278 Order to vacate not to be made in certain circumstances
Despite section 276, VCAT must not make an order to vacate if—
(a) the application for the order to vacate is in respect of a notice to vacate given under section 268; and
(b) VCAT is satisfied that—
(i) the interruption to quiet and peaceful enjoyment of the supported residential service has ceased; and
(ii) the disturbance is not a recurrence and will not be repeated.
