• Assemble evidence that the trust’s "sole or dominant purpose" is one of the limbs in s 6(2)(a)-(c): receiving/distributing property transferred by a government body for a community purpose; holding/managing/disposing of indigenous‑held land for a community purpose; or receiving/managing/distributing income from indigenous‑held land applied for community purpose.
• Evidence can include the trust deed’s objects clause, minutes of trustee meetings, annual reports, distribution records, and descriptions of beneficiaries showing the community primarily intended to benefit.
• Because "community purpose" is defined as "a purpose that is intended to benefit primarily the members of a particular community or group" (s 4), records should explain who the community or group is and how the benefit is directed to them.

5. Trace interposed entities

• Where a government body transfers property "through an interposed entity" (s 6(2)(a)), document the chain of transfer and the relationship between the government body and the intermediary.
• Keep contracts, deeds, funding agreements, or grant letters evidencing that the ultimate source was a government body.

6. Record‑keeping and proof

• Keep originals or certified copies of trust deeds, transfer instruments, grant letters, settlement statements, minutes, distribution records, financial statements and tax returns that substantiate the trust’s activities and receipts.
• Maintain a dated audit trail for any deed variations, property transfers, or changes in beneficiary class.

7. Check Schedules and legislative currency

• Section 5 confirms the instrument can amend or repeal other instruments via Schedules. Inspect the Schedules attached to the instrument and consult the legislative instrument register for any later amendments that might affect the instrument’s operation.
• Do not rely on column 3 of the commencement table for legal content; s 2(2) says that column is not part of the instrument.

8. Where ambiguity exists, document reasons for classification

• If a trust’s status depends on a contested point,eg whether an event was a deed variation, whether a benefit is "primarily" for a community, or whether a transfer was income,record the trustee’s reasoning, legal advice received, and factual basis for the decision. That evidence will be material to administrative review or disputes.

9. Plan actions that could jeopardise exclusion

• If maintaining excluded status under s 7 is desired, avoid post‑reference deed variations and avoid accepting capital transfers after the reference time. If either is necessary, seek legal advice about the consequences for excluded status and any remediation steps.

10. When in doubt, obtain written advice and preserve contemporaneous records

• Because the instrument’s consequences derive from how s 1207P of the Social Security Act is applied, obtain advice that links the instrument’s classification to the practical effects under s 1207P.
• Preserve evidence in readily retrievable form to support administrative review or audit queries.

Following the steps above will place trustees in a position to demonstrate objectively that a trust meets the textually specified criteria of the instrument. The instrument does not create procedural steps for seeking an administrative declaration; it is therefore prudent to maintain comprehensive records so that any decision maker applying s 1207P can verify the trust’s status against the instrument’s express criteria.
