12A Delegation

For the purposes of section 15 of the Act, the following powers of the Regulator are not delegable—

(a) the power to give a report to Parliament under section 16ZM of the Child Wellbeing and Safety Act 2005;

(b) the power to give a report to Parliament under section 41O of the Child Wellbeing and Safety Act 2005.

Subdivision 1—Preliminary

13 Application of Division

(1) For the purposes of section 23 of the Act, a requirement set out in Subdivision 2, 3, 4, 5 or 6 is a prescribed requirement for registration.

(2) For the purposes of sections 169, 170 and 172 of the Act, the requirements set out in Subdivisions 2, 3, 4, 5 and 6 are the prescribed registration criteria.
