Sexual Reassignment Regulations 2015

The regulations define several key concepts that structure the administrative scheme. Act means the Sexual Reassignment Act 1988 (SA), though that Act is now repealed except for the transitional purposes saved by the 2016 amendment. Minister means the Minister responsible for the Health Care Act 2008, placing the regulatory framework within the health portfolio rather than the births, deaths and marriages registration portfolio. Psychiatrist is defined narrowly as a person registered under the Health Practitioner Regulation National Law as a specialist in psychiatry, while psychologist means a person registered under that National Law to practise in the psychology profession other than a student. This distinction matters because only adults must provide an affidavit from a psychiatrist or psychologist relating to counselling received about sexual identity; no equivalent requirement applies for child applicants. Quarter means a three-month period beginning 1 January, 1 April, 1 July or 1 October, which is the reporting period for hospital returns. Recognition certificate is the document issued by a magistrate confirming that a person who has undergone a reassignment procedure is of a particular sex for legal purposes. The regulations do not define reassignment procedure itself; that term is defined in the principal Act and must be read together with these regulations. The register is the register of reassignments maintained by the Registrar under regulation 7, distinct from the general register of births. The index to the register allows the Registrar to trace connections between register entries and entries altered in any other register under section 9(1)(b) of the Act, which is the mechanism by which a recognition certificate results in amendment of the birth register. The concept of relevant person controls who may search the register or obtain copies: the person themselves, a guardian of a child, or someone acting under a Supreme Court order. Corresponding laws is a concept from the Act that enables recognition of interstate certificates; the regulations list seven jurisdictions' laws (New South Wales, Australian Capital Territory, Northern Territory, Queensland, Victoria, Tasmania, and Western Australia) and declare them corresponding laws as amended or substituted from time to time. This means the list is dynamic and incorporates future amendments to those interstate laws without requiring amendment of the South Australian regulations. The periodic return is a confidential report that hospitals must submit to the Minister within one month of the end of each quarter, containing the person's name, procedure details, practitioner names, counselling details, treatment stage assessment, and any other information required as a condition of approval under section 6 of the Act. The return must be in a form approved by the Minister, not in a form prescribed in the regulations themselves, giving the Minister significant discretion over information requirements.

The regulations directly affect several distinct groups. Applicants for recognition certificates are the primary beneficiaries and duty-bearers. They must complete Form 1, provide a certified birth certificate, pay $86, and arrange for a medical practitioner to swear an affidavit about the reassignment procedure. Adults must also arrange for a psychiatrist or psychologist to swear an affidavit about counselling received. These requirements impose search costs, professional fees, and administrative burdens on individuals already navigating a sensitive medical and legal process. For parents or guardians applying on behalf of a child, the requirement for a psychiatrist or psychologist affidavit does not apply, but the guardian must consent to the person being a relevant person for register access purposes. Medical practitioners who perform reassignment procedures face obligations to swear affidavits for applications and to provide information to hospitals for periodic returns. They must also restrict access to reassignment records under regulation 8, and are authorised to access records for treatment purposes. Psychiatrists and psychologists must swear affidavits about counselling provided to adult applicants, creating a gatekeeping role that may involve professional liability and billing. Hospitals bear the most significant ongoing compliance burden under regulation 9: they must identify each quarter any person who undergoes a reassignment procedure or part of a procedure, compile a return with the person's name, procedure details, practitioner names, counselling information, and treatment stage assessment, and provide it to the Minister confidentially within one month of the quarter's end. Hospital staff must also comply with access restrictions on reassignment records. The Registrar of Births, Deaths and Marriages must maintain the register of reassignments and the index, restrict access to relevant persons only, correct errors, and when issuing copies of altered entries must show the entry as altered unless the applicant is a relevant person and requests the alteration be shown. Magistrates authorised under the Act issue recognition certificates in the prescribed Form 2, and are included in the list of persons who may access reassignment records. Law enforcement and prosecution authorities of the State may access reassignment records in the course of official duties, which raises privacy implications for individuals who have undergone reassignment. Researchers may access records if acting under the authority of the Minister for research purposes. The South Australian Health Practitioners Tribunal may access records under its statutory authority. The Minister receives quarterly returns and authorises research access to records. Public Service officers in the administrative unit responsible for the Health Care Act 2008 may access records in the course of official duties. Critically, the transitional note means that only individuals who lodged applications under the old Act before its repeal are affected by these regulations for new certificate applications; other individuals are now governed by the Births, Deaths and Marriages Registration (Gender Identity) Amendment Act 2016.

The regulations create specific duties and rights that operate primarily through prohibitions and permissions. Duty to use prescribed forms: An application to a magistrate for a recognition certificate must be made in Form 1 set out in Schedule 1 (regulation 5(1)(a)). This is a mandatory requirement; non-compliance would likely render an application invalid. Duty to accompany application with specified documents: The application must be accompanied by an affidavit from a medical practitioner about the reassignment procedure and associated treatment, an affidavit from a psychiatrist or psychologist about counselling for adult applicants, a certified birth certificate, and the $86 fee (regulation 5(1)(b)). These are cumulative requirements. Fee payment duties: The $86 application fee (regulation 5(1)(b)(iv)) and the $51.50 registration fee (regulation 6) are prescribed amounts. The regulations do not exempt anyone from these fees or provide for waiver. Registrar's duty to maintain register: The Registrar must keep a register of reassignments and an index that enables tracing connections between entries (regulation 7(1), (2)). This is a positive duty to maintain accurate records. Registrar's power to correct errors: If the Registrar is satisfied there is an error, omission or misstatement in an entry on the register, the Registrar may correct the entry and make consequential alterations to other registers (regulation 7(6)). This is discretionary, not mandatory, though failure to correct known errors could be subject to judicial review. Right to access register: Only a relevant person may require a search of the register or index, or obtain a copy of an entry (regulation 7(3)). Relevant person means the person themselves, a child's guardian, or someone acting under a Supreme Court order (regulation 7(7)). This creates an exclusionary right against third parties. Right to uncorrected copy: If the Registrar issues a copy of an altered entry, the copy must show the entry as altered (regulation 7(4)), but a relevant person may apply for a copy showing the alteration (regulation 7(5)). This means standard copies issued to third parties who are not relevant persons will not reveal the pre-alteration record. Duty not to access reassignment records: A person must not inspect, copy or remove a reassignment record unless they fall within one of the 13 categories in regulation 8(2)(a) to (m). This is a criminal prohibition enforced by a $2,000 maximum penalty. The categories include the person themselves, guardians, those with consent, treating practitioners, those acting under a practitioner's authority, hospital staff in official duties, health department officers, researchers with Ministerial authority, the Health Practitioners Tribunal, law enforcement, court or tribunal authorities, magistrates, and anyone authorised under any Act or law. This creates a broad permission for state actors including law enforcement that does not require the person's consent. Hospital's duty to provide periodic returns: If a person undergoes a reassignment procedure at a hospital, the hospital must within one month of the end of the quarter provide a confidential return to the Minister with the person's name, procedure details, practitioner names, counselling details, treatment stage assessment, and any other information required as a condition of approval under section 6 of the Act (regulation 9(1)). The return must be in a form approved by the Minister. Duty not to access returns: Similar restrictions apply to inspecting, copying or removing returns, with a narrower list of authorised persons than for general records (regulation 9(2)), and the same $2,000 maximum penalty.

The regulations create two criminal offences, each carrying a maximum penalty of $2,000. The first is the unauthorised inspection, copying or removal of a reassignment record (regulation 8(2)). The second is the unauthorised inspection, copying or removal of a periodic return (regulation 9(2)). Both are strict liability offences in the sense that the regulations do not specify a mental element such as intention, recklessness or knowledge. This means a person who inspects a record in good faith but without falling within one of the listed authorisations could be liable, though a court would likely consider honest and reasonable mistake of fact as a defence at common law in South Australia. The penalty of $2,000 is modest relative to the seriousness of the privacy breach; it is a maximum, not a minimum. The regulations do not create any other offences, such as failure to provide a periodic return, failure to pay fees, or failure to use the prescribed form. The enforcement of the regulations falls to the ordinary criminal justice system. The regulations do not specify which agency investigates breaches. Given the subject matter, the Health Department or the Registrar would likely refer suspected breaches to South Australia Police for investigation. The regulations do not provide for civil remedies such as damages for breach of privacy, injunctions, or orders for destruction of records. A person whose records were unlawfully accessed would need to rely on other causes of action such as breach of confidence or negligence, or on privacy legislation. The regulations do not create any administrative penalties such as infringement notices, enforceable undertakings, or cancellation of approvals. The regulations do not provide for vicarious liability of hospitals or employers for acts of their staff, though general criminal law principles of accessorial liability would apply. The regulations do not contain any limitation period for prosecution; the general criminal law of South Australia would govern. The $2,000 penalty should be assessed against the costs of compliance: a hospital must train staff, maintain secure systems, and produce quarterly returns. The penalty for breach is a fraction of the cost of implementing robust access controls, creating a potential under-deterrence problem. The regulations do not specify any reporting obligations for breaches, nor any power for the Minister or Registrar to issue compliance directions or audit compliance.

The regulations interact with several statutes and regulatory frameworks. Sexual Reassignment Act 1988 (SA) is the principal Act under which these regulations are made. The regulations operationalise sections 6 (conditions of approval), 9(1)(b) (alteration of registers), and 9(3) (prescribed fee for registration). The regulations survive only for transitional purposes after the repeal of the principal Act by the Births, Deaths and Marriages Registration (Gender Identity) Amendment Act 2016. This means references in the regulations to provisions of the principal Act must be read as applying only to the residual transitional scheme. Health Care Act 2008 (SA) is referenced in the definition of Minister; the Minister responsible for that Act is the relevant Minister for these regulations. This places the regulatory scheme in the health portfolio. Health Practitioner Regulation National Law is incorporated by reference in the definitions of psychiatrist and psychologist, which depend on registration under that National Law. The regulations do not treat counsellors, social workers, or other mental health professionals as qualified to provide the required affidavit for adults. Births, Deaths and Marriages Registration Act 1996 (SA) is relevant because section 9 of the Sexual Reassignment Act provided for amendment of the birth register. The regulations interact with the Registrar's functions under the births registration legislation. The 2016 amendment Act that repealed the principal Act was itself an amendment to the Births, Deaths and Marriages Registration Act, so the regulatory framework shifted from a standalone gender recognition statute to integration within the births registration system. Corresponding laws listed in regulation 4 include interstate gender recognition legislation. This enables recognition of certificates issued under those laws without requiring fresh applications in South Australia. The regulation declares the listed laws as corresponding laws as amended or substituted from time to time, meaning the list is dynamic and incorporates amendments to those interstate laws without requiring amendment of the South Australian regulations. The Western Australian Gender Reassignment Act 2000 is included but the corresponding Victorian, NSW and other laws are under births registration statutes, reflecting different legislative approaches across jurisdictions. Privacy legislation: The regulations do not reference the Privacy Act 1988 (Cth) or South Australian privacy legislation. The access restrictions in regulations 8 and 9 may complement or duplicate obligations under privacy law, but the regulations do not coordinate with those regimes. Health Practitioner Regulation National Law (South Australia) Act 2010: The South Australian Health Practitioners Tribunal established under that Act is authorised to access reassignment records. Criminal law: Unauthorised access to records may constitute an offence under other legislation such as the Criminal Law Consolidation Act 1935 (SA) (e.g., unlawful use of a computer), but the regulations provide a specific, lower-penalty offence. Evidence law: The requirement for an affidavit from a medical practitioner and from a psychiatrist or psychologist for adults interacts with the law of evidence regarding sworn statements and the competence of expert witnesses.

The Sexual Reassignment Regulations 2015 were made on 20 August 2015, published in the Gazette on that date at page 3880, and commenced on that date (principal regulations, year 2015, number 195). They revoked the earlier Sexual Reassignment Regulations 2000, consolidating and updating the regulatory framework. The principal regulations included an initial regulation 2 (definition of commencements) and a Schedule 2, both of which were later removed. On 1 July 2016, the regulations were varied by amending regulations 2016 number 137, published in the Gazette on 23 June 2016 at page 2363. The 2016 variation: omitted regulation 2 entirely under the Legislation Revision and Publication Act 2002; omitted Schedule 2 under the same Act; varied regulation 5(1) (the application requirements); and varied regulation 6 (the registration fee). The content of the variations to regulations 5(1) and 6 is not detailed in the legislative history table beyond noting they were varied, but the operative text in the current regulations shows regulation 5(1) with the requirement for a medical practitioner's affidavit and, for adults, a psychiatrist or psychologist's affidavit, and regulation 6 with the $51.50 registration fee. The 2016 amendments appear to have reduced or rationalised the application requirements, possibly removing earlier requirements for additional documentation. The most critical amendment history is not in the regulations themselves but in the principal Act's repeal. The legislative history note appended to these regulations states that they continue in force for the purposes of applications for registration of recognition certificates under section 9 of the repealed Sexual Reassignment Act 1988 but for no other purpose, per Schedule 1 of the Births, Deaths and Marriages Registration (Gender Identity) Amendment Act 2016. This means that from 1 July 2016, the regulations apply only to a closed class of pre-existing applications. New applications from that date are governed by the new framework under the births registration legislation. The regulations have not been further amended since 2016. The omission of regulation 2 and Schedule 2 under the Legislation Revision and Publication Act 2002 was a machinery amendment to remove spent provisions, not a substantive policy change. The $86 application fee and $51.50 registration fee have not been indexed since 2015 or 2016, meaning their real value has diminished. The forms in Schedule 1 bear the date references "20___" indicating they were designed for the 2015 to 2020 period, suggesting they may be outdated and that the Minister may have approved different forms for transitional applications.

The regulations themselves have not been the subject of any reported litigation in South Australian courts, at least insofar as the source material discloses. The source does not mention any cases and I must not invent them. The Sex Discrimination Act 1984 (Cth) and related federal litigation on gender identity may have shaped the broader policy context, but no specific challenges to these regulations are recorded in the provided text. The regulatory framework has been superseded by the 2016 amendments, which likely reduces the prospect of further litigation under these regulations. Given that the regulations are now only transitional, any litigation would concern the interpretation of the transitional provisions, the validity of applications lodged before the repeal, or disputes about access to records created under the old regime. The requirement for a psychiatrist or psychologist affidavit for adults could potentially be challenged as discriminatory or burdensome, but no such challenge is recorded in the source.

Several aspects of the regulations warrant careful attention. The most significant trap is the transitional scope limitation. The legislative history note states plainly that the regulations continue in force for the purposes of applications for registration of recognition certificates under section 9 of the repealed Act but for no other purpose. A practitioner who picks up these regulations without reading the note could mistakenly advise a client that the old framework still applies for new applications. It does not. Anyone seeking a recognition certificate after 1 July 2016 must proceed under the Births, Deaths and Marriages Registration (Gender Identity) Amendment Act 2016, not these regulations. The psychiatrist or psychologist affidavit requirement applies only to adults. For child applicants, the regulations specify only a medical practitioner's affidavit about the reassignment procedure. This creates a lower evidentiary threshold for children, though guardians must consent to the application and may need to demonstrate the child's capacity to consent. The certified birth certificate requirement in regulation 5(1)(b)(iii) could be difficult or impossible for some applicants to obtain, particularly those born overseas, those who are estranged from their family of origin, or those whose original birth certificate reflects a sex that causes them distress. The regulations do not provide an alternative for such cases. The fees are not indexed and have not changed since 2015/2016, but the requirement to pay them is absolute with no waiver provision. The register index allows the Registrar to trace the connection between the reassignment register entry and the altered birth register entry. This means that even after a person's birth certificate is amended, the index preserves a link between the old and new records. Regulation 7(3) restricts access to this index to relevant persons, but the existence of the index creates a permanent record of the reassignment that could be vulnerable to security breach or lawful access by the state. The broad access for law enforcement under regulation 8(2)(j) permits members of a law enforcement or prosecution authority of the State to access reassignment records in the course of official duties, without any requirement for a warrant, the person's consent, or even reasonable suspicion of an offence. This is a significant incursion on privacy that does not appear in the corresponding regimes of other states and may be broader than necessary. The ministerial authority for research under regulation 8(2)(h) allows the Minister to authorise access to reassignment records for research purposes. The regulations do not require the researcher to obtain ethics approval, the person's consent, or even notification to the person. This creates potential for research access without individual control over personal information. The periodic return requirement obliges hospitals to report to the Minister the name of every person who undergoes a reassignment procedure, along with procedure details, practitioner names, and counselling information, every quarter. This is effectively mandatory reporting of sensitive medical information to the state without the person's consent or even knowledge. The return must be provided within one month of the end of the quarter, creating administrative pressure that may increase the risk of data breach. The $2,000 penalty for unauthorised access may be insufficient to deter deliberate breaches by persons with lawful access but improper motives, such as hospital staff accessing records out of curiosity. The regulations do not impose any obligation to audit access, notify affected persons of breaches, or report breaches to any oversight body. The error correction power in regulation 7(6) is discretionary: the Registrar may correct an error, not must. An individual who discovers an error has no right to compel correction under these regulations, though other legal avenues may exist.

Compliance obligations under these regulations are fragmented across different duty-bearers. For applicants for recognition certificates under the transitional regime, the pathway is defined by regulation 5 and Schedule 1 Form 1. The applicant must complete Form 1 with their name and address, the hospital details, their place and date of birth, and their signature. They must attach an affidavit from a medical practitioner that addresses the reassignment procedure and any associated treatment. If the applicant is an adult, they must also attach an affidavit from a psychiatrist or psychologist about counselling received about sexual identity. A certified birth certificate must be provided, and the $86 fee must be paid. The application is made to a magistrate, not to a court registry. Applicants should verify which magistrates are authorised to issue recognition certificates before lodging. For medical practitioners swearing affidavits, the affidavit must relate to the reassignment procedure carried out and any associated treatment provided. The affidavit should be sworn before an authorised witness. The regulations do not prescribe the level of detail required, but the affidavit must enable the magistrate to be satisfied that the person is entitled to a certificate. For psychiatrists and psychologists swearing affidavits for adult applicants, the affidavit must relate to counselling received about sexual identity. The regulations do not specify how many counselling sessions are required, what content the counselling must cover, or how recent it must be. Practitioners should use professional judgment and document their reasoning. For hospitals, compliance is more structured. The hospital must identify each quarter any person who undergoes a reassignment procedure or part of a procedure, or receives associated treatment. Within one month of the end of that quarter, the hospital must compile a confidential return to the Minister using a form approved by the Minister. The return must include: the person's name, details of the procedure or treatment, the name of any medical practitioner or other person who carried out or supervised the procedure or treatment, details of any counselling or other services provided in association, an assessment of the stage reached in the person's treatment as at the end of that quarter, and any other information required as a condition of approval under section 6 of the Act. The hospital must ensure the return is provided confidentially. The hospital must also ensure that reassignment records are stored securely and that only persons within the categories listed in regulation 8(2) inspect, copy or remove them. Staff should be trained on these categories, and access logs should be maintained to demonstrate compliance. For the Registrar, compliance involves maintaining the register and index accurately, ensuring that only relevant persons are permitted to search or obtain copies, issuing copies of altered entries showing the entry as altered except where a relevant person applies for the alteration to be shown, and correcting errors when satisfied they exist. For all duty-bearers, the transitional nature of the regulations means that compliance should be coordinated with the new framework under the Births, Deaths and Marriages Registration (Gender Identity) Amendment Act 2016. Where possible, policies and procedures should be updated to reflect that these regulations now apply only to residual matters. Record retention policies should account for the fact that these regulations may remain in force for many years while transitional applications are processed. Any person contemplating accessing reassignment records should check all 13 categories in regulation 8(2) and document the specific category under which they claim authority.
