Service Victoria (Transfer of Professional Engineers Registration Functions) Regulations 2021

The Regulations are brief and operate through a few tightly defined concepts. First, the statutory foundation: the Regulations are made under section 58 of the Service Victoria Act 2018 (regulation 2). Second, the notion of a transferred identity verification function: regulation 5 makes those functions listed in Schedule 1 “transferred identity verification functions” for the purposes of section 10(5) of the Service Victoria Act 2018. The Note under regulation 5 restates that those functions are to be performed by the Service Victoria CEO “on and from the commencement date” specified in regulation 3, linking the transfer to the Act’s transfer mechanism.

Third, channel-limited transfer: every Schedule item conditions the transfer on the application or information being “made by input into an Internet site or mobile application maintained for that purpose.” That language defines the operational boundary of the transfer. It implies that the transfer applies only to identity verification embedded in those particular digital channels and not to identity verification undertaken where the relevant information is provided by other means. Fourth, the subject-matter of the transferred functions: the Schedule lists precise procedural contexts in the Professional Engineers Registration Act 2019 where identity information is collected and identity verification occurs. The listed contexts are applications for registration or endorsement (ss 10 and 11), certain items in s 13(a)(i) and (ii), s 14(1)(c), and renewals under s 20. Each Schedule entry says both “collecting identity information provided with [the specified application or purpose]” and “verifying the applicant’s identity.”

Fifth, the source agency: each Schedule entry records the Business Licensing Authority as the service agency from which functions are transferred. Regulation 4 defines “Business Licensing Authority” by reference to the Business Licensing Authority Act 1998; regulation 4 also defines “the Act” as the Service Victoria Act 2018. Finally, temporal and lifecycle concepts: commencement is 1 November 2021 (regulation 3), the Regulations were made on 26 October 2021 (Endnotes), and the Endnotes record an automatic sunset ten years after making under the Subordinate Legislation Act 1994.

These concepts together create a narrowly scoped administrative reallocation: a set of identity-collection and verification tasks tied to specific registration and renewal processes for professional engineers, moved from one named public agency to the Service Victoria CEO where and only where those tasks arise through particular online channels.

Primary institutional actors. The Regulations directly affect two named public actors. First, Service Victoria, or more precisely the Service Victoria CEO, is the recipient of the transferred functions. The Note to regulation 5 explicitly states that a transferred identity verification function “is to be performed by the Service Victoria CEO” (see regulation 5 and its Note). Second, the Business Licensing Authority is the agency from which the listed identity-verification functions are transferred; Schedule 1 records the Business Licensing Authority in Column 3 for each item.

Statutory subjects and private parties. The instrument affects persons who interact with the Professional Engineers Registration Act 2019 in specified ways. The Schedule specifies applications for registration and for endorsement, certain matters under section 13(a)(i) and (ii), a matter under section 14(1)(c), and renewal applications under section 20 of the Professional Engineers Registration Act 2019. The practical cohort therefore consists of applicants for registration as professional engineers (including applications for registration in an additional area of engineering), applicants for endorsement of registration, persons providing the identity information contemplated by ss 13(a)(i) and (ii) and s 14(1)(c), and applicants for renewal of registration, but only where those interactions occur by input into an Internet site or mobile application maintained for that purpose.

Operational staff and vendors. The Regulations will also affect the teams and contractors who operate the online channels referenced. Each Schedule item conditions the transfer on information “collected from input into an Internet site or mobile application maintained for that purpose.” The identity of the maintainer is not specified in the Schedule, but the practical implication is that whoever maintains the relevant internet site or mobile application will have to align with the change in which body performs identity verification for qualifying inputs. That can include software vendors, IT operations teams, and digital service managers within the Business Licensing Authority and Service Victoria.

Regulatory and legal boundaries. The Regulations interact with three named Acts: the Service Victoria Act 2018, the Professional Engineers Registration Act 2019, and the Business Licensing Authority Act 1998, as referenced in regulation 4 and Schedule 1. They also sit within the lifecycle framework of subordinate legislation under the Subordinate Legislation Act 1994, which imposes the 10-year sunset noted in the Endnotes. The end result is that affected private parties are narrowly defined: applicants who submit identity information via specified digital channels for the specified professional-engineer registration processes; the effect does not, in the text, extend to in-person, paper, or other channels.

Geography and timing. The Regulations commenced 1 November 2021 (regulation 3). The Endnotes record the making date of 26 October 2021 and the sunset date 26 October 2031. Amendments were made by the Service Victoria (Miscellaneous) Amendment Regulations 2024 (S.R. No. 38/2024) that, among other changes, substituted regulation 1 and revoked certain provisions; see the Table of Amendments in the Endnotes for dates. Those amendments will affect the instrument’s text and therefore which parties are impacted by the current version.

Core duty imposed by the instrument. The Regulations do not create wide-ranging new powers or duties beyond prescribing which identity-verification functions are “transferred identity verification functions” for the purposes of the Service Victoria Act 2018. The concrete duty is that the identity verification functions listed in Schedule 1 become functions to be performed by the Service Victoria CEO under section 10(5) of the Service Victoria Act 2018 (see regulation 5 and its Note). The Schedule identifies the tasks as “collecting identity information provided with an application” in particular statutory contexts and “verifying the applicant’s identity.”

Allocation of operational responsibility. The Schedule specifies the Business Licensing Authority as the service agency from which the listed functions are transferred. That allocates operational responsibility away from the Business Licensing Authority and to the Service Victoria CEO for those items where the channel condition is met. The text does not set out the Service Victoria CEO’s internal procedures or standards for verification; it only prescribes that the specified identity-verification functions are transferred.

Channel-conditioned scope. A key limiting duty is the channel condition: the transfer applies only where the application or identity information is submitted by input into an Internet site or a mobile application maintained for that purpose. If the identity information or application is provided by a different means the Schedule language suggests the transfer does not apply. The Regulations therefore create a duty for the Service Victoria CEO to perform verification for qualifying digital inputs, and implicitly leave non-qualifying channels outside the transferred functions.

Rights and obligations not enumerated in the Regulation. The Regulations do not themselves create procedural rights for applicants, nor do they specify timeframes, evidence standards, privacy protections, recordkeeping obligations, or appeal rights in relation to identity verification. Any such rights or obligations would have to be located in the Service Victoria Act 2018, the Professional Engineers Registration Act 2019, the Business Licensing Authority Act 1998, or other instruments. The Regulations’ silence on procedures means the operational standards and rights applicable to applicants will derive from those parent Acts, Service Victoria’s internal rules, or digital service arrangements rather than from these Regulations.

Lifecycle obligations. The Endnotes record a sunset at 10 years after making under the Subordinate Legislation Act 1994. That creates a time-limited duty allocation: unless extended or remade, the transferred functions will revert to their prior legal state or require reauthorisation after the sunset. The Table of Amendments also shows that the instrument has been subject to amendment by S.R. No. 38/2024, which substituted regulation 1 and revoked certain parts of the instrument, indicating changes to duties can occur by later subordinate instruments.

Summary. The Regulations operate as a reallocation of specific administrative tasks related to identity verification for selected professional-engineer registration interactions submitted through particular digital channels. The duty is placed on the Service Victoria CEO to perform those transferred verification functions; the Regulations do not set out verification standards, complaint mechanisms, or consequential administrative arrangements.

Absence of penalty provisions. The Regulations themselves do not create any penalties, offences, or express enforcement mechanisms. A search of the Regulations’ provisions shows no penalty clauses or criminal or civil sanctioning language. The Schedule simply identifies the identity verification functions that are transferred and the agency from which they are transferred. Therefore these Regulations do not on their face impose direct sanctioning rules or administrative penalties.

Enforcement of the transferred functions. The instrument allocates certain duties to the Service Victoria CEO (see regulation 5 and its Note), but it does not specify monitoring, compliance, review, or enforcement steps for ensuring those duties are performed. Any enforcement of performance obligations for the Service Victoria CEO will logically derive from the Service Victoria Act 2018 (the authorising Act) and from relevant administrative oversight mechanisms applicable to public sector executives rather than from these Regulations themselves. The Regulations expressly operate “for the purposes of section 10(5) of the Act” (regulation 5), so enforcement and accountability mechanisms embedded in the Service Victoria Act 2018 or in public sector governance frameworks would govern compliance.

Relationship to the Professional Engineers Registration Act 2019. The Schedule ties the transferred verification work to specific sections of the Professional Engineers Registration Act 2019 (ss 10, 11, 13(a)(i) and (ii), 14(1)(c), and 20). Any sanctions or procedural consequences for incorrect identity verification, false information in applications, or breach of statutory obligations connected to those registration processes will derive from the Professional Engineers Registration Act 2019 or other applicable legislation, not from these Regulations. The Regulations do not prescribe how identity verification should be validated or what recourse applicants might have if verification is incorrect or contested.

Administrative accountability. Because the transfer is to the Service Victoria CEO, normal lines of administrative accountability for Service Victoria apply. The Regulations do not specify internal reporting requirements, performance indicators, or audit steps. Enforcement in the sense of ensuring the identity verification tasks are performed will depend on the oversight available under the Service Victoria Act 2018, the Department’s governance arrangements, and any directions or service-level agreements between Service Victoria and other agencies. The Endnotes indicate the Regulations were made by the Governor in Council under s 58 of the Service Victoria Act 2018, which signals executive-level authorisation rather than a statutory criminal or civil enforcement model within the Regulations themselves.

Sunset and compliance continuity. The instrument will sunset ten years after making under the Subordinate Legislation Act 1994, unless otherwise extended or remade. That temporal feature creates an enforcement and continuity risk from a compliance perspective: if the transfer expires without transitional arrangements, responsibility for the relevant verification tasks may revert or require new authorisation. The Regulations do not set out transitional enforcement rules in that event.

Primary statutory connections. The Regulations are an implementation instrument under the Service Victoria Act 2018. Regulation 2 expressly states they are made under section 58 of the Service Victoria Act 2018. Regulation 5 identifies the transferred functions “for the purposes of section 10(5) of the Act,” creating a specific link between the Regulations and the Service Victoria Act 2018. The Schedule, in turn, links the transferred identity verification functions to several provisions of the Professional Engineers Registration Act 2019: sections 10, 11, 13(a)(i) and (ii), 14(1)(c), and 20. Regulation 4 defines “Business Licensing Authority” by cross-reference to the Business Licensing Authority Act 1998.

Channel-specific interplay. The transfer is strictly channel-specific: it applies when identity information or applications are provided by input into an Internet site or a mobile application “maintained for that purpose.” That creates an interface between digital service-delivery arrangements and the substantive registration statute. If the Professional Engineers Registration Act 2019 prescribes certain steps or documentary requirements for identity verification, those substantive requirements remain in force; these Regulations merely shift the institutional actor who performs the identity-checking task for qualifying online channels.

Administrative and subordinate legislation framework. The Endnotes show the Regulations were made by the Governor in Council under the Service Victoria Act 2018 and are subject to the Subordinate Legislation Act 1994 sunset provisions. The Endnotes also reproduce interpretative guidance from the Interpretation of Legislation Act 1984 concerning headings, examples, punctuation, numbering and other style issues. In practice that means the Regulations sit within the usual Victorian subordinate legislation framework, subject to normal rules about commencement, amendment, revocation, and automatic sunset unless affirmative action is taken.

Amendments and revocations. The Table of Amendments records that the Service Victoria (Miscellaneous) Amendment Regulations 2024 (S.R. No. 38/2024) made changes, including substituting regulation 1 and revoking regulation 6 and Schedule 2. Those amendments, which commenced on 29 May 2024 for regs 18 to 20, affect the structure and content of the instrument. The presence of such amendments demonstrates that the instrument is capable of being adjusted by subsequent subordinate instruments, so its interactions with other laws can change over time.

Privacy, data and other regulatory overlays. The Regulations require collection and verification of identity information but do not specify privacy, data-protection, or records-retention standards. Any obligations in those domains would be governed by other laws and policies, such as information privacy laws and Service Victoria internal policies. The Regulations’ silence on these matters means implementers must look to the Service Victoria Act 2018, the Professional Engineers Registration Act 2019, and other applicable statutes and policies to determine data-handling obligations. The Schedule’s channel condition also implies technological and contractual interactions with parties that maintain the internet sites and mobile applications.

Transitional and practical interactions. The Regulations move certain tasks from the Business Licensing Authority to the Service Victoria CEO. The nature of that transfer will require practical interfacing between agencies , for example, data sharing, operational handover, and possibly service-level agreements , although the Regulations do not themselves mandate those arrangements. The instrument therefore interfaces with administrative law principles and agency operational policies rather than altering substantive registration law provisions in the Professional Engineers Registration Act 2019.

Making and commencement. The Endnotes record that the Service Victoria (Transfer of Professional Engineers Registration Functions) Regulations 2021 were made on 26 October 2021 by the Governor in Council under section 58 of the Service Victoria Act 2018 and came into operation on 1 November 2021 (regulation 3). The Endnotes also record the statutory sunset default under the Subordinate Legislation Act 1994, with the instrument to “sunset 10 years after the day of making” on 26 October 2031 unless action is taken.

Subsequent amendments. The Table of Amendments in the Endnotes records the Service Victoria (Miscellaneous) Amendment Regulations 2024, S.R. No. 38/2024. That instrument was made on 28 May 2024. The Table notes that regulations 18-20 of that amendment instrument commenced on 29 May 2024 (see the Table entries). The front matter of the Regulations shows editorial notes that regulation 1 was substituted by S.R. No. 38/2024 regulation 18, and that regulation 6 and Schedule 2 were revoked by S.R. No. 38/2024 regulations 19 and 20 respectively. Those references show that the 2024 miscellaneous amendment modified the 2021 Regulations’ structure.

Recorded textual edits. Within the Regulations text itself there are brief marginal notes indicating substitutions and revocations: “Reg. 1 substituted by S.R. No. 38/2024 reg. 18.” “Reg. 6 revoked by S.R. No. 38/2024 reg. 19.” “Sch. 2 revoked by S.R. No. 38/2024 reg. 20.” These annotations indicate which parts of the original instrument were changed by the 2024 amendment. The exact effect of the substitution of regulation 1 is limited to the Objective provision text; the instrument retains the core operative provisions (regulations 2 to 5 and Schedule 1) in the published version incorporated to 29 May 2024.

Lifecycle disposition. The Endnotes reproduce the Subordinate Legislation Act 1994 requirement that subordinate instruments “sunset” after 10 years unless remade or extended. That places a hard temporal limit on the Regulations’ effect absent further legislative action, with the sunset scheduled for 26 October 2031. The presence of the 2024 amendments demonstrates that the instrument can and has been modified by later subordinate rules.

Lack of explanatory detail entries. The Explanatory Details section in the Endnotes contains “No entries at date of publication,” which indicates there is no further published explanatory material within this document beyond the simple notes in the Table of Amendments and the Endnotes. For anyone tracing amendment history it will be necessary to consult the S.R. No. 38/2024 instrument itself for the precise text of the substitutions and revocations.

Practical reading. Practitioners should note that the instrument’s current form as incorporated to 29 May 2024 includes the 2024 edits reflected in the marginal notes. Any further changes after that date will be recorded in later versions. The substantive transfer of identity verification functions from the Business Licensing Authority to the Service Victoria CEO, for the channel-conditioned items in Schedule 1, remains the core effect preserved through the identified amendments.

The Regulations themselves, as published, contain no entries describing litigation or judicial consideration. The Explanatory Details section explicitly lists “No entries at date of publication.” There are no reported cases, appeals, or tribunal decisions cited within the Regulations, the Endnotes, or the Table of Amendments that concern the interpretation or application of these Regulations. The document does not refer to any precedent or litigation that has tested the transfer mechanism or the application of the provisions to particular factual circumstances.

Practical consequence of the absence. The absence of litigation entries in the instrument means there is, within this source, no judicial gloss on the scope of the transfer, on the channel condition for online input, or on the relationship between the Service Victoria CEO’s duties and the functions retained by the Business Licensing Authority. Any interpretive issues that might arise in practice , for example, whether a particular online channel counts as “maintained for that purpose,” or whether hybrid applications fall within the transfer , were not resolved in judicial material recorded here.

Where to look for dispute sources. Although this instrument contains no litigation history, practical disputes could arise in operational contexts: for example, data-handling disagreements between agencies, contested identity-verification decisions by Service Victoria in relation to registration applications, or transitional issues arising from the instrument’s sunset. Any such disputes would likely engage the Service Victoria Act 2018, the Professional Engineers Registration Act 2019, administrative law remedies, or information-privacy frameworks. However, this instrument does not itself record or adjudicate such conflicts.

Recommendation implicit in silence. Because the Regulations do not contain litigation history, parties implementing or affected by the transfer should treat potential edge cases as untested by the courts in the record supplied here, and plan for administrative dispute-resolution processes, inter-agency agreements, and procedural clarity to reduce the risk of contested decisions that might otherwise escalate to litigation.

Channel condition restricts coverage. The Schedule repeatedly conditions the transfer on the application or identity information being “made by input into an Internet site or mobile application maintained for that purpose.” That phrase is narrowly decisive. If an applicant submits identity information by paper, email, phone, or in person, the Schedule language suggests the transfer does not apply. Implementers and advisers must not assume the transfer covers all identity verification connected to the Professional Engineers Registration Act 2019; it is limited to inputs via the specified digital channels. Failure to spot that limitation can lead to operational confusion about which body is responsible for verifying identity in a given case.

Role of the Service Victoria CEO, not Service Victoria generally. The Note to regulation 5 states that a transferred identity verification function “is to be performed by the Service Victoria CEO.” The instrument assigns responsibility to the CEO office-holder, not generically to a department or to Service Victoria as a conceptual agency. Practical implementation should therefore clarify internal delegation, delegation instruments, and the persons authorised to act on behalf of the CEO. Misreading the assignment as a non-executive transfer to a unit or team without formal delegation could create governance issues.

No procedural standards in the Regulations. The Regulations transfer the tasks of “collecting identity information” and “verifying the applicant’s identity” but do not prescribe the required documents, verification thresholds, timeframes, recordkeeping standards or privacy safeguards. Parties should not assume that the Regulations themselves impose such standards; they must consult the governing Acts and internal Service Victoria procedures. The absence of standards increases the risk of inconsistent practice unless operational guidance is produced and published.

Ambiguity about who “maintains” the site or app. Schedule entries say the transfer applies where the application is made by input into “an Internet site or mobile application maintained for that purpose.” The Schedule does not identify who maintains the site or app. That gap creates a potential interpretive flashpoint: does “maintained for that purpose” mean maintained by the Business Licensing Authority, by Service Victoria, or by a contracted third-party? Practitioners should identify and document the maintainer(s) of the relevant digital channels to avoid disputes about whether a given input meets the Schedule’s channel condition.

Narrow subject-matter scope. The Schedule lists specific sections from the Professional Engineers Registration Act 2019. The transfer covers only the identity-collection and verification steps tied to those statutory processes. It does not transfer decision-making on registration, endorsement outcomes, discipline, or other regulatory functions. Misapprehending the Schedule as effecting a broader transfer of “registration functions” would be erroneous.

Sunset risk. The Endnotes record the Subordinate Legislation Act 1994 sunset rule, which will cause the Regulations to expire ten years after making on 26 October 2031 unless action is taken. There is operational risk if the sunset is not addressed in good time: responsibilities may need reauthorisation or transition arrangements to prevent gaps. Do not assume permanence.

Amendments change text but not always substance. The instrument has been amended by S.R. No. 38/2024; the marginal notes record a substitution of regulation 1 and revocations of certain items. Amendments can alter the instrument’s form and therefore its interpretive contours. When advising, always check the incorporated version date: this document is incorporated to 29 May 2024.

No penalties or procedural enforcement within the instrument. Because the Regulations do not specify enforcement mechanisms or penalties for failing to perform the transferred duties, parties should not rely on this instrument for enforcement substance. Any enforcement or redress will arise from the parent Acts and administrative frameworks.

Formatting and table quirks. The printed Schedule includes a broken cell across items 3 and 4 where the phrase “mobile application maintained for that purpose.” appears on a line by itself. That formatting can cause reading mistakes; practitioners should carefully reconstruct the intended text from the two-table rows to avoid misreading which statutory references apply to which items.

Identify qualifying interactions. The first compliance step is to map which Professional Engineers Registration Act 2019 interactions fall within Schedule 1. The Schedule identifies applications for registration under s 10 (including for additional areas of engineering), endorsement applications under s 11, specified items under s 13(a)(i) and (ii), s 14(1)(c), and renewal applications under s 20. For each operational process, confirm whether the identity information is being provided by input into an internet site or a mobile application “maintained for that purpose.” Only where that channel condition is satisfied does the transfer to the Service Victoria CEO apply (regulation 5 and Schedule 1).

Clarify who maintains digital channels. Because the Schedule conditions the transfer on inputs into an internet site or mobile application “maintained for that purpose,” agencies should document who maintains each qualifying digital channel. That includes identifying third-party vendors, clarifying contractual responsibilities for uptime, data access and secure transfer, and recording who is authorised to certify that a given input meets the Schedule’s channel test. This will determine whether Service Victoria or the Business Licensing Authority has responsibility for identity verification for a particular input.

Operationalise the Service Victoria CEO’s role. The Note to regulation 5 assigns the transferred identity verification functions to the Service Victoria CEO. Service Victoria should institute delegation instruments, authorise named officers, produce internal procedural guidance for identity verification in the professional engineers context, and ensure staff understand the statutory linkage to the Professional Engineers Registration Act 2019. Because the Regulations do not set verification standards, Service Victoria must adopt or publish verification standards and recordkeeping practices consistent with the Service Victoria Act 2018 and any applicable information-privacy obligations.

Agree inter-agency handover processes. Practical compliance requires inter-agency arrangements between Service Victoria and the Business Licensing Authority to hand over data, historical records, and any ongoing verification processes. Where applications are in flight at the time of transfer, a clear process is required for who completes outstanding verifications. Although the Regulations do not mandate transitional steps, effective compliance will depend on documented transfer protocols, data-sharing agreements, and service-level commitments.

Ensure privacy and data protection compliance. The Regulations effect the collection and verification of identity information. Even though the instrument does not specify privacy standards, agencies must ensure all collection, storage, verification, and disclosure of identity information complies with privacy laws, departmental policies, and secure data-handling practices. That includes minimising data retention, applying proper access controls, and ensuring lawful bases for data transfers between agencies.

Publish guidance for applicants. Applicants use online channels. To reduce errors and disputes, Service Victoria and the Business Licensing Authority should publish plain-language guidance for applicants explaining where identity verification will be performed, what evidence is required, and where to seek assistance. Because the Regulations do not specify evidentiary requirements, publication will reduce operational friction and the risk of challenges to verification decisions.

Monitor sunset and amendment obligations. The Endnotes record that these Regulations will sunset after ten years under the Subordinate Legislation Act 1994. Agencies should track this timeline and plan for reauthorisation, extension or replacement well ahead of the 26 October 2031 sunset to avoid legal uncertainty. Additionally, any amendments (such as S.R. No. 38/2024) should be incorporated into operational documentation so staff work from the current legal text.

Record delegation and accountability. Because the transfer is to the CEO office-holder, Service Victoria should record formal delegations and publish internal accountability lines so that an applicant subject to identity verification knows who made the verification decision and who to approach with queries. This is particularly important because the Regulations do not themselves create a procedural appeals path.

Test edge cases for channel qualification. Practitioners should identify borderline cases, such as hybrid application channels (partially online, partially in-person), submissions via third-party portals, or applications started on one channel and completed on another. For each scenario, document the agency responsible for verification and the protocol for transferring responsibility if the channel changes mid-process.

Maintain auditable records. Finally, because identity verification can be contested and the Regulations do not specify verification standards, agencies should keep auditable records of verification steps taken, documents checked, dates and times of verification, and the identity of the verifier. That practice supports accountability and reduces risk of disputes or complaints.

By following these steps agencies and applicants will align operational practice with the narrow, channel-conditioned transfer effected by regulation 5 and Schedule 1, while addressing gaps in the instrument by reference to governance, privacy and inter-agency arrangements.
