Social Security (Class of Visas – Newly Arrived Resident’s Waiting Period for Carer Payment) Determination 2018

The Determination works through a few discrete statutory concepts. First, the instrument is a statutory determination made under a specific subsection of the Social Security Act 1991. Section 3 states that the Determination is issued "under subsection 201AA(5B) of the Social Security Act 1991." The drafting technique is straightforward: the parent Act gives the power to specify classes of visas for a particular provision, and this Determination exercises that power.

Second, the instrument uses the notion of "for the purposes of subsection 201AA(5)" of the Act. That phrase is the legal hook: the Determination does not stand alone, it operates only in relation to the statutory rule found at subsection 201AA(5) of the Social Security Act 1991. The Determination supplies the list of visa classes that are to be taken to be relevant under that statutory subsection. Section 4 is explicit: "For the purposes of subsection 201AA(5) of the Social Security Act 1991 the classes of visas are: (a) Subclass 116 (Carer); and (b) Subclass 836 (Carer)."

Third, the instrument adopts a plain enumeration approach rather than defining concepts by reference to other legislative instruments or criteria. It operates by naming particular subclass numbers and the label "Carer" in parentheses. There are no definitions, no operative schedules beyond those two items, and no cross‑references to other migration legislation within the Determination text itself.

Fourth, the compilation endnotes introduce secondary statutory concepts relevant to users of the Determination as a legal source. Endnote 1 explains the role of endnotes in compilations. Endnote 2 provides an abbreviation key for the compilation. Endnote 3 sets out the legislation history, including registration and commencement dates for the original instrument and the 2021 amendment. Endnote 4 provides an itemised amendment history at provision level, indicating that certain earlier provisions (for example, s 2 and s 5) have been repealed by later amendments or as a consequence of other Acts. The compilation notes also make the procedural point that uncommenced amendments are not shown in the compiled text and that the compiled law may be modified by other laws without changing the text shown in the compilation. That procedural machinery affects legal certainty because the compilation is a snapshot in time rather than a dynamic register of all possible legal modifications.

Fifth, the Determination is subordinate legislation that derives legal effect from the parent Act. The interplay between the scheduling function of this Determination and the substantive provisions of the Social Security Act 1991 is the core conceptual relationship: the Determination supplies data (visa subclasses) that the Act's formula uses to determine who is within scope of a waiting period regime. The Determination does not itself articulate the normative rules that flow from being within scope; those remain in the Act.

Finally, in descriptive terms, the instrument’s title and content identify it as linked to a "Newly Arrived Resident’s Waiting Period for Carer Payment." That phrase signals the policy area and the population of interest: newly arrived residents who may be assessed for a Carer Payment waiting period under the Social Security Act 1991. The instrument’s legal role is to decide which visa subclasses are treated as relevant for that statutory waiting period mechanism.

At the most immediate level, the Determination affects persons holding or claiming status under Subclass 116 (Carer) and Subclass 836 (Carer). Section 4 explicitly lists those two subclasses. Because the Determination operates "for the purposes of subsection 201AA(5) of the Social Security Act 1991," the persons whose administrative or legal status is determined by reference to subsection 201AA(5) will be affected when they hold one of those two visa subclasses.

The target population inferred from the instrument’s title and text are newly arrived residents facing the waiting period for Carer Payment. The instrument itself does not define "newly arrived resident" or the contours of the waiting period, however. It supplies which visa subclasses are to be treated as a class of visas under the Act’s relevant subsection. Consequently, applicants, prospective applicants and recipients of the Carer Payment whose residence or immigration status is contested or under verification will need to have particular regard to whether their visa is Subclass 116 or Subclass 836. For administrative decision‑makers charged with applying subsection 201AA(5), the Determination is the authoritative list they must consult to decide whether a person’s visa falls within the class specified by the Act.

Lawyers, migration advisers, advocates, accountants and compliance officers representing or advising clients on eligibility for Carer Payment in the newly arrived resident context are also directly affected. They will need to know whether a client holds one of the listed subclasses so they can determine how subsection 201AA(5) of the Social Security Act 1991 applies to that client. Similarly, agencies or officers who make determinations under the Social Security Act, or who administer payments, need to factor the Determination into their decision procedures because it designates which visa subclasses trigger the statutory treatment.

The Determination does not itself create obligations that affect other categories of visa holders. No other visa subclasses are listed, and the Determination does not purport to alter the status of other visas. That concentrated designation means the instrument directly affects only the relatively narrow set of persons on those two visa subclasses, and indirectly affects administrative processes and legal advice practice areas that deal with newly arrived resident waiting periods for Carer Payment.

Finally, the compilation metadata and amendment history will affect any stakeholder relying on the Determination as a source of law. The endnotes show that the instrument was first registered and commenced in late 2018, and subsequently amended in 2021. Anyone assessing the Determination’s current legal effect must verify the in‑force text and note that compilations may not reflect uncommenced amendments or external modifications. The endnotes themselves instruct users to consult the Legislation Register for uncommenced amendments and the series page for further details.

The Determination does not, by its text, impose procedural duties or create rights in the sense of conferring entitlements that are enforceable directly against the Commonwealth. It performs a classificatory role: it designates Subclass 116 and Subclass 836 as the "classes of visas" relevant to subsection 201AA(5) of the Social Security Act 1991 (s 4). The operative legal effect of that classification is realised only through the parent Act. In other words, the Determination supplies an input that the Social Security Act uses; the duties, rights and entitlements arise from the Act, not from the Determination itself.

Because the instrument is made under subsection 201AA(5B) of the Social Security Act 1991 (s 3), the power to make such a Determination is a statutory delegation from the Act. That delegation is a procedural point: the Act authorises the making of determinations of visa classes, which may alter who is subject to a statutory waiting period. The Determination therefore changes which persons will be affected by the duties and rights created in subsection 201AA(5) of the Act, but it does not itself spell out those duties or rights.

For practical purposes, the key "duty" for administrative decision‑makers is to consult this Determination when applying subsection 201AA(5). If a decision as to eligibility, waiting period application, or other administrative consequence depends on whether a person holds a class of visa specified in subsection 201AA(5), the decision maker must apply the Determination’s list. Likewise, the key "right" for holders of Subclass 116 and Subclass 836 is that their visa subclass is explicitly designated under the Determination for the purposes of the Act. Whether that designation produces a substantive entitlement, a delay, or a disqualification depends on subsection 201AA(5) itself.

The Determination also imposes an evidentiary implication for applicants and advisers: because the instrument designates particular subclasses, individuals who claim to be exempt from or subject to the waiting period must be able to demonstrate which subclass they hold. The Determination’s value as an evidentiary reference is that it is the legal instrument naming the visa subclasses relevant to the statutory provision.

Finally, the compilation and amendment notes set out procedural obligations on users of the legal text. The compilation warns that uncommenced amendments are not shown and that modifications by other laws may change operation without altering the compilation text. Practitioners therefore carry the duty to verify the in‑force status of both the Determination and the parent Act provisions before relying on the instrument in advice or litigation.

The Determination contains no penalty provisions and does not itself establish an enforcement mechanism. The three substantive sections in the text (name at s 1, authority at s 3, and the class list at s 4) do not create offences, sanctions, or regulatory obligations. The compilation endnotes similarly do not record any penalty or enforcement apparatus in the Determination itself.

Enforcement implications of the Determination therefore arise only indirectly through the Social Security Act 1991. The Determination is expressly made under subsection 201AA(5B) of that Act (s 3) and operates for the purposes of subsection 201AA(5) (s 4). Any consequences, including the imposition of financial liabilities, disqualification, or administrative recovery powers, would derive from the substantive provisions of the Social Security Act and the administrative frameworks established there. The Determination does not purport to alter or to create those enforcement powers; it merely specifies which visa subclasses the Act’s rules should treat as a given "class of visas."

Users of the Determination should therefore treat it as a classification instrument rather than an instrument that prescribes enforcement. If a decision under the Social Security Act leads to penalty, recovery, or other enforcement action, that action will rest on the Act and its enforcement sections. The Determination’s evidentiary and definitional role may, however, be material in any enforcement or review process. For example, whether a person is within scope of a waiting period that triggers suspension or recovery of payments will depend on the interaction between the Act’s enforcement provisions and the Determination’s list, but the Determination itself does not establish the enforcement rules.

The compilation notes make a procedural point relevant to enforcement and compliance: changes to the Determination may occur by amendment or modification, and compilations do not always reflect uncommenced amendments. Practitioners engaged in enforcement or defence should therefore confirm the in‑force text and any modifying instruments on the Legislation Register to avoid acting on an outdated classification that might undermine the legal basis for an administrative enforcement decision.

The Determination is expressly subordinate to the Social Security Act 1991 and operates only through the references to that Act. Section 3 states the statutory source of power: the instrument is "made under subsection 201AA(5B) of the Social Security Act 1991." Section 4 further specifies that its content is "for the purposes of subsection 201AA(5) of the Social Security Act 1991." Those explicit cross‑references define the Determination’s legal interaction with the parent Act: it supplies factual data, visa subclass identifiers, that the Act requires for its internal operation.

Beyond the parent Act, the compilation endnotes identify two other statutory frameworks that affect how the Determination is to be treated as a published and compiled legal instrument. Endnote 1 explains that the Legislation Act 2003 authorises First Parliamentary Counsel to make editorial and presentational changes when preparing compilations and that such editorial changes do not change the effect of the law. That provision means that the compiled text, together with its endnotes, forms the usable public source but may include presentational adjustments. Endnote 1 also discusses misdescribed amendments and sets out abbreviations used in the compilation context. These procedural statutory elements matter for legal practitioners because they indicate that a compilation is a curated representation of the in‑force instrument rather than the sole source of legal authority.

Endnote 3 (Legislation history) and Endnote 4 (Amendment history) record the Determination’s amendment path and show how subsequent instruments have modified the original. The compilation notes explicitly instruct users that uncommenced amendments are not shown in the text and that modifications by other laws may alter operation without changing the text in the compilation. Those procedural interactions mean that the Determination should be read in a legal environment where other Acts or instruments may affect its operation even if the compilation does not reflect those modifications.

The Determination interacts indirectly with migration law and visa classification regimes, because it selects visa subclass numbers as the operative identifiers. Although the Determination itself does not reference migration legislation, any changes in visa subclass numbering or migration policy would affect the Determination’s real‑world application. That potential interaction is not articulated in the Determination but follows from the instrument’s reliance on subclass numbers as the mechanism for legal identification.

Finally, because the Determination designates visa subclasses for purposes of the Social Security Act, it creates a cross‑system dependency between immigration status and social security eligibility. Any administrative action under migration law that alters a person’s subclass status will therefore interact with social security decision‑making that refers to subsection 201AA(5). The Determination is the legal bridge in that interaction by naming the relevant subclasses.

The compilation includes a discrete amendment history and legislative timeline in the endnotes. The original Determination was registered on 26 September 2018 (F2018L01347) and commenced on 1 October 2018, as recorded in Endnote 3. An amending Determination titled Social Security (Class of Visas ‑ Newly Arrived Resident's Waiting Period for Carer Payment) Amendment Determination 2021 was registered on 3 August 2021 (F2021L01066) and commenced on 4 August 2021 (Endnote 3). The compilation covering the instrument shows the text as amended and in force on 4 August 2021 and includes amendments up to F2021L01066, with a compilation registration date of 4 February 2022.

Endnote 4 provides a provision‑level amendment history. It indicates that certain provisions were affected as follows: "s 2..................... | rep LA s 48D" and "s 5..................... | rep F2021L01066." Those entries record that section 2 of the Determination was repealed by a provision of the Legislation Act (s 48D) and that section 5 was repealed by the 2021 amending Determination (F2021L01066). The main text of the compiled Determination contains sections 1, 3 and 4; the absence of sections 2 and 5 from the compiled text is consistent with the amendment history that shows those provisions have been repealed.

The compilation notes also carry standard procedural material about uncommenced amendments and modifications. They advise users that the effect of uncommenced amendments is not shown in the compiled text and that any modifications by another law do not amend the compilation’s text even though they affect operation. The endnotes instruct readers to consult the Legislation Register and the series page for information on uncommenced amendments and modifications.

Practitioners should therefore be attentive to two practical points from the amendment history. First, the instrument has been amended since its original registration, and the compiled text reflects those amendments to the point of the compilation date. Second, some provisions previously present in earlier versions of the Determination have been repealed, which explains why the compiled text contains only a small set of operative sections. A careful check of the Legislation Register and, if necessary, the original amending instruments will be required to reconstruct the full amendment history or to determine whether any subsequent uncommenced amendments or modifications have affected operation.

The compilation does not record any litigation history. The instrument itself contains no references to cases, and none are cited in the endnotes. The endnotes are limited to compilation, amendment and procedural information; they do not list court decisions, judicial reviews, or tribunal matters related to the Determination. Therefore, as far as this compilation discloses, there is no recorded litigation history attached to the Determination within the compiled material.

Absence of litigation entries in the compilation does not necessarily mean no legal challenges have occurred in any forum. The compilation is a statutory record of the instrument itself and its amendment history; it does not function as a comprehensive litigation database. Users who require assurance on the existence or non‑existence of litigation should conduct targeted searches of court and tribunal databases and the Legislation Register for references to disputes arising under subsection 201AA(5) of the Social Security Act 1991 or decisions that engage this Determination by name or by effect.

For practitioners advising clients on matters that could generate review or contestation, eligibility assessments under the waiting period regime, administrative errors about visa subclass status, or disputes over the application of the Social Security Act provisions, this Determination will typically be one of several documents relevant to judicial review or merits review. The Determination supplies a classification that will be relevant in legal argument about whether a person is within a statutory class; any litigation will turn on the substantive Social Security Act provisions together with administrative facts. The compiled text and its endnotes do not indicate any past litigation precedents that interpret this Determination.

Given the Determination’s narrow scope, litigation that directly challenges the Determination is likely to be procedural or declaratory in nature, for example challenging an administrative decision that relied on the Determination in applying subsection 201AA(5). The compiled material does not provide evidence of any such challenges. Practitioners should therefore treat the litigation history as blank in the compilation and undertake independent litigation searches where a client’s case hinges on potential judicial or tribunal scrutiny of the Determination’s application.

Several practical pitfalls arise from the Determination’s brevity and its role as a classificatory instrument.

1. Limited scope, but consequential effect. The Determination itself only names visa subclasses. It does not set the substantive waiting period rules. Because the legal consequence of being in a designated class flows from the Social Security Act 1991, practitioners must avoid treating the Determination as a standalone statement of entitlement or disqualification. The Determination’s s 4 simply lists Subclass 116 and Subclass 836 for the purposes of subsection 201AA(5). The substantive effect is determined by the Act.

2. Reliance on visa subclass numbering. The instrument identifies visa status by subclass numbers. Migration law and administrative practice may reclassify or rename visa categories over time. The Determination does not itself adapt to changes outside the Social Security Act framework. If migration law alters subclass numbering or migratory pathways, the Determination may not reflect those changes unless it is amended. The compilation endnotes emphasise that the compiled law operates as modified by other laws but that such modifications may not appear in the compilation text. Practitioners should verify current visa subclass nomenclature before relying on the Determination.

3. Repealed or absent provisions. The amendment history in Endnote 4 shows that some earlier provisions, such as s 2 and s 5, have been repealed. The compiled instrument contains only ss 1, 3 and 4. Users who expect additional procedural or interpretive text in the Determination should check the amendment history and prior versions. The absence of those provisions may be material where an administrative practice previously referenced parts of the earlier instrument.

4. Compilations are snapshots. The compilation covers the text as amended and in force on 4 August 2021 and indicates amendments up to F2021L01066. The endnotes warn that uncommenced amendments are not shown and that modifications by other laws may affect operation without changing the compiled text. Practitioners must therefore consult the Legislation Register and series page for up‑to‑date status and for any uncommenced amendments that might later come into force.

5. No procedural guidance. The Determination supplies no guidance on how the visa classification is to be evidenced, verified, or contested administratively. Decision‑makers will apply the parent Act’s administrative rules, but the Determination does not prescribe document standards, verification timelines, or review pathways. That absence may produce administrative uncertainty in cases where visa status is disputed or records are incomplete.

6. Narrow beneficiary population. Because only Subclass 116 and Subclass 836 are listed, only those visa holders are directly implicated by the Determination. Other visa holders who consider themselves in similar circumstances but hold other subclasses will not be covered by this Determination. Advisers should not assume coverage by analogy.

7. Interaction with external instruments. The Determination is a subordinate instrument under the Social Security Act. Any changes to the parent Act’s structure, or to the power to make determinations, could affect the Determination’s authority. The endnotes reference the Legislation Act’s role in editorial changes and misdescribed amendments; that procedural context matters in edge cases where drafting or registration errors are alleged.

8. Evidentiary reliance. Administrative decision‑makers are likely to use the Determination as the authoritative list. Applicants should therefore ensure they can produce evidence of their subclass status in any claim or review. The Determination does not itself set out the evidentiary standard, which remains a feature of the wider administrative framework.

9. No penalties or remedial text. The Determination contains no remedial or penalty provisions. Any dispute over consequences will be litigated or reviewed under the Social Security Act. Practitioners must therefore be careful to frame challenges in terms of the parent Act and not the Determination alone.

10. Compilation metadata matters. The compilation records registration dates, amendment instruments and the dates on which amendments commenced. Misreading those dates can produce reliance on provisions that were not yet in force at a relevant time. The endnotes instruct users to check commencement details, a frequent source of practical error.

Taken together, those "gotchas" flow directly from the instrument’s narrow, classificatory design and the procedural notes in the compilation. They translate into concrete tasks for advisers and administrators: verify subclass status, check in‑force text and amendment chronology, and avoid treating the Determination as a substitute for the Social Security Act’s substantive rules.

Compliance in relation to this Determination is largely a matter of accurate classification and documentary proof. Because the Determination names Subclass 116 (Carer) and Subclass 836 (Carer) as the classes of visas "for the purposes of subsection 201AA(5) of the Social Security Act 1991" (s 4), the primary compliance step for individuals and advisers is to establish whether the person’s visa is one of those subclasses.

Practical compliance steps include:

• Confirm visa subclass status. Verify that the client’s visa is specifically Subclass 116 or Subclass 836 by inspecting the visa grant notice, visa label, visa immi account entry or other official immigration documentation. The Determination operates by reference to subclass numbers; accurate identification is therefore essential.

• Retain documentary evidence. Keep copies of visa grant letters and any relevant migration documentation. Because the Determination does not specify evidentiary standards, decision‑makers under the Social Security Act will rely on recognisable immigration documents to apply subsection 201AA(5). Practitioners should assemble the standard visa evidence that an administrative decision maker would expect.

• Check the in‑force text and amendment status. Consult the Legislation Register and the series page to confirm that the Determination in use is the current, in‑force version. The compilation notes emphasise that uncommenced amendments and external modifications may not appear in the compiled text. Practitioners should verify whether any subsequent amendments or modifications have altered the list of relevant visa subclasses.

• Cross‑check timing and commencement dates. If an application or decision hinges on a particular date, confirm the Determination’s registration and commencement timeline in Endnote 3. The original Determination commenced on 1 October 2018 and an amending Determination commenced on 4 August 2021. Where timing is material to eligibility, ensure that the correct version of the Determination is applied.

• Integrate Determination checking into broader eligibility assessments. Because the Determination affects only the identification of visa classes for purposes of subsection 201AA(5), compliance requires also checking the substantive eligibility, waiting period and administrative rules in the Social Security Act 1991. The Determination does not relieve practitioners from that parallel task.

• Prepare for administrative challenge. If a decision maker disputes the visa subclass or refuses to accept supplied evidence, be ready to seek internal review or merits review under the Social Security Act procedures. The Determination will be a primary document in any argument about whether a person is within the class specified by subsection 201AA(5).

• Monitor migration law changes. Because visa subclass numbers and migration instruments may change, adopt a practice of periodic verification of visa subclass designations, particularly if advice is being given for future events or on the basis of migration pathways in flux.

• Document reliance. Where a person’s entitlement or waiting period position is materially affected by the Determination, record decisions or advice that relied on the Determination and the date on which the Determination and the parent Act were consulted. This record assists in any subsequent compliance audit or review.

• Seek specialist advice where necessary. The Determination’s operation is intertwined with the Social Security Act. If a client’s circumstances are complex, or if there is uncertainty about which version of the Determination or the Act applies, seek specialist social security or migration advice.

These steps follow necessarily from the Determination’s function as a list of visa subclasses (s 4) and from the compilation and amendment notes that highlight the need to verify in‑force status and any external modifications. The compliance burden imposed by this Determination is therefore primarily administrative and documentary rather than substantive or regulatory.
