#### 5 Minister may make determinations authorising payments (1) The Minister may make a determination authorising a payment of financial assistance under this Act to a State for a year for the purposes of the following: (a) capital expenditure for vocational education and training; (b) recurrent expenditure for vocational education and training. (2) A determination made under subsection (1) for a year must be consistent with the allocations made by the Ministerial Council under section 6 for that year. (3) A determination made under subsection (1) is not a legislative instrument.
