### 5 Application of Act
> This Act, other than [Division 3](#HP9@HD3@EN) of [Part 9](#HP9@EN) , does not apply to –
>

> >
> > > (b) [*\[Section 5 Amended by No. 22 of 1999, s. 5, Applied:01 Feb 2000\]*](/view/html/inforce/2000-02-01/act-1999-022#GS5@Hpb@EN) a court of summary jurisdiction within the meaning of the [Justices Act 1959](/view/html/inforce/2026-04-12/act-1959-077) that is hearing a charge against a person who has not attained the age of 18 years.
