What it does
This Determination formally declares the National Injury Insurance Scheme Queensland to be an approved personal care support scheme for the purposes of section 35A of the Social Security Act 1991. The operative text that does this is in clause 4(1), which states: "The scheme for the provision of personal care support known as the National Injury Insurance Scheme Queensland is an approved scheme for the purposes of section 35A of the Social Security Act 1991." The instrument is made by the Minister for Social Services and is signed and dated: Christian Porter, dated 18 July 2017 (heading and signature block).
Mechanically, the instrument also sets its commencement. Clause 2 contains a commencement table which records that "The whole of this instrument" is taken to have commenced on 1 July 2016. That date appears in the table under the "Commencement" column, and the instrument includes an explicit note that the table relates only to the provisions as originally made and will not be amended to deal with later amendments of the instrument. Clause 3 records the legal authority for making the Determination, stating that the instrument is made under section 35A of the Social Security Act 1991.
Clause 4(2) provides a definitional statement identifying what is meant in this Determination by the National Injury Insurance Scheme Queensland. That clause describes the scheme as "the fully-funded, no-fault lifetime care and support scheme for people with catastrophic injuries sustained in motor vehicle accidents, consistent with national agreed minimum benchmarks, which was established by commencement of the National Injury Insurance Scheme (Queensland) Act 2016 on 1 July 2016." The Determination therefore performs three mechanical functions: (a) declares approval under s 35A, (b) fixes the scheme definition used for that approval, and (c) sets the instrument commencement as 1 July 2016 while being signed on 18 July 2017.
