Sentence Administration (Interstate Transfer of Community Based Sentences) Act 2009

The Act is built around a limited set of terms and concepts that determine scope, procedure and effect. Central definitions and their mechanical roles are:

• Community based sentence. For Western Australia, this is a community based order under Part 9 of the Sentencing Act 1995, an intensive supervision order under Part 10, or a conditional suspended imprisonment order under Part 12 Division 1 (s 7(a)(i)-(iii)). For interstate jurisdictions, the term is defined by the corresponding law of that jurisdiction (s 7(b); s 10). The Act therefore ties applicability to specific WA sentencing instruments and to whatever corresponding instruments participating jurisdictions declare or have under corresponding law (s 7; s 10).

• Participating jurisdiction and interstate jurisdiction. A participating jurisdiction is Western Australia or any State/Territory declared in regulations (s 8(3)); an interstate jurisdiction is any participating jurisdiction other than Western Australia (s 8(4)). The regulations power therefore controls which jurisdictions can take part (s 31).

• Local authority and interstate authority. The local authority is the chief executive officer of the Department (s 12). The interstate authority is whatever entity is named as the local authority under the corresponding law of the interstate jurisdiction (s 11). The scheme assumes a mirror institutional role in each participating jurisdiction.

• Local register. The Department must keep a local register of interstate sentences registered in WA (s 14(1)), and may correct mistakes (s 14(2)). Corresponding registers exist under other jurisdictions’ laws; the Act creates mechanisms for correcting inaccurate interstate register information and resolving disputes (ss 28-29).

• Registration criteria and required details. Registration is discretionary but conditional. The statutory registration criteria require (a) offender consent not withdrawn, (b) existence of a corresponding community based sentence under WA law, (c) the offender can comply locally, and (d) the sentence can be safely, efficiently and effectively administered locally (s 19(1)(a)-(d)). The Act authorises the regulations to declare corresponding sentences or laws (s 19(2)(b); s 10). The local authority may request specified supporting documents and particulars with the transfer request, including a certified copy of the interstate sentence, the offender’s consent, pre‑sentence reports, psychological assessments, criminal record and compliance history, and an explanation that the offender has been told about the consequences of registration (s 16(2)(a)-(i)).

• Decision and preconditions. The local authority may (i) register, (ii) register subject to preconditions, or (iii) refuse registration (s 20(1)). Preconditions are tools to ensure the offender can comply and is willing to comply (s 21); preconditions might include a requirement to demonstrate residence in WA by a stated time or to report to a specified person (s 21(2)(a)-(b)). The authority must give written notice of preconditions and may later amend or revoke them (s 21(3)-(4)). The local authority may make its decision without hearing the offender (s 20(4)).

• Legal effects of registration. Once registered, the interstate sentence becomes a community based sentence in force here and ceases to be so in the interstate jurisdiction; it is taken to have been validly imposed by the appropriate court in WA; the offence is taken to be an offence against WA law but the penalty is taken to be the relevant penalty under the originating jurisdiction’s law (s 24(1)(a)-(f); s 24(1)(d)-(e)). Any part of the sentence already served interstate is taken to have been served here (s 24(1)(f)). WA law applies to the sentence and breaches, with changes prescribed by regulations (s 24(1)(h)). The Act preserves appeal or review rights in the originating jurisdiction (s 24(3)-(5)).

• Evidentiary presumptions. Certificates appearing to be signed by the local authority or interstate authority stating matters from the registers are evidence of the matters, and courts must accept such certificates as proof if there is no contrary evidence (s 30(1)-(6)).

These concepts allocate legal formality (registration, registers, certificates), administrative discretion (local authority decisions, preconditions, delegation s 13) and regulatory flexibility (participating jurisdictions, corresponding laws, prescribed matters s 31). The Act therefore creates a hybrid administrative-legal process that converts interstate community based sentences into enforceable WA sentences once statutory thresholds and procedures are met.

The Act primarily affects four categories of actors and, secondarily, the administrative bodies that service transfers:

• Offenders. The Act applies to adults and to persons covered by Young Offenders Act 1994 s 50A (s 4(1)). Offenders subject to community based sentences under participating jurisdictions are the subjects of registration requests. Their consent is a statutory precondition for registration (s 19(1)(a)), and they can withdraw consent at any time prior to registration (s 18). The Act requires the interstate authority to state the reasons given by the offender for requesting registration and to explain the consequences of registration to the offender in language likely to be readily understood (s 16(2)(g)-(h)). Once a sentence is registered, the offender becomes subject to WA law in relation to that sentence (s 24(1)(h)), and may be re‑sentenced in WA for breaches (s 24(1)(g)). Offenders bear the practical burdens of consenting, meeting any preconditions imposed to demonstrate capacity to comply (s 21), and adapting to different breach consequences and enforcement practices in WA (s 16(2)(g)).

• Interstate authorities (sending jurisdictions). An interstate authority initiates registration in WA by making a written request and supplying prescribed documents (ss 15-16). It must certify copies of sentences, provide offender consent documents, pre‑sentence and assessment reports, compliance history, and statements about served parts of the sentence and the offender’s reasons for transfer (s 16(2)). If an offender requests registration in WA, the interstate authority is the party that transmits the packet and communicates with the local authority; it also receives notice of registration or refusal (s 23; s 20(6)). The interstate authority must also respond to requests for additional information (s 17) and, where a local sentence has been registered interstate, coordinate corrections and dispute responses under ss 28-29. This places administrative and record‑keeping burdens on interstate authorities.

• Local authority (Western Australia Department). The CEO of the Department is the local authority (s 12) and may delegate functions to public service officers (s 13). The CEO decides whether to register, may impose preconditions (s 21), keeps the local register (s 14), and issues notices of registration or refusal (ss 22-23; s 20(6)). The Department therefore bears the operational cost of intake, decision‑making, monitoring preconditions, registering details and handling communications with interstate authorities and offenders. The Act permits the local authority to decide without hearing the offender (s 20(4)), which centralises decision power in the Department.

• Courts and enforcement agencies in this jurisdiction. Once registration occurs, courts in WA treat the sentence as validly imposed by the appropriate court here (s 24(1)(b); s 24(6)), and may deal with breaches or exercise powers in relation to the sentence. Police, probation officers and other supervisory entities will face the practical task of supervising compliance under WA law (s 24(1)(h)); the Act allows regulations to prescribe how WA law applies with changes (s 24(1)(h); s 31). Courts must accept certificates from the local or interstate authority as evidence unless there is contrary evidence (s 30(5)). This affects evidence pathways and evidentiary practice.

Secondary effects include family members and employers of offenders who may be affected by the offender’s change of supervision jurisdiction, and the fiscal and staff resources of the Department and interstate authorities who must process requests and maintain registers. The Act does not prescribe fees or funding arrangements; those administrative costs fall on the agencies unless regulations prescribe otherwise (s 31 allows prescription of matters necessary to give effect to the Act, but the Act does not itself authorise fees).

Finally, the Act excludes certain sentences and sentence components from its reach: parole orders and sentences to the extent they impose fines or require reparation are excluded (s 4(2)(a)-(c)), so victims and creditors affected by fines or reparations are not within the transfer scheme for those sentence components.

The Act creates statutory duties for authorities and procedural rights for offenders. Key duties and rights include the following, tied to the relevant provisions.

Duties of the local authority (Department CEO)

• Maintain the local register of registered interstate sentences and correct mistakes or omissions (s 14(1)-(2)).

• Consider a written request for registration that meets form and documentary requirements (s 16(1)-(2)); may ask for additional information (s 17).

• Decide whether to register, register subject to preconditions, or refuse registration, having regard to the registration criteria and any prescribed matters (s 20(1)-(3)). The authority may nevertheless refuse even if the registration criteria are met (s 20(3)(a)), but must not register unless satisfied the criteria are met (s 20(3)(b)).

• Give written notice of refusal to the offender and the interstate authority if registration is refused (s 20(6)).

• If registering, enter the required details into the local register (s 22), and give written notice of registration to the offender and interstate authority including the date of registration (s 23).

• Impose, amend or revoke preconditions for registration and give written notice of those preconditions (s 21(1), (3)-(4)).

• Delegate functions to public service officers where appropriate (s 13).

Duties of interstate authorities

• Make requests for registration in writing and supply the specified documents (s 15; s 16(1)-(2)).

• Provide certified copies of the interstate sentence, offender consent, pre‑sentence reports, psychological assessments, criminal record details and compliance history, and a statement explaining parts of the sentence already served and conveying that the offender has been informed of consequences of registration (s 16(2)(a)-(g)).

• Receive notice of registration or refusal and respond to information requests from the local authority (s 17; s 23; s 20(6)).

Rights of offenders

• Consent is required for registration and may be withdrawn at any time before registration by written notice to the local authority (s 19(1)(a); s 18).

• Offenders must be informed, by the interstate authority, about the consequences of registration in language likely to be readily understood (s 16(2)(g)).

• The offender’s reasons for requesting registration must be set out by the interstate authority (s 16(2)(h)).

• Appeals and reviews related to the underlying conviction or sentencing in the originating jurisdiction remain preserved; the Act expressly does not affect such rights (s 24(3)) and provides that any appellate decision in the originating jurisdiction has effect here (s 24(4)). The Act, however, does not create a new right of appeal in WA in relation to those matters (s 24(5)).

Enforcement and evidentiary duties

• Courts must accept certificates from a local or interstate authority as proof of register matters unless there is contrary evidence (s 30(1)-(6)). Authorities are therefore obliged to issue accurate certificates and to supply corrected information where registers are inaccurate (ss 28-29).

Regulatory duties and powers

• The Governor may make regulations prescribing necessary or convenient matters to give effect to the Act, including declaring participating jurisdictions and corresponding laws (s 31; s 10; s 8(3)). The regulations can therefore shape duties and practical requirements not enumerated in the Act.

Other operational features

• The local authority may decide without hearing the offender (s 20(4)), and may register sentences even if the interstate jurisdiction is not the originating jurisdiction or where the sentence has previously been registered or refused (s 20(5)). These provisions allocate procedural discretion to the Department and limit procedural rights for offenders regarding an administrative hearing within WA.

Collectively, the Act imposes documentary and communicative duties on interstate authorities, record‑keeping and decision‑making duties on the local authority, and conditional rights on offenders focused on informed consent and the opportunity to withdraw consent prior to registration. The Act prioritises administrative processing and inter‑agency exchange over formal adversarial procedures within WA.

The Act does not create new criminal offences, monetary penalties or a dedicated enforcement agency; rather, it sets out how existing community based sentences, once registered, are to be enforced in Western Australia and how breaches are dealt with. Key enforcement mechanics are:

Registration confers enforceability in WA

• Once registered, the interstate sentence "becomes a community based sentence in force in this jurisdiction" and ceases to be enforceable in the interstate jurisdiction (s 24(1)(a)). Registration therefore transfers enforcement jurisdiction.

• The court treatment and enforcement pathway is established by taking the sentence to have been validly imposed by the appropriate court in WA (s 24(1)(b); s 24(6)), which determines the competent forum for matters related to the sentence in WA: the Magistrates Court for summary offences or appeals from summary courts, and the Supreme Court otherwise (s 24(6)).

Consequences for breaches

• Breaches of a registered sentence may be dealt with in WA whether the breach occurred before or after registration (s 24(1)(g)). The local law of WA applies to the sentence and to any breach, subject to changes prescribed by regulations (s 24(1)(h)). That enables WA courts to hear breach proceedings and to apply WA procedural or enforcement tools as the regulations permit.

• The Act explicitly warns that consequences for breach in WA may be different from those in the interstate jurisdiction and requires the interstate authority to have explained this to the offender (s 16(2)(g)(ii)-(iii)). The offender’s risk profile for breach penalties therefore can change on transfer.

Penalty attribution

• While the offence for which the sentence was imposed is taken to be an offence against WA law after registration (s 24(1)(d)), the penalty is taken to be the relevant penalty under the law of the originating jurisdiction, not WA’s penalty for an offence of that kind (s 24(1)(e)), except where WA is the originating jurisdiction (s 24(2)). This means that the substantive sanction level is ordinarily preserved from the originating jurisdiction despite enforcement moving to WA courts. The practical effect is that WA will enforce the originating jurisdiction’s penalty regime (as the "relevant penalty") subject to any regulatory changes the Governor may prescribe under s 31 and s 24(1)(h).

Evidentiary facilitation

• The Act facilitates proof in breach or enforcement proceedings by treating certificates from the local or interstate authority as evidence of matters recorded in the registers and requiring courts to accept such certificates as proof if there is no evidence to the contrary (s 30(1)-(5)). This reduces transactional friction in court proceedings about registration facts and past service of sentence, while preserving scope for contrary evidence.

Administrative enforcement levers

• The local authority can impose preconditions for registration to establish that the offender can comply and is willing to do so; failure to meet preconditions can prevent registration (s 21(1)-(2); s 22(2)). These preconditions operate as preventive enforcement levers by conditioning transfer on demonstrable capacity to comply.

Lack of express financial penalties or enforcement powers

• The Act contains no express penal sanctions for authorities that fail to perform duties (for example, no criminal offence for failing to correct the register), and does not specify fines or costs to be charged to parties; such matters could be supplied in regulations if the Governor prescribes them (s 31). Enforcement in relation to sentence compliance is therefore exercised through the ordinary sentencing and breach mechanisms available to WA courts and supervisory agencies once the sentence is registered.

Preservation of appellate rights

• Appeal or review rights relating to the original conviction or imposition of sentence remain in the originating jurisdiction (s 24(3)), and any sentence or decision of that appeal has effect in WA (s 24(4)). The Act clarifies that registration does not extinguish substantive appellate remedies in the originating jurisdiction, which can affect enforcement outcomes in WA if an appellate decision alters the sentence.

Operational enforcement burdens

• Practically, enforcement requires WA to receive and maintain accurate register entries (s 14), supervise compliance under WA rules (s 24(1)(h)), and process breach proceedings using the evidentiary machinery in s 30. These tasks transfer administrative and operational costs to the Department and courts.

In short, the Act does not create new penalties but reassigns the locus of enforcement to WA courts and supervisory regimes on registration, preserves originating penalties in most cases, enables the use of certificates as prima facie evidence, and provides administrative preconditions and regulatory paths that shape enforcement practice.

The Act is designed as a cooperative instrument that integrates with Western Australia’s Sentencing Act 1995, the Young Offenders Act 1994, and the comparable laws of other jurisdictions. Key points of statutory interaction:

Sentencing Act 1995

• The Act anchors the definition of community based sentences to specific instruments under the Sentencing Act 1995: community based orders (Part 9), intensive supervision orders (Part 10) and conditional suspended imprisonment orders (Part 12 Division 1) (s 7(a)). Therefore, the character and content of sentences capable of transfer are determined by WA sentencing law as enacted in the Sentencing Act 1995.

Young Offenders Act 1994

• The Act applies to adults and persons to whom Young Offenders Act 1994 s 50A applies (s 4(1)). That means young persons who fall within the specific cross‑reference in the Young Offenders Act are within the transfer scheme. Any age‑specific procedural protections in the Young Offenders Act remain relevant in practice.

Corresponding laws and interstate statutory schemes

• For sentences from other jurisdictions, the Act relies on "corresponding law" to determine what counts as a community based sentence there (s 10). The Governor may, by regulation, declare that particular interstate laws correspond (s 10(b)) and may declare participating jurisdictions (s 8(3)). The Act therefore depends on parallel statutory schemes in other jurisdictions to deliver mutual recognition. Interactions include the interstate authority being whatever entity serves as the local authority under the corresponding law (s 11), and the ability to correct or dispute entries in interstate registers under ss 28-29.

Effect on criminal classification and penalty law

• On registration, the offence for which the sentence was imposed is taken to be an offence against WA law (s 24(1)(d)), but the penalty is taken to be the relevant penalty under the originating jurisdiction’s law (s 24(1)(e)), unless WA is the originating jurisdiction (s 24(2)). This creates an interaction between substantive criminal law (classification of offences under WA statutes) and the originating jurisdiction’s penalty regime. The effect is that WA courts will enforce the originating penalty even while treating the offence as a WA offence for enforcement purposes.

Appellate and review rights

• The Act preserves rights of appeal or review in the originating jurisdiction relating to conviction or imposition of sentence (s 24(3)). Any resulting appellate orders take effect in WA as though imposed in WA (s 24(4)). However, the Act does not create new appeal rights in WA concerning those matters (s 24(5)). This preserves the primacy of the originating jurisdiction’s appellate routes while ensuring that appellate outcomes bind WA authorities.

Regulatory interface

• The Governor’s regulation‑making power (s 31) can interact with many substantive points in other laws: regulations can declare participating jurisdictions (s 8(3)), corresponding laws (s 10(b)), or corresponding community based sentences under WA law for which transfer is permitted even if not strictly corresponding (s 19(2)(b)). Regulations may also prescribe required details, define procedural elements, and potentially affect how WA law applies to registered sentences (s 24(1)(h)). Therefore, the operation of the Act in practice will depend significantly on the content of regulations and the interaction of those regulations with WA sentencing law and interstate statutory frameworks.

Evidentiary rules and court practice

• The Act provides that certificates from the local authority or interstate authority are evidence of register matters and that courts must accept them unless there is contrary evidence (s 30(1)-(6)). That interacts with ordinary evidence law by creating a statutory evidentiary route for proving registration, previous service and related particulars.

Exclusions and gaps

• The Act expressly excludes parole orders and aggregate sentence components that impose fines or reparation from the transfer scheme (s 4(2)(a)-(c)). Those excluded elements remain governed by parole legislation, fines enforcement statutes and restitution laws in each jurisdiction. The Act therefore does not create cross‑jurisdictional mechanisms for financial penalties or parole supervision.

In sum, the Act is an overlay that links WA’s sentencing statutes to corresponding interstate regimes through administrative recognition and register mechanisms, while preserving originating appellate remedies and retaining certain exclusions. The regulation power is a key interface that can shape alignment and operational detail across jurisdictions.

The compilation table supplied in the Act text records the Act’s enactment and commencement history as follows:

• Short title: Sentence Administration (Interstate Transfer of Community Based Sentences) Act 2009 (5 of 2009).

• Assent: 14 May 2009 (s 1 and s 2 commence on the day of assent, s 2(a)).

• Other provisions commencement: The remainder of the Act commenced by proclamation on 1 October 2011 (Gazette reference: 23 Sep 2011 p. 3811), pursuant to s 2(b).

The Act text provided contains no further amendment entries or schedules showing subsequent amendments. The compilation table does not list any later amending Act numbers or amendment dates. Therefore, based on the supplied material, the legislative history is limited to enactment in 2009 and staged commencement in 2009 (s 1-2) and 2011 (rest of the Act). No other amendments, repeals, or legislative modifications are recorded in the material you supplied.

Regulation‑level changes are not recorded in the Act text. The Act grants a broad power for the Governor to make regulations prescribing matters necessary or convenient for giving effect to the Act (s 31). These regulations could add operational details, declare participating jurisdictions, declare corresponding laws or sentences, and prescribe required details for registers and certificates (see s 10; s 8(3); s 19(2)(b); s 22(3); s 30(3)). Any such regulations are not printed in the Act text provided and are therefore not reflected in the compilation table here.

If you require a complete legislative history including amending Acts, regulation instruments made under s 31, and commencement notices beyond what appears in the compilation table, you will need to consult WA Government Gazettes, the consolidated statute database or the Department’s legislative instrument registers to identify regulations, disallowable instruments, or later statutes that amend or interact with this Act.

The Act text supplied does not include any judicial decisions or references to cases. The Act itself does not name any cases, nor does it record litigation arising under it. The statute provides mechanisms (for example, certificates under s 30) for evidentiary use in courts, and preserves appellate rights in the originating jurisdiction (s 24(3)-(5)), but no decisions interpreting or applying the Act are contained in the material you supplied.

Consequently, there is no litigation history within the Act text to summarise. To assemble litigation history, decisions applying these provisions, questions about interpretation of registration criteria, or disputes about the evidentiary effect of certificates, you would need to search legal databases and case law reporters for decisions that cite this Act or for decisions involving interstate transfer of community based sentences involving WA. The statutory provisions that might be litigated include the registration criteria (s 19), the local authority’s discretionary power (s 20), the preconditions regime (s 21), the legal effect of registration (s 24), and the evidentiary presumptions for certificates (s 30).

Given the Act’s preservation of originating jurisdiction appellate rights and the potential for discretion in registration, litigation that might arise would plausibly focus on procedural fairness where an offender claims unfairness from a decision taken without a hearing (s 20(4)), on the meaning of "can be safely, efficiently and effectively administered" in s 19(1)(d), or on the interaction between the "relevant penalty" under the originating jurisdiction and WA enforcement mechanisms (s 24(1)(e), (h)). None of those hypothetical disputes appear in the statutory text provided.

If you want a jurisdictional search for reported decisions mentioning this Act or decisions on interstate transfer of community based sentences involving Western Australia, I can prepare a targeted case law search plan and list likely databases and search terms.

This Act contains several provisions and interactions that can produce outcomes unfamiliar to practitioners who assume simple recognition or identical enforcement across borders. The following are concrete practical points to watch for, each tied to the statutory text.

Consent and withdrawal window

• Registration requires the offender’s consent and the offender may withdraw consent at any time before registration by written notice to the local authority (s 16(2)(b); s 18). This gives the offender an explicit window of leverage up to the moment of registration. An interstate authority should therefore not assume consent is irrevocable.

Discrepancy between offence classification and penalty

• On registration the relevant offence is taken to be an offence against WA law (s 24(1)(d)), but the penalty is taken to be the "relevant penalty" under the originating jurisdiction’s law (s 24(1)(e)). Practitioners should not assume that classification and penalty will both follow WA law post‑registration; the Act preserves the originating penalty except where WA is the originating jurisdiction (s 24(2)). That can be counterintuitive when WA’s maximum or range differs.

Registration without hearing and wide discretion

• The local authority may decide without hearing the offender (s 20(4)) and may refuse registration even if the registration criteria are met (s 20(3)(a)). Administrative discretion is therefore broad, and the Act does not require a hearing or an internal merits review prior to refusal. Offenders’ procedural protections on the administrative decision are therefore limited by the statute.

Preconditions and monitoring burden

• The local authority may impose preconditions to be satisfied before registration, such as proving residence in WA or reporting to a specified person (s 21(2)(a)-(b)). Meeting preconditions may require the offender to generate documentary evidence or attend appointments, which imposes compliance effort and potential delay.

Regulatory uncertainty

• The Act delegates significant detail to the regulations: declarations of participating jurisdictions (s 8(3)), the scope of corresponding laws and sentences (s 10; s 19(2)(b)), and how WA law applies to registered sentences (s 24(1)(h); s 31). The absence of published regulations at any given time can create uncertainty about which jurisdictions participate and what sentences correspond.

Evidence certificates and limited contrary routes

• Certificates from the local or interstate authority stating register matters are treated as evidence, and courts must accept them unless there is contrary evidence (s 30(1)-(5)). Practitioners should ensure register accuracy and be prepared to adduce contrary evidence where necessary. Relying on a certificate without cross‑checking register accuracy risks surprise disputes.

Scope exclusions

• Parole orders and sentence components imposing fines or reparation are excluded from the Act (s 4(2)(a)-(c)). Parties seeking a comprehensive transfer of all sentence components must note that financial penalties and parole supervision are not covered by this scheme.

Appellate rights preserved but not duplicated

• The Act preserves appeals and reviews in the originating jurisdiction (s 24(3)) and provides that any appellate sentence or decision then has effect here (s 24(4)). However, the Act does not give the offender a right of appeal in WA concerning those matters (s 24(5)). Practitioners must coordinate appellate strategy across jurisdictions.

Potential for re‑registration cycles

• The local authority may register a sentence even if the sentence has previously been registered in WA or even if the authority has previously refused to register it (s 20(5)(b)-(c)). This allows for repeat transfer attempts and potentially cyclical administrative processing.

Obligations for clear communication

• The interstate authority must state that the offender has been told, in language likely to be readily understood, about the legal consequences of registration and the differences in breach consequences (s 16(2)(g)). Failure to meet this explanatory duty could become a procedural challenge, particularly where consent is later said to have been uninformed.

Preservation of prior service

• Any part of the sentence served interstate before registration is treated as served in WA (s 24(1)(f)). Accurate records of time served must be provided and accepted; otherwise disputes over credit for time served can arise.

Register corrections and disputes

• Sections 28-29 create an obligation to notify interstate authorities of inaccuracies and a procedure for an offender to challenge entries in an interstate register. However, the mechanism is administrative, not adjudicative, and hinges on cooperation between authorities.

Practitioners should plan file checklists and communications protocols accordingly, especially in matters where penalty regimes differ, where offenders may withdraw consent up to registration, or where the local authority’s discretionary capacity and regulation‑based variability could materially affect outcomes.

Below is a practical compliance checklist and operational steps for each principal actor, grounded in the statutory requirements. This is designed for operational staff in Departments, interstate authorities, supervising agencies, and practitioners advising offenders.

For interstate authorities seeking to register an interstate sentence in WA (sending jurisdiction responsibilities)

1. Prepare a written request that meets form requirements (s 16(1)(a)-(b)):

   • Ensure the request is in writing and states the offender’s name, date of birth, last‑known address and any other particulars required by the WA local authority (s 16(1)(a)-(b)(i)-(iii)).

2. Assemble and certify required documents (s 16(2)):

   • A certified copy of the interstate sentence (s 16(2)(a)).
   • A copy of the offender’s written consent for registration (s 16(2)(b)). Ensure consent is informed and documented.
   • Any relevant pre‑sentence reports held by the interstate jurisdiction (s 16(2)(c)).
   • Any relevant psychological or other assessments (s 16(2)(d)).
   • Details of criminal record and compliance history (s 16(2)(e)(i)-(ii)).
   • A statement explaining parts of the sentence already served in any jurisdiction (s 16(2)(f)).
   • A statement that the authority has explained to the offender, in language likely to be readily understood, the consequences of registration (s 16(2)(g)).
   • A statement of the reasons the offender has given for requesting registration (s 16(2)(h)).
   • Any other documents requested by the WA local authority (s 16(2)(i)).

3. Ensure communication quality:

   • Use plain language when explaining consequences to the offender per s 16(2)(g); retain evidence of that explanation.

4. Be responsive to requests for additional information:

   • The local authority may ask for further materials under s 17; maintain capacity to produce timely responses.

5. Retain the right to update documents:

   • Be ready to supply supplementary assessments or corrections if the local authority identifies inaccuracies (s 28).

For offenders considering transfer

1. Know that consent is required and revocable prior to registration:

   • Provide written, informed consent (s 16(2)(b); s 19(1)(a)).
   • You may withdraw consent at any time before registration by written notice to the local authority (s 18).

2. Understand explained risks and differences:

   • Expect the interstate authority to explain differences in breach consequences and penalties; ask for that in writing (s 16(2)(g)).

3. Be prepared to meet preconditions:

   • The local authority may require proof of residence or other conditions to establish ability and willingness to comply (s 21(2)(a)-(b)). Collect documentation early.

For the local authority (WA Department operational steps)

1. Intake and verification:

   • Verify the request is in writing and includes required particulars (s 16(1)(a)-(b)). Ensure all supporting documents in s 16(2) are present and certified.

2. Information requests and due diligence:

   • Promptly ask for additional information under s 17 if documents are incomplete or further assessment is needed. Keep a log of requests and responses.

3. Apply registration criteria:

   • Evaluate the request against s 19(1)(a)-(d): consent, existence of a corresponding community based sentence under WA law (or regulations declaring correspondence, s 19(2)), ability to comply, and whether the sentence can be safely, efficiently and effectively administered locally.

4. Decision-making and preconditions:

   • Decide to register, refuse, or conditionally register with preconditions (s 20(1)-(3)). If imposing preconditions, give written notice to the offender and interstate authority (s 21(3)). Be precise about time limits and evidence required for preconditions.

5. Delegation and record‑keeping:

   • Use delegation under s 13 to authorise public service officers to exercise functions; maintain clear delegation instruments. Enter registered sentences into the local register (s 22(1)-(2); s 14(1)). Keep a process for correcting mistakes (s 14(2)).

6. Notifications:

   • Give written notice of registration including date of registration to the offender and interstate authority (s 23(1)-(2)). If refusing, give written notice to both parties (s 20(6)).

7. Post-registration supervision:

   • Align supervision and breach handling to WA law and any changes prescribed by regulations (s 24(1)(h)). Maintain communication with prosecution and courts regarding evidence and certificates (s 30).

For courts and enforcement officers

1. Evidence practice:

   • Treat certificates under s 30 as evidence of register matters; accept them if no contrary evidence is adduced (s 30(5)). Where necessary, seek corroborating records.

2. Breach proceedings:

   • Proceed under WA procedural law as applied to the registered sentence; account for the originating jurisdiction’s "relevant penalty" where applicable (s 24(1)(e), (h)).

Record correction and disputes (both local and interstate authorities)

1. Monitor accuracy:

   • If you become aware that interstate register information is inaccurate, inform the interstate authority of the corrections required (s 28(2)-(3)). Include details of any part of the sentence served in WA after request but before registration (s 28(3)(a)) and any outcomes of appeals (s 28(3)(b)).

2. Handle offender disputes:

   • When an offender claims in writing that interstate register information is inaccurate, the interstate authority may send the local authority the claim and an extract from the interstate register (s 29(2)). The local authority must check accuracy and respond with confirmation or corrected information (s 29(3)-(5)).

Regulatory preparedness

1. Follow regulations:
   • The Act leaves important definitions and operational details to regulations under s 31. Ensure staff have current copies of those regulations, and update internal processes if the Governor declares new participating jurisdictions or corresponding laws (s 8(3); s 10; s 19(2)(b)).

Practical checklist summary for a completed registration packet (minimum items based on s 16(2)):

• Written request with offender particulars (s 16(1)(a)-(b)).
• Certified copy of interstate sentence (s 16(2)(a)).
• Offender’s written consent (s 16(2)(b)).
• Pre‑sentence report(s) (s 16(2)(c)).
• Psychological/other assessments (s 16(2)(d)).
• Criminal record and compliance history (s 16(2)(e)).
• Statement of service already completed (s 16(2)(f)).
• Statement that consequences were explained in plain language (s 16(2)(g)).
• Offender’s reasons for transfer (s 16(2)(h)).
• Any other items required by the local authority (s 16(2)(i)).

This statutory checklist aligns with the Act’s mandatory documentary pathway and the operational roles assigned to the interstate authority and the local authority. Implementing agencies should document each step, retain copies of communication with offenders and interstate authorities, and maintain an auditable file to support certificates used in court.
