#### 30 Conditions of payment (1) A payment of financial assistance to a State or to another person for a year for a strategic national initiative is made on the following conditions: (a) the condition that the financial assistance be spent in accordance with guidelines determined by the Ministerial Council; (b) in the case of a payment to a State—the conditions specified in Part 2; (c) any other terms and conditions: (i) set out in a written agreement with the State or other person; or (ii) if there is not such an agreement—determined by the Minister for the purposes of that payment. (2) A determination made under paragraph (1)(a) or subparagraph (1)(c)(ii) is not a legislative instrument.
