Social Security (Pension Valuation Factor) Determination 2018

The Determination revolves around four core concepts: defined benefit income stream, indexation factor, relevant year, and pension valuation factor.

• Defined benefit income stream: The instrument repeatedly applies to “a person’s defined benefit income stream” (see s 6). The Determination does not redefine that term; it relies on the definition in section 23 of the Social Security Act 1991 (s 4 note). That ties the instrument to the statutory meaning used in the Act’s means-testing framework.

• Relevant year: Defined in the instrument as “the 12 month period for which the value of a person’s income stream is being worked out for section 1120 of the Act” (s 4). This fixes the temporal unit for the calculation of indexation factors and the age measure used in s 6(a).

• Indexation factor: This is the pivotal intermediate value used to select a row in the Schedule 2 matrix. The Determination creates two alternative statutory routes to work out the indexation factor depending on whether indexation is non-discretionary (s 7) or discretionary (s 8). For non-discretionary indexation, the Determination prescribes fixed ranges for particular indexation mechanisms (salary-linking, price-index-linking, a rate set by governing rules), and applies an absolute cap of 8% where indexation exceeds that rate (s 7(2)-(5)). For discretionary indexation, trustees’ determinations are aggregated by averaging the indexation factors determined for the income stream over the five years immediately preceding the relevant year (s 8(2)-(4)), subject to a fallback average for funds in existence less than five years (s 8(5)) and to the same 8% cap (s 8(6)).

• Pension valuation factor: The endpoint is the numeric pension valuation factor in Schedule 2. Section 6 instructs that where the indexation factor is determined under s 7 or s 8, the pension valuation factor that applies is the entry in Schedule 2 corresponding to (a) the age of the person on the person’s next birthday following the beginning of the relevant year and (b) the indexation factor for the person’s income stream (s 6). Schedule 2 is a two-dimensional matrix: columns are indexation factor ranges (for example, “At least 2.5% but less than 3%”) and rows are age bands (for example, “61 to 65”), and each cell contains the numeric pension valuation factor.

Other embedded concepts: the instrument references governing rules and trustee discretion as the factual determinants of whether indexation is discretionary (s 7(1); s 8(1)). It also uses the Australian Statistician’s published price index as a trigger for using one of the prescribed indexation ranges (s 7(3)). The instrument explicitly treats non-discretionary indexation as “indexed otherwise than as described in subsection 8(1)” (s 7(6)), establishing a binary classification between discretionary trustee determinations and everything else.

The instrument affects several groups directly and indirectly by changing the valuation input used under section 1120 of the Social Security Act 1991.

• Pensioners and prospective pensioners receiving defined benefit income streams: Persons with defined benefit income streams whose means for social security purposes are calculated under s 1120 are directly affected. For any relevant year, the Determination prescribes which pension valuation factor applies to them (s 6). That numeric factor is used in the statutory valuation method in s 1120 and will therefore influence the test of financial resources that determines entitlement and payment rates under the social security regime.

• Superannuation funds and trustees: Funds that pay defined benefit income streams must identify whether indexation of those streams is discretionary or non-discretionary under their governing rules (s 7(1); s 8(1)). Trustees who exercise discretion over indexation set the factual basis for the s 8 averaging method; their annual determinations for up to five years are the inputs into the indexation factor average (s 8(2)-(4)). Funds also need to record and, when necessary, provide the history of indexation rates or trustee decisions, because the department applying s 1120 will require the chosen indexation factor.

• Departmental decision-makers administering the Social Security Act: The Department of Social Services (or delegated decision-makers) must apply these rules when valuing a person’s income stream for s 1120. The Determination prescribes the algorithmic steps to follow: determine discretionary vs non-discretionary, derive indexation factor per s 7 or 8, determine person’s age on next birthday, then lookup Schedule 2 to find the pension valuation factor (s 6-8).

• Sponsors of defined benefit schemes and advisers: Actuaries, scheme administrators and advisers will need to understand how governing rules’ wording and trustees’ practices translate into the Determination’s categorisation and the consequent valuation. The Determination’s numerical ranges and capping rules (s 7(5); s 8(6)) will affect how schemes and advisers frame and document indexation mechanisms.

• The Commonwealth’s fiscal and administrative apparatus: While not a private-party “affected” group in the sense of individual obligations, the use of these factors changes the quantified resource positions used in the social security means-testing system, and therefore affects administration of pensions and related expenditure.

The instrument does not itself create new legal rights or obligations directly enforceable against trustees beyond those consequences already contained in the Social Security Act. It does, however, alter the monetary effect of defined benefit indexation practices on means testing outcomes and therefore influences incentives for trustees, members and advisers.

The Determination does not create freestanding criminal or civil offences. Its operative effect is prescriptive: it instructs how decision-makers and trustees should treat indexation and which pension valuation factor to apply under s 1120 of the Act. The key duties and rights that follow from the instrument are therefore administrative and evidential.

Duties

• Trustees and funds: Trustees must establish and record whether indexation of a defined benefit income stream is discretionary under their governing rules (s 7(1); s 8(1)). Where indexation is discretionary, trustees’ determinations for each of up to five immediately preceding years are the inputs for the indexation factor average (s 8(2)-(4)). Funds with governing-rule-set indexation must identify the exact rate set by those rules so that it can be located within the ranges in Schedule 2 (s 7(4)). Where a fund has been in existence or making payments for less than five years, trustees or administrators must recognise that the instrument prescribes a default indexation factor range of at least 2.5% but less than 3% for discretionary streams (s 8(5)). Trustees must also understand that any indexation above 8% is taken to be 8% for the Determination’s purposes (s 7(5); s 8(6)).

• Administrative agencies: The Department must apply the Determination’s steps when working out the value of a person’s income stream under s 1120 (s 6). That requires obtaining and relying on evidence of the indexation mechanism and the fund’s historical trustee determinations or rates.

• Record-keeping and evidence provision: While the Determination itself does not set out a records regime, its operation makes documentary record-keeping a de facto duty: trustees and fund administrators will need to maintain records of governing rules, rate settings, trustee discretionary determinations and the year-by-year indices used in the averaging calculation.

Rights

• Persons in receipt of defined benefit income streams: They have a statutory expectation that the valuation under s 1120 will follow this Determination when the decision-maker is working out the value of their income stream (s 6). If a person disputes the factual characterisation (for example, whether indexation was discretionary or non-discretionary) or the mapping of rates into Schedule 2 ranges, their administrative review rights under the Social Security Act and general administrative law frameworks will operate (the Determination does not create or change appeal rights; the Act governs those).

• Funds and trustees: The instrument provides a clear, prescribed method to determine the pension valuation factor. Trustees have the procedural right, by exercise of their governing-rule discretions (s 8(1)), to influence the indexation factor for the purposes of valuation by making annual determinations; s 8(2) makes their determinations the concrete inputs for the five-year average.

Limits and administrative discretion

• The Determination relies on trustees’ factual classifications and decisions. It itself exercises no discretionary power to vary the prescribed ranges or the Schedule 2 factors. The only statutory discretion is the trustees’ discretion over indexation where their governing rules permit it; how trustees exercise that power affects the calculation under s 8.

• The Age input is not discretionary: s 6(a) requires the person’s age to be taken as the age on the next birthday following the beginning of the relevant year. There is no statutory choice about which birthday to use.

Overall, the instrument creates binding prescriptive steps for administrative valuation but leaves factual classifications and trustee choices as the locus of private-party action that will determine which prescribed path applies.

The Determination itself contains no penalty provisions, infringement notices, or enforcement sanctions. It is a subordinate instrument made under subsection 1120(3) of the Social Security Act 1991 (s 3), and its legal force is to prescribe the method for calculating pension valuation factors used when the Act requires a value to be worked out under s 1120 (s 6). Enforcement and compliance consequences therefore flow indirectly through the operation of the Social Security Act and the administrative processes that use the Determination, not through newly-created sanctions in the Determination.

Operational enforcement mechanisms and consequences to consider, as derived from the instrument’s structure:

• Administrative enforcement via benefit calculations: The primary “enforcement” effect is monetary and administrative. The Department, using the Determination, will compute a pension valuation factor and then apply that factor in valuing the income stream under s 1120 of the Act. That valuation influences entitlement thresholds and payment rates. Incorrect provision of information by a fund or pensioner, or mischaracterisation of the indexation mechanism, could therefore result in a higher or lower declared value and thus lead to a change in pension entitlement. Any subsequent departmental correction may trigger recoveries, debt notices, or administrative penalties available under the Social Security Act generally. The Determination does not specify these downstream remedies, but they are the channels through which non-compliance influences parties.

• Evidentiary and procedural challenges: Affected persons have administrative review and merits review routes under the Act and general administrative law if they dispute the Department’s application of the Determination to their case (the Determination does not modify those routes). Because the Determination prescribes precise mapping rules, disputes will largely be factual (which range applies, is indexation discretionary), and those disputes will be resolved through the department’s processes and, where available, tribunals or courts according to the Act and general law.

• No inspection or reporting powers in this instrument: The Determination does not create statutory powers to compel trustees to produce documents, nor does it set reporting standards. Those powers, if used, come from the parent Act or other legislation, not from this instrument.

In sum, the Determination is an instructive administrative instrument; non-compliance or disagreement about its application will be resolved by the administrative apparatus and statutory remedy framework that governs social security decisions rather than by penalties contained inside the Determination itself.

This Determination is explicitly reactive to and embedded in the Social Security Act 1991. It operates as an instrument under subsection 1120(3) of that Act (s 3), so its primary legal interaction is with the statutory means-testing and valuation regime in s 1120. The instrument does not attempt to stand alone; instead it supplies numerical inputs and mapping rules that s 1120 requires decision-makers to use when valuing a person’s defined benefit income stream.

Interactions specified or implied by the Determination:

• Social Security Act 1991, section 23 definitions: The instrument relies on definitions contained in s 23 of the Act, notably “defined benefit income stream” and “governing rules” (s 4 note). That reliance ties the meaning of key terms in this Determination to the Act’s definitions.

• Section 1120 application: Section 6 explicitly links the Determination to the process of working out the value of a person’s income stream for s 1120 of the Act. The Determination therefore modifies the inputs decision-makers use under s 1120 without changing the statutory mechanics of s 1120 itself.

• Superannuation governing rules and trustee law: The Determination repeatedly refers to “the governing rules of the fund” and to trustee discretion (s 7(1); s 8(1)). Although the Determination does not amend trust law or superannuation law, its effect depends on the legal characterisation of governing rules and the bindingness of trustee determinations under the fund’s constitutional documents. Therefore, the exact legal operation of trust and superannuation law , including interpretation of governing rules, exercise of trustee discretion and documentation obligations , will determine whether the Determination’s non-discretionary or discretionary paths apply in practice. The Determination does not modify trustees’ powers; it uses the factual existence of those powers as a branching point.

• Australian Bureau of Statistics indices: The Determination refers to “a price index published by the Australian Statistician” (s 7(3)). That links the instrument to the statistical outputs of the ABS; where indexation is tied to an ABS price index, the Determination prescribes the indexation factor range to be used rather than using the actual published annual percentage change.

• Administrative law and review mechanisms: Because the Determination prescribes steps for a statutory decision under the Act, its application will be subject to administrative law standards, including procedural fairness and merits and judicial review paths available under the Social Security Act and the Administrative Decisions (Judicial Review) Act or related review regimes. The Determination does not alter review rights but will be the basis of factual and legal reasoning that is subject to those review channels.

• Repeal of prior Determination: Schedule 1 repeals the Social Security (Pension Valuation Factor) Determination 1998. That repeal directly affects the statutory landscape by replacing the earlier instrument’s tables and rules with this Determination’s structures and Schedule 2 matrix.

Absent from the instrument are cross-references to taxation, corporations or other legislation that might govern scheme design or trustee obligations; nevertheless, the Determination’s practical operation will intersect with those legal fields in the real world because scheme design and trustee decisions under other statutory regimes will determine which branch of this Determination applies.

The text provided contains the original instrument as made and includes an explicit repeal of the previous Determination from 1998. The operative historical entries from the instrument itself are:

• Date and maker: The Determination is dated 25 November 2018 and is signed by the then Minister for Families and Social Services, Paul Fletcher (instrument header). The instrument states it is made under subsection 1120(3) of the Social Security Act 1991 (s 3).

• Commencement: The whole instrument commenced the day after registration (s 2(1) and the commencement table). The instrument contains a note that the commencement table relates only to the provisions as originally made.

• Repeal of earlier instrument: Schedule 1 expressly repeals the entire Social Security (Pension Valuation Factor) Determination 1998 (Schedule 1 item 1).

• Schedules and content: Schedule 2 constitutes the pension valuation factors matrix used from commencement.

The Determination itself does not list subsequent amendments or revision notes. The instrument’s own commencement note says the schedule relates only to the instrument as originally made and will not be amended there; that is an administrative comment that later amendments, if any, would be recorded elsewhere in consolidated versions.

From the text provided, there are no later amending instruments, no transitional provisions other than the commencement provision, and no revision history contained in the instrument beyond the repeal of the 1998 Determination. If practitioners require later amendment history, they will need to consult consolidated instrument records or the Federal Register of Legislation for post-2018 amendments; those are not contained in the instrument text supplied here.

The Determination contains no statement of litigation nor does it cite any judicial decisions. The instrument text provided does not refer to, rely on, or incorporate any case law. It is an administrative instrument specifying calculation rules and a table, not a declaratory instrument that interprets precedent.

Because the Determination prescribes the manner in which the value of defined benefit income streams is worked out for s 1120 of the Social Security Act, disputes that arise in practice , for example, about whether a fund’s indexation is discretionary or about the correct mapping of a trustee’s rate to a Schedule 2 range , would be resolved through the Act’s administrative decision-review and judicial review mechanisms, and potentially through merits review where the Act provides. However, the instrument text itself contains no reported litigation, no references to cases and no litigation-related transitional rules.

In short, the instrument’s text presents no litigation history. Any litigation arising from application of these provisions would be external to the Determination and not recorded in the Determination itself. Practitioners should therefore consult administrative and tribunal decisions applying s 1120 and this Determination in specific fact patterns for substantive precedent; none are provided in this instrument.

This Determination is compact but contains a number of features that can produce operational or interpretive surprises.

• Binary classification of indexation: The instrument divides indexation into two classes , non-discretionary (s 7) and discretionary (s 8) , with the latter defined as indexation “by discretionary determination of trustees of the fund” (s 8(1)) and the former defined negatively as “indexed otherwise than as described in subsection 8(1)” (s 7(6)). That negative definition places the burden on trustees and administrators to establish whether a governing rule or practice amounts to a trustee discretion or is instead a mechanical, rule-based (non-discretionary) indexation. The instrument does not give examples or tests beyond the textual distinction, which may generate factual disputes.

• Fixed presumptions for common mechanisms: The instrument replaces actual historical indexation rates with statutory presumptions for some indexation mechanisms. Salary-linked indexation is taken to be a rate of at least 4% but less than 5% (s 7(2)). Indexation by reference to an ABS price index is treated as at least 2.5% but less than 3% (s 7(3)). These are blunt instruments: actual salary growth or CPI could be materially different in particular years, but the Determination prescribes a fixed bracket to be used for valuation. That can lead to over- or under-statement of the income stream value relative to actual indexation.

• Range mapping and boundary inclusion: Schedule 2 uses headings like “At least 2.5% but less than 3%”. Section 7(4) and 8(4) require mapping a governing-rule-set rate or an average into “the range of rates set out in Schedule 2 that includes that rate” or “includes the average”. Practitioners should note that the ranges are left-inclusive and right-exclusive, so an exact value equal to the upper boundary belongs to the next column (except the 8% column which is separately labelled “8%” and the instrument caps above-8% values at 8% (s 7(5), s 8(6))). The instrument does not specify rounding rules for averages; therefore, an average that equals a boundary (for example, exactly 3.00%) will fall into the “At least 3% but less than 4%” column under the ordinary meaning of “at least”.

• Trustee-determined averaging: For discretionary indexation, s 8(2)-(4) makes the indexation factor the average of the indexation factors determined for the person’s income stream (or for a class of income streams that includes it) for the five years immediately preceding the relevant year, with the average calculated as sum divided by 5. The Determination requires the use of trustees’ determinations as historical inputs; if trustees failed to record rates or exercise inconsistent approaches across years, the averaging step could be contested. The instrument permits averaging across classes of income streams where appropriate (s 8(3)), which introduces an aggregation choice that trustees must document and justify.

• Short-life funds and defaults: If the fund has been in existence or making payments to the person for less than five years, the indexation factor for discretionary streams defaults to “at least 2.5% but less than 3%” (s 8(5)). That default may differ materially from the fund’s intended practice and will affect valuation until five years of data exists.

• The 8% cap: Both s 7(5) and s 8(6) cap indexation at 8% for Determination purposes. Funds that, for contractual or governing-rule reasons, provide indexation above 8% will have their pension valuation factor calculated as if indexation were 8%. That cap compresses high-indexation outcomes and may affect valuation where indexation steps are very generous.

• Age measure: s 6(a) requires use of the age on the person’s next birthday following the beginning of the relevant year. This specific formula can produce a materially different age band assignment than using age at the start of the relevant year or age at the time of application. Administrators and advisers must be careful to use the next-birthday rule.

• No rounding or precision rules: The Determination prescribes averaging and mapping but does not give rules about rounding decimals or resolving averages that straddle boundary points. That silence leaves procedural choices to administrators or to later administrative practice; parties may need to seek clarifying guidance or rely on general administrative practice.

• Evidence and documentation gap: The instrument presumes the availability of trustee determinations and governing rules but does not impose documentation standards or timelines for providing that evidence to the department. The absence of such prescriptive evidence rules may increase disputes and administrative friction.

These features mean that factual characterisation of a fund’s indexation mechanism, record-keeping by trustees, and precise arithmetic in calculating averages and mapping ranges can significantly affect the pension valuation outcome. Practitioners should anticipate and document choices carefully.

Compliance with the Determination is an administrative process of gathering the prescribed factual inputs and mapping them to Schedule 2. The following stepwise checklist sets out the practical compliance steps that funds, trustees, advisers and departmental officers should follow, grounded in the instrument’s provisions.

1. Identify that s 1120 valuation applies

• Confirm that the person’s income stream is a “defined benefit income stream” as that term is defined in section 23 of the Social Security Act 1991 (s 4 note). The Determination only applies for the purposes of working out a person’s income stream value under s 1120 (s 6).

2. Establish the relevant year

• Determine the 12 month period for which the valuation is being done; this is the “relevant year” as defined in s 4. The age and the historical trustee determinations or indexation rates will be measured relative to that relevant year.

3. Determine whether indexation is discretionary or non-discretionary

• Examine the fund’s governing rules and the factual record to establish whether indexation is by “discretionary determination of trustees” (s 8(1)) or not. If trustees have an explicit discretion to set indexation amounts or rates periodically and have exercised it, the discretionary route in s 8 applies. If indexation is mechanical, formulaic, or explicitly set by rules without trustee discretion, treat it as non-discretionary under s 7(1) and s 7(6).

4. Calculate or select the indexation factor

• If non-discretionary (s 7):

  • If indexation is by reference to movements in salary, take the indexation factor to be at least 4% but less than 5% (s 7(2)).
  • If indexation is by reference to movements in a price index published by the Australian Statistician, take the indexation factor to be at least 2.5% but less than 3% (s 7(3)).
  • If indexation is a rate explicitly set by the governing rules, determine that rate and identify which range in Schedule 2 includes it; take the indexation factor to be that range (s 7(4)).
  • If indexation is more than 8%, take the indexation factor to be 8% (s 7(5)).

• If discretionary (s 8):

  • Obtain the indexation factors determined for the person’s income stream, or for a class that includes it, for the five years immediately preceding the relevant year (s 8(2)-(3)).
  • Calculate the arithmetic average by summing those five annual indexation factors and dividing by five (s 8(3)).
  • Map the resulting average into the Schedule 2 range that “includes the average” (s 8(4)).
  • If the fund has existed or made payments to the person for less than five years, take the indexation factor to be at least 2.5% but less than 3% (s 8(5)).
  • If any annual indexation exceeds 8% or the average exceeds 8%, cap the indexation factor at 8% (s 8(6)).

Notes on calculation: The Determination explicitly uses simple arithmetic averaging (sum/5). The instrument does not prescribe rounding rules for averages that fall exactly on range boundaries; practitioners should document the method used and be prepared to justify it if questioned.

5. Determine age input

• Compute the person’s age on the person’s next birthday following the beginning of the relevant year, as required by s 6(a). Use that age to select the appropriate age band row in Schedule 2.

6. Look up the pension valuation factor in Schedule 2

• Use the age band and the column corresponding to the indexation factor range to identify the numeric pension valuation factor (s 6; Schedule 2). That numeric factor is the value that applies for the purposes of section 1120 of the Act.

7. Record-keeping and evidence

• Maintain contemporaneous documentary evidence of:
  • The fund’s governing rules showing the mechanism of indexation.
  • Trustee minutes or determinations where discretion was exercised, including the annual indexation factors used as inputs for the five-year average (s 8(2)).
  • Calculations used to derive the five-year average and whether the 8% cap was applied.
  • Date calculations proving the person’s age on next birthday following the relevant year start (s 6(a)).
• Given the absence of statutory evidence rules in this Determination, record-keeping is essential to respond to departmental requests or disputes.

8. Provide information to the department when requested

• On request from departmental decision-makers applying s 1120, supply the governing rules, trustee determinations, and calculations that substantiate the chosen indexation factor. The Determination prescribes the mapping; the department will rely on trustees’ records to apply it.

9. Anticipate disputes and document choices

• Where there is genuine factual ambiguity about whether indexation is discretionary, document the legal basis for your view, reference the governing rules, and record trustee practice. Because the Determination defines non-discretionary as “otherwise than” s 8(1) (s 7(6)), careful drafting and minutes will reduce contestability.

10. Transitional and substitution considerations

• The instrument replaced the 1998 Determination (Schedule 1). If a matter straddles the repeal and commencement dates, confirm which Determination applies to that relevant year; the instrument’s commencement provision (s 2) states the whole instrument commenced the day after registration.

In practice, compliance is a combination of legal analysis (classifying indexation), arithmetic (averaging and mapping), and administration (record-keeping and timely evidence provision). The Determination gives prescriptive steps but leaves factual determinations and evidence-gathering to funds and to the department, so thorough documentation is the most reliable compliance action.
