105RImmunity

105R Immunity (1) The Secretary, a delegate of the Secretary or an employee within the meaning of the **Public Administration Act 2004** is not personally liable for anything done or omitted to be done in good faith— (a) in the carrying out of a function or the exercise of a power under this Part; or (b) in the reasonable belief that the act or omission was in the carrying out of a function or the exercise of a power under this Part. (2) Any liability resulting from an act or omission that, but for subsection (1), would attach to the Secretary, a delegate of the Secretary or an employee within the meaning of the **Public Administration Act 2004** attaches instead to the State.
