charter, while keeping legal enforceability and remedies off the table.

The Act creates obligations and rights that fall mainly on three groups: State authorities, the Minister and the Multicultural Commission, with knock‑on effects for public sector administrative units, stakeholders in the multicultural community and, indirectly, local government and entities captured by the definition of State authority.

• State authorities. The Act defines “State authority” broadly (s 3(1)). It includes officeholders established by Act, public sector agencies, Crown agencies or instrumentalities, local councils under the Local Government Act 1999 (s 3(1)(d)), bodies established for a public purpose by or under an Act and those established or subject to control or direction by the Governor, a Minister or Crown bodies (s 3(1)(e)(i)-(iii)). The regulations may expand or limit this list, including declaring additional persons or bodies to be State authorities, or excluding persons from the definition (s 3(1)(f)). That means the statutory duty to have regard to the Charter (s 20(1)) can apply to a large and potentially adjustable set of public entities. The Act expressly allows regulations to prescribe circumstances under which a State authority will be taken not to be in breach of the duty (s 20(2)).

• The Minister. The Minister has multiple decision points: appointment and removal of Commission members (s 7), appointment of presiding and deputy presiding member (s 8), direction and control over the Commission except on formulation of advice and reports to the Minister (s 5(4)), requirement to ensure the Commission has reasonable resources (s 6), responsibility for preparing, varying and publishing the Charter after consultation (s 19(1), (3)-(6)), and power to request reports from the Commission and lay them before Parliament (s 18). The Minister also proposes the scheme for calls for expressions of interest (s 7(3)), determines remuneration (s 10) and approves committees (s 13(1)). The power to make regulations is vested in the Governor but the Minister typically initiates regulations (s 21).

• Multicultural Commission. The Commission is the organisational hub created by the Act. Its members, staff (via agreements with administrative units, s 16), committees (s 13) and delegated officers (s 12) are the operational resources. Members must be Australian citizens or permanent residents (s 7(2)), and membership is subject to composition requirements and term limits (s 7(4)-(7)). The Commission’s functions are advisory, promotional and consultative (s 11). The Commission is required to meet at least six times a year (s 9(2)), keep accurate minutes (s 9(8)), present annual reports (s 15), and follow prescribed consultation principles (s 17).

• Administrative units and public servants. Public Service administrative units are affected practically because the Act permits the Commission to use their staff, equipment and facilities by agreement with the Chief Executive of the administrative unit (s 16). The Act also contemplates combined annual reporting with a relevant administrative unit (s 15(3)). Administrative units may therefore bear administrative costs when supporting the Commission and facilitating consultations.

• Communities and stakeholders. The Charter and the Commission’s consultative obligations direct interactions with South Australians from diverse backgrounds and the Commissioner for Aboriginal Engagement (s 19(4)(a), s 17(1)(a)). The Commission is tasked with increasing awareness of diversity and the harms of racism and promoting interculturalism (s 11(e)-(h)). Although the Charter does not create enforceable individual rights (s 19(8)), the Act affects how public decision makers are expected to consider cultural, linguistic, racial and religious diversity.

• Bodies subject to regulatory designation. The Governor may, by regulation, declare additional persons or bodies to be State authorities or exempt others from operation of the Act (s 21(1)-(3); s 3(1)(f)). Those regulatory instruments will affect who must have regard to the Charter and who is outside the Act’s ambit.

In sum, the Act centrally affects public administration, the Minister’s portfolio, the Commission’s membership and staff, and public entities that the regulations define as State authorities. Its direct legal impact on private parties is limited because the Charter is non‑enforceable and the statutory duties apply to State authorities, not private persons, unless those private bodies are declared State authorities by regulation.

The Act creates a set of duties, procedural requirements and rights that are largely administrative and advisory. It does not create new private legal entitlements enforceable in court.

Duties on State authorities

• Have regard to the Charter. Every State authority must, when carrying out its functions or exercising its powers, have regard to, and seek to give effect to, the South Australian Multicultural Charter (s 20(1)). That is a statutory duty of administrative consideration which requires State authorities to integrate the Charter into decision making. The duty is subject to statutory exceptions and regulations (s 20(2)).
• Regulatory exceptions and non‑liability. The duty will not be breached where a State authority is acting in accordance with a requirement under this or any other Act, or in circumstances prescribed by the regulations (s 20(2)). Failure to comply with the duty does not, of itself, give rise to civil liability against the Crown, the State authority or any other person (s 20(3)). That limits direct legal remedies for individuals asserting Charter breach.

Duties on the Commission

• Consultation obligations. The Commission must establish and maintain processes to ensure participation of South Australians from diverse backgrounds in consultations it undertakes (s 17(1)(a)). The Commission must also comply with other Ministerial requirements and any regulations governing consultation (s 17(1)(b)-(c)). The Minister can direct the Commission to undertake consultation in a specified manner, and where such direction applies the section is taken not to apply to the extent of the inconsistency (s 17(2)).
• Reporting obligations. The Commission must report annually to the Minister on its operations by 31 October each year (s 15(1)). The Minister must lay the report before both Houses of Parliament within six sitting days of receipt (s 15(2)). The Commission must also provide reports requested by the Minister in the form and within the period specified (s 18(1)-(2)), and the Minister must cause those reports to be laid before Parliament within six sitting days (s 18(4)). The Commission may also prepare reports it considers appropriate (s 18(3)).
• Administrative process duties. The Commission must meet at least six times annually, keep accurate minutes of meetings (s 9(2), (8)), and observe quorum and voting procedures set out in s 9(1), (4)-(5).

Ministerial duties and discretions

• Resource duty. The Minister must ensure the Commission is provided with such resources as may reasonably be required to carry out its functions under the Act (s 6). The Act does not prescribe a standard of proof or mechanism for enforcement of that requirement.
• Charter preparation and consultation. The Minister must prepare and maintain the Charter in consultation with the Commission and must consult on draft versions, publish drafts on a website, invite submissions and cause the Commission to undertake consultation in accordance with the Act (s 19(1), (4)(a)-(c)). After consultation, the Minister must publish the Charter in the Gazette, publish it on a website and cause it to be laid before Parliament within six sitting days (s 19(5)-(7)).
• Appointments and removals. The Minister must call for expressions of interest before appointing members under an instrument‑determined scheme (s 7(3)). The Minister appoints members, sets terms and can remove members for specified reasons, including misconduct and incapacity, or reconstitute the whole Commission if the Minister considers it has failed to carry out its functions satisfactorily (s 7(6)-(9)).
• Regulation‑making. The Governor may make regulations for matters contemplated by or necessary for the Act including exempting persons from operation or incorporating codes and standards (s 21).

Rights

• No new private legal rights. The Charter is explicitly non‑enforceable and does not create legal rights or entitlements (s 19(8)). The Act does not create a private right to sue for breach of the Charter or breach of the duty to have regard to it (s 20(3)). Individuals retain any rights they already have under other laws, and the Commission may refer discrimination matters to the Commissioner for Equal Opportunity (s 11(i)), but the Act itself provides no rights of private enforcement.

Other process rights and protections

• Conflict of interest carve‑out for members. A member of the Commission is not taken to have a direct or indirect interest in a matter for the purposes of the Public Sector (Honesty and Accountability) Act 1995 merely because the member has an interest shared in common with people from a particular cultural group or substantial section of such people (s 14). That is a limited statutory protection aimed at preventing the ordinary lived‑experience connections of members from automatically triggering conflict rules.

Overall, the Act imposes administrative duties to consider and promote multicultural principles across public administration, sets up procedural rights and duties for the Commission and Minister in relation to appointment, consultation, publication and reporting, and stops short of creating enforceable private legal rights.

The Act primarily uses administrative levers rather than penal sanctions. It creates few, if any, direct criminal or civil penalties in the text provided. Enforcement mechanisms are organisational and political, focusing on Ministerial control, reporting, and regulation, rather than court‑enforced sanctions.

Key enforcement and accountability mechanisms

• Ministerial control and removal powers. The Minister may remove a member of the Commission for misconduct, failure or incapacity to carry out duties satisfactorily, contravention of appointment conditions, dishonourable conduct, or absence without leave from four consecutive meetings (s 7(8)(a)-(e)). The Minister may also remove all members if, in the Minister’s opinion, the Commission has failed to carry out its functions satisfactorily and reconstitution is required (s 7(9)). Those powers are administrative but potentially significant for disciplining membership and ensuring compliance with expectations.

• Reporting and parliamentary oversight. The Commission must produce an annual report by 31 October each year summarising operations for the preceding financial year (s 15(1)). The Minister must lay that report before both Houses of Parliament within six sitting days of receipt (s 15(2)). Reports requested by the Minister must be provided in the specified form and time and must also be laid before Parliament within six sitting days (s 18(1)-(4)). Those provisions create a transparency and parliamentary oversight mechanism rather than a penalty regime.

• Resource guarantee. The Minister must ensure reasonable resources for the Commission to perform its functions (s 6). This is an affirmative accountability mechanism but contains no specified enforcement remedy if resources prove inadequate.

• Regulatory tools. The Governor may make regulations necessary or expedient for the purposes of the Act, including exemptions, application rules and incorporation of codes and standards (s 21). Regulations may specify circumstances in which State authorities will be taken not to be in breach of the duty to have regard to the Charter (s 20(2)). Regulations can therefore create legally enforceable norms where the Act itself does not, depending on the content of regulations.

Limits on legal enforcement

• Non‑justiciability of the Charter. The Charter is expressly an expression of policy and does not create legally enforceable rights or entitlements (s 19(8)). That removes a primary avenue for private enforcement through civil suits for breach of the Charter.

• No civil liability for breach of the duty. A failure by a State authority to comply with the duty to have regard to the Charter does not, of itself, give rise to civil liability against the Crown, the State authority or any other person (s 20(3)). That provision narrows the scope for legal redress against public authorities based on the Charter duty.

• No specified criminal offences or pecuniary penalties in the Act. The text contains no express criminal sanctions or monetary penalties for failure to comply with administrative duties or consultation requirements, apart from removal of members for conviction of an indictable offence which automatically vacates office (s 7(10)(d)).

Practical enforcement consequences

• Political and reputational sanctions will be the primary enforcement instruments. Publication of reports, Ministerial removals, parliamentary scrutiny and media attention are the realistic accountability channels. The Act’s design points to administrative correction rather than litigated remedies.

• Regulatory instruments can change that calculus. The Governor’s regulation‑making power allows the creation of more prescriptive obligations or exceptions and could, if used, create enforceable rules or compliance mechanisms beyond those set in the Act. Any such regulations would need to be consulted and made under the proper power in s 21.

In short, the Act creates governance, reporting and Ministerial tools to enforce compliance, while excluding civil liability for breaches of the Charter duty and not introducing new criminal offences for non‑compliance with its core provisions.

The Act explicitly cross‑references and interacts with existing statutes and administrative frameworks, and creates a regulatory gateway that allows further legal interaction by incorporation or declaration.

Direct statutory references

• Local Government Act 1999. The Act expressly includes local councils constituted under the Local Government Act 1999 in the definition of “State authority” (s 3(1)(d)). That brings local councils into the statutory duty framework to have regard to the Charter unless regulations exclude them.

• Public Sector (Honesty and Accountability) Act 1995. Section 14 provides an interaction with the conflict of interest regime under the Public Sector (Honesty and Accountability) Act 1995. A member of the Commission will not be taken to have a direct or indirect interest in a matter under that Act merely because the member shares an interest common to a particular cultural group or a substantial section of such people (s 14). That carves out a specific exemption for cultural‑group shared interests from automatic conflict rules.

• Commissioner for Equal Opportunity and Commissioner for Aboriginal Engagement. The Act contemplates consultation and collaboration with the Commissioner for Equal Opportunity (s 11(i)) and requires consultation with the Commissioner for Aboriginal Engagement when preparing, varying or substituting the Charter (s 19(4)(a)). Those references tie the Commission’s advisory functions into existing anti‑discrimination and Aboriginal engagement frameworks.

Repeal and transitional interaction

• Repeal of 1980 Act. The Act repeals the South Australian Multicultural and Ethnic Affairs Commission Act 1980 (Schedule 1 cl 2) and dissolves the previous Commission (Schedule 1 cl 3(1)). Transitional provisions treat existing members of the old Commission as appointed under the new Act and vest existing rights, assets and liabilities in the Minister (Schedule 1 cl 3(2)-(3)). Those transitional rules maintain continuity while changing the governing statute.

Regulatory incorporation and evidence

• Regulations may incorporate or apply a code, standard, policy or other document prepared by the Minister or another specified person or body, with or without modification (s 21(3)(e)). If incorporated, the regulations require the code or document to be kept available for public inspection and permit production of a Ministerially certified copy as evidence in legal proceedings (s 21(4)(a)-(b)). That mechanism allows normative material to be given legal effect or evidentiary weight via regulation.

Limits on judicial enforcement

• Charter non‑justiciable. The Charter is explicitly an expression of policy and does not create legally enforceable rights or entitlements (s 19(8)). Coupled with the non‑liability clause for State authority failures to comply with the Charter duty (s 20(3)), the Act reduces the likelihood that rights under the Charter can be litigated, preserving existing legal remedies only to the extent they arise under other laws.

Delegation and administrative law principles

• Delegation permitted. The Commission may delegate its functions or powers to specified persons or holders of specified offices (s 12(1)-(2)). Delegations must be in writing and are revocable at will (s 12(3)). That creates administrative flexibility but also potential issues about accountability and the exercise of statutory functions through delegates.

Interaction with public service employment and resources

• Use of Public Service staff. The Commission may, by agreement with the Chief Executive of an administrative unit, use staff, equipment or facilities of that unit (s 16). That creates an administrative interdependence between the Commission and existing public service structures, and enables the government to support the Commission without direct staffing changes in the Act.

Potential regulatory reach

• Definition of State authority is partially delegable by regulation. The regulations may declare “any other person or body” to be a State authority or declare persons to be excluded from that definition (s 3(1)(f)). That allows the executive to alter the set of actors subject to the statutory duty to have regard to the Charter through subordinate instruments, thereby creating further law‑to‑law interactions.

In sum, the Act intersects with anti‑discrimination, Aboriginal engagement, local government, public sector governance and administrative law through statutory references and the Governor’s broad regulations power. It preserves the existing legal hierarchy by restricting the Charter to a policy instrument and by permitting enforcement and standards to be developed through regulations or other statutes where necessary.

The text provided contains the original enactment details and the principal repeal of the prior 1980 statute. There are no subsequent amendments recorded in the supplied document.

Principal enactment

• The South Australian Multicultural Act 2021 is recorded as Year 2021 No 39. It received assent on 21 October 2021 and commenced on 2 December 2021 (Gazette 2.12.2021 p4214), as noted in the Legislative history (Legislative history section, principal Act entry). The Act came into operation on a day to be fixed by proclamation (s 2); the legislative notes confirm commencement on 2 December 2021.

Repeal and replacement

• The Act repealed the South Australian Multicultural and Ethnic Affairs Commission Act 1980 (Schedule 1 cl 2). Transitional provisions dissolve the old Commission and provide for continuity of members, assets and liabilities: members in office immediately prior to repeal are taken to be appointed under the 2021 Act for the remainder of their terms and on the same conditions; the chair of the old Commission is taken to be the presiding member under the new Act (Schedule 1 cl 3(2)). Rights, assets and liabilities of the old Commission vest in the Minister on the day clause 2 of the Schedule comes into operation (Schedule 1 cl 3(3)).

Regulatory and subordinate law development

• The Act contemplates significant subordinate law development through regulations (s 21). The regulations may exempt persons or classes, declare persons to be State authorities or excluded from that definition, incorporate standards and codes, and make saving or transitional provisions (s 21(2)-(3)). As such, the Act’s practical application and reach may be substantially modified by subsequent regulations, although the provided text does not include any instruments.

Amendments since principal Act

• The provided material contains a Legislative history box that lists the principal Act and its commencement details, but does not list subsequent amending Acts. If amendments are made, they would appear in the official Index of South Australian Statutes or on the South Australian legislation website. The Act itself establishes processes for Charter review at least every five years (s 19(3)), which creates an internal mechanism for policy revision rather than statutory amendment.

Transitional continuity protections

• Appointment continuity and vesting of assets and liabilities preserve legal and operational continuity across the legislative replacement of the 1980 Act by the 2021 Act. These transitional provisions reduce displacement costs and immediate legal uncertainty for the Commission, its members and creditors.

For practitioners tracking the Act’s evolution, the primary sources for amendment history are the official South Australian legislation portal and subsequent Gazettes. The Act’s architecture anticipates substantial shaping by regulations and by the Minister’s exercise of appointment, removal and publication powers.

The text supplied contains no litigation history. The Act itself names no judicial decisions, and the schedule and legislative history do not record any cases. As enacted, the Act limits avenues for litigation in relation to the Charter: the Charter is declared to be an expression of policy that does not create legally enforceable rights or entitlements (s 19(8)), and a State authority’s failure to comply with the duty to have regard to the Charter does not, of itself, give rise to civil liability (s 20(3)). Those provisions will reduce the prospects for direct litigation concerning the Charter’s operation.

Potential litigation vectors that the text does not create but that would remain available under other laws

• Administrative law review. Because the Charter duty is a statutory consideration that State authorities must have regard to when exercising powers, an affected party might seek judicial review of a public decision under existing administrative law principles if it can be shown that the decision‑maker failed to take into account relevant considerations or otherwise breached statutory duties that remain justiciable. However, s 20(3) limits the immediate civil liability consequence of failing to comply with the Charter duty. The supplied Act does not specify how administrative law review would interact with s 20(3), and the text does not provide any case law.

• Delegation and exercise of power. The Act permits delegation by the Commission (s 12). Any dispute about the validity of a delegated action could, in principle, be subject to judicial review if the delegation did not comply with the statutory requirements (for example, if no written instrument existed where required) or if a delegate exceeded delegated authority. The supplied Act does not contain litigation examples.

• Removal and appointment decisions. The Minister’s powers to appoint and remove members are administrative decisions that, in theory, could be subject to judicial review on limited grounds such as jurisdictional error, procedural unfairness or unreasonableness. The Act provides statutory grounds for removal (s 7(8)) and the Minister’s discretion to reconstitute membership (s 7(9)), but the present text does not include litigation history challenging those powers.

• Conflict of interest carve‑out. Section 14 provides a specific protection from being treated as having a direct or indirect interest under the Public Sector (Honesty and Accountability) Act 1995 where the interest is shared in common with a cultural group. Disputes about the interpretation or scope of that carve‑out could be litigated in appropriate contexts, but none are recorded in the supplied material.

Because the Act itself was enacted in 2021 and the material does not supply subsequent case law, practitioners should consult judicial databases and later legislative updates to identify any litigation that has arisen since commencement. The Act’s explicit removal of civil liability for Charter duty failure, and the Charter’s express non‑justiciability, mean that the most likely litigation moving forward would concern ancillary administrative law matters, interpretation of regulation, or disputes arising under other statutes referenced by or interacting with the Act.

This Act contains several drafting features and procedural traps that can catch practitioners, public officials and stakeholders if they do not read the provisions carefully. Many of the practical implications arise from what the Act allows rather than what it mandates.

Charter is not legally enforceable

• The Charter is expressly stated to be an expression of policy that does not create legally enforceable rights or entitlements (s 19(8)). Clients who expect judicial remedies for breach of Charter obligations will be disappointed. The statutory duty on State authorities to have regard to the Charter (s 20(1)) is not transformed into a private cause of action by the Act; further, s 20(3) makes clear that failure to comply does not, of itself, give rise to civil liability. Practitioners should not treat “have regard to” as equivalent to legally enforceable standards unless other statutes or regulations create such enforceability.

Broad but adjustable definition of “State authority”

• The Act defines “State authority” broadly (s 3(1)), and gives the regulations power to declare any other person or body to be a State authority or exclude persons from that definition (s 3(1)(f); s 21(2)). That means the scope of who must have regard to the Charter can be altered by subordinate legislation. Be alert to regulatory changes that expand the duty to bodies not normally thought of as public authorities.

Ministerial control and independence nuance

• The Commission is subject to the direction and control of the Minister except in relation to formulation of advice and reports to the Minister (s 5(4)). That formulation carve‑out is narrow. In practice the Minister appoints members, sets terms, determines remuneration, approves committees and may remove members singly or en mass (s 7, s 10, s 13). The Commission’s independence in practice will therefore be limited; advice may be protected from directions in form, but not necessarily in other operational respects. Do not assume full statutory independence.

Removal of members and reconstitution power

• The Minister can remove members for broad grounds including misconduct, incapacity, contravention of appointment conditions, dishonourable conduct and repeated absences (s 7(8)). The Minister may also remove all members if the Commission has “failed to carry out its functions satisfactorily” (s 7(9)). Those provisions provide wide executive control over membership and can lead to sudden reconstitution. Clients should plan for continuity risks.

Consultation requirements subject to Ministerial override

• The Commission must establish participatory consultation processes (s 17(1)), but the Minister may direct it to undertake consultation in a specified matter in accordance with Ministerial directions and the section will not apply to the extent of inconsistency (s 17(2)). That means consultative safeguards can be bypassed by Ministerial instruction.

Delegation revocable at will and potential for further delegation

• Delegations must be in writing but are revocable at will and may be sub‑delegated if the instrument permits it (s 12(1)-(3)). This can create uncertainty about who actually exercises a function at a given time, with attendant accountability and administrative law risks.

Conflict of interest carve‑out scope

• Section 14 protects members from being treated as having an interest under the Public Sector (Honesty and Accountability) Act merely because their interests are shared with a cultural group. This is a narrow protection aimed at enabling lived‑experience representation. It does not immunise members from other conflict rules or from situations where a member’s personal interest is distinct from group interests.

Regulations can materially change practical effect

• The regulations power is wide and may incorporate codes and standards, exempt persons or classes, and decide who is and is not a State authority (s 21). Changes by regulation can therefore create binding operational obligations where the Act itself is non‑binding. Watch subordinate instruments and incorporated documents, and ensure that any referenced codes are readily available for inspection as required by s 21(4).

Resource guarantee is non‑specific

• The Minister must ensure the Commission is provided with such resources as may reasonably be required (s 6). The Act sets no budgetary baseline or enforcement mechanism. If the Commission lacks resources, the Act provides no direct statutory remedy; this is a political rather than judicial accountability lever.

Transitional vesting places assets in the Minister

• Assets and liabilities of the repealed Commission vest in the Minister (Schedule 1 cl 3(3)). That centralises ownership and control and may affect creditors, service contracts and property management. Parties doing business with the outgoing Commission should check transitional arrangements and any ministerial directions.

Publication and timing obligations are tight

• The Minister must publish the Charter in the Gazette and on a website, and lay it before Parliament within six sitting days after publication (s 19(5)-(7)). Similarly, annual and requested reports must be laid before Parliament within six sitting days after receipt (s 15(2); s 18(4)). Administrative staff should build those deadlines into processes to avoid procedural delay.

In short, the main “gotchas” flow from the Act’s reliance on administrative processes, broad executive discretion and a strong subordinate law centre. Practitioners should not conflate the policy prominence of the Charter with legally enforceable rights and must monitor regulatory instruments and Ministerial decisions that materially shape implementation.

Compliance under the Act is primarily administrative. Different actors have distinct and concrete compliance obligations. Below are practical steps for the Minister, the Multicultural Commission, State authorities, administrative units and those preparing or responding to regulatory instruments.

For the Minister and Ministerial staff

• Resource planning. Ensure the Commission is resourced with what is reasonably required to carry out its functions (s 6). Document budgetary allocations, service agreements with administrative units (s 16) and any constraints. The Act gives no enforcement mechanism for resource shortfall, so transparency and parliamentary reporting will be the main accountability routes.
• Appointments process. Before appointing members call for expressions of interest under a scheme determined by the Minister (s 7(3)). Publish the scheme and ensure the selection process records how candidates meet the diversity, gender and geographical criteria mandated (s 7(4)-(5)). Ensure appointment instruments state terms and conditions and comply with citizenship or residency requirements (s 7(2), (6)).
• Charter process. Prepare drafts of the Charter in consultation with the Commission and the Commissioner for Aboriginal Engagement (s 19(1), (4)(a)). Publish the draft on an accessible website, invite submissions and cause the Commission to undertake the required consultation (s 19(4)(a)-(c)). After finalising the Charter, publish it in the Gazette and on the website and lay it before both Houses within six sitting days (s 19(5)-(7)). Keep records of submissions and consultation steps to demonstrate compliance with the statutory process.
• Reporting and parliamentary laying. When receiving the Commission’s annual or requested reports, ensure they are laid before both Houses within six sitting days (s 15(2); s 18(4)). Maintain an auditable record of dates for receipt, publication and laying.

For the Multicultural Commission

• Meetings and governance. Hold at least six meetings per calendar year and maintain accurate minutes (s 9(2), (8)). Ensure quorum rules are observed (s 9(1)). Publish procedures if required and ensure delegations are made in writing and subject to the statutory constraints (s 12(3)).
• Membership composition and eligibility. Verify appointees meet citizenship/permanent residency requirements (s 7(2)), implement term limits and reappointment restrictions (s 7(6)-(7)), and monitor attendance to avoid forfeiture or Ministerial removal grounds (s 7(8)).
• Consultation processes. Establish processes to ensure participation of South Australians from diverse backgrounds when undertaking consultations (s 17(1)(a)). Where the Minister issues directions about consultation, document compliance and those directions because s 17(2) allows Ministerial directions to override s 17(1).
• Reporting obligations. Prepare an annual report for the preceding financial year by 31 October and provide other reports to the Minister on request in the form and time specified (s 15(1); s 18(1)-(2)). Keep records to support statements in reports about consultation, evaluations and outcomes.
• Delegation and committees. If delegating, use written instruments stating conditions and whether further delegation is permitted (s 12(1)-(3)). Obtain Ministerial approval before establishing committees when required (s 13(1)). Ensure committee membership follows the same diversity principles as far as practicable (s 13(2)).

For State authorities and local councils

• Integrate the Charter into decision‑making. Have internal policies and checklists that ensure decision makers “have regard to” and seek to give effect to the Charter when exercising functions and powers (s 20(1)). Document consideration of the Charter in records of decisions to demonstrate compliance.
• Understand exceptions. Identify circumstances where action is mandated by other Acts or by regulations so that the authority can rely on s 20(2) where appropriate. Keep a register of statutory requirements that may conflict with the Charter.
• Training and awareness. Provide training to public servants and councillors on the content of the Charter and the meaning of “have regard to” so that the statutory duty is implemented in practice. Use the Commission as an advisory source under s 11(d)-(f).

For administrative units and Chief Executives

• Staff and facilities agreements. If the Commission seeks to use staff, equipment or facilities, enter a formal agreement with the Chief Executive as required by s 16. Track the costs and time contributions of staff secondments.
• Annual reporting coordination. Where combining the Commission’s annual report with the administrative unit’s report, ensure timelines and content align with s 15(3).

For lawyers and compliance officers reviewing proposed regulations or codes

• Monitor subordinate instruments. The regulations power can change who is a State authority and can incorporate codes that may be given legal effect (s 21(3)-(4)). Review drafts of regulations and incorporated codes for binding legal obligations and public inspection requirements (s 21(4)(a)).
• Check evidentiary certification. If a code is incorporated, the Minister’s certification provides admissible evidence in proceedings (s 21(4)(b)). Ensure that standards used in decision making are those properly incorporated and publicly available.

For community stakeholders and NGOs

• Participate in consultation steps. When a draft Charter or variation is published, make submissions and engage with the Commission to ensure views are recorded (s 19(4)(b)-(c)). Keep records of submissions and follow up on responses.
• Use referral pathways. The Commission may refer discrimination matters to the Commissioner for Equal Opportunity (s 11(i)). Use existing anti‑discrimination mechanisms in addition to engagement with the Commission.

Record keeping and audit

• Document all consultation, decision making and delegation instruments. Written delegations are mandatory and must be retained (s 12(3)(a)). Maintain minutes, attendance records, consultation records, budget documentation and publication dates for Gazettal and website notices.

In practice, compliance looks like an administrative compliance programme: appointment protocols, documented consultations, published drafts and final Charter in the Gazette and online, written delegations and committee instruments, timely and thorough reporting to the Minister and Parliament, and policies that embed the Charter into decision making across State authorities.
