113 Maximum term of imprisonment for indictable offence heard and determined summarily S. 113(1) amended by Nos 48/1997 s. 28(7), 68/2009 s. 97(Sch. item 110.81). (1) If a person is convicted by the Magistrates' Court in a summary hearing of an indictable offence under section 28(1) of the **Criminal Procedure Act 2009**, the maximum term of imprisonment to which the Court may sentence the offender is 2 years. (2) Subsection (1) is subject to any contrary intention appearing in any Act other than this Act. S. 113A inserted by No. 48/1997 s. 31.
