Sex Work Decriminalisation Act 2022

The Act sets out six main statutory concepts as its core architecture, each expressed in its purposes clause (s 1). First, decriminalisation as an object. The text states the principal purpose is to decriminalise sex work and to provide for the reduction of discrimination against, and harm to, sex workers (s 1(a)). That is a policy object declared by Parliament; the Act itself implements that object by repealing the pre-existing Sex Work Act 1994 (s 37) and by redirecting specific offence material into other criminal statutes (s 1(d)-(f)).

Second, reallocation of criminal law content. The Act does not leave all former Sex Work Act offences to disappear; it expressly provides for the re-enactment of offences relating to sex work involving children and coercion in the Crimes Act 1958 (s 1(d)) and for re-enactment of certain other sex-work offences in the Summary Offences Act 1966 (s 1(e)). It also instructs an amendment to the Summary Offences Act 1966 to provide for regulation of advertising of sex work (s 1(f)). Mechanically, the immediate effect is a shifting of substantive criminal prohibitions and the loci of their enforcement to other statutes.

Third, anti-discrimination protections. The Act requires an amendment to the Equal Opportunity Act 2010 to introduce a new protected attribute,profession, trade or occupation,and to remove an existing exception allowing accommodation to be refused to persons engaging in commercial sexual services (s 1(g)(i)-(ii)). Those amendments change the statutory framework for discrimination claims and providers of goods and services, but the detailed language of the new protections and the removal of an exception will be found in the amendments to that Act rather than in this short Act.

Fourth, a local-law constraint. Section 3 forbids local laws made under the Local Government Act 2020 from being inconsistent with or undermining the purposes of this Act (s 3(1)). The provision expressly operates in addition to section 72 of the Local Government Act 2020 (s 3(2)), so it is a parallel statutory constraint on municipal regulatory power as it relates to sex work.

Fifth, a review mechanism. The Minister is required to cause a review of the operation of the amendments to be undertaken within a statutory window, that is, commencing not earlier than three and not later than five years after the commencement day (s 4(1)-(3)). The Minister determines terms of reference and appoints the reviewer, who must provide a written report to the Minister and have that report tabled in each House of Parliament (s 4(3)-(5)). The Act therefore embeds a delayed evaluation point and vests the Minister with control over scope and appointment.

Sixth, repeal and timing mechanics. The Act contains staged commencement provisions (s 2(1)-(3)) and an explicit repeal of the Sex Work Act 1994 (s 37). The Endnotes set out actual commencement dates for various sections and describe amendment instruments that altered the Act after assent. The Act itself also records internal repeals of Parts and sections effected by s 83 (as reproduced in the current Version material), setting out a complex overlay of staged and subsequent repeals.

These concepts create an architecture where decriminalisation is effected by repeal and relocation of criminal offence provisions, anti-discrimination law is expanded, municipal regulation is constrained, and a ministerially-controlled review is mandated. The operational detail and sanction mechanics are to be found in the Acts and instruments to which this Act points.

The statutory effects identified in the Act touch a set of identifiable parties, and the Act nominates who will make key decisions about implementation.

Primary individuals: persons who perform commercial sexual services, described in the purposes clause as "sex workers", are the central subject of the Act’s declared purposes (s 1(a)). The Act’s core objective is to decriminalise sex work and reduce discrimination and harm to these individuals (s 1(a)). The Act’s amendment to the Equal Opportunity Act 2010 to add a protected attribute for profession, trade or occupation and to remove an accommodation exception will directly affect sex workers’ legal protections against discrimination (s 1(g)(i)-(ii)).

Business entities: operators of premises, brothel operators and other commercial providers that previously fell under the Sex Work Act 1994 licensing or regulatory regime are directly affected because the Sex Work Act 1994 is repealed (s 37). The Act does not itself set out a replacement licensing regime within the supplied text, so operators must look to consequential amendments in other statutes and instruments for the new regulatory obligations, and to any transitional instruments not contained in this excerpt.

Local government: municipal councils are affected in two ways. First, local laws made under the Local Government Act 2020 must not be inconsistent with or undermine the purposes of this Act (s 3(1)). Second, the Act explicitly positions that constraint in addition to existing requirements in s 72 of the Local Government Act 2020 (s 3(2)), indicating councils must consider this Act when making or amending local laws relating to activities connected with sex work.

Service providers and accommodation industry: the removal of an exception permitting accommodation to be refused to persons engaging in commercial sexual services (s 1(g)(ii)) directly affects accommodation providers and those who deliver hospitality and housing services. They must operate under the amended Equal Opportunity Act 2010 protections once that amendment is in force.

Advertisers and media channels: the Act assigns advertising regulation to the Summary Offences Act 1966 (s 1(f)). Advertising businesses, platforms and individuals who advertise sexual services will therefore be subject to the regulatory framework the Summary Offences Act provides following the consequential amendments.

Criminal justice and enforcement agencies: the Act relocates certain prohibitions,offences related to children and coercion,to the Crimes Act 1958 (s 1(d)), and other offences to the Summary Offences Act 1966 (s 1(e)), so law enforcement and prosecutorial practice will operate under those destination Acts for sex-work related criminality after commencement. The Act itself does not establish operational enforcement regimes; enforcement powers and penalties will derive from the destination Acts.

Minister, Parliament and reviewer: the Minister is given an affirmative duty to cause a review to be undertaken within a three-to-five-year window after commencement (s 4(1)-(3)). The Minister determines the terms of reference for that review and appoints the reviewer who must provide a written report for tabling in Parliament (s 4(3)-(5)). Parliament is affected as the recipient of the review and as the body that enacted the repeal and consequential amendments.

Other statutes and administrators: administrators or regulators responsible for the Crimes Act 1958, the Summary Offences Act 1966, the Equal Opportunity Act 2010 and other consequentially amended Acts will be affected because they will need to accommodate the re-enacted offences, advertising regulation, and anti-discrimination provisions that are shifted into their jurisdictions (s 1(d)-(g), s 1(h)).

Finally, the timing and staged commencement mean that different cohorts will have to monitor distinct dates: sections 1-3, 5-36 commenced on 10 May 2022, and sections 4 and 37-83 on 1 December 2023, per the Endnotes. Those dates determine when particular duties, prohibitions and review obligations became operative (Endnotes). Parties affected therefore need to align operational changes with those commencement milestones.

The Act creates a small set of statutory duties and confers or directs the creation of statutory rights by amendment of other Acts. These are concrete and primarily administrative or structural rather than prescriptive behavioural obligations within the Act itself.

Duties

• Ministerial duty to commission a review. The Act requires the Minister to cause a review of the operation of the amendments made by the Act to be undertaken. The review must commence no earlier than three years after the commencement day and no later than five years after the commencement day (s 4(1)-(3)). The Minister determines the terms of reference for the review and appoints the reviewer (s 4(3)). The appointee must provide a written report to the Minister, and the Minister must cause the review to be tabled in each House of Parliament (s 4(4)-(5)). "Commencement day" is defined as the day on which all provisions of the Act are in operation (s 4(6)).

• Local government constraint. A statutory constraint is placed on local laws under the Local Government Act 2020: a local law must not be inconsistent with the purposes of the Act or undermine decriminalisation and the objective of reducing discrimination and harm to sex workers (s 3(1)). The section states it is in addition to, and does not derogate from, section 72 of the Local Government Act 2020 (s 3(2)). The effect is a positive statutory duty on councils to ensure their local laws are compatible with this Act’s stated purposes.

• Direction for consequential amendments. While not cast as a duty in operative legislative text within this supplied excerpt, the Act directs the re-enactment of specified offences into the Crimes Act 1958 and the Summary Offences Act 1966 and the amendment of the Equal Opportunity Act 2010 (s 1(d)-(g)). Administrators and drafters of those destination Acts therefore have the task of giving effect to those directions via amendment instruments and parliamentary processes.

Rights

• Anti-discrimination protection expansion. The Act directs an amendment to introduce a new protected attribute into the Equal Opportunity Act 2010 to protect persons from discrimination on the basis of their profession, trade or occupation (s 1(g)(i)). That direction confers an identifiable statutory right to protection against discrimination in the contexts governed by the Equal Opportunity Act, subject to the detailed wording and scope of the actual amendment in that Act.

• Accommodation right. The Act expressly directs repeal of an exception that permitted accommodation to be refused to persons engaging in commercial sexual services (s 1(g)(ii)). That change will remove a lawful basis for refusing accommodation in circumstances previously covered by the exception, once the Equal Opportunity Act amendment is in force.

• Regulatory clarity for advertising. The Act instructs the Summary Offences Act 1966 to be amended to provide for the regulation of the advertising of sex work (s 1(f)). Although the Act does not itself grant specific advertising rights, it transfers regulatory responsibility to the Summary Offences Act, which will contain the legal duties, prohibitions and potential exceptions for advertising.

Absence of certain duties and rights in the text

• No licensing obligations or explicit regulatory duties within this Act. The Act does not, within the text provided, create a new licensing regime, impose ongoing compliance obligations on sex work operators in the form of statutory conditions, or set out enforcement penalties. Those legal obligations, if any, will be established by the destination Acts and by consequential instruments referenced in the purposes clause (s 1(d)-(h)).

• No explicit penalties or enforcement apparatus in this Act. The Act relies on other statutes to carry penalties and enforcement for offences that are re-enacted (s 1(d)-(f)). For parties seeking certainty about compliance obligations and sanctions, the practical key duties and rights are therefore to be located in the Crimes Act 1958, the Summary Offences Act 1966 and the Equal Opportunity Act 2010 as amended in consequence.

Who decides

• The Minister controls the review’s terms and appointment (s 4(3)). Parliament has enacted the principal changes, including repeal (s 37), and local councils must align local laws to the Act’s purposes (s 3). Administrators and courts will interpret the re-enacted offences when they appear in other statutes.

In short, the Act imposes a constrained set of duties: a Ministerial review obligation and a prohibition on inconsistent local laws, while conferring or directing the creation of anti‑discrimination rights through amendments to the Equal Opportunity Act, and delegating the detail of criminal and advertising regulation to other Acts.

The Act itself contains minimal direct enforcement machinery or penalty provisions. Its principal enforcement-related effects are relocations and constraints rather than the creation of novel sanctions within the text supplied.

No penalties set out in this Act. The Act does not include a schedule of offences, penalty amounts, enforcement powers, licensing sanctions, or administrative penalty regimes. Instead, the Act instructs re-enactment of specified offences in other statutes: offences concerning sex work involving children and coercion are to be re-enacted in the Crimes Act 1958 (s 1(d)), and certain other sex-work offences are to be re-enacted in the Summary Offences Act 1966 (s 1(e)). The Act also directs that the Summary Offences Act be amended to provide for regulation of the advertising of sex work (s 1(f)). Consequently, the penalties and enforcement mechanisms applicable to sex-work-related criminality and advertising will be those that exist, or are created, under the destination Acts rather than under this Act.

Local law constraint enforcement. Section 3 requires that local laws must not be inconsistent with or undermine the purposes of this Act (s 3(1)). The section does not itself prescribe a penalty for breach. As the section says it is in addition to section 72 of the Local Government Act 2020 (s 3(2)), enforcement or challenge against an inconsistent local law would proceed by reference to existing mechanisms under the Local Government Act 2020 and general administrative law remedies. The Act does not create a novel enforcement route specific to that constraint.

Enforcement of re-enacted offences in other statutes. Because the Act repositions specific offences into the Crimes Act 1958 and the Summary Offences Act 1966 (s 1(d)-(f)), the enforcement powers, investigatory authorities, prosecutorial discretions, and penalty frameworks will be those codified in those destination Acts. Prosecutors and courts will therefore apply the destination Act provisions and sentencing rules when dealing with offences that have migrated from the repealed Sex Work Act 1994.

Review and parliamentary scrutiny rather than sanction. The Act mandates the Minister to commission a review of the operation of the amendments made by the Act within a three‑to‑five‑year window after all provisions are in operation (s 4(1)-(3)). The reviewer must provide a written report that the Minister tables in each House of Parliament (s 4(4)-(5)). That mechanism is evaluative and supervisory; it is not an enforcement mechanism for individual compliance but a post‑implementation accountability tool.

Transitional and consequential enforcement instruments reside outside the Act. The Act expressly contemplates consequential amendments to other Acts (s 1(h)), and the table of amendments and Endnotes record subsequent amending Acts and commencement steps. Any administrative enforcement regimes, civil remedies, or criminal penalties that apply post-repeal will be found in those consequential instruments and destination Acts rather than in this Act’s text.

In practice, for anyone assessing penalties or enforcement risk arising from these changes, the operative documents to consult are the Crimes Act 1958 and the Summary Offences Act 1966 as amended pursuant to the scheme contemplated by s 1(d)-(f), and the amended Equal Opportunity Act 2010 for civil anti‑discrimination consequences. The Act functions as a routing instrument rather than as a self-contained enforcement statute.

The Act explicitly reorganises regulatory responsibility across a set of existing statutes and places a constraint on local government law-making. The interaction points are stated in the purposes clause and in the local law provision, and the Endnotes and Table of Amendments document further statutory instruments that altered the Act post-assent.

Primary destination statutes

• Crimes Act 1958. The Act directs that offences relating to sex work involving children and coercion are to be re-enacted in the Crimes Act 1958 (s 1(d)). The effect is that child-protection and anti-coercion offences that formerly sat, in whole or part, in the Sex Work Act 1994 will now be enforced and interpreted under the Crimes Act framework and its associated procedural and substantive law.

• Summary Offences Act 1966. The Act directs re-enactment of certain sex-work-related offences and specifically directs amendment of the Summary Offences Act to provide for regulation of advertising of sex work (s 1(e)-(f)). That allocates offences of a summary, public-order or minor criminal character to the Summary Offences Act and places advertising regulation under its scope.

• Equal Opportunity Act 2010. The Act mandates amendments to the Equal Opportunity Act 2010 to introduce a new protected attribute protecting persons from discrimination on the basis of profession, trade or occupation, and to repeal an exception that permitted accommodation to be refused to persons engaging in commercial sexual services (s 1(g)(i)-(ii)). The detailed rights, immunities, exceptions, remedies and enforcement mechanisms will therefore come from the Equal Opportunity Act once the amendments are enacted.

Local Government Act 2020

• Section 3 of this Act constrains local laws made under the Local Government Act 2020 by prohibiting inconsistency with, or undermining of, the purposes of the Sex Work Decriminalisation Act 2022 (s 3(1)). The section expressly operates in addition to, and does not derogate from, section 72 of the Local Government Act 2020 (s 3(2)). In practice, this places an additional interpretive obligation on councils when framing local laws touching on sex work or associated activities, and it creates a statutory touchpoint for considering the validity of local laws.

Interplay with consequential amendment machinery

• The purposes clause states the Act will make consequential amendments to other Acts (s 1(h)). That phrase signals that this Act is a node in a larger legislative programme. The actual language and operative effect of those consequential amendments will be found in the amending instruments and in the destination Acts.

Interpretation and technical provisions

• The Endnotes reproduce general interpretation information referencing the Interpretation of Legislation Act 1984 and contain material about style, headings and legislative items. This affects how one reads headings and notes in this Act and in destination Acts (Endnotes, ILA references). That interpretive material is relevant when applying the Act alongside the destination statutes.

Commencement and staged operation

• The Act’s commencement provisions (s 2(1)-(3)) provide fallback commencement dates if proclamation does not occur. The Endnotes record the actual operational dates: sections 1-3, 5-36 began on 10 May 2022, and sections 4, 37-83 began on 1 December 2023. The staged commencement affects when the repeal of the Sex Work Act 1994 took effect and when the review duty and local law constraints became operative.

Amending legislation

• The Table of Amendments lists subsequent Acts that amended the Sex Work Decriminalisation Act 2022, including the Justice Legislation Amendment (Sexual Offences and Other Matters) Act 2022 and the Major Crime and Community Safety Legislation Amendment Act 2022, with their assent and commencement dates. Those instruments altered this Act’s provisions and are part of its legal context. The Version notation (Version No. 007, incorporating amendments as at 1 December 2025) in the front matter indicates the Act should be read in that consolidated form.

Practical inter-Act effects

• Removal of the Sex Work Act 1994 (s 37) creates a legal vacuum unless and until destination Acts and consequential amendments articulate new regulatory details. For enforcement, prosecution, or civil protection questions, a reader must consult the amended Crimes Act, Summary Offences Act and Equal Opportunity Act. The Act’s local-law constraint forces municipal law to be interpreted and drafted so as to be consistent with the declared purposes (s 3).

In sum, the Act is a reallocative instrument that reshapes the locus of criminal law and anti-discrimination protections by moving particular subject-matter into other statutes and by constraining the exercise of local government law-making in relation to sex work (s 1(d)-(g), s 3). The Endnotes and Table of Amendments record ensuing legislative activity that further changed the Act’s text and timing.

The Act’s marginal history is compact but contains staged commencements and subsequent amending Acts. The Version header identifies this text as Version No. 007, incorporating amendments as at 1 December 2025. The table and endnotes supply concrete dates and the instruments that altered the Act.

Assent and initial commencement framework

• Assent. The Sex Work Decriminalisation Act 2022 was assented to on 1 March 2022 (Endnotes).

• Intended commencement mechanics. Section 2 provides for commencement by proclamation, with fallback dates if proclamation does not occur. Subsection (2) provided that if certain provisions did not commence before 10 May 2022 they would commence on that date; subsection (3) provided that any other provisions not commenced before 1 December 2023 would commence on that day (s 2(1)-(3)).

Recorded commencement

• The Endnotes record that sections 1-3 and 5-36 commenced on 10 May 2022 by operation of s 2(2). Sections 4 and 37-83 commenced on 1 December 2023 by operation of s 2(3) (Endnotes). The staged commencement therefore delivered earlier operation for preliminary matters and later operation for the repeal and review machinery.

Subsequent amendments and related Acts

• Justice Legislation Amendment (Sexual Offences and Other Matters) Act 2022 (No. 38/2022). The Table of Amendments records that this Act assented on 6 September 2022 and that its relevant sections commenced on 1 January 2023 and 30 July 2023 for specified sections that amended the Sex Work Decriminalisation Act 2022. The Table notes the current state of those amendments in relation to this Act.

• Major Crime and Community Safety Legislation Amendment Act 2022 (No. 44/2022). This Act assented on 27 September 2022 and had commencement of its relevant section on 28 September 2022, per the Table of Amendments.

Repeals and internal changes recorded in the Act

• The body of the Act as printed indicates that Parts 3-5 (headings and ss 5-36) were repealed by s 83 of No. 7/2022. The table also indicates that s 83 repealed Pts 3-5 (ss 5-36), Pt 7 and Pt 8 (ss 39-83) on 1 December 2024 and that s 38(4) repealed s 38 on 1 December 2025. The textual annotations show multiple layers of internal repeal dating to instruments enacted after the original Bill.

Versioning and consolidation note

• The front matter states Version No. 007 and that the Version incorporates amendments as at 1 December 2025. The Endnotes remind readers that the consolidated version includes amendments made by Acts and subordinate instruments and that one should consult the legislation.vic.gov.au site for up-to-date versions and instruments.

Miscellaneous interpretive notes

• The Endnotes include references to the Interpretation of Legislation Act 1984 and guidance on style and interpretation (for example, heading and note treatment). Those interpretive mechanics affect how later readers parse the Act and its amendments.

Practical implications of the amendment history

• The Act’s repeal of the Sex Work Act 1994 became effective on the dates indicated in the Endnotes (s 37; Endnotes). Several subsequent amendment Acts and repeal steps altered the internal structure of this Act after its initial passage. For practitioners, it is therefore necessary to consult the consolidated Version No. 007 to see the Act as currently in force and to consult the destination Acts for the content that was reallocated.

In short, the Act was enacted in 2022, began to operate in stages in 2022 and 2023, and was subsequently subject to amending Acts in 2022 and further internal repeals and changes recorded through December 2025. The Endnotes and Table of Amendments are the statutory record of that evolution.

The text supplied and its Endnotes do not record any litigation arising under the Sex Work Decriminalisation Act 2022. The source material contains the Act as enacted, the second reading speech dates, commencement information and a table of subsequent amending Acts, but it does not include any judicial decisions, appeal records or reported cases that interpret or apply the Act. The Endnotes include standard interpretation guidance drawn from the Interpretation of Legislation Act 1984 but do not report any court proceedings concerning this Act.

Absent entries. The Endnotes explicitly state "No entries at date of publication" under explanatory details (Endnotes, section 3). That notation indicates the parliamentary materials reproduced with the Act did not include records of litigation or of judicial interpretation when the consolidated version was produced.

Potential loci for litigation. While the source does not record litigation, the Act’s mechanics identify several concrete areas where legal disputes might be expected to arise in future, and which practitioners should monitor in the destination Acts. These include:

• The validity or scope of local laws challenged as inconsistent with this Act (s 3). Because s 3 makes such inconsistency a statutory criterion, potential disputes may engage questions of statutory construction and administrative law as to whether a local law "undermines" the Act’s purposes. The Act itself does not set a bespoke dispute mechanism, so any challenge would proceed via ordinary administrative or judicial review routes.

• Interpretation of re-enacted offences once they appear in the Crimes Act 1958 and the Summary Offences Act 1966 (s 1(d)-(f)). Re-enactment frequently gives rise to litigation over whether text is substantively equivalent, how sentencing ranges apply, and the interaction of new statutory wording with existing statutory schemes.

• Application of the new protected attribute and removal of the accommodation exception under the Equal Opportunity Act 2010 (s 1(g)(i)-(ii)). The detailed wording of those amendments will determine the scope of protected activity and any permissible exceptions, which courts may have to construe in discrimination cases.

No judicial record in the supplied material. Because the supplied consolidation contains no case law, readers must consult case law databases, court registries and later consolidated Acts to determine whether litigation has since occurred. The consolidated text and Endnotes as supplied do not provide that information.

The Act contains several practical and interpretive points that can produce implementation risk, compliance uncertainty, or unintended administrative complexity. These are matters drawn from the Act’s text and from what it leaves to other instruments.

1. Repeal without detailed in situ replacement. The Act repeals the Sex Work Act 1994 in express terms (s 37) and directs the re-enactment of certain offences into other statutes (s 1(d)-(f)). The supplied text does not include transitional provisions or a comprehensive replacement regulatory code. Practically, businesses, sex workers and regulators must look to consequential amendments and destination Acts to determine the operative legal rules. This creates an interim phase in which the precise obligations, licensing arrangements and penalties are spread across multiple statutes and amending instruments, increasing the risk of misreading applicable requirements.

2. Fragmentation of offence law across statutes. Offences are moved into the Crimes Act 1958 and the Summary Offences Act 1966 (s 1(d)-(f)). Practitioners must track both destination Acts for complete coverage of criminal prohibitions, modes of proof, and sentencing frameworks. Fragmentation may produce interpretive complexity when an act engages elements of more than one destination statute, for example where advertising regulation in the Summary Offences Act interacts with coercion offences in the Crimes Act.

3. Local government constraint with limited procedural clarity. Section 3 requires local laws not be inconsistent with, or undermine, the purposes of this Act (s 3(1)) and is said to be in addition to s 72 of the Local Government Act 2020 (s 3(2)). The Act does not prescribe the mechanism by which inconsistency is determined or the remedy for an inconsistent local law. That leaves municipal drafters uncertain about the standard of review or the evidentiary basis required to demonstrate inconsistency or undermining, and it pushes resolution into pre-existing administrative or judicial channels.

4. Ministerial control of the review scope. The Minister sets the terms of reference for the mandated review and appoints the reviewer (s 4(3)). The Act fixes timing (3 to 5 years after commencement day) but not the review’s specific metrics or transparency processes. Entities preparing for the review must therefore anticipate a ministerially curated scope rather than a legislatively prescribed evaluation framework.

5. Timing complexity and staged commencements. The commencement regime establishes fallback dates (s 2(2)-(3)). The Endnotes record different operative dates for different sections: sections 1-3, 5-36 began on 10 May 2022, and sections 4 and 37-83 on 1 December 2023. Additionally, internal repeals and amending Acts changed the structure of the Act following assent. Parties must confirm which provisions were in force at a given time to avoid applying repealed or not-yet-commenced rules.

6. New anti-discrimination protections not spelled out here. The Act directs insertion of a protected attribute in the Equal Opportunity Act 2010 (s 1(g)(i)) and repeal of an accommodation exception (s 1(g)(ii)), but the exact scope, exemptions, and remedies depend on the wording of the Equal Opportunity Act amendments. Relying parties should not assume the scope of protection until the destination Act’s text is consulted.

7. Advertising regulation moved to Summary Offences Act. The Act states advertising will be regulated under the Summary Offences Act (s 1(f)) but does not include the wording. Advertisers, platforms and intermediaries therefore face uncertainty as to permitted content, necessary disclaimers, or geographic limits until the Summary Offences Act is amended and the details are published.

8. No express offence of regulatory non-compliance in this Act. There is no provision specifying penalties for contravening s 3’s local-law constraint, nor any enforcement route set out here for breaches. That may create the illusion of compliance safety where other statutory or common law routes still expose actors to legal challenge.

9. Administrative burden of multi-Act compliance. The Act’s structure disperses legal obligations across at least three destination Acts and leaves consequential amendments and subordinate instruments to fill the gaps (s 1(d)-(h)). Practitioners should expect a non-trivial compliance burden as businesses, councils and regulators reconcile multiple statutes and instrument changes.

10. Versioning and consolidated text. The front matter shows Version No. 007 incorporating amendments as at 1 December 2025, and the Table of Amendments records multiple amending Acts. Users must consult the consolidated version to avoid relying on out-of-date text and should make sure they track commencement provisions in the Endnotes.

Each of these "gotchas" arises from the Act’s structural decision to effect decriminalisation through repeal-and-reallocation rather than by setting a detailed, standalone statutory scheme in the Act itself (s 1, s 37). Practitioners should therefore map obligations and risks across the destination Acts and monitor ministerial instruments, consequential amendments, and local-law activity.

Compliance requires a targeted, cross-instrument approach because the Act operates mainly by repeal and by reallocating regulatory responsibility to other statutes. The steps below are a practical checklist for in-house counsel, compliance officers, council officers, and operators. Each item cites the relevant provisions in the Act supplied.

1. Confirm applicable commencement dates and Version. Check the consolidated Version No. 007 and the Endnotes for the operative dates. Sections 1-3, 5-36 commenced on 10 May 2022 and sections 4, 37-83 on 1 December 2023 (Endnotes). Verify whether subsequent amendments noted in the Table of Amendments apply to your organisation’s operations.

2. Identify destination Act provisions. Because the Act relies on re-enactment rather than prescribing offences in situ, identify and read the amended provisions in:

   • Crimes Act 1958 for offences concerning children and coercion (s 1(d));
   • Summary Offences Act 1966 for other sex-work offences and for advertising regulation (s 1(e)-(f));
   • Equal Opportunity Act 2010 for the new protected attribute and repeal of the accommodation exception (s 1(g)(i)-(ii)). Compliance requires aligning practices to the operative wording in those Acts and any subordinate instruments.

3. Local-law review and drafting. If you are a council legal or regulatory officer, review existing and proposed local laws under the Local Government Act 2020 for inconsistency with the Sex Work Decriminalisation Act’s purposes clause (s 3(1)). Document how any regulatory provisions avoid undermining the Act’s purpose to decriminalise sex work and reduce discrimination and harm to sex workers. Consider formal legal advice where the local law could be read as limiting activities in a way that may be contrary to the Act’s purposes.

4. Update organisational policies affecting accommodation and discrimination. Accommodation providers and employers should update anti-discrimination policies and acceptance/refusal criteria in light of the directed repeal of the accommodation exception in the Equal Opportunity Act 2010 (s 1(g)(ii)). Until the specific amendment text is confirmed, adopt a cautious approach that avoids refusals tied expressly to a person’s engagement in commercial sexual services where that would likely be caught by the forthcoming change.

5. Advertising compliance. Advertisers and platforms must review the Summary Offences Act amendments once in force to determine permitted advertising content and restrictions (s 1(f)). In the interim, avoid practices that could be interpreted as advertising unlawful activity under current law, and implement internal sign-off processes that flag sex-work advertising for legal review.

6. Record-keeping for review. Because the Minister must cause a review to commence between three and five years after commencement day and the Minister sets the terms of reference (s 4(1)-(3)), organisations should preserve relevant data and records that may be relevant to an assessment of the amendments’ operation. This includes records of complaints, incidents of coercion, advertising practices, employment arrangements, accommodation refusals, and any local-law enforcement actions.

7. Staff training and engagement. Train front-line staff, compliance officers and regulatory teams on:

   • The change in legal framework due to repeal of the Sex Work Act 1994 (s 37);
   • The existence of new or relocated offences in the Crimes Act and Summary Offences Act (s 1(d)-(f));
   • The expanded anti-discrimination protections anticipated in the Equal Opportunity Act 2010 (s 1(g)(i)-(ii));
   • The local-law constraint imposed on councils (s 3). Training should emphasise checking the destination Acts for final text.

8. Legal audit and gap analysis. Conduct a legal audit that maps former obligations under the Sex Work Act 1994 to:

   • New offences and procedures in the Crimes Act and Summary Offences Act;
   • Anti-discrimination obligations in the Equal Opportunity Act;
   • Any licensing or registration processes retained or created by consequential instruments. The audit should identify gaps where obligations were formerly statutory but are now to be located in secondary instruments or elsewhere.

9. Engagement with regulators and policymakers. Where possible, engage early with the agencies responsible for amending the destination Acts to obtain guidance drafts, regulatory impact statements, and compliance guidance. The Act creates ministerial discretion over the review’s terms (s 4(3)), and regulators are likely to issue policy guidance ahead of, or following, the review.

10. Monitor local-law activity and potential challenges. For operators whose business model depends on local zoning or health and safety rules, monitor council regulatory activity closely and maintain contemporaneous records of council decisions. Because s 3 requires local laws not to be inconsistent with the Act’s purposes (s 3(1)), local law changes that appear to curtail decriminalisation objectives may be susceptible to challenge under existing legal avenues.

11. Prepare submissions for the statutory review. The Act mandates a Ministerial review and tabling in Parliament (s 4(1)-(5)). Affected parties should prepare to provide evidence-based submissions and data when the Minister issues terms of reference, including operational data and policy recommendations.

12. Confirm insurance and contract documentation. Businesses and individuals should review insurance policies and contracts to assess whether coverage and contractual terms remain appropriate post-repeal. Contracts that conditioned services on compliance with regulations previously imposed under the Sex Work Act 1994 may need amendment to reflect the new legal landscape.

13. Seek bespoke legal advice for transitional cases. If you are affected by conduct or enforcement that occurred around the repeal date or in the intervening period when the destination Acts were being amended, obtain legal advice to clarify which statute applied at the time and how transitional arrangements were handled.

Each of these compliance steps is grounded in the Act’s mechanics: repeal of the Sex Work Act 1994 (s 37), re-enactment directions (s 1(d)-(f)), local-law constraints (s 3), the Ministerial review duty (s 4) and the Equal Opportunity amendments (s 1(g)). Because several critical details reside in consequential amendments and destination Acts, a compliance programme must be multi‑track: monitor statute and instrument updates, document operational impacts, and preserve data for the statutory review.
