Soil and Land Conservation Regulations 1992

The Regulations revolve around a small set of recurring policy and administrative concepts. Define them as the Regulations do and then set out the immediate regulatory effects.

Notice and reassessment

• A notice is the formal written notification to the Commissioner of an intention to drain or pump water that will be discharged off the land or into watercourses (regulations 5(1), 6(1)). The notice must be in a Commissioner‑approved form. If works do not commence within two years, a reassessment notice is required at least 90 days before proceeding (regulations 5(2), 6(2)). The reassessment mechanism resets the Commissioner’s capacity to review changed circumstances.

Supporting material and approvals

• Each notice must be accompanied by a plan or aerial photograph in a Commissioner‑approved scale, with a north point, lot identifiers, the location of proposed works and discharge points, and adjacent public roads (regulations 5(2a)(a), 6(2a)(a)). It must also include any approvals, permissions or applications under any State law relevant to the draining, pumping or discharge, or construction of works intended for the drainage (regulations 5(2a)(b), 6(2a)(b)). These provisions create a documentary linkage between soil conservation review and other statutory approval regimes.

Geography-specific capture

• The Peel‑Harvey Catchment Area is singled out for separate application of the same notice and supporting material requirements (regulation 6(1)). The regulation expressly identifies the area by reference to Figure 1 of Appendix 1 to Statement of Planning Policy No. 2 prepared under the Town Planning and Development Act 1928. The separate provision ensures the Commissioner receives notice for works both within and discharging to or from the catchment.

Information sharing and coordination

• On receipt of a notice, the Commissioner must forward a copy to any Public Authority or district committee that is or may be concerned with the salinity or condition of receiving land or water (regulations 5(4) and 6(4)). That obliges information flows across agencies and committees, enabling coordinated technical and policy assessment.

Service charge procedural architecture

• Regulation 7 points district committees to specific steps required by section 25A(8) of the Act before recommending a service charge. Those steps are then detailed in regulations 8-13: holding one or more public meetings with specified notice periods and content (regulation 8), prescribed procedures and chairing arrangements including vote entitlements for owners (regulation 9), mandatory written information to be placed before the meeting including full costings and implementation timetables (regulation 10), forwarding results and supporting documents to affected local governments (regulation 11), and the materials the district committee must send to the Minister with any recommendation (regulation 12). The district committee must also report to the Minister at intervals of no longer than 12 months on the progress of every service funded by a service charge (regulation 13).

Offences and evidential requirements

• Two primary criminalised behaviours are present: discharging water without having given the required notice (regulations 5(3) and 6(3); penalty $2 000), and making or providing false or misleading statements in any notice given under the Regulations (regulation 14; penalty $1 000). The false‑statement offence covers knowledge and reckless disregard and includes both statements and provided information (regulation 14(a)-(d)).

Authority card formalisation

• The form of the authority card referenced in the Act is set out in Schedule 1. The schedule requires identification information including a photograph and signatures (regulation 3 and Schedule 1).

Transitional interaction with the EP Act

• The compilation table and accompanying note reproduce the transitional provisions inserted by the Environmental Protection Amendment Act 2003, which prescribe how pre‑commencement regulation 4 notices interacting with clearing and the EP Act are to be treated (see the notes under ‘Other notes’ and the compilation table entry). The transitional wording in the note clarifies that certain regulation 4 notices are treated as clearing permits for the purposes of the EP Act in particular circumstances.

Taken together, these concepts build a multi‑layered compliance regime: operational (what to submit and when), informational (what must be explained at public meetings and to local government), and enforcement (penalties for non‑notification and false statements). The Regulations create procedural touchpoints between landowners, local government, district committees, the Commissioner and other State authorities.

The Regulations identify and allocate duties and decision points across several groups. Naming the actors and what the Regulations require of them clarifies who bears costs and who exercises discretion.

Owners and occupiers of land

• Primary obligations fall on any owner or occupier proposing to drain or pump water and discharge it elsewhere. They must give written notice in a Commissioner‑approved form at least 90 days before works start, attach specified plans or aerial photographs and relevant approvals or applications under State law (regulations 5(1), 5(2a); regulation 6 for the Peel‑Harvey Catchment Area). If they discharge without notice they commit an offence (regulations 5(3), 6(3)). If they provide false or reckless information in a notice, they commit an offence (regulation 14).

District committees of soil conservation districts

• District committees propose service charges under section 25A of the Act, and regulation 7 imposes steps they must take before recommending a service charge to the Minister: holding public meetings in accordance with regulations 8-10 and consulting local governments under regulation 11. District committees must forward meeting outcomes and documentation to the Minister if they recommend a service charge, and must report to the Minister at least annually on the progress of any service funded by a service charge (regulations 11-13).

The Commissioner (of Soil and Land Conservation)

• The Commissioner receives notices of proposed draining or pumping, requires those notices to be in an approved form, must be sent reassessment notices if works are delayed beyond two years, must circulate received notices to relevant public authorities or district committees (regulations 5(1), (2), (2a), (4); 6(1), (2), (2a), (4)). The Commissioner also approves the form of the notice and the form of the authority card (regulation 3).

Affected local governments

• Local governments in which land subject to a proposed service charge is situated are "affected local governments" (regulation 8(6)). They must receive at least six weeks’ notice in writing of the public meeting convened by the district committee (regulation 8(3)). They must exhibit public meeting notice at council offices (regulation 8(5)). After a public meeting that votes for a proposed service charge the district committee must forward materials to all affected local governments, which then must present the information to council and advise the district committee whether they support or oppose the proposal and whether they will accept an arrangement to serve notices of assessment under section 25B(1a)(b) (regulation 11(1)-(3)). Local governments therefore act as gatekeepers that must express support and may elect to assist in administration.

Local government chairpersons and meeting procedures

• The Regulations determine who chairs public meetings that are part of the service charge process: the mayor or president (or deputy in their absence) where there is only one affected local government, and where there are multiple affected local governments the mayor/president or deputy of the local government with the greatest number of people who would be liable to pay the proposed charge (regulation 9(1)). The meeting procedure is either the standing orders of the chair’s council or a procedure adopted by a majority of those present and entitled to vote at the meeting (regulation 9(3)). Each owner of land proposed to be charged is entitled to vote at the meeting (regulation 9(4)).

Public authorities and other statutory approval bodies

• On receipt of a notice the Commissioner sends copies to any Public Authority or district committee that is or may be concerned with the salinity or condition of receiving land or water (regulations 5(4), 6(4)). Owners must attach any approvals, permissions or consent obtained under any law of the State, or any pending application for such approvals, when giving notice (regulations 5(2a)(b), 6(2a)(b)). This makes other statutory approval bodies de facto stakeholders in the earlier stages of drainage proposals.

Members of the public who are landowners

• Owners of land that would be liable to pay a proposed service charge are entitiled to vote at the public meeting (regulation 9(4)). The public meeting notice requirements also require publication in a local newspaper and exhibition at the offices of affected local governments (regulation 8(2), (5)).

Minister

• The Minister receives recommendations from district committees accompanied by documents prescribed by regulation 12. The Minister also sets the quorum for the public meeting after consultation with the district committee (regulation 9(2)). The Minister is therefore the decision point for pronouncing on service charges once the procedural steps have been completed.

In summary, the Regulations distribute responsibilities between private landholders who undertake draining or pumping works, district committees that design and recommend service charge schemes, the Commissioner who reviews and circulates notices, local governments that must be consulted and may assist in administration of service charges, and the Minister who accepts or rejects recommendations. Each actor has a legally specified role producing interdependencies: failure by an owner to attach approvals or to notify the Commissioner triggers offences; failure by a district committee to follow public meeting requirements may undermine a recommendation to the Minister; local governments may decline to act as notice servers under section 25B arrangements, affecting administration.

This part summarises the primary duties imposed by the Regulations and the principal rights they confer.

Duties of owners and occupiers proposing draining or pumping

• Notify the Commissioner in writing, on a Commissioner‑approved form, at least 90 days before commencing to drain or pump water that will be discharged off the land or into watercourses (regulations 5(1), 6(1)).
• If works are not commenced within 2 years of the original notice, give a new notice at least 90 days before proceeding for reassessment (regulations 5(2), 6(2)).
• Accompany each notice with a plan or aerial photograph at an approved scale showing north point, scale, identification of the land and adjacent land, location of proposed drains or pumping works, proposed discharge location, and nearby public roads (regulations 5(2a)(a), 6(2a)(a)).
• Accompany each notice with any approval, permission or consent under any State law required to carry out the works or discharge the water, or any pending application for such approvals (regulations 5(2a)(b), 6(2a)(b)).
• Avoid discharging water before providing the required notice; doing so is an offence punishable by fine (regulations 5(3), 6(3)).

Rights of owners and occupiers at public meetings

• If a service charge is proposed on their land, owners of land proposed to be charged are entitled to vote at the public meeting called by the district committee (regulation 9(4)).
• The Regulations require owners be provided with specified written information to enable an informed vote: description of the proposed service, implementation plan, timetable, full costing including administration costs, and details of cost imposition (regulation 10(1)(a)-(e)). These information obligations are rights in the sense that they create an entitlement to receive information.

Duties of district committees proposing a service charge

• Before recommending a service charge the district committee must hold one or more public meetings according to regulations 8-10 and undertake consultation with affected local governments in accordance with regulation 11 (regulation 7).
• Ensure public meeting notice is given in a newspaper circulating in the district not more than 4 weeks and not less than 2 weeks before the meeting, and that affected local governments receive not less than 6 weeks’ notice in writing (regulation 8(2)-(3)).
• Provide the meeting with written information: a non‑technical description, implementation plan, timetable, full costing including administration costs, and the proposed method of cost imposition (regulation 10(1)).
• Where the meeting votes for the service charge, forward to all affected local governments the information presented to the meeting, a summary of meeting progress, and the district committee’s recommendation (regulation 11(1)).
• When making a recommendation to the Minister, forward all documents required by regulation 12 including copies of the public meeting information, newspaper notices and evidence of local government support (regulation 12).

Duties of local governments

• Exhibit public meeting notices on a notice board at the local government’s offices (regulation 8(5)).
• After receiving the district committee’s post‑meeting materials, present them to council and advise the district committee whether it supports or opposes the proposal; if it supports the proposal, indicate willingness to make arrangements under section 25B(1a)(b) to serve notices of assessment and give brief reasons (regulation 11(2)-(3)).

Duties of the Commissioner

• Receive and process notices in the Commissioner‑approved form, require reassessment notices where appropriate, and forward received notices to relevant public authorities or district committees concerned with the salinity or condition of receiving land or water (regulations 5(1), (2), (4); 6(1), (2), (4)).
• Approve the form of the notice and the authority card referenced in regulation 3.

Rights and constraints for Ministers

• The Minister receives the district committee’s recommendation together with prescribed material (regulation 12). The Minister also sets the quorum for public meetings after consultation with the district committee (regulation 9(2)). The procedural rule constrains the Minister to consult the district committee on quorum, but the Minister retains the power to determine the quorum.

Offences and evidentiary duties

• A person making a notice must not knowingly or recklessly make a statement that is false or misleading in a material particular, or provide such information. Breach is an offence carrying a penalty of $1 000 (regulation 14). The offence applies to notices given under regulation 4, 5 or 6, though regulation 4 was deleted and the note explains related transitional treatment under the EP Act.

Reporting obligations

• District committees must report to the Minister at intervals of not more than 12 months on progress of every service on which a service charge is imposed (regulation 13).

Rights implied by information flows

• The Commissioner must send copies of notices to public authorities and district committees concerned with the condition of receiving land or water (regulations 5(4), 6(4)). That creates a right for those authorities to receive timely information and to participate in any technical assessment or further action.

These duties and rights are tightly time‑bound. Owners must comply with the 90‑day pre‑commencement notice and the 2‑year reassessment rule. District committees must meet prescribed notice windows for public meetings, and local governments must respond after council consideration. The Regulations therefore translate high‑level statutory powers in the Act into specific operational steps and information entitlements.

The Regulations specify a small set of criminal penalties and allocate enforcement tasks across public officers, largely through information‑sharing and administrative steps.

Offences and prescribed penalties

• Discharging water without having given the required notice: Regulation 5(3) and regulation 6(3) each create an offence for an owner or occupier who discharges water without having given the required notice under those respective regulations. The prescribed penalty for that offence is $2 000.
• False and misleading statements or information in a notice: Regulation 14 creates an offence for making a statement in a notice under regulation 4, 5 or 6 that the person knows is false or misleading in a material particular, or makes such a statement with reckless disregard, or provides or causes to be provided information that is false or misleading or provided recklessly. The penalty is $1 000.

Enforcement architecture and information flow

• The Commissioner is the recipient of notices and is required to forward copies of any notice received under regulation 5 or 6 to any Public Authority or district committee that is or may be concerned with the salinity or condition of the receiving land or water (regulations 5(4), 6(4)). That creates the primary administrative node for detection: the Commissioner receives the trigger notices and circulates them for assessment.
• The Regulations do not itself create a separate enforcement office or inspectorate beyond the Commissioner’s role in receiving and circulating notices and the authority card formalisation in Schedule 1. The Act (not reproduced here) contains the underlying enforcement powers referenced by the authority card in section 21(2) which this instrument formalises (regulation 3 and Schedule 1).
• District committees must report annually to the Minister on the progress of every service for which a service charge is imposed (regulation 13). That reporting obligation creates a continuing administrative oversight mechanism that may expose non‑compliance in delivery or cost management.

Procedural penalties and administrative consequences

• The Regulations themselves do not set administrative penalties other than the fines for non‑notification and false statements. They do, however, establish procedural pre‑conditions to lawful discharge and to the imposition of service charges; failing to follow those pre‑conditions may lead to criminal fines and, depending upon the content of the Act and other relevant laws, further administrative measures. For example, the Owner must attach any approvals under other State laws when giving notice (regulation 5(2a)(b), 6(2a)(b)). If approvals are absent or defective, that will affect the merits of any assessment by the Commissioner or referral to other authorities.

Evidential and practical enforcement issues

• The false‑statement offence is framed both for knowing falsity and for recklessness, lowering the standard of culpability from dishonesty to reckless disregard in some circumstances (regulation 14(b), (d)). Enforcement will therefore rest on proving either knowledge or recklessness and the materiality of the falsehood.
• The Regulations create reporting and information obligations which, if enforced, create administrative records that can be used in later enforcement. The Commissioner’s circulation of notices to public authorities is a key mechanism for multi‑agency review and, where necessary, referral to other regulatory regimes.

Interaction with the EP Act transitional provisions

• The compilation table and the note under "Other notes" reproduce transitional provisions from the Environmental Protection Amendment Act 2003 that treat certain pre‑commencement regulation 4 notices as if they were clearing permit applications under the EP Act in defined circumstances (see Other notes, the text of s 119 reproduced in the compilation). This creates a pathway by which earlier notices may attract EP Act procedural and enforcement consequences if they fall within the transitional scope.

In sum, enforcement under the Regulations will be executed largely through receipt and circulation of notices by the Commissioner, annual reporting by district committees, and criminal penalties for the narrow but significant offences of non‑notification and false statements. The Regulations do not prescribe broad administrative sanctions beyond these fines, nor do they create an independent enforcement body; the Commissioner and the Minister remain the key public officers through which enforcement and oversight are channelled.

The Regulations repeatedly reference other State statutes and approvals, and the compilation note expressly addresses interactions with the Environmental Protection Act 1986. The document binds procedural steps to other legal regimes in several concrete ways.

Reference to the Soil and Land Conservation Act 1945

• The Regulations are subordinate legislation made under the Soil and Land Conservation Act 1945. Multiple provisions implement or reference specific sections of the Act, for example regulation 3 implements the form of the authority card referred to in section 21(2) of the Act, and regulation 7 implements procedural steps contemplated by section 25A(8) of the Act. The Regulations therefore operationalise parts of the Act rather than replace any substantive powers in the parent statute.

Interactions with planning policy and the Town Planning and Development Act

• Regulation 6 references the Peel‑Harvey Catchment Area "set out in Figure 1 of Appendix 1 to the Statement of Planning Policy No. 2 prepared under section 5AA of the Town Planning and Development Act 1928." This is an explicit cross‑reference to planning policy prepared under another statute, which the Regulations use to define a geographic scope for specific notice obligations. That ties the soil conservation regime to spatial planning instruments prepared under different statutory authority.

Linkage to other State approvals

• Both regulations 5(2a)(b) and 6(2a)(b) require an owner or occupier to attach any approvals, permissions or consents obtained under any law of the State, or any application submitted for such approval, to a notice. This creates an obligation to disclose the status of parallel approvals under any other State statute, for example approvals under the Environmental Protection Act, waterway protections, local planning approvals or other statutory consents.

Transitional interface with the Environmental Protection Act 1986

• The compilation table and the accompanying "Other notes" include the transitional provisions from the Environmental Protection Amendment Act 2003 (s 119). Those transitional provisions treat certain pre‑commencement regulation 4 notices as clearing permits for specified EP Act purposes, and they provide conditions under which such notices are regarded as applications under section 51E(1) and (2) of the EP Act. The note thereby establishes a specific legal interaction where a regulation 4 notice given within certain timeframes is folded into the EP Act clearing permit regime, subject to payment of any prescribed fee and other conditions.

Local government law and standing orders

• Regulation 9(3) ties meeting procedure either to the standing orders of the local government whose chairperson presides, or to a procedure determined by a majority of those present and entitled to vote. That creates a procedural tack between the soil conservation service charge mechanics and local government governance instruments established under local government legislation and council standing orders.

Administrative law consequences

• The transfer of notices to public authorities and district committees (regulations 5(4), 6(4)) ensures other relevant statutory decision‑makers receive information in time to exercise their own statutory powers or limits. The duty to include any approvals obtained under other State laws when submitting a notice creates a record that can be used by those agencies in considering compliance or in pursuing further regulatory action.

Practical consequence: multi‑regime compliance

• An owner proposing drainage or pumping must navigate at least three overlapping regulatory regimes: soil and land conservation notice procedures under these Regulations and the Act, any relevant local government planning or building permits, and any environmental approvals under the Environmental Protection Act or other State laws. The Regulations make that overlap explicit by requiring the owner to disclose approvals or pending applications and by cross‑referring to planning policy for geographic demarcation.

In short, the Regulations are not an isolated code. They create procedural links to the Town Planning and Development Act through SPP No. 2 for Peel‑Harvey, prescribe documentary disclosure of approvals under any State law, and, via the compilation note, document specific transitional treatment with the Environmental Protection Act. Those cross‑references require that compliance planning for drainage or the imposition of service charges take account of approvals and processes under at least three other legal frameworks.

The compilation table and marginal notes in the Regulations provide a concise amendment record from 1992 to 2020. The running history in the text and the compilation table lists the following chronological changes and insertions.

Initial enactment and early amendments

• Soil and Land Conservation Regulations 1992 were published 17 June 1992 and commenced on that date (Compilation table).
• A set of amendments followed in 1999 (Soil and Land Conservation Amendment Regulations 1999) published 11 June 1999, which inserted the service charge procedural provisions (regulation 7 and regulations 8-13 are marked "inserted: Gazette 11 Jun 1999 p. 2534‑7"). These 1999 amendments introduced the detailed public meeting and local government consultation architecture for imposing service charges.

Subsequent changes and deletions

• Further amendments were published in 2002 (Soil and Land Conservation Amendment Regulations 2002), commencing 23 Aug 2002, and in 2004 (Soil and Land Conservation Amendment Regulations 2004) published 22 Jun 2004; the 2004 amendments inserted the false‑statement offence (regulation 14 inserted: Gazette 22 Jun 2004 p. 2139).
• The Environmental Protection Amendment Act 2003 contains consequential amendments affecting how certain pre‑commencement regulation 4 notices are treated in relation to the EP Act. The compilation table records that s 118 and s 119 of that Act assented 20 Oct 2003 and were commenced 8 Jul 2004. The compilation table includes the full text of the transitional s 119 as an "Other note", describing how some regulation 4 notices are to be treated as clearing permits under the EP Act under specified conditions.

Modernisation and form substitution

• The Regulations were later amended in 2020 (Soil and Land Conservation Amendment Regulations 2020, SL 2020/51), with r. 1 and 2 commencing 1 May 2020 and the remainder commencing 2 May 2020. Schedule 1 was inserted by SL 2020/51 r. 4, updating the authority card form (Schedule 1 inserted: SL 2020/51 r. 4). The marginal note indicates that earlier forms (Form 1, Forms 2 and 3, Schedule 3) were deleted in prior amendments (Act No. 54 of 2003 and Gazette 22 Jun 2004).

Specific textual edits recorded in marginal notes

• Regulation 2 was amended by Act No. 54 of 2003 s. 118(2) to define "the Act" as the Soil and Land Conservation Act 1945 (ensuring internal clarity).
• Regulation 3's authority card form was set out in Schedule 1; earlier regulation 4 was deleted by Act No. 54 of 2003 s. 118(3). The compilation shows progressive pruning of now‑redundant forms and schedules and a move toward a simplified authority card in 2020.

Practical effect of the amendment history

• The 1999 amendments are the most consequential programmatically because they introduced the service charge public meeting and local government consultation process that structures how district committees may seek to fund soil conservation services via service charges.
• The 2003/2004 changes interacted with the Environmental Protection Act and created the false‑statement offence, tightening compliance and dealing with overlapping clearing permit processes.
• The 2020 amendment formalised the authority card format and appears to reconcile the Regulations with modern administrative practice for authorised officers.

The compilation table therefore documents a sequence of targeted amendments: 1999 procedural insertions for service charges; 2002 and 2004 amendments including new offences and deletions of forms; 2003 EP Act transitional machinery; and 2020 housekeeping and formalisation of the authority card. The marginal notes in the Regulations in each affected clause record the specific amendment instrument and date, enabling readers to trace textual provenance.

The text provided contains no judicial decisions, court citations or references to litigation concerning these Regulations. The instrument itself lists only statutory amendments and compilation notes. Therefore, within the confines of the material provided:

• There are no cases named in the Regulations or in the compilation notes.
• No appellate or trial decisions are reproduced or referenced in the instrument.
• The compilation table and "Other notes" record legislative amendments and transitional provisions, not judicial interpretations.

Practically this means any legal questions about interpretation, enforcement, or the meaning of terms such as "discharge" in regulation 5 or the materiality standard in regulation 14 must be determined either by reference to the parent Act, other statutes, or by litigation in the courts. The absence of cited case law in the text supplied should be treated as an absence of judicial annotations in this instrument. Users seeking authoritative interpretations, dispute outcomes, or precedent on the scope of offences and the application of public meeting procedures will need to consult case law databases, the Act, or administrative decisions not reproduced here.

This section flags provisions that commonly cause compliance friction, operational risk, or unintended legal consequences because of precise timeframes, documentary requirements and cross‑regime links in the Regulations.

90‑day pre‑commencement notice and 2‑year reassessment trap

• Owners must give notice at least 90 days before work starts (regulations 5(1), 6(1)). If they give notice but do not commence work within two years, they must give a fresh notice at least 90 days before proceeding (regulations 5(2), 6(2)). The practical consequence is a hard reset: a notice that has aged beyond two years cannot be relied on, and proceeding without a reassessment or fresh notice risks an offence under regulations 5(3) and 6(3). Project timelines must be managed to avoid repeated re‑notice costs and procedural delay.

Detailed plan specifications

• Notices must be accompanied by a plan or aerial photograph at a Commissioner‑approved scale showing a north point, lot numbers, location of proposed works and discharge points, and adjacent public roads (regulations 5(2a)(a), 6(2a)(a)). A schematic or vague plan will not satisfy the regs; the Commissioner may require reassessment or may forward the notice for scrutiny by public authorities. Landowners should ensure survey‑level precision if required.

Attachment of other approvals is mandatory

• The requirement to attach any approvals, permissions or consents obtained under any State law, or pending applications, means an owner cannot silo the soil conservation notice from other permitting processes (regulations 5(2a)(b), 6(2a)(b)). Failure to attach such documentation can slow assessment and alert other agencies, possibly leading to referral or enforcement.

Geographical capture of Peel‑Harvey

• Regulation 6 captures any works "from, on or under" land situated in the Peel‑Harvey Catchment Area, and covers discharges whether inside or outside the area (regulation 6(1)). A landowner may be surprised to find that works near the catchment or that discharge into its hydrology attract the extra procedural attention.

Public meeting notice windows and quorum setting

• For service charges, public meeting notices must be published not more than 4 weeks and not less than 2 weeks before the meeting, while affected local governments must receive at least 6 weeks’ written notice (regulation 8(2)-(3)). These overlapping windows require coordination: give local governments six weeks’ notice and then ensure newspaper notices fall within the four to two week window. The Minister determines the quorum after consulting the district committee (regulation 9(2)), an unusual delegation that can create uncertainty for meeting planning if the Minister delays or sets a high quorum.

Chairing rules where multiple local governments are affected

• Where more than one local government is affected, the chair is the mayor/president of the local government with the greatest number of persons who would be liable to pay the proposed service charge (regulation 9(1)(b)). This requires an accurate pre‑meeting assessment of who would be liable; disputes as to the chairperson could arise if liability counts are contested.

Voting entitlement restricted to owners

• Only owners of land proposed to be charged are entitled to vote at the public meeting (regulation 9(4)). Occupiers or other affected parties may therefore have voice in debate but not vote, which can materially affect the outcome of a vote on a service charge.

Full costing requirement

• Regulation 10(1)(d) requires a full costing of the proposed service including separate details of expected administration costs. Underestimating administrative costs can produce later budget shortfalls and stakeholder dissatisfaction. District committees must therefore prepare robust, auditable costings before the meeting.

False statement and materiality

• Regulation 14 criminalises false or misleading statements in notices under regulation 4, 5 or 6 and covers both knowledge and recklessness. The offence imposes a $1 000 fine. The materiality threshold must be assessed, and the inclusion of reckless disregard widens potential culpability beyond deliberate falsehood. Practitioners should ensure accuracy in every element of a notice.

Interplay with EP Act transitional provisions

• The compilation note reproduces s 119 of the Environmental Protection Amendment Act 2003, which treats certain regulation 4 notices as clearing permits under the EP Act in defined circumstances. Since regulation 4 itself has been deleted in later amendments, the transitional provisions in s 119 are a potential source of ambiguity about when old notices are treated as EP Act clearing permits and whether fees apply. Careful attention to timing and fee payment is necessary where historical notices are concerned.

Formality of Commissioner‑approved forms

• Notices must be on Commissioner‑approved forms. The Regulations do not itself publish those forms within the text (except the authority card format in Schedule 1). Practitioners should obtain the current Commissioner‑approved form to ensure procedural compliance.

Service charge administration dependency on local governments

• If a local government opposes the service charge or refuses the arrangement under section 25B to serve notices of assessment, the practical administration of a service charge may be hampered even if the district committee secures other approvals. Regulation 11(3) requires local government to indicate whether it will make the arrangement and to give brief reasons. The district committee’s recommendation must therefore anticipate local government administrative willingness.

These "gotchas" are not legal opinions; they are operational pitfalls directly traceable to the Regulations’ text. Parties planning works or proposing service charges should design processes to anticipate re‑notice requirements, robust survey documentation, coordination with local governments and other approval processes, and careful preparation of financial estimates and meeting materials.

This is a pragmatic, source‑grounded compliance checklist and procedural roadmap for the two primary user groups these Regulations address: (A) owners or occupiers proposing to drain or pump water that will be discharged, and (B) district committees proposing to impose a service charge. Each step lists the exact provisions that create the obligation.

A. Owners and occupiers proposing draining or pumping (regulations 5 and 6)

1. Confirm whether your land falls within the Peel‑Harvey Catchment Area

   • If the land is within the area identified in Statement of Planning Policy No. 2, treat regulation 6 as the operative provision; if not, use regulation 5. Regulation 6(1) extends to discharges whether within or outside the area.

2. Obtain the Commissioner‑approved notice form

   • Notices must be in a form approved by the Commissioner (regulations 5(1), 6(1)). Do not submit a freeform letter.

3. Time your notice

   • Serve the notice at least 90 days before commencing draining or pumping (regulations 5(1), 6(1)). If you gave an earlier notice and did not commence within two years, give a reassessment notice at least 90 days before proceeding (regulations 5(2), 6(2)).

4. Prepare the plan or aerial photograph to required detail

   • Provide a plan or aerial photograph at a Commissioner‑approved scale that has a north point and scale clearly marked, identifies the land and adjacent land including lot or location numbers, shows locations of proposed works and where water will be discharged, and shows any adjacent public roads (regulations 5(2a)(a), 6(2a)(a)). Obtain survey assistance where necessary.

5. Collate approvals and applications under other State laws

   • Attach any approvals, permissions or consents already obtained under any State law for the proposed works or discharge, or attach pending applications (regulations 5(2a)(b), 6(2a)(b)). This includes environmental approvals, clearing permits, planning or works approvals.

6. Submit the notice to the Commissioner in accordance with directions

   • Lodge the completed Commissioner‑approved notice and attachments with the Commissioner at least 90 days prior to commencement (regulations 5(1), 6(1)).

7. Expect the Commissioner to circulate the notice

   • On receipt the Commissioner will send a copy of the notice to any Public Authority or district committee that is or may be concerned with the salinity or condition of the receiving land or water (regulations 5(4), 6(4)). Anticipate technical queries.

8. Do not discharge until the 90‑day period expires and any further administrative steps are completed

   • Discharging without having given the required notice is an offence with a $2 000 penalty (regulations 5(3), 6(3)).

9. Ensure accuracy and avoid false statements

   • Avoid making statements known to be false or made with reckless disregard in any notice; regulation 14 criminalises such conduct with a $1 000 penalty. Ensure all facts, lot numbers and attachments are accurate and supported.

B. District committees proposing a service charge (regulations 7-13)

1. Plan the public meeting(s)

   • Regulation 7 requires that one or more public meetings in accordance with regulations 8-10 be held and that consultation with local governments under regulation 11 be undertaken before recommending a service charge to the Minister.

2. Select an accessible venue and check capacity

   • Hold the meeting at a place within the district reasonably accessible to persons who would be liable and of sufficient capacity (regulation 8(1)).

3. Give the required notices

   • Place a newspaper notice circulating in the district not more than 4 weeks and not less than 2 weeks before the meeting (regulation 8(2)).
   • Give all affected local governments not less than 6 weeks’ written notice of the public meeting (regulation 8(3)).

4. Draft required notice content

   • Ensure notices specify the soil conservation purpose, the category of persons affected, and outline the purpose of the meeting (regulation 8(4)(a)-(c)). Local governments must exhibit the meeting notice at their offices (regulation 8(5)).

5. Determine chair and quorum before meeting

   • Identify the appropriate chairperson as per regulation 9(1): mayor/president or deputy depending on single or multiple local government involvement. Obtain the Minister’s determination of quorum after consultation with the district committee in advance of the meeting (regulation 9(2)).

6. Prepare meeting procedure

   • Decide whether to use the chairing local government’s standing orders or allow the meeting to adopt a procedure by majority vote (regulation 9(3)).

7. Prepare and publish the meeting information pack

   • Regulation 10 requires written information: a detailed non‑technical description of the proposed service, a plan of implementation, a timetable for completion, full costing including administration costs, and details of how costs will be imposed. Make these documents available at the meeting and include them in the package forwarded after the meeting.

8. Record meeting outcomes properly

   • Keep a summary of the progress of the meeting, record votes and recommendations. Regulation 11(1) requires the district committee to forward the meeting information, a summary, and the committee’s recommendation to all affected local governments where the meeting votes for the imposition of a service charge.

9. Coordinate with local governments

   • After receipt of meeting materials local governments must present information to council and advise whether they support the proposal and whether they will accept arrangements to serve notices of assessment under s 25B(1a)(b) (regulation 11(2)-(3)). Obtain written evidence of local government support to include with any recommendation to the Minister.

Overarching compliance pointers

• Keep precise records of all notices, plan scales, approvals attached, newspaper notice dates and local government correspondence. These documents are likely to be required by the Commissioner, by local governments, and by the Minister if a service charge recommendation is made.
• For any notices under regulation 4 (now deleted) that may pre‑date these Regulations, check the transitional provisions in s 119 of the Environmental Protection Amendment Act 2003 in the compilation notes if relevant, particularly to establish whether any older notice is treated as a clearing permit application under the EP Act.
• Obtain legal and technical advice to ensure plan scale, north point, lot numbers and administration costings meet the Commissioner’s expectations. The false‑statement offence carries a criminal penalty and covers reckless disregard.

This compliance roadmap is a direct mapping from the Regulations’ text: the 90‑day timing and 2‑year reassessment (regulations 5(1), 5(2), 6(1), 6(2)), plan and attachment requirements (regulations 5(2a), 6(2a)), public meeting and notification requirements (regulations 7-11), Ministerial package requirements (regulation 12), annual reporting (regulation 13), and the false‑statement offence (regulation 14). Following these steps aligns practical process with statutory commands and reduces the risk of triggering the prescribed penalties.
