Sources of the Law Act 1985

The statute rests on a few tightly worded conceptual pivots that determine its legal operation.

• Declaratory baseline for historical law. Section 2(1) establishes a single, temporally precise baseline: the law in force in the Colony of South Australia immediately before 22 September 1863. That baseline encompasses both the common law and statutes of England as they were applicable to that Colony. The formula is prescriptive: where a question arises about whether a pre-22 September 1863 law was part of the Territory’s law, the South Australian baseline is “to be taken for all purposes” as the law in force on that date, “to the exclusion of any other law that at any time before that date was in force in the whole or any part” of the area, but only “so far as it was applicable thereto” (s 2(1)).

• Exclusion list. Section 2(2) operates as a negative filter. It removes from consideration any statute that appears in the Schedule and any statute that was repealed by such a statute, by stating that those statutes “shall not be taken to be a law in force on or immediately before, or at any time after, 22 September 1863” in the geographic area in question. The Schedule therefore functions as a catalogue of specific statutory items to be excluded from the declaratory baseline.

• Temporal cut-off for English law. Section 3 answers a different but related question: at what historical date the Territory is to be treated as having been established for the purposes of assessing whether an English law or statute applied. The Act deems the Territory to have been established on 28 December 1836 for all such questions. That date is the reference point for determining the pre-existing applicability of imperial (English) statutes to the Territory.

• Geographic focus. The Act repeatedly refers to “the geographical area that now constitutes the Territory,” and sets out the rule where “a question arises as to whether a law in force before 22 September 1863 is still, or was at a particular date, a part of the law of the whole or any part of” that area (s 2(1)). The phrasing indicates that the Act’s operation is limited to problems of historical attribution within the current boundaries of the Territory.

• Limited substantive effect. The Act does not itself create new rights, criminal offences, or regulatory obligations for ongoing conduct. Its operation is evidentiary and declaratory: it prescribes which body of historical laws to treat as authoritative when resolving disputed questions about the law in force at the relevant historical moment.

• “So far as it was applicable thereto” qualifier. Section 2(1) repeatedly limits the application of the South Australian baseline to parts of that law that were actually applicable to the geographic area in question. This introduces a functional test: a South Australian statute or English common law principle is to be taken as part of the Territory’s law only to the extent it could properly be applied to that geographic area.

These concepts structure the practical work of legal research and litigation: identify whether a question as to the pre-22 September 1863 law arises; ascertain the content of South Australian law immediately before that date (including English statutes and common law as applicable to South Australia); exclude any statute in the Schedule and any statute repealed by a statute so listed; and apply the “applicability” filter to confine the resulting corpus to what could sensibly be applied to the Territory’s geography.

The Act is framed to govern resolution of historical-law questions. The immediate decision-makers it addresses are courts and other adjudicative bodies faced with disputes that turn on what law was in force in the Territory at or before 22 September 1863. The Act does not create administrative machinery, enforcement agencies, regulatory licences, or criminal penalties, and therefore its direct addressees are judicial and quasi-judicial decision makers and the legal practitioners who appear before them.

Practical stakeholders likely to be affected when the Act is invoked include:

• Parties to litigation or administrative review where the operative legal question depends on whether a pre-22 September 1863 law formed part of the Territory’s law. That includes property owners, pastoral lessees, miners, successors in title, and any private actors whose rights or liabilities are traced to 19th-century legal regimes. The Schedule’s subject matter (waste lands, pastoral leases, mineral leases, assessments and similar topics) indicates concrete categories of private interests that could be implicated when questions about historical legal authority arise.

• Solicitors, barristers and researchers who must identify and argue which statutory or common-law provisions applied historically. The Act changes the legal research baseline and thus affects the scope and content of historical survey work.

• Land and resource registries, title offices, surveyors and advisors when historical legal attribution is relevant to title disputes, boundaries, or claims based on historic grants or leases. Although the Act does not alter current registers directly, a judicial application of the Act may lead to reinterpretation of historical documents.

• Public authorities or persons making decisions with historical-law implications, for example those resolving claims for compensation for historic resumption or improvement claims tied to pastoral or mining leases. The Act prescribes how such historical claims should be assessed as a matter of legal attribution.

• Historians and archival custodians insofar as judicial reliance on the Act will require retrieval of South Australian statutes and records as they existed immediately before 22 September 1863 and possibly records concerning English statutes as applied to South Australia as of the deemed 1836 establishment date.

Who pays and who decides. The Act does not itself impose fees or taxes. The immediate costs of invoking the Act fall on parties who litigate historical questions , they bear counsel, research and possibly expert witness costs to establish what South Australian law comprised immediately before 22 September 1863 and whether listed statutes or their repealed antecedents are implicated. Courts and tribunals decide under the prescribed legal rule in s 2(1) and s 3; the Act supplies the rule but not adjudicative personnel.

Finally, because the Act is limited to resolving “where a question arises,” routine present-day conduct and regulation that does not rely on the 19th-century legal baseline is not directly affected unless historical attribution is put in issue.

The Act itself creates no ongoing regulatory duties, civil obligations or private rights in the contemporary sense. Its operative function is to supply a legal rule of attribution for historical questions. The “duties” it establishes are procedural or evidential duties that operate in litigation and decision-making contexts, and they fall on courts and parties engaged in resolving historical questions.

Primary obligations set by the Act

• Apply prescribed baseline when question arises. Section 2(1) directs courts and decision makers to take the law in force in the Colony of South Australia immediately before 22 September 1863 , including the common law and statutes of England applicable to that Colony , as the law in force in the Territory’s geographical area on that date, “to the exclusion of any other law that at any time before that date was in force in the whole or any part of that geographical area,” but only “so far as it was applicable thereto.” In practice, this creates a legal obligation for decision makers to orient their historical-law determination to that South Australian baseline when the statutory test is triggered.

• Observe statutory exclusions in the Schedule. Section 2(2) places an evidentiary constraint: any statute listed in the Schedule, and any statute repealed by a statute so listed, “shall not be taken to be a law in force on or immediately before, or at any time after, 22 September 1863” in the area. This is an instruction to exclude whole categories of statutes and their repealed predecessors from the corpus that would otherwise be treated as in force.

• Use deemed establishment date for imperial law. Section 3 prescribes that for all questions concerning the applicability of a law or statute of England to the Territory, the Territory shall be deemed to have been established on 28 December 1836. Decision makers and advisers therefore must use that date as the temporal reference when assessing whether English statutes applied.

Consequences for litigants and advisers

• Evidentiary and research duties. Parties who assert rights or liabilities that depend on the law purportedly in force at or before 22 September 1863 must marshal primary materials showing what South Australian statutes and English statutes (as applicable to South Australia) existed at the relevant dates, and they must address the Schedule exclusions and the “applicability” limitation in s 2(1). Practitioners thus have a duty to investigate statutory text, legislative commencement and repeal histories, and common-law positions as of the relevant dates.

• Pleading and proof. Because the Act supplies a prescriptive baseline only “where a question arises,” litigants bear the practical burden of pleading and establishing that such a question falls for resolution. The Act does not automatically change registers or require administrative filings; it comes into play when parties litigate historical-law status.

No statutory private rights or penalties created

• No new substantive rights. The Act does not itself confer ownership, leasehold, title, rights to minerals, or monetary awards. It is not drafted as a remedial or proprietary statute; rather it is a rule of statutory construction and historical attribution.

• No penal regime. The Act contains no penalties, enforcement powers or administrative sanctions. It does not empower a regulator to act or impose obligations on current-day conduct.

In sum, the Act's duties are confined to the legal process: courts and decision makers must apply the specified historical baseline and exclusions when addressing questions about which pre-22 September 1863 laws formed part of the Territory’s law, and parties must meet the attendant evidential and research burden to invoke that rule.

The Sources of the Law Act 1985 does not create a system of penalties, nor does it confer enforcement powers on an administrative agency. The Act’s form and language show it is a rule of attribution and construction rather than an enforcement statute. There are no sections imposing fines, imprisonment, civil penalties, licensing conditions, compliance notices, or regulatory duties. There is likewise no delegation of enforcement to an executive agency, minister or regulator.

How the Act is enforced in practice

• Judicial application. The Act’s operation is realised through judicial or tribunal application. When a legal dispute “raises a question” about whether a pre-22 September 1863 law was part of the Territory’s law, courts and tribunals are directed by s 2(1) to treat the South Australian baseline as the law in force at that time, subject to s 2(2) exclusions and the “applicability” grammatical limitation. Enforcement, therefore, is procedural: courts give effect to the statutory instruction when rendering judgments that depend on historical-law attribution.

• Evidentiary effect. The Act changes the evidential and legal framework that parties must address. Parties who fail to adduce the relevant historic statutes, to demonstrate applicability, or to deal with excluded statutes listed in the Schedule may find arguments rejected for lack of support, but that is a litigation risk rather than a statutory penalty. The Act does not itself prescribe sanctions for non-compliance with discovery or production obligations.

• No administrative enforcement route. Because the Act contains no administrative powers, executive notices or delegated enforcement mechanisms, there is no administrative enforcement channel analogous to regulatory infringement processes. Any adverse effect arising out of the application of the Act will be realised through judicial outcomes or through civil dispute resolution processes invoking the Act’s rule.

Practical implication for parties

• Costs of litigation. The practical cost for parties is the time and expense of historical legal research and of making or defending claims that depend on the historical legal baseline. Those costs are not statutory penalties but are the burdens of litigation.

• Potential for rulings that alter legal characterisations. Where a court applies the Act and concludes that a particular statute was or was not part of the Territory’s law at the relevant historical time, that determination may have substantive consequences for property rights, lease obligations, succession claims or other matters traditionally litigated on historical-law grounds. Any enforcement effect is therefore indirect and mediated by ordinary civil processes.

In sum, the Act prescribes no penalties and establishes no enforcement machinery; its effect is implemented by judicial application and the evidentiary burdens that flow from that application.

The Act is a statute of attribution and interacts with other laws primarily by prescribing which historical statutes and common law are to be treated as authoritative when resolving particular legal questions. Its interaction with the wider legal fabric is therefore procedural and contextual.

Priority of the South Australian baseline over other pre-1863 sources

• Exclusive rule for contested historical questions. Section 2(1) directs that, on the relevant issue, the law in force in the Colony of South Australia immediately before 22 September 1863 shall be taken “for all purposes” to be the law in force in the Territory’s area on that date, “to the exclusion of any other law that at any time before that date was in force in the whole or any part” of that area, “so far as it was applicable thereto.” The wording displaces competing claims that some other local ordinance, custom, or statute , even if earlier in time or local to parts of the area , formed the law, by prescribing South Australian law at that moment as the governing reference point.

• Interaction with statutes listed in the Schedule. Section 2(2) imposes a negative interaction rule: any statute in the Schedule, and any statute repealed by a statute so listed, shall not be taken to be a law in force on or immediately before, or at any time after, 22 September 1863. Consequently, those listed statutes are formally excluded from being treated as part of the Territory’s law at the relevant date. Where a listed statute itself repealed an earlier statute, the earlier statute is also excluded.

Temporal determination for English law

• Deemed establishment date for imperial law. Section 3 interacts with the body of English statutes and the common law by prescribing 28 December 1836 as the date on which the Territory is deemed to have been established for purposes of assessing applicability of English law. That means that when determining whether a statute of England applied to the Territory, decision makers must treat 28 December 1836 as the relevant establishment date.

Interaction with contemporary law and current rights

• Not a source of substantive contemporary law. The Act does not itself amend or repeal any contemporary statutory provisions, nor does it purport to change modern-day legal obligations. Its function is to resolve historical attribution questions where those questions bear on contemporary disputes. Therefore, it interacts with current law only insofar as courts use its historical attribution rule to decide questions that have present-day legal consequences.

Limits and qualifications

• Applicability qualifier. The “so far as it was applicable thereto” language in s 2(1) limits the interaction: even a South Australian statute in force immediately before 22 September 1863 is to be taken as part of the Territory’s law only to the extent it was applicable to that geographic area. This introduces a limit on the transplant of South Australian law into the Territory’s legal fabric.

• Geographical focus. The Act repeatedly references “the geographical area that now constitutes the Territory,” confining application to that defined area and to disputes that concern whether a pre-22 September 1863 law was part of the law of “the whole or any part” of that area.

Practical effects for legal research and pleading

• Research direction. For historical legal questions, practitioners must identify South Australian statutes and the body of English law as applied to South Australia at the relevant dates, check the Schedule exclusions and trace repeals where necessary. The Act therefore reshapes the line of legal research to be pursued when these disputes arise.

• Repeal chains. Because s 2(2) excludes statutes listed in the Schedule and “any statute repealed by a statute so listed,” there is an interaction between the Schedule and the wider statute book: a listed statute’s repeal of an earlier statute will itself remove that earlier statute from consideration under the Act. Practitioners must therefore map repeal chains that cross into the pre-1863 period.

Overall, the Act does not itself amend other statutes or create conflicts in the contemporary statute book; instead it prescribes a rule for resolving which historical laws are to be treated as part of the Territory’s legal inheritance and thereby interacts with other laws primarily as a rule of evidence and attribution in litigation.

The statute as provided contains a brief record of its own enactment and does not show any subsequent amendments. The Endnotes supplied with the Act record the following key legislative metadata:

• The instrument is cited as Sources of The Law Act 1985 (Act No. 2, 1985). The Endnotes show the assent date as 1 April 1985 and state that the Act commenced on 1 April 1985. The collection provided is labelled “As in force at 1 April 1985.”

• The text of the Act contains only three operative sections (s 1, s 2, s 3) and a Schedule listing specific statutes. There are no amending provisions within the text, no notes of subsequent insertions or deletions, and no marginal notes indicating later variations.

• The Endnotes provide a key to abbreviations used elsewhere in the statute collection, but they do not record any amendments to the Sources of the Law Act 1985. The absence of inserted or substituted provisions within the Act text as supplied is consistent with no later amendments being reflected in this version.

Given the limited material supplied, the Act’s legislative history, as recorded here, is confined to its original enactment in 1985 and the statement that it was “as in force at 1 April 1985.” The Schedule itself lists statutes enacted between 1853 and 1872; those are part of the Act’s operative exclusions but are not amendments to this Act.

If one needs to know whether there have been later amendments after 1 April 1985, or whether later statutes amended or repealed parts of this Act, such information is not present in the supplied text. The Act as provided contains no internal amending history beyond its original commencement date.

The supplied text contains no citations to case law and records no judicial decisions applying or interpreting the Act. The Act’s Endnotes and contents as provided are limited to the statute itself, its Schedule and the assent/commencement metadata. There is no litigation history included in the document you provided.

Accordingly, the following is a statement strictly limited to the source material available:

• The Sources of the Law Act 1985, as supplied, contains no reported cases, no exemplars of judicial interpretation, and no entries in the Schedule or text indicating that courts have construed its provisions.

• Because the Act is framed to be applied “where a question arises” about historical legal attribution, the statute’s practical effect is realised through judicial application. However, the supplied text does not record any such applications, interlocutory rulings, appellate decisions, or citations in subsequent legislation.

• If a practitioner requires precedents on how courts have interpreted the “to the exclusion of any other law” language in s 2(1), the “so far as it was applicable thereto” limitation, or the effect of the Schedule exclusions in s 2(2), further research in reported case law databases, tribunal decisions and law reports would be necessary because no litigation history is provided in the Act as supplied.

In short, there is no litigation history in the source document. Any analysis of how courts have applied the Act would require examination of judicial decisions recorded outside the text you provided.

Several features of the Act are easy to overlook but can materially affect how it operates in practice. The following points are drawn from the Act’s text and the Schedule; they identify potential pitfalls for practitioners and clients when the statute is engaged.

1. “Where a question arises” is the trigger point. The Act does not automatically rewrite historical records or re-register titles. The statutory rule applies only “where a question arises as to whether a law in force before 22 September 1863 is still, or was at a particular date, a part of the law” of the Territory (s 2(1)). Parties must plead and properly raise that question; the Act is not a free-standing declaratory instrument that judicial or administrative bodies apply ex officio absent contested litigation.

2. The “to the exclusion of any other law” formulation has scope and limit. Section 2(1) directs that the South Australian baseline immediately before 22 September 1863 shall be taken “to the exclusion of any other law that at any time before that date was in force in the whole or any part of that geographical area.” That phrase can be read broadly to displace competing local legal claims; however, the exclusion is qualified by “so far as it was applicable thereto,” which means the transplant of South Australian law is constrained by actual applicability to the Territory’s geography. Practitioners should not assume unqualified importation of every South Australian provision without addressing the applicability condition.

3. Schedule includes statutes enacted after 22 September 1863. The Schedule lists Acts up to the early 1870s (for example Nos. 26 and 27 of 1870-71 and No. 18 of 1872). Section 2(2) states that any statute listed in the Schedule, and any statute repealed by a statute so listed, shall not be taken to be a law in force “on or immediately before, or at any time after, 22 September 1863.” This has two immediate impacts: it excludes some statutes enacted after the date from being treated as though they were in force at the date, and it also excludes any earlier statutes that were repealed by a listed statute. Practitioners must trace repeal chains carefully; a later-listed statute may have repealed an earlier local statute that would otherwise be relevant, and the Act excludes both the listed enactment and the earlier statute it repealed from being treated as law at or around the 1863 date.

4. “Any statute repealed by a statute so listed” can extend exclusions beyond the Schedule. The Schedule therefore has a domino effect: identify each listed statute’s repeal history. If a listed statute repealed an earlier statute, that earlier statute is excluded even if it is not itself listed. This can catch practitioners who rely only on the Schedule and not on the repeal relationships between statutes.

5. “So far as it was applicable thereto” invites contested factual and legal inquiry. Proving whether a South Australian statute as of immediately before 22 September 1863 was actually applicable to a specific part of the Territory can raise contested issues of historical fact (for example, boundaries, administrative reach) and legal interpretation (for example, whether a statute's territorial scope extended to lands later forming part of the Territory). Parties should be prepared to present and resist historical evidence about territorial definitions, local ordinances and administrative practice.

6. Section 3’s deemed establishment date for English law may change the baseline for imperial statutes. For questions about whether English statutes applied to the Territory, the Act deems the Territory to have been established on 28 December 1836 (s 3). Practitioners must therefore use that date when assessing whether a particular imperial statute applied, rather than other possible reference dates.

7. The Act does not create new remedies. It is not a remedial statute that confers compensation or grants rights; it is an attribution rule. Any remedial consequence arises only through litigation outcomes or other substantive law that supplies remedies once the historical-law question has been resolved.

8. No administrative guidance or enforcement mechanism is supplied. Because the Act contains no direction to an agency or executive body, there is no internal administrative process for resolving disputed historical-law questions outside courts and tribunals. This concentrates reliance on adversarial processes and court resources.

9. Research burden is concentrated. To apply the Act, parties must retrieve South Australian statutes, the applicable parts of English statute law and common-law position as they stood immediately before 22 September 1863 (and in respect of English law as of 28 December 1836). This can increase legal research costs and may necessitate expert evidence.

10. The Act applies only to the “geographical area that now constitutes the Territory.” Where historical administration or competing laws affected parts of that area differently, the Act requires a granular assessment of applicability “to the whole or any part” of that area. Parties should be alert to the possibility that different parts of the current Territory may, for historical reasons, present different answers under the Act.

These gotchas show that applying the Act requires careful mapping of statutory text, repeal histories and historical territorial applicability; failure to trace repeal chains or to address applicability may produce flawed arguments or unexpected exclusions.

Because the Act creates no continuing regulatory obligations, “compliance” in this context means adopting a disciplined approach for legal practitioners, public authorities and private parties who may rely on or be affected by a judicial determination of what law was in force on or before 22 September 1863. The following practical steps flow from the Act’s wording and Schedule.

1. Confirm whether a qualifying question has been raised

• Before undertaking historical research, establish that a genuine legal question exists as to whether a law in force before 22 September 1863 is still, or was at a particular date, part of the law of the whole or any part of the current Territory. The Act applies only “where a question arises” (s 2(1)). If no such question is pleaded or relevant to the dispute, the Act’s attribution rule will not be engaged.

2. Use the South Australian baseline immediately before 22 September 1863

• If the question is engaged, treat the law in force in the Colony of South Australia immediately before 22 September 1863 as the primary baseline, including the common law and the statutes of England that were applicable to that Colony at that time (s 2(1)). Practitioners must retrieve primary statutory texts, contemporary legislative instruments, and contemporaneous statements of the common law as recognised in South Australia immediately before that date.

3. Apply the “so far as it was applicable thereto” limitation

• For each candidate statute or common-law principle, assess whether it was actually applicable to the geographical area that now constitutes the Territory. The Act confines the import of South Australian law to the extent of its applicability (s 2(1)). This is both a legal and factual exercise requiring analysis of territorial scope, the statute’s operatory provisions and historical administrative reach.

4. Check the Schedule and trace repeal chains

• Inspect the Schedule closely. Any statute listed in the Schedule, and any statute repealed by a statute so listed, is to be excluded from being taken as a law in force on or around 22 September 1863 in the relevant area (s 2(2)). Practically, this requires tracing the legislative history of each listed statute to identify statutes repealed by it, and then excluding those statutes from the corpus of historical laws to be considered.

5. For questions involving English law, use the 1836 establishment date

• When the question concerns whether a statute of England applied to the Territory, treat 28 December 1836 as the Territory’s establishment date for these purposes (s 3). This means practitioners examine English statutes’ commencement and territorial application as between 28 December 1836 and the relevant date.

6. Assemble primary evidence and prepare pleadings

• Gather authoritative primary sources (statute texts, legislative instruments, repeals, journals or parliamentary records where relevant, and any contemporary legal commentaries admissible as historical evidence). Plead the historical question explicitly, set out the South Australian baseline relied upon, identify any Schedule exclusions relied upon by the opposing party, and adduce facts and authorities that show applicability or lack of it.

7. Anticipate evidentiary hurdles and expert support

• Given the potential complexity of proving which laws were in force and applicable in a mid-19th-century colonial context, consider the need for expert evidence (for example, historians, legal historians or archivists) and be prepared to address disputes about the content and territorial reach of statutes. The Act’s mechanics make that proof decisive.

8. Account for litigation costs and client advice

• Inform clients that invoking or defending a claim involving historical-law attribution under this Act likely involves additional research and associated costs. Because the Act requires identification of historical materials and may involve tracing repeal chains, budget time and resources accordingly.

9. Where administrative bodies face historical questions, consider referral to courts

• Since the Act supplies a rule for judicial/tribunal determination but gives no administrative mechanism, if a public authority faces a contested historical-law question that will materially affect rights or obligations, consider whether the matter should be litigated or referred to a tribunal to obtain a binding determination. Administrative decision makers should record the factual and legal basis for any decision informed by the Act.

10. Document reproduction and sourcing

• When preparing submissions or decisions that rely on the Act, cite section 2(1), section 2(2) and section 3 explicitly and include clear references to the South Australian statute texts and to any English statutes invoked as of 28 December 1836. Also document repeal chains supporting any Schedule exclusions. Precision in citation will reduce the risk of evidentiary challenges.

Summary checklist

• Is a question about pre-22 September 1863 law in issue? (s 2(1))
• Has the South Australian baseline (immediately before 22 September 1863) been identified and sourced? (s 2(1))
• Have you examined whether each candidate law was “applicable thereto”? (s 2(1))
• Have you checked the Schedule and traced whether any listed statute or any statute repealed by a listed statute would be excluded? (s 2(2))
• For English statutes, have you used 28 December 1836 as the deemed establishment date? (s 3)
• Have you pleaded the historical question clearly and assembled necessary expert evidence?

Following these steps maps the Act’s textual obligations into a practical compliance process for litigants, advisers and decision makers.
