164 Announcement before entry (1) Subject to subsection (2), a police officer exercising a power of entry under section 163— (a) must announce that the police officer is authorised by law to enter the premises; and (b) if the police officer has been unable to obtain unforced entry, must give any person at the premises an opportunity to allow entry to the premises. (2) A police officer need not comply with subsection (1) if the police officer reasonably suspects that immediate entry to the premises is required to ensure— (a) the safety of any person; or (b) that an offence against section 169 does not continue; or (c) that the arrest of an offender in relation to an offence against section 169 is not frustrated.
