Sheriff's Act 1978

The Act is structured around a small number of organising concepts that determine who has authority to act, at which places, and on what basis. Those concepts are defined and implemented across multiple sections, and control the permitted conduct of sheriff personnel, police acting under arrangement, and members of the public.

• Participating body and premises. The Act expands beyond court buildings, defining "participating body" to include participating courts under the Courts Administration Act 1993 and any person or body declared by regulation (s 4 definition). "Premises of a participating body" is broadly defined, expressly encompassing precincts, immediate environs, adjacent carparks and footpaths, laneways between or abutting premises, and any place at which a body is conducting a view or inspection for proceedings (s 4). The Act therefore extends security powers beyond the interior of courtrooms to defined external spaces.

• Security officer as a legal role. "Security officer" is a statutory class that includes the sheriff, deputy sheriffs, sheriff's officers appointed by the sheriff, and police officers authorised under arrangements to exercise those powers temporarily (s 4 definition). The sheriff may impose conditions on appointments and issue identity cards that specify any limitations (s 9B, s 9C).

• Restricted item. The Act defines a category of items that attract special rules (s 4). The list includes explosives and incendiary devices, items caught by the Summary Offences Act weapons provisions, firearms as defined by the Firearms Act 2015, items prohibited under the rules or directions of the participating body, and any other item reasonably capable of jeopardising security or the orderly conduct of proceedings. This definition is the pivot for search, surrender and seizure powers in Pt 3.

• Differentiated search regimes. The Act separates scanning searches (non-contact scanning devices) authorised for persons on or about to enter premises (s 9F(1)(a)(i)), physical searches authorised where a person is required by law to attend (s 9F(1)(c)), and searches where reasonable grounds exist to suspect the presence of a restricted item (s 9F(1)(d)). The Act imposes procedural protections on each kind of search (s 9F(2)-(4)) such as non-contact scanning, limits on removal of clothing, requirement for searches to be carried out by same-sex officer where practicable and with at least two persons present, and a requirement to avoid undue humiliation and to respect cultural and religious beliefs.

• Reasonable grounds and belief. Multiple powers are anchored to "reasonable grounds" or "reasonable directions" (s 9E(1)(a), s 9F(1)(d), s 9G(b)), and the Act provides protection where a security officer acts on a reasonable belief that a person is required by law to attend, so that conduct is not rendered unlawful solely because that belief turns out to be incorrect (s 9H). The statute therefore makes operational decisions depend partly on the officer's judged state of mind subject to objective reasonableness.

• Interaction with police powers. The Act incorporates police by permitting temporary authorisation to exercise security powers (s 9D), by allowing police to assist the sheriff and take on enforcement functions (s 9DA), and by providing for handover of detained persons to police as soon as reasonably practicable (s 9E(1)(b)(ii), s 9G(e), s 11(3)). These provisions create a operational interface with the South Australia Police while maintaining the sheriff's supervisory role under the Act.

• Limits on force and particular prohibitions. The Act repeatedly conditions uses of force to "only such force as is reasonably necessary" (s 9E(1)(b)(i), s 9F(5)(a)), sets constraints on invasive searches, forbids placing a spit hood on a person with a significant maximum penalty (s 9J), and requires prompt handover to police for persons arrested (s 11(3)). These are statutory constraints that guide operational conduct and create criminal liability for specified prohibited conduct.

• Delegation, immunity and Crown liability. Deputy sheriffs and temporary appointees may exercise the sheriff's powers in scope (s 6(5), s 7(3)), but the Act relieves individual sheriffs and officers from personal tort liability for acts in the course of their duties, routing civil claims to the Crown (s 12(1)-(3)). This shifts civil risk away from individual officers and onto the Crown.

These core concepts control the distribution of power across the sheriff, sheriff's officers, police acting under arrangement, and participating bodies, and they structure practical duties such as search and seizure, control of entry, detention and handover protocols.

The Act creates obligations and confers powers on a defined set of public officers, courts and categories of private persons. The primary affected groups are:

• The sheriff. The Act creates the office of sheriff, situates it within the Supreme Court framework and prescribes appointment, dismissal and duties (s 5, s 8, s 9). The sheriff is the statutory official responsible for executing process, carrying out duties under other Acts, and observing court directions (s 8).

• Deputy sheriffs and sheriff's officers. The sheriff may appoint deputy sheriffs and sheriff's officers, who assist the sheriff in carrying out duties (s 6). Deputy sheriffs carry full powers and immunities of the sheriff within the scope of their appointment but are subject to direction (s 6(5)). Persons appointed for particular matters under s 6(3) are not Public Service employees and have terms approved by the State Courts Administration Council (s 6(4)).

• Security officers. Security officers are a statutory category (s 4) that includes the sheriff, deputies, appointed sheriff's officers, and police temporarily authorised under arrangements. Security officers exercise the operational security, search and detention powers in Pt 3 (s 9B, s 9E-9G).

• South Australia Police. The Act contemplates two separate mechanisms for police involvement. First, police may be authorised under an arrangement to exercise powers of security officers on a temporary basis; in exercising those powers police are responsible to the sheriff and a sheriff's certificate is prima facie evidence of authorisation (s 9D). Second, the sheriff and officers may be assisted by police under s 9DA, and police assisting are taken to have the powers of the sheriff under the Enforcement of Judgments Act 1991 (s 9DA(1)-(2)). Police personnel therefore operate under both the sheriff’s operational control when authorised and under their own statutory powers when assisting.

• Participating bodies and their principal officers. The Act requires the sheriff to be responsible to the principal officer of each participating body for providing assistance to maintain security at the body's premises (s 9A). "Participating body" is broad, including participating courts as defined in the Courts Administration Act 1993 and any person or body declared by regulation (s 4). Principal officers are either judicial heads for participating courts or officers designated by regulation for other bodies (s 4).

• Court users and the public. Members of the public who enter or attempt to enter premises of participating bodies are affected by the Act’s directions, search and exclusion powers (s 9E, s 9F). People who are required by law to attend premises (e.g. by order, summons, subpoena, bail condition or custody) are subject to distinct powers including physical searches (s 4 definition of "required by law" and s 9F(1)(c)).

• Detained persons and defendants. Individuals brought in lawful custody, persons whose bail is revoked by a participating body, persons in custody who surrender themselves, and escapees on or near participating premises are all the subjects of special handling provisions (s 9E(1)(b)-(f), s 10). Arrested persons must be taken before the specified body as soon as reasonably practicable and may be detained until that happens (s 10).

• Persons dealing with goods. Those who possess restricted items face search and surrender powers (s 9G). Where items are surrendered or removed, security officers must hold restricted items in safe keeping while a person remains on the premises and hand items believed to be unlawfully held to police as soon as reasonably practicable (s 9G(h)).

• Regulatory actors and fee payers. The Governor and the State Courts Administration Council are engaged via regulation-making (s 16). The regulations may prescribe fees and expenses payable to the sheriff for execution of process and other duties, and those fees may vary according to value, class of matter, party and other bases and need not be related to actual administrative costs (s 16(4)(b), s 16(5)). Anyone served by sheriff processes or whose property is sold under process will be affected by those fees.

• Civil claimants and the Crown. Because the sheriff and officers have no personal tort liability for acts in the course of their duties and civil claims lie against the Crown, aggrieved private parties will ordinarily need to pursue the Crown rather than individual officers in tort claims (s 12(2)-(3)).

In short, the Act creates a security enforcement ecosystem centred on the sheriff, links police to sheriff duties by formal arrangements, extends search and exclusion powers to court precincts and other participating premises, and assigns civil risk to the Crown while allowing the Governor to regulate fees and operations.

The Act lists specific statutory duties for the sheriff and confers operational rights and limitations for security officers. For practitioners seeking practical application points, the key duties and rights are:

• Duties of the sheriff. The sheriff must execute or cause the execution of all process, civil or criminal, directed by a court, perform duties imposed by another Act, and observe and carry out court directions (s 8). The sheriff must attend criminal sittings or cause an officer to attend, and at the court's request attend other sittings (s 9(1)-(2)). The sheriff is responsible to the principal officer of participating bodies for providing assistance in maintenance of security and order at premises (s 9A).

• Appointment and supervisory duties. The sheriff controls appointment and conditions of sheriff's officers and may appoint officers as security officers subject to conditions. The sheriff may vary or revoke conditions and revoke appointments (s 9B). Security officers must be issued an identity card in a form approved by the Administrator, with required particulars and statements of limitations where a condition narrows the powers (s 9C(1)-(2)).

• General security powers. Security officers may give reasonable directions to persons on premises for security or orderly conduct (s 9E(1)(a)). If a person refuses to comply, or behaves unlawfully on the premises, a security officer may refuse entry or remove the person using only reasonably necessary force, or detain and hand the person over to a police officer as soon as reasonably practicable (s 9E(1)(b)). Security officers have powers to assist with the movement of persons in lawful custody to or from premises, to take into custody persons whose bail has been revoked by the participating body, and to keep in custody persons in lawful custody or who surrender themselves into custody (s 9E(1)(c)-(e)). Security officers may arrest without warrant persons who escape custody, or appear to have escaped while on or being brought to/from premises (s 9E(1)(f)). At the direction of the participating body, officers may restrain persons appearing before the body to maintain order (s 9E(1)(g)).

• Search powers and limits. Security officers may require persons entering premises to submit to scanning-device searches for restricted items or for possessions (s 9F(1)(a)). Persons required by law to attend may be required to submit to physical searches and take anything necessary for that search (s 9F(1)(c)). Where reasonable grounds exist to suspect a restricted item on a person, the officer may require production or submit the person to a physical search (s 9F(1)(d)). The legislation imposes procedural limits: scanning must be non-contact (s 9F(2)(a)); a person cannot be required to remove inner clothing or underwear, nothing may be introduced into an orifice, and searches must be carried out expeditiously and without undue humiliation and, as far as reasonably practicable, consistent with cultural or religious beliefs (s 9F(2)(c), s 9F(4)(b), (d)). Physical searches must be conducted by same-sex officers and with at least two persons present except where not practicable (s 9F(4)(c)).

• Requirements to produce status information. Where proceedings are not open or certain persons are not entitled to attend, security officers may require persons to provide information reasonably required to determine entitlement, and may refuse or remove persons who refuse or who are not entitled (s 9E(1)(h)).

• Handling of restricted and unlawful items. If an officer finds a restricted item or an item believed to be unlawfully possessed, the officer may refuse entry, remove the person, detain and hand the person and item to police, require surrender of the item and, where the person is required by law to attend, apply reasonable force to remove the item (s 9G(d)-(g)). Surrendered restricted items must be held in safe keeping while the person is on the premises and items believed unlawfully possessed must be handed to police promptly, together with relevant information (s 9G(h)(i)-(ii)).

• Arrest procedure. Persons arrested by the sheriff or officers pursuant to a process issued by a participating body must be brought before the specified body as soon as reasonably practicable and may be detained until that happens (s 10).

• Prohibitions and statutory offences. The Act criminalises refusal to comply with a security officer's direction (s 9E(2), penalty stated), hindering or obstructing the sheriff or assisting persons (s 11(1)), and false representation as an officer (s 11(5)). The Act expressly prohibits security officers using spit hoods on persons, with a maximum penalty of two years imprisonment (s 9J(1)-(2)).

• Rights relating to belief and error. Section 9H protects security officers who act on a reasonable belief that a person is required by law to attend, by providing that actions taken in the exercise or purported exercise of powers are not rendered unlawful merely because the person is not in fact required to attend. Section 9I clarifies that lawful refusal of entry or removal under this Part is not an excuse for non-compliance with statutory requirements to attend (s 9I).

• Identification and return of identity cards. Security officers must carry identity cards, produce them on request, and return them to the sheriff if they cease to be security officers; failing to return is a penalty offence (s 9C(1), (3)-(4)).

• Immunity and liability. The sheriff and officers incur no personal tort liability for acts or omissions in course of duties; that liability lies with the Crown (s 12(1)-(3)). This affects both operational decision-making and civil redress.

These duties and rights create a detailed, statute-backed operational framework, allocating both authority and procedural limits and embedding safeguards for conduct that might otherwise be intrusive or involve use of force.

The Act sets out specific penalties for breaches by members of the public and prescribes enforcement processes for the sheriff and sheriff's officers. The statutory regime combines summary criminal penalties, detention and handover powers, and civil liability routing.

• Criminal penalties and maximums. The Act specifies maximum penalties for several offences. A person who refuses to comply with a direction of a security officer is guilty of an offence, with a maximum penalty of $2,500 or imprisonment for 6 months (s 9E(2)). Hindering or obstructing the sheriff, deputy sheriff, sheriff's officer or a person assisting them is also an offence attracting a maximum penalty of $2,500 or 6 months imprisonment (s 11(1)). Falsely representing oneself as the sheriff, deputy sheriff, sheriff's officer or security officer carries the same maximum penalty (s 11(5)). Failure to return an identity card after ceasing to be a security officer attracts a maximum penalty of $1,250 (s 9C(4)). The Act creates a distinct and severe prohibition on the use of spit hoods by security officers, punishable by up to two years imprisonment (s 9J(1), (2)).

• Arrest and detention powers. The sheriff, deputy sheriffs and sheriff's officers may arrest persons who commit offences under the Act, for example obstruction under s 11(1) or false representation under s 11(5), and must hand arrested persons over to police "as soon as reasonably practicable" (s 11(2)-(3)). Security officers may, without warrant, arrest a person who escapes from custody or appears to have escaped while on or being brought to/from participating premises (s 9E(1)(f)). The Act further allows detention on premises, including keeping in custody persons whose bail has been revoked by a participating body (s 9E(1)(d)-(e)), and to detain persons and hand them to police when they are in possession of items believed unlawfully possessed (s 9G(e)).

• Limits on use of force. Repeated statutory language qualifies uses of force, permitting only "such force as is reasonably necessary" for removal or taking custody (s 9E(1)(b)(i), s 9G(d)). Forcing open a person's mouth or removing anything from a person's mouth is limited to supervision by a registered medical practitioner (s 9F(5)(a)(ii)). These limits are part of the enforcement mechanism and frame admissible force.

• Procedural protections that affect enforcement. Searches must be expeditious, avoid undue humiliation and, as far as reasonably practicable, respect religious and cultural values (s 9F(2)(d), s 9F(4)(d)). Physical searches should involve two persons and officer of the same sex except where not practicable (s 9F(4)(c)). These protections may shape how enforcement is operationalised, including staffing and documentation requirements.

• Administrative sanctions via regulations. The Governor may make regulations providing for fines (not exceeding $2,500) for offences against regulations (s 16(4)(f)). Regulations can therefore create additional, lower-tier administrative penalties for breaches of regulatory rules governing sheriff activities.

• Evidence and proof mechanisms. A certificate of the sheriff purporting to certify that a specified police officer was authorised to exercise security officer powers constitutes proof, in the absence of proof to the contrary, of the matters so certified (s 9D(3)). This creates a statutory evidentiary mechanism that simplifies proving authorisation in legal proceedings, unless rebutted.

• Civil liability routing. The sheriff and officers incur no personal tort liability for acts in the course of duties under the Act, so civil claims in tort against those officers lie against the Crown (s 12(1)-(3)). Practically, injured parties must sue the Crown rather than individual officers, which affects the process for civil redress, limitations and indemnity arrangements.

• Interaction of criminal and civil enforcement. Where a security officer detains a person and handover to police is required, the Act requires handover as soon as reasonably practicable, creating a chain between immediate statutory enforcement by officers and formal criminal prosecution by police. The Act does not provide adjudicative processes for contested detentions beyond handing to police and the usual criminal justice processes.

Overall, enforcement under the Act is a mixture of on-the-spot enforcement powers for security officers, statutory constraints on force and intrusive measures, specified criminal penalties for non-compliance or impersonation, and Crown indemnity for officer conduct. These rules shape operational responses to incidents at participating premises and define the legal avenues for subsequent redress.

The Act repeatedly references, incorporates and preserves rights and powers under other statutes. Understanding these cross‑references is essential for operational and legal planning.

• Courts Administration Act 1993. Appointments of the sheriff and of deputy sheriffs and sheriff's officers are to be made under the Courts Administration Act 1993 (s 5(3), s 6(1)). The Act thus sits alongside the administrative framework for court staffing and the State Courts Administration Council.

• Summary Offences Act 1953 and Firearms Act 2015. The definition of "restricted item" incorporates weapons within the meaning of s 21A of the Summary Offences Act 1953 and firearms within the meaning of the Firearms Act 2015 (s 4 definition, paras (b) and (ba)). As those Acts evolve, the meaning of restricted items adjusts accordingly through these cross‑references.

• Enforcement of Judgments Act 1991. Police officers assisting under s 9DA are taken to have the powers of the sheriff under the Enforcement of Judgments Act 1991 (s 9DA(2)). This imports execution and enforcement powers used in civil enforcement into police conduct when assisting sheriff functions.

• Juries Act 1927. The Act incorporates attendance required by a summons under the Juries Act 1927 as a circumstance in which a person is "required by law to attend the premises of a participating body" (s 4(2)(d)). This matters because persons required by law to attend are subject to broader search powers (s 9F(1)(c)).

• Procedural and civil law. The Act’s immunity provisions mean that civil liability for wrongful or negligent acts of sheriffs and officers is determined under the ordinary law of torts, but subsection 12(2) displaces individual officer liability and routes claims to the Crown (s 12(1)-(3)). That creates interplay with general tort principles, the Crown Proceedings Act or equivalents, and with public law accountability mechanisms.

• Non-derogation clause. Section 15A states that nothing in the Act derogates from the powers of the sheriff or a participating body under any other Act or law. That clause preserves overlapping statutory powers and indicates that the Act is not exhaustive in displacing other legal powers.

• Regulations and fees. Section 16 allows regulations, generally on the recommendation of the State Courts Administration Council, to prescribe fees and expenses payable to the sheriff, to provide for safe keeping and disposal of items surrendered under the Act, and to regulate performance of duties of the sheriff and security officers (s 16(1)-(4)). Regulations may therefore interact with revenue and administrative law, and the Act explicitly permits fees that are not related to actual administrative cost (s 16(5)).

• Evidentiary certificate about authorisation. A certificate of the sheriff purporting to certify police authorisation under an arrangement is admissible as proof in the absence of contrary proof (s 9D(3)). This provision interacts with rules of evidence and administrative proof in prosecutions or civil proceedings about the lawfulness of acts by police exercising security officer powers.

• Spit hood prohibition supremacy. Section 9J(2) expressly provides that the spit hood prohibition applies despite any other provision of this Act or any other Act or law. This gives the prohibition a form of statutory primacy over other statutory powers that might be thought to permit such restraints.

• Interaction with criminal law. The Act authorises arrest without warrant in certain circumstances (s 9E(1)(f)) and sets offence provisions applicable to refusal to obey directions and obstruction (s 9E(2), s 11). These provisions interface with general criminal law, police powers of arrest and custody, and procedural rights in criminal prosecutions.

In practice, the Act builds on and interacts with the wider corpus of court administration, weapons/firearms regulation, enforcement law and police powers. The non‑derogation clause and explicit cross‑references mean practitioners must consider the Act in conjunction with the other statutes expressly cited and with the regulations the Governor may make under s 16.

The legislative history recorded in the Act shows layering of amendments since enactment, with particular attention to the security and courtroom-order regime introduced in 2000 and later regime additions:

• 1978, Sheriff's Act 1978 (No 82). The principal Act received assent on 30 November 1978. Although enacted in 1978, several provisions show later commencement dates in the reprint history.

• 1991, Sheriff's Act Amendment Act 1991 (No 81). Amendments effective from 6 July 1992 altered provisions including substitution of s 5 and s 6 (references in the history show s 5 and s 6 were substituted by 81/1991), and amendments to other sections (history notes s 4 redesignation and others). The 1991 Act effected restructuring of officer appointment provisions.

• 1995, Statutes Amendment (Courts Administration Staff) Act 1995 (No 85). This amendment (commencement 14 December 1995 for Pt 6 ss 13 & 14) amended s 5(3) and s 6(1), reflecting administrative changes for court staff and transitional arrangements.

• 1996, Statutes Amendment (Attorney-General's Portfolio) Act 1996 (No 67). Amendments (commencement 17 October 1996 for Pt 15) adjusted parts of the Act including s 4 and s 16.

• 2000, Statutes Amendment and Repeal (Security and Order at Courts and Other Places) Act 2000 (No 49). This is a key reform, with Pt 2 (ss 4-16) and schedule commencing 29 September 2000. It inserted Part 3 (Security and order at courts and other places) and introduced the concept of participating body, premises of participating bodies, security officer categories, search and detention powers, identifications, and administrative provisions. Numerous sections were inserted or re‑drafted in this reform.

• 2012, Summary Offences (Weapons) Amendment Act 2012. The Schedule 1 amendments (Sch 1 cl 3) amended the definition of restricted item in 2012 and the relevant transitional provisions came into effect 15 December 2012.

• 2015, Firearms Act 2015. Schedule 1 (clause 19) amendments updated the Act's cross-reference to firearms and took effect 1 July 2017 (Gazette 27.6.2017 p2619). This modified the definition of "restricted item" to include firearms per the new Firearms Act.

• 2017, Statutes Amendment (Court Fees) Act 2017. Part 4 (s 6) commenced 5 March 2018 in relation to fees, and s 16(5) was inserted to expand what regulations may prescribe regarding fees (including maximums, minimums and variable bases).

• 2019, Statutes Amendment (Attorney-General's Portfolio) (No 2) Act 2019. Part 13 (s 20) amended the definition of premises of a participating body, effective 19 September 2019.

• 2021, Statutes Amendment (Spit Hood Prohibition) Act 2021. This Act inserted s 9J, prohibiting spit hoods, and came into force 25 November 2021.

• 2023, Statutes Amendment (Civil Enforcement) Act 2023. Section 6 inserted s 9DA, allowing the sheriff and other officers to be assisted by police and clarifying that police assisting have the powers of the sheriff under the Enforcement of Judgments Act 1991, with commencement 18 September 2023 (Gazette 10.8.2023 p2955).

Transitional provisions are recorded, for example preserving employment status for court orderlies who became sheriff's officers on commencement of the 2000 reforms (Statutes Amendment and Repeal (Security and Order at Courts and Other Places) Act 2000, s 24). The legislative history in the Act lists all these amendments and specified commencement dates, showing the Act incrementally expanded from a narrow sheriff’s role to include a statutory security regime interfacing with police and reflecting later policy choices on weapons, firearms, fees and the prohibition of spit hoods.

The version of the Act provided contains no court judgments or litigation particulars. The legislative text itself does not list any cases, nor does it identify judicial interpretations or reported decisions applying the Act. The Act’s legislative history in the text is limited to amendments and commencement details; it does not include litigation summaries.

Consequently, the Act as published supplies statutory language but not any case law clarifying ambiguities such as the scope of "reasonable directions", the appropriate threshold for "reasonable grounds" to suspect restricted items, the standard for "undue humiliation", or the application of the Crown immunity provisions in specific fact patterns. Practitioners should therefore be aware that interpretive questions will have to be resolved through external case law research and, where relevant, judicial review or criminal procedure precedents not contained within this Act.

Because s 9D(3) creates a statutory evidentiary certificate rule and because the Act routes tort claims to the Crown (s 12), any litigation about the exercise of statutory powers is likely to engage administrative law principles, criminal law procedure and tort law principles as applied to Crown liability. Those interactions will ultimately be fleshed out in case law, but none is provided in the statutory text you supplied.

For litigation-oriented practice, key areas to research externally (not addressed in the Act text) include:

• Judicial interpretation of limits on searches and searches of persons required by law to attend, including what constitutes "undue humiliation" and what procedural safeguards courts require.

• Case law on the "reasonably necessary" force standard used in removals and seizures.

• Precedents on the Crown being the proper defendant where the sheriff or officers are alleged to have acted wrongfully, including procedural routes and limitations for claims against the Crown.

• Evidence decisions regarding admissibility and weight of sheriff certificates under s 9D(3) and the capacity of defendants to rebut those certificates.

Absent case citations in the Act, these are matters for independent legal research in the jurisdiction's reported judgments and administrative law records.

Several provisions create practical traps for practitioners and operational risks for agencies. These are specific mechanics and statutory features that often cause unintended consequences if not attended to in practice.

• Broad physical scope of premises. The definition of "premises of a participating body" reaches not only court buildings, but precincts, immediate environs, adjacent carparks and footpaths, laneways between or abutting premises, and places at which a participating body is conducting a view or inspection (s 4). Security powers therefore extend beyond formal court rooms, and policies or signage limited to building entrances may be insufficient to lawfully exercise powers elsewhere.

• Differentiated search regimes and the "required by law" trap. Persons "required by law to attend" (defined in s 4(2)) are subject to physical searches (s 9F(1)(c)), whereas others may be required only to submit to non-contact scanning (s 9F(1)(a)). Section 9F(7) creates a strategic mechanism: if a person refuses to answer a question under s 9F(1)(b) about whether they are required by law to attend, the officer may treat them, for purposes of the Part, as if they are required by law to attend. That statutory deeming can intensify the intrusiveness of searches on persons who refuse to answer, and practitioners must advise clients accordingly.

• Non-suspicion from non-compliance with scanning. Section 9F(6) explicitly states that failure to comply with a scanning-device requirement does not of itself constitute grounds for suspecting a restricted item. Operationally, a security officer must avoid assuming that refusal to be scanned is immunological of further action, but also must not treat such refusal as justification for escalated suspicion absent other grounds. This tension requires clear operational guidance.

• Evidence certificate as prima facie proof. A sheriff’s certificate certifying police authorisation under an arrangement constitutes proof in the absence of proof to the contrary (s 9D(3)). The practical risk is that, unless a defendant can obtain evidence to the contrary, acts by police exercising security powers will be sustained in court by statutory certificate evidence, shifting the evidential burden onto the defendant.

• Fees that need not relate to cost. Regulations may prescribe fees that are not related to actual administrative cost and may vary by value, time, class of matter, or party (s 16(5)). This creates a policy and compliance risk: litigants and defendants may face fee impositions that exceed administrative costs, and the Act gives no statutory constraint tying fees to cost recovery.

• Immunity and claims routing. Section 12 removes personal tort liability for sheriff officers, placing claims against the Crown. Practically, that imposes procedural differences, limitations and potentially different limitation periods or remedies or indemnity rules compared with suing an individual officer. Agencies must have clear procedures for claims and practitioners must be aware of the Crown as the appropriate respondent.

• Spit hood prohibition overrides other law. Section 9J(2) states the spit hood prohibition applies despite any other Act or law. This absolute bar is a strict compliance risk for officers and agencies accustomed to carrying restraining devices; training and equipment reviews must reflect the statutory prohibition.

• Same-sex/dual-officer search requirement except when not practicable. Section 9F(4)(c) requires at least two persons to be present and searches to be carried out by an officer of the same sex as the person, except where not practicable. In practice, what is "not practicable" can be contested in incident reviews and litigation, and operational rosters must be designed to avoid routine reliance on the exception.

• Force limits and mouth-opening restriction. The Act permits reasonable force only, and restricts applying force to open the mouth or remove items from the mouth to supervision by a registered medical practitioner (s 9F(5)(a)(ii)). Operational failure to secure medical oversight when enforcing removal from the mouth is a significant compliance and liability risk.

• Handover timing obligations. Several provisions require handing detained persons or items to police "as soon as reasonably practicable" (s 9E(1)(b)(ii), s 9G(e), s 11(3)). The phrase "reasonably practicable" is fact-dependent and can give rise to disputes if handover is delayed or logistically difficult.

• Identity card return penalty and match of limitations. Identity cards must state any limitations on powers; failure to return an identity card upon ceasing to be a security officer attracts a penalty (s 9C(4)). Agencies need robust card‑management systems to avoid administrative offences and to ensure public transparency about any conditions that limit an officer's powers.

• Treatment of entry refusal as no excuse for non-attendance. Section 9I states that lawful refusal of entry or removal under the Part is not an excuse under other law for failure to attend where attendance has been legally required. That places the onus on persons required to attend to make alternative arrangements or remedy removal, and it may create friction where persons are removed from premises and cannot attend proceedings.

These "gotchas" are operational and legal friction points that require proactive policy design, training, documentation and litigation readiness. They reflect statutory trade-offs between on‑the‑spot security discretion and procedural safeguards.

Complying with the Act requires both institutional arrangements and frontline practices. The points below translate statutory requirements into practical compliance tasks for sheriffs, participating bodies, security officers, police and administrators.

• Governance, appointments and identity cards. Ensure all appointments are made under the Courts Administration Act 1993 as required (s 5(3), s 6(1)). Maintain records and written instruments for temporary or limited appointments under s 6(3). Issue identity cards in the form approved by the Administrator that contain a photograph, name or unique code and state that the holder is a security officer under this Act, and include any limitations on powers on the face of the card (s 9C(1)-(2)). Implement a strict card return process so that when a person ceases to be a security officer the identity card is returned to the sheriff forthwith; track compliance because failure to return attracts a penalty (s 9C(4)).

• Policies for searches and screening. Develop written search and screening policies aligned with s 9F. Distinguish scanning-device searches from physical searches. For scanning searches, ensure devices meet the non-contact requirement and staff are trained to avoid bodily contact (s 9F(2)(a)). For physical searches of persons required by law to attend, implement protocols to ensure same-sex officer presence and a minimum of two other persons (s 9F(4)(c)), except where not practicable; create incident recording practices to justify invoking the "not practicable" exception. Prohibit removal of inner clothing or underwear, and prohibit introduction of anything into orifices; establish medical supervision procedures if mouth-opening or removal-of-mouth items is required under limited circumstances (s 9F(4)(b), s 9F(5)(a)(ii)).

• Training and cultural sensitivity. Train security officers on the statutory obligation to carry out searches "in a manner that avoids undue humiliation" and, as far as reasonably practicable, to avoid offending cultural values or religious beliefs genuinely held by the person (s 9F(2)(d), s 9F(4)(d)). Design training modules on reasonable directions, reasonable grounds, and the appropriate use of force consistent with "only such force as is reasonably necessary" (s 9E(1)(b)(i), s 9G(d)).

• Force and restraint protocols. Adopt clear use-of-force policies that mirror the statutory standard of reasonable necessity, with incident recording, supervisory review and audit trails. Ban spit hoods and confiscate or remove such devices from operational kits (s 9J(1)-(2)). Establish incident reporting that documents the legal basis for force and the contemporaneous justification of "reasonably necessary" to defend against later legal scrutiny.

• Police arrangements and certificates. If entering into arrangements under s 9D or s 9DA with the Commissioner of Police, document the terms in a written agreement that sets out scope, lines of responsibility and chains of command, given the Act deems police "responsible to the sheriff" under s 9D(2). Ensure the sheriff provides certificates of authorisation where appropriate and maintains records to enable rebuttal of any certificate in litigation since s 9D(3) makes such certificates prima facie evidence.

• Handover and custody procedures. Create protocols to hand detained persons and items to police "as soon as reasonably practicable" with time-stamped records (s 9E(1)(b)(ii), s 9G(e), s 11(3)). Where the Act requires items surrendered to be held in safe keeping while a person remains on the premises, create secure storage inventories and chain-of-custody logs (s 9G(h)(i)-(ii)). Track disposal processes, and align them with any regulations made under s 16(4)(ac) about safe-keeping and disposal.

• Signage and public information. Post clear signage at all relevant access points for the premises of participating bodies, including precincts and adjacent areas described in the definition, notifying the public of screening, searching and prohibition of restricted items, and that persons may be asked to provide information showing entitlement to attend proceedings (s 4, s 9E(1)(h)). This helps to provide notice and reduce disputes about lawfulness of directions.

• Record keeping and incident management. Maintain contemporaneous reports for all intrusive interactions (searches, detentions, uses of force), noting statutory basis (which subsection authorised the action), the identities of officers present, whether the person was "required by law to attend", reasons for any use of medical supervision, and the time of handover to police. Such records will be crucial in litigation or internal review since the Act uses standards such as "reasonable" and "expeditiously" that are fact sensitive.

• Fees, accounting and regulatory compliance. If imposing fees and expenses under s 16(4)(b), ensure compliance with any regulations and transparency regarding amounts and bases. Be aware that regulations may prescribe fees that are not linked to administrative cost and may vary by class, time or value (s 16(5)). Publish fee schedules where required and create dispute settlement procedures as s 16(4)(c) envisages.

• Legal advice and training for participating bodies. Principal officers should coordinate with the sheriff on the sheriff's responsibilities (s 9A) and ensure participating bodies have informed policies on who may attend proceedings, who is excluded and how entitlement is to be checked under s 9E(1)(h). Provide legal training for principal officers and registry staff on the effect of s 9I, that lawful refusal of entry under this Part does not excuse statutory obligations to attend.

• Civil risk management. Recognise that tort claims against officers are routed to the Crown (s 12(2)-(3)). Ensure the agency has procedures to manage claims against the Crown, including notification, record preservation and internal investigations to facilitate timely resolution and possible settlement.

• Audit and review. Because the Act allows regulations and because many standards are fact dependent, establish periodic compliance audits for search practice, use-of-force incidents, handovers to police, identity card management and fee collection. Ensure that any practices relying on exceptions (such as "not practicable" for same-sex searches) are specifically recorded with reasons.

Implementing these measures will align operational practice with statutory requirements and reduce the risk of unlawful searches, inappropriate use of force, improper handover delays, and regulatory non-compliance. Documentation and training are the central compliance levers.
