What it does
This instrument, the Social Security (Prospective Determinations for Some Recipients) Guidelines 2026, replaces the earlier Social Security (Prospective Determinations) Guidelines 2015 in full (Schedule 1). It is a delegated instrument made under the Social Security Act 1991 and comes into force the day after it is registered (s 1; s 2(1)). The instrument establishes a limited set of rules by which the Secretary of the Department may determine that particular recipients do not satisfy certain statutory criteria in the Act, and it caps the maximum length of any such prospective determination at 12 weeks (ss 6-7).
Mechanically, the instrument does three things. First, it defines terminology for this instrument: it defines Act to mean the Social Security Act 1991 and adopts the statutory cross-reference definition of social security law (s 5). Second, it sets out four factual circumstances under which the Secretary may conclude that a person does not satisfy the criteria in paragraphs 500E(1)(b), 546(1)(b) or 600(1)(b) of the Act (s 6). Those circumstances are: (a) the person is required under the social security law to provide additional evidence to establish particular paragraphs of the Act; (b) the person has incurred an overpayment arising from the person’s failure to comply with social security law provisions; (c) the person has contravened a provision of the social security law; or (d) an event or change of circumstances has occurred, or is likely to occur, that might affect either the person’s qualification for parenting payment, youth allowance or jobseeker payment, or payment of those pensions to the person (s 6(a)-(d) and subparagraphs (d)(i)-(ii)). Third, it limits the maximum length of a period for the referenced paragraphs to 12 weeks (s 7).
The instrument is made under subsections 500E(2), 546(2) and 600(2) of the Act (s 3). The instrument also contains a commencement table and a note on the non-operative status of column 3 of that table (s 2). The combined effect is to provide a short, rule-like specification of when the Secretary may take a prospective approach to determinations under the three named Act paragraphs and to do so for a limited time only, replacing the previous guidelines instrument from 2015 (Schedule 1).
