Severe Substance Dependence Treatment Regulations 2022

The instrument concentrates on documentary and eligibility mechanics around three core concepts taken from the Act: the application procedure for a detention and treatment order, a medical recommendation to the court, and the special warrant enabling a prescribed practitioner to examine a person who cannot otherwise be examined.

Prescribed form and prescribed information. Each step under the Act that requires a form or certain information is matched to a model form in Schedule 1. Regulation 6(1) prescribes Form 1 for s 10(2)(a) applications and sets the minimal information an applicant must provide: applicant contact details, respondent name/date of birth/address/telephone and the applicant signature (reg 6(1)(b)(i)-(iii)). Form 1 also carries procedural directions that are part of the statutory rule: the recommendation must be attached and current at time of filing; the applicant must seek VCAT information about guardianship status; and if a guardian exists the applicant must, within 24 hours of filing, take all reasonable steps to serve the guardian with the application and attached recommendation (Form 1, Schedule 1).

Prescribed practitioners and scope. The Regulations define who may sign recommendations and be paid for them, by prescribing professional categories and an operational exception for practitioners providing care in Victoria Police custody on the police force’s behalf (regs 6(2), 7(1), 8(1), 11(1)). This is a functional definition: fellowship or affiliation with the RANZCP and fellowship of the Australasian Chapter of Addiction Medicine are express categories; otherwise a clinician qualifies only if they are providing care to a person in Victoria Police custody on behalf of Victoria Police.

Recommendation content and clinical consultation. Form 2, which implements s 12(7)(a), demands a structured, factual recommendation. The prescribed information includes confirmation the recommending practitioner is prescribed, that they personally examined the patient, the date and time of the exam, whether the exam was at another person’s request or under a special warrant, a full statement that the practitioner’s opinion that the statutory criteria in s 8(2) apply, the facts supporting that opinion, the name of the proposed treatment centre, and confirmation that the practitioner consulted with a senior clinician at the treatment centre and recorded the senior clinician’s name and consultation time (reg 7(2)(b)(i)-(xi); Form 2). The consultation element creates an interlock between the recommending practitioner and the receiving treatment centre, with an affirmative confirmation that facilities and services are available to treat the patient.

Special warrant mechanics. Form 3 is prescribed for magistrates’ orders to enable a prescribed practitioner to examine a person where that cannot otherwise occur (reg 8(2); Form 3). The warrant authorises, in company with the prescribed practitioner, entry to specified premises subject to s 37 of the Act, and authorises the use of reasonable force to permit the medical examination. The warrant must state an expiry date and be returned to the court unexecuted if not executed by expiry (Form 3; cross-referencing s 13(4) of the Act).

Payment alignment with Medicare schedule. Regulation 11(2) fixes the prescribed rate for recommendations at the rate consistent with the fees in the Commonwealth table of medical services; reg 11(3) gives the meaning of that table. The Regulations therefore align payment for certain Act-specified medical services with a Commonwealth fee schedule.

Revocation and revocation form. Regulation 10 prescribes Form 5 for applications under s 22(1) to revoke detention and treatment orders. Form 5 requires the applicant to state whether they are the person subject to the order, the nominated person, or the guardian, and to attach a copy of the original order.

Interpretative cross-links. The Regulations explicitly adopt specific short definitions: they declare that "the Act" means the Severe Substance Dependence Treatment Act 2010 and that "Victoria Police" has the meaning given in s 3(1) of the Victoria Police Act 2013 (reg 5). The Endnotes also place the Regulations within broader subordinate legislation time limits and cross-reference the Interpretation of Legislation Act 1984 and Subordinate Legislation Act 1994 for style and sunset.

Taken together, the main conceptual thrust is administrative: the Regulations do not alter the statutory thresholds for involuntary detention and treatment, they standardise the paperwork, narrow who can make the medical recommendation or be paid for it, and require a site-specific consultation confirming capacity to admit and treat the patient.

Directly affected parties. The Regulations create procedural duties and entitlements that affect a limited set of actors.

• Applicants to the Magistrates' Court under s 10 of the Act. Form 1 prescribes the information the applicant must supply (reg 6(1)(b)), and imposes filing steps, court attendance and ancillary duties such as seeking VCAT information and serving a guardian within 24 hours if one exists (Form 1). The Regulations thus affect individuals, nominated persons or organisations who may initiate applications under the Act; the Act itself determines who can be an applicant, but the Regulations control documentary form and timing.

• Prescribed registered medical practitioners. Multiple provisions identify who is "prescribed" for recommending detention and treatment (reg 7(1)); for making examinations under warrant (reg 8(1)); for applications that rely on a medical practitioner’s input (reg 6(2)); and for payment eligibility under s 39(1) (reg 11(1)). Practitioners who are fellows or affiliates of RANZCP or fellows of the Australasian Chapter of Addiction Medicine are explicitly included. Private practitioners who are not in those professional categories can still be prescribed only when they provide medical care to a person in Victoria Police custody and that care is provided on behalf of Victoria Police. That affects the pool of clinicians who may lawfully make recommendations and claim payment under the Act, and it creates a narrower route for custody-based clinicians.

• Magistrates' Court and magistrates. The court must use the prescribed forms when exercising the particular functions specified in the Act (regs 6(1)(a), 7(2)(a), 8(2), 9, 10). Form 4 illustrates the court order wording and the standard 14-day detention period, and includes a specified transport authorisation under s 20(4) (Form 4). Magistrates therefore operate within a prescribed documentary framework when issuing warrants and orders.

• Victoria Police and police officers. The Regulations incorporate Victoria Police at multiple points. The definition of "Victoria Police" is adopted by reference (reg 5). For persons in police custody, a broader class of medical practitioner is prescribed (regs 6(2)(c), 7(1)(c), 8(1)(c), 11(1)(c)). Form 3 explicitly directs a named member or "all members of the police force" to accompany a prescribed medical practitioner, to enter premises subject to s 37, and to use reasonable force as necessary (Form 3). The court-issued transport authorisation in Form 4 expressly authorises a police officer to take the person to the treatment centre where necessary.

• Treatment centres and senior clinicians. Form 2 requires the recommending practitioner to consult a senior clinician at the proposed treatment centre, to record the senior clinician’s name and the date and time of consultation, and to confirm that facilities and services are available at that centre (reg 7(2)(b)(viii)-(x); Form 2). Treatment centres therefore have a gatekeeping role for capacity and suitability confirmations.

• Guardians and the Victorian Civil and Administrative Tribunal (VCAT). Form 1 mandates that the applicant request VCAT information about guardianship status. If there is a guardianship order, applicants must take all reasonable steps to serve the guardian with the application, the recommendation and other filed documents within 24 hours (Form 1). Guardians are thus brought into the process and can be parties to later applications including revocation (Form 5 provides a checkbox for guardian as applicant).

Indirectly affected parties and institutional interactions. The Regulations interact with Commonwealth Medicare arrangements by tying the prescribed payment rate to the table of medical services under the Commonwealth Health Insurance Act 1973 (reg 11(2)-(3)). Courts, police custodial health services, treatment centres and practitioners who rely on Medicare billing will need to align billing and reimbursement practices with the Commonwealth schedule. The Regulations also interact procedurally with the Subordinate Legislation Act 1994 by setting a sunset date under that Act and with the Interpretation of Legislation Act 1984 for style and interpretive questions (Endnotes).

Who is not covered by the Regulations. The Regulations do not expand the universe of persons who may be detained or the statutory thresholds for detention; they do not create new offences or penalties; and they do not prescribe payment beyond the limited point of recommending medical practitioners under s 39(1). Other health practitioners, private treatment providers, families and employers may be affected in practice but are not directly regulated unless they act as applicants, guardians, treatment-centre senior clinicians, or prescribed medical practitioners.

The Regulations create a set of mandatory documentary duties and procedural confirmations that are claims on the behaviour of applicants, prescribed medical practitioners, magistrates and treatment-centre senior clinicians. They also provide limited rights tied to those procedural steps.

Applicant duties. An applicant seeking a detention and treatment order must use Form 1 for the purposes of s 10(2)(a) (reg 6(1)(a)), supply the prescribed information (reg 6(1)(b)(i)-(iii)), and attach a recommendation that is current at the time of filing (Form 1). The applicant must take the application to the Magistrates' Court nearest to the respondent’s residence to obtain a hearing date, and must request VCAT information about whether a guardian represents the respondent (Form 1). If a guardian exists, the applicant must take all reasonable steps to serve the guardian with the application and the recommendation within 24 hours of filing (Form 1). Filing and service are explicit procedural duties; failure to comply with those steps may affect the admissibility or validity of the application in court.

Prescribed medical practitioner duties. A recommending or examining practitioner must be prescribed under the Regulations (reg 7(1), reg 8(1)). The practitioner must personally examine the patient (Form 2 requires personal examination and records of date/time), prepare a recommendation identifying the patient, set out explicitly that the s 8(2) criteria apply, and state the facts underpinning that clinical opinion (reg 7(2)(b)(v)-(vi); Form 2). The practitioner must also name the treatment centre proposed for detention, consult with a senior clinician at that centre and record the consultation details and the senior clinician’s confirmation that facilities and services are available (reg 7(2)(b)(vii)-(x)). The practitioner’s signature, name, qualifications, professional address and telephone number must appear on the recommendation (Form 2). For examinations under warrant, the practitioner must be one of the prescribed categories (reg 8(1)) and proceed in company with authorised police in accordance with the warrant (Form 3).

Magistrates' duties and statutory authorisations. The Magistrates' Court must use the prescribed forms when exercising the specified powers (regs 6(1)(a), 7(2)(a), 8(2), 9, 10). Form 4 contains the standard order language for a 14-day detention and sets out transport authorisation language that tracks s 20(4) of the Act, authorising police, ambulance paramedics or non-emergency patient transport providers to take the ordered person to the treatment centre (Form 4). When issuing a special warrant, the magistrate must include an expiry date and can authorise entry and reasonable force as provided by the Act (Form 3).

Treatment-centre senior clinician duties. The Regulations require the recommending practitioner to consult a senior clinician at the proposed treatment centre and record the senior clinician’s name and the date/time of the consultation, and to confirm that the senior clinician has advised that facilities and services are available to treat the person (reg 7(2)(b)(viii)-(x); Form 2). This creates an evidentiary duty on the recommending clinician to obtain and include the receiving centre’s assessment before filing the recommendation.

Payment-related rights and constraints. Regulation 11(2) prescribes the payment rate as the Commonwealth table rate under the Health Insurance Act 1973 for the relevant medical service. Regulation 11(1) specifies which practitioners are eligible to be paid for recommendations under s 39(1) of the Act. The Regulations therefore limit the monetary entitlement under s 39(1) to those practitioners and cap the rate at the corresponding Medicare schedule amount.

Rights to revoke and process for revocation. Form 5 prescribes the application process for revoking a detention and treatment order under s 22(1). It identifies who may apply for revocation by way of checkbox (the person subject, the nominated person, or the guardian), and requires attachment of a copy of the original order. The applicant must file at the Magistrates' Court and obtain a hearing date (Form 5). Thus the Regulations set a clear procedural right and prescribed pathway for seeking revocation.

Warrant execution and safeguards. Form 3 requires an expiry date for a special warrant and obliges return of an unexecuted warrant to the court if not executed by expiry (Form 3). The warrant authorises the use of reasonable force to permit a prescribed practitioner to examine a person, but execution is subject to s 37 of the Act (Form 3). Those crossover references preserve Act-based safeguards while operationalising warrant execution.

What the Regulations do not create. The Regulations do not themselves create criminal penalties, nor do they expand or contract the substantive medical or legal criteria for detention contained in the Act. The duties imposed are largely procedural and documentary; substantive determinations of whether s 8(2) criteria are met remain matters for clinical judgment and judicial consideration under the Act.

The Regulations do not introduce new offences or civil penalties; they operate primarily by prescribing forms, practitioner categories and payment rates that the Act requires or contemplates. Consequently enforcement of the Regulations will be institutional and procedural rather than criminal.

No penalty provisions in the Regulations. A careful reading of the text shows no provision that creates an offence, fines or express compliance penalties. The Table of Provisions and each regulation set out forms and prescribed information requirements, but neither the Regulations nor the Schedule impose statutory penalties for failure to use the forms or supply information. Where enforcement consequences exist, they arise from the Act itself, from court process, or from operational actors refusing to act if prescribed steps are not properly completed.

Court-enforced consequences. The Magistrates' Court plays the central enforcement role when the Act’s detention and treatment scheme is invoked. The Regulations require the court to use prescribed forms for applications, recommendations, warrants and orders (regs 6(1)(a), 7(2)(a), 8(2), 9, 10). If prescribed forms are not used or the prescribed information is missing, the court may decline to act, postpone hearing or dismiss an application; those are procedural enforcement outcomes inherently within the court’s remit. Form 1 explicitly directs applicants to file the application at the Magistrates' Court nearest the respondent’s residence and states that failure to attach a current recommendation will be inconsistent with the filing requirement. The Regulations therefore rely on court gatekeeping rather than on statutory fines.

Operational refusal to effect action. Operational actors such as treatment centres, senior clinicians and transport providers may decline to accept or effect a detention if prescribed consultation confirmations are absent. Form 2 requires written confirmation from a senior clinician that facilities and services are available; absent that confirmation a treatment centre may refuse admission. Similarly, police executing a warrant under Form 3 are authorised to use reasonable force subject to s 37 of the Act; they are not required to act where the warrant is deficient or has expired. The practical enforcement mechanism is therefore refusal to execute or to receive a person where prescribed steps are absent.

Payment controls and audits. Regulation 11 prescribes eligible practitioners and links the payable rate to the Commonwealth table of medical services (reg 11(2)-(3)). Payment claims outside these parameters may be refused by the paying authority or subject to audit under usual public sector financial controls. The Regulations therefore impose a billing constraint that will be enforceable at the payment-processing stage; practitioners seeking higher fees for recommendations will be limited by the prescribed rate.

Warrants and authorised use of force. Form 3 authorises police, in company with a prescribed medical practitioner, to enter premises and use such force as is reasonably necessary to permit examination, subject to s 37 of the Act (Form 3). The enforcement risk here is physical execution of the warrant by police; legal limits on force derive from the Act’s cross-reference and common law. The Regulations specify an expiry date for warrants and require the return of unexecuted warrants to the court if not executed by expiry, which imposes an administrative check and timeline on enforcement actions.

Judicial review and other legal remedies. The Regulations do not themselves identify remedies for non-compliance, but procedural defects in the recommendation, failure to consult a senior clinician, or improper prescription of a recommending practitioner could provide grounds for challenge in the court that issued an order, or for judicial review in the supervisory jurisdiction. This is not to assert that such litigation exists; it is to note that statutory processes typically admit review when statutory prerequisites have been ignored. The Regulations’ prescriptive approach to form and content (for example Form 2’s detailed factual statements) tends to create clear standards against which compliance can be tested in any litigation over process or validity of orders.

Summary. Enforcement under these Regulations will be carried out through courts, operational refusal by treatment centres and police, and payment processing aligned to Commonwealth schedules. The Regulations do not create standalone penalties; they work by conditioning the ability to obtain or execute orders on the presence of prescribed forms, prescribed practitioner status and certain confirmations (for example, senior clinician confirmation of available facilities).

The Regulations explicitly reference and integrate with multiple other statutory frameworks and administrative bodies. These cross-references determine definitions, procedural interfaces and payment arrangements.

Severe Substance Dependence Treatment Act 2010. The Regulations are made under s 40 of the Act (reg 2) and repeatedly implement procedural requirements in the Act: application form and content under s 10(2) (reg 6(1)); medical recommendation rules under s 12 (reg 7); special warrant under s 13 (reg 8); detention and treatment order form under s 20(1) (reg 9); revocation form under s 22(1) (reg 10); and payment for recommendations under s 39(1) (reg 11). The Regulations do not alter the Act’s substantive criteria such as the s 8(2) threshold; instead they prescribe the documentary processes by which the Act is to be operationalised.

Victoria Police Act 2013. The term "Victoria Police" is adopted by reference to s 3(1) of the Victoria Police Act 2013 (reg 5). The Regulations also condition the prescription of additional categories of medical practitioners on whether they provide care to persons in custody at facilities operated by Victoria Police and whether that care is provided on behalf of Victoria Police (regs 6(2)(c), 7(1)(c), 8(1)(c), 11(1)(c)). Form 3 expressly names police officers as the addressees of a special warrant and authorises them to accompany practitioners and use reasonable force. The Regulations therefore intersect operationally with police custodial health arrangements and with magistrates’ powers to authorise police action.

Health Insurance Act 1973 (Commonwealth). Regulation 11(2) prescribes the rate payable for recommendations as the rate consistent with the fee specified in the table of medical services under the Commonwealth Health Insurance Act 1973, and reg 11(3) defines the table of medical services accordingly. That establishes a billing and reimbursement interface with Commonwealth Medicare arrangements. Practitioners and paying authorities must therefore align claims under the Act with the Commonwealth’s table and its interpretive rules, which may affect item numbers, eligibility and reimbursement procedures.

Subordinate Legislation Act 1994 and Interpretation of Legislation Act 1984. The Endnotes record that the Regulations were made on 8 February 2022, commenced on 20 February 2022, and will sunset after ten years on 8 February 2032 under the Subordinate Legislation Act 1994 (Endnotes 1). The Endnotes also record the applicability of interpretive style provisions from the Interpretation of Legislation Act 1984, including that headings, notes, punctuation and examples form part of the instrument and other style effects. This governs how the Regulations should be read and how Schedule headings and notes are treated legally.

VCAT and guardianship law. Form 1 requires the applicant to request VCAT for information about whether the respondent is represented by a guardian under a guardianship order, and, if so, to serve that guardian within 24 hours (Form 1). The Regulations therefore create a direct procedural interaction with guardianship processes overseen by VCAT, and introduce a timing obligation where guardianship is present.

Magistrates’ Court procedures and criminal/administrative law. The Regulations are framed for use in proceedings in the Magistrates' Court of Victoria, with forms that specify court reference, hearing details and the court’s role in setting hearing times and issuing warrants and orders (Forms 1, 3, 4, 5). Those procedures must interact with existing Magistrates' Court rules and practice directions, including service rules, proofs of service and hearing timetables.

Public health and mental health law. While the Regulations themselves do not reference specific public health acts, their deployment will intersect with any other statutory duties under Victorian public health, mental health or disability statutes where involuntary detention or treatment is concerned. The careful requirements in Form 2 to state facts, proposed treatment centre and availability of services will cause overlaps in operational decision-making where other laws regulate consent, capacity, or involuntary treatment.

Practical consequence of these interactions. The Regulations align Victorian administrative and court processes with Commonwealth billing schedules, police custody health arrangements and VCAT guardianship records. They standardise documentary evidence the Magistrates' Court will expect when exercising statutory powers. Where any of these other laws or administrative systems are out of step with the prescribed forms or payment rules, operational difficulties may arise: for example, an inability to secure a timely senior clinician confirmation because treatment-centre processes differ, or mismatch in payment codes between the Commonwealth table and executed services.

This statutory rule is a single-version instrument with a short recorded amendment history.

Making and commencement. The Endnotes record that the Severe Substance Dependence Treatment Regulations 2022 (S.R. No. 8/2022) were made by the Governor in Council under s 40 of the Severe Substance Dependence Treatment Act 2010 on 8 February 2022 and came into operation on 20 February 2022 (Endnotes 1; reg 3). Regulation 2 also records the authorising provision as s 40 of the Act.

Revocation of prior regulations. Regulation 4 expressly revokes the Severe Substance Dependence Treatment Regulations 2011. The Endnotes’ explanatory details add that S.R. No. 5/2011 was extended in operation by S.R. No. 7/2021 and is now revoked by reg 4. The replacement of the 2011 Regulations with this 2022 set is therefore explicit.

No subsequent amendments recorded. The Table of Amendments in the instrument states that there are no amendments made to the Regulations by statutory rules, subordinate instruments or Acts (Endnotes 2). Further, the version provided notes that it does not contain amendments not yet in operation (Endnotes 3).

Sunset provision. The Endnotes record that the Regulations will sunset 10 years after making on 8 February 2032 under the Subordinate Legislation Act 1994 (Endnotes 1). That imposes a time limit on the Regulations’ effectiveness unless they are remade or extended under the subordinate legislation regimes.

Interpretive and style amendments. The Endnotes also record the effect of the Interpretation of Legislation Act 1984 on the instrument’s style and interpretive scope, including that headings, notes and punctuation form part of the statutory rule as from 1 January 2001 and other interpretive effects (Endnotes 1).

Explanatory detail and footnote. The explanatory details indicate a single stylistic note relating to reg 4, and the Endnotes include standard references for location and currentness of legislation. There are no recorded transitional provisions, savings clauses or staged commencements; the Regulations took full effect on the stated commencement date.

Practical implication for users. For practitioners, courts and agencies the current Regulations are a fresh, complete set replacing the 2011 instrument. There are no later amendments to account for in the instrument text; the sunset date in 2032 is the only timed provision of note. Users should, however, monitor the legislation.gov.au site or official government publications for any subsequent statutory rules that may amend or replace this instrument before 2032.

The Regulations themselves do not list any cases and the Endnotes do not record litigation. The instrument is procedural and prescriptive in form and establishes documentary requirements, practitioner categories and a payment rate. As of the text provided, there is no recorded litigation history attached to these Regulations.

Possible litigation vectors implied by the text. Although there are no named cases in the instrument, the Regulations’ prescriptive documentary and eligibility requirements create identifiable points where litigation or judicial review might be brought. The text suggests the following procedural vulnerabilities or areas where parties could litigate the legality of a detention or the validity of a recommendation or warrant, grounded in the Regulations’ content:

• Non-compliance with prescribed form or prescribed information. Form 2 contains detailed mandatory information (reg 7(2)(b)(i)-(xi)). If a recommending practitioner or applicant files a recommendation or application that omits required elements, an affected person may challenge the procedural validity of the recommendation or order. The Regulations make the information requirements explicit, which creates a clear benchmark against which compliance can be judged in court.

• Whether the recommending or examining practitioner was properly "prescribed" under the Regulations. The Regulations prescribe who qualifies as a prescribed registered medical practitioner (regs 6(2), 7(1), 8(1), 11(1)). Litigation may concern whether a particular practitioner satisfies those criteria, for example whether a practitioner who provided care in police custody did so "on behalf of Victoria Police" as required by the Regulations. The instrument’s text creates a definitional test that could be litigated.

• Failure to consult or to secure senior clinician confirmation. Form 2 requires consultation with, and confirmation by, a senior clinician at the proposed treatment centre (reg 7(2)(b)(viii)-(x)). Litigation could arise where an order was made but the required consultation did not occur or where the senior clinician’s confirmation was inadequate or misleading.

• Warrant execution issues. Form 3 authorises police to enter premises and use reasonable force subject to s 37 of the Act (Form 3). Challenges could be mounted over unlawful entry, excessive force, or the warrant being stale or not executed by the expiry date. The Regulations require an expiry date and returning of unexecuted warrants, creating specific administrative obligations that could be the subject of challenge.

• Payment disputes. Reg 11 caps the prescribed rate at the Commonwealth table of medical services. Disputes about entitlement to payment or appropriate item numbers consistent with the table could be litigated or subject to administrative review, given the cross-jurisdictional billing interplay with Medicare.

No cases named. Because the Regulations do not list or rely on judicial decisions, and because the version provided records no amendments or litigation in its endnotes, there is no litigation history embedded in the instrument text for citation.

Practical consequence. For practitioners advising clients, the Regulations’ prescriptive content is more likely to generate interlocutory or administrative litigation about compliance than to generate substantive appeals on the lawfulness of detention criteria. Where a party alleges that statutory prerequisites were not met, the explicit form-based requirements in the Regulations will provide discrete grounds for challenge or for raising injunction applications to prevent an order’s execution.

The Regulations are short but precise, and a small number of practical traps arise directly from the text. These are matters that practitioners, medical staff, police and applicants should watch for because the Regulations make them mandatory or condition other actors’ participation on them.

Recommendation must be current at filing. Form 1 requires that a recommendation attached to the application be "current at the time of the application" (Form 1). There is no statutory definition of "current" in the Regulations. Practitioners should assume recency is material and ensure the examination and recommendation date and time specified in Form 2 correspond closely to the application filing time to avoid a challenge on currency grounds (reg 7(2)(b)(iii)).

Strict practitioner prescription for non-custodial settings. Only fellows or affiliates of RANZCP and fellows of the Australasian Chapter of Addiction Medicine are automatically prescribed (regs 6(2)(a)-(b), 7(1)(a)-(b)). A treating private general practitioner who is not a fellow in those bodies will not be "prescribed" for the Act’s recommendation purposes unless that practitioner is providing care to the person in Victoria Police custody on behalf of Victoria Police (regs 6(2)(c), 7(1)(c)). That limits the set of clinicians who may lawfully make recommendations for community-based patients and may lead to delays securing a permitted recommender.

Consultation requirement with senior clinician. Form 2 requires that the recommending practitioner consult a senior clinician at the proposed treatment centre, record the senior clinician’s name and the date/time of consultation, and confirm that the treatment centre has suitable facilities and services (reg 7(2)(b)(vii)-(x)). Failure to obtain this confirmation before filing could result in the court refusing to act, or treatment centres refusing admission. Practitioners must therefore secure institutional confirmation before filing.

Dependence on treatment-centre capacity. The Regulations require a treatment-centre senior clinician to confirm availability of facilities and services. The Regulations do not provide a mechanism to secure a treatment place if a centre declines to accept the patient or lacks capacity. This may create a practical bottleneck: the court can make an order only where a treatment centre is identified and has confirmed capacity (Form 2); an inability to find a centre will impede the detention pathway.

Timing and service to guardians. Form 1 obliges applicants to request VCAT information about whether a guardian is in place and, if there is a guardianship order, to take all reasonable steps to serve the guardian with the application and recommendation within 24 hours of filing (Form 1). Applicants who do not check VCAT or fail to effect timely service may have procedural shortcomings used against them in court.

Special warrant expiry and return. Form 3 requires an expiry date for special warrants and obliges return of an unexecuted warrant to the court if it cannot be executed by expiry (Form 3; s 13(4) cross-reference). Failure to return an unexecuted warrant, or executing a warrant past expiry, risks the court treating the search or examination as unauthorised.

Transport authorisation scope. Form 4’s transport authorisation for a detainee lists police officers, ambulance paramedics, non-emergency patient transport providers and "anyone else specified in this order" (Form 4). That broad authorisation can be useful operationally, but it also requires the court to be precise if it wishes to limit who may be used for transport. Practitioners should ensure the order specifies the authorised transporter to avoid operational disputes.

Payment limited to Commonwealth schedule. Reg 11(2) ties the prescribed rate to the Commonwealth table of medical services under the Health Insurance Act 1973. Practitioners cannot expect a higher bespoke state fee for recommendations under s 39(1) unless separate arrangements exist; payment disputes could arise if practitioners bill above the table.

No penalties in the Regulations. The Regulations do not provide for penalties for failure to comply with prescribed forms. That is a double-edged sword: there are no fines, but failure to comply can have operational consequences such as refusal of court action or treatment centres refusing admission. Practitioners should not mistake the absence of fines for absence of consequence.

Interpreting "on behalf of Victoria Police". The exception that permits additional practitioners to be prescribed when providing care "on behalf of Victoria Police" to persons in police custody is fact-specific and may be open to debate in particular cases (regs 6(2)(c), 7(1)(c), 8(1)(c), 11(1)(c)). Practitioners and police must be clear on the contractual or administrative basis that amounts to "on behalf of Victoria Police" to avoid disputes about practitioner eligibility.

Record-keeping and evidentiary sufficiency. The forms demand precise factual statements, including the facts on which a practitioner’s opinion is based (Form 2). Practitioners should record clearly whether facts are personally observed or communicated by others, and retain contemporaneous notes to support the Form 2 content in any subsequent hearing or review.

This section sets out concrete, sequential steps to comply with the Regulations when seeking a detention and treatment order, making a recommendation, obtaining or executing a special warrant, or revoking an order. Each step references the relevant regulation or form provision.

1. Identify whether an application is appropriate under the Act. Confirm substantive eligibility under the Act’s criteria in s 8(2) before commencing the procedural steps required by the Regulations. The Regulations do not alter the Act’s substantive criteria, they prescribe form and process (regs 6-11).

2. Secure an appropriate prescribed medical practitioner. For non-custodial patients, ensure the recommending practitioner is either a fellow or affiliate of the Royal Australian and New Zealand College of Psychiatrists, or a fellow of the Australasian Chapter of Addiction Medicine (regs 6(2)(a)-(b), 7(1)(a)-(b)). For persons in Victoria Police custody, confirm whether the practitioner provides care "on behalf of Victoria Police" so that the practitioner qualifies under the custody exception (regs 6(2)(c), 7(1)(c)).

3. Practitioner to examine patient and prepare Form 2. The recommending practitioner must personally examine the patient and complete Form 2, including: patient details and date/time of exam; confirmation the practitioner is prescribed; whether the exam was at the request of another person or under a special warrant; a statement that all criteria in s 8(2) apply; the facts supporting that opinion, distinguishing observed facts from reported facts; the proposed treatment centre; confirmation of consultation with the senior clinician at that centre and the senior clinician’s name and time of consultation; and the practitioner’s full name, qualifications, professional address and contact number (reg 7(2)(b)(i)-(xi); Form 2).

4. Consult and obtain senior clinician confirmation. Before filing, the recommending practitioner must contact the proposed treatment centre’s senior clinician, discuss the case, and secure a confirmation that facilities and services are available at the centre to treat the patient. Record the senior clinician’s name and the date/time of the consultation in Form 2 (reg 7(2)(b)(viii)-(x); Form 2). Retain contemporaneous written or electronic records of this consultation.

5. Prepare the application using Form 1. The applicant must complete Form 1 with their details and the respondent’s details, attach the current recommendation (Form 2), and sign (reg 6(1)(a)-(b); Form 1). Double-check that the recommendation is current at the time of application filing.

6. Check guardianship with VCAT and serve guardian if applicable. As required by Form 1, request VCAT for information on whether the respondent is represented by a guardian. If a guardianship order exists, take all reasonable steps to serve the guardian with the application and attached recommendation within 24 hours of filing (Form 1). Keep proof of VCAT inquiries and service steps.

7. File at the correct Magistrates’ Court and obtain a hearing date. Take the application to the Magistrates' Court nearest the respondent’s place of residence to obtain a hearing date and time (Form 1). Ensure filing is timestamped and that the court completes the hearing details on the form.

8. If an examination requires a special warrant, apply using Form 3. Where the patient cannot be examined voluntarily, apply to the Magistrates' Court for a special warrant using Form 3, providing the person’s details and specifying premises to be entered (reg 8(2); Form 3). The magistrate will specify the expiry date. Be prepared to accompany a prescribed medical practitioner and a police officer to execute the warrant. Return an unexecuted warrant to the court if not executed by expiry (Form 3).

9. If the court makes a detention and treatment order, the court will issue Form 4. Form 4 is the standard order for 14 days from admission and includes the transport authorisation provision permitting police, ambulance paramedics, or others specified to effect transport under s 20(4) (reg 9; Form 4). Ensure the order correctly identifies the treatment centre and transport persons.

10. If a detention and treatment order is to be revoked, use Form 5. The person subject, the nominated person or the guardian may apply to revoke an order using Form 5, attach a copy of the original order and file at the Magistrates' Court to obtain a hearing date (reg 10; Form 5).

11. Billing and payment compliance for recommending practitioners. If claiming payment under s 39(1), ensure you are a prescribed practitioner under reg 11(1) and charge at the rate consistent with the Commonwealth table of medical services under the Health Insurance Act 1973 as prescribed by reg 11(2)-(3). Confirm applicable Medicare item numbers and documentation required by the paying authority before submitting a claim.

12. Maintain contemporaneous records and evidence of compliance. Keep verbatim copies of all completed Forms 1-5, electronic or hard copies of the recommendation with the factual bases required in Form 2, records of senior clinician consultations, proof of VCAT inquiries, proof of service to guardians, and timestamps for filings and warrant execution. These records will be key to demonstrating compliance if procedural questions are raised.

13. Practical liaison tips. Practitioners and applicants should pre-verify treatment-centre capacity before filing to avoid a situation where the court issues an order but no centre can accept the patient. Where police custody is involved, coordinate early with Victoria Police custodial health services to confirm whether a practitioner is providing care "on behalf of Victoria Police" to qualify under the custody exception. For magistrates and court staff, standardise filing and hearing calendar entries to ensure Form 1’s requirement to use the nearest Magistrates' Court is consistently applied.

14. Quality control and audit readiness. Given the payment is tied to the Commonwealth table, ensure financial offices and practitioners understand Medicare coding and retention of invoices. Maintain audit trails showing that the practitioner was prescribed, the recommendation was current at filing, consultation with the senior clinician occurred, and all filing and service steps were completed in time.

By following these steps and keeping rigorous documentary evidence of each prescribed element in the Regulations and forms, applicants, practitioners and treatment centres can significantly reduce the risk of procedural rejection, dispute or litigation.
