10 Referral to DPP (1) On a referral under section 9(2), the DPP must decide whether or not to apply under section 61 for a detention order in respect of the eligible offender. (2) For the purposes of subsection (1), the DPP— (a) must have regard to the assessment report in respect of the eligible offender; and (b) may have regard to any other report, information or matter that the DPP considers relevant. (3) Nothing in this section requires the DPP to apply for a detention order in respect of an eligible offender. (4) If the DPP decides not to apply for a detention order, the DPP may refer the matter back to the Secretary.
