What it does
The Snowy Hydro Legacy Fund Act 2018 creates a dedicated financial mechanism for channelling the proceeds from the New South Wales Government’s sale of its interest in Snowy Hydro Limited to the Commonwealth into infrastructure projects in regional NSW. The Act establishes, in Part 3, the Snowy Hydro Legacy Fund within the Special Deposits Account. Money may be paid into the Fund from three primary streams: appropriations by Parliament for the Fund’s purposes, appropriations for services used to fund approved regional infrastructure projects, and appropriations for general government purposes directed by the Treasurer into the Fund (s 9(1)(a)-(c)). Pre-commencement appropriations may also be paid in (s 9(2)). Payments out of the Fund cover the cost of approved regional infrastructure projects, administrative expenses related to the Fund, and any other amounts directed or authorised by law (s 10). The Treasurer may invest money in the Fund in accordance with Part 6 of the Government Sector Finance Act 2018 if the administering Minister is a GSF agency, or otherwise in a manner approved by the Treasurer (s 11).
The Act does not itself mandate that any particular infrastructure project be funded. Instead, it sets out a two-stage decision process. First, the Premier and the Minister for Regional New South Wales may jointly nominate an infrastructure project if they consider it will improve economic development in regional NSW and primarily benefit regional NSW (s 5(1)-(2)). A part of a larger project can be nominated if that part meets the criteria (s 5(3)). The nomination must be notified in writing to the Treasurer (s 5(4)). Second, the Treasurer must approve the nominated project before it becomes eligible for funding (s 6(1)). In deciding whether to approve, the Treasurer must take into account whether funding the project is consistent with the purpose of the Fund (s 6(2)), but subsection (3) explicitly states that this does not limit other matters the Treasurer may consider. Section 8(2) records Parliament’s intention that total payments from the Fund for approved projects will be equivalent to the value of the proceeds of the Snowy Hydro sale. That provision is aspirational rather than legally enforceable. The Act also requires the Treasurer to publish information annually detailing payments from the Fund in the previous financial year, in any form or manner the Treasurer determines (s 13). The Crown in right of NSW is bound by the Act (s 14), and the Governor may make regulations for carrying out the Act (s 15).
