What it does
This legislative instrument varies the per-kilometre fares allowance payable under the Social Security Act 1991 by tying the monetary rate to the Australian Taxation Office cents‑per‑kilometre rate for cars that is set by a separate tax legislative instrument. Concretely:
- Section 4 changes the amount referred to in subsection 1061ZAAK(3) of the Social Security Act 1991 to be "the rate of cents per kilometre for cars for an income year determined, from time to time, by legislative instrument under subsection 28‑25(4) of the Income Tax Assessment Act 1997" (that is, the ATO cents‑per‑kilometre rate for cars).
- Section 5 replaces the table in subsection 1061ZAAK(4) of the Social Security Act 1991 so that the rate for "All private vehicles (excluding taxis)" is the same ATO‑determined cents‑per‑kilometre for cars referenced in s 4.
The instrument commences, in whole, the day after it is registered (section 2, table). It is made under the delegated power in subsection 1061ZAAK(8) of the Social Security Act 1991 (section 3). A final editorial note states the document name was amended on registration to include the year, under section 12 of the Legislation Rules 2026.
Mechanically, the instrument removes a locally set monetary figure from the Social Security fares allowance provisions and replaces it with a cross‑reference to the ATO's per‑kilometre rate as determined under the Income Tax Assessment Act 1997. The instrument does not change eligibility criteria, entitlements, recordkeeping, or procedural rules contained in the Social Security Act; it changes only the monetary rate terms that are referred to in the Act (see ss 4-5).
