131 Transitional provision—Sentencing and Mental Health Acts (Amendment) Act 2005 (1) This Act, as in force immediately before the commencement day, continues to apply on and after that day to a person who, immediately before that day, was the subject of a hospital order made under section 93(1)(d) as in force before that day. (2) Subsection (1) ceases to have effect 2 years after the commencement day and consequently the person ceases to be an involuntary patient at that time, unless he or she has been discharged from the hospital order earlier. (3) A hospital security order in force under section 93(1)(e) immediately before the commencement day is taken, on and after that day, to be a hospital security order made under section 93A for the remainder of its duration. ***commencement day*** means the day on which section 6 of the **Sentencing and Mental Health Acts (Amendment) Act 2005** comes into operation.
