Sex Industry Act 2019

The Act relies on a limited set of legal concepts and thresholds that determine legal status, enforcement, and administrative obligations.

• Sex work, sex worker and sex services business. “Sex work” is defined as provision of services that involve participating in sexual activity with another person in return for payment or reward; “sex services business” means a business that provides for or arranges sex work; “sex worker” is a person who performs sex work (s 4). Those definitions are the base for the contract validation (s 7), offences (Parts 3), and suitability certificate requirements (Part 4). The definition ties regulatory obligations to economic transactions rather than to venue type or business model.

• Decriminalisation of contracts. Section 7 states a contract for or to arrange sex work is not illegal or void on public policy or similar grounds. That is a rule of private law validity. It does not, by itself, create positive licensing rights, nor does it prevent criminal prosecution under other provisions; it simply removes a bar to enforceability of commercial agreements.

• Public health overlay. Sex work is “taken to be a declared activity” under the Public and Environmental Health Act 2011 (s 6(1)), bringing sex‑work activities within that Act’s definition of public health powers. However, s 6(2)(a) expressly exempts sex services businesses from registration under that Act, and s 6(2)(b) prevents police from exercising powers or functions as authorised officers under that Act in relation to sex work. This combination applies the health statute’s definitions and some obligations but narrows registration and particular enforcement channels.

• Rights to refuse and consent. Section 9 establishes that a person may refuse or cease sex work at any time despite any contract and that entering a contract does not, by itself, constitute consent for the purposes of criminal law. The section separately preserves civil contract remedies where performance is not provided.

• Offences targeting exploitation and child protection. Parts 3 (ss 10-16) criminalise inducement to perform sex work or to provide payments using intimidation, threats, supplying dangerous drugs, fraud, or property damage; criminalise receipt of payments derived from sex work by or of children; and prohibit the use of children in sex work. Several child‑related subsections are strict liability as to the child’s age (ss 12(3), 13(3), 14(3)). Penalties vary from monetary penalty units to up to 14 years imprisonment for the most serious child cases.

• Suitability certificates and threshold. Under s 18, if a sex services business engages three or more sex workers, the operator must hold a suitability certificate. Where the operator is a body corporate, each executive officer and any nominated day‑to‑day controllers must also hold certificates (s 18(2)). Applications require payment of prescribed fees (s 19(2)). The Director issues certificates if satisfied applicants are suitable and meet regulatory requirements (s 19(3)). The Director may investigate and revoke (s 21). Use of information collected under Part 4 is limited and personal information must be destroyed once the person ceases to hold a certificate (s 22).

• Administrative architecture. The Director is a public sector employee appointed by the Minister (s 22A); the Director may delegate powers to other public sector employees or, with Ministerial consent, to other persons (s 22B). Review of issuing or revoking suitability certificates is to NTCAT (s 23 and Schedule). Regulations can prescribe fees, advertising requirements, suitability certificate requirements, and matters relevant to revocation (s 24(2)(a)-(d)). A Review Committee with industry, community, public health and OHS representation is established (s 25) and must perform specified reviews (s 26).

• Transitional changes and record destruction. The Act repeals prior prostitution regulation Acts (s 27) and requires destruction of all personal information obtained under particular parts of the repealed Act and registers (s 28), overriding the Information Act 2002.

Each of these concepts carries operational consequences: eligibility and threshold rules affect who needs to apply for certificates; the “reasonable steps” obligation (s 8) is a standard with uncertainty; the Director’s appointment and delegation powers concentrate administrative discretion; and the data‑destruction obligation removes historical administrative data that could otherwise be used for oversight or research.

The Act affects identifiable groups differently and assigns costs, responsibilities and rights in distinct ways.

• Sex workers. Defined as persons who perform sex work (s 4), individual sex workers are affected by removal of the contractual invalidity rule (s 7), the right to refuse work (s 9), the safe‑sex obligation on themselves together with operators (s 8), advertising restrictions (s 15(2) prohibits ads likely to induce a person to seek employment), and certain criminal offences where they are victims of coercion or exploitation (ss 10-11, 12-14). Individual sex workers do not, under the text, have to hold suitability certificates , the certificate requirement attaches to operators and, for body corporates, to executive officers and nominees (s 18).

• Operators of sex services businesses. Operators who engage three or more sex workers must hold a suitability certificate (s 18(1)). Where an operator is a body corporate, executive officers and nominees need certificates (s 18(2)). Operators are subject to the “reasonable steps” safe sex obligation (s 8). Failure to hold a required suitability certificate is not an offence but supports issuance of a written notice by the Director to pay a civil penalty prescribed by regulation (s 18(3)-(5)).

• Bodies corporate. When an operator is a body corporate, not only the corporate entity but each executive officer and day‑to‑day nominee must hold certificates (s 18(2)); the corporate operator may nominate day‑to‑day controllers (s 17). This makes corporate forms carry individual compliance obligations for named persons.

• Clients. Clients are affected indirectly: the Act establishes rights for sex workers to refuse (s 9) and contains offences criminalising coercion and fraudulent representations (ss 10-11). Medical examination misrepresentations are criminalised (s 16). Public‑health rules and exemptions from registration under the Public and Environmental Health Act (s 6) will shape standards that clients may encounter.

• Public sector regulators and the Minister. The Minister appoints the Director (s 22A) and prescribes terms of reference for the Review Committee (s 25(4)). The Director has investigatory, issuing and revocation powers (ss 19-21) and may delegate (s 22B). NTCAT has review jurisdiction for specified decisions (s 23).

• Police and public health authorised officers. Section 6(2)(b) prevents police officers from exercising powers or performing functions as authorised officers under the Public and Environmental Health Act 2011 in relation to sex work. The Act also exempts sex services businesses from registration under that public‑health Act (s 6(2)(a)), which narrows the footing on which authorised officers might act.

• Industry intermediaries and advertisers. Advertising in newspapers, television or radio is an offence unless in accordance with regulations (s 15(1)), and publishing an advertisement likely to induce a person to seek employment as a sex worker is an offence (s 15(2)). These provisions affect media organisations, recruitment intermediaries and advertising platforms contemplated by the regulations.

• Individuals involved in child exploitation. The Act creates heavy criminal liability for persons who cause, allow, accept, or receive payments connected to children in sex work (ss 12-14). Strict liability applies as to the actual age in specific subsections (ss 12(3), 13(3), 14(3)).

• Data holders and past registrants. The Act requires destruction of personal information obtained under defined parts of the repealed Prostitution Regulation Act 1992 and registers (s 28), directly affecting those who previously held records (government agencies) and persons whose information was held.

Who pays and who decides: operators of businesses with three or more sex workers, and where the operator is a corporation, executive officers and nominees, incur the suitability certificate compliance costs and fees (ss 18-19); the Director decides on issuing or revoking suitability certificates (ss 19-21) and may impose civil penalties for non‑compliance with the certificate requirement (s 18(3)). The Minister decides appointment of the Director (s 22A), and regulations made by the Administrator (on the Minister’s advice) determine fees and requirements (s 24).

Behavioural effects likely include structuring businesses to avoid the three‑worker threshold, increased use of informal or cooperative work arrangements, shifts in advertising channels away from print, TV and radio toward online platforms not mentioned in s 15(1), and increased reliance on private contracts enforceable under the general law (s 7), subject to the safety and criminal prohibitions in Parts 2 and 3.

The Act creates specific duties, affirmative rights and standards of conduct for different actors. The most significant are listed below with the legal text references and a note on operational meaning.

• Right to contract and enforceability: s 7 states that no contract for or to arrange sex work is illegal or void on public policy or similar grounds. Operationally, parties can enter binding commercial agreements for the provision or arrangement of sex work and seek civil remedies (damages, specific performance where available) in normal courts. The Act does not create an obligation to perform under contract; s 9 preserves a worker’s right to refuse.

• Right to refuse: s 9(1) gives individuals the express right to refuse to perform or continue sex work at any time. Section 9(2) clarifies that having entered a contract does not mean consent for criminal law purposes where the person withdraws or does not consent. This dual framing protects personal autonomy in criminal law while leaving contractual remedies available where appropriate (s 9(3)).

• Duty to adopt and promote safe sex practices: s 8 requires operators and sex workers to “take all reasonable steps” to adopt and promote safe sex practices. The test is an objective “reasonable steps” standard; the Act does not define specific measures. Regulations may fill that gap (s 24(2)(b)). Enforcement mechanisms for this duty are not detailed in the Act itself; compliance may be relevant to suitability certifications or other sanctions if regulating instruments or guidelines attach consequences.

• Suitability certificate obligations: s 18 imposes an obligation on operators of sex services businesses that engage three or more sex workers to hold a suitability certificate. For corporate operators, executive officers and nominees must hold certificates (s 18(2)). The Director may issue certificates if satisfied of suitability and compliance with any regulatory requirements (s 19(3)). A certificate remains in force until the holder is no longer required to hold it or until revoked (s 20). The Director can investigate and revoke on prescribed or contravening information (s 21).

• Duty of confidentiality and destruction of applicant data: s 22(1) says information collected under Part 4 must not be used for any purpose other than the purpose for which it was given. Section 22(2) requires the destruction of personal information as soon as practicable after the person stops holding a suitability certificate, despite the Information Act 2002. That imposes a short retention horizon and restricts secondary uses of the data.

• Criminal prohibitions and duties not to exploit: Parts 3 (ss 10-16) set duties not to engage in inducement by violence, threats, drug supply, fraud or property damage (ss 10-11) and not to involve children in sex work or receive payments from their sex work (ss 12-14). Section 15 places advertising restrictions, and s 16 prohibits misleading statements about medical examinations. Those provisions create both criminal duties (imprisonment for serious offences) and monetary penalties for advertising/statement contraventions.

• Administrative and review rights: Applicants or certificate holders have a right to review under NTCAT for refusal to issue or revocation of certificates (s 23 and Schedule). The Review Committee must assess and report on the industry and the Act’s operation (s 26), and the Minister must table the report (s 26(3)).

• Delegation and decision‑making: The Director may delegate powers to public sector employees or, with Ministerial consent, to any other person (s 22B). The Minister appoints the Director (s 22A), and the Minister appoints and defines the Review Committee’s terms (s 25). These provisions centralise appointment and administrative control with the Minister and Director.

In combination, the rights and duties create a regulatory environment where private contracting and worker autonomy are recognised, but with administrative controls and criminal prohibitions aimed at exploitation and child protection. The suitability certificate threshold (three or more sex workers) is the principal statutory lever that configures who must engage with regulators and accept record submission, background checks or other suitability requirements prescribed by regulations. The data‑destruction rule limits long‑term state record‑keeping about operators and their personnel.

The Act contains a mix of criminal penalties (imprisonment and penalty units), strict‑liability provision for certain elements, and administrative civil penalties for non‑compliance with suitability‑certificate obligations.

• Criminal imprisonment offences. The Act creates several offences carrying imprisonment maxima:

  • Inducing a person to perform sex work by intimidation, assault, threats, supplying a dangerous drug, fraud, or property damage where the defendant is reckless as to the result: maximum imprisonment 5 years (s 10).
  • Inducing a person to provide payment from sex work by the same kinds of conduct, and where the payment is derived (directly or indirectly) from sex work and the defendant is reckless as to that circumstance: maximum imprisonment 5 years (s 11).
  • Causing or allowing a child under 14 to perform sex work or work in a sex services business: maximum imprisonment 14 years (s 12(1)). For children aged at least 14 but under 18, the maximum is 7 years (s 12(2)). Provision of strict liability as to the age element for ss 12(1)(c) and 12(2)(c) (s 12(3)).
  • Receiving payment derived from sex work performed by another person who is under 14: maximum 14 years (s 13(1)); if the person is at least 14 but under 18, maximum 7 years (s 13(2)). Strict liability as to age in s 13(3).
  • Agreeing to sex work by a child (offer or acceptance to enter into an agreement): maximum 14 years if child under 14 (s 14(1)); maximum 7 years if child aged at least 14 but under 18 (s 14(2)). Strict liability as to the child’s age (s 14(3)).

• Monetary penalties and strict liability. Some contraventions attract penalty units:

  • Non‑compliant advertising in newspaper, TV or radio except in accordance with regulations: maximum 20 penalty units (s 15(1)).

  • Publishing an advertisement likely to induce a person to seek employment as a sex worker: maximum 20 penalty units (s 15(2)). Subsections (1) and (2) are strict liability (s 15(3)). The Act defines “likely to induce” by reference to invitations to work in or obtain work through a sex services business unless the ad clearly indicates the work does not involve sex work (s 15(4)). The relevant issue is how the regulations prescribe allowable forms of advertising (s 24(2)(b)).

  • Misleading statements or implications about having undergone a medical examination which induce a belief about STI or blood borne virus status and lead to contracting for sex work: maximum 20 penalty units (s 16(1)). Strict liability applies to whether the defendant stated or implied having undergone an exam (s 16(2)).

• Administrative civil penalties. Failure to hold a suitability certificate when required is not an offence but the Director may issue a written notice requiring payment of a civil penalty as prescribed by regulation (s 18(3)). The notice must specify amount and time for payment (s 18(4)), and the amount is a debt due to the Territory (s 18(5)). The Act leaves quantum and mechanisms for civil penalties to the regulations.

• Investigatory powers and revocation. The Director may investigate whether a person is suitable to hold a certificate if the Director receives information on matters prescribed by regulation or a contravention of Territory law, guideline or standard governing the operation of the business (s 21(1)). After investigating, the Director may revoke the certificate if the person is no longer suitable or confirm suitability (s 21(2)). The Act does not list explicit investigatory powers such as search or compulsory production; the Director’s functional investigatory toolbox is therefore dependent on other statute or delegated instruments.

• Review and oversight. Review rights are available to affected persons for specified reviewable decisions: refusal to issue a suitability certificate (applicant) and revocation of a suitability certificate (certificate holder) (s 23 and Schedule). Review is to NTCAT under the Northern Territory Civil and Administrative Tribunal Act 2014. The Review Committee must assess and report on the Act’s operation and effectiveness within defined timeframes (s 26).

• Data handling and destruction. Section 22 restricts use of information collected under Part 4 to its original purpose and requires destruction of personal information as soon as practicable after the person stops holding the certificate. Section 28 requires destruction of certain records collected under the repealed Prostitution Regulation Act 1992. These provisions limit the state’s long‑term capability to use administrative data for investigations, trend analysis or prosecutions and are an enforced constraint on enforcement memory.

Enforcement architecture concentrated enforcement levers on criminal law for exploitation and child protection, administrative discretion for suitability certificates, monetary penalties for advertising and misleading medical claims, and NTCAT for review. The Act leaves specific investigative powers, procedural protections and concrete regulatory requirements to delegated instruments. This creates implementation risk: the rules governing fees, what constitutes suitability, the content of advertising regulations, and the exact revocation triggers will be set by regulation or administrative practice rather than in the primary text.

The Act is framed as an overlay to existing Territory and Commonwealth regulatory systems, and it expressly interacts with the Criminal Code, the Public and Environmental Health Act 2011, the Information Act 2002, and broader law domains.

• Criminal Code , general principles. Section 5 expressly applies Part IIAA of the Criminal Code to offences under this Act. Part IIAA contains general principles of criminal responsibility, defences, burden of proof and definitions relevant to crafting offences. That means mens rea definitions, defences, and evidentiary rules from the Criminal Code govern the Act’s offences. For example, the “reckless” mental element referenced in ss 10-11 is to be understood through the Criminal Code framework as applied by s 5.

• Public and Environmental Health Act 2011. Section 6(1) declares sex work a “declared activity” under the Public and Environmental Health Act 2011, importing health definitions and potentially some regulatory levers. But the text then makes two carve‑outs: sex services businesses are exempt from registration under that Act (s 6(2)(a)), and a police officer may not exercise powers or perform functions as an authorised officer under that Act in relation to sex work (s 6(2)(b)). Operationally, this means public‑health obligations can apply (the declared activity status) but routine public health registration and certain enforcement powers are restricted. The Act thereby chooses to apply health law content while restricting specific enforcement channels; the result shifts the primary regulatory enforcement locus to the Director and any regulations under this Act.

• Information Act 2002 and record destruction. Section 22(2) requires destruction of personal information collected under Part 4 (suitability certificates) as soon as practicable after the person stops holding the certificate, despite the Information Act 2002. Section 28 goes further by requiring destruction, despite the Information Act, of all personal information obtained under specified parts of the repealed Prostitution Regulation Act 1992 and of personal information held in the repealed Act’s registers. Those provisions create a statutory override to the usual Information Act retention rules, constraining disclosure and archival use, and affect historical record availability for regulators, researchers and complainants.

• Occupational health and safety, employment, planning, taxation, discrimination laws. Section 3(e) recognises that the sex industry should be able to operate “in accordance with the laws of the Territory and the Commonwealth as they apply to all individuals and businesses generally”, listing employment, occupational health and safety, workers compensation, planning, taxation and discrimination. The Act therefore leaves these general legal duties intact; operators remain subject to the usual employment law and OHS obligations. Any collision between requirements under those Acts and this Act will, absent express conflict, be sequenced by ordinary statutory interpretation principles.

• Delegation and administrative law. The Director is a ministerially appointed public sector employee (s 22A). The Director’s delegation power (s 22B) permits delegation to other public sector employees or, with Ministerial consent, to any other person. That creates potential interface with the Administrative Decisions (Judicial Review) regime and general administrative law: decisions by delegates may be subject to judicial review and merits review where permitted (NTCAT for suitability certificate decisions per s 23). The Schedule limits reviewable decisions to issuance/refusal and revocation.

• Repeal of prior Acts. Section 27 repeals the Prostitution Regulation Acts of 1992, 1993 and 2000. Section 28 mandates destruction of specified records created under the 1992 Act. That terminates the prior licensing or registration registers and replaces them with the new suitability certificate model and privacy rules.

• Interaction with regulations. The Act expressly delegates a wide range of detailed content to regulations (s 24(2)), including fees, advertising requirements, suitability certificate requirements and matters relevant to revocation. This means the practical operation of advertising restrictions, the quantum of civil penalties for non‑certificate operators, what constitutes “suitability”, procedural expectations for investigations, and other granular matters will be specified outside the primary Act.

Overall, the Act is an example of statutory deregulatory intent in one dimension (removing the contract bar, s 7) combined with targeted administrative regulation (suitability certificates) and criminal law overlays for coercion and child protection. It imports public health content while limiting registration and police authorised officer powers, and it overrides general information‑law retention rules for certain records.

The endnotes provide a concise list of amendments up to the consolidation dated 25 May 2024. The Act originally received assent on 13 December 2019 and commenced on 12 June 2020 (Endnotes 2). The relevant recorded amendments and insertions are as follows.

• Statute Law Revision Act 2020 (Act No. 26, 2020) amended s 4 and s 5 (Endnotes 2-3). The specifics of those amendments are not in the consolidated text, but the endnotes record that ss 4 and 5 were amended.

• Justice and Licensing Legislation Further Amendment Act 2022 (Act No. 21, 2022) made several changes: ss 18-21 were amended (Endnotes 3), ss 22A-22B were inserted (creating the Director and delegation provisions), Part 5 heading was amended, and Part 7 transitional provisions were inserted and restructured (Endnotes 3). Those changes reflect a shift from a previous “Commissioner” model to a Director model, and added delegation and transitional regime features (Part 7).

• Justice and Other Legislation Further Amendment Act 2024 (Act No. 9, 2024) amended s 4 and is noted in the endnotes as having commenced select parts from 1 July 2024 with remainder on 25 May 2024 (Endnotes 2-3). The endnotes list s 4 amended by No. 9, 2024 s 42. The 2024 Act also amended or inserted certain parts of the schedule of amendments.

• The endnotes record parts of the Act that were amended, parts that expired, and insertion of new parts over time (Endnotes 3). For example, the change from Commissioner to Director and the consequential delegations in 2022 are explicitly recorded.

Practical effect of the amendment pattern in the text: the Director role and delegation framework (ss 22A-22B) and the amendments to s 18-21 (suitability certificates) were inserted by the 2022 amendments, indicating a reorganisation of administrative responsibility and a possible expansion of delegation. The 2024 amendments to s 4 suggest definition changes, potentially to accommodate other legislative or policy adjustments; the consolidated text reflects those changes.

For lawyers and compliance advisers, it is important to check the textual history for changes to the threshold and procedural requirements for suitability certificates (ss 18-21), the identity of the decision maker (Commissioner to Director), and any consequential regulatory instruments made pursuant to s 24 after those amendments. The Act's endnotes indicate a dynamic statutory context where regulations and ministerially appointed delegates could change the operational requirements.

The Act’s consolidated text contains no references to court decisions or precedent decided under the statute. The Schedule creates NTCAT review rights for two classes of decisions (refusal to issue a suitability certificate and revocation of a suitability certificate; Schedule and s 23), but the statute does not record outcomes or cases. The endnotes do not list any judicial decisions.

What the Act does provide is a statutory channel for merits review: NTCAT has jurisdiction to review reviewable decisions specified in the Schedule (s 23(1)), and the Schedule lists affected persons for those decisions (applicants and certificate holders). Therefore, any litigious challenge to suitability certificate refusals or revocations will proceed by application to NTCAT under the Northern Territory Civil and Administrative Tribunal Act 2014 procedures (s 23 Note). Judicial review (judicially supervised review of administrative action) remains available under general administrative law principles, but the Act itself confines statutory merits review to NTCAT for the two specified decision types.

Because the Act repealed previous prostitution regulation Acts (s 27) and mandates destruction of certain historic registers (s 28), historical litigation referencing the old Acts may remain relevant as legal background but the enforcement and administrative frameworks for the past regime are expressly removed. Practitioners should therefore anticipate that litigation and appeals will focus on the new suitability certificate decisions, on the interpretation of “reasonable steps” in s 8, on the scope of the Director’s investigatory and revocation powers under s 21, and on the evidentiary and constitutional limits to strict‑liability provisions (ss 12-14; ss 15-16).

Given the absence of recorded cases in the text provided, legal research should include subsequent NTCAT decisions and Northern Territory Supreme Court decisions that may have considered administrative law challenges to Director decisions, statutory interpretation of the Act’s offence provisions in conjunction with Part IIAA of the Criminal Code (s 5), and any constitutional challenges or procedural fairness claims linked to the revocation and investigatory processes under s 21.

The Act contains several drafting features and statutory choices that create practical pitfalls for operators, sex workers, regulators, and advisers.

• Threshold effect at three sex workers (s 18). The statutory requirement to hold a suitability certificate applies where an operator “engages 3 or more sex workers” (s 18(1)). This creates a hard threshold incentive. Operators might restructure to keep headcount below three, split operations across entities or use independent contractor arrangements to avoid the certificate requirement. Those structural adaptations may undermine the regulatory intent while complicating enforcement and taxation. Advisers should note the Act’s plain text: count of engaged workers triggers regulatory obligation.

• Ministerial appointment and delegation (ss 22A-22B). The Director is appointed by the Minister (s 22A(1)) and may be named by office or position (s 22A(4)). The Director’s delegation power (s 22B) allows delegation to public sector employees or other persons with Ministerial consent. That creates two practical issues: 1) a high degree of administrative discretion that can produce inconsistent practice between Directors over time; 2) delegation to non‑public employees is possible with Ministerial consent, opening a pathway for outsourcing or third‑party decision‑makers, which raises questions about procedural fairness, conflicts of interest and accountability.

• Data destruction (ss 22(2), 28). The Act requires destruction of personal information collected under Part 4 as soon as practicable after the person ceases to hold a suitability certificate (s 22(2)). It also requires destruction of historical registers under the repealed Prostitution Regulation Act 1992 (s 28), despite the Information Act 2002. That removes the state’s ability to retain longitudinal records about operators and individuals, which may hamper investigations, future audits, and research into industry trends.

• Limited enforcement channels for public health powers (s 6). The Act imports the Public and Environmental Health Act 2011 by declaring sex work a declared activity (s 6(1)), but then exempts sex services businesses from registration under that Act (s 6(2)(a)) and bars police from acting as authorised officers under that Act in relation to sex work (s 6(2)(b)). This combination may create uncertainty about which public health obligations apply, who enforces them, and how those obligations map to the “reasonable steps” test in s 8. Regulators and operators will need clear regulations or guidance to avoid confusion.

• Vague “reasonable steps” standard (s 8). The duty on operators and sex workers to take “all reasonable steps” to adopt and promote safe sex practices (s 8) is undefined. Without regulatory detail, there is legal uncertainty about what measures satisfy the standard, who bears the burden of proof in enforcement, and what penalties apply. Section 24(2) allows the regulations to prescribe advertising and suitability requirements and matters relevant to revocation, but the Act itself leaves a gap.

• Strict liability on age elements (ss 12(3), 13(3), 14(3)). Several child protection subsections impose strict liability as to age. That choice reduces prosecution difficulty where age evidence is strong, but also creates potential for convictions in cases where defendants had reasonable but mistaken beliefs about age. Defenders will need to consider relevant Criminal Code defences, but the Act’s strict liability statement narrows mens rea defences on the age element.

• Advertising carve‑outs and modern media. Section 15(1) prohibits advertisements in newspapers, television or radio other than as in regulations. The Act does not mention online platforms directly. The risk is twofold: advertisers may migrate online where the Act is silent, and enforcement resources may not align with the actual advertising landscape. Regulations can address this (s 24(2)(b)), but until they do, expectations and compliance may be unclear.

• Civil penalty rather than offence for missing certificate (s 18(3)). The Act opts for administrative monetary penalties rather than criminal sanctions where an operator lacks a required suitability certificate. The Director issues notices requiring payment of an amount prescribed by regulation (s 18(3)). This creates an enforcement path that prioritises remediation and revenue collection over criminal sanction but may also be perceived as lighter than a licensing offence. The quantum and collection mechanisms are delegated to regulation.

• Limited reviewable decisions (Schedule and s 23). The Schedule confines NTCAT review to refusal to issue and revocation decisions. Other potentially important administrative actions, such as notices requiring payment of civil penalties under s 18(3) or other regulatory sanctions, are not listed as reviewable decisions under the Schedule unless regulations extend review rights. This narrow list might leave affected parties with narrower avenues for appeal or review and push disputes into judicial review rather than merits review.

These “gotchas” create operational uncertainty that should be addressed in regulations, administrative guidance, or by litigation that clarifies ambiguous terms.

Compliance with the Sex Industry Act 2019 requires attention to both statutory obligations and delegated instruments (regulations and administrative guidance). The following practical checklist and explanation is grounded in the Act’s text.

1. Determine whether a suitability certificate is required (s 18).

   • Count the number of sex workers engaged by your business. If three or more are engaged by the operator, the operator must hold a suitability certificate (s 18(1)).
   • If the operator is a body corporate, ensure each executive officer and any nominated person with day‑to‑day control holds a suitability certificate (s 18(2)). The operator may nominate day‑to‑day controllers (s 17).

2. Apply for a suitability certificate if required (s 19).

   • Lodge an application to the Director and pay the prescribed fee (s 19(1)-(2)).
   • Provide any information required by regulation or by the Director to demonstrate suitability (s 19(3)(a)-(b)). Anticipate background checks, proof of identity and evidence of compliance with public health and workplace laws, as regulations might require.

3. Implement and document “reasonable steps” for safe sex practices (s 8).

   • Although the Act does not define “reasonable steps”, operators should adopt written policies and procedures covering condom and barrier use protocols, STI prevention information, access to medical testing, worker training, client screening, and recordkeeping sufficient to demonstrate steps taken.
   • Ensure sex workers and staff are trained and that records of training and policies are maintained while a certificate is held. Remember that personal information collected under Part 4 must be destroyed when the certificate ceases (s 22(2)), so retain only non‑personal procedural documentation where possible.

4. Follow public health and OHS obligations (s 3(e) and s 6).

   • Review how the Public and Environmental Health Act 2011 applies as sex work is a declared activity (s 6(1)), but note sex services businesses are exempt from registration (s 6(2)(a)) and police are barred from acting as authorised officers under that Act in relation to sex work (s 6(2)(b)). Seek administrative guidance from the Director’s office about which public health standards to meet given the exemption.
   • Maintain standard employment and OHS compliance: workplace safety systems, workers compensation, discrimination compliance and tax obligations remain applicable (s 3(e)).

5. Manage advertising carefully (s 15).

   • Do not place advertisements for sex work in newspapers or on television or radio unless such advertising is expressly permitted by regulation (s 15(1)).
   • Avoid publishing ads that could be “likely to induce a person to seek employment as a sex worker” unless the advertisement clearly indicates the work does not involve sex work (s 15(2)-(4)). If recruiting staff, use neutral job descriptions and clear statements about the nature of work.
   • Monitor regulatory updates for permitted advertising practices (s 24(2)(b)).

6. Avoid prohibited inducement and misleading medical claims (ss 10-11, 16).

   • Do not engage in or facilitate conduct involving intimidation, threats, supply of dangerous drugs, fraud, property damage or similar that could induce performance of sex work or payments (ss 10-11).
   • Do not state or imply that you or another person has undergone a medical examination that would induce a belief about STI status where this is not true , s 16 makes such misrepresentations an offence with strict liability for the statement element (s 16(2)).

7. Protect children and verify ages (ss 12-14).

   • Maintain age‑verification processes to ensure no person under 18 is engaged in sex work or employed in a sex services business. The Act carries severe penalties and strict liability for age in key subsections (ss 12(3), 13(3), 14(3)).
   • Keep documented procedures (without retaining personal information beyond what is necessary and in compliance with s 22).

8. Prepare for Director investigations and revocation risk (s 21).

   • Keep operational records that demonstrate compliance with laws, guidelines and standards governing the business because the Director may investigate on receipt of information about matters prescribed by regulation or contraventions of law or standards (s 21(1)).
   • If subject to an investigation, cooperate with procedural fairness requirements and seek early legal advice given the potential for revocation (s 21(2)) and limited merits review rights under NTCAT (s 23).

9. Manage data with mandated retention and destruction obligations (s 22).

   • Understand that personal information collected under Part 4 must only be used for the purpose for which it was provided and must be destroyed as soon as practicable after the person stops holding a suitability certificate (s 22(1)-(2)). Ensure information management systems support secure destruction after the statutory trigger.
   • Note the broader destruction mandate for historical registers from the repealed Act (s 28) and do not request or attempt to use those destroyed records.

10. Engage regulatory counsel and monitor regulations (s 24).

    • Many operational specifics are delegated to regulations (s 24(2)(a)-(d)). Compliance requires monitoring the regulations for prescribed fees, advertising requirements, suitability criteria and matters relevant to revocation.
    • Consider engaging with the Review Committee processes (s 25-26) to stay informed and to provide industry input when the Committee assesses the operation of the Act.

Practical recordkeeping note: while destruction obligations limit retention of personal data collected under Part 4, retain non‑personal documentation demonstrating policies and operational compliance (for example, anonymised logs or aggregate statistics not constituting personal information), subject always to legal constraints.

If a suitability certificate is refused or revoked, a person may apply to NTCAT for review (s 23). For civil penalty notices under s 18(3) and for criminal charges, seek immediate legal advice and consider both merits review (where available) and judicial review merits.

Compliance therefore hinges on counting workers to determine thresholds, adopting and documenting robust safe‑sex and workplace policies, limiting and monitoring advertising, setting age‑verification processes, and maintaining a data‑management regime that respects the statutory destruction and limited use obligations. Regulations, guidance from the Director, and NTCAT jurisprudence will materially affect how these duties are implemented in practice.
