Sentence Administration (Community Corrections Centres) Notice 2008

The notice uses a small set of formal concepts to accomplish its effect. Those concepts and their legal function in the notice are:

• Declaration of place: Clause 2 is the statutory mechanism by which "a place described in Table 1, 2, 3, 4, 5 or 6 is declared to be a community corrections centre." The legal operation is to convert a named physical location into a place with the legal status of a community corrections centre for the purposes of the applicable sentencing statutory framework.

• Categorisation by table: The instrument organises declared places into six categories: Metropolitan Centres (Table 1), Regional Centres (Table 2), Reporting Centres (Table 3), Remote Aboriginal Community Offices (Table 4), Regional Youth Justice Services (Table 5), and Community Programme Centres (Table 6). These categories are labels within the notice that communicate administrative roles and likely service types. The notice itself does not supply definitions of those roles , rather it groups locations to reflect the way community corrections delivery is structured in practice.

• Specificity and descriptive labelling: Entries vary in precision. Some rows give a full street address with unit or level details (for example, "Central Law Courts, Level 4, 501 Hay Street" in Table 1). Others use descriptors such as "Office Buildings" or "Demountable Buildings" for the building type (see Table 4 entries), or "the place designated by signage as the Broome Adult Community Corrections Centre within: Broome Regional Centre, 7 Barker Street, Broome" (Table 2). The legal consequence is that the instrument may rely on external signs, building designations, or administrative labelling to identify the operative site in practice.

• Revocation of prior instrument: Clause 3 expressly revokes the earlier Order of 2002. That is a standard administrative clean-up: it replaces the previous schedule with the 2008 notice and its subsequent amendments, making the current notice the operative register of centres.

• Amendment and Gazetteing: The compilation table documents the instrument’s amendment history via Gazette notices and amendment notices. The notice is not static; it is designed to be updated through formal Gazette amendments, which the compilation table tracks for practitioners who must verify the current list of declared places.

These concepts together perform a registrational function: the notice is not a code of conduct, a regulation of powers, or a statement of offender duties. It is a formal list that attaches statutory status to premises used for community corrections. The instrument is therefore a building-block of the broader administrative apparatus of sentence administration: it fixes the spatial footprint of community corrections delivery across metropolitan, regional and remote Western Australia.

The notice directly affects the location-based administration of community corrections and therefore a defined set of actors and interests.

• Community corrections agencies and operational staff: Persons and units delivering community-based sentences, supervising orders, or administering rehabilitation programmes will rely on the listed premises as authorised sites for their work. The metropolitan, regional and reporting centres listed in Tables 1-3 are the named operational bases. The instrument places on those agencies the implicit administrative task of ensuring services are available at those declared locations.

• People subject to community-based sentences or orders: Offenders required to report to, attend or receive services at community corrections centres are affected because the notice fixes the legally recognised sites where reporting and supervisory interactions are to take place. The instrument therefore shapes where an offender must present for supervision, programs, assessments, treatment or other court-ordered requirements. The notice itself does not list individual obligations, but it determines the legal identity of the sites where such obligations will be fulfilled.

• Courts, legal practitioners and probationers’ representatives: Courts and practitioners will use the list to specify reporting locations in orders, warrants and sentencing directions. Accurate knowledge of which premises are declared is therefore material to drafting of orders, bail or recognisance conditions that require attendance at a community corrections centre.

• Police and justice agencies: Police, court registries and local justice agencies rely on the declared addresses for operational coordination, service of documents, and for escort or custody arrangements where community supervision intersects with custodial provisions. Reporting centres and remote offices (Table 3 and Table 4) are particularly relevant for local police stations or registries.

• Local property stakeholders: Landlords, building managers and operators of the named premises are affected in the sense that their premises are formally used for government functions. The notice does not create tenancy or lease terms, but the declaration may require the premises owner to accommodate signage, access or shared-use arrangements with the Department responsible for sentence administration.

• Indigenous and remote communities: Table 4 lists a substantial set of remote Aboriginal community offices and maps each to a nearest town and reporting centre. The practical effect is that remote community offices are formally recognised as nodes in the network of community corrections service delivery. This affects community-run resources and local service access points, and implicates transport, cultural liaison and administrative resourcing.

• Youth justice stakeholders: Table 5 identifies Regional Youth Justice Services sites in Geraldton and Kalgoorlie. Agencies, youth justice staff, the courts, community providers and family advocates involved in youth sentencing and supervision will treat those locations as the authorised youth justice service centres.

• Administrators and regulators: The Department that administers sentence administration must manage and maintain the declared list; changes to the list occur through Gazette amendments, as recorded in the compilation table. The compilation table shows a long series of amendment notices, so administrators and external stakeholders (lawyers, magistrates, police) must consult the consolidated instrument or the Gazette history to confirm the current list.

The notice does not directly impose new statutory duties on these groups; rather it modifies the geographic framework within which existing duties, powers and obligations under the Sentence Administration Act 2003 and related instruments are exercised. The practical impact is therefore spatial and administrative: where services are lawfully delivered and where legal attendance obligations can be enforced.

The Notice itself is a declaratory register and does not create detailed procedural duties, penalties or rights. The text is limited to naming and categorising places (cl. 2, Tables 1-6) and revoking the prior order (cl. 3). Consequently:

• The Notice does not specify offender duties or practitioner obligations in the text. It does not, for example, prescribe attendance frequencies, reporting procedures, or supervisory conditions. Any duties and rights that attach to attendance at these locations arise under the Sentence Administration Act 2003, related regulations or court orders, not from the Notice. Users of this instrument must therefore read it together with the principal Act to understand the substantive legal obligations that apply at the declared sites.

• The Notice confers a legal status on premises that enables the exercise of powers and performance of duties provided elsewhere in the statutory scheme. For example, orders requiring attendance at a community corrections centre will be enforceable only at locations that have legal recognition as such. The Notice therefore performs an enabling function: it makes certain premises the legally appropriate loci for the performance of duties that are located in the substantive Act and regulations.

• Rights of access and administrative logistics: while the Notice does not create private rights (such as occupancy or tenancy rights) for landlords or occupants, it establishes an administrative expectation that the listed location is available to the administering agency. Practical rights and duties about access, security, confidentiality, and paperwork handling will be governed by separate administrative arrangements, leases, memoranda of understanding or departmental policies which are outside the Notice text.

• Procedural consequences for courts and practitioners: Courts naming a reporting place in sentencing orders will, practically, refer to the addresses listed in Tables 1-6. This creates a practical duty on courts and registries to ensure the addresses they use accord with the current copy of the Notice. Failure to reference a declared site could create procedural uncertainty about where attendance obligations are to be fulfilled.

• Delegation and signage: some entries operate by reference to signage or a designated part of a larger facility (for example the Broome entry in Table 2: "The place designated by signage as the Broome Adult Community Corrections Centre within: Broome Regional Centre, 7 Barker Street, Broome"). The Notice therefore contemplates delegated administrative identification , the precise place may be pointed to by signage. The administrative implication is that the department or facility manager has the practical duty to ensure signage and on-site designation match the legal register.

In short, the Notice itself is not a source of standalone duties or rights beyond designation. It is a location‑designating instrument whose operational effect is to provide the legally recognised places where the substantive statutory duties and rights under the Sentence Administration Act 2003 and associated subsidiary instruments are to be carried out. Practitioners must therefore consult the principal Act and departmental operational policies to identify the precise duties and rights that apply at the declared centres.

The Notice contains no express penalty provisions and does not itself create enforcement mechanisms. Clauses 1-3 perform citation, declaration and revocation functions and the instrument’s schedule lists physical locations; nowhere in the Notice are offences, sanctions or enforcement processes prescribed. Therefore:

• Enforcement and penalty powers relevant to the activities that occur at the declared centres are to be found in the Sentence Administration Act 2003 and related regulations or orders, not in this Notice. Any compliance failure by an offender (for example, failing to report, contravening a supervision condition), and any sanction such as breach proceedings or imprisonment, will rely on the substantive statutory and court-based mechanisms external to this instrument.

• Administrative non-compliance with the Notice itself (for example, operating a community corrections function at an unlisted site) is not expressly penalised in the text. However, because the Notice identifies the sites authorised for community corrections delivery, operating at a non-declared site may create practical legal and administrative difficulties, including challenges to the validity of orders that specify an incorrect reporting location. The Notice does not itself provide a penalty for such mis-placements.

• Revocation and amendment as the administrative enforcement tool: clause 3 revokes the 2002 Order. The Notice relies on the established public law mechanism of revocation and amendment via Gazette instruments to maintain the legal register. The compilation table shows frequent amendments. Maintaining an up-to-date register via formal amendment is the instrument’s built-in compliance mechanism; the onus is on administrators to apply Gazette amendments so that the declared list reflects operational reality.

• Practical enforcement considerations: the Notice uses signage-based and building-descriptor identification for some entries. If signage is inconsistent with the Gazetteed listing, practical enforcement of reporting obligations may be contested in individual cases. The Notice does not resolve those disputes; resolution requires recourse to the principal Act, court procedures or administrative directions.

In short, the Notice is not an enforcement instrument. It provides the legal addresses at which the substantive enforcement powers of the Sentence Administration Act 2003 are exercised. To understand specific penalties and enforcement processes applicable at these places, the relevant provisions of the Act, regulations and court practice must be consulted.

The Notice is a subordinate instrument linked to the primary sentencing framework enacted as the Sentence Administration Act 2003. While the Notice does not itself recite the enabling provision in its short text, it is titled and published as part of the statutory apparatus connected to that Act (header and compilation table). Its interactions with other laws are therefore principally administrative and spatial rather than substantive. The following interactions are evident from the content and structure of the Notice:

• Complementarity with the Sentence Administration Act 2003: The Notice declares the physical places that are to be used in implementing sentence administration in the community. The substantive powers, offender obligations, licensing of community service programs, monitoring and breach procedures will be provided by the principal Act and regulations. The Notice supplies the geographically specific settings in which those statutory provisions operate.

• Relationship to court orders and sentencing practice: Courts that impose community-based sentences, fines with reporting obligations, community service orders, or supervision orders will rely on the Notice to determine legally recognised reporting locations. The Notice therefore interacts operationally with court practice rules and sentencing forms, which must reference declared centres. Courts will therefore need to ensure that directions to report or to attend a named centre conform to the current Gazetteed list.

• Administrative law and statutory instrument hierarchy: The Notice is a tertiary instrument in the hierarchy of statutory sources. It may be amended by Gazette notices (as tracked in the compilation table). Any conflict between the Notice and primary legislation would be resolved in favour of the primary statute. The Notice’s role is consistent with normal administrative law practice: it implements part of a statutory regime by specifying locations where functions will be performed.

• Interface with property, tenancy and municipal regulation: The buildings and premises listed are physical properties that remain subject to property law, lease terms, local planning and building regulations, and health and safety legislation. The Notice does not displace those regimes; it sits alongside them. In practice, the Department or agency responsible for sentence administration will need to ensure that use of declared premises complies with relevant occupational health and safety, building code, planning approvals and, where relevant, local government bylaws.

• Interaction with policing and justice processes: Reporting centres and entries that are placed within court houses or police stations (for example, Collie Court House in Table 3) create a practical interface with policing and court registry processes. The Notice thus functions alongside police powers, court registry procedures and local justice administrative arrangements, and those operational interfaces will determine how reporting, document service and escalations occur.

• Indigenous community and intergovernmental arrangements: Table 4 maps remote Aboriginal community offices to nearest towns and reporting centres. This mapping implies interactions with Aboriginal community governance structures, remote service delivery funding arrangements, native title considerations (insofar as they affect land use), and other intergovernmental service delivery arrangements. The Notice itself does not alter native title or land tenure, but it designates public service usage of certain community premises.

• Relationship with other statutory notices: The Notice expressly revokes the 2002 Order (cl. 3). The compilation table shows a sequence of amendment notices and corrections published in the Government Gazette. Practitioners must therefore read the Notice together with subsequent Gazette amendments to identify the current legal position.

Overall, the interaction is one of administrative enablement: the Notice provides the statutory spatial coordinates for the implementation of the Sentence Administration Act 2003 and thereby interfaces with courts, police, property law, local government requirements, and departmental operational arrangements.

The Notice has an extensive amendment history recorded in its compilation table. The original Sentence Administration (Community Corrections Centres) Notice 2008 was published and commenced on 8 August 2008. Since then the Notice has been altered repeatedly by formal amendment notices and Gazette insertions. Key points drawn directly from the compilation table:

• Multiple amendment rounds: The compilation table lists amendment notices in 2009 (several), 2010, multiple in 2011, 2012 (several), 2013, 2015, 2016, 2017, 2018, 2019 and an amendment in 2025 recorded as SL 2025/199 (11 Dec 2025). The table shows that some amendments were small (corrections) and others inserted or amended entire tables.

• Timing mechanics: Each Gazette amendment entry in the compilation table records two commencement items: clauses 1 and 2, and the remainder of the Notice, indicating that some initial clauses take effect immediately on publication while other parts commence the following day, as indicated in the compilation table notes (standard drafting form in Gazette notices). For example the 2009 Amendment Notice has cl. 1 and 2 commencing on 28 July 2009 and the rest on 29 July 2009.

• Table insertions and amendments: Specific tables were inserted or amended at different times. The visible schedule annotations show, for instance, that Table 1 (Metropolitan Centres) was inserted in Gazette 8 June 2018 and later amended by SL 2025/199 cl. 4. Table 6 (Community programme centres) is noted as inserted in Gazette 28 Aug 2009 with subsequent amendments on 23 Oct 2009 and 8 Jun 2018. Table 4 (Remote Aboriginal Community Offices) is shown as amended in Gazette 8 Jun 2018.

• Corrections: The compilation table includes an explicit correction entry: Sentence Administration (Community Corrections Centres) Amendment Notice (No. 2) 2019 published 5 March 2019, with a subsequent correction recorded on 12 March 2019 (p. 665). This demonstrates that care must be taken to consult both initial amending instruments and any corrections or later consolidations.

• Revocation: Clause 3 of the Notice revokes the earlier Sentence Administration (Community Corrections Centres) Order 2002. That earlier instrument is therefore no longer operative following the 2008 Notice and its amendments.

• Latest recorded amendment entries: The compilation table records an amendment notice SL 2025/199 dated 11 Dec 2025 and a corresponding commencement note indicating parts of that amendment had commencement dates shortly thereafter (15 Dec 2025 for parts other than cl. 1 and 2). The presence of a 2025 amendment entry in the compilation table indicates the list is periodically updated into the mid-2020s. Practitioners must therefore consult the consolidated instrument as published on the official legislation website or the Gazette history to ensure they rely on the most recent version.

Taken together, the amendment history shows that the declared list is dynamic. Locations have been added, moved between categories, corrected or otherwise modified through formal Gazette notices. Users of the Notice must therefore treat the schedule as a living administrative list and verify, by reference to the Gazette or the consolidated online version, that the addresses they rely upon reflect the current statutory list.

The Notice itself does not record any litigation, and the instrument’s text and compilation table contain no references to court decisions or legal challenges. The compilation table and the body of the Notice record only the text of the schedule and its amendment history. Therefore, from the source provided:

• No cases, proceedings or judicial interpretations are cited in the Notice. The instrument is a register and contains no legal argumentation or contested adjudications to which the document points.

• The Notice does not reference any statutory appeals, declaratory proceedings, or contested administrative decisions concerning the validity of centre declarations. If litigation or judicial consideration has occurred in practice about the use, location or legal effect of declared centres, that material is not present in this instrument’s text or its compilation table.

• Practitioners seeking litigation history relevant to the use of these sites, disputes about the validity of attendance requirements at particular premises, or judicial interpretation of what constitutes a "community corrections centre" for the purposes of the Sentence Administration Act 2003 will need to search court databases, law reports and decisions under the principal Act. The Notice itself supplies no litigation annotations.

• The absence of litigation references in the notice does not imply an absence of disputes in practice; it simply reflects that the Gazette instrument is an administrative list, not a litigation digest. Any contested issues about signage-based identification (for example where the instrument relies on "the place designated by signage") or about the sufficiency of a declared address to support enforcement could become subjects of litigation, but such disputes are not recorded in this instrument.

In short, the provided source contains no litigation history. For case law relevant to how these locations are used in sentencing and breach processes, or about the legal consequences of using an unlisted site, separate legal research in the relevant court archives would be required.

The Notice’s practical utility comes with a set of operational and legal friction points that practitioners, administrators and frontline staff should note. These are derived from the Notice text and the form of its tables.

• Varying degrees of address specificity: Some entries give precise unit and level numbers (for example, "Central Law Courts, Level 4, 501 Hay Street" in Table 1), while others use generic descriptors such as "Office Buildings", "Demountable Buildings" or simply indicate a town and facility name. Generic descriptors may complicate service of documents, directions or operational identification where precise location matters. For remote users, relying on a generic descriptor may require confirmation of which specific building within a community is the intended site.

• Signage-based identification: Table 2 includes an entry described as "The place designated by signage as the Broome Adult Community Corrections Centre within: Broome Regional Centre, 7 Barker Street, Broome." That language delegates part of the place-identification function to onsite signage. If signage is inconsistent with Gazetteed entries, the operative site may be contestable in procedural disputes about where an obligation must be performed. Practitioners should verify onsite signage or departmental confirmation before relying on a signage-based description in court documents.

• Multiple entries for similar towns: The Notice lists multiple entries for the same town that appear to reflect different functions or offices. For example, Karratha has two entries in Table 2 ("2 Bassett Road" and "70 Welcome Road"). Midland appears in both Table 1 and Table 3 at different addresses (Level 1, 52 The Crescent in Table 1; 5 Brockman Road in Table 3). That differentiation suggests that metropolitan/regional centres are distinct from reporting centres; parties must use the correct table and address for the specific purpose (e.g., reporting versus program attendance). Using the wrong address could produce procedural confusion.

• Remote offices mapped to reporting centres: Table 4 lists remote Aboriginal community offices and, in a separate column, the "Nearest Town" and "Reporting Centre". The mapping means that while remote offices are recognised, they are administratively linked to a larger reporting centre. For attendees from remote communities, this can have significant practical implications for travel, escort or how compliance is monitored. The Notice simply records the mapping; it does not resolve funding, transport or culturally-sensitive delivery issues.

• Frequent amendments and corrections: The compilation table records many amendments and corrections. An address that appears current in one publication may have been altered shortly thereafter. Reliance on a non-consolidated copy risks using an outdated address. Practitioners should always check the most recent version of the Notice (or the Gazette entries cited in the compilation table) before finalising orders or directions.

• Functional labels vs legal effect: The table headings (e.g., "Reporting Centres", "Community programme centres") describe likely functions, but the Notice does not define those functions. Users must not assume, based solely on table headings, the scope of services available at a particular site. For example, a "Reporting Centre" might not provide the full range of assessment or treatment services available at a "Regional Centre" even though both are declared community corrections centres. Verify available services with the administering department.

• No operational or resourcing detail: The Notice confers legal status on premises but says nothing about staffing, opening hours, accessibility, security protocols or facilities for privacy. Courts and supervising officers who direct attendance at an address declared in the Notice should ensure the practical availability of services at that location.

• Potential for administrative mismatch with leases or building control: Declaring a public function at premises does not eliminate existing lease obligations, subletting restrictions, or planning approvals that may constrain use. The Notice does not engage with property law. Administrators must ensure lawful occupancy arrangements exist before directing court-ordered attendance at a site.

• Youth justice specificity: Table 5 lists Regional Youth Justice Services at two locations. Youth-specific operational rules, privacy protections and child welfare obligations will be governed by different administrative frameworks. A failure to recognise the separateness of youth services from adult services could lead to procedural and legal errors.

These "gotchas" are not legal conclusions; they are operational points drawn from the text of the Notice about where uncertainty, administrative friction or procedural missteps are most likely to occur. The common remedy is to cross-check the most recent consolidated Gazette version of the Notice, confirm onsite designation or signage, and liaise with the administering department before finalising orders or requiring attendance.

Compliance with the legal regime created by this Notice is largely administrative: ensure that any requirement to attend, operate from or refer to a community corrections centre uses the addresses and table categories as currently declared. The practical steps for different stakeholder groups are set out below.

For courts and legal practitioners:

• Always verify the current form of the Notice before naming a reporting or attendance location in an order. The compilation table shows frequent amendments and corrections; rely on the consolidated legislation database or the Government Gazette cited in the table rather than a local printout that may be out-of-date.
• Specify both the declared location and the table category in orders when necessary (for example "report to the Rockingham community corrections centre, 15B Whitfield Street, as listed in Table 1 of the Sentence Administration (Community Corrections Centres) Notice"), to reduce ambiguity about which site is intended.
• If the Notice identifies the place by signage (for example the Broome entry in Table 2), confirm in court that signage exists and that the registries and local staff can confirm the exact meeting point.

For supervising officers and departmental administrators:

• Maintain a current internal register that tracks Gazette amendments listed in the compilation table. Administrative processes should require sign-off when an address is added, changed or removed, and ensure physical signage and public information pages are updated contemporaneously with Gazette amendments.
• Where an entry is imprecise (e.g., "Office Buildings", "Demountable Buildings"), publish an internal and public clarifying note that identifies the exact building, hours, contact numbers and safe access points. This reduces disputes about where offenders must present.
• Coordinate with property managers, local councils and facility owners to ensure occupancy, lease and planning compliance. Obtain written confirmation that the premises may be used for community corrections functions.

For police and court registries:

• Use the Notice as the authoritative source for locations where documents should be served or where police escort tasks will be arranged. Confirm whether the listed site is a reporting centre (Table 3) rather than a full regional centre, since services and opening hours will differ.
• For remote communities, consult the Table 4 mapping to determine the designated reporting centre and the associated remote office. Confirm whether matters require attendance at the nearest town reporting centre rather than the remote office itself.

For NGOs, community service providers and landlords:

• If a facility is listed, update contracts, MOUs and service agreements to reflect the declared status. Confirm with the Department whether any specific compliance or security requirements attach to hosting community corrections functions.
• For landlords of properties listed in the Notice, ensure that lease arrangements are consistent with the use; if the property was listed without landlord consent or agreement, raise the issue with the Department and seek resolution in writing.

For representation of remote and Indigenous communities:

• Be aware that Table 4 maps numerous remote Aboriginal community offices to a nearest town and reporting centre. If travel, cultural liaison or transport arrangements are required by court order, raise these practicalities in court and ask for orders that account for the logistical realities and costs of attendance.

For all users:

• Treat the Notice as a location register and not as the source of operational rules. To understand the legal consequences of attendance, obligations, breach processes and sanctions, consult the Sentence Administration Act 2003 and relevant departmental operational procedures.
• Where a declared site is changed by departmental decision but not yet Gazetted, do not rely on informal notifications. Only the Gazette amendment (and the consolidated online version) confers legal status. If immediate operational change is necessary, obtain a written administrative direction and seek prompt Gazettal.

Checklist to reduce practical risk:

1. Confirm the current Gazetteed version of the Notice (consult the compilation table and consolidated online legislation).
2. Cross-check the exact table and address before specifying a reporting location in any court order.
3. Verify onsite signage and hours where the Notice uses signage-based identification.
4. Ensure property and lease arrangements permit the community corrections use of a site.
5. Update internal, public-facing and court-facing contact details to match the declared listing.

Following these steps keeps procedural orders aligned with the statutory register and minimises disputes about venue, attendance obligations and administrative confusion.
