SENTENCING REGULATIONS 1996

The Regulations revolve around a small set of recurring legal and operational concepts that translate the Act into everyday practice. Each concept has a specified regulatory anchor.

Prescribed program and undertaking (reg 2)

• Reg 2(1) lists four categories of prescribed program that qualify for inclusion as a program condition on a community correction order or an intensive community correction order: alcohol or other drug treatment programs; education or training in driving; any other education or training program; and treatment or counselling addressing personal factors. The entry is categorical rather than exhaustive in individual programme design, but it confines the statutory trigger to those program types. Reg 2(2) prescribes the undertaking form as Form 1 in the Schedule.

Proper officer (reg 3)

• For the Local Court, the proper officer (the person who performs functions the Act assigns to a proper officer) is a registrar, as defined by the Local Court Act 2015. The note clarifies that Supreme Court arrangements are in rule 81A of the Supreme Court Rules 1987, indicating a split in administrative responsibility by court tier.

Prescribed persons (reg 4)

• Reg 4 lists which occupational categories are "prescribed persons" for particular powers and notices in the Act: probation and parole officers and Agency employees under the Minister responsible for Correctional Services (subreg 1), prosecutors (subreg 2), the Chief Health Officer (for s 85(2)) (subreg 3), and the Chief Health Officer and the Commissioner (for s 86(1)) (subreg 4). This both enables and limits who may take specified statutory steps.

Prescribed conditions (reg 5)

• Reg 5(1) supplies a suite of conditions that may be attached to an order under s 34(1)(c) of the Act. They include supervision/reporting (5(1)(a)); residence/time‑of‑day requirements (curfew-like) (5(1)(b)); wearing or permitting the installation and retrieval of an approved monitoring device and associated equipment (5(1)(c)-(d)); participation in prescribed programs as directed by the Commissioner (5(1)(e)-(f)); alcohol and drug prohibitions and testing (5(1)(g)-(h)); non‑association and non‑communication directions (5(1)(i)); and place exclusion (5(1)(j)). Reg 5(2) cross‑prescribes those conditions for breach processes under s 48(1)(d).

Forms and certificates (regs 11-13 and Schedule)

• The Schedule prescribes several forms the Act references: Form 1 (undertaking), Form 4 (application for breach of suspended sentence), Form 5 (Chief Health Officer certificate and report to support hospital orders), Form 5A (application for breach of hospital order), Form 5B (certificate for victims of identity crime under s 97AB), and Form 6 (listing other alleged offences that may be taken into account). The forms set out the particulars the regulations expect when courts, sheriffs, registrars, prosecutors, Chief Health Officer or judges act.

Rehabilitation program in relation to domestic and family violence (regs 14-18)

• Reg 14 defines an "order" for this Part as a CCO or intensive CCO subject to the condition requiring satisfactory completion of a domestic and family violence (DFV) rehabilitation program. Reg 15 establishes that Part 3 applies for ss 34(3) and 48(3) of the Act. Reg 16 imposes notification obligations on program facilitators: they must notify police and a probation and parole officer if they become aware of relevant offending or conduct contrary to a DVO while the offender is subject to the order, or if they reasonably believe the offender presents an unacceptable risk (16(1)). Notices must be in writing and include particulars (16(2)). Program facilitators must also provide completion or non‑compliance notices to the probation and parole officer (16(3)), and a participation notice to the court if requested (16(4)). Reg 17 permits the court to require periodic attendance for review and to request participation notices. Reg 18 sets out the conditions for an offender to be considered to have "satisfactorily completed" a DFV rehabilitation program: completion of the program; no breach of any DVO in force during the order; no commission of any domestic violence during the order; and that a probation and parole officer has received a completion notice under reg 16(3)(a).

Standard of decision and discretion

• The Regulations explicitly use standards that introduce professional discretion in operation: program facilitators are required to act if they "believe on reasonable grounds" an offender may present an unacceptable risk (reg 16(1)(c)). The Commissioner has direction powers about program participation (reg 5(1)(e)). The Chief Health Officer provides clinical certificates and reports for hospital orders (Form 5), which rely on medical practitioner opinion. The court retains review powers and discretion to require the offender to appear (reg 17).

Operational linkages to the Act

• The Regulations repeatedly anchor to named sections of the Act (for example, s 3(1), s 34, s 39A/B, s 42, s 43, s 48, s 80, s 85, s 86, s 97AB, s 107). Where consequences or sanctions are engaged by the Act, the Regulations focus on the mechanics of notice, form and administrative process, rather than re‑expressing substantive penalty regimes.

In sum, the main concepts translate legislative triggers into concrete program types, persons authorised to act, standard conditions capable of being imposed on orders, forms for core processes, and mandatory reporting and certification duties where DFV rehabilitation or hospital orders are involved.

The Regulations allocate duties and obligations among several identifiable groups, and impose discrete constraints on offenders. Major affected parties are:

Offenders subject to community correction orders or intensive CCOs

• The regulations directly shape what courts can require of such offenders. Reg 5 lists conditions that may be imposed: supervision and reporting to probation and parole officers (report within two business days after the order comes into force, reg 5(1)(a)(ii)), residence or curfew requirements (5(1)(b)), wearing/allowing monitoring devices and permitting installation/retrieval of equipment (5(1)(c)-(d)), participation in prescribed programs (5(1)(e)-(f)), abstaining from alcohol and drugs except when medically prescribed (5(1)(g)), submission to breath/analysis/blood/urine testing on request of probation and parole or police (5(1)(h)), non‑association/non‑communication obligations (5(1)(i)), and place exclusions (5(1)(j)). For DFV program orders, reg 18 sets a cumulative test for satisfactory completion that includes no DVO breaches and no domestic violence during the order; an offender can complete a course but still fail the statutory completion test if other criteria are unmet. These requirements create compliance tasks and potential consequences to be invoked under the Act (the Regulations cross‑refer to the relevant enforcement sections).

Program facilitators of DFV rehabilitation programs

• Reg 16 imposes several mandatory duties on facilitators: they must notify police and a probation and parole officer if they become aware of the offender committing domestic violence while subject to an order, becoming aware of conduct contravening a DVO, or where they reasonably believe the offender poses an unacceptable risk. Notices must be written and contain particulars (16(2)). Facilitators must also provide completion and non‑compliance notices to probation and parole officers, and produce participation notices to courts on request (16(3)-(4)). Those obligations transfer investigative and reporting costs to non‑state service providers, and introduce professional judgement points ("reasonable grounds" in reg 16(1)(c)).

Probation and parole officers and Agency employees

• Reg 4(1) designates probation and parole officers and Agency employees under the Minister responsible for Correctional Services as prescribed persons for multiple sections of the Act. Probation and parole officers receive completion and non‑compliance notices (reg 16(3)), may request breath/blood/urine tests (reg 5(1)(h)), and supervise offenders under the prescribed conditions (reg 5(1)(a)). They also act as recipients of notifications that can trigger enforcement steps.

Police

• Police are direct recipients of written notifications from program facilitators when the facilitator becomes aware of offending or DVO contraventions while the offender is subject to an order (reg 16(1)-(2)). Police may also, together with probation and parole officers, request testing under reg 5(1)(h), and be the applicant or party in breach proceedings as the Act provides.

Courts, registrars and sheriffs

• The Local Court registrar is the proper officer for purposes of the Act (reg 3). The Schedule’s Forms 4 and 5A indicate how breach applications will be lodged and the registrars or sheriffs who sign such forms. Reg 17 gives courts power to require offenders to appear for periodic reviews and to request participation notices from program facilitators , courts therefore manage both evidentiary receipt of notices and review triggers for orders.

Chief Health Officer and Commissioner

• The Chief Health Officer is a prescribed person for sections dealing with hospital orders (reg 4(3)-(4)) and must provide the certificate and report in Form 5 that underpin hospital orders under s 80 (reg 12 and Schedule Form 5). The Commissioner is a prescribed person for reg 4(4) purposes and may direct offenders to participate in prescribed programs as per reg 5(1)(e).

Prosecutors

• Reg 4(2) adds prosecutors to the list of prescribed persons for certain sections of the Act (s 43(1) and (2)), and the Schedule’s Form 6 shows the role of prosecutors or police officers in listing other alleged offences for sentencing purposes. Prosecutors are also the party who may initiate breach proceedings as the forms indicate.

Victims of identity crime and judges

• Form 5B is a prescribed certificate for victims of identity crime under section 97AB of the Act; it is completed by a Supreme Court Judge or Local Court Judge and contains particulars of how identification information was used to commit specified offences.

Third parties and service providers

• Service providers who run prescribed programs and trainers delivering driving or other training are functionally bound by facilitator obligations where the program is a DFV rehabilitation program. Additionally, persons in the victim cohort (protected persons under DVOs) are affected indirectly by the reporting obligations and the statutory completion test.

Who bears the costs

• Offenders bear time, monitoring, possible device and testing costs to the extent the order requires these actions. Program facilitators and probation and parole officers bear administrative and reporting costs, specifically the obligation to provide written notices with particulars. Police and courts incur processing work responding to facilitator notifications and enforcing breaches through the prescribed forms. The Chief Health Officer must allocate clinical resources to certify hospital orders via Form 5.

How decisions are made

• The Regulations allocate decision points across facilitators (reasonable grounds determinations and notifications), probation and parole officers and police (testing and supervision), the Chief Health Officer (clinical certificate and report), the Commissioner (directions to participate in programs), and courts (reviews, breach hearings and acceptance of completion notices). The legislation makes those decision roles explicit and ties specified procedural mechanics to named actors.

The Regulations impose precise duties on particular actors and create some procedural rights. Below are the operative duties, the actor who must perform them, and the statutory basis.

Duties of program facilitators for DFV rehabilitation programs (regs 16 and 17)

• Notify police and a probation and parole officer in writing if they:
  • become aware of an offender committing domestic violence while subject to the order (reg 16(1)(a));
  • become aware of conduct that contravenes a domestic violence order while subject to the order (reg 16(1)(b)); or
  • believe on reasonable grounds the offender may present an unacceptable risk to the safety or welfare of a protected person or other person (reg 16(1)(c)).
• The notice must be in writing and include particulars of the offender’s conduct (reg 16(2)).
• Provide to a probation and parole officer:
  • a completion notice if the offender satisfactorily completes program requirements (reg 16(3)(a));
  • a non‑compliance notice if the offender fails to comply with a program requirement (reg 16(3)(b)).
• Provide a participation notice to a court summarising participation if requested (reg 16(4)).
• Practical effect: these duties shift evidentiary and reporting responsibilities to facilitators and require written records with particulars.

Duties of probation and parole officers (reg 5 and reg 16)

• Supervise offenders who are under ongoing supervision as a prescribed condition (reg 5(1)(a)(i)).
• Receive offenders’ reports at a specified place within two business days after the order comes into force (reg 5(1)(a)(ii)).
• Request or effect breath, breath analysis, blood or urine tests at the request of a probation and parole officer or police officer (reg 5(1)(h)) , the reg authorises testing at their request, placing an operational duty on supervising officers to administer the testing regime.
• Receive completion or non‑compliance notices from program facilitators for DFV programs (reg 16(3)).

Duties of police (reg 16)

• Receive written notifications from program facilitators of the same events that trigger notification to probation and parole (reg 16(1)-(2)).
• The Regulations do not prescribe a particular action police must take upon receipt, but their role as recipient places an implicit duty to consider enforcement action under the Act in light of the notice.

Duties of the Chief Health Officer (reg 4(3), reg 12 and Schedule Form 5)

• Act as a prescribed person for hospital order processes (reg 4(3)-(4)).
• Certify and report in the prescribed Form 5 that a defendant appears to be suffering from a mental illness requiring hospital treatment, that treatment can only be obtained by admission and detention in a hospital, and that admission is appropriate for health, safety or protection of the public; and report that facilities are available (Form 5 parts A and B).

Duties of the Commissioner (reg 4(4), reg 5(1)(e))

• The Commissioner is prescribed for particular sections and may direct offender participation in programs designed to address personal factors that contribute to offending (reg 5(1)(e)). The text establishes an executive direction role for the Commissioner in program allocation.

Court duties and powers (regs 11, 16(4), 17)

• Courts may require offenders to appear from time to time for a review of their progress in a DFV program (reg 17(1)).
• Courts may request participation notices from program facilitators (reg 17(2) and 16(4)).
• Courts are the place where breach applications are heard using prescribed forms (Form 4 for breaches of suspended sentences, Form 5A for breach of hospital orders), and judges certify Form 5B where relevant.

Rights and procedural protections embedded in the forms and regs

• Form 6 establishes a mechanism whereby an accused may, prior to sentence, request leave to admit other alleged offences to be taken into account by the sentencing court. The form contains a memorandum for the accused’s information that explains consequences and procedural protections (Schedule Form 6 Part A), including that an admission taken into account is not a conviction and that admissions cannot be used in subsequent proceedings if the conviction is maintained unless it is quashed (Form 6 Part A clauses (3)-(5)). This is a procedural right afforded to accused persons in sentencing processes.
• Reg 16(2) requires notifications to include particulars, which is an evidentiary standard that helps ensure recipients receive actionable information rather than bare assertions.

Interaction with penalty and enforcement provisions in the Act

• The Regulations refer to relevant Act sections for consequences. For example, reg 16(3)(b) notes that failure to comply with a program requirement may constitute a breach of the order and points to ss 39A/39B or 48F/48G of the Act for the consequences. Reg 11 prescribes Form 4 for applications under s 43(1) and (2) of the Act. The Regulations therefore structure procedural entry points but leave substantive sanctions to the Act.

Standards of decision

• The "reasonable grounds" threshold in reg 16(1)(c) is a legal standard that binds facilitator conduct to an objective/subjective mix familiar in administrative law contexts. The Regulations do not define "acceptable risk" beyond the statutory language.

Prescribed forms create duties to provide content and signature

• The Schedule’s forms (Forms 1, 4, 5, 5A, 5B, 6) require specified fields and are the prescribed method for triggering or recording certain processes. Signatory fields in Forms 4 and 5A indicate that a sheriff or registrar will lodge applications for breach proceedings, linking administrative gatekeeping to court processes.

In short, the Regulations allocate reporting and supervisory duties across non‑state and state actors, prescribe standard conditions that limit offenders’ liberty and privacy, and provide structured procedural mechanisms (forms and written notices) for raising and recording compliance and breach issues. They create rights and evidentiary structures for accused persons when other alleged offences are to be taken into account, and they require clinical certification for hospital orders.

The Regulations themselves do not set out new substantive penalties; instead they provide the procedural channels and documentary mechanisms by which the Act’s enforcement and penalty provisions are implemented. Key enforcement features and pathways in the Regulations are:

Breach processes via prescribed forms

• Reg 11 prescribes Form 4 for applications under s 43(1) and (2) of the Act (application for breach of an order suspending sentence). Form 4 sets out that an application will be heard at a named court and records the grounds for the application: either the commission of an offence punishable by imprisonment while the order was in force or within two years of the operational period, or a failure to comply with specified conditions (Schedule Form 4). The form structure formalises how the prosecuting or prescribed person frames the grounds for a breach hearing.
• Reg 12A prescribes Form 5A for applications under s 86(1) and (2) for breach of a hospital order. Form 5A mirrors Form 4’s procedural template for hospital order breaches.

Reference to the Act for consequences

• In places, the Regulations point parties to the Act’s substantive enforcement framework. For example, reg 16(3)(b) notes that a facilitator’s report of non‑compliance may amount to a breach of the order and directs readers to sections 39A/39B or 48F/48G of the Act for the consequences. Similarly, the forms reference the appropriate Act provisions that empower courts to deal with breaches (Form 4 references s 43 of the Act; Form 5A references s 86). The Regulations therefore create the ticket for entry to statutory enforcement rather than creating independent sanctions.

Court review powers and requirements to appear

• Reg 17(1) gives the court discretion to require an offender to appear from time to time for review of progress in a DFV rehabilitation program. Attendance at such reviews is a mechanism by which the court supervises compliance and may, depending on the Act’s breach provisions, proceed to enforcement steps based on the materials presented.

Notification‑triggered enforcement

• Reg 16 imposes reporting duties on program facilitators to notify police and probation and parole officers of DFV offending, DVO contraventions or reasonable concerns about unacceptable risk. Those notices, required to be in writing and to include particulars (reg 16(2)), are practical enablers of enforcement by police or the correctional authorities. That is, the facilitator’s written notice is a likely precondition to the formal breach processes a court may entertain.

Clinical certification and hospital orders

• Form 5 requires the Chief Health Officer to certify that a defendant appears to be suffering from mental illness requiring hospital treatment and that treatment can only be obtained by admission and detention in a hospital (Schedule Form 5 Part A), and to report on the availability of hospital facilities (Part B). Those certified materials are the factual foundation on which courts make hospital order decisions under the Act, and a failure to comply with hospital orders is processable by Form 5A.

Submission to monitoring and testing

• Reg 5 confers power for courts to impose conditions requiring offenders to wear approved monitoring devices, to permit installation and retrieval of necessary equipment in specified places, and to submit to breath, blood or urine tests at the request of a probation and parole officer or police officer. These conditions, when breached, can be the grounds for enforcement and for applications under the Act’s breach provisions.

Who enforces

• Enforcement steps are court‑based and initiated by prescribed persons. Reg 4 designates probation and parole officers, Agency employees, prosecutors and, in the hospital order context, the Chief Health Officer and the Commissioner as prescribed persons who may initiate or support enforcement processes. The Schedule forms show that prosecutors/police commonly initiate breach applications, with a sheriff or registrar lodging those applications.

Limits and omissions

• The Regulations do not specify penalties (terms of imprisonment, fines or specified additional orders) for breaches; those penalties sit in the Act. The Regulations also do not specify the content of "approved monitoring device" or the procedural safeguards around installation on third‑party property; they simply permit the court to impose such conditions and require the offender to allow placement and retrieval. The Regulations make no separate provision for appeals, remission or review beyond the court’s review powers in reg 17.

Administrative enforcement costs

• By requiring written notices with particulars (reg 16(2)) and prescribing standard forms, the Regulations increase administrative formality. Police, probation and parole officers, registrars and the court registry will bear processing costs. Program facilitators bear the cost and professional risk of making "reasonable grounds" judgments and providing written particulars.

In brief, penalties are enforced under the Act but the Regulations supply the procedural levers: forms for breach applications, duties to notify, formal record‑keeping requirements and court review mechanisms. The Regulations thereby shape the timing, available evidence and administrative path by which enforcement is advanced.

The Regulations are explicitly tied to the Sentencing Act 1995 by construction, but they also reference and rely upon other legislative instruments and administrative rules. The textual cross‑links and practical interactions are as follows.

Primary interaction with the Sentencing Act 1995

• Almost every provision in the Regulations is anchored to specific sections of the Act. Reg 2 addresses definitions in s 3(1) of the Act; reg 5 prescribes conditions for s 34(1)(c) and s 48(1)(d); regs 16-18 operate for ss 34(3) and 48(3) in relation to DFV rehabilitation programs; regs 11-13 identify prescribed forms for various Act sections (s 43, s 80, s 86, s 97AB, s 107). The Regulations function as subordinate instruments that fill in the operational detail the Act leaves to subordinate legislation.

Interaction with court procedural rules and local court statutes

• Reg 3 defines the proper officer for the Local Court as a registrar under the Local Court Act 2015. The note to reg 3 directs readers to rule 81A of the Supreme Court Rules 1987 for Supreme Court arrangements, thereby tying practice to separate court rules and the Local Court Act. The role of registrars/sheriffs in Forms 4 and 5A demonstrates that registry practice and judicial administration rules are relevant to enforcement mechanics.

Interaction with correctional and public health administrative regimes

• Reg 4(1) explicitly links prescribed persons to employees of the Agency responsible under the Minister for administration of the Correctional Services Act 2014. That means the Regulations interface with functions, definitions and organisational responsibilities found in the Correctional Services Act and any subordinate instruments under it. The Commissioner is named as a prescribed person for hospital order breach purposes, establishing an administrative bridge to correctional executive functions.
• Reg 12 and Schedule Form 5 bring the Chief Health Officer into the sentencing processes, linking sentencing to public health administrative powers and hospital capacity considerations. Form 5 requires the Chief Health Officer to certify mental illness and hospital availability, which will inevitably interact with hospital capacity and statutory duties under health legislation.

Interaction with domestic violence / DVO frameworks

• Reg 16 requires program facilitators to notify police if they become aware of conduct contravening a DVO while the offender is subject to an order, or if they reasonably believe the offender presents an unacceptable risk to a protected person. That ties the sentencing enforcement regime to the domestic violence protection order regime (the DVO regime), and therefore to the statutory framework governing DVOs (not reproduced in the Regulations). The DFV rehabilitation completion test in reg 18 explicitly includes the requirement that the offender did not breach any DVO in force during the order.

Interaction with criminal offences and evidentiary processes

• Form 6 (Schedule) operates where other alleged offences may be taken into account at sentencing. It interacts with criminal procedure by providing a standard way to warn an accused about the consequences of admitting unproven allegations for sentencing purposes. The Form includes procedural protections and consequences (e.g., admissions not amounting to conviction, limits on subsequent proceedings) which interact with the broader rules about pleas, admissions and sentence calculation in criminal law.

Statutory amendments and commencement (Endnotes)

• The Endnotes catalogue the Regulations’ amendment history and the Acts that have altered their scope. These include the Sentencing and Other Legislation Amendment Act 2022 (Act No. 28, 2022) which inserted Part 3 (regs 14-18) on DFV rehabilitation, the Justice Legislation Amendment (Domestic and Family Violence) Act 2023, and subsequent Justice and Other Legislation Amendment Acts in 2024. Those amending Acts are separate statutes; the Regulations therefore must be read in light of the operative amending statutes and their commencement dates as recorded in the Endnotes.

Interaction with administrative responsibilities and delegation

• The Regulations rely on administrative delegation: the Commissioner can direct program participation; registrars and sheriffs perform filing functions; program facilitators make risk judgments. Those roles will be implemented under respective administrative frameworks and policies (for example, policies for monitoring device use), which may be governed by other statutes or administrative instruments even though the Regulations do not specify them.

What the Regulations do not do

• They do not alter criminal offence definitions, nor do they set penalties. They do not provide an exhaustive code for monitoring device technology, data handling or privacy, nor do they contain detailed procedural rules for contested breach hearings; instead, they interact with court rules and the primary Act. They also do not define DVOs or the scope of "domestic violence", relying on those definitions in the Act or other statutes.

Net effect

• Practitioners must read the Regulations alongside the Sentencing Act 1995, the Local Court Act 2015, the Supreme Court Rules 1987, the Correctional Services Act 2014 and the various amending statutes listed in the Endnotes to determine the full legal and administrative picture. The Regulations serve as the operational bridge between sentencing law and practical enforcement and supervision mechanisms across correctional, health and policing systems.

The Regulations have been amended repeatedly since their inception in 1996. The Endnotes attached to the instrument provide the authoritative amendment chronology. Key entries in the amendment history are:

Founding instrument and early amendments

• The Sentencing Regulations were first notified and commenced on 1 July 1996 (SL No. 28, 1996). Early amendments included Sentencing Regulations (SL No. 57, 1996) (notified 19 December 1996; commenced same day) and a 1997 amendment (SL No. 9, 1997) (notified and commenced 9 April 1997). The Statute Law Revision Act 1997 also made consequential changes later that year.

2001-2014 period

• Sentencing (Consequential Amendments) Act 2001 (Act No. 56, 2001) (assent 19 October 2001; commenced 22 October 2001) made consequential changes to the sentencing framework.
• A set of regulatory amendments occurred in 2006: Sentencing Amendment (Prescribed Persons) Regulations 2006 (SL No. 1, 2006) (notified and commenced 1 February 2006), and Sentencing Amendment (Alcohol Court) Regulations 2006 (SL No. 21, 2006) (notified and commenced 14 June 2006).
• The Alcohol Reform (Substance Misuse Assessment and Referral for Treatment Court) Act 2011 (Act No. 19, 2011) made changes commencing 1 July 2011.
• The Prisons (Correctional Services) (Community Orders) Regulations (SL No. 53, 2011) were notified 20 December 2011 and commenced 27 February 2012.
• The Alcohol Mandatory Treatment Act 2013 (Act No. 17, 2013) commenced 1 July 2013.
• Sentencing Amendment Regulations 2014 (No. 23, 2014) and Sentencing Amendment (Identity Crime) Regulations 2014 (No. 24, 2014) were both notified and commenced on 1 July 2014, tied to broader identity crime and sentencing reforms.

2014-2016 consequential changes

• Correctional Services (Related and Consequential Amendments) Act 2014 (Act No. 27, 2014) (assent 4 September 2014; commenced 9 September 2014) made consequential amendments.
• Local Court (Repeals and Related Amendments) Act 2016 (Act No. 9, 2016) (assent 6 April 2016; commenced 1 April 2016) edited aspects of the court framework relevant to the regulations.

Recent and significant amendments introducing Part 3 (DFV rehabilitation)

• Sentencing and Other Legislation Amendment Act 2022 (Act No. 28, 2022) (assent 9 December 2022) inserted new provisions, notably Part 3 regulating DFV rehabilitation programs (the Endnotes show pt 3 heading and rr 14-18 were inserted by Act No. 28, 2022 s 35). The Act’s amendments had a later commencement for the Regulations set out in the Endnotes.
• Justice Legislation Amendment (Domestic and Family Violence) Act 2023 (Act No. 33, 2023) (assent 6 December 2023) commenced 25 March 2024 and interacts with DFV provisions.
• Sentencing Amendment Regulations 2023 (No. 23, 2023) were made on 30 November 2023 and commenced 1 December 2023 as part of Sentencing Legislation Amendment Act 2023 (Act No. 11, 2023).
• Justice and Other Legislation Amendment Act 2024 (Act No. 4, 2024) contains multiple commencement dates for different parts, with several provisions commencing 25 March 2024 and others at various dates (Endnotes list specific clauses and commencement information). Notably, pt 3 div 2 and parts relating to sentencing amendments commenced 25 March 2024 per the Endnotes.

Other amendments and general revisions

• The Endnotes list multiple formal amendments of a technical nature carried out by the Interpretation Legislation Amendment Act 2018 to rr 1, 3, 4 and 4A and the Schedule.
• The list of amendments (Endnotes 4) provides specific references to which regulations were substituted, inserted or repealed by particular amending instruments, for example: replacement of r 2 by No. 53, 2011 r 42; r 3 substituted by No. 21, 2006 r 3; r 4 amended and substituted across a number of Acts; insertion of new regs r 14-18 by Act No. 28, 2022 s 35; and a sequence of Schedule amendments across several instruments.

Practical effect of the amendment history

• The amendment record shows the Regulations have been regularly updated to align with statutory reforms (for example, alcohol treatment regimes, identity crime amendments, DFV reforms). When advising clients or operationalising compliance, practitioners must consult the Endnotes to confirm which provisions were in force at a particular time, as several amendments have staged commencements. The Regulations as reprinted are stated to be "As in force at 1 July 2024" which incorporates the amendments listed in the Endnotes up to the Justice and Other Legislation Further Amendment Act 2024 entries noted to have parts commence on 1 July 2024.

Workflows for checking currency

• To ensure correct compliance and enforcement, practitioners should cross‑check the Endnotes’ list of amending legislation and commencement dates when relying on particular regulatory duties (for instance, the DFV program provisions introduced by the 2022 Act and operationalised through 2023-24 amendments).

The Regulations as provided contain no case law, judicial decisions or litigation history. The instrument itself does not list any reported or unreported decisions that have interpreted these Regulations. The Schedule forms and regulatory text refer to court sections of the Act and administrative offices (registrars, sheriffs, Chief Health Officer), but the text does not cite or summarise judicial authorities.

Consequences of the absence of litigation history in the instrument

• Practitioners will need to search external legal databases and court reports to discover judicial interpretation or disputes about:
  • the meaning and application of prescribed conditions (for example, the scope of "approved monitoring device" and the implied privacy or property implications of installation and retrieval);
  • the threshold and application of the "reasonable grounds" standard in reg 16(1)(c) for program facilitators;
  • the evidentiary sufficiency of participation, completion or non‑compliance notices in breach proceedings;
  • the procedure and fairness obligations where program facilitators’ written notices trigger police or correctional action; and
  • the validity and use of Form 6 admissions in subsequent proceedings if a conviction is quashed.

What the Regulations themselves require in the absence of case guidance

• Because the Regulations set out formal mechanics and forms, administrative compliance will follow the letter of regs and the Schedule. However, absent binding guidance in the instrument, contested questions about the limits or procedural safeguards attendant on those duties will be resolved by courts applying general administrative and criminal procedural law, and those decisions will not be located in the Regulations themselves.

Practical recommendation implied by the Regulations

• Where a facilitator, probation officer, or legal practitioner is unsure about the correct course of action when a notification duty is triggered, the Regulations require written notice with particulars (reg 16(2)). That procedural minimum protects the notifier and provides a clear basis for any later contested enforcement step. For litigators, the absence of litigation history in the Regulations signals a need to compile persuasive materials and to rely on broader legal principles when litigating points arising from the Regulations.

The Regulations are precise in places but leave substantive gaps and practical traps that practitioners and administrators should note. Below are specific "gotchas" drawn from the text.

1. Written notification requirement and particulars (reg 16(2))

• Program facilitators must notify police and probation and parole officers in writing and must include "the particulars of the offender's conduct of which the program facilitator is aware". The requirement to include particulars increases evidentiary expectations. A facilitator who notifies orally, or in writing but with inadequate particulars, risks the notice being treated as non‑compliant, which may compromise enforcement action and potentially expose the facilitator to procedural critique.

2. "Reasonable grounds" trigger requires judgement (reg 16(1)(c))

• Facilitators must notify if they "believe on reasonable grounds" the offender may present an unacceptable risk. That phrase imposes a mixed subjective/objective standard that can be tested in later proceedings. Facilitators may inadvertently expose themselves to legal scrutiny or internal review if their "reasonable grounds" conclusions are poorly documented. Good practice is to record the factual basis contemporaneously.

3. Completion is conditional, not merely course completion (reg 18)

• Reg 18 requires the offender to complete the DFV program, not breach any DVO in force during the order, commit no domestic violence during the order, and have a probation and parole officer receive a completion notice. An offender can complete program modules yet still fail to satisfy the statutory test because of a DVO breach or an incident of domestic violence in the order period. This cumulative test can frustrate offender expectations and generate disputes about whether completion was "satisfactory".

4. Monitoring device terms undefined (reg 5(1)(c)-(d))

• Reg 5 allows courts to order offenders to wear or have attached an "approved monitoring device" and to allow placing, installation and retrieval in a specified place of anything necessary for its operation. The Regulations do not define "approved monitoring device", the approval process, data retention, privacy safeguards, or third‑party consent for equipment on private property. Those omissions create operational ambiguity and potential legal friction, especially around privacy and property rights.

5. Short reporting window to probation and parole (reg 5(1)(a)(ii))

• Offenders must report to a probation and parole officer at a specified place within two business days after the order comes into force. A "business day" timing standard can catch offenders who are out of the Territory, hospitalised, or otherwise unable to comply, creating immediate technical breach risks. Courts and officers will need to account for legitimate non‑compliance reasons; practitioners should document any impediment to reporting.

6. Tests at request of police or probation and parole officer (reg 5(1)(h))

• The requirement that an offender "must submit to a breath test, breath analysis or blood or urine test at the request of a probation and parole officer or police officer" creates operational questions about how tests are administered, the chain of custody for samples, and what lawful grounds police or supervising officers must have for requesting a test. The Regulations do not specify criteria or procedural safeguards for testing requests.

7. Forms that create technical grounds for challenge (Schedule Forms)

• The Schedule’s forms contain boilerplate and signature blocks for sheriffs/registrars, prosecutors, the Chief Health Officer and judges. Failure to complete a form correctly or to obtain the correct signatory may provide grounds for procedural challenges in breach proceedings. For example, Form 5B is signed by a Supreme Court or Local Court judge; an incorrect judicial signatory could raise procedural questions about the certificate's validity.

8. Interaction with DVOs but no procedural guidance (regs 16 and 18)

• Program facilitators must notify police if they become aware of contraventions of a DVO. The Regulations do not specify whether facilitators should first seek consent from victims before notifying police, nor how facilitators should handle risk‑sensitive information. Facilitators must reconcile confidentiality obligations to clients with the statutory duty to notify; the Regulations require written particulars but do not provide privacy rules or victim safety protocols.

9. No statutory definition of "domestic violence" in these Regulations

• Part 3 uses the terms "domestic violence" and "DVO" but the Regulations do not define them; readers must look to the Act or other statutes for precise meanings. Practitioners need to be careful when applying the completion test (reg 18) to verify the operative definition of "domestic violence" and whether specific acts fall within it.

10. Administrative burden falls on non‑state actors

• Program facilitators and correctional staff carry the brunt of the notification and record‑keeping obligations. If facilitator organisations are small service providers, the cost of legal compliance (writing particulars, maintaining records and responding to court requests for participation notices) may be non‑trivial and underfunded.

11. Forms do not themselves create rights to legal assistance

• The forms and notice duties impose obligations but do not provide express procedural protections (for example, the right to legal representation at a review under reg 17). Parties should be aware that legal representation may not be automatically provided at court reviews absent other statutory entitlements.

12. Temporal gaps and staged commencement of amendments (Endnotes)

• The Endnotes show multiple amending Acts with different commencement dates. Practitioners must confirm which version of the Regulations was in force at the relevant time. Failure to do so can generate procedural and substantive error when advising about past conduct or when invoking breach processes.

These points are not exhaustive but highlight specific operational traps. Each "gotcha" follows from the Regulations’ text: they arise from what the Regulations require to be done, what they leave undefined, and how they allocate reporting and supervisory burdens.

Compliance under the Regulations requires a coordinated, procedural approach by each affected actor. Below are practical steps tied to the regulatory text to meet obligations and reduce implementation risk.

For courts and court registries

• Use the prescribed forms in the Schedule exactly as required. For breach applications under s 43(1)/(2) use Form 4 (Schedule, Form 4); for hospital order breaches use Form 5A; for hospital order certification rely on Form 5; for identity‑crime victim certificates use Form 5B; and for listing other alleged offences use Form 6.
• Ensure that the proper officer for Local Court matters is the registrar as defined in the Local Court Act 2015 (reg 3). For Supreme Court practice, check rule 81A of the Supreme Court Rules 1987 per the note to reg 3.
• When requesting participation notices under reg 16(4) or requiring attendance under reg 17(1), make clear the timing and information required from the program facilitator to prevent defective or delayed notices.

For program facilitators (DFV rehabilitation programs)

• Implement written notification templates that capture the particulars required by reg 16(2). Keep contemporaneous records of the factual basis for any notice, including dates, participants, reported incidents, risk indications and the facilitator’s reasons for concluding there are reasonable grounds.
• Train staff to identify what constitutes "domestic violence" and "contravention of a DVO" under the relevant statutory definitions (the Regulations assume those definitions live elsewhere).
• Establish protocols for deciding when to serve a completion notice versus a non‑compliance notice to probation and parole officers (reg 16(3)). Keep a clear audit trail showing program attendance, modules completed, and remediation offered.
• Prepare for courts’ potential requests for participation notices (reg 16(4) and reg 17(2)) by keeping participation summaries that are concise, factual and compliant with confidentiality laws. Ensure protocols balance legal duties to notify police with client confidentiality obligations, and obtain express consent or work with legal counsel where appropriate.
• When filing a written notice to police, ensure these are routed through appropriate organisational legal or safeguarding officers to reduce risk of procedural error.

For probation and parole officers and the Commissioner’s office

• Establish administrative receipt points for completion and non‑compliance notices from program facilitators and mark them against offender records to inform supervision and enforcement decisions (reg 16(3)).
• Ensure testing processes are operational: establish procedures for requesting and conducting breath, breath analysis, blood or urine tests at the request of supervising officers or police (reg 5(1)(h)). Record the lawful grounds for tests and maintain chain‑of‑custody records for samples.
• Where the court imposes monitoring device conditions, coordinate with relevant technical units about installation, maintenance, and retrieval procedures (reg 5(1)(c)-(d)). Document consent processes, access arrangements and property owner interactions.

For police

• Designate an intake and investigation pathway for written notices received under reg 16(1). Notices must include particulars (reg 16(2)); police should log notices and assess whether an investigation, DVO proceeding or breach application is warranted.
• Coordinate with prosecutors and registrars when a breach application under Form 4 or Form 5A is contemplated.

For Chief Health Officers and clinical staff

• Use Form 5 to certify and report on hospital orders as required by reg 12 and Schedule Form 5. Ensure the certificate includes the medical practitioner’s opinion about the necessity of admission and the Chief Health Officer’s report on the availability of facilities.
• Maintain records demonstrating that the clinical opinion was informed by a medical practitioner’s assessment, and that facilities are available as stated in Form 5 Part B.

For prosecutors and legal practitioners

• When advising on or initiating breach proceedings, ensure that the appropriate prescribed form is used and that the grounds are correctly stated in line with the Act and the Regulation’s prescribed forms (Form 4 and Form 5A).
• In matters where other alleged offences are to be taken into account at sentencing, follow Form 6’s structure and ensure the accused receives the memorandum for information to avoid later procedural objections.

For offenders and defence counsel

• Be aware that the completion standard for DFV rehabilitation programs is cumulative (reg 18). Do not rely on course completion alone: check for any DVO breaches, episodes of domestic violence during the order and confirm the probation and parole officer has received the completion notice.
• If a condition requires reporting within two business days (reg 5(1)(a)(ii)), plan for the logistical requirements to meet that deadline or document impediments promptly to avoid technical breaches.
• When an offender is asked to allow installation or retrieval of monitoring equipment (reg 5(1)(d)), counsel should clarify the precise terms, location, duration, and access protocols and negotiate reasonable terms in the order where appropriate.

Recordkeeping and evidence practice

• Parties required to give notices must keep copies of written notices, contemporaneous notes, and any supporting materials (incident reports, attendance logs, clinical notes where appropriate and lawful). Reg 16(2) requires particulars; those particulars are evidence in enforcement or review.
• All written notices should be dated, signed and delivered by a traceable method to the named recipients (police and probation and parole officer) to create a clear chain of delivery.

Privacy, confidentiality and victim safety

• The Regulations require disclosures to police and supervisory authorities but do not supply detailed privacy rules. Organisations must ensure compliance with applicable privacy laws and victim safety protocols when preparing notices. This includes limiting unnecessary disclosures and ensuring notification does not inadvertently place a protected person at increased risk.

Policies and training

• Agencies, facilitators and courts should adopt policies that align with the Regulations: template notices, training on "reasonable grounds", guidelines for the use of monitoring devices, protocols for testing and sample handling, and integrated response pathways for DFV incidents reported by facilitators.

Check cross‑legislation and commencement timing

• Because the Regulations interact with the Act and multiple amending statutes (see Endnotes), practitioners should verify that the particular regulatory provisions in force at the relevant date match the advice or action they propose. The Endnotes provide commencement details that affect which provisions apply.

In summary, compliance requires disciplined paperwork, clear audit trails, staff training on reporting thresholds and definitions, and coordination among police, probation and parole officers, program facilitators, clinical staff and courts. The Regulations specify mechanics; successful compliance is administrative as much as legal.
