Sentencing Regulations 2021

The Regulations operate by filling in procedural and form detail that the Sentencing Act 1991 leaves to subordinate instrument. Primary concepts and their legal mechanics include the following.

Definitions: reg 5 supplies key defined terms. Notable definitions are holiday (in relation to community corrections centres and Public Holidays Act 1993), prohibited poison (as a Schedule 8 or 9 Poison under the Drugs, Poisons and Controlled Substances Act 1981), specified location (which extends beyond a community corrections centre to include any place an offender is directed to attend for unpaid work, treatment or other purposes and includes directions given by the Secretary, Regional Manager, community corrections officers or other authorised persons under the Act or the Corrections Act 1986), and unauthorised area (an area designated by the Regional Manager or a community corrections officer as off limits to an offender). These definitions structure where obligations apply, what substances are caught by prohibitions, and which persons may legally give directions.

Delegation and prescribed classes: reg 6 identifies the prescribed class of person for purposes of s 115B(1)(a)(iii) of the Act in relation to Part 3A or 3B of the Act: persons employed in the Department of Justice and Community Safety under Part 3 of the Public Administration Act 2004 at Grade 6 or higher. That creates a threshold on who may be delegated certain functions relating to drug and alcohol treatment orders and related matters.

Service and forms: reg 7 requires courts to serve copies of community correction orders, drug and alcohol treatment orders, and fines work orders on both the offender and the Regional Manager as soon as practicable, and prescribes methods of service (personal or ordinary service in line with Criminal Procedure Act 2009 procedures) and proof of service (section 399 CPA) (reg 7(1)-(3)). Schedule 1 contains a number of prescribed forms used throughout the regime (Form 1 declaration about time in custody; Form 1A transfer order; Forms 1B and 2 applications to review justice plan conditions).

Unpaid community work: Part 2, reg 8 sets the permissible nature of unpaid community work that can be imposed as part of a drug and alcohol treatment order, community correction order or fines work order. The permissible categories are work for hospitals/educational/charitable/non‑profit bodies; work at homes of socially disadvantaged or disabled persons or institutions for such persons; work on Crown land; or work on land used for a public purpose by a person or body under any Act (reg 8(1)). The regulation bars requiring an offender to perform work that would normally be done by paid labour (reg 8(2)). It allows remote performance where onsite performance is not reasonable or practicable and lists circumstances that may justify remote performance including public health risk, offender disability, caring responsibilities or remote residence (reg 8(3)-(4)).

Offender obligations and monitoring: Parts 3, 4 and 5 prescribe obligations under drug and alcohol treatment orders (reg 12), assessments and treatment obligations (reg 13), obligations under community correction orders (regs 14-15) and under fines work orders (regs 17-18). Recurring requirements include abstaining from alcohol for at least eight hours before attending a centre or specified location (see reg 12(1)(b) and reg 15(1)(a)), prohibition on use or possession of drugs of addiction or prohibited poisons without lawful authorisation (regs 12(1)(c), 15(1)(b), 18(1)(b)), prohibition on being under the influence while attending or performing work (regs 12(1)(d), 15(1)(c), 18(1)(a),(b)), requirements to obey lawful directions and not leave a centre without permission (regs 12(1)(a),(f), 18(1)(d)), and obligations to notify and produce a medical certificate where non‑attendance results from illness (regs 12(1)(h),(g); 18(1)(e),(g)). All these obligations are couched as prescribed obligations for the purposes of the corresponding sections of the Act.

Fines and payments: reg 16 governs part payment to reduce unpaid community work under s 69U(3) of the Act. It lists acceptable payment routes: in person at community corrections centres during set hours on non‑public‑holiday weekdays; by post; by electronic funds transfer or credit card to an ADI; or by cash, bank cheque (marked "not negotiable") or money order payable to the Department of Justice and Community Safety (reg 16(1)). The regulation clarifies that a bank cheque is not taken to be paid until honoured (reg 16(2)) and fixes a minimum part payment of $100 (reg 16(3)). Crucially, reg 16(4) defines "electronic funds transfer" as excluding transfers over the Internet or telephone banking.

Variation and review procedures: regs 19-20 prescribe the form and required particulars of applications to vary community correction orders and fines work orders. regs 21-26 specify the prescribed persons or classes of persons who may make or be a party to certain applications and reviews (police, informants, Chief Commissioner, Regional Managers, community corrections officers, OPP lawyers in different contexts).

Contravention and transfer process: Part 7 clarifies that the Part applies to suspended sentence orders (reg 27), prescribes who may commence contravention proceedings (Regional Manager or community corrections officer , reg 28), prescribes who can act in transferred proceedings where the offender is before a higher court (reg 29), requires the proper officer of the sentencing court to fix a hearing date when a proceeding is transferred under s 83AJ(1) (reg 30), and prescribes the form of the transfer order as Form 1A (reg 31).

Special categories and timelines: Part 8 prescribes the forms for review of justice plan conditions (Form 1B for mandatory treatment and monitoring orders; Form 2 otherwise , reg 32) and prescribes that the information required in relation to Court Assessment Orders is advice about duration in accordance with s 93(2) of the Act (reg 33). Part 9 prescribes fixed periods relevant to historical homosexual convictions: 42 days after which a conviction becomes expunged (reg 34), a 14‑day prescribed notification period (reg 35) and a 28‑day period for data controllers to take action (reg 36).

Taken together, the Regulations transplant many administrative and compliance rules into subordinate law. Where the Act provides broad powers or requirements, the Regulations supply concrete, enforceable steps, timetables, forms and limits.

The Regulations allocate roles, obligations and decision points among several actors. The primary affected groups are:

• Offenders subject to community correction orders, drug and alcohol treatment orders, fines work orders, unpaid community work requirements, mandatory treatment and monitoring orders, suspended sentence orders and orders for release on adjournment. The Regulations materially affect what those offenders must do (attendance, abstinence windows, tests and treatment, notification, medical certificates, photograph requirements) and how they can make or respond to variation or review applications (see regs 12-13, 15, 18, 19-20, Forms 1B and 2).

• Courts and judicial officers. The Regulations require courts to include specified matters in community correction orders and fines work orders (regs 14 and 17), to serve copies of certain orders on the offender and the Regional Manager and to use prescribed forms for declarations and transfer orders (reg 7, reg 10 and Schedule 1 Forms). Proper officers and registrars have a duty to fix hearing dates for transferred proceedings (reg 30) and to complete prescribed particulars for applications (regs 19-20).

• Regional Managers and community corrections officers. These actors are central executors of the regime. They receive served copies of orders (reg 7(1)), keep records of offender attendance and performance of unpaid community work (reg 9), designate unauthorised areas of community corrections centres (reg 5 definition), direct offenders to specified locations (reg 5 specified location), enforce offender obligations (regs 12, 15, 18), and are among the prescribed persons who may make applications or commence proceedings (regs 21, 23, 28-29). They hold discretion about directions and recording procedures, and are explicitly empowered to require photographs for records (regs 12(2), 15(2), 18(2)).

• Department of Justice and Community Safety employees at Grade 6 or higher. Reg 6 prescribes this class of persons as those who may be delegated certain functions under s 115B(1)(a)(iii) of the Act in relation to Parts 3A and 3B. That affects who within the department can exercise delegated powers concerning drug and alcohol treatment orders.

• Police and informants and persons employed in the Office of Public Prosecutions (OPP). For various applications and reviews (variation of community correction orders, variation of instalment/time to pay orders, variation of fines work orders, variation of orders for release on adjournment, review of justice plans and justice plan conditions), the Regulations list the Chief Commissioner of Police, police officers, informants and OPP lawyers as prescribed persons or classes (regs 21-26). This prescribes who may be a party to or make relevant applications, shaping enforcement initiation.

• Community organisations and institutions that receive unpaid community work. Reg 8(1) contemplates work for hospitals, educational or charitable institutions or other non‑profit bodies and for homes of socially disadvantaged or disabled persons. Those bodies will receive labour but are insulated by reg 8(2) from the risk that the offender be required to perform work normally done by paid labour.

• Data controllers and administrative staff handling historical homosexual convictions. Part 9 prescribes short timeframes within which actions must be taken around expungement notifications and data controller action (regs 34-36), affecting agency administrative processes.

• Financial intermediaries and community corrections centres. Reg 16 prescribes payment channels for part payment of fines. It allows in‑person payments at centres during set hours, postal payments, EFT or credit card to an ADI, and cash or money order, and places a minimum part payment amount of $100 (reg 16(1)-(3)). The unusual definition of "electronic funds transfer" excluding internet and telephone transfers (reg 16(4)) affects the types of digital payment services that can be accepted for these reductions.

Who pays: offenders pay fines and deliver labour; public agencies (Department of Justice and Community Safety and community corrections centres) bear administrative cost of record‑keeping, service and enforcement; community organisations hosting unpaid community work receive labour but must ensure compliance with the prohibition on substituting paid labour.

Who decides: courts impose orders and are responsible for required content (regs 14, 17). Regional Managers and community corrections officers decide on directions to specified locations, designate unauthorised areas, record attendance and may commence contravention proceedings (regs 5, 9, 28). The Secretary, Regional Manager or authorised persons may give directions that define a specified location (reg 5).

The Regulations therefore configure a multi‑actor administrative ecosystem. They centralise operational discretion in Regional Managers and community corrections officers for day‑to‑day enforcement while reserving initiation of orders and prescribed content to courts. The specified classes of persons for delegation and application processes limit which agency employees can exercise certain functions, concentrating some decision‑making at defined ranks and roles (reg 6; regs 21-26).

The Regulations create prescriptive duties for courts, Regional Managers, community corrections officers, offenders and a set of prescribed officers, and they record procedural rights (for example a right to apply for variation and review) subject to form and time rules. Below are the main duties and the rights embedded in the Regulations, with specific references.

Duties of courts and proper officers:

• Serve copies of community correction orders, drug and alcohol treatment orders and fines work orders on the offender and the Regional Manager as soon as practicable; service by personal or ordinary service and proof of service as per Criminal Procedure Act 2009 (reg 7(1)-(3)).
• Include prescribed particulars in community correction orders (reg 14) and fines work orders (reg 17). Those particulars include offender identity, offence details, reporting centre contact details, terms prescribed by sections of the Act (such as s 45 or s 69V), dates of the order, commencement, the period, signatures of the judicial officer and offender or counsel's signature confirming consent (regs 14(1)(a)-(o); 17(1)(a)-(m)).
• Use prescribed forms where specified: declaration about time held in custody (Form 1, reg 10), transfer of proceedings form (Form 1A, reg 31), and applications to review justice plan conditions (Forms 1B and 2, reg 32).

Duties of Regional Managers:

• Keep accurate records of the dates and hours each offender has satisfactorily or unsatisfactorily performed unpaid community work and times of attendance at centres or other required places (reg 9(a)-(b)).
• Receive served copies of relevant orders (reg 7(1)(b)).
• Enforce regulations concerning specified locations and unauthorised areas, and instruct offenders (reg 5 definition of specified location; reg 12(1)(a),(f); reg 18(1)(d)). The Regional Manager may designate unauthorised areas (reg 5).

Duties of community corrections officers and delegated departmental persons:

• Act on directions in relation to specified locations and to instruct offenders, record attendance and performance, commence contravention proceedings where prescribed (reg 12(1)(a), reg 9, reg 28).
• Reg 6 prescribes that delegations under s 115B(1)(a)(iii) may be exercised by Department employees at Grade 6 or higher; that effectively bounds who may be given certain delegated powers.

Duties of offenders:

• Under drug and alcohol treatment order contravention requirements (contravention‑response attendance), an offender must obey lawful instructions at the centre or specified location, abstain from alcohol for at least 8 hours before attendance and refrain from consuming alcohol while at the centre or while doing unpaid community work, not use drugs of addiction or prohibited poisons without lawful authorisation when attending or performing work, not be under the influence while attending or performing work, not possess alcohol or prohibited poisons while at the centre or performing work, not leave without permission, notify staff promptly if unable to attend and provide medical certificates where absence is caused by illness, and not enter unauthorised areas without permission (reg 12(1)(a)-(j)). The offender must also have their photograph taken for centre records when directed (reg 12(2)).
• Equivalent obligations are prescribed in relation to community correction orders (reg 15(1)-(2)) and fines work orders (reg 18(1)-(2)). The Regulations repeatedly make attendance and photographic record obligations, substance abstention and prohibition on possession, and notification and medical certificate requirements compulsory.

Rights and procedural safeguards:

• Offenders have procedural avenues to apply for variation of orders or review of justice plan conditions. Applications for variation must be in writing and include specifics (regs 19-20) and are subject to prescribed persons being able to apply (regs 21-26).
• Form 1B and Form 2 (Schedule 1) provide prescribed notice content for applications to review justice plan conditions; Form 1B includes a "TAKE NOTE" reference making explicit that, if the justice plan condition is varied, the varied condition must be as onerous as or more onerous than before (Form 1B TAKE NOTE referencing s 44A(3) of the Act). That communicates a statutory constraint on the court's power to vary these conditions.
• Courts may accept alternative evidence of an offender's consent where the offender or legal practitioner cannot sign (reg 14(2); 17(3)), which preserves a measure of flexibility in cases of incapacity or logistical inability to sign.

Administrative duties linked to fines:

• Section 16 prescribes permissible payment channels, a minimum part payment of $100, and the treatment of bank cheques (reg 16(1)-(3)). Reg 16(4) narrows the definition of electronic funds transfers by expressly excluding internet or telephone banking transfers.

Obligations on data controllers and time limits:

• In the context of historical homosexual convictions, the Regulations set short prescribed periods: 42 days after which a conviction becomes expunged for s 105I(3) purposes (reg 34), a 14‑day notification period (reg 35) and 28 days for data controllers to take prescribed action (reg 36).

Penalties and enforcement mechanisms under these Regulations operate via the Act's enforcement provisions (for example contravention processes and consequences under the Sentencing Act 1991) and are not substantially altered here; however the Regulations provide operational detail that triggers enforcement, including service rules (reg 7), specified forms for transferred proceedings (reg 31 Form 1A), and the list of persons who may commence proceedings (reg 28). The Regulations also impose record‑keeping duties (reg 9), the breach of which will affect evidentiary and enforcement trajectories in contravention hearings.

In short, the Regulations create clear, recurring offender duties (attendance, abstinence, loyalty to lawful directions, notification and medical certificate requirements, photographic records) and allocate administrative duties and procedural rights across courts, Regional Managers, community corrections officers and prescribed classes of persons.

The Regulations are primarily procedural and prescriptive; they do not themselves create fresh autonomous criminal offences with standalone penalties. Instead, enforcement operates through the Sentencing Act 1991’s substantive framework and the ordinary enforcement mechanisms of the courts and correctional administration; the Regulations supply the triggers, forms and evidence needed for enforcement actions. The following points in the Regulations bear directly on enforcement and evidentiary mechanisms.

Contravention proceedings and who may start them: Part 7 confirms that the contravention regime applies to suspended sentence orders (reg 27) and prescribes that, for section 83AG(2)(f) and section 83AL(2)(f) of the Act, the prescribed class of persons who may commence contravention proceedings or act where the offender is before a higher court are the Regional Manager or a community corrections officer (regs 28-29). That concentrates enforcement initiation with correctional administrators rather than with a broader set of officials.

Transfer of proceedings and procedural steps: If a contravention proceeding is transferred under s 83AJ(1) of the Act, the proper officer of the sentencing court must fix a date for the transferred proceeding (reg 30). The Magistrates' Court’s transfer order is prescribed as Form 1A (reg 31 and Schedule 1). Those procedural rules shape timing and the movement of hearings between courts, which influences case management for enforcement.

Proof, records and evidence: Reg 9 imposes an explicit record‑keeping duty on Regional Managers to keep accurate records of dates and hours on which each offender has or has not satisfactorily performed unpaid community work and times of attendance at community corrections centres or other places the offender must attend. Those records will serve as primary evidence in contravention matters. Where a court serves a copy of an order (reg 7), service must be proved consistent with s 399 of the Criminal Procedure Act 2009, thereby linking statutory evidentiary standards to enforcement.

Offender obligations that affect enforceability: The Regulations prescribe specific obligations that, if breached, are contraventions under the Act (for example failing to attend, consuming alcohol within specified timeframes, being under the influence, possession of prohibited poisons, leaving without permission). For contraventions that lead to attendance at a community corrections centre under s 18ZL(1)(d) of the Act, reg 12 specifies detailed requirements for the offender at that centre including abstinence, obedience to lawful directions and notification obligations. These detailed obligations supply the factual predicates for breach findings.

Fines enforcement mechanics and payments: Reg 16 sets out acceptable payment routes for part payment of fines to reduce unpaid community work and fixes a minimum part payment of $100. The stipulation that a bank cheque is not treated as made until honoured (reg 16(2)) protects administrative certainty when assessing whether part payments have been made, and creates a point at which payment may be considered not complete, with enforcement consequences for unpaid amounts.

Delegations and who may exercise enforcement powers: The Regulations narrow delegations: reg 6 prescribes the class of departmental employees (Grade 6 or higher) who may be delegated functions for Parts 3A and 3B. That affects who among the administrative staff may formally exercise powers that can trigger enforcement steps in the drug and alcohol treatment order context.

Forms and procedural completeness: Several prescribed forms in Schedule 1 are designed to ensure that particular enforcement steps are procedurally complete and documented: Form 1 (declaration about time held in custody) creates a standardised mechanism for courts to declare pre‑sentence custody time to be reckoned as time served; Form 1A standardises transfer orders; Forms 1B and 2 standardise justice plan review applications and contain prescribed warnings and information to be provided to offenders. Using prescribed forms reduces procedural error risk but also imposes strict content requirements that, if omitted, could delay enforcement or lead to defects in the proceedings.

Timeframes for data action: For historical homosexual convictions, reg 34 prescribes a 42‑day period after which a conviction becomes an expunged conviction under s 105I(3) of the Act; reg 35 prescribes a 14‑day notification period; reg 36 prescribes a 28‑day period for data controllers to take action. Those deadlines create enforceable administrative timetables; failure to meet them may give rise to remedial obligations under the Act or administrative challenge (the Regulations themselves do not specify penalties but specify timing that is relevant to successful administrative performance).

Sanctions and adjudicative consequences arise under the Sentencing Act and are not substantially created by these Regulations. Instead, the Regulations shape enforceability by defining the conduct that constitutes compliance or contravention, setting evidence and service rules, specifying who may commence proceedings and fixing administrative timelines and record‑keeping obligations. Enforcement practitioners should treat the Regulations as procedural constraints and evidentiary aids , failures in service, recording, or use of required forms may impede enforcement or expose decisions to procedural challenge.

The Sentencing Regulations 2021 operate expressly as subordinate instruments to the Sentencing Act 1991 (reg 2). Their content frequently interfaces with other Acts and statutory instruments; those cross‑references define the scope and context of many obligations. The key interactions recorded within the Regulations include the following.

Criminal Procedure Act 2009: Reg 7(2)-(3) imports service rules and proof of service procedures from the Criminal Procedure Act 2009, specifying that service of orders (community correction, drug and alcohol treatment orders, fines work orders) can be effected by personal service in accordance with s 391 CPA or ordinary service under s 394 CPA and must be proved in accordance with s 399 CPA. This ties fundamentals of jurisdictional and procedural validity to the CPA.

Public Holidays Act 1993: The definition of holiday (reg 5) refers to public holidays appointed under the Public Holidays Act 1993 "in the place in which the community corrections centre is located". That matters for operational scheduling of attendance and payment options (reg 16 refers to payments only on Monday to Friday that are not holidays).

Drugs, Poisons and Controlled Substances Act 1981: The definition of prohibited poison in reg 5 relies on Schedules 8 and 9 of the Drugs, Poisons and Controlled Substances Act 1981. That cross‑reference anchors the substance‑related prohibitions in the broader statutory scheme governing controlled substances.

Corrections Act 1986 and its regulations: The definition of specified location (reg 5) includes "any other person authorised under the Act, these Regulations or the Corrections Act 1986 or the regulations made under that Act". This cross‑link broadens the range of potential authorised persons who can require attendance, and situates the community corrections environment within the corrections statutory architecture.

Public Administration Act 2004: Reg 6 uses employment classifications under the Public Administration Act 2004 to define who can be a prescribed delegated person (Grade 6 or higher). That imports public service staffing frameworks into the exercise of delegated functions under the Sentencing Act.

Sentencing Act 1991: The Regulations consistently operate to give detail to sections of the Act. Examples include:

• Reg 6 for s 115B(1)(a)(iii);
• Reg 7 for obligations around service where the Act requires orders to be given effect;
• Regs 12 and 13 in response to s 18ZL, s 18ZF, s 18ZG and related provisions for drug and alcohol treatment orders;
• Regs 14-15 relating to provisions in the Act about community correction orders and offender obligations (s 45 and s 44A(1), s 47);
• Regs 16-18 linked to the fine conversion provisions in Part 5 of the Act (s 69U, s 69V);
• Regs 19-26 prescribing particulars for applications and identifying prescribed persons consistent with sections for variation, review and application in the Act (for example s 48N, s 61, s 68, s 69J, s 78, s 81, s 82);
• Part 7 (regs 27-31) operationalises contravention and transfer mechanics referenced in Part 3C and Schedule 3 to the Act (for example s 83AJ, s 83AL);
• Reg 33 providing prescribed information for Court Assessment Orders under s 92 and s 93;
• Part 9 (regs 34-36) implementing timeframes in the Act dealing with historical homosexual convictions (s 105I and s 105K).

Interpretation of Legislation Act 1984: The Endnotes indicate that style changes and interpretative effects under the Interpretation of Legislation Act 1984 (ILA) apply to the Statutory Rule (Endnotes 1). That means headings, examples, punctuation and provision numbers are treated as part of the Statutory Rule in ways required by the ILA.

Subordinate instruments replaced: Schedule 2 revokes prior Sentencing Regulations dating back to 2011 and subsequent amendment regulations. The replacement therefore interacts with the body of subordinate law previously in force and resets the regulatory baseline.

Administrative law and evidence: By prescribing forms, record keeping and proof of service standards, the Regulations interact indirectly with administrative law principles and evidentiary practice. Compliance with the prescribed forms and service protocols can influence the procedural validity of orders and the admissibility or sufficiency of proof in contravention hearings.

In sum, the Regulations are not freestanding; they explicitly import substantive definitions and procedural rules from other Acts to ensure that sentencing administration aligns with the broader statutory architecture covering criminal procedure, corrections, controlled substances and public administration. Practitioners should read the Regulations in tandem with the Sentencing Act 1991, the Criminal Procedure Act 2009, the Corrections Act 1986, the Drugs, Poisons and Controlled Substances Act 1981, the Public Holidays Act 1993 and the Public Administration Act 2004.

The Regulations, as published, record a clear origin and immediate subordinate history within the Endnotes and Schedule 2.

Making and commencement:

• The Regulations were made on 21 December 2021 by the Governor in Council under s 116 of the Sentencing Act 1991 and came into operation on 21 December 2021 (reg 3; Endnotes General information).

Revocations and replacement of prior subordinate instruments:

• Schedule 2 lists revoked regulations, explicitly revoking the Sentencing Regulations 2011 (S.R. No. 159/2011) and subsequent Sentencing Amendment Regulations issued in 2012, 2013, 2014 (two sets), 2016 and 2018 (S.R. Nos. 74/2012; 73/2013; 16/2014; 57/2014; 38/2016; 162/2018). The Schedule shows this instrument replaced those earlier statutory rules and consolidated or reset the subordinate regulatory framework for sentencing.

Amendments since making:

• The Endnotes include a Table of Amendments section which, in this version, records that there are no amendments made to the Sentencing Regulations 2021 by statutory rules, subordinate instruments or Acts (Endnotes 2). The Explanatory details section in the Endnotes is blank (Endnotes 4), showing no published explanatory material attached to further amendments.

Sunset and review provisions:

• The Endnotes note that the Sentencing Regulations 2021 will sunset ten years after making (21 December 2031) pursuant to s 5 of the Subordinate Legislation Act 1994 (Endnotes General information). This places a legislated expiry date on the instrument unless renewed or remade before that date.

Amendments not in operation:

• The Endnotes include a section "Amendments Not in Operation" (Endnotes 3) and state that this version does not contain amendments that are not yet in operation. In other words, at the date of the published version there were no prospective amendments queued that are yet to commence.

Style and interpretive adjustments:

• The Endnotes indicate that style changes authorised by section 54A of the Interpretation of Legislation Act 1984 apply. That affects how headings, punctuation and other formatting matter are treated as part of the Statutory Rule (Endnotes 1). Those style matters may appear minor, but they have interpretive consequences under the ILA and are recorded explicitly.

Practical effect of the amendment history:

• Practitioners should note the consolidated nature of this instrument and the express revocation of earlier regulations. If relying on historical subordinate rules, the Schedule 2 revocations must be checked to ensure a prior regulatory provision has not been carried over in a different form. The lack of amendments since enactment means the text as printed is the operative instrument up to any subsequent amendment instrument not reflected in this version.

Overall, the amendment history in the text is short and clear: this instrument was made in December 2021, it replaced earlier Sentencing Regulations and it remains unamended as of the version date, with a statutory sunset in 2031.

The Regulations themselves do not include case law and the printed Endnotes do not record any litigation arising from the Sentencing Regulations 2021. The Endnotes contain a "Table of Amendments" and an "Explanatory details" section, both of which show no entries indicating that any reported court challenges, judicial review applications or appellate decisions stemming from these Regulations are recorded in the instrument (Endnotes 2, 4). The Regulations also do not list any transitional judicial determinations or administratively authorised clarifications.

What the Regulations do show is how procedural compliance and record keeping will feed into contravention and variation proceedings under the Sentencing Act 1991. For example:

• Reg 9 requires the Regional Manager to keep accurate records of attendance and unpaid community work performance; those records will form the core evidence in contravention proceedings (Part 7).
• Reg 7 requires courts to serve copies of orders and rely on Criminal Procedure Act service rules (s 391, s 394, s 399 CPA), which are commonly litigated points in other contexts; incomplete or defective service could give rise to procedural challenges in contravention matters.
• Forms prescribed in Schedule 1 standardise declarations and transfer mechanisms; failure to use the prescribed form in a way mandated by the Act and Regulations may provide a basis for procedural objections.

Because the Regulations operate largely as procedural instruments supporting the Sentencing Act, litigation that touches on them will likely arise by way of:

• challenges to procedural fairness or jurisdictional defect where required steps (service, record‑keeping, prescribed content of orders) have not been met;
• evidentiary disputes about compliance with obligations imposed by regs 12, 15 and 18 (for example whether an offender was "under the influence" or whether an absence was for illness and appropriately evidenced by a medical certificate);
• disputes over the validity of transfer orders or the timing for transferred proceedings where reg 30 requires proper officers to fix a date and reg 31 prescribes a transfer form.

The text in Schedule 2 revoking earlier Sentencing Regulations suggests there was a prior regulatory regime; any earlier litigation would need to be checked against those instruments to determine continuity of legal issues. The present Regulations do not identify any litigation history. Practitioners seeking litigation history should therefore consult court databases and reported decisions for cases that reference the Sentencing Act 1991 and look for citations to these specific Regulations; such searches are outside the content of the Regulations themselves.

In short, these Regulations do not, on their face, record a litigation history. They do, however, prescribe processes and documentary routes that will be determinative in enforcement and contravention litigation, and so they are likely to be implicated in future proceedings even though no such cases are recorded in the instrument.

Several operational details in the Regulations present traps for the unwary, procedural risks, or items likely to generate administrative friction. These are concrete items grounded in the text.

1. Electronic funds transfer definition excludes internet and telephone banking (reg 16(4)). Reg 16(1)(c) allows payment "by electronic funds transfer, or by a credit card, to an ADI", but reg 16(4) then specifies that "electronic funds transfer" does not include (a) a transfer of money over the Internet or (b) a withdrawal or transfer of money carried out by telephone banking. That results in an odd operational constraint: many common online bank transfers or phone banking transfers are expressly excluded. Practitioners and payment administrators must check whether their "EFT" procedures qualify under reg 16 as permitted methods, or whether the centre must accept alternate methods (in person, post, card to an ADI, cash or money order). Failure to interpret or implement this correctly could mean payments thought to reduce unpaid work are not legally effective under reg 16(2) (bank cheques only count when honoured).

2. Minimum part payment requirement (reg 16(3)). A part payment must be at least $100. Where an offender attempts to make smaller payments frequently, those payments will not reduce unpaid community work for the purposes of s 69U(3) unless each payment meets the $100 threshold. Administrative systems must enforce and communicate this to avoid disputes when calculating work conversion.

3. Photographic record requirement and privacy implications (regs 12(2), 15(2), 18(2)). The Regulations make it a prescribed requirement that offenders attend to have photographs taken to be included in community corrections centre records. There is no detailed privacy regime in the Regulations about storage, retention or disclosure beyond stating the requirement. Agencies must ensure data handling and privacy compliance under other applicable laws, and offenders and advocates should be aware that photographic identification is mandatory when a direction is given.

4. Broadness of "specified location" and delegation to "any other person authorised" (reg 5). The definition of specified location encompasses places the offender is directed to attend by the Secretary, the Regional Manager, a community corrections officer or "any other person authorised under the Act, these Regulations or the Corrections Act 1986 or the regulations made under that Act". That language is broad and can create operational ambiguity about who may authorise locations and the scope of directions. Practitioners should map authorising instruments under the Corrections Act and internal delegations to determine who may validly direct attendance.

5. Unauthorised area designation (reg 5). The Regulations permit Regional Managers or community corrections officers to designate "unauthorised areas" within a centre. There is no further prescriptive guidance in the Regulations about the process for designation, notice to offenders, or review. An offender entering a designated unauthorised area risks contravention enforcement , the administrative process for designation should therefore be documented to avoid procedural unfairness claims.

6. Prohibition on performing work usually done by paid labour (reg 8(2)). Offenders must not be required to perform work that would normally be performed by paid labour. This creates a compliance obligation for host organisations and the Department. Mischaracterising labour may create legal challenges or obligations to reassign or remunerate work. Agencies must assess tasks to ensure they fall within the permitted categories set out in reg 8(1) and consider the remote work authorisation criteria in reg 8(3)-(4).

7. Medical certificate and "as soon as practicable" timing (regs 12(1)(h), 12(1)(g), 18(1)(g), 18(1)(e)). Several obligations require the offender to notify "as soon as practicable" and to provide a medical certificate "as soon as practicable" if non‑attendance is due to illness. The phrase "as soon as practicable" is imprecise and creates disputes about timeliness. Procedures should state expected timeframes for submission of medical certificates and reasonable extensions.

8. Consent signatures and "other evidence satisfactory to the court" (regs 14(2), 17(3)). If an offender or legal practitioner cannot sign a community correction or fines work order, reg 14(2) and reg 17(3) allow consent to be indicated by "any other evidence that is satisfactory to the court". That gives courts wide discretion; practitioners should ensure there is contemporaneous evidence of consent to avoid later challenges.

9. Delegation limited to Grade 6+ (reg 6). The prescribed class for delegation is persons at Grade 6 or higher in the Department. Operationally this restricts who may be delegated certain functions, potentially causing bottlenecks if appropriate Grade 6 staff are unavailable. Administrators should plan delegations and continuity arrangements accordingly.

10. Mandatory content in orders and practical drafting traps (regs 14 and 17). The Regulations list many required particulars for community correction orders and fines work orders. Omitting required particulars could render an order procedurally defective or provide a ground for challenge. Courts and clerks must ensure forms capture all listed items: identity, offence, reporting centre contacts, terms under relevant sections of the Act, dates, signatures and whether the order is a mandatory treatment and monitoring order.

11. Timeframes for historical homosexual convictions (regs 34-36). The Regulations prescribe short and specified deadlines (42 days, 14 days, 28 days) for different stages of expungement notifications and data controller action. Records and data workflows must be configured to meet these short deadlines, or agencies risk failing to comply with the prescribed periods.

12. No express mechanism in the Regulations for appeals or merits review of some administrative decisions (for example designation of unauthorised areas, directions to specified locations). While the Act provides review mechanisms in some areas, the Regulations confer administrative powers without detailing internal review pathways, increasing the risk of procedural challenge if decisions are exercised inconsistently.

These "gotchas" are concrete operational and legal risks embedded in the Regulations. Agencies, courts and practitioners should map internal processes to the Regulations and the cross‑referenced statutes, ensure staff training on payment rules and delegation thresholds, and document designation and notification steps to reduce dispute risk.

Compliance with the Sentencing Regulations 2021 requires process, documentation and training across courts, Regional Managers, community corrections officers, offenders and agencies handling fines and historical convictions. Below are practical, source‑grounded steps by stakeholder with references to the relevant provisions.

Courts and registrars

• Ensure orders contain the required particulars. For community correction orders follow reg 14(1)(a)-(p) to include offender identity, offence, centre contact details, terms under s 45 of the Act, whether it is a mandatory treatment and monitoring order, conditions under s 44A(1) and s 47, period, intensive compliance period details where relevant, dates, judicial signature and offender consent signature or other evidence of consent (reg 14). For fines work orders ensure reg 17(1)(a)-(m) particulars are included.
• Serve copies of orders promptly on the offender and the Regional Manager using personal service (s 391 CPA) or ordinary service (s 394 CPA) and ensure proof of service is recorded consistent with s 399 CPA (reg 7(1)-(3)). Use the court’s standardised service and proof system to avoid challenges.
• Use prescribed forms where required. Form 1 for declarations about time held in custody (reg 10); Form 1A for transfers of proceedings under s 83AJ (reg 31); Forms 1B and 2 for justice plan condition review applications (reg 32).
• When transferring proceedings under s 83AJ ensure the proper officer fixes and records the hearing date (reg 30) and completes Form 1A (reg 31).

Regional Managers and community corrections centres

• Establish record‑keeping systems to meet reg 9: maintain accurate logs of dates and hours for satisfactory or unsatisfactory unpaid community work and attendances at centres or other required places. Ensure records include timestamps and signatures where practicable to provide clear evidence in contravention proceedings.
• When designating unauthorised areas under reg 5, document the basis and provide adequate notice to offenders and staff. Maintain an up‑to‑date map of authorised/unauthorised areas and a written designation policy to support enforcement decisions.
• Implement procedures to accept payments under reg 16: publicise accepted methods (in‑person during 10.00 a.m.-4.00 p.m. Monday-Friday non‑holidays; by post; EFT or credit card to an ADI; cash, bank cheque marked "not negotiable", or money order to the Department), enforce the $100 minimum part payment requirement and ensure bank cheques are only recorded as paid once honoured (reg 16(1)-(3)). Confirm that the centre’s EFT methods comply with the narrower reg 16(4) definition, and where necessary make arrangements for accepted alternative payment channels.
• Enforce photographic requirements. Put in place privacy‑compliant protocols for capturing, storing and restricting use of offender photographs as required under regs 12(2), 15(2), 18(2). Where privacy regimes require, implement retention schedules aligned to broader privacy legislation.
• Ensure staff trained to issue directions to offenders (specified locations) and to record authorisations. Because specified location includes directions from "any other person authorised under the Act, these Regulations or the Corrections Act 1986" (reg 5), maintain an up‑to‑date list of authorised persons and delegations.

Community corrections officers and delegated departmental staff

• Confirm whether delegations have been properly made; reg 6 prescribes that a "prescribed class" for s 115B delegations are persons employed at Grade 6 or higher. Ensure only properly delegated officers exercise delegated powers and maintain a delegation register to evidence authority.
• Enforce offender obligations at centres and specified locations: require compliance with the abstinence windows (at least 8 hours before attending and while attending; reg 12(1)(b), reg 15(1)(a)), prohibit possession and use of prohibited poisons and drugs of addiction without lawful authorisation (regs 12(1)(c), 15(1)(b), 18(1)(b)), require adherence to directions and conditional permissions to leave (regs 12(1)(a),(f), 18(1)(d)). Record all instances of non‑compliance in the reg 9 log.
• Be prepared to receive notifications of inability to attend and medical certificates and record the timeliness of such notifications, given the "as soon as practicable" requirement (regs 12(1)(g)-(h), 18(1)(e)-(g)).

Offenders and legal practitioners

• Understand the obligations attached to relevant orders. For community correction orders, community corrections officers must ensure community correction orders are expressed in plain language and include the explicit statement that reg 15 prescribes obligations (reg 14(1)(e), reg 15).
• If an offender cannot attend as required, notify the Regional Manager or community corrections officer "as soon as practicable" and, if absence is due to illness, produce a medical certificate signed by a registered medical practitioner as soon as practicable (regs 12(1)(g)-(h), 18(1)(e)-(g)). Document all communications and preserve copies of certificates.
• When seeking variation or review, comply with reg 19 or reg 20 application requirements: applications must be in writing and include listed particulars (applicant name and signature, respondent name, date, grounds, court details, the order’s commencement and cessation dates, hearing date/location recorded by proper officer, and any other relevant information).
• Where consent signatures cannot be provided on orders, ensure alternative evidence of consent is put before the court that will be "satisfactory to the court" (regs 14(2), 17(3)). Keep contemporaneous witness statements to support consent.

Policing, informants and OPP

• If initiating applications or reviews under the Act, consult regs 21-26 to confirm whether you are a prescribed person for that application. For example, the Chief Commissioner of Police, police officers, Regional Managers, community corrections officers and OPP lawyers are prescribed persons for variation of community correction orders and fines work orders (regs 21 and 23). For variation of instalment or time to pay orders (s 61), the prescribed persons are an informant, police officer or OPP lawyer (reg 22).

Administrators handling historical homosexual convictions

• Configure workflows to meet the prescribed timeframes: the conviction becomes expunged after 42 days for s 105I(3) purposes (reg 34); notifications must be sent within 14 days (reg 35); data controllers must take action within 28 days (reg 36). Assign responsibility for each step and implement monitoring to ensure dates are met.

Training and audit

• Train staff and stakeholders on the specific requirements: the $100 minimum part payment rule, the EFT exclusions, the 8‑hour alcohol abstention rule, photographic requirements and record‑keeping obligations. Regular audits should check compliance with reg 9 record‑keeping, reg 7 service proof practices and reg 16 payment handling.

Documentation and dispute avoidance

• Keep standardised templates for forms and checklists to ensure required particulars are captured on orders (regs 14, 17). Where the court can accept alternative evidence of consent, record the form of evidence and the court’s acceptance in the court file.
• Where designations (unauthorised areas, specified locations) are made, always issue written notices to impacted offenders and preserve copies in the reg 9 records.

By translating each regulatory prescription into a documented process, assigning responsibility, training staff and auditing compliance, courts and agencies can operationalise the Regulations in ways that reduce procedural defect risk and support enforceable outcomes.
