32 Procedure on hearing of objection (1) This section applies to the Supreme Court when hearing an objection to a control order by the controlled person. (2) The objection does not affect the operation of the control order unless the Court orders the operation of the order is stayed until proceedings in relation to the objection end. (3) The Supreme Court: (a) must consider the notice of objection; and (b) may hear evidence by or for the controlled person and the Commissioner; and (c) must determine whether there is a ground for making a control order and if it is appropriate to do so. (4) The Supreme Court must: (a) if it determines there is a ground for making a control order and it is appropriate to do so – confirm or vary the control order; or (b) if it determines otherwise – revoke the control order.
