Social Security (Exempt Lump Sum - Market-linked Income Stream) Determination 2017

This instrument (Social Security (Exempt Lump Sum - Market‑linked Income Stream) Determination 2017) declares that certain residual payments from a specified class of income streams are to be treated as an "exempt lump sum" for the limited statutory purpose set out in paragraph 8(11)(d) of the Social Security Act 1991. The instrument is short and narrowly framed. It (a) defines the kinds of payments covered, (b) links eligibility to an external regulatory requirement in the Superannuation Industry (Supervision) Regulations 1994, and (c) confines the legal effect to the single statutory head of power relied on (paragraph 8(11)(d) of the Act). The operative provision is clause 6: if a person is a beneficiary of a market‑linked income stream, a residual balance exists after payment of the final year's annual payment, clause 3 of Schedule 6 of the SIS Regulations requires the residual to be paid to the beneficiary within 28 days of the stream's term ending, and the person is in receipt of a social security payment, then any amount paid in accordance with that SIS requirement is an exempt lump sum for the purposes specified (s 6).

The instrument commences the day after registration, with the table indicating 24 January 2017 as the relevant date (s 2(1) and the commencement table). It was made under paragraph 8(11)(d) of the Social Security Act 1991 (s 3) and revokes the earlier Social Security Exempt Lump Sum Determination No. 7 of 2004 (FACS) (s 4). Definitions included are limited: "Act" (the Social Security Act 1991), "market‑linked income stream" (an asset‑test exempt income stream which meets the requirements of subsection 9BA(1) of the Act), and "social security payment" (having the same meaning as in the Act) (s 5). The instrument itself contains no penalties, no administrative procedures, and no explanatory policy material; it performs a single legal characterisation function, cross‑referencing the Act and the SIS Regulations (s 6).

Mechanically, the instrument converts a payment that meets its four conditions into an exempt lump sum, but only "for the purposes of paragraph 8(11)(d) of the Act" (s 6). The instrument does not, on its face, alter the SIS Regulations, the Social Security Act, or the obligations of superannuation trustees beyond confirming how those trustees’ payments should be characterised for the specified social security purpose. The instrument is subordinate legislation produced by a delegate of the Secretary of the Department of Social Services (instrument header).

The instrument is built around a small set of defined or referenced concepts. The operative definitions and cross‑references determine its reach.

• Market‑linked income stream. Defined by reference: "market‑linked income stream means an asset‑test exempt income stream which meets the requirements of subsection 9BA(1) of the Social Security Act 1991" (s 5). The instrument therefore relies on the Act's definition/criteria in s 9BA(1) to identify the class of income streams it will treat. The determination does not restate or expand s 9BA(1); it imports that statutory standard and treats a stream that meets it as a "market‑linked income stream" for the instrument's purposes.

• Beneficiary. The instrument uses the ordinary legislative term "beneficiary of a market‑linked income stream" (s 6(a)). The instrument does not define "beneficiary", so the reader must look to the Act, the income stream contract, or the SIS Regulations to determine who is a beneficiary in any given case.

• Residual balance and final year's annual payment. Clause 6(b) triggers when, "after the payment of the final year's annual payment from that market‑linked income stream there is a residual balance in the relevant account." The term "residual balance" is not separately defined; the identification of that balance is a factual and contractual matter in relation to an income stream. The instrument therefore applies to payments representing a residual balance that remains once scheduled annual payments have completed.

• SIS Regulations linkage. Clause 6(c) requires that clause 3 of Schedule 6 of the Superannuation Industry (Supervision) Regulations 1994 "requires that the residual balance in the account of the market‑linked income stream is to be paid to the beneficiary within 28 days of the end of the market‑linked income stream's term." The instrument does not create the 28‑day requirement; it takes the existence of that SIS Regulatory requirement as a precondition for the exemption. If the SIS Regulations impose a different timing or method, the clause will not be satisfied.

• Social security payment. Clause 6(d) requires that "the person is in receipt of a social security payment" at the relevant time. The instrument imports the Social Security Act's definition of that term (s 5), so whether a particular payment qualifies depends on how the Act defines and administratively treats "social security payment".

• Purpose limitation. The exempt status is expressly limited to "the purposes of paragraph 8(11)(d) of the Act" (s 6 last line). The instrument does not purport to make the payment exempt for other Commonwealth statutes, tax law, or other regulatory regimes.

This instrument affects a small, defined set of actors by specifying how particular residual payments are to be characterised for one social security purpose. The principal affected parties are:

• Beneficiaries of market‑linked income streams. Clause 6(a) requires that the person be a beneficiary of a market‑linked income stream. Beneficiaries who are in receipt of a social security payment at the time the residual payment is made are directly affected because the instrument causes the payment to be treated as an exempt lump sum for the specified statutory purpose (s 6). Whether a person qualifies as a beneficiary must be determined under the income stream documentation and the scope of the imported s 9BA(1) of the Act.

• Providers and trustees of market‑linked income streams. Trustees and providers who manage the income stream accounts and make the residual payments are practically implicated. Clause 6(c) predicates the exemption on clause 3 of Schedule 6 of the SIS Regulations requiring the trustee to pay the residual balance to the beneficiary within 28 days of the income stream’s term ending. Trustees therefore need to be aware that if and when they make such a residual payment in accordance with the SIS requirement, that payment will be treated, for the relevant social security purpose, as an exempt lump sum (s 6).

• Recipients of social security payments and administrators of those payments. The Department of Social Services and other administering agencies that apply paragraph 8(11)(d) of the Act will use this instrument as the legal basis for treating qualifying residual payments as exempt lump sums when performing eligibility or means testing under the Act. The instrument constrains the administrative characterisation of such payments for social security purposes.

• Parties with competing legal interests in residual balances. Any person or entity with a legal claim to a residual balance may be affected indirectly because the instrument sets out the conditions in which the residual payment to a beneficiary will be characterised as exempt for the relevant social security purpose. The instrument does not change who is entitled to the residual; it only changes the statutory characterisation of the payment once made to a qualifying beneficiary.

• Legal and compliance advisers. Lawyers and compliance staff for superannuation funds, financial advisers marketing market‑linked income streams, and social security law practitioners will need to check eligibility and timing conditions (beneficiary status, residual existence, the 28‑day SIS requirement, and concurrent receipt of a social security payment) before concluding the exemption applies.

The instrument does not create freestanding positive duties or criminal sanctions. Instead it creates a statutory characterisation that produces administrative rights and obligations in other laws, by reference. The principal operational duties and rights that follow from the instrument are:

• Duty on trustees to follow SIS Regulations. Clause 6(c) expressly conditions the exemption on clause 3 of Schedule 6 of the SIS Regulations requiring payment of residual balances to beneficiaries within 28 days of the end of the market‑linked income stream's term. That SIS regulatory requirement is external to this instrument, but the instrument effectively ties the availability of the exemption to compliance with that regulatory duty. Trustees therefore remain subject to the SIS obligation; the instrument does not substitute or change trustee obligations under SIS, but compliance with those obligations is a precondition for the exemption under the Social Security Act provision invoked.

• Right of a beneficiary (for social security purposes) to have a qualifying residual treated as an exempt lump sum. If all the conditions in s 6 are satisfied, the beneficiary obtains the legal right, against the Department administering paragraph 8(11)(d) of the Act,to have that amount treated as an exempt lump sum for the purposes of that paragraph. The instrument does not itself specify entitlements beyond this characterisation; any downstream entitlements or consequences flow from paragraph 8(11)(d) of the Act.

• Implied administrative duty to verify conditions. The Department of Social Services (and decision makers applying paragraph 8(11)(d) of the Act) will need to verify the four conditions set out in s 6 when deciding whether the payment is an exempt lump sum for the statutory purpose. Verifying beneficiary status, existence of a residual balance after the final year's payment, compliance with the SIS 28‑day requirement, and whether the recipient is in receipt of a social security payment necessarily involves examining superannuation documentation and social security records. The instrument does not prescribe evidentiary standards or processes, but administrative decision‑makers must apply the conditions.

• Interaction with other statutory rights and duties. The instrument is explicit that the exemption is "for the purposes of paragraph 8(11)(d) of the Act" (s 6). It therefore grants a narrowly focused right tied to the operation of that paragraph and does not, by its terms, create rights or alter duties under other Commonwealth statutes. Parties seeking to rely on the instrument in other contexts should first confirm whether those contexts refer to the same statutory provision or otherwise adopt its characterisation.

The determination itself contains no penalty provisions, compliance sanctions, or specified enforcement pathways. It is a declaratory subordinate instrument that characterises certain payments as "exempt lump sums" for a particular statutory purpose (s 6). Enforcement and penalties, if any, therefore arise from the statutory and regulatory regimes the instrument references rather than from the instrument itself.

Relevant enforcement points based on the instrument’s structure are:

• Enforcement under the Social Security Act 1991. The instrument was made under paragraph 8(11)(d) of the Act (s 3) and directs a particular characterisation for the purposes of that paragraph (s 6). Any penalties or remedial consequences connected to incorrect claims of exempt lump sums, or to fraudulent representations to obtain social security payments, will be governed by the enforcement provisions of the Social Security Act and its administrative procedures. The instrument does not create new offences; it creates a basis for officials to accept or reject claimants’ assertions in performing their existing statutory functions.

• Enforcement under the SIS Regulations. Clause 6(c) requires that clause 3 of Schedule 6 of the Superannuation Industry (Supervision) Regulations 1994 "requires" the residual to be paid within 28 days. The duty to make that payment on trustees is imposed by the SIS Regulations, not this determination. Any trustee non‑compliance with that SIS obligation will be enforced under the SIS regime, which may include supervisory action by the Australian Prudential Regulation Authority (APRA) or other regulatory sanctions under superannuation law. The instrument presumes the SIS duty exists and makes the exemption contingent upon its operation.

• Administrative review. The instrument will be relied upon by Departmental decision‑makers when applying paragraph 8(11)(d). A beneficiary or trustee who disagrees with an administrative decision based on this instrument would need to use the administrative review and merits review channels available under the Social Security Act and related administrative law, not a remedy within the instrument itself.

• No criminal penalties in the instrument. There is no provision within this instrument that imposes criminal liability or civil penalties for mischaracterising a payment. Any consequences for misstatement, fraud, or failure to meet eligibility conditions are matters for the Act’s enforcement framework.

The instrument is explicitly cross‑referential and therefore interacts with at least two external statutory/regulatory instruments: the Social Security Act 1991 and the Superannuation Industry (Supervision) Regulations 1994. The interactions are functional and conditional.

• Interaction with the Social Security Act 1991. The instrument is made under paragraph 8(11)(d) of the Act (s 3) and expressly limits the legal effect of the declared exemption to "the purposes of paragraph 8(11)(d) of the Act" (s 6). It therefore operates as subordinate legislation that modifies how a particular payment is to be treated for administration under that paragraph of the Act. The instrument imports the Act’s definition of "social security payment" (s 5). It also imports, by reference for the definition of "market‑linked income stream", the Act’s subsection 9BA(1) (s 5). Consequently, any change to the Act’s definitions, to paragraph 8(11)(d), or to s 9BA(1) may alter which income streams and which payments fall within the instrument’s scope.

• Interaction with the SIS Regulations. Clause 6(c) conditions the exemption on clause 3 of Schedule 6 of the Superannuation Industry (Supervision) Regulations 1994 requiring payment of residual balances to beneficiaries within 28 days of the income stream’s term ending. This instrument therefore depends on the existence and content of that SIS Regulation clause. If the SIS Regulations are amended, or if clause 3 operates differently in practice, the availability of the exemption under this determination may be affected. The instrument does not alter the SIS Regulations; it simply uses them as a conditional predicate for the exemption.

• No express interaction with taxation law or other Commonwealth laws. The determination does not purport to affect taxation treatment or other Commonwealth statutory regimes. It is expressly limited to the Social Security Act purpose in paragraph 8(11)(d). That means, for example, that the instrument does not itself bind or alter revenue law treatment of the same payment, and it does not amend the SIS Regulations or the Act. Parties should not assume the exemption applies beyond the specified social security purpose without checking the relevant statute or regulation.

• Revocation of prior instrument. Section 4 revokes the Social Security Exempt Lump Sum Determination No. 7 of 2004 (FACS). That revocation affects the relationship between the old instrument and current law: where the earlier instrument dealt with similar or overlapping issues, this instrument now provides the controlling departmental declaration. Any legacy interactions or transitional treatments under the 2004 instrument are no longer in force; the relevant interactions now must be interpreted against this 2017 determination and the primary statutes/regulations.

The instrument is short and contains only two explicit historical details.

• Commencement. Section 2 and the commencement table show that "the whole of this instrument" commences "the day after this instrument is registered" and the published table records the date 24 January 2017 in Column 3 (s 2(1) and the table). Section 2(2) qualifies that any information in column 3 is not part of the instrument; it may be edited in published versions. Technically, therefore, the instrument’s operative commencement is the day after registration as recorded in the formal table, but the Column 3 note is not itself a substantive part of the instrument.

• Revocation of earlier determination. Section 4 expressly revokes "Social Security Exempt Lump Sum Determination No. 7 of 2004 (FACS)". There are no transitional provisions or savings clauses included in the instrument. No other amendments, schedules, or subsequent revocation dates are included in the text supplied.

No later amendments, modifications, or statutory replacements are recorded in the instrument as presented. The instrument itself states that the commencement table "relates only to the provisions of this instrument as originally made" and "will not be amended to deal with any later amendments of this instrument" (s 2 note). That language indicates the published commencement metadata is a historic record rather than an operative clause to be treated as substantive law.

Because the instrument depends on external statutory provisions (the Social Security Act and the SIS Regulations), its effective scope may be altered by later amendments to those external instruments. The instrument contains no mechanism to update its imported references automatically; any change to the imported statutory provisions will affect how the instrument operates in practice but will not alter the instrument’s text unless the instrument itself is amended or revoked.

In short, the instrument replaced a 2004 determination and came into effect the day after registration in January 2017, and there are no further amendments recorded within the text provided.

The instrument text supplied contains no litigation history. It names no court decisions, and it does not reference any judicial interpretation or precedent. Because the instrument is a departmental determination made under paragraph 8(11)(d) of the Social Security Act 1991, any judicial engagement with it would arise from disputes over the Secretary’s or the Department’s application of paragraph 8(11)(d) where the instrument is invoked. Such litigation, if it exists, is not referenced in the instrument and therefore is outside the scope of the source material provided.

Practitioners seeking to know whether courts have considered the operative interplay of this determination with paragraph 8(11)(d), or whether there have been challenges to the interpretation of "market‑linked income stream" in s 9BA(1) of the Act or to the SIS Schedule 6 clause 3 requirement, will need to search case law and administrative decisions externally. The instrument itself supplies no guidance about precedent, appeals, merits review, or judicial outcomes.

The instrument does, however, provide the precise language that would be the subject of any judicial review: the four conditions in s 6, the importation of s 9BA(1) for the "market‑linked income stream" definition (s 5), and the limitation of the exemption "for the purposes of paragraph 8(11)(d) of the Act" (s 6). Any litigation would necessarily turn on interpretation of those clauses and on the related facts (e.g., whether the residual payment was made in accordance with the SIS requirement, and whether the recipient was "in receipt of a social security payment" at the relevant time).

Because the instrument revokes an earlier 2004 determination (s 4), litigation addressing the earlier instrument's operation might be informative contextually, but it is not documented in the instrument text. Practitioners should search administrative law and social security case databases for decisions applying paragraph 8(11)(d) and s 9BA(1) if they require precedential guidance beyond the determination’s text.

This instrument’s narrow scope and multiple external references create several practical traps and points of legal vulnerability that advisers and administrators should note. These are concrete, source‑based issues arising from the instrument’s wording.

• The exemption is limited to "the purposes of paragraph 8(11)(d) of the Act" (s 6). Do not assume the label "exempt lump sum" will carry across to tax law, family law, bankruptcy, or other statutory regimes. The instrument’s legal effect is expressly confined to one paragraph of the Social Security Act.

• The instrument imports key definitions and requirements rather than defining them itself. "Market‑linked income stream" is defined by reference to subsection 9BA(1) of the Act (s 5). Whether a particular product qualifies therefore depends on the Act’s test in s 9BA(1), not on any description in the instrument. Changes to s 9BA(1) will change who qualifies under this determination overnight without amendment to the determination itself.

• Clause 6(c) conditions the exemption on the SIS Regulations' clause 3 of Schedule 6 requiring payment within 28 days. If the SIS Regulation is amended, replaced, or interpreted differently, the exemption may cease to be available. Trustees should not assume the 28‑day timing will always be present; they must monitor the SIS Regulations.

• The beneficiary must be "in receipt of a social security payment" when the residual is paid (s 6(d)). If the recipient is not actually receiving a social security payment at the time of the residual payment, the payment will not satisfy the instrument’s condition and thus will not be characterised as an exempt lump sum under this determination. Beneficiaries who stop receiving social security prior to the residual payment will not qualify under this instrument.

• The instrument applies only when a residual balance exists "after the payment of the final year’s annual payment from that market‑linked income stream" (s 6(b)). If the product or trustee treats the final year's payment differently, or the contract requires different treatment of balances, there may be factual disputes about whether a residual exists post the final yearly payment. The instrument does not define "final year's annual payment" or "residual balance",these will be fact‑sensitive questions.

• The instrument gives no procedural guidance. It does not specify what documentation or proof a beneficiary must tender, nor does it state how Departmental decision‑makers should ascertain compliance with the SIS clause or the beneficiary’s social security status. Administrative practice and evidential standards are therefore left to the Department’s ordinary processes under the Act.

Compliance under this determination requires coordination among trustees, beneficiaries, financial advisers, and Departmental decision‑makers. Because the instrument is declaratory and depends on external instruments, compliance focuses on ensuring the factual and documentary preconditions in s 6 are satisfied and demonstrable.

Steps trustees and providers should take

1. Confirm product classification under s 9BA(1). Trustees must determine whether the income stream they administer meets the requirements of subsection 9BA(1) of the Social Security Act 1991 so that it qualifies as a "market‑linked income stream" for the purposes of this determination (s 5). If uncertain, trustees should document the basis for the classification and obtain legal advice because the instrument depends on that classification.

2. Follow clause 3 of Schedule 6 SIS Regulations. Ensure residual balances are paid to beneficiaries within the 28‑day period specified in clause 3 of Schedule 6 of the SIS Regulations, where that obligation applies (s 6(c)). Trustees should document compliance with the 28‑day requirement, payment dates, account records, and trustee minutes, because timely payment is a precondition for the exemption.

3. Record the final year’s annual payment and residual balance. Trustees should maintain clear accounting showing the last scheduled annual payment and any remaining residual balance after that payment, so it is evident when the residual arises (s 6(b)). This avoids factual disputes about whether a residual balance existed after the final year's payment.

4. Provide beneficiary evidence. Trustees should be prepared to provide beneficiaries with written confirmation of their beneficiary status, the amount and date of the residual payment, and evidence that the payment was made in accordance with SIS Schedule 6 clause 3. Such documentation will help beneficiaries demonstrate they meet the instrument’s conditions to the Department (s 6(a), (b), (c)).

Steps beneficiaries and advisers should take

1. Verify social security status at time of payment. The instrument requires that the person be "in receipt of a social security payment" when the residual is paid (s 6(d)). Beneficiaries seeking the exempt treatment should ensure their social security payment is active at that point, or otherwise be prepared to show they were in receipt at the time the residual was paid.

2. Obtain contemporaneous documentation. Beneficiaries should obtain from the trustee a written statement confirming the residual payment amount and date, confirmation that the payment was made in accordance with clause 3 of Schedule 6 of the SIS Regulations (including timing within 28 days), and confirmation of beneficiary status. That evidence will be needed to support claims under paragraph 8(11)(d) of the Act as applied by the Department (s 6).
