What it does
These Regulations set detailed, operational rules under the Sex Industry Act 2019 for three discrete matters: the form and content of newspaper advertising for sex work (r 3), the fee for an application for a suitability certificate (r 4), and the information that counts as meeting the statutory requirement to hold a suitability certificate (r 5). The Regulations commence on the commencement of s 24 of the Sex Industry Act 2019 (r 2). They do not create new licensing powers or enforcement sanctions; they prescribe standards and thresholds that interact with the Act’s licensing and suitability scheme.
Mechanically, the instrument does the following.
- Advertising: Prescribes a maximum size for a newspaper advertisement (no larger than 3.5 cm x 4.5 cm), requires placement in the classifieds under an "Adult Services" or similar heading, and lists content exclusions and narrow photographic limits (r 3).
- Fee: Fixes the application fee for a suitability certificate at 100 revenue units (r 4).
- Suitability criteria: Specifies the disqualifying circumstances for an applicant for a suitability certificate based on a 10 year lookback, including convictions for defined "relevant offences", bankruptcy or insolvency dealings, being an executive officer of a corporate body convicted of particular offences, and prior revocation of a suitability certificate in any jurisdiction (r 5(1) and (2)).
The Regulations cross‑refer to the Act for scope and enforcement. They apply, expressly, to newspaper advertisements for sex work under s 15(1) of the Act (r 3). The suitability provisions operate as the statutory test for applicants under s 19(3)(b) of the Act (r 5(1)). The fee provision is made for the purpose of s 19(2) of the Act (r 4). The Regulations therefore operate as implementing detail for the Act rather than as a standalone regulatory regime.
